The following arrests were made in connection with the Motley Crue concert at Darien Lake Performing Arts Center on Friday.

Ricky I. McAllister, 24, of 2nd Avenue, Albion, Pa., is charged with trespass. McAllister allegedly refused to leave the concert venue after being told to leave many times. He was jailed on $350 bail.

Ryan J. Vanandel, 25 of Russ Road, Grimsby, Ontario, Canada, is charged with disorderly conduct. Vanandel allegedly urinated in public. He was released on $100 bail. 

Thomas S. Ashby, 27, of Wexford Place, Webster, is charged with harassment, 2nd. Ashby is accused of pushing a security guard while being ejected from the venue. 

Matthew A. Rodak, 38, of Jerico Road, Bergen, is charged with harassment, 2nd. Rodak is accused of shoving a security guard while being ejected from the venue. 

Christopher M. Jensen, 37, of E. Water Street, Waterloo, is charged with trespass. Jensen allegedly entered the concert area after being ejected and told not to return.

Jacob A. Steger, 30, of Buffalo Road, Alleghany, is charged with disorderly conduct. Steger allegedly fought with concert security.

Regy M. Root, 36, of Coneflower Drive, West Henrietta, is charged with trespass. Root allegedly returned to the concert area after being ejected and told not to return.

The following people received citations for allegedly consuming alcohol under age 21.

A domestic dispute in Alexander on Thursday started out as a report of a wife running over her husband with her car and ended for him with a trip to the Genesee County Jail.

Jerod Norcross, 33, formerly of Attica and currently believed to be a resident of West Virginia, suffered a couple of cracked ribs when the side-view mirror of his wife's Toyota struck him, as well as a contusion to his foot when a tire backed over it.

Norcross is accused of taking an unknown object and smashing in the back windshield of the car and cause other damage to the car's body.

After being transported to UMMC by the Alexander ambulance, Norcross was treated and released. Upon release from the hospital, Norcross was arrested by a trooper and arraigned in Alexander Town Court.

He was charged with criminal mischief, 3rd, and jailed on $2,500 bail.

The investigation is ongoing and additional charges are pending, according to State Police Sgt. Sam Taglienti.

The wife was not charged because it's not believed she intentionally tried to hit her husband, Taglienti said. She was reportedly trying to get away from him and he was allegedly trying to stop her.

The type of object that Norcross allegedly used to smash the back windshield has not been determined, Taglienti said. It hasn't been found.

The couple formerly lived in Attica, according to Taglienti, and moved to West Virginia and were in Alexander visiting family.

There is a report of six youths with baseball bats fighting at the intersection of Jerome Place and East Main Street.

UPDATE 12:01 a.m.: First officer on scene, no youths anywhere to be seen.

A man has allegedly been struck by a Toyota in a domestic dispute and he has a leg injury and a couple of broken ribs. The location is 11130 Bowen Road, between Buffalo Street Road and Broadway in Alexander.

Alexander Fire Department and medics are en route.

The female driver is at the Attica Police station and wants to tell her side of the story.

UPDATE 2:06 p.m.: Two State Troopers are now at the scene.

UPDATE 2:24 p.m.: Alexander Ambulance is transporting the victim to UMMC.

Shawn Michael Twardowski, 28, of West Main Road, Batavia, is charged with endangering the welfare of a child. Twardowski is accused of telling an 8-year-old child to get out of a chair. When the child refused, saying she was saving the chair for her mother, Twardowski allegedly grabbed the the back of the chair and forcibly ejected the child from the chair. The child suffered a minor leg injury.

Christopher Michael Smith, 17, of Porter Avenue, Batavia, is charged with two counts criminal mischief, 3rd. Smith is accused of causing more than $250 damage to vehicles parked at 8039 Oak Orchard Road (Godwin Pumps) on Tuesday evening by spray painting the hood and sides of two different utility work trucks. Smith is also accused of stealing a vehicle from 7993 Call Parkway, Batavia (Ashley Furniture) and crashing it into a wall, causing damage to both the truck and the building. Smith was jailed on $10,000 bail.

Brian K, Dyer, 44, of 3 Dewey Ave., Batavia, is charged with felony DWI. Dyer was reportedly stopped at 9 p.m., Tuesday, on Dewey Avenue by Officer Chris Camp. Dyer reportedly has had a DWI conviction within the past 10 years. Following arraignment in Batavia City Court, Dyer was held in jail without bail.

According to Donna McAuley, for 45 years she managed to live her life without ever getting so much as a traffic ticket, and now she has people drive past her house and yell "crack head."

McAuley was arrested July 13, 2010 and accused of being part of a methamphetamine ring that included a dealer from Le Roy now serving more than 17 years in a federal prison.

McAuley was charged, along with four others, of conspiracy with intent to distribute narcotics. She was facing a maximum sentence of 40 years and a $2 million fine.

A few weeks ago, the charges against McAuley, aka Donna L. Boon, were dismissed.  

The Batavian spent a few weeks trying to get an explanation for the dismissal from the U.S. Attorney's office in Western New York and today we managed to contact Brett Harvey, who was prosecuting the case.

Harvey said he can't discuss the specifics behind the prosecution's motion to dismiss the charges because of the ongoing investigation (two defendants in the alleged ring still face charges), but that the case was dismissed "without prejudice."

That means the federal government could refile charges against McAuley, Harvey said.

"We dropped complaint, but have we have leave to pursue additional charges if circumstances warrant," Harvey said.

McAuley's Rochester-based attorney said he doesn't think that's going to happen.

"Donna McAuley's life has been in turmoil for more than a year, including the execution of a search warrant of her home," Robert Napier said. "In the end, the government concluded it does not have sufficient legal basis in which to pursue an indictment before a grand jury. 

"My conclusion," Napier added, "is that the government did not have enough evidence to pursue any charges against Ms. Boon."

According to Napier and McAuley, no drugs were found in her home at Batavia-Oakfield Townline Road when it was searched as part of an early morning raid by local and federal law enforcement on July 13, 2010.

That day, local law enforcement and the DEA and FBI along with Bill Hochul, the U.S. Attorney for Western New York, held a press conference attended by region-wide media. They announced the arrests of McAuley along with Donald G. Vanelli, 47, of 8394 Lake St., Le Roy; David H. Cohen, 49, of 918 Goodman St., Rochester; Andrew W. Chapman, 40, of 5 Cedar St., Batavia; and Kerry A. Ball, 51, of 7202 Meadville Road, Basom.

Vanelli eventually entered a guilty plea. The former Road Agents motorcycle club president admitted to procuring from suppliers and distributing between 5 and 15 kilograms of methamphetamine from 2004 through July 2010.

He was sentenced to 17 1/2 years in federal prison.

The charges against two of the three other defendants are still pending (at time of posting, we didn't have details on which two).

McAuley has admittedly mixed feelings about media coverage of her case being dismissed.

She feels vindicated -- she is adamant that she was not involved in any meth dealing and was not criminally associated with Vanelli, whom she characterized as a friend of 15 years.

She would also just like the case to go away, get her life back and not draw further public attention to her name.

And her name has drawn some attention.

It's been part of media reports every time Vanelli's case has made it through the federal court system.

It came up again when her husband, 62-year-old James Henry McAuley Jr. (aka "Mitch") was charged in a racketeering case stemming from the baseball-bat beating of a man in Rochester more than five years ago and an alleged plot to murder members of a potential rival motorcycle gang.

According to federal authorities, Mitch McAuley, who is currently confined to Elkton Federal Corrections Facility in Elkton, Ohio, on other charges, is vice president of the Rochester Hells Angels.

Donna McAuley said that even with her ties to Mitch McAuley and Donald Vanelli, she herself has never been involved in criminal activity. She has held down respectable, professional jobs for most of her adult life, she said, and she came to Genesee County 15 years ago to establish a reputation for herself as a good citizen.

The case against McAuley was apparently based entirely on wiretaps that recorded conversations between her and Vanelli. FBI agents claimed McAuley and Vanelli used a coded language to arrange for meetings to exchange drugs and/or cash. For example, there was one time when Vanelli, supposedly out of meth to sell, received a call from  McAuley.

According to the transcript, McAuley said, "I, um, what did I want last night, oh geez, I don't know, oh my friggin', I, can you stop by today and check my lawn mower? This mornin'?"

Agents took that to mean that McAuley had acquired a supply of meth.

Vanelli allegedly went to McAuley's house later that morning and when returned to his own home in Le Roy, allegedly arranged for a customer to make a buy.

McAuley said her contact and conversations with Vanelli were never about drugs. There was no coded language. Vanelli was just a longtime friend.

Robert Napier said his client is "an innocent, hard-working professional."

A 39-year-old Ellicott Street resident is in jail following an alleged domestic incident during the early morning hours in which a victim reportedly received cuts to his hand.

Taken into custody was Andrew A. Crimes, of 334 Ellicott St..

The name of the victim, who was transported by Mercy EMS to UMMC, has not been released.

The alleged incident occurred near the intersection of Ellicott Street and Goade Park at 12:21 a.m.

Crimes was charged with assault, 3rd, menacing, 2nd, endangering the welfare of a child, criminal obstruction of breathing or blood circulation and harassment, 2nd.

Following arraignment in Batavia City Court, Crimes was jailed on $5,000 bail.

Call of Duty II is one of the hottest video games on the market, and at least one person in Batavia has a copy that doesn't belong to him.

The game, a version known as Modern Warfare II, was stolen from a residence on Maple Street within the past week, along with an Xbox console and a controller.

The residents were out of town from the July 12 thru 18, returning home early this morning to find that their house had been broken into and the Xbox, controller and game all missing.

Nothing else was touched.

"Sometimes when a report like this appears in the press, a parent or somebody is alerted and they notice a child has something that they can't explain where or how they got it," Det. Pat Corona said.

Someone has reportedly been stabbed on the street, prompting City of Batavia police to respond to a location on Ellicott, just south of Hutchins Street. The victim, an adult male with a laceration to his right hand and middle finger, has just arrived at UMMC via Mercy EMS.

UPDATE 12:55 a.m: The incident may be a domestic situation and the suspect is in custody, according to a police officer.

Mark D. Tooley, 28, of Main Road, Stafford, is charged with a felony count of DWAI-Drugs, felony aggravated unlicensed operation and criminal possession of a controlled substance, 7th. At 2:28 p.m., the Sheriff's Office received a report of a red Dodge Caravan being driven erratically on Westbound Route 33, Bergen. The vehicle was located driving on Route 33 in Stafford and observed crossing a double solid center line and weaving within its own lane. The car was stopped and Tooley was charged with the offenses listed above along with criminal impersonation, 2nd, for allegedly giving a false name and date of birth to a deputy and driving left of pavement markings. Tooley was was jailed on $25,000 bail.

Steven Keith Snyder, 46, of Westside Drive, Chili, is charged with DWI, driving with a BAC of .08 or greater, failure to reduce speed and refusal to submit to breath test. Snyder was arrested during an investigation into a property damage accident reported at 12:02 a.m. Thursday on Walker Road, Darien, by Sgt. Brian Frieday.

Earl Shateek Anthony Lockhart, 18, of East Main Street, Batavia, is charged with petit larceny. Lockhart is accused of shoplifting from Kmart on June 21, but he could not be apprehended that day. He is accused of stealing $54.23 in merchandise. Lockhart was jailed on $1,000 bail.

Jody Blaine Gillett, 50, of Pine Hollow Drive, Batavia, is charged with DWI, aggravated DWI and moving from lane unsafely. Following a lengthy investigation into an accident on Clinton Street Road, Batavia, on Feb. 23, Gillett was accused of driving while intoxicated.

Douglas Paul Cornelius, 32, of Pratt Road, Pembroke, is charged with petit larceny. Cornelius is accused of stealing woodworking equipment from a location on Pratt Road, Pembroke. 

Tyler P. Schroeder, 19, of Lewiston Road, Batavia, is charged with petit larceny. Schroeder is accused of stealing $700 from a residence in Elba on June 3. Schroeder was arraigned in Oakfield because no Elba town justice was available and remanded to Genesee Jail on $3,000 bail.

Earl Shateek Anthony Lockhart, 18, of East Main Street, Batavia, is charged with unlawful possession of marijuana. Lockhart is accused of trying to hand off marijuana he had in his pocket to a girlfriend while in Town of Batavia Court on an unrelated criminal charge.

William Andrew Johnson, 23, of Alexander Street, Rochester, is charged with unlawful possession of marijuana. Johnson was allegedly found in possession of marijuana during a traffic stop at 8:43 p.m., Tuesday, on Route 77, Corfu, by Deputy Patrick Reeves.

John Jeffery McCombs, 23, of Oxford Street, Rochester, is charged with unlawful possession of marijuana. McCombs was a passenger in a vehicle stopped for alleged traffic violations at 8:43 p.m., Tuesday, on Route 77, Corfu, when he was allegedly found in possession of marijuana by Deputy Patrick Reeves.

Nathaniel Michael Dickens, 18, of Broadway Street, Oakfield, is charged with harassment, 2nd. Dickens is accused of striking another person during an incident on July 7.

Deborah A. Schramm, 30, of East Main Street, Batavia, and Michael R. Schramm, 35, of East Main Street, Batavia, are charged with petit larceny. Deborah and Michael are accused of shoplifting at Walmart.

It's a ticket to one of the last hangings in Genesee County and it was last seen hanging in the Holland Land Office Museum in the early 1970s.

It was around that time, maybe a couple of years earlier, that it was apparently stolen.

In 1973, an unidentified couple bought it from a guy selling antiques out of the trunk of his car in Pavilion.

A few weeks ago, the now-elderly couple decided to donate it to the Genesee Country Museum, but the museum director there immediately recognized it as property of HLOM and called up Director Jeffrey Donahue to see about returning it.

A few days ago, Don Read, Bob Turk and Donahue drove to Mumford to recover the framed relic.

The ticket was issued in May 1866 by Sheriff Parley Upton (unknown family connection to Gen. Emery Upton) to Henry Todd, a local newspaper editor. It was donated to the HLOM by Philip Skelton Jr.

The murderer hanged was Levi Mayhew, a veteran of the Civil War who became the lover of another man's wife. The cuckold's wife wanted her husband dead and tried to get Mayhew to poison him, but he wouldn't do it. When she threatened to do it herself, Mayhew decided to kill the husband, Theodore Dunham, himself by beating him to death in Indian Falls.

Mayhew was hanged on May 4, 1866.

The last hanging in Genesee County was apparently 10 years later when Thomas B. Quackenbush was punished for the Dec. 3, 1875 murder of Sarah Norton, also in Indian Falls. He was executed by hanging in August 1876 by Sheriff Ward.

UPDATE: It looks like the last execution was Charles Stockley, hanged on Aug. 19, 1881 at the age of 24. Stockley shot and killed his former boss in a dispute over the man's daughter.

The following arrests were made in connection with the Kid Rock concert at Darien Lake Performing Arts Center on Wednesday.

Richard W. Wilson, 16, of Lemunyan Hill Road. Wilson is charged with assault, 2nd, resisting arrest, disorderly conduct and sale of imitation drugs. Wilson allegedly sold an imitation drug and then fought with deputies. A deputy was injured during the scuffle, suffering numerous cuts on his forearm, requiring several stitches. Wilson was jailed on $20,000 bail. The injured deputy is Youth Officer Chris Erion.

David T. Costrino, 50, of Brown School House Road, Holley, is charged with criminal possession of a controlled substance, 7th, and unlawful possession of marijuana. Costrino was allegedly found in possession of Ecstasy, hallucinogenic mushrooms and marijuana.

Austin G. Costrino, 25, of Brown School House Road, Holley, is charged with criminal possession of a controlled substance, 7th, and unlawful possession of marijuana. Costrino was allegedly found in possession of Ecstasy, hallucinogenic mushrooms and marijuana.

Travis M. Queary, 28, of 7038 Texas Road, Croghan, is charged with arrested for trespass, disorderly conduct and unlawful possession of marijuana. Queary allegedly refused to leave the concert venue after being ejected. He then allegedly caused a disturbance in the campground area and during the investigation of that incident was allegedly found in possession of marijuana.  

Tara M. Victor, 32, of Juniata Place, Buffalo, is charged with criminal possession of a controlled substance, 7th, and possession of a controlled substance not in original container. Victor allegedly possessed a controlled substance in an unmarked bottle with out a prescription.

Joseph G. Marchese, 49, of Ladner Avenue, Buffalo, is charged with harassment, 2nd. Marchese allegedly punched a security guard while being escorted from the venue.

A 17-year-old of Hulberton Road, Holley, is charged with disorderly conduct. The youth allegedly caused a disturbance in the parking lot. The person was jailed on $250 bail.

A 17-year-old of Allen Road, East Concord, was charged with trespass. The youth allegedly returned to the concert venue after being ejected and told not to return.

Kelly L. Prue, 40, of Strathmore Circle, Rochester, is charged with disorderly conduct. Prue allegedly spat on a passing employee.

Burt T. Lyon Jr., 46, of Wehrle Drive, Lancaster, is charged with petit larceny. Lyon allegedly stole a display sign.

A Village of Le Roy resident was arrested early this morning after a brief overnight investigation into a report of a gun being fired into a residence at 36 E. Main St., Le Roy, at 12:05 a.m.

Taken into custody and held on $5,000 bail is Travis J. Hubbard, 21, of Clay Street.

It's not clear why Hubbard fired the gun, described as a shotgun, into the apartment. The circumstances that prompted the incident remain under investigation.

Hubbard was charged with reckless endangerment, 2nd, criminal mischief, 4th, and unlawful possession of marijuana.

The suspect allegedly broke the front door window of the victim's apartment and discharged the shotgun into the stairwell.

Mercy EMS requested to the Pembroke Service Center on the New York State Thruway to evaluate a person reportedly thrown from a moving limousine in the area.

The person reportedly suffered only minor cuts and abrasions.

No word on what law enforcement is on scene, but this would likely be a Troop T (State troopers who patrol the Thruway) call, which we don't pick up on our scanner.

East Pembroke Fire also dispatched as required for an EMS call.

UPDATE 12:49 a.m.: When the East Pembroke chief arrived, he couldn't find the individual. Dispatchers recontacted Thruway authorities and were told that he had gone inside the service center and personnel should ask for a waitress named "Bunny" who could point him out. The chief spoke to personnel at the service center who said the individual walked out. There was also a report of a person walking on the Thruway, but he was spotted two miles east of the service center. "It may be one and the same call," says a dispatcher. There was no law enforcement on scene, but a trooper is dispatched. Now a chief says he has a visual on the subject, "but he wants nothing to do with us."

UPDATE 1:11 a.m.: Troopers on scene. Subject in custody.

UPDATE 1:18 a.m.: Medic with the subject now. Dispatch has received more calls about an apparently intoxicated male walking on the Thruway. Checking on availability of troopers to respond.

UPDATE 1:24 a.m.: Apparently, the two troopers handling the case at the service center are the only two Troop T officers on duty on the stretch of Thruway between Buffalo to Rochester.

UPDATE 1:36 a.m.: Troopers now checking eastbound. East Pembroke chief standing by.

UPDATE 1:57 a.m.: The pedestrian subject has been located. No medical assistance needed. East Pembroke back in service.

A resident in the area of East Main Street and South Street in Le Roy has reported he and his family were awoken by the sound of a gun shot.

Upon investigation, the resident says a bullet apparently entered the apartment through a window and lodged in a wall.

There is no suspect description available.

Nobody was injured by the shot.

Le Roy Police are responding.

Members of the Local Drug Enforcement Task Force have reportedly seized about $3,000 in cocaine after executing a search warrant against two individuals suspected of dealing drugs.

Taken into custody and jailed without bail were Edward J. Fuller (aka "Taz"), 21, of Parsells Street, Rochester, and Alex S. Dumbleton, 18, of Washington Avenue, Batavia.

Both are charged with two counts of criminal possession of a controlled substance, 3rd.

Task Force members executed the search warrant late Tuesday night by initiating a traffic stop on a vehicle occupied by Fuller and Dumbleton. The stop was made on Ellicott Street.

A search was conducted of the car and of a residence on Jackson Street.

The pair were allegedly found in possession of more than an ounce of cocaine with a street value in excess of $3,000.

Assisting in the arrest were the District Attorney's Office, Batavia police officers and Sheriff's deputies.
