Brian N. Miles is indicted on counts of attempted forgery in the second degree, a Class E felony, criminal possession of a forged instrument in the second degree, a Class D felony, criminal possession of stolen property in the fifth degree, a Class A misdemeanor, and criminal possession of a controlled substance 7th degree, a Class A misdemeanor. Miles is accused of attempting to fill out JP Morgan check that belonged to another person in order to obtain cash on Nov. 15, 2021,d while at the ESL Federal Credit Union on Veterans Memorial Drive in Batavia. He was allegedly found in possession of a stolen JP Morgan checkbook. On that date, he was allegedly found in possession of cocaine.

Timothy W. Szurgot is indicted on counts of criminal possession of stolen property in the third degree, a Class D felony and criminal impersonation in the second degree, a Class A misdemeanor.  Szurgot was allegedly found in possession of a stolen 2018 Focus on Oct. 25 in the Town of Batavia. He is accused of assuming the identity of another person on Oct. 25 with the intent to defraud another person.

Joseph G. Bauer is indicted on a felony count of DWI, aggravated unlicensed operation in the first degree, a Class E felony. Bauer is accused of driving drunk while on a suspended license on July 4 in the Town of Darien, on Park Road.

Jacob W. Patterson, 27, of Kilian Road, Pembroke, is charged with criminal possession of a controlled substance, obstructing governmental administration and operating a motor vehicle while impaired by drugs. Patterson was arrested after officers William Yung and John Gombos were dispatched to a gas station on East Main Street on April 24 to check on a report of an intoxicated driver. Patterson allegedly tried to run from officers before being subdued and apprehended.  He was issued an appearance ticket.

Jordan E. Hamilton, 26, of Baker Road, Kent, is charged with tampering with physical evidence and criminal possession of a controlled substance.  Hamilton was reportedly a passenger in a vehicle at a gas station on East Main when Officer William Yung dispatched on April 24 to check on a report of an intoxicated driver. Hamilton was allegedly found in possession of a controlled substance. He was issued an appearance ticket.

Tonya Marie Ficarella, 36, of Lovers Lane, Batavia, is charged with petit larceny. Ficarella is accused of stealing merchandise from a store on Veterans Memorial Drive at 1:44 p.m. on May 2. The Sheriff's Office withheld the name and address of the store. Ficarella was issued an appearance ticket. UPDATE: The Sheriff's Office has released that the location was Walmart.

Jaime Leigh Ayala, 43, of Walnut Street, Batavia, is charged with criminal contempt 2nd. Ayala is accused of entering a store where a protected party worked at 8:28 a.m. on May 2. Ayala was released on an appearance ticket.

Jakob Neale Abrams, 18, of Indian Falls Road, Darien, is charged with DWI, driving with a BAC of .08 or greater, leaving the scene of a property damage accident, driving while using a mobile phone, failure to keep right. Abrams was reportedly involved in a property damage accident at 1:59 a.m. on April 30 on Harper Road, Darien. He was arrested following an investigation by deputies Ayrton Blankenburg and Jeremiah Gechell.

Christopher John Gulczewski, 33, of Thomas Street, Holley, is charged with endangering the welfare of a child. Gulczewski is accused of threatening to kill a mother in front of her children at 3:20 p.m. on May 3 at a location on South Main Street in Elba.  He was held pending arraignment.

Jerrol Paul Newell, 53, of West Main Street, Batavia, is charged with criminal contempt 2nd.  Newell was arrested while incarcerated in Genesee County Jail for an incident reported at 2:29 p.m. on May 2. The nature of his alleged offense was not released by the Sheriff's Office. He was arraigned and remanded back to the custody of the jail.

Auntunez Jaime Antunez, 35, of Dewey Avenue, Batavia, is charged with DWI, driving with a BAC of .08 or greater, failure to keep right and speeding. Antunez was stopped at 11:25 p.m. on May 5 by Deputy Ryan Mullen on Route 33 in Batavia. He was issued and appearance ticket.

Danielle Florance Reed, 34, of Standart Woods, Auburn, is charged with felony DWI, felony driving with a BAC of .18 or greater, speeding, failure to dim lights, and moving from lane unsafely. Reed was stopped at 1:50 a.m. on May 7 on Route 20 in Pavilion by Deputy Zachary Hoy.

Casey T. Vaughn, 33,of East Main Street, Batavia, is charged with harassment 2nd, strangulation 2nd, criminal mischief 4th and aggravated family offense. He is also charged with criminal mischief 4th and criminal tampering 3rd. Vaughn allegedly struck another person and broke a mirror on April 28 during a disturbance at a location on East Main Street, Batavia. That same day, while in custody, Vaughn allegedly spit on a wall, floor, bench, and desk in an interview room at the Batavia police station. He is also accused of pulling molding off the wall.  On the first set of charges, he was ordered held on $10,000 bail. On the second set, he was issued an appearance ticket.

Cassandra F. Smith, 37, of Manhattan Avenue, Batavia, was arrested on four warrants issued by Batavia City Court. Smith was first arrested on April 8 on two counts of petit larceny after she allegedly stole property from different yards on Manhattan Avenue. On April 14, Smith allegedly committed criminal tampering and trespass at a residence on Ross Street by being on the property after being trespassed earlier by police and throwing garbage/other items at the residence.  A warrant was requested.  On April 23, Smith allegedly trespassed again at the residence on Ross Street and was captured on Ring cam.  A warrant was requested. 

Tanika N. Avant, 21, of Bank Street, Batavia, is charged with two counts of harassment 2nd and endangering the welfare of a child. Avant is accused of being involved in a disturbance on April 28 at an undisclosed location and engaging in a physical altercation with another person. During the course of the altercation, he allegedly struck a juvenile. He was arraigned in City Court and released.

James T. Hardaway, 39, of Utica Street, Brockport, is charged with speeding, unlicensed operation, and DWI. Hardaway was stopped on April 30 on Clinton Street, Batavia, by Officer Joseph Weglarski. He was released on an appearance ticket.

Misty R. Scutt, 34, of Exchange Street, Attica, is charged with driving while ability impaired by drugs. Scutt was the subject of a traffic stop by Officer Joseph Weglaski on Jan. 28 in the City of Batavia and arrested on April 28 following the return of a lab analysis of a blood sample. She was issued an appearance ticket.

Hunter M. Passage, 22, of Dellinger Avenue, Batavia, is charged with no headlamps, speed in zone, and driving while ability impaired by drugs. Passage was stopped at a gas station on West Main Street, Batavia, by Sgt. Mitch Cowen on April 27. He was issued an appearance ticket.

A vehicle is off the road, and entrapment and injuries are reported in the area of 9575 Alleghany Road, Darien.

The Town of Darien Republican Committee invites graduating seniors that live in the Town of Darien to apply for a scholarship of $1,000.

"This is a unique opportunity because they can be enrolled in college, trade school or the armed forces," a committee member said. 

There will be two scholarships available, and seniors are asked to complete the scholarship form provided HERE.

Delonta R. Curry is indicted on counts of criminal possession of a weapon in the second degree, a Class C violent felony, and criminal possession of a weapon on school grounds, a Class E felony. Curry is accused of possessing a weapon on school grounds in the City of Batavia on Feb. 22 with the intent to use the weapon against another person.

James J. Santiago Jr., is indicted on one count of failure to register a change of address as a sex offender, a Class E felony. Santiago is accused of failure to notify the NYS Division of Criminal Justice of a change of address within the required 10 days for a registered sex offender in July.

Isaac C. King is indicted on counts of criminal contempt in the first degree, a Class E felony and aggravated family offense, a Class E felony. King is accused of making repeated phone calls to a victim in violation of a court order in December in the Town of Pembroke.

Jarrod K. Fotathis is indicted on counts of grand larceny in the fourth degree, a Class E felony, conspiracy in the fifth degree, a Class A misdemeanor, criminal possession of stolen property in the fourth degree, a Class E felony, petit larceny, a Class A misdemeanor, and unlawful possession of personal identification in the third degree., a Class A misdemeanor. Fotathis is accused of stealing a credit card in the City of Batavia on Sept. 2. He is also accused of stealing cash from the same victim. In a second indictment, Fotathis is indicted on counts of identity theft in the second degree, a Class E felony and petit larceny, a Class A misdemeanor. Sometime on Feb. 3 or Feb. 4, Fotathis allegedly used a person's identity of a second victim to make purchases of $670.77 using that person's debit card. He also allegedly stole an Amazon Fire Stick. 

Jeffrey A. Hewitt is indicted on counts of criminal possession of a weapon in the third degree, a Class D felony, aggravated unlicensed operation in the first degree, a Class E felony, criminal possession of a controlled substance in the seventh degree, a Class A misdemeanor, and driving while ability impaired by drugs. On Sept. 25, Hewitt was allegedly found in possession of a metal knuckle knife. On that date, he was allegedly driving a 2009 Infinity while his driving privileges were suspended or revoked. He was allegedly found in possession of cocaine. 

Rufus G. Johnson is indicted on a count of burglary in the third degree, a Class D felony, and two counts of petit larceny, a Class A misdemeanor. Johnson is accused of entering Walmart at 4133 Veterans Memorial Drive on Oct. 8 with the intent to commit a crime inside the building. He is accused of stealing property while inside the store.

Johnnie M. Waston is indicted on a count of criminal mischief in the third degree, a Class E felony. Waston is accused of damaging the windshield of a 2017 Nissan Murano belonging to another person on July 21.

Jason S. Neth is indicted on counts of unlawful imprisonment in the first degree, a Class E felony, and leaving the scene of an incident without reporting, a Class E felony.  Neth is accused of restraining a person under circumstances that exposed the person to risk of serious physical injury in the Town of Darien on June 11. He is accused of operating a motor vehicle and having caused serious physical injury to another person and leaving the scene.

Driving too fast through a curve is the likely cause of a traffic accident on Simonds Road in Darien at 1:43 p.m. on Tuesday, according to a Sheriff's Office accident report.

Charles Chesley, 52, of Varysburg, the sole occupant and driver of a 2016 Western truck, reportedly hauling manure, was entrapped in the cab of the vehicle and needed to be extricated by crews from Darien, Corfu and East Pembroke.

He was airlifted to Strong Memorial Hospital by Mercy Flight Central.  He is listed in "guarded" condition. At Strong, patients in the Intensive Care Unit are listed as "guarded."

No citations are listed on the accident report, which Deputy Kevin McCarthy prepared.

A manure truck rollover accident is reported in the area of 10067 Simonds Road, Darien.

Darien Fire, Corfu Fire and East Pembroke Fire were dispatched.

Law enforcement on scene requested Mercy Flight on standby.

UPDATE 1:59 p.m.: Mercy Flight Central requested to the scene.  There is a 30-minute ETA.

UPDATE 2:03 p.m.: Patient is alert.

UPDATE 2:37 p.m.: Mercy Flight is on the ground.

UPDATE 2:53 p.m.: DEC is responding though the manure spill is flowing into a field. "No waterways involved."  A heavy wrecker is canceled. The owner is apparently going to take care of moving it.

UPDATE 3:02 p.m.: The patient is being transported to Strong Memorial Hospital.

Two weeks after accepting a plea offer on a rape charge, an Erie County man already serving 13 years in federal prison on related charges was sentenced in County Court today to four years in prison.

The sentence for Nicholas Turnquist, 37, will run concurrent to his federal term as well as a related four-year term out of Erie County.

Neither Assistant District Attorney Will Zickl nor the defense attorney, Joseph Lobosco, made any argument regarding a potential sentence before Judge Melissa Lightcap Cianfrini issued her ruling.

Turnquist didn't make a statement in court and the victim in the case declined to make a statement because she's spoken at previous hearings about the impact of Turnquist's crimes on her life.

A decade ago, Turnquist, who most recently lived in West Falls, reportedly engaged in sexual activity with a minor in multiple jurisdictions, including Genesee County, Wyoming County, Erie County, Pennsylvania and Canada.

He was indicted by a grand jury on counts of rape in the third degree, a Class E felony, and sexual abuse in the first degree, a Class D violent felony, in connection with a crime in Darien on Aug. 23, 2014.  He was arrested locally in 2020 following an investigation by Howard Carlson of the Genesee County Sheriff's Office.

The only real discussion in court today was about a request by Turnquist that Cianfrini order the Sheriff's Office to hold him in Genesee County, instead of returning him to Alleghany County until he's returned to custody in Buffalo. 

Lobosco said his client told him that he's taking several medications. When he gets transferred from one jail or prison facility to another, the administration of his medication gets disrupted, and he wants to keep taking his medication. Cianfrini said she didn't have the authority to order the Sheriff or the U.S. Marshalls on transportation and housing, but she said it was her understanding that the Marshalls were going to pick Turnquist up in Genesee County to return him to federal custody.

A 37-year-old man who once lived in Wyoming County and Erie County, and is already facing 13 years in federal prison on a sex crimes conviction, admitted on Friday in County Court to a rape at Darien Lake Theme Park in 2014.

Nicholas Brian Turnquist, who came into court in an orange Alleghany County Jail jumpsuit, accepted a plea offer that doesn't limit his potential prison sentence on the rape in the third-degree conviction but will allow him to serve the sentence at the same time he serves his sentence in federal prison.

A decade ago, Turnquist, who most recently lived in West Falls, reportedly engaged in sexual activity with a minor in multiple jurisdictions, including Genesee County, Wyoming County, Erie County, Pennsylvania and Canada.

He was indicted by a grand jury on counts of rape in the third degree, a Class E felony, and sexual abuse in the first degree, a Class D violent felony, in connection with a crime in Darien on Aug. 23, 2014.  He was arrested locally in 2020 following an investigation by Howard Carlson of the Genesee County Sheriff's Office.

He was also charged with predatory sexual assault of a child and second-degree rape in Wyoming County.  That case went to trial, but the charges were dismissed halfway through the trial based on conflicting statements made by the victim during her testimony.  The statements related to the timeline of events, which had bearing on her age -- and hence the nature of the criminal charges under New York's penal code -- at the time of the rapes.

The course of rapes involving a single victim started in 2012, when the victim was 14, according to prosecutors, and continue for at least two more years.

Turnquist was sentenced in federal court in November following his conviction for transportation and attempted transportation of a minor with the intent to engage in criminal sexual activity.  He will be on parole for 15 years following his federal prison term.

Our friend Paul Saskowski asked us to take a look at his impressive Christmas light display in Darien, at Harlow and Sumner roads.  Some of his lights came from the light display the DiSalvos used to put up on Fargo Road, so The Batavian made the road trip last night, stopping along the way to take pictures of the lights of other homes.

A country drive on a snow-covered December evening is good entertainment.  Christmas lights aren't just for city folks.  There's a particularly nice stretch along Alexander Road in Batavia where nearly every home on both sides of the road are lit up, and it's almost magical to drive through. A photo couldn't do the stretch justice.

Melvin Andre Huntley, 41, of Wilkenson Road, Batavia, is charged with promoting prison contraband 1st, promoting prison contraband 2nd, and criminal possession of a controlled substance 7th. Huntley was accused of possessing and bringing a controlled substance into the Genesee County Jail at 7:35 p.m. Nov. 16. He was arraigned in City Court and released back into the custody of the jail. Previously: Child sex predator convicted by jury, faces possible life in prison

Brett M. Holt, 32, of West Center Street, Medina, and Kelly M. Holt, 46, of West Center Street, Medina, are each charged with petit larceny. On Dec. 12 at 5:20 p.m., dispatchers received a report of a theft in progress at Sally Beauty Supply on Veterans Memorial Drive. Patrols eventually located two individuals matching the description of the suspects inside of Kohl's Department Store. The suspects were returned to Sally's, where a witness identified them as the individuals suspected of stealing $400 in products. Both suspects were processed at the Genesee County Jail and released on appearance tickets.

Dustin Travis Forkell, 31, of Hulberton Road, Holley, is charged with falsifying business records, 1st, criminal possession of a controlled substance 7th, and criminal impersonation 2nd. Forkell is accused of possessing narcotics while being arrested on separate offenses in the City of Batavia on Dec. 11 at 6:30 p.m. He is accused of attempting to conceal his true identity while being processed at the Genesee County Jail. Forkell was released on an appearance ticket.

Alyssa Michele Harnish, 34, of Main Street Road, Batavia, is charged with criminal possession of a controlled substance 7th. Harnish was arrested on Dec. 14 as the result of an incident reported on Nov. 16 at 9 p.m. at a location on West Main Street Road, Batavia. She was issued an appearance ticket.

Stephanie Lynn Salcido, 33, of Ellicott Street Road, Batavia, is charged with felony DWI, moving from lane unsafely, uninspected motor vehicle, unregistered motor vehicle, and aggravated unlicensed operation. Salcido was stopped on Dec. 15 at 2:38 a.m. on Lake Street Road, Le Roy, by Sgt. Matthew Clor. She is also accused of driving without a required interlock device. Salcido was issued an appearance ticket.

Kevin Quinn Widzinski, 29, of Hubbard Drive, Chili, is charged with DWI, moving from lane unsafely, and speed not reasonable and prudent. Widzinski was arrested by Deputy Zachary Hoy following the report of a motor vehicle accident on Dec. 15 at 7:24 p.m. on Warsaw Road in Le Roy. Widzinski was released on an appearance ticket.

Micahel Gilbert Hoskins, 50, of Rochester, is charged with DWI, driving with a BAC of .08 or greater, driving an uninspected vehicle, and driving with an open alcohol container. Hoskins was stopped on Dec. 4 at 12:10 a.m. on Seven Springs Road, Stafford, by Deputy Ryan Mullen. He was issued an appearance ticket.

Tatiana Makarevic, 55, of Maple Road, Alabama, is charged with DWI, driving with a BAC of .18 or greater, and moving from lane unsafely. Makarevic was stopped on Dec. 15 at 8:48 p.m. on Alleghany Road, Pembroke, by Deputy Jacob Kipler. Makarevic was processed at the Genesee County Jail and released on an appearance ticket.     

Karrie Ann Morrow, 40, of Alexander Road, Batavia, is charged with petit larceny. Morrow on Dec. 14 in connection with a theft reported at 2 a.m., Oct. 11 on Genesee Street, Pembroke. She was issued an appearance ticket.

Arthur James Brown, 48, of State Street, Batavia, is charged with sex offender failure to register a change of address. Brown is to report a change of address within the required 10 days for a registered sex offender. He was arraigned in City Court and ordered held without bail.

Bryan D. McEwan, 36, of Darien, is charged with criminal mischief 4th and endangering the welfare of a child. McEwan was arrested by State Police in connection with an incident reported at 10:10 p.m. on Dec. 18 at a location in Darien. McEwan was released to a third party. No further information released.

About 400 National Grid customers in Genesee County are without power due to weather-related outages.

The largest outage is in Darien with 310 customers without power.

There is an outage along Beckwith Road in Batavia, one in Basom and one in East Oakfield, along with outages that affect five or fewer customers in East Bethany, and Batavia.

East Pembroke was dispatched to Beckwith Road on wires.  National Grid is on scene.

Earlier, Alexander Fire was dispatched to Halstead Road for a wire down and a field on fire.

Savannah can expect to find more snow on the ground in the morning.  A snow band is passing over southern Genesee County now and is trying to push north into Batavia.

Draper is accused of signing a fraudulent bill of sale on June 22 at Pawn Kings on Veterans Memorial Drive in Batavia. He is also indicted on counts of criminal contempt in the first degree, a Class E felony, and harassment in the second degree, a violation.  Draper is accused of violating an order of protection and taking physical action against another person on June 17 at a location on Miller Avenue, Batavia.

Andrew A. Searight and Jerrotonia A. Scarbrough are indicted on two counts of aggravated cruelty to animals under Section 353-a(1) of the Agriculture and Markets Law, a felony.  Both are accused of intentionally killing and causing physical injury to two dogs on May 10.

Dustin M. Locicero is indicted on counts of falsifying business records in the first degree, a Class E felony, burglary in the third degree, a Class D felony, and petit larceny, a Class A misdemeanor. Locicero is accused of signing a fraudulent bill of sale at Pawn Kings on Veterans Memorial Drive, Batavia, on April 26.  He is accused of breaking into a garage on Broadway Road, Darien, on June 5 and stealing a power nailer, an orbital sander, and a battery charger.

Aaron T. Hendershot is indicted on two counts of criminal mischief in the second degree, a Class D felony, and one count of obstructing governmental administration. Hendershot is accused of damaging a City of Batavia patrol vehicle on Sept. 11 and of damaging the tires of a vehicle belonging to a local resident on Sept. 10. He is also accused of intentionally obstructing a public servant from performing an official function on Sept. 11.

Ajie J. Smith-Ezell is indicted on a count of assault in the second degree, a Class D violent felony. Smith-Ezell is accused of intending to cause serious injury to another person and causing serious injury to that person on March 12 in the City of Batavia.

Marcella F. Greene is indicted on a count of driving while impaired by drugs, a Class E felony, of reckless driving, a misdemeanor, and criminal possession of a controlled substance in the seventh degree. Greene is accused of being impaired by drugs while operating a 2003 Dodge on East Main Street and North Spruce Street, City of Batavia, on April 22.

John Saddler, Jr. is indicted on counts of aggravated family offense, a Class E felony, and criminal contempt in the second degree, a Class A misdemeanor. Saddler is accused of violating a court order at 2:33 p.m. on July 10 in the City of Batavia.

Todd A. Kendall is indicted on a count of failure to verify as a sex offender, a Class E felony. Kendall, a registered Level 2 sex offender, is accused of providing a current photograph of himself to authorities in a manner and within a time period required by law.

John C. Hoogasian is indicted on a count of grand larceny in the third degree, a Class D felony. Hoogasian is accused of stealing a 2018 Chevrolet Silverado pickup truck from a location on Oak Orchard Road, Elba, on Sept. 29, 2021. He is also indicted on a count of bail jumping in the second degree, a Class E felony. He is accused of failing to appear in Town of Oakfield Court as ordered as part of a criminal proceeding.

Arthur J. Brown is indicted on a count of failure to register a change of address as a sex offender, a Class E felony. Brown is accused of failure to register a change of address within the required 10 days as a registered sex offender.

Ledeja K. Wright is indicted on counts of burglary in the second degree, a Class C felony, criminal mischief in the third degree, a Class E felony, and criminal tampering in the third degree, a Class B misdemeanor. Wright is accused of entering a residence on Holland Avenue, Batavia, on June 15 with the intent to commit a crime inside the residence. Wright is accused of damaging a television and stereo inside the residence. Wright is also accused of damaging property of another person with the intent to cause substantial inconvenience to another person.

Jeffrey D. Hall is indicted on a count of sexual abuse in the first degree, a Class D violent felony. Hall is accused of subjecting another person to sexual contact by forcible compulsion on May 24 at a location in the City of Batavia.

Joseph D. Krug is indicted on a count of grand larceny in the fourth degree, a Class E felony. Krug is accused of stealing property with a value exceeding $1,000 from a location in the Town of Batavia on Feb. 16.

Jamie M. Cyr is indicted on a count of promoting prison contraband in the first degree, a Class D felony. Cyr is accused of possession of suboxone while confined to the Genesee County Jail on April 16.
