Congressman Chris Jacobs (NY-27) joined a bipartisan letter to the House and Senate appropriations committees calling for additional funding for the Department of Agriculture’s (USDA’s) ReConnect rural broadband grant program in the upcoming FY21 funding bill. 

“I have long advocated for increased broadband investment in NY-27. The pandemic has only elevated that need,” Jacobs said. “With schools moved online, businesses increasingly relying on the internet, telemedicine services becoming more popular, and farm technology advancing – the need for reliable high-speed internet access is urgent. The ReConnect Program is a sound investment that has helped connect our underserviced communities.”

Congress created the ReConnect Program in FY18 with a $600 million appropriation. $550 million and $555 million were appropriated in FY19 and FY20, respectively. To date, USDA has invested more than $1.3 billion in high-speed broadband infrastructure. Currently, the proposed FY21 Senate budget for this program has been cut by $150 million relative to FY20 funding levels. Jacobs is asking for increased funding for this rural broadband program relative to recent years.

“Our children, families, farmers, and economy rely on access to high-speed internet – we must ensure that we are making sufficient investments that set them up for success,” Jacobs said.

“I rise in support of extending the successful and bipartisan Paycheck Protection Program by making $138 billion in already appropriated funds available to help more businesses that are experiencing dire and desperate need.

"This week it was reported that almost 30 percent of small businesses in New York have closed for good due to the COVID-19 epidemic, and many more will face the same fate without further aid. $138 billion appropriated to the PPP is just sitting here in Washington, D.C., instead of helping our nation's small businesses.

For months we have asked the Speaker to allow a vote on H.R. 8265, which simply enables the SBA to do another round of grant awards -- getting this $138 billion out on the street before it's too late for many of these hard hit businesses. This legislation is targeted, addresses a dire need across the nation, and requires no additional federal funds.

"I urge the Speaker and her leadership to reconsider this tactic and allow this legislation to come to the floor for a vote. I'm confident it will receive bipartisan support. Thank you very much, I yield back.”

Background: H.R. 8265 – The Paycheck Protection Program Extension Act – would extend the application deadline for the Paycheck Protection Program, allowing for $138 billion in already appropriated funds to be made available to small businesses. The legislation was originally authored by Rep. Steve Chabot (R-OH).

Congressman Chris Jacobs (NY-27) is calling for Congress to remain in Washington, D.C., until a new COVID-19 relief bill is passed. This comes as the Democratic leadership in the House released an amended legislative schedule with fewer voting days prior to the holidays. 

“The idea that Congress should go home for the holidays and wait until the new year when a new presidential administration takes office is reprehensible,” Jacobs said. “I have spoken with restaurants, small businesses, families, and local elected officials – I can say with full authority there isn’t time left.”

Recently, New York Governor Andrew Cuomo announced new COVID-19 restrictions and business shutdowns throughout Western New York. (*SEE NOTE BELOW*) Similar restrictions have been put in place in numerous other states, and national weekly jobless claims have risen the past two weeks for the first time since July.

“Many small businesses in my district are facing bankruptcy, and they are unsure if they can keep employees or survive a second shutdown without further assistance,” Jacobs said. “My colleagues and I have been trying to free $138 billion in already appropriated Paycheck Protection Program funds for months; however, the Speaker and the Democratic Caucus have refused to work with us. This is aid we can deliver right now.

“Additionally, local governments are struggling due to revenue losses and COVID-19 expenses. I have cosponsored the SMART Act to deliver billions in additional funding to these governments – without it, they will have to lay off staff and cut critical public safety, EMS, and educational services our constituents rely on."

The SMART Act (H.R. 6954) is bipartisan legislation that would provide $500 billion in aid for state and local governments. One third of this aid, roughly $161 billion, would be sent directly to local governments. 

“We need to get a deal done and there are bipartisan solutions we can pass right now," Jacobs said. "With cases spiking, employees being laid off, schools closing, and small businesses facing uncertain futures, we have no time for the political games the Speaker has been playing with this aid. The American people elected me, and my colleagues, to work for them, and they need us to act now. We should not be leaving for the holidays until bipartisan, targeted relief is passed and signed.”

Congressman Chris Jacobs (NY-27) sent a letter to Governor Andrew Cuomo urging him to include Scaffold Law reform in his next budget proposal. Specifically, Congressman Jacobs called for implementing a comparative liability standard for gravity-related injuries.

“Reforming the burdensome Scaffold Law is long-overdue in New York State," Jacobs said. "As we are staring down a massive budget deficit and a stalled economy, reforming this archaic law is an excellent first step.

"Meaningful reform to the Scaffold Law would unleash our economy, attract new investment into our state, and lower the cost of living for all New Yorkers. We are the last state in the nation to have such a regulation, and there has never been a more urgent time to reform it.”

Currently, New York is the only state in the nation with a liability regime like the Scaffold Law, which imposes an absolute liability standard for gravity-related injuries on construction sites. This has resulted in a projected 8- to 10-percent increase to all construction costs – a cost that is handed down to taxpayers and deters investment in New York State.

For example, complying with the Scaffold Law is expected to add an additional $180 to $300 million to the Gateway Program and added an estimated $400 million to the Tappan Zee Bridge.

Congressman Jacobs introduced the Infrastructure Expansion Act in September. This legislation would exempt federally funded projects from the Scaffold Law and instead require a comparative liability standard for gravity-related injuries. Because the Scaffold Law is a state law, a bill passed by the New York State Legislature and signed into law by Governor Cuomo would be the most direct way to repeal or reform it.

Congressman Chris Jacobs (NY-27) held a press conference this morning to highlight the critical need for additional state and local COVID-19 relief funding. He was joined by NYS Senate Minority Leader Rob Ortt, Assemblyman Mike Norris, Niagara County Legislature Chair Rebecca Wydysh, and Orleans County Legislature Chair Lynne Johnston. 

"Our small rural governments are struggling and facing severe cuts to first responders, education, hospitals, and other critical services unless additional aid is provided to them," Jacobs said.

In NY-27, Monroe County and Erie County received CARES Act funding because they met the population threshold of over 500,000 residents. With this funding these counties were able to launch programs to aid towns and small businesses.

Meanwhile, smaller counties, including Orleans and Niagara, have received little to no funding. The SMART Act would send one-third of the $500 billion ($161 billion) directly to local governments based on revenue loss, population size, and COVID-19 caseload.

Washington, D.C. – Congressman Chris Jacobs (NY-27) has introduced and cosponsored a series of bills to strengthen the economy andnational security by taking on the Chinese Communist Party (CCP) and the People's Republic of China (PRC) on multiple fronts. Many of the bills were part of House Republicans’ China Task Force Report, which contains more than 400 recommendations to address the threat of China to the United States.

"China presents a clear threat to the strategic interest of the United States both at home and overseas, and we must act now to protect our economy and national security," Jacobs said.

"The CCP’s manipulative actions have made it clear they are not responsible members of the international community. This critical legislation I am supporting holds the CCP accountable, provides greater protections for Americans, and ensures we develop a strong economic position through advanced manufacturing."

The bill Rep. Jacobs introduced was the No Small Business Aid for China Act. This legislation would prohibit the Small Business Administration from providing aid, counsel or assistance to a small business with significant ties to China.

“My legislation ensures that American government assistance is used to support American small businesses," Jacobs said. "As we defeat the COVID-19 pandemic, my priority is a strong American economic comeback. That means ensuring money benefits domestic companies that need it most."

Furthermore, Rep. Jacobs cosponsored several other pieces of legislation:

• H.R. 8238 – AIM Act – Establishes an intelligence office within the U.S. Department of Agriculture to counteract Chinese efforts to steal American agricultural technology and to evaluate threats to American agriculture.
• H.R. 12 – The China Task Force Act – This is a comprehensive package of 137 pieces of legislation designed to protect American universities and intellectual property, bolster American manufacturing, and hold China accountable for their cover-up in response to COVID-19.

Highlights of the China Task Force Act:

• H.R. 6421 Li Wenliang Global Public Health Accountability Act of 2020 – allows the President to impose sanctions on foreign individuals and entities involved in deliberate acts to conceal or distort information about a public health emergency of international concern, including COVID-19. 
• H.R. 7178 – CHIPS for America Act – would establish investments and incentives to support U.S. semiconductor supply manufacturing research and development and supply chain security.

"I, once again, commend the hard work and dedication of the China Task Force for delivering a comprehensive report on the threat of China," Jacobs said. "Bringing back good-paying American jobs, protecting our economy and agriculture, and holding the Chinese Communist Party accountable for devastation of the COVID-19 pandemic should be top priorities for Congress. H.R. 692 – The Preexisting Conditions Protection Act of 2019 – would preserve access to health care for people with preexisting conditions if the Affordable Care Act is significantly changed or repealed.

Congressman Chris Jacobs (NY-27) is releasing the following statement after the United States Department of Agriculture announced it has authorized $500 million to support a fourth round of the Farmers to Families Food Box program.

“I commend the USDA and the Administration for continuing to make American families and farmers a top priority,” Jacobs said. “The Farmers to Families Food Box program has been a highly successful program that has provided healthy nutritious food to millions of American families.

"I have seen how it supports farmers and agribusinesses right here in NY-27 and will continue to advocate for programs that support local agriculture.”

This is the fourth round of purchases for the USDA Farmers to Families Food Box program that will award contracts for deliveries between Nov. 1st and Dec. 31st. The program was launched on May 15 in response to COVID-19 and to date has delivered more than 110 million boxes to American families.

Congressman Chris Jacobs (NY-27) has cosponsored the State Municipal Assistance for Response and Transition (SMART) Act.

“Many local governments in Western New York did not meet the 500,000 resident threshold to receive coronavirus funding from the CARES Act," Jacobs said. "Without additional aid to state and local governments our hospitals, first responders, and schools are facing the risk of layoffs and cuts to critical services they provide our communities."

The SMART Act would provide $500 billion for a Coronavirus Local Community Stabilization Fund to provide aid to state, local, and tribal governments. The latter would get $16 billion of the funds. The other $484 billion would be distributed to localities in three tranches based on the population, relative revenue loss, and COVID-19 caseload in the state as of June 1^st.

States would be required to release at least one third of these funds – totaling $161.3 billion – to municipal and county governments.

“Our local governments and services they provide are critical to rural communities,” Jacobs said. "Ensuring they have the resources they need is a top priority during this pandemic. I am proud to cosponsor this legislation to support these communities, and I will continue to advocate for targeted funding for local governments in additional COVID-19 relief legislation."

Congressman Chris Jacobs (NY-27) has cosponsored four pieces of legislation to help drive economic recovery – the Paycheck Protection Small Business Forgiveness Act, a bill extending coronavirus aid for airlines, the Small Business Expense Protection Act of 2020, and the Coronavirus Economic Relief for Transportation Services (CERTS) Act.

• H.R. 6821 – Small Business Expense Protection Act of 2020 would allow businesses to deduct expenses covered with forgivable Paycheck Protection Program loans from their federal taxes.
• H.R. 7642 – Coronavirus Economic Relief for Transportation Services (CERTS) Act would provide assistance to bus and motor coach operators that have been significantly impacted by COVID-19. In addition to supporting employees, these funds could be used to support operation and maintenance of existing equipment. 

“Supporting the American workforce and reducing the burdens placed on our small businesses are critical to bolstering our nation’s economic recovery," Jacobs said. "As I continue fighting for policies that put American workers and small businesses first, I am also strongly urging the Speaker, the Senate, and the White House to reach a bipartisan deal to provide comprehensive COVID-19 relief for our families, small businesses, and farmers.”

Congressman Chris Jacobs (NY-27) supports the China Task Force Report released yesterday that outlines a comprehensive plan to counter the People’s Republic of China and hold the Chinese Communist Party (CCP) accountable for their destabilizing behavior.

“I commend the China Task Force for their hard work developing a comprehensive plan to address the economic, national security, and now health threats the Chinese Communist Party poses to the American people,” Jacobs said.

“The global pandemic has especially highlighted the clear threat the CCP presents and the serious need to secure our supply chains – especially those used in the production of critical medicines and medical supplies. The report developed by the China Task Force covers a wide range of issues involving the Chinese Communist Party, including: the forced labor and persecution of the Uyghur people; securing critical supply chains; providing resources to investigate and prosecute intellectual property theft; and securing production of advanced technologies such as AI, 5G, and autonomous vehicles.

“The Chinese Communist Party has a long record of human rights violations, stealing intellectual property, and manipulating critical information -- holding them accountable should and can be a bipartisan priority," Jacobs said. "I look forward to working with my colleagues to implement recommendations in this report to address the critical challenges posed by China."

Congressman Chris Jacobs (NY-27) signed a discharge petition yesterday to force a vote on H.R. 8265, a bill that would release the over $130 billion in unspent Paycheck Protection Program funds currently available.

“American small businesses are facing unprecedented challenges, and we have an excellent opportunity to deliver them critical aid now," Jacobs said. "The success of the Paycheck Protection Program cannot be disputed, so the fact that this bill has been used as a pawn in partisan games is an appalling disservice to the American people.

"I was proud to cosponsor H.R. 8265, and I am proud to sign this discharge petition and join my colleagues to support American small businesses. I urge my colleagues on the other side of the aisle to sign this petition to help us get this critical funding to our small businesses and main streets."

In a social media post, Nate McMurray, candidate for the NY-27 seat in the Nov. 3 General Election, accused his opponent Chris Jacobs of participating in a rally in Hamburg where Gov. Andrew Cuomo was, in McMurray's words, subjected to a "mock trial and lynching."

Except that even the heavily edited video McMurray posted shows the puppet hanging marionette-like from a crossbar, much like a puppeteer would operate. 

Jacobs denied being at the rally at the time the life-sized puppet was brought onto the stage.

A spokesman for Jacobs issued the following statement:

“Rep. Jacobs spoke at the beginning of the event and left immediately after his remarks to attend another event in Monroe County. The puppet was not on display during his remarks.”

A person who was at the rally with Jacobs said Jacobs was at the event only long enough to speak, about five minutes, and left at least an hour before the puppet was brought out.

This afternoon, McMurray issued a press release accusing Jacobs of "hitting a new low."

“This district has a history of political climbers like Bill Paxon, Tom Reynolds, Chris Lee, and Chris Collins who used the communities and families of NY-27 for personal gain,” McMurray said. “But the hatefulness on display Saturday is a disgraceful new low. Chris Jacobs and his comrades have fully embraced the worst of Trumpism in Western New York.”

The rally was sponsored by the 1791 Society, a pro-Second Amendment group, and billed as an Anti-Cuomo event. 

According to the Buffalo News, the marionette was brought to the rally by Melbourne Sann, of Rome, N.Y., who conducted a mock trial of Cuomo.

Sann, wearing a Revolutionary War uniform, asked for verdicts from the crowd on Cuomo's policies, ranging from abortion rights to bail reform. As the crowd yelled "guilty," a spectator struck the suspended figure in the lower back with a folded metal chair.

“Thank you, Mr. Speaker. Mr. Speaker, of the many excellent provisions in the CARES Act, which was passed by this body, undoubtedly one of the most successful was the PPP, the Paycheck Protection Program - which literally helped thousands of small businesses and over 50 million jobs be saved during the COVID-19 pandemic. The PPP was also successful because it partnered with the private sector, utilizing local banks to disperse the PPP loans. Already the banks had relationships with the small businesses in their communities.

"These existing relationships between banks and small businesses were invaluable in getting these funds out on to the street in record speed. Again, saving thousands of businesses and millions of jobs. In my district alone, PPP saved over 50,000 jobs. It is due to the success of the PPP and the significant need for additional PPP funds for small businesses around the nation that I rise in support of H.R. 8265, sponsored by Representative Chabot. This is a commonsense piece of legislation, there is approximately $130 billion in unspent PPP funds.

"This bill simply enables the small business administration to do another round of PPP awards. There is still incredible demand and need for this program. So, this is not an allocation of additional money. As both sides debate a much larger and more complicated new stimulus package, I think this bill is a great first step. It is a program that has shown itself to be incredibly effective in saving jobs and small businesses.

"There is most definitely more demand for PPP loans from small businesses and local nonprofits. The model of awarding the funds has shown itself to be excellent. Finally, it doesn't require an additional appropriation. Mr. Speaker, our small businesses are fighting for their survival and millions of jobs hang in the balance. We can do this.
