Dustin M. Locicero, 26, formerly of 16 Gibson St., Bergen, is charged with criminal possession of stolen property, 4th, and four counts of identity theft. Locicero, currently an inmate at the Elmira Correctional Facility, is accused of possessing a stolen credit card at the Wilson Farms store, 8132 Buffalo Road, Bergen, on March 18, and allegedly using it to make three separate ATM withdrawls and one merchandise purchase. The investigation was conducted by Deputy Dana Richardson and Investigator Timothy Weis.

Stephen John Farrell, 44, of the Bare Hill Correctional Facility, Malone, is charged with burglary, 3rd, and criminal mischief, 4th. Farrell is accused of using force to enter a Bergen business during the early morning hours of Feb. 11. The entry door was damaged. Farrell was arraigned in Genesee County Court and bail was set at $10,000.

Cody James Sundown, 20, of Sailles Plank Road, Irving, is charged with criminal mischief, 4th. Sundown was arrested on a bench warrant out of Town of Pembroke Court. Sundown is accused of damaging another person's vehicle on Nov. 27.

Matthew Scott Williams, 23, of 21 Maple St., upper, Batavia, is charged with a violation of probation. Williams was taken into custody at 7:47 p.m., Thursday. Williams was wanted on a bench warrant out of Town of Elba Court. He was jailed on $5,000 bail. (For previous arrest reports on Williams, click here.)

A 26-year-old Stafford man apparently had a bad day at the Department of Social Services office and when a security guard told him it was time to leave, he didn't immediately comply.

"The situation became verbal and then it became physical," said Trooper Mark Catanzaro.

The initial 9-1-1 call for assistance came into the Emergency Dispatch Center at 11:14 a.m.

Taken into custody and facing a possible harassment, 2nd, charge is Steven Joseph, who listed an address in Mancuso Heights, off Seven Springs Road, Stafford.

The security guard was checked by Mercy EMS as a precaution, but was not injured, though his jacket was torn.

Joseph did not appear injured either. 

Catanzaro said Joseph was at DSS seeking services, but "it wasn't going well." He became agitated and the security guard suggested he leave and come back another day.

During the confrontation, the guard wrestled Joseph to the ground and held him there until law enforcement arrived.

Catanzaro was first on scene. A city police officer and Sheriff's deputy arrived on scene seconds later.

UPDATE: A reader sent an e-mail saying that Mancuso Heights is actually in the Town of Batavia.

At least eight buildings in Downtown Batavia were tagged with graffiti some time since later yesterday evening, according to police.

The police report doesn't specify which buildings, but the building owners were notified that police officers spotted the graffiti sometime around 2 a.m.

There has been a little tagging of downtown buildings in the past, but this new tagging does not match the previous words/symbols left.

Chief Randy Baker said the police officer wasn't even sure what the message of the tags were.

Baker suggested that anybody who is downtown after dark call police and report any suspicious activity around buildings.

UPDATE: Downtown property owner Ken Mistler is offering a $500 reward for information leading to the arrest and conviction of the tagger.

Anthony P. Dioguardi, 28, a resident of Wyoming Correctional Facility, is charged with four counts of sexual abuse, 1st. Dioguardi is accused of having forcible sexual contact with a child under 11 on two separate occasions in 2006. Dioguardi is currently serving a sentence on a conviction for similar acts, also in 2006. The case was investigated by Det. Kevin Czora, Batavia PD.

Amanda Ann Barclay, 23, of Angling Road, Corfu, is charged with criminal contempt, 2nd. Barclay is accused of remaining in the presence of two people whom she is barred by court order from contacting.

Kenyada R. Peterkin, 29, of Saxton Street, Rochester, is charged with criminal possession of a controlled substance, 7th, aggravated unlicensed operation, unlicensed operation and unlawful possession of marijuana. Peterkin was arrested following a traffic stop by members of the Local Drug Enforcement Task Force. He was allegedly found in possession of crack cocaine and marijuana. Peterkin was jailed on $1,500 bail.

A 17-year-old from Asbury Road, Pavilion, is charged with criminal contempt, 2nd, and harassment, 2nd. The youth allegedly violated a court order by hitting another person during an argument.

Matthew Joseph Dahl, 19, Tinkham Road, Darien, is charged with DWI, driving with a BAC of .08 or greater, driving left of pavement markings in a no-passing zone and inadequate headlights. Dahl was stopped at 2:06 a.m., Saturday, on Tinkham Road, Darien, by Deputy Jason Saile.

Stephen Daniel Golembiewski, 32, of Main Road, East Pembroke, is charged with DWI, driving with a BAC of .08 or greater, driving left of center pavement markings and obstructed rear plate. Golembiewski was stopped at 1:13 a.m., Sunday, on Indian Falls Road, Pembroke, by Deputy Patrick Reeves.

Jenna Alexandra Kavanagh, 18, of Guaymar Circle, Rochester, is charged with unlawful possession of marijuana. Kavanagh was allegedly found in possession of marijuana during a traffic stop on Thursday by Deputy James Diehl.

Brandy Rose Douglas, 31, of South Main Street, Elba, is charged with DWI, driving with a BAC of .08 or greater, aggravated unlicensed operation and driving left of pavement markings in a no-passing zone. Douglas was stopped at 12:17 a.m., Friday, on Chapel Road, Byron, by Deputy Jason Saile.

Tomubari Godswill Gbaraba, 18, of 262 14th St., Buffalo, is charged with rape in the first degree. Gbaraba is accused of having forced sexual intercourse with an 18-year-old victim at College Village. Gbaraba was jailed on $50,000 bail.

Christine A. Woika, 37, of 82 Gilbert St., Le Roy, is charged with reckless endangerment of property and endangering the welfare of a child. Woika is accused of placing a jacket and other clothing in an oven in an apartment and leaving the oven on. The clothes started to burn and if they had caught fire, the fire could have spread causing at least more than $250 in damage. Woika is also accused of allowing herself to become incoherent to the point that she had to be transported to a hospital while she was caring for a 2-year-old child.

John Weston Boddy, 19, of Junction Road, Pavilion, is charged with unlawful possession of marijuana. Boddy is accused of possessing marijuana while on Pavilion Central School property. He was issued an appearance ticket by Deputy Brian Thompson.

A 17-year-old, of Roanoke Road, Pavilion, is charged with unlawful possession of marijuana. The youth is accused of possessing marijuana while on Pavilion Central School property. He was issued an appearance ticket by Deputy Brian Thompson.

Gary Frank Caccamise, 64, of Attica, is charged with unlawful possession of marijuana and drinking alcohol in a motor vehicle. Caccamise was reportedly spotted by Deputy Brian Thompson allegedly drinking alcohol in a motor vehicle. Upon further investigation, Thompson allegedly found Caccamise in possession of marijuana.

Gerald George Ryder, 50, of Bloomingdale Road, Alabama, is charged with criminal mischief, 4th, and harassment, 2nd. Ryder is accused of punching a woman in the head and then smashing her wooden bookcase during an incident at 2:30 a.m., Saturday.

Dylan Allen Barclay, 17, of Lewiston Road, Basom, is charged with criminal sexual act, 1st. Barclay is accused of a criminal sexual act with a child less than 11 years old. 

Robert Jackson, 62, of Robinson Road, Lockport, is charged with DWI, driving with a BAC of .08 and failure to keep right. Jackson was stopped at 7:21 a.m. Wednesday on Lewiston Road, Alabama, by Deputy Brad Mazur.

Robert Paul Leiser, 42, of Lockport Road, Oakfield, is charged with petit larceny and failure to pay a fine. Leiser was picked up on a bench warrant for the petit larceny. He is accused of not paying a fine out of Batavia City Court. Leiser was jailed on $500 bail.

Robert J. Macklem, 21, of 1 Prospect Ave., Batavia, is charged with criminal contempt, 1st. Macklem is accused of violating a "stay away" protection order. A probation officer allegedly found the protected person at Macklem's residence during a routine visit. Macklem was jailed without bail.

Brian D. Leavy, 32, of 10 Cedar St., Batavia, is charged with DWI, driving with a BAC of .18 or greater and speeding. Leavy was stopped at 12:16 a.m. on West Main Street, Batavia, by Sgt. Steve Mullen, Batavia PD.

Burnette McWilliams, 56, of Bartlett Street, Rochester, is charged with criminal impersonation, 2nd, aggravated unlicensed operation, leaving the scene of a property damage accident, unlicensed operation and following too closely. McWilliams is accused of causing a motor-vehicle accident in December in Oakfield. McWilliams allegedly told Deputy Brian Thompson  that her name was Barbara Brown. Upon further investigation, it was determined that McWilliams allegedly provided a false identity and was driving on a suspended license. McWilliams turned herself in to the Sheriff's Office on Monday.

Investigators believe that a fire in Bergen on Monday night was deliberately set. Nobody was injured in the fire.

The fire, reported at 9:10 p.m., destroyed an old trailer and two cars used for parts at Bergen Auto Recycling, 7652 Clinton St. Road.

Deputy Chief Jerry Brewster said investigators don't have much to go on.

"The owner of the yard has no idea of why anyone would do this," Brewster said. "There was scant evidence...a set of snow-covered footprints approaching the RV and then leaving."

Brewster said Jim Bouton of Genesee County Emergency Services determined the fire was likely deliberately set.

Brewster said he was told the trailer was worthless.

"I presume that some type of accelerant was probably used," Brewster said.

Fire departments from Bergen, South Byron and Churchville responded to the scene.

Chelsie R. Dibble is indicted on a felony charge of DWI and a felony charge of driving with a BAC of .18 or greater. Dibble is accused of driving drunk Sept. 19 on Hopkins Road.

No other grand jury indictments were released this week.

Scott Dennis Boyles, 31, of Warsaw Road, Le Roy, is charged with two counts of criminal mischief, 4th, and harassment, 2nd. Boyles is accused of preventing another person from making a call to the Sheriff's Office during an alleged domestic incident. He's also accused of damaging a chair in the residence and having physical contact with the other person.

Randy R. Skrypek, 35, of Cluber Road, Rochester, is charged with DWI and driving with a BAC of .08 or greater. He was arrested following a report of a domestic incident on Fisher Road, Oakfield, at 4:45 p.m., Monday. Skrypek allegedly drove to the location in an intoxicated condition.

A 17-year-old resident of Mechanic Street, Byron, is charged with criminal mischief, 4th. She is accused of forcing a door open, punching a hole in a wall. The youth was jailed on $100 bail.

Amy Lou Platten, 41, of Main Road, Pembroke, is charged with criminal contempt, 2nd. Platten allegedly violated an order of protection.

A third suspect in an alleged fight at the Eagle Hotel in Le Roy on Jan. 23 has been arrested and charged with harassment, 2nd.

Steven Hare, 37, of 9 Washington Ave., Le Roy, was arraigned and released following his arrest.

Hare is accused of shoving another person during the alleged altercation.

Previously charged with assault, 2nd were Thomas B. Streamer, 40, of 28 Grover St., Warsaw, and Thomas W. Sherman, 41, of 108 North St., Le Roy.

One alleged victim was taken to UMMC with with facial, head and shoulder injuries.

If you plan to down a brew or two over Super Bowl weekend, local law enforcement officials hope you'll remember: Don't drink and drive.

To help emphasize the point, the State Police announced they will have extra patrols on roads throughout Western New York and troopers will also man check points at undisclosed locations.

The Sheriff's Office, according to Deputy Chief Gordon Dibble, will also have extra cruisers on the road, though no checkpoints are planned.

The State Police plan to provide increased patrols in hopes that increased visibility and enforcement efforts will ensure that this upcoming weekend will be a safe one for people in Western New York.

Troopers and investigators will also check on liquor stores and taverns to enforce age restrictions on alcohol consumption.

Jorge Alberto Rojas Cazares, 16, of Gully Road, Le Roy, is charged with illegal entry. Cazares came to the attention of the Sheriff's Office while Deputy Joseph Graff investigated the complaint of a person receiving unwanted text messages. The youth was turned over to the U.S. Border Patrol.

Mark H. Poole, 44, of 104 Oak St., Batavia, is charged with endangering the welfare of a child and harassment, 2nd. Poole is accused of being in a physical altercation with a person under 17 years old. Poole was jailed on $750 bail.

Three residents of the West End Trailer Park are accused of beating another resident with a metal baseball bat causing injuries serious enough to send the victim to the hospital.

The three suspects turned themselves in Jan. 22 and were each charged with assault, 2nd.

The alleged beating occurred Dec. 16 at the trailer park, 4016 W. Main St. Road, Batavia.

Charged were Anthony J. Loverdi, 41, Paul A. Loverdi, 42 and Steven L. Maltese, 41.

Anthony Loverdi and Maltese were jailed on $2,000 bail and bail was set at $10,000 for Paul Loverdi.

As many as five individuals, and possibly more, were involved in the altercation, according to the Sheriff's Office.

The victim suffered facial and back injuries.

The investigation was conducted by Deputy Brad Mazur with assistance from Investigator Timothy Weis, Deputy Tim Wescott, Deputy Cory Mower and Deputy Chris Parker.

Thomas B. Streamer, 40, of 28 Grover St., Warsaw, and Thomas W. Sherman, 41, of 108 North St., Le Roy, are each charged with assault, 2nd. Both men are accused of getting into a fight with a 37-year-old Le Roy resident while at the Eagle Hotel on Jan. 23. The alleged victim suffered serious physical injuries to his shoulder, head and face. He was treated at UMMC. Streamer and Sherman were arraigned in Le Roy Town Court and released under supervision of Genesee Justice. Le Roy Police say that further arrests are pending.

Walter Lyle Knickerbocker, 53, of South Street Road, Le Roy, is charged with petit larceny. Knickerbocker is accused of stealing road salt from the DOT salt barn on routes 19 and 20, Pavilion. The alleged theft(s) occurred on and before Jan. 19.

Aaron D. Swimline, 24, of Main Road, Corfu, is charged with a felony count of DWI, a felony count of aggravated DWI (driving with a BAC of .18 or greater), unlawful possession of marijuana, speed not reasonable nor prudent, moving from lane unsafely. Swimline was reportedly involved in a one-car accident at 12:59 a.m., Saturday in the area of 2553 Main Road, Corfu. The accident was investigated by Deputy Howard Carlson.

LaToya Tamika Vialva, 19, of Liberty Street, Batavia, is charged with trespass. Vialva is accused of being on College Village property after being banned from the property.

A Level 3 sex offender accused of committing similar offenses within months of his release from custody entered not guilty pleas in Genesee County Court today to the four counts against him.

Ronald A. Smith, 18, of 679 E. Main St., is charged with failure to register a change of address and three counts of sexual abuses, 1st.

Smith was allegedly living on Thorpe Street when he allegedly sexually abused at least one child. When he moved from Thorpe, he allegedly did not notify police of his correct address.

Smith is being held on $25,000 bail.

Public Defender Jerry Ader will have 45 days to prepare and make motions in the case.

Paul Douglas Marquardt, 38, of Chick Road, Darien, charged with 39 counts of criminal contempt, 2nd. Marquardt is accused of having contact with a person he was barred by court order from contacting. He was jailed on $10,000 bail.

Michael Jason Sullivan, 39, of Hosmer Road, Churchville, is charged with petit larceny. Sullivan was stopped by Gates Police, who discovered there was an active warrant for Sullivan's arrest in Genesee County. Sullivan is accused of stealing scrap metal from Demo's, Clinton Street Road, Bergen.

Matthew Roy Ace, 24, of Vine Street, Batavia, is charged with aggravated unlicensed operation, 3rd. Ace was taken into custody by Batavia Police on a bench warrant and turned over to the Sheriff's Office. Ace was jailed on $100 bail.
