A revised wastewater agreement between the town and city of Batavia may rectify a capacity issue between those two municipalities, however, it came too late for HP Hood’s $120 million expansion project, says Lynne Bohan, group vice president of Communications & Government Affairs for HP Hood LLC.
HP Hood altered its course after being notified that permitting was not approved for the project in the Batavia Agri-Business Park, Bohan said. The expansion was to be 32,500 square feet and was to create 48 new jobs and retain 455 full-time jobs at Genesee Valley Agri-Business Park for a projected local economic impact of $49.87 million in wages and tax revenue.
“Hood implemented a tactical pause on the expansion projects in progress. We remained in contact with local government representatives to gain an understanding of constraints to approving permits,” Bohan said to The Batavian Friday. “Discussions continued regarding project support while we worked on contingency plans. This was not an immediate decision and was just finalized recently as we reviewed our updated business strategy.”
Hood officials opted to expand the scope of “a similar expansion project already in progress at a similar Hood facility on the East Coast,” Bohan said, adding that the company will consider future projects at the Batavia site. “Yes, we have other expansion projects for our Batavia site proposed. Timing is dependent on business needs and appropriate support from the community.”

Tabelski said during council’s Tuesday meeting that the situation had potentially been rectified with a revised wastewater agreement between the town and city of Batavia. She also said that “we will lift the SEQR challenge to the HP Hood project,” regarding a state environmental review.
Genesee County Economic Development Center had approved sales tax exemptions estimated at $4.52 million, a property tax abatement estimated at $549,705 base on an incremental increase in assessed value, and a mortgage tax exemption estimated at $536,000, bringing the value of the proposed financial agreement to approximately $5.6 million.
GCEDC President Mark Masse was not available for comment Friday.
Eight years after acquiring a plant in Batavia originally designed to produce a Greek-style yogurt marketed as such, H.P. Hood has been honored by an industry trade magazine for operating 2024's Dairy Plant of the Year.
The honor follows the company's being named partner of the year for 2020 by Genesee County Economic Development Center and winning an operational excellence award in 2023 by Buffalo Business First.
The award recognizes the 458,000-square-foot H.P. Hood plant for its automation processing equipment, wide array of products it produces, employee safety record, sustainability efforts, and community involvement.
The Lynnfield, Mass.-based company employs 418 people in Batavia.
Hood has installed state-of-the-art technology, including an automated layer and pick system, full pallet labelers, and advanced chiller and air management systems.
Hood has developed an extensive safety plan with regular employee training.
Sitting on 133.4 acres in the Genesee Valley Agri-Business Park, the Hood plant strives to use equipment and processes that are environmentally friendly, including efficient energy use and waste reduction. The company conducts regular energy audits and upgrades infrastructure as needed.
Hood is now among Batavia's larger employers. Community involvement initiatives include supporting the Crossroad House's flower sale, participating in Day of Caring, the Holland Land Office Museum Winter Wonderland of Trees, and supporting the Batavia Muckdogs, Community Action, the Salvation Army, and the Kwians's Club's Books for Babies.
More than 60 percent of the company's employees live in Genesee County.
The city of Batavia has temporarily halted a $120 million expansion project with HP Hood in the town of Batavia due to “violations of the town’s contracted wastewater capacity limit,” and both municipalities are working to rectify the situation, City Manager Rachael Tabelski says.
Tabelski sent the town Planning Board a letter on March 13 notifying the group that the city had not been informed in a timely manner that the town had been established as lead agency for the proposed expansion of process lines at HP Hood on Feb. 13, 2024, and the city did not receive word of that until March 4. The city, therefore, objects to the town acting as the lead agency, Tabelski said.
In addition, ”due to violations of the town’s contracted wastewater capacity limit, the project cannot proceed,” Tabelski said in the letter.
When asked for further comments in an interview, Tabelski said, “As we are in active negotiations with the town regarding a new purchase capacity agreement, I’m going to respectfully decline an interview at this point.”
She did provide the two-page letter sent to the planning board, which includes background about the apparent increased wastewater discharge that was “identified as part of the state environmental quality review (SEQR) for the project application and 2021 SEQR amendment for the Genesee Valley Agri-Business Park.”
“The city was never furnished a copy of the 2021 GEIS (generic environmental impact statement) amendment and is an involved agency,” Tabelski said.
In 1983, the city and town entered into a wastewater facility agreement that outlined ownership and operation of the new treatment plant. In February 2015, they entered into a wastewater facility agreement and a wastewater metering agreement. The city currently owns 84.55% of the total plant capacity, and the town owns 15.45%.
Due to ongoing development in the town, including the Genesee Valley Agri-Business Park, the town’s sanitary sewer flows are exceeding the contractual limit of .85 million gallons per day (MGD) or 15.45% of the total capacity, Tableksi said.
Each city and town resolution in May 2023 identified the parties’ mutual concerns about potential increased flow resulting from the Kings Plaza pump station project, and the average sewer flow was 1.2 MGD. In fall 2023, the town advised the city that HP Hood was expanding but that it was only the warehouse and would not create additional demand for water or sewer capacity. Hood already discharges 1.1 to 1.2 MGD. By the end of 2023, the town’s average sewer flow had increased to 1.33 MGD, Tabelski said.
“This is well in excess of the town’s contractual limit of .85 MGD,” she said. “Consequently, the town has no capacity to allocate to expansion of HP Hood or any other facility at this time.”
The city also cannot permit increased sewer flows from the town of Batavia until the wastewater treatment plan expansion study is complete, she said.
“The city and town still need to enter into a proposed wastewater agreement that was circulated in January 2024. However, this agreement will still not allow for increased discharge beyond 1.2 MGD. This pending agreement will be the town’s limit for wastewater discharge.”
As for its objection to the town being lead agency for the Hood project, Tabelski said that “the town has failed to accurately and timely inform the city about the expansion of wastewater capacity demand at the Ag Park.”
“In addition, the town is in breach of the wastewater agreement with the city by discharging in excess of .85 MGD,” she said. “A lead agent under SEQR is responsible for thoroughly and accurately evaluating the potential environmental impacts prior to making a determination of significance on the action.
“The town’s excess wastewater discharge beyond contract limits threatens the city’s discharge limits and has the potential to exceed the city’s (State Pollutant Discharge Elimination System) permit,” she said. “As a result, the city objects to the town’s lead agency designation for this action under SEQR.”
The Batavian sent questions on Wednesday to Planning Board Chairwoman Kathy Jasinski about why the town exceeded its wastewater capacity and what the town would do to rectify the matter so that it could proceed with the Hood project, which has received the blessings of Genesee County Economic Development for the $120 million expansion.
Jasinski replied on Friday, referring The Batavian to the town engineer. The Batavian has sent questions to Steven Mountain and received an auto-response that he will be out of the office until March 27.

GCEDC’s board recently approved the Hood financial package, prompting The Batavian to ask if the agency was aware of the wastewater situation and request comment about the city’s action to put a hold on the project.
“We are aware that the city and town of Batavia are continuing discussions regarding the current capacity at the wastewater treatment plant as our communities plan for the future,” Director of Marketing and Communications Jim Krencik said. “The GCEDC Board of Directors approved incentives that directly support HP Hood’s warehouse expansion. All IDA incentives cannot be approved until the completion of a project’s SEQR. The non-warehouse project is currently under the SEQR review by the town. Soliciting comments and feedback from interested and involved agencies, such as the city’s letter, is the first step in that process.”
In her conclusion, Tabelski said the city is willing to consider “other mitigation options to decrease wastewater discharge by the town” so that it can remain within the contractual limit.
“Unfortunately, until such wastewater reduction options are implemented by the town, there is no wastewater capacity,” she said.

A Town of Batavia resident and business owner reiterated his objections Tuesday night to a proposed Genesee Biogas plant earmarked for the Genesee Valley Agri-Business Park but, once again, project developers attempted to alleviate his concerns over the smell of its emissions.
Speaking at the Batavia Town Planning Board meeting at the Town Hall on West Main Street Road, Eric Biscaro questioned Lauren Toretta, president of CH4 Biogas, and Sara Gilbert of Pinewood Engineering, about the extent of the odor from the facility, which is set to be constructed on Ag Park Drive, not far away from Ellicott Street Road.
“If you go by O-AT-KA (Milk Products Cooperative) on lots of given days, the odor there is enough to … it’s bad,” Biscaro said. “So, it’s seems that it would be more intense at your place if you’re going to bring it over from O-AT-KA and (HP) Hood and Upstate (Niagara Cooperative). If you’re going to be worse than O-AT-KA, then I’m going to tell you that I’m going 100 percent against this.”
Biscaro mentioned his neighbors on Ellicott Street Road and also those on Shepard Road when he added, “We really don’t want you to do that to us.”
The scene mirrored what played out six months ago when Biscaro, as a member of the Genesee County Planning Board, voiced his opposition to the digester based on the potential odor.
Last night, as was the case in May, Gilbert and Toretta, responded by stating that measures are in place to mitigate the smell as the digester handles sanitary waste primarily from the three Ag Park enterprises.
Gilbert said the digester storage tanks feature a process that is “entirely enclosed,” unlike the system at O-AT-KA that has open air containers where “odors can get into the air and get wind dispersed.”
“It is an enclosed process, it has odor filtration, and we also have an odor mitigation plan that we’ve started to prepare if there’s a breakdown in the process; a way to identify it and rectify it,” she said.
Toretta called the digester, which was first proposed about nine years ago, a “next level” project and a “landmark facility” that comes with numerous technological advances.
Biscaro then brought up the placement of the facility and wondered why it couldn’t be shifted further north on Ag Park Drive, closer to HP Hood and Upstate and farther away from people’s homes.
“This is the parcel that the Ag Park asked us to be on,” Toretta replied, noting that Hood is planning an expansion and has use for more of its property. “We also oriented the site as far from the road as possible, up against the tree line …”
Prior to Biscaro’s comments, Gilbert updated planners on the project, emphasizing that waste from the food processing plants will be shipped to lagoons approved by the New York State Department of Environmental Conservation and not to the City of Batavia wastewater treatment plant.
She said the waste is deemed by the DEC as “good material for fertilizer.”
Gilbert addressed other key points such as making sure the project aligns with federal requirements concerning environmental impact, stormwater treatment, water usage, truck traffic and wildlife protection.
She noted that county planners have recommended approval of a height variance for the storage tanks, and that the next step is to return to the Town Planning Board to take on the State Environmental Quality Review process.

Since opening in 2011, the Ag Park and supporting infrastructure have generated investments of approximately $607 million by HP Hood, Upstate Niagara Cooperative, Marktec Products, and O-AT-KA Milk Products that have resulted in a cluster with over 1.2 million sq. ft. of food and beverage facilities set to employ over 1,000 professionals in the food processing industry, which is the leading employment sector in Genesee County and GLOW region.
HP Hood’s investment also marks another $100+ million project in Genesee County, and the fifth largest in the county’s history, four of which have been announced in just the past year.
These projects include Plug Power’s expansion announced by New York State Governor Kathy Hochul in 2023 in which the company will be investing an additional $377 million on top of the $290 million investment Plug Power announced in 2021 at Western New York Science & Technology Advanced Manufacturing Park (STAMP). Also in 2023, Edwards announced a $319 million project at STAMP and Horizon Acres Associates announced a $142 million multi-phase development in the town of Pembroke.

The GCEDC board will also consider a final resolution from Oak Orchard Solar 3 LLC for a 5 MW community solar farm in the town of Batavia. The $9 million project is projected to generate $4,000/megawatts (AC) annually + a 2% annual escalator of revenues to Genesee County and the Elba Central School District, along with a host agreement with the Town of Batavia.
Empire State Development (ESD) today announced that dairy product manufacturer HP Hood will grow its operations in Genesee Valley Agri-Business Park. The project will include the addition of new processing systems, along with other upgrades, which will allow the company to increase capacity for the production of additional extended-shelf-life (ESL) beverages at the Batavia facility. As a result, the company has committed to creating up to 48 new jobs at the manufacturing facility. To date, the company has created more than 400 jobs at the site and currently employs close to 1200 statewide. Hood purchased the on-site, 363,000-square-foot plant in 2018 from the Dairy Farmers of America for $60 million and soon after expanded the facility by another 100,000 square feet. HP Hood is the agri-business park’s largest landowner.
“This continued commitment from one of the nation's most prominent dairy companies will create top-quality jobs and spur new investment in the Finger Lakes," said Empire State Development President, CEO and Commissioner Hope Knight. ESD is assisting the forward-thinking project with up to $1 million through the performance-based Excelsior Jobs Tax Credit Program in exchange for job creation commitments. The total project cost has been placed at $120 million. Genesee County is also considering providing incentives for the project. Greater Rochester Enterprise also assisted with the expansion effort. Construction on the planned updates is expected to be completed in the first quarter of 2025.

A long-discussed plan to build a biogas plant in the Genesee Valley Agri-business Park in the Town of Batavia is again moving forward with the recommended approval on Thursday of a height variance for a storage tank on the property.
Sara Gilbert, of Pinewood Engineering, asked the board to Genesee County Planning Board on Thursday to recommend approval for the company to build a digester storage tank taller than allowed by zoning code. The biogas plant seeks approval for an 83.5-foot tall digester tank.
Gilbert noted that the board previously recommended approval of the variance for a plant location that was going to be just outside the ag park but the Town of Batavia board prefers the company build the plant inside the park so the application for the variance needed to be resubmitted for the new location in the park.
She also noted that HP Hood was granted a variance for a much taller tank, and Oatka Milk has tanks with heights that do not conform to the zoning code so the Genesee Biogas proposal is consistent with existing construction in the area.
The board approved the recommendation with one no-vote, from Eric Biscaro, who expressed concern about potential odor from the plant.
"I don't care what the height of the tank is, personally," Biscaro said. "I mean, I'm right next to this thing, and I would just as soon get back into that park further because I work at Armor (Building Supply) right down the road from Oatka and Let me tell you, it's pretty ripe there sometimes. And I'm close to this plant, living near there then I am at work. I'm under the impression that this plant is going to smell worse than Oatka."
No, Gilbert said, everything at the plant is enclosed, and the air coming out of the plant is filtered.
"It is different than maybe a more traditional digester," Gilbert said. "It actually has a negative pressure system that can pull the air out and put it through a biofilter system that filters the air. So it does not have a strong smell. And it doesn't have any animal waste at all associated with it. It's only food-grade waste from the plants in the park."
Genesee County Planning Director also informed the board that the only matter on the agenda for Thursday was the high variance. Genesee Biogas will present at a later date a site plan review, where issues such as odor can be considered.
In 2014, at a previous public meeting, Paul Toretta, CEO of CH4 Biogas, explained how the plant works: "We make green power out of organic waste. Once the digester does its thing, it captures methane and powers an engine that makes green power and puts it on the grid. The engine produces heat that can be used to heat Quaker Muller and Alpina (the plants in the park at the time), helping them cut their heating bill."
Quaker Muller's plant is now owned and operated by HP Hood, and Alpina is owned and operated by the Upstate Milk Cooperative.
There just isn't enough room in the Genesee Valley Ag Park on the east side of the Town of Batavia for a project as large as the Fairlife plant announced today in Monroe County.
The 745,000-square-foot facility will be built by Coca-Cola and create an estimated 250 jobs in the Town of Webster. The company is expected to invest $650 million in the project.
Asked if the Genesee County Economic Development Center competed for the project, Jim Krencik, senior director of marketing and communications for GCEDC, said it is against agency policy to discuss what companies might have looked at Genesee County as a possible site location for a facility.
"The huge winners here are the dairy farmers," Krencik said. "Wherever it's located in our region, the dairy farmers are the biggest winners."
When asked a follow-up question, he said with HP Hood and Upstate Niagara Milk Cooperative operating in the park along with planned expansions, the Coca-Cola facility wouldn't fit in the park.
Asked about potential sites in Genesee County for such a facility, he said there could be, but that would depend on available infrastructure, and he reiterated the policy of not discussing negotiations with businesses.
HP Hood is the largest land owner in the Ag Park. Its current facility sits on 80 acres, and the company also owns a 22-acre parcel to the factory's north, and 30-acre and 17-acre parcels to the west. All three of those parcels are currently vacant.
The Coca-Cola project in Monroe County has echoes of another soda company's foray into the dairy business -- when Pepsi Co teamed up with the Theo Muller Group to build a Greek yogurt factory in the ag park. Pepsi and Muller invested $206 million into the project only to close the doors less than three years later.
Pepsi sold the 363,000-square-foot plant to the Dairy Farmers of America for $60 million.
The other failed Greek yogurt project, the plant built by Alpina, is now a dairy processing facility for Upstate Niagara Milk Cooperative.
The big difference, perhaps, between the Pepsi and Coke projects is that Pepsi was trying to start a new business line and enter the emerging and competitive market of Greek yogurt. And the product, some critics pointed out, wasn't really Greek yogurt. Pepsi Muller found it hard to get its products on grocery store shelves.
According to the company's website, Fairlife is an ultra-filtered, flavored dairy drink. The process reportedly removes the lactose and much of the sugar and leaves behind more protein and calcium.
Gov. Kathy Hochul praised Coca-Cola for selecting Monroe County as the location for its new plant.
"This decision by Fairlife to expand their operations in Monroe County marks the next chapter in New York's agricultural success story," Hochul said. "New York's dairy industry serves as a crucial economic engine for our state, and this $650 million investment from Fairlife will create jobs and drive economic impact, particularly in the Finger Lakes."

The GCEDC Board of Directors accepted an initial resolution for La Fermière’s proposed $25 million project to construct a 50,000 sq. ft. yogurt manufacturing facility in the Genesee Valley Agri-Business Park.
The proposed project adds to Batavia’s Dairy Hub of the Northeast, supporting over 900 direct jobs, over $500 million of capital investment, and over 1 million square feet of dairy processing facilities.
La Fermière has pledged to create up to 68 jobs over the first 3 years of operations in Genesee County. Founded in France, the company has been active in US markets since 2018.
“We are ready to move to the next step. The next level for us is to make our very first big investment in the US and building a new state of the art facility here,” La Fermière US Vice President Lucas Praticci said in a presentation to the GCEDC Board.
La Fermière plans to produce French yogurt and dairy dessert products using fresh milk and cream at the facility.
“We have a unique product, and we are very proud to bring this culture and our culture here to the US,” Praticci said.
La Fermière is requesting $1.8 million in property, sales, and mortgage tax assistance. The project is estimated to generate $54.9 million of local economic benefits over 10 years, equal to $43 dollars in economic activity for every $1 of public investment.
A public hearing on the proposed project will be scheduled in the town of Batavia at Batavia Town Hall.
The GCEDC accepted an initial resolution from O-AT-KA Milk Products, LLC for a 3,246 sq. ft. expansion of its existing facility in the town of Batavia.
The proposed $3.5 million investment will house two new 18,000-gallon tanks to increase the capabilities of cream-based liquor beverages. The expansion proposes to create two new jobs.
O-AT-KA Milk Products, LLC is requesting approximately $214,406 in property, sales, and mortgage tax assistance. The project is estimated to generate $3.5 million of local economic benefits over 10 years, equal to $27 dollars in economic activity for every $1 of public investment.
A public hearing on the proposed project will be scheduled in the town of Batavia at Batavia Town Hall.
The GCEDC also approved a final resolution for Apple Tree Acres, LLC. The $3.15 million project will construct a stand-alone 50,000 sq. ft. facility in the Apple Tree Acres business park. Apple Tree Acres, LLC plans to create three new jobs.
Apple Tree Acres, LLC has been granted approximately $490,225 in property, sales, and mortgage tax exemptions. The project is estimated to generate $2.8 million in economic activity, equal to $6 of economic activity for every $1 of public investment.

Governor Kathy Hochul today announced that La Fermière, a family-owned French yogurt and desserts company, will establish its U.S. production operations in New York State. The company has committed to constructing a 45,000 square-foot yogurt and dairy desserts production facility at Genesee Valley Agri-Business Park in Batavia, with plans for future, additional expansion. As a result, La Fermière, expects to create up to 135 New Jobs in the region. Additionally, the company will utilize millions of pounds of milk provided by New York dairy farmers to create its globally renowned dairy products. Agribusiness is a core pillar of the locally designed Finger Lakes Forward plan, a comprehensive plan that is working to revitalize and grow the regional economy.

Empire State Development is assisting this project with up to $1.35 million in performance-based Excelsior Jobs Tax Credits in exchange for job creation commitments. Genesee County, Greater Rochester Enterprise, and Invest Buffalo Niagara are providing support for the company’s growth in New York State. The total project cost has been placed at $25.8 million dollars. The company expects to be operational at the site by November of 2023.
Located in the Town of Batavia, Genesee County, the Genesee Valley Agri-Business Park was developed as the largest food and beverage greenfield in the northeastern U.S. to connect the region’s agricultural production, talent and transportation networks. The 250-acre Ag Park and the surrounding area has become the Dairy Processing Hub of the Northeast, with more than 1 million square-feet of operations and approximately 1,000 workers employed across multiple production and supply chain companies.
Founded in Marseille, France in 1952, the company was purchased by Groupe Tarpinian in 2002. In the mid to late 2010s, La Fermière began working with a New York state-based co-packer in an effort to bring its sustainably packaged French yogurt to the U.S. market. The company had considered site locations throughout the country for its state-of-the-art manufacturing facility but selected New York, thanks to the focused support from both the State and its regional economic development partners.

The third time apparently wasn’t the charm for the Batavia Town Board in its quest to receive visual screening projections from Batavia Solar LLC for a ground-mounted, 1.65-megawatt solar systems on vacant land owned by the Genesee Gateway Local Development Corp. at 99 Med Tech Drive.
The issue has delayed the project, which will be located off R. Stephen Hawley Drive across from Genesee Community College, for several months as planners have requested – thus far unsuccessfully – for the developer to provide projection pictures of the screening around the solar panels.
Planners, at their Tuesday night meeting, took the referral off the table, thinking they would be ruling on a special use permit. But after a discussion about the visuals, they voted to place it back on the table.
The planning board maintains that one-, five- and 10-year simulations of how the property will look with adequate screenings are necessary to ensure the system is out of sight from the neighboring property of Robert and Michelle Wood.
Planning Board Chair Kathleen Jasinski informed the board Tuesday that officials of the Genesee County Economic Development Center contacted her and indicated that the Woods “were agreeable to the (proposed) screening and they wondered if we could deal with this without doing the projection pictures.”
Planner Don Partridge said that he also talked to the couple.
“I feel we can get along without it (projection photos),” Partridge said. “(If)) they do a double row of pine trees there, I think that will be sufficient.”
His colleagues had different ideas, however.
Steven Tanner said he wanted to see how it would look, not only from Hawley Drive, but from other roads in the vicinity, and Jon Long agreed.
“We’ve requested it a couple times so I don’t think it’s that big of a cost to the project,” Long said. “And then we have it on file if there are any problems down the road.”
Paul McCullough said it would set “a dangerous precedent” by not obtaining the documentation, prompting Jeremy Liles to agree, before Town Building Inspector Dan Lang said he didn’t think it would be “appropriate to make exceptions.”
“I would remain consistent with everything we’ve done with every other solar. I suggest that we do require them to show us the actual detail,” Lang said.
As a result, a consensus to get the visualizations was reached, and all members, except Partridge, voted to put the referral back on the table once again.
Rising Water Levels at Ag Park
In another development, planners voted to adopt an amended version of the generic environmental impact statement for the Genesee Valley Agri-Business Park on East Main Street Road in light of an increase in the daily amount of water being used at the facility.
Town Engineer Steve Mountain reported that the current water usage at the park, which is the home of HP Hood, has moved past the original 614,000 gallons per day threshold and that future projections put the usage at 1.8 million gallons per day.
“This is the first project that exceeded the original threshold in the generic environmental impact statement … by a significant amount,” Mountain said.
The project to which he was referring to is HP Hood’s installation of a 16-inch water main from the town line on Route 5 down to the Ag Park Drive entrance that will cross the road and tie into the park.
“That will be a direct connection to the Monroe County Water Authority water source,” Mountain said. “To date, all of the water has come directly out of the city on East Main and Cedar Street.”
Mountain said the reason for the change is “water chemistry.”
“The water authority water is very low in chlorides (low levels of chlorides prevent corrosion) and you can imagine how many pipes there are in the HP Hood facility. That will alleviate a lot of the corrosion issues that they’re having,” he explained.
While that will provide additional volume for the future, HP Hood also is building a new storage tank, which it will own. Mountain said the 16-inch water main will be dedicated to the Town of Batavia.
Mountain said the 1.8 million gallons per day level is the new threshold that is under consideration, adding that letters were sent out to involved agencies and businesses. He also noted that O-At-Ka Milk Products wishes to be included in the mix for more water.
He then advised planners it was up to them to determine whether they think it is a significant impact or a negative or minor impact (negative declaration). The board then voted to adopt a revision of the original finding statements for the Agri-Business Park as it pertains to the expanded water threshold.
The Genesee Gateway Local Development Corporation (GGLDC) Board of Directors approved the sale of 28 acres of land parcels in the Genesee Valley Agri-Business Park at its Feb. 6 board meeting.
HP Hood is purchasing 22 acres and Upstate Niagara Cooperative is purchasing six acres. Both companies have plans to grow and expand their businesses in the Ag Park over the next several years.
HP Hood and Upstate Niagara Cooperative are part of a food and beverage manufacturing hub that has invested more than $500 million into a food and beverage manufacturing hub that including the Genesee Valley Agri-Business Park has more than 1 million square feet of facilities and more than 700 workers.
With the sale of the 28 acres, there are approximately 80 acres remaining in the Ag Park, including a 30-acre site with direct railroad access and a retail-friendly parcel at the park’s entrance on Route 5.
Over the years, Town of Batavia leaders have overseen significant economic development in their municipality and, with that, have had to add professional staff to handle all of the negotiations, inspections, engineering studies and paperwork that comes with it.
On Wednesday night, the Town Board -- realizing that its employees are in need of more space to perform their jobs in a most efficient manner -- voted to contract with a Batavia design firm to provide a floor plan and elevations for a building that would connect Town Hall to the adjacent Town Highway garage at 3833 W. Main Street Road.
“We’ve been looking at this since 2012; even back then we knew we were short of space,” said Town Supervisor Gregory Post following the meeting. “We have three times the staff that we had when the building was constructed (2001-2002) … and now we’re left with a situation where seven employees are working in a room not much bigger than my living room.”
Post said he is expecting to receive renderings from Design & Drafting by Gina LLC, of Seven Springs Road as part of the contract, which calls for the town to pay the firm $60 per hour up to a maximum of $2,500.
He explained that the current building was supposed to have a full basement – which didn’t happen – and “lost 50 percent of its anticipated floor space during construction.”
“This is turning out to be a different concept than originally thought of (a freestanding addition), but we realized that our efficiencies could be enhanced by connecting Town Hall with the highway garage,” he said. “We will save in energy costs and create new office space within the connecting building.”
In other action, the board:
-- Set a public hearing for 7 p.m. Sept. 12 at Town Hall to consider the establishment and construction of a proposed Genesee Valley Agri-Business Park Sewer Improvement Area on East Main Street Road and the vicinity.
Post said that if the sewer improvement area comes to pass, rates would be established fairly by usage, with businesses in the Agri-Business Park (such as HP Hood and Upstate Milk) along with residents within its boundaries sharing in the costs.
The resolution states that the engineering firm of Clark Patterson Lee has already prepared a preliminary map, plan and report for the project, which calls for the installation of larger sanitary sewer pumps, electrical upgrades, installation of a new generator and other improvements.
The Town plans to pay the $400,000 project cost by the issuance of serial bonds -- offset by any federal, state, county and/or local funds received.
-- Voted to pay an additional $37,626 to Keeler Construction for unanticipated work during the construction of a new pedestrian bridge over the Tonawanda Creek as part of the Ellicott Trail Project.
According to the resolution, it was discovered that driving steel piles for the bridge abutment would have required temporary relocation of the overhead electric lines at an estimated cost of approximately $90,000, according to National Grid.
Keeler, to avoid this charge, revised the design to allow the use of drilled king piles to support the bridge at the reduced cost.
Post said work continues on Ellicott Trail, which is expected to open by the end of October.

Upstate Niagara Cooperative announced today that they have completed their acquisition of a yogurt plant located at the Genesee Valley Agri-Business Park in Batavia.
The Western New York-based dairy cooperative had signed a purchase agreement on Feb. 28th to buy the facility from Climb Your Mountain Inc. in a transaction facilitated by Harry Davis & Company.
“We’re very excited to have finalized our purchase of this manufacturing plant in Batavia,” said Larry Webster, CEO of Upstate Niagara Cooperative. “As a dairy cooperative owned by farm families throughout the region, this acquisition is located central to our member milk supply.
"This production-ready facility is only a few years old and represents an investment by our member-owners towards continued and long-term growth for our cooperative. We look forward to adding manufacturing jobs within the Genesee County community while offering additional products and manufacturing capabilities to our customers.”
Exact plans regarding when the plant will reopen and what products will be manufactured at the facility have yet to be announced.
The Upstate Niagara Cooperative is continuing to work with the Genesee County Economic Development Center (GCEDC) on this project. In the last decade, dairy products manufacturing companies have invested more than $500 million into facilities in the Genesee Valley Agri-Business Park and Genesee County has more than 1,500 acres of shovel-ready sites to accommodate additional growth in the dairy, food and beverage industry.

The Upstate Niagara Cooperative and its members were recognized earlier this year by the Genesee County Chamber of Commerce as their 2019 Agricultural Organization of the Year.
