A man arrested for alleged assault during the Lil' Wayne concert Thursday is now also accused possessing cocaine in jail.
David F. John, Jr., 23, of 1248 Lackawana St., Buffalo, was placed into Genesee County Jail on $1,000 bail following an alleged altercation at Darien Lake Theme Park.
During a routine search at the jail, he was found to allegedly possess cocaine.
He has been charged with promoting prison contraband in the first degree.
John was initially charged with harassment and assault.
Bail on the new charge is $5,000.
ok how can somebody be
ok how can somebody be charged for the arresting officer not searching him properly. even though it was wrong the person was probably hoping that if it wasn't found the first time it wouldn't be found but since it was shouldn't the officer take some kind of blame for not properly doing the search?
Amen
Amen
What if it had been a
What if it had been a handgun? I know of 2 incidents where this happened. One guy wasn't even in a cell yet, pulls a handgun from his waistband and shoots himself in the head. The video is all over the web. The other one was a "large" man had a gun hidden in his fat folds and got it into the jail.
I can see how a small amount
I can see how a small amount of cocaine can be missed during a routine pat down at time of arrest. There are also ways to conceal it avoid detection during a pat down, if one thought ahead of such a scenario. The arresting officer didn't do a strip search. He's checking for weapons and whatever might be in pockets and such. I'm not at all surprised the alleged possession wasn't found at the time of his arrest.
Don't assume that the drugs
Don't assume that the drugs were in an area accessible by a standard search. Does the term "crack" cocaine sound familiar. I'm sure you can figure that out.
but its still not the persons
but its still not the persons fault the cop didnt do his job properly like the other post what if it was a gun and he killed another officer. every place should be searched if there going place that kinda of charge on somebody
Jason, if the guy had cocaine
Jason, if the guy had cocaine on his person in jail, he committed the crime. If that's true, he had a responsibility to reveal it at the time of his arrest. He doesn't get off the hook just because the cop didn't find it. Unless you want cops to start strip searching every arrestee in the middle of the street?
i understand that but what if
i understand that but what if he had a razor blade hidden somewhere imagine what he could of done, but with the proper search it all could be avoided. all im saying is charge him for the cocain but not for promoting prison contraband. and if so the arresting officer should hold some responsibility
Finding cocaine on someone in
Finding cocaine on someone in jail is an admission that some level of control within the jail was lost. Who should be responsible for that? I know what my answer is.
Have you ever done a pat-down
Have you ever done a pat-down search of criminal suspect?
