Aaron J. Wood, 20, of Iroquois Road, Caledonia, is charged with petit larceny. Wood is accused of unwrapping and eating a $3 pizza while in the Tops Market in Le Roy. Wood allegedly tried to leave the store without paying for the pizza.

Joseph Dennis Vendetta, 30, of Tracy Avenue, Batavia, is charged with DWI, driving with a BAC of .08 or greater, tinted windows and driver's view obstructed. Vendetta was stopped at 2:21 a.m., Saturday, on Richmond Avenue by Deputy Patrick Reeves.

Billy Joe Budziszewski, 20, of Alleghany Road, Corfu, is charged with criminal possession of a weapon, 3rd, and criminal mischief, 4th. Budziszewski is accused of getting into a dispute with his father Friday morning. During the dispute, Budziszewski allegedly became verbally abusive and punched the kitchen wall and front door, causing some damage during the argument. Budziszewski also allegedly had a pair of metal knuckles in his bedroom dresser.

Luis Geraldo Pacheco, 49, of Webster Avenue, Rochester, is charged with three counts of criminal contempt, 2nd. Pacheco is accused of violating a stay away order on three separate occasions.

Melvin Gaylord Draper, 30, of Webber Avenue, Oakfield, is charged with felony DWI, aggravated DWI (BAC of .18 or greater), aggravated unlicensed operation, 1st, and improper signal. Draper was stopped at 12:47 a.m., Saturday, on Bank Street Road, Batavia, by Sgt. Brian Frieday.

Gene Robert Schmidt, 44, of Dodgeson Road, Alexander, is charged with DWI, driving with a BAC of .08 and failure to keep right. Schmidt was stopped at 1:33 a.m., Saturday, on Bowen Road, Alexander, by Deputy Jason Saile.

Trent H. Burgess, 39, of West Avenue Brockport, is charged with DWI, driving with a BAC of .08 and speeding (89 mph in a 55 mph zone). Burgess was stopped at 12:26 a.m., Sunday, on Clinton Street Road, Stafford, by Deputy Howard Carlson.

Brian James Nelson, 24, of Grove Street, Painted Post, is charged with DWI, driving with a BAC of .08 or greater, failure to keep right and driving left of pavement markings in a no-passing zone. Nelson was arrested following the investigation by Deputy Jason Saile into a one-car accident at 6:04 a.m., Sunday, on Route 77 in Darien. 

Daniel L. Cone, 51, of 6380 Clinton St. Road, Bergen, is charged with DWI, driving with a BAC of .08 or greater, speed not reasonable and prudent, following too closely and moving unsafely from lane. Cone was stopped at 5:55 p.m., Saturday, on East Main Street, Batavia, by Officer Dan Coffey.

Lawrence D. Williams, 51, of 148 Hutchins St., Batavia, is charged with criminal possession of a controlled substance, 7th. Williams was allegedly found in possession of a small quantity of cocaine following a traffic stop.

Scott G. Tooley, 26, of 199 S. Main St., Batavia, is charged with endangering the welfare of a child. Tooley is accused of leaving a young child at home without adequate supervision.

Following an investigation into an alleged assault of a 14-year-old at a party on Cleveland Road in Pembroke on Aug. 23, a Portageville man is facing two felony charges.

Arrested on Oct. 21 was Joshua J. Ebersole, 25, of State Route 19A, Portageville. Ebersole is charged with strangulation, 2nd, and assault, 2nd.

He was jailed on $10,000 bail.

Also charged was David M. Snyder, 25, of Genesee Street, Warsaw. Snyder is charged with assault, 3rd, a misdemeanor.

The case was investigated by Deputy Jason Saile and Investigator Roger Stone.

Catherine R. Bater, 20, of 112 Lake St., Le Roy is charged with grand larceny and endangering the welfare of a child 1st. Bater was arrested by Le Roy Police on two separate cases. In the first case, Bater is accused of stealing a laptop computer, digital camera and multiple DVDs from a residence on Lathrop Avenue on or about Sept. 25. The camera and computer were recovered. In the second incident, Bater is accused of switching out a prescription of generic Ritalin belonging to a juvenile with high blood pressure medication (Clonidine). The switched medication was subsequently administered to the juvenile causing the youth to lose consciousness. Batar was arraigned and jailed on an unspecified amount of bail.

Eric Bratcher, 22, of 7 1/2 North St., Le Roy, was arrested on a bench warrant. Batcher is accused of violating the terms of his release under supervision contract. Bratcher was originally charged Oct. 16 with burglary, accused of breaking into a Gilbert Street residence and stealing a video game system and games. Bratcher was jailed on an unspecified amount of bail.

Uriah Ian Charles Smoke, 26, of Bloomingdale Road, Basom, is charged with reckless endangerment, 2nd, and criminal mischief. Smoke is accused of throwing a glass coffee mug at a minivan while his girlfriend and their child were in the van. The impact caused the glass of the sliding door window to shatter, spraying the infant with glass. The infant was not injured.

Andrew Joseph Lennox, 23, of Webber Avenue, Oakfield, is charged with trespass. Lennox is accused of being on College Village property after being banned from the property.

An Oakfield man already accused of other thefts is facing new burglary and larceny charges following an investigation by Sheriff's investigators into a recent series of crimes in the Oakfield and Elba area.

Benjamin W. Muntz, 22, of 6966 Knowlesville Road, Basom, is being charged with burglary, 3rd, grand larceny, 3rd, and petit larceny.

Muntz is already being held in the Genesee County Jail on a third-degree burglary charge.

Investigators suspect Muntz of stealing an ATV, a dune buggy and a dirt bike from a residence in the Town of Oakfield between June 20 and June 26. The value of the three vehicles is reportedly more than $2,500.

He's also suspected of stealing a large quantity of tractor weights from a location in Elba between Aug. 1 and Sept. 7 with a total value of more than $8,000.

Muntz is also suspected of stealing tractor weights from outside a building in Alabama around Sept. 1 with a value of about $500.

The ATV, dune buggy and dirt bike have been recovered, officials report, but they believe the tractor weights were sold for scrap metal.

In early September, Muntz was arrested and accused of entering a barn in Alabama and stealing a small child's dirt bike. He's also been accused of trespassing and attempting to steal items from a property in Byron.

On the two new felony charges, Muntz was ordered held without bail.

A young woman worked an agreement with Jeremy Almeter, owner of Glass Roots on Center Street, to avoid criminal charges after she was caught on video making an art heist from the shop. The woman walked out the front door with two paintings on the very first day Almeter was using a video surveilance system installed by Rich Clark of Computer and Phone Repair (CPR). Almeter and the woman made an agreement not to release her name. She walked in front of the store for two hours today carrying the sign reading "I stole art from Glass Roots."

Jeremiah T. Jones, 38, of 535 McGinnis Road, Scottsville, is charged with criminal obstruction of breathing or blood circulation and harassment, 2nd. Jones was allegedly involved in a domestic dispute at a residence on Central Avenue at 8:10 a.m., Tuesday.

Kara Jo Oliveri, 27, of Moller Street, Binghampton, was arrested on a bench warrant related to a petit larceny charge. Oliveri was arrested in Binghampton and arraigned in Darien Town Court. Oliveri posted $305 bail.

Jason Michael Norton, 39, of Pekin Road, Oakfield, is charged with grand larceny and petit larceny. Norton is accused of stealing money and giving discounts on store merchandise under retail value while employed at Lowe's. The total value of the alleged thefts exceeds $1,800.

Joseph Charles Wind, 41, of Horseshoe Lake Road, Batavia, was arrested on a bench warrant. Wind was arrested by Rochester Police on a warrant out of Batavia City Court and turned over to the Genesee County Sheriff's Office. Wind was jailed on $100,000 bail. The nature of the underlying alleged crime was not released.

A Le Roy resident has been arrested and charged with using marijuana and cash to pay for unspecified sexual acts.

Taken into custody is Thomas J. Hutton, 28, of 92 Lake St., #2, Le Roy.

Hutton is charged with criminal sale of marijuana, 5th, unlawful possession of marijuana and patronizing a prostitute.

Hutton was jailed on $1,000 bail.

The charges follow an investigation by Le Roy Police into an allegation that Hutton paid a third party cash and marijuana for the performance of sexual acts.

A search warrant was executed on Hutton's residence with the assistance of the Genesee County Sheriff's Office, which allegedly led to the discovery of marijuana at the residence.

There's been an increase in home burglaries and overnight vehicle break-ins in the Oakfield and Alabama area, according to Chief Deputy Jerome Brewster.

Some of the burglaries may be related and there is at least one person whom investigators suspect being involved in several -- but not all -- of the thefts.

Items ranging from jewelry and electronics to cars and motorcycles have been stolen during the spree.

"Business is kind of booming out that way," Brewster said.

In Alabama there's been a pair of daylight burglaries that investigators think are connected because of the type of items stolen, the similarity between the houses and the close proximity to each other.

Other burglaries include:

    -- a garage on Drake Street, where a pipe wrench was stolen;
    -- homes on Galloway Road and Fisher Road, both with televisions, cash and other items stolen;
    -- a pair of dirt bike thefts on Oak Street and Cary Street in the Village of Oakfield;
    -- a pick-up truck, also stolen in the village, on Mill Street;
    -- and copper stripped and stolen from a home across from Oakfield-Alabama Elementary School on Route 63.

It's likely, Brewster said, that local thieves -- in addition to the one person already a person of interest -- is involved in these larcenies.

A local resident whose car was broken into over night called The Batavian and wondered why the Sheriff's Office isn't increasing patrols in the area.

Brewster said that approach isn't really productive. Unless a deputy is super familiar with a neighborhood, he might not spot cars or people who are out of place.

"That's why it's so important that people call us if they see something suspicious," Brewster said.

Brewster said if a resident sees an unfamiliar car drive down a street and drop somebody off, or if a garage door has been left open, for example, it's a good idea to call the Sheriff's Office (343-5000).

Joshua Ray Radley, 25, of Old Meadow Lane, Batavia, is charged with unlawfully growing cannabis, unlawful possession of marijuana and unlawful possession of fireworks. Radley was arrested following an investigation into a complaint filed on July 27.

Loralyn L. Bateman, 35, 874 Gabbey Road, Corfu, is charged with driving while ability impaired by alcohol. Bateman turned herself in at Batavia PD on a warrant out of Batavia City Court.

Michael A. Witkop, 19, 249 Ross St., Batavia, is charged with DWI, aggravated unlicensed operation and improper right turn. Witkop was stopped at 12:38 a.m., Sunday, on River Street, Batavia, by Officer Darryl Streeter.

Brian M. Raphael, 23, of 4 Noonan Drive, Batavia, is charged with aggravated DWI, moving from lane unsafely and improper turn. Raphael was stopped at 1:09 a.m., Saturday, on Liberty Street, Batavia, by Officer Marc Lawrence.

Peter J. Kaiser, 50, of Jackson Road, Middleport, is charged with driving while ability impaired by alcohol, failure to stop for stop sign and speed not reasonable and prudent. Kaiser was charged following an investigation into a traffic accident that occurred Sept. 16 on Lockport Road, Alabama.

Rusty Everett Vanson, 46, of Jefferson Street, Attica, is charged with felony DWI, driving with a BAC of .08 or greater and driving left of pavement markings in a no-passing zone. Vanson was stopped at 12:57 a.m., Sunday, on Attica Road in Alexander by Deputy Jason Saile.

Eric Michael Duda, 49, of Main Road, Stafford, is charged with criminal contempt, 1st. Duda allegedly asked a third party to contact a person he is barred by court order from contacting. He has a previous conviction for criminal contempt, 2nd, within the last five years. Duda was jailed on $5,000 bail.

David Michael Johns, 46, of East Street, Gainsville, is charged with grand larceny, 4th, falsifying business records, 1st, and petit larceny. While employed at Kistner Concrete Products, 10056 East Road, Bethany, Johns allegedly loaded merchandise valued at more than $1,100 into a customer's vehicle and failed to turn in funds to the business from the transaction. Johns is accused of falsifying a packing slip and turning it over to his supervisor in an attempt to account for reportedly missing merchandise. In a separate incident, Johns is accused of loading merchandise into a customer's vehicle with a value of $150 and failing to turn funds over to the business.

Joseph James Lloyd, 40, of 100th Street, Niagara Falls, NY, is charged with grand larceny, 3rd. Lloyd, operating as M. Franklin Home Improvement, Inc., is accused of accepting a payment of $15,000 from a Town of Pembroke resident in October 2010 to build a garage on her property, but Lloyd allegedly failed to use any of the money towards the project.

Matthew C. Higgins, 29, of 2823 Graney Road, Caledonia, is charged with felony DWI. Higgins was taken into custody by Le Roy Police after a concerned citizen initially reported an occupied vehicle parked in the driving lane of Perry Road just south of Route 20. When the citizen approached the vehicle, the driver took off north on Perry and continued into the village. A car reportedly driven by Higgins was stopped on East Main Street in the village after allegedly failing to keep right. Higgins was jailed on $5,000 bail.

Seokjoon Suh, 25, of Batavia Stafford Townline Road, Batavia, is charged with criminal possession of a weapon, 4th. Suh is accused of possessing a collapsible baton while at College Village.

Cody James Sundown, 21, of Skye Road, Tonawanda, was turned over to the Genesee County Sheriff's Office by the Niagara County Sheriff's Office on a bench warrant out of the Town of Pembroke for criminal mischief, 3rd. Bail was set at $750 or $5,000 bond.

Robert Lee Williams, 21, of State Street, Batavia, is charged with criminal contempt, 2nd. Williams is accused of violating an order of protection by going to the place of employment of the protected party. The order specifically barred Williams from going to that business location.

A man with ties to both Wyoming and Genesee counties, who is wanted in Florida, may be in the area according to the Genesee County Sheriff's Office.

A car from Florida that may have been brought to the area by Michael Jay Finch was located Tuesday in the Village of Wyoming.

The car was reported stolen in Florida.

Finch is wanted on a battery by strangulation charge by the Manatee County Sheriff's Office.

The 32-year-old Finch is described as 5'6" tall, 180 lbs., with a shaved or bald head.

Finch should be considered dangerous, the Sheriff's Office said.

Anybody with information about Finch should call 9-1-1 immediately.

UPDATE: According to Sheriff Gary Maha, Finch has been taken into custody. Finch was spotted by a Wyoming County Sheriff's Deputy exiting a cemetery in the Village of Wyoming. At the time of his arrest, Finch allegedly possessed a kitchen knife and pepper spray.

A driver involved in a single-car accident shortly after 2 a.m., Tuesday, that destroyed a telephone pole on South Jackson Street has been charged with DWI.

David M. Hagen, 23, of 22 Williams St., Batavia, faces additional charges of failure to keep right, passing a stop sign, leaving the scene of an accident and unlawful possession of marijuana.

Police located Hagan at his residence after he fled the scene on foot. When he returned about 15 minutes later, he immediately started picking up some sports equipment that had been thrown from the car. He told an officer, "I didn't think I was going that fast, but I guess I was."

Hagen, who complained of back pain and was transported to a hospital by his mother, was arrested by Officer Eric Dibble once Dibble completed his investigation.

Following arraignment in Batavia City Court, Hagen was released and is scheduled to reappear in court on Nov. 9.

John M. Forte, 23, of 4898 Ridge Road, Williamson, is charged with burglary, 3rd. Forte is accused of forceably entering a business in the Village of Le Roy on or about Nov. 8 and stealing copper from the basement of the building.

Eric Bratcher, 22, of 7 ½ North St., Le Roy, is charged with burglary, 2nd, and petit larceny. Bratcher is accused of entering the residence of a friend over the weekend and stealing a game system and games. Bratcher was arraigned and released under supervision of Genesee Justice.

Marianne Dawson, 50, 20 N. Spruce St., Batavia, is charged with DWI. Dawson was charged with DWI. Dawson was arrested at 5:18 p.m. Monday on Seneca Avenue by Officer Kevin DeFelice.

A 16-year-old resident of Snipery Road, Darien, is charged with criminal contempt, 2nd. The youth got into an argument with her parents about getting ready and going to school. She allegedly became verbally abusive and threw an item at her father. Family Court had issued an order of protection requiring her not to engage in offensive conduct toward her parents. The youth was released after arraignment and transported to school.

Darleen Angie McComb, 53, of Lake Street, Le Roy, is charged with petit larceny. McComb is accused of stealing a $30 pair of boots from R and D Outlet Center on Clinton Street Road, Stafford.

Basillo Martinez, 48, of Clinton Street Road, Bergen, was arrested on a bench warrant for alleged criminal possession of stolen property and criminal possession of a weapon.

Jeffrey Allen Good, 36, of Route 98, Alexander, is charged with criminal possession of a controlled substance, 7th, criminal use/possession of a hypodermic instrument and criminal use of drug paraphernalia. Good was allegedly found by his probation officer in possession of heroin in packaging along with hypodermic needles while in his home. Good was taken into custody by Deputy Brian Thompson. Good was jailed on $5,000 bail.

John Cheston Townley, 36, of Liberty Street, Bliss, was arrested on a bench warrant for DWI. Townley had been incarcerated on unrelated charges in Wyoming County.

A Mercy EMS ambulance is being dispatched to the scene of an alleged attempted burglary where the would-be female burglar reportedly fell and hit her head.

She is semi-conscious.

Batavia PD is just arriving on scene at the Seneca Avenue residence.

Batavia PD responded to a 9-1-1 call this morning reporting a domestic disturbance at 110 Walnut St. and when officers arrived, one of the people allegedly involved in the disturbance fled the scene.

The subject was seen heading into the woods behind the house.

Joshua A. Harris, 22, of no permanent address, was taken into custody by Batavia officers after a short pursuit. Deputy Brian Thompson and his K-9 "Pharoah" assisted in the search.

Harris was wanted on three warrants related to charges of criminal contempt, 2nd.

This morning Harris was charged with obstructing governmental administration and resisting arrest.

Theodore Murphy, 51, of 29 Central Ave., Batavia, is charged with criminal possession of a weapon, 3rd. Murphy is accused of possessing an electronic stun gun on Sept. 25 while on Central Avenue. Murphy was jailed without bail.

Reginald J. Hawker, 56, of 220 W. Main St., #4, Batavia, is charged with trespass. Hawker is accused of entering Wilson Farms on West Main Street after previously being barred from the store.

Jerome S. Dennis, 25, of 15 Thorpe St., Upper, Batavia, is charged with harassment. 2nd. Dennis is accused of spitting on another person.

Phillip Michael Busch, 19, of Bowen Road, Attica, is charged with DWI, driving with a BAC of .08 or greater, failure to signal and moving from lane unsafely. Busch was stopped at 3:06 a.m., Sunday, on Bowen Road in Alexander by Deputy Jason Saile.

Jennifer Lynn Hoehn, 38, of Dublin Road, Bergen, is charged with criminal mischief. Hoehn is accused of damaging a 2005 Chevrolet Silverado belonging to another person.

Ryan Donal Spencer, 22, of Sumner Road, Darien, is charged with DWI, driving with a BAC of .08 or greater and inadequate exhaust. Spencer was stopped at 12:51 a.m. Saturday by Deputy Jason Saile.

The following indictments were issued last week by the Genesee County Grand Jury.

Rodney A. Barber is charged with one count of criminal possession of a controlled substance, 3rd, a Class B felony, after he was allegedly found on March 17 to possess the narcotic cocaine with the intent to sell it. The location was 3967 W. Main St. in the Town of Batavia. He is also charged with one count of criminal possession of a controlled subtance, 4th, for allegedly knowingly and unlawfully possessing one or more preparations, compounds, mixtures or substances containing cocaine which had an aggregate weight of an eighth of an ounce or more.

Mark C. Gregori is charged with criminal possession of a controlled substance, 3rd, a Class B felony, after he was allegedly found on Nov. 3, 2010 in the Town of Elba in possession of the narcotic cocaine with the intent to sell it.

Michael B. Pfaff is charged with one count of driving while intoxicated, a Class E felony, after he was allegedly found driving a 2008 Suburu on Myrtle Street in Le Roy on April 17 while intoxicated. He is also charged with one count of driving while intoxicated with a BAC of .08 or greater, a Class E felony.

Thomas J. Torres is charged with one count of driving while intoxicated, a Class D felony, after he was allegedly found driving a 2004 Chevrolet on Route 237 in Stafford while intoxicated on April 23. He is also charged with one count of aggravated driving while intoxicated, also a Class D felony, for allegedly having a BAC of .18 or greater.

Jamie L. Broadbent is charged with criminal possession of stolen property, a Class E felony, for allegedly knowingly possessing stolen property with the intention of benefitting herself or a person other than the owner. She was allegedly found in possession of a public benefit card belonging to someone else while in the City of Batavia on May 9.

Chester L. Sherman II is charged with one count of driving a 1998 Chevy pickup truck while intoxicated and one count of driving with a BAC of .08 or greater. The charges stem from his arrest April 20 on Route 262 in Byron.

Jonathan J. Langenfeld is charged with one count of burglary in the first degree, a Class B violent felony, after he allegedly entered private property on Ellicott Street Road in Pavilion on April 17 with the intent to cause, then actually causing, physical injury to a person who was not a participant in the crime. He is also charged with burglary, 2nd, a Class C violent felony, for allegedly entering private property with the intent to commit a crime. And he is charged with assault, 2nd, a Class D violent felony, for allegedly intending to seriously injure a person and then causing serious injury to that person.

Barry L. Posey, 19, of West Main Street, Batavia, is charged with petit larceny. Posey was arrested following a traffic stop on a bench warrant out of the Town of Batavia Court. He was jailed on $2,000 bail.

Gina Lynn Schmidt, 22, of Forest Avenue, Oakfield, is charged with disorderly conduct. During an investigation into an unrelated matter it was discovered that there was an active bench warrant in place for the arrest of Schmidt. She was held on $175 bail.

Joshua Gerald Bachorsk, 26, of South Spruce Street, Batavia, is charged with three counts of criminal possession of stolen property, 4th, and petit larceny. Bachorsk is accused of possessing a Pembroke woman's credit card without her consent and using it on three separate dates to purchase gift cards at a retail store on Veterans Memorial Drive. Bachorsk also allegedly removed a washer and dryer set from the basement of the same woman's home and sold them without her consent. Bachorsk was jailed on $10,000 bail.

Aaron Walter Pahuta, 19, of Route 20A, Warsaw, is charged with petit larceny. Pahuta is accused of shoplifting from Kmart.

Matthew Scott Williams, 23, of West Main Street Road, Batavia, is charged with aggravated harassment, 2nd. Williams is accused of sending threatening text messages to another person.

Matthew S. Williams, 23, of Hundredmark Road, Elba, is charged with grand larceny, 4th. Williams is accused of stealing his father's RG Industries .22 caliber revolver from their residence. Williams was jailed on $10,000 bail.

William Heany, 75, of 400 E. Main St., Batavia, is charged with forcible touching. Heany is accused of touching the intimate parts of a woman by force.

Kelly M. Stalker, 33, of Indian Falls Road, Pembroke, is charged with burglary, 3rd. Stalker allegedly broke into a locked storage area in a trailer on Indian Falls Road and removed prescription medication and money belonging to somebody else. Stalker was jailed on $5,000 bail.
