Firefighter union out in force to picket city's decision to scrap ambulance

A constant chorus of car horns sounded support of the protestors circling the walk out front of City Hall this morning. Some two dozen members of Firefighters Local 896 braved the bitter winds to picket the City Council's recent decision to end its ambulance service by fall.

Some of the signs read: "Think! Where's your ambulance coming from?" and "Chest Pain? How long will you wait?" Such statements punctuated the argument that the gap in service could have quite dire consequences. Union President Greg Ireland spoke of a past incident, before the city had instituted its own ambulance service, when a man in arrest lay in the street with no transport available to get him to a hospital. In another instance, a victim suffering from third-degree burns had to drive himself to the hospital.

The occasion was also used to get out the word on a new Web site the union has launched at www.bataviaambulance.com.

Overall, the mood was civil yet determined as union members stalked the ground with purpose. Ireland stepped aside to speak with the media during the protest. We will post his comments in a video within the hour.

Earlier today, we reported that the city of Batavia may not release the salaries of its city employees until after the City Council has already voted on the budget. Several individuals have come to us to express concern over the choice by Council to institute raises for city officials when unemployment is on the rise and every week seems to bear the news of another downtown business closing shop.

Is it just? Should city officials and department heads get raises just because all other city employees are guaranteed a raise under their union contract?

City employee salary info may not be available until after budget vote

For those of you who missed it, Daily News reporter Joanne Beck turned out an excellent piece Saturday on the proposed pay raises for city officials. When Beck questioned city leaders about the raises slated for department heads, despite the down economy, and about the significant increase in pay for the assistant city manager—$24,000 more than past assistants—she was accused of being sexist.

From that article:

Council President Charlie Mallow believes it's a ''sexist'' form of badgering for no good reason.

"It seems we have chosen to disrespect and take for granted those who have come in to clean up the mess others have left us with," Mallow said Thursday. "I also believe there is sexism in this whole line of questioning. There are at least four other men that make more money than (Assistant Manager Sally Kuzon) and I don't see repeated questions about them."

Mallow and City Manager Jason Molino felt the same way, they said: The assistant's salary is justified and the topic is not really news. But it wasn't Kuzon, who has worn many hats to oversee public works, community development and code enforcement, being questioned. Her salary of about $84,000 was. Past assistants have made about $60,000.

The issue of salary increases has been raised on a few occasions. When The Batavian asked about the raises for department heads last month, we were told that it was only fair because all the other city employees were guaranteed raises as a result of union contracts.

Mallow told us in an e-mail at the time:

There is a sense of right and wrong here. I do not believe non-union employees should be punished for not being part of a collective barging unit. Keep in mind that our administrative people have worked hand in hand with council to eliminate close to a $3 million dollar spending deficit in the last two years. The hard work of these administrative people reduced the size of city government. Some people out of sheer ignorance would like to single these people out; I think the rest of the community understands how far we have come and who helped us along the way.

Since then we have been trying to break out the budget info that pertains specifically to employee salaries. Last week, in what ought to be the ultimate effort, we filed a Freedom of Information Law request with the city clerk's office. In it, we requested the salaries for all city employees for the current fiscal year, the proposed salaries for the coming year, and those of the previous year.

On February 13, five days after we filed the request, we were informed that it would require 45 days for the city to compile the information. From Heidi Parker, city clerk: "With regards to the request for salary information, gathering that data could take a significant amount of time and therefore will be available within 45 days. I will forward you the information sooner, if I get it before the 45 days."

If you do the math, that would make the information available on March 30. City Council has until March 31 to approve the budget. Right now, they plan to vote well before that date, likely early in March at the next business meeting, we were told.

The question is simple: How can the city justify pay raises when the economy is so obviously in a funk? In downtown Batavia alone, five business have closed their doors since November, and more are rumored to follow suit. More than just a loss to the business community and downtown shoppers and diners, these closures signify a loss of tax revenue.

It turns out we weren't the only ones who had trouble procuring such information. A councilman and the Daily News also ran into road blocks. Fortunately for the Daily, their FOIL request was approved in time.

Councilman Bob Bialkowski has asked to add salaries to the agenda for council's conference meeting Feb. 23. He wants to discuss the topic of salaries versus personnel, he said.

That won't happen during public session, Mallow said. He feels it is about personnel, which is personal, and it won't be a free-for-all in open session, he said.

Bialkowski had asked to get administrative salary information but was rebuffed by council, he said. He was not aware what the top salaries were until they were published in The Daily News recently, he said. That information, which was obtained by a Freedom of Information Act request, listed the assistant manager's salary at the top with $83,959, followed by the city manager's salary at $83,487. Those salaries are contingent on a proposed 2.85 percent raise in the 2009-10 budget. City Council has until March 31 to adopt a final budget.

Genesee County Democrats have a ball on Valentine's Day

The Genesee County Democratic Party held their Annual Valentine’s Day Dinner Dance at Sacred Heart Hall on Saturday, February 14th.  Under the Chairmanship of Lew Henning of Batavia, this annual event brought together party faithful and elected officials from across Western New York.  As part of a GLOW County commitment program, Democrats joined from Genesee, Livingston, Wyoming Counties as well as Erie County to celebrate the past successful elections.

“We are very excited about our local, statewide and national elections this past November,” declared Lorie Longhany, Genesee County Democrat Party Chair.  “It is great to be here celebrating with all those that worked hard on that election.  I am also pleased that we are able to share that success with our surrounding Democrat Party leaders and elected officials.”

The Master of Ceremonies for the event was City of Batavia Council President Charles Mallow.  Music and entertainment were provided.  “This year we will be working hard on our local races, including the City of Batavia At-Large Council Seats,”declared Mallow.  “Now is the time to move forward, assess issues and work hard to insure the best possible government for our constituents.”

Democrats are expected to announce their slate of candidates in late spring or early summer.  All County Legislature Seats are up as well as City Council At-Large Seats.

Big winners of the evening were Raymond Yacuzzo of LeRoy, who won the 50/50 Drawing and Margaret Kapperman of Batavia, winner of the Door Prize.

Yesterday, we reported that the Batavia City Council voted to go ahead and spend $425,000 on design work for some six downtown infrastructure improvement projects, including some sewer and water line upgrades. Those designs will then be sent to the state in the hopes of landing $4.5 million in economic stimulus money to fund the projects. Council members who approve of the gamble—although they oppose labeling it as a gamble—say that it's an opportunity to create jobs in Batavia and better the city's infrastructure. What do you think?

News roundup: City could tap into stimulus package for $4.5 million

Batavia's City Council voted in favor of a measure last night that would use $425,000 to "design work for a half dozen" infrastructure projects, WBTA's Dan Fischer reports. That investment of $425,000 is supposed to yield $4.5 million worth of construction, on projects such as: undersized water mains, waterline break history, inoperable valves, sanitary sewer line conditions and road conditions.

Fischer explains that the $425,000 would be part of the aid received by the city from the Video Lottery Terminal Aid that was received earlier this year.

Councilman Frank Ferrando is quoted in the Daily News this morning as saying: "If we can get $4.5 million to get jobs that we have to do and can get it for an investment of $425,000, I think we have to do it,” he said. “There’s going to be a lot of money out there."

No one, however, explains how any of this would work. In fact, rather than explaining it, the article today in the Daily has only this to say:

It is a gamble. Assistant Manager Sally Kuzon said there’s no guarantee of the city actually getting the money from the state Economic Facility Corp. But spending $425,000 to design those six projects is a move toward it, she said.

It's a gamble!? So the city plans to gamble with gambling money. A little irony, perhaps. Furthermore, where did the state Economic Facility Corp. come from? No one is explaining this to us, folks. All we hear is Frank Ferrando saying: 'Hey, we can turn $425,000 into $4.5 million. Poof! We're rich and we have jobs. How can we not do this?'

What everyone has failed to note is that the hoped-for millions that would magically be available if only the city spent this $425,000 are part of the proposed economic stimulus package that just last night was the subject of a national news conference.

From a letter drafted by Assistant City Manager Sally Kuzon:

I have been monitoring the progress of the President's proposed Economic Stimulus Package over the last several weeks in an attempt to place the city in a competitive position to receive funding for infrastructure improvements.

Kuzon goes on to say that while there has been "tremendous debate" over just what will happen with the stimulus, she believes that "infrastructure improvements nationwide will have a prominent position within this initiative." In other words, the city should get it on it. We should submit "shovel ready projects" to the state's Economic Facility Corp., which will adminster the federal funds allocated to New York.

She continues:

Although there is a certain amount of uncertainty as to whether or not the programs will include loans or grants or whether the program will extend to projects not currently listed on the (Intended Use Plan); it is clear that only shovel ready projects submitted to the EFC will be considered for the current or future funding rounds. Based on this premise, I am recommending several projects for Council to consider submitting tothe EFC for economic stimulus funding.

We mentioned some of those projects above. The $425,000 requested by Kuzon would be used to design the projects and submit the designs to the state so that they would be eligible to receive the funding if and when it became available. However...

It is unknown at this time if the design phase or only construction cost will be eligible for reimbursement. If for some reason the city does not receive economic stimulus funding the projects will be designed and ready for construction as funds or grants become available in the future.

In a letter drafted to the City Council on Kuzon's proposal, City Manager Jason Molino writes: "The crux of this stimulus package is to get people back to work receiving pay checks; with $4,500,000 of infrastructure improvements that goal will be acheived."

Nowhere does anyone explain how these infrastructure improvements will acheive the goal of "getting people back to work." Kuzon never once takes up this issue in her letter, and nothing from Council addresses this either. We only hear people tell us: It will happen.

Molino justifies this use of these funds in this way:

Utilizing a portion of this years (sic) VLT aid to support the project design costs is both appropriate and realistic considering the City did not budget for this one-time revenue and these costs are one-time capital costs.

Council President Charlie Mallow can be heard in an audio quote on WBTA as saying that Batavia needs to do this. Otherwise, the jobs will go to New York City. He wrote to us in an e-mail this morning:

The action council took last night was about job creation right here in Genesee County, instead of New York City. Regardless of how we feel about the spending on the national level, we owe it to our residents to secure our share of this huge stimulus package. We are all going to pay for it whether we have enough foresight to act or not on a local level.

Councilmen Sam Barone and Bob Bialkowski were the only two members of Council who voted against the measure, saying that the state aid could be used instead to reduce the city's deficit or for "future needs."

Updated (8:28 a.m.): Council President Charlie Mallow responded to our question of how this stimulus money would create jobs.

Any aid we receive needs to be spent on projects that are shovel ready and can break ground in 180 days. That means putting people to work this summer. Local construction workers would be the first ones to work or to keep on working. Then there is the trickle down affect with people who work driving trucks, making concrete, selling building supplies, laying pipe, and even restaurants the workers, etc. We as a local government decided to do what we needed to do so that our people would feel the benefits of these make work projects that will be going on around the country. I believe this depression era type projects will boost our economy up and out of the slump we find ourselves in.
 
If fully funded, these projects will rebuild parts of 11 streets in the city this year. These projects are for sewer, water, road surface and sidewalks, and most call for complete reconstruction. This work will be on top of the work being done on Walnut, Oak and the $150,000 of sidewalk repair already budgeted this year. There will be a lot of activity going on this summer to rebuild the city from the ground up.

Update (8:35 a.m.): A very timely headline in the Buffalo News this morning reads: New York loses millions in revised Senate stimulus bill. From the article:

Gone entirely is funding for higher education construction, which, under the House-passed version, could have meant up to $242 million for the University at Buffalo.

Similarly, the Senate eliminated funding for school construction. The House bill would have provided $31.9 million for the district of Rep. Brian Higgins, D-Buffalo.

Senators also halved a $79 billion fiscal stabilization fund for the states. While much of the aid to local school districts remains intact, the cuts included a $25 billion fund aimed at helping governors balance their budgets.

Will we see even more funds cut from the stimulus by the time it is passed?

News roundup: Public hearing tonight on proposed city budget

Batavia's City Council will hold a public hearing tonight at 7 o'clock on the proposed budget for next year. Council has worked the property tax increase down to about 3 1/2 percent according to WBTA's Dan Fischer. Further budget cuts have reduced the increase to 2.17 percent. Water rates are slated for a 4 percent hike. That meeting will be at City Hall.

Batavia Consolidation Plan gets its own Web site

City and town of Batavia officials announced today that a Web site will be launched by the end of the week devoted to the consolidation plan right now being put together for the municipalities. We've included most of the text from that press release below. We also received a "Consolidation Plan Process Flow Chart" that details the process for approving the potential consolidation.

Noting that the "topic of consolidation has generated tremendous interest in Batavia in recent weeks," Town Supervisor Greg Post and City Council President Charlie Mallow today issued a joint statement endorsing the work of the joint consolidation planning committee. They also announced that by the end of the week the City and Town websites will have links to a special "Batavia Consolidation Plan" website so that area residents can stay informed about the planning process.

Mallow and Post pointed out that the actual work of developing the plan is the responsibility of the seven-member City/Town Consolidation Study Committee that is working with the Center for Governmental Research (CGR), a nonprofit consulting group based in Rochester. "We were both please with its decision — one recently endorsed by our respective boards — to move from a 'study' to a 'plan,'" they said.

Post added, "I'm a believer in smaller government and I'm action-oriented. This community does not need a study that sits on a shelf. It needs a plan so that Town voters have the choice of saying yes or no."

Mallow said, "I'm a firm believer in consolidating the City and Town, because there are so many benefits for our community going forward. Consolidation will positively impact every generation that comes after us."

They pointed out that the Committee will develop a report of model options for the combined community by June 1. The Committee will then hold community forums for the public to provide input in June and July. Based on the input, the Committee will develop a draft plan to present to the City Council and Town Board in early August. Assuming City Council and Town Board approve, a consolidation plan will be presented to City and Town voters at the November 3 election.

City department heads slated for raises tied to scheduled union raises

Batavians can take some comfort in the fact that the City Council recently whittled down the proposed tax increase of 3.6 percent down to 2.17 percent, without really sacrificing any city services—the jury is still out on whether the ambulance flap will help or hinder us in the long run.

Nevertheless, some rumors are going around that the Council has instituted raises for all of the city department heads. We put the question to Council President Charlie Mallow this morning in an e-mail. He told us that "all city employees have mandated cost of living increases based on union contracts except seven administrative people." Mallow feels that it's unfair for those seven people not to receive the same sort of "increases"—he never used the word "raise"—as the rest of the union-backed employees.

His words:

Here are some of the budgeted figures listed under "personnel services"—does not include overtime, social security, supplies, etc.—for a few of the city's top offices (2008 and 2009):

• City Manager's Office: $103,629 (2008), $106,140 (2009)
• Bureau of Finance: $35,639 (2008), $39,040 (2009)
• Bureau of City Assessment: $33,624 (2008), $34,590 (2009)
• Bureau of Inspection: $138,246 (2008); $195,860 (2009)

Strangely, the "Bureau of the Clerk-Treasure" is scheduled for a reduction in its budget for personnel services in 2009. That office was listed at $64,212 in 2008; $60,790 has been listed for 2009.

Since the budget does not break down each city employee's salary into a tidy, comprehensible format, we asked Mallow if the Council had a document illustrating all of the changes that were effected. He replied: "A list of budget changes does not exist; it was a very fluid process." We then asked if the city could provide a list of every employee's salary for 2008 and the proposed salary for 2009. We're waiting on that.

More from Mallow:

The single most important thing behind this budget was planning for the future with a series of contingency funds. These funds will allow the city to save for future equipment purchases. Doing this will allow us to have a stable tax rate in the future and be less prone to large swings like we have seen in the past. People should understand that we have taken on the practices that businesses use every day. We plan, we have goals and we live within our budget.

Conversation on the stimulus bill: Where does it go from here?

We were glad to see so many folks getting into the discussion yesterday about the national stimulus package that was passed by the U.S. House of Representatives earlier this week. That bill, already proving quite controversial, will go to the Senate next week for round two.

There were some clear divisions among opinion, yet both sides made strong cases. Some of you expressed a general yet cautious support for the stimulus bill on the grounds that it would "right the ship of state," as Russ Stresing put it so eloquently. Others among you decried the attempt to try to "buy our way out of debt," and called for a reining in of spending.

What is the next step in the conversation when both sides of the argument—because, for now at least, this argument is restricted to only two sides (the classic: for and against)—make valid claims? Neither is wrong. Surely, the nation will have to make "strategic investments" at some point to dress our wounds. It's not unlike a fellow who finds himself unemployed and unable to secure a new job. Perhaps an investment in a new suit, a new haircut or even a credited business course at a local community college could give him that edge. On the other hand, any such investments are based on hypothetical situations: 'If I make this happen, then this could happen...' And funds that could have went toward the perennial costs of food and shelter will have been wasted on a hoped for conclusion that may never come to pass.

Furthermore, accusations that this or that side is playing politics are also all true. One of our readers yesterday commented that the president sought the votes of the House Republicans on the stimulus bill so that said Republicans—none of whom voted in favor of the bill—could not use their unified dissent as a political weapon in the future. Well, doesn't that indict both sides? Democrats are threatening to push through the bill to flex their majority muscle. While Republicans are all too content in playing the foil.

President Barack Obama spoke a lot about "change" during the campaign, but if you ask me, this seems to be a whole lot of politics as usual. In the meantime, while we're trying to figure all that out, Howard passed along this article from a site called Good, that pieces together some of the arguments against a stimulus. Very informative. The author sums up his stance, in this way:

And there you have it. In my mind, economics seems to be a mostly made-up “science,” and I am pretty sure nothing the government does will have as much effect as other events (see: Great Depression and World War II, for instance). That said, doing nothing (or just lowering taxes) does not really seem like a viable move for a government, politically if not also economically. So, if we can get another round of the equivalent of WPA posters and CCC National Park trails out of this, maybe that’s all we need until whatever is really going to cure the recession comes along. But, in the meantime, it’s important to look at all sides.

Voices united in the call for new management of the Falleti Ice Arena

Not much to report on this yet, but a half dozen people spoke at the City Council meeting tonight, asking the city to seek new management for the Falleti Ice Arena in Batavia. They spoke in pretty condemning terms, claiming that the arena is no longer "a family-based skating wrink." One speaker went as far as to say that under the new management: "We've had our right to skate taken away."

The central issue among all the complainants was the allegedly unceremonious banishing of skate instructor Joan Disbrow from the arena. According to the mother of one young skater, a member of the management crew, Firland Management, vociferously dismissed Disbrow from the premises while she was on the ice with one of her students.

Councilwoman Marianne Clattenburg spoke up after all of the comments had been made. She said she has heard from several families that have made similar claims. "I think we may have made the wrong mistake with Firland Management," she said.

Council members Kathy Briggs, Rose Mary Christian and Bill Cox all agreed.

"I'm concerned with the volume of complaints—all one-sided," said Cox. "We need to give citizens the right to have a good skate and enjoy their sport."

A representative of Firland Management, Jim Cain, was scheduled to speak at the meeting. He cancelled. City Manager Jason Molino said that Cain called earlier in the day to say that he was not feeling well and could not attend.

There was some mention, as well, about the unsatisfactory budget report provided by Firland for the city's consideration.

We will look into this story and see what more we can find out.

City Council officially gets out of the ambulance business

It's official. Batavia's out of the ambulance business. City Council voted unanimously tonight not to continue funding and operating the county-wide ambulance service. True to the word of Council President Charlie Mallow, there was no discussion to be had by the city leaders. Councilwoman Rose Mary Christian was the only member to speak.

"It's a shame that the county hasn't come to the aid here," she said. "They're always passing the buck."

Further, despite the packed house—at least a couple dozen residents filled the audience—only two citizens spoke.

Poll: Should the city wash its hands of the county-wide ambulance service?

Later tonight, Batavia's City Council will vote to cease its funding and operation of the county-wide ambulance service managed by the city fire department. Discussion among members of Council was had at a recent budget meeting, and Council President Charlie Mallow has assured us that they are essentially all in agreement and that tonight's vote is merely the formal act on what has already been decided.

Seventeen of the 18 other municipalities in the county that benefit from the ambulance service have expressed their desire to continue with the city-run service. So we may see a few speakers at tonight's meeting. The vote will follow the Council's conference meeting, which begins at 7:00pm at City Hall.

News roundup: City poised to scrap county-wide ambulance service

Batavia is ready to get out of the ambulance business. City Council said last night that it would vote Monday to terminate its agreement with the rest of the county to provide ambulance service throughout the county, according to an article this morning in the Daily News. Joanne Beck writes: "That will mean no more city ambulance service for all residents of Genesee County, including the city."

"No more city ambulance." Flat out.

WBTA's Dan Fischer is quick to point, however, that the void will not remain empty for long. "If council votes to close down the ambulance service, expect a deal to be struck with a private ambulance service out of Rochester or Buffalo," he says.

Beck put together a fine article, replete with colorful quotes from Council, such as this one from Frank Ferrando:

“If we’re making money, none of us would want to give it up.... I think we want to provide this service, and it’s an excellent service, we just can’t foot the bill. We can’t foot the bill for the whole damn county.”

As for the rest of "the whole damn county"—they're not so willing to give up the service. Beck writes:

Seventeen of 18 Genesee County municipalities have indicated they’d like to extend the current ambulance service agreement another year, City Manager Jason Molino said. Pembroke opted out. The city must first “execute an extension and modification agreement” to continue offering the service before it can then notify those municipalities of the city’s termination clause, Molino said.

Poll: Downtown Batavia celebrations: Fund 'em or scrap 'em

Yesterday, we ran a post about the push by some members of Batavia's City Council to cut down on the funding for downtown celebrations, such as Summer in the City and Christmas in the City. Councilman Bob Bialkowski explained that they only wanted to limit the amount of funding available to cut down on overtime costs, but that they would not eliminate the celebrations altogether. Bialkowski justifies the push for cuts as a measure to minimize the city's property tax rate. Opponents of the cuts, however, argue that any cut in funding would shift too much of a cost burden onto the Batavia Business Improvement District, sponsors of the events.

Downtown events could land on the budget chopping block—or not...

Earlier this morning, one of our readers, John Roach, left the following comment:

It’s a shame that after all the hard work by BID, the 5 Republicans on City Council have submitted a budget proposal that will take enough money away from city celebrations and events that it might kill the Summer/Christmas in the City.

That caught our attention, and we set out to find exactly what the City Council had planned for budget cuts that might affect future events downtown. We asked for comment from Council President Charlie Mallow and Don Burkel, director of the downtown Business Improvement District. Burkel has not yet commented. Burkel responded via e-mail at noon today:

"There should be no budget cuts for Christmas in the City, Summer in the City or any other BID activities, as this would definitely have a negative impact on the downtown businesses.  In this time of economic hardship the merchants need these events to generate activity to attract shoppers and visitors to the Batavia Business Improvement District."

Mallow responded in an e-mail:

"I was sent a proposed amendment to lower the city's contribution from a few of the council members. Council will be talking about this proposed amendment as well as the rest that were submitted on Saturday.

"From my point of view a consensus was come to on the amount of this line item in the last budget. I do not support the cut, I think its unfair and hurts the businesses downtown and I think doing anything to jeopardize either event would lower our quality of life in the city.

"The members that proposed the amendment alluded to the idea that they had a majority in favor of the cut. I find that hard to believe."

While we were waiting to hear back from Mallow and Burkel, we also spoke with a few other members of Council: Rose Mary Christian, Kathy Briggs and Bob Bialkowski.

Bialkowski, who expressed an overall optimism about the budget process this year, said: "We're not eliminating any downtown events." Instead, he said, several members of Council were looking at ways to reduce overtime costs—especially those related to the management of downtown events—to help reduce the property tax burden. While this would not "eliminate" downtown events, it would reduce the funding available for them.

According to the budget proposal prepared by the office of the city manager, actual overtime costs so far paid out in the current budget season total more than $530,000, as listed in the budget's general fund. That total does not include such special funds as water and sewer, ambulance—in which overtime costs exceed $300,000—and the mall, which for some reason is maintained as a separate fund.

Nevertheless, most of those overtime expenses fall within the budgeted amounts. In fact, both fire and police overtime costs were under. For some reason, the communications department totaled more than four times what was budgeted. To date, that department has accrued $28,612 in overtime costs, while a mere $7,000 was budgeted.

What's most apt here, however, is the overtime cost for "community celebrations," which has totaled $4,997 so far. Those are the costs that Bialkowski has called into question. He says that if the city could get more use out of volunteers for the downtown celebrations and shift the schedule for assistance from public works employees from the weekend to Friday and Monday, the cost would drop from, say, $1,000 to $500, since overtime costs would be avoided.

"I'm a big believer for volunteering for events," he said. "We're just trying to keep any property tax minimal. We're looking at all costs, trying to keep it down as low as possible."

Cutting back on overtime costs are just one way he would hope to get expenses down for the next budget season. He has proposed a list of amendments, he says, that would reduce about $70,000 in "miscellaneous items" and by sharing services and getting more time out of certain city vehicles.

Christian and Briggs said that the cuts proposed by Bialkowski and others would, in fact, cut the funding for downtown events and shift the cost burden onto the BID, which would not be able to manage, and so be forced to eliminate the events.

"Some council members have recommended cuts in this area," said Briggs in an e-mail. "One suggestion was cutting it from $3,000 to $2,000. Nothing is definite yet. In my opinion the events shouldn't be scrapped. I'm not going to support this cut. We can't expect the Business Improvement District to pick up all of the cost, and we have to have some celebrations, right!"

Christian is of the same mind. She says that she is "not one of them," referring to some other members on Council who are trying to cut the funding for downtown events. Instead of those cuts, she said that she asked for City Manager Jason Molino to see if he can cut 1 to 1 1/2 percent from elsewhere in the budget. She hopes to get an answer on where and how that might be pulled off at the session Saturday.

"We'll see if Jason can find cuts in certain areas," she said. "The budget is astronomical. It's $24 million. We have to be realistic. The economy is a disaster. The stock market is a disaster. Even the president has said, it's not up to government, it's up to us. It's up to the people to make a change."

Poll: Should city employees live here?

Last night, the Batavia City Council voted to waive the residency requirement for 14 city employees. That was all the news that was reported about the 6-to-1 vote. Nobody has yet been able to tell us why exactly the city has such a requirement if it's willing to waive it for such a large number of employees. In the meantime, we would like to get your thoughts. Do you feel it's imperative for a person to live in the city of Batavia if they are employed here? Can someone in Oakfield do the job? Does it matter? If it doesn't matter, why does the city require residency here? If it does matter, why would the city waive that requirement? Well, what do you think?

News roundup: Council waives residency requirement—Updated

Batavia's City Council last night waived the residency requirement for 14 city employees, according to WBTA's Dan Fischer. Councilman Bob Bialkowski was the sole dissenter in the 6-to-1 vote. Assistant City Manager Sally Kuzon and recently appointed Code Enforcement Officer Ronald Panek were among those relieved of the requirement.

No one has yet explained exactly what such a decision means for the city. If the residency requirement was in place: How did the city hire 14 people in violation of the requirement? We put the question to Council President Charlie Mallow this morning, and we're waiting for his response. We'll be sure to get it up when he responds, if he doesn't just beat us to the punch and post a comment before then.

Update: Mallow has responded to our inquiry from earlier this morning.

"The City has a residency requirement for all employees to live within the boundaries of the County," he said. "These employees were identified as living outside the County, some who have worked for the City for over 10 years, and it has been determined that it is in the best interest of the City to waive this requirement  for these people."
