Martin K. Toporczyk, 49, of Darien Center passed away suddenly in Warsaw on Saturday August 19, 2017. Marty was born in Buffalo on December 4, 1967 to the late Daniel M. Toporczyk and his mother Dolores Kleps.

Marty was a mason at Pike Construction.  Marty loved to fish, collect coins, and was an all-around nice guy.  A people person with the gift of gab.  He will be dearly missed.

He is survived by his children Brittany K. Toporczyk of Alden and Morgan K. Toporczyk of Springhill FL., brother Mark Toporczyk (Tonya Hackett) of East Bethany; nephew Brandon K. Toporczyk of California, serving in the U.S. Navy; niece Brianna C. Toporczyk of Alexander; Aunt MaryAnn (Paul) Reese of Arizona; Cousin Jeff Reese of Connecticut; and girlfriend Ann Cox of Warsaw

There will be no prior calling hours. A memorial Service will be held at a later date to be announced.

No appeal planned after DWI charge dismissed when DA's office didn't comply with discovery rules

The District Attorney's Office will not appeal the dismissal of a DWI charge against a Bethany resident over a procedural error by prosecutors, Assistant District Attorney William Zickl says.

The case was dismissed on appeal by County Court Judge Melissa Lightcap Cianfrini, upholding an earlier ruling by City Court Judge Durin R. Rogers that a defendant's right to a speedy trial was violated because of the procedural error.
