National Prescription Drug Take Back Day is April 28, help keep water supply safe

New York Sea Grant is encouraging the public to take expired, unused and unwanted pharmaceuticals to designated law enforcement agency locations on National Prescription Drug Take Back Day from 10 a.m. to 2 p.m. on April 28.

This federally designated day for collection of waste pharmaceuticals prevents the entry of such products as antibiotics, blood pressure regulators, pain medications, tranquilizers, and hormones, into state waterways and drinking supply sources.

In Genesee County, you can drop off unwanted drugs, no questions asked, at these locations:

  • Batavia Police Department, 10 W. Main St., Batavia
  • Genesee County Sheriff's Office is conducting a drop-off at the Pembroke Town Highway Barn at routes 5 and 77, East Pembroke
  • Village of Le Roy Police Department, 3 W. Main St., Le Roy

“Proper disposal of unused medications is critically important to protect the public drinking water supply and the Great Lakes ecosystem," said Helen Domske, New York Sea Grant Coastal Education specialist, Buffalo.

"Take Back Day sites accepting these pharmaceuticals provide easily accessible drop-off points so everyone can do their part to protect New York’s waters.”

The New York Sea Grant website has information about the impact of keeping pharmaceuticals and personal care products out of the Great Lakes and other water sources. The results of a two-year research project, funded by New York Sea Grant, to examine the effectiveness of advanced water treatment options, environmental levels, and the potential effects of pharmaceuticals in New York waters are expected later this year.

“Research is increasing our understanding of the impact of bioactive chemical substances on the aquatic food web," said Domske, who is also the associate director of the Great Lakes Program at SUNY Buffalo.

"For example, research has recently documented the presence of antidepressants and their metabolites as well as antihistamines in fish such as largemouth bass, yellow perch, walleye and steelhead trout in the Niagara River. Although researchers believe the levels do not pose a threat to humans eating the fish, they are problematic and one of the reasons we do not want people to flush medicines down the toilet or drain."

Earlier this year, the New York State Department of Environmental Conservation announced a $2 million pilot Pharmaceutical Take-Back initiative that officially begins this month with pharmacies, hospitals, long-term care facilities and other sites participating in the collection and proper disposal of the unwanted, unused pharmaceuticals. National Prescription Drug Take Back Days take place twice a year, in the spring and fall. According to the federal Drug Enforcement Agency, a record-setting collection of 912,305 pounds of expired, unused, and unwanted prescription drugs took place during the Fall 2017 National Prescription Drug Take Back Day.

Man shot by deputy at Log Cabin was looking for a fight according to early reports from the scene

UPDATE 11:40 a.m.: The name of the man shot is Keith A. Kent, 61, of Albion.

A man who was shot and killed outside the Log Cabin Restaurant late last night was causing a disturbance inside the establishment, according to Undersheriff Gregory Walker, and said at one point, "where are the police?"

The man was challenging people inside the restaurant to a fight, trying to convince them to meet him outside, Walker said.

Deputies were dispatched to the restaurant a little before 11 p.m. for the disturbance and while in route were informed of the reports that shots where fired.

“The officers were given a description of the subject who had the handgun," Walker said during a press conference this morning at the Sheriff's Office on Park Road. "When they arrived in the parking lot they saw a subject who matched the description and also when they arrived there was a shot that was fired as officers arrived on scene.”

Officers shouted numerous commands for the subject to drop the weapon, Walker said.

"He did not comply and the officers had to shoot and did kill the subject," Walker said.

The name of the deceased has not been released yet pending notification of his family.

Walker said the man did turn and point his gun at a deputy.

Walker confirmed that deputies were wearing body cams and body cams were recording at the time of the events. That video footage is still under review.

He couldn't say, with the limited information still available, how many officers -- including state troopers and possibly Batavia PD -- were on scene at the time of the shooting.

While it appears there were shots fired inside and outside the restaurant that hasn't been confirmed yet through the investigation. 

Walker said he could not say yet how many shots were fired, either by the subject or by police.

The type of handgun used by the subject was not released nor was information released about whether it was legally owned, by whom and whether the subject had a permit. 

Since the shooting involves a member of the Sheriff's force, there will be an independent investigation of the shooting.

While the name of the deputy involved hasn't been released, Walker said, “He’s doing OK considering the circumstances. We will be spending a lot more time with him and helping him out to get through this circumstance.”

Major Edward Kennedy, State Police, Troop A, said the investigation will be conducted just like any other investigation -- the forensic evidence will be gathered, evidence reviewed and witnesses interviewed.

“I understand your questions," Kennedy said. "They’re relevant. They are absolutely understandable but they are things we cannot comment on. This is currently an active crime scene. We are in the very early stages of an investigation. This is a tragedy for everyone. That is the best we can give you right now.”

Man shot and killed after pointing handgun at deputy outside Log Cabin Restaurant

A Sheriff's deputy dispatched to a report of shots fired at the Log Cabin Restaurant at just before 11 p.m. Wednesday shot and killed an armed suspect after the suspect pointed his weapon at the deputy, according to Undersheriff Gregory Walker.

"Officers were responding to the scene (for a report of shots fired) and when they got here they found the suspect in the parking lot," Walker said. "The officers yelled commands to him; when they yelled the commands to him, he turned towards one of our officers and pointed the gun at our officer. Our officer did take the shot and the suspect was killed."

The suspect's weapon was recovered at the scene, Walker said.

Since the shooting involved a Sheriff's deputy, the State Police were asked to lead an independent investigation. Walker said he expects a joint Sheriff's Office and State Police press conference later this morning or early afternoon to discuss the incident in more detail.

At this time, Walker said, investigators do not know why the suspect was firing his gun.

The only person shot was the suspect. He has not yet been identified. Nobody else was injured in the incident.

While details of the incident have not been confirmed yet, it's possible, Walker said, the suspect did fire his weapon both inside and outside the restaurant before law enforcement arrived on scene.

There were customers and staff in the restaurant when the incident started.

The suspect was armed with a handgun, according to Walker, and officers were informed before arriving on scene that there was confirmation of shots being fired at the location.

The name of the deputy involved has not been released.

The Log Cabin Restaurant is located at 1227 Gilmore Road, Indian Falls. At this time, Gilmore Road remains closed between Route 77 and Akron Road.

Neither Walker nor Chief Deputy Jerome Brewster could remember another officer-involved shooting in Genesee County in the past 30, 40, or more years. Brewster said he thinks the last one involved Batavia PD on Oak Street in the 1970s.

Grand Jury: Woman allegedly jumped bail, failed to appear in county court on felony charge

Serena L. Snyder is indicted for the crime of bail jumping in the second degree, a Class E felony. It is alleged that she did not appear personally on Sept. 26 in Genesee County Court as ordered after having been released from custody on the condition she would do so, nor did she voluntarily appear in court within 30 days thereafter. She was to appear in court in connection with an unspecified felony charge against her.

Steven Obara is indicted for the crime of driving while intoxicated as a Class E felony. It is alleged that on Oct. 8 in the Town of Pembroke that Obara drove a 2007 Jeep on Route 33 while he was intoxicated. In Special Information filed by the District Attorney's Office, Obara is accused of having been convicted of driving while intoxicated, as a misdemeanor, on Feb. 1, 2011 in the Town of Elma in Erie County. That conviction was within 10 of the commission of the crime alleged in the current indictment.

Tree falls into house on Killian Road, East Pembroke

Law and Order: Person accused of twice pulling fire alarm when there was no emergency at DePaul

Jonathan P. Balaz, 41, of East Main Street, Batavia, is charged with falsely reporting an incident, 2nd. Balaz is accused of intentionally pulling a fire alarm at the DePaul Housing Complex on East Main Street at 12:43 p.m. Wednesday causing an emergency response by Batavia fire when there was no emergency. He is also accused of the same crime, with the same charge, at 9:17 p.m. Friday.

Dawn M. Orlando, 48, of Wood Street, Batavia, is charged with harassment, 2nd. Orlando is accused of hitting another person in an incident reported at 12:30 p.m. March 25.

Marcus L. Speed, 30, of Hawthorne Court, Elmira, was arrested on a warrant for alleged failure to appear on an appearance ticket. He was jailed on $1,000 bail.

Walter B. Hale Jr., 40, of East Avenue, Batavia, was arrested on a warrant related to a charge of criminal contempt, 2nd. He posted bail and was released.

Cathleen Joan Mills, 48, of Route 333, Campbell, is charged possessing for sale or transport more than 10,000 unstamped cigarettes. Mills was charged as a result of an investigation by Deputy Robert Henning of a report of a person buying a large quantity of cigarettes.

Luis Gabriel Lopez, 21, of 7 Fairway St., Macedon, is charged with criminal possession of marijuana, 3rd. Lopez was charged after he was allegedly found in possession of marijuana with an aggregate weight of more than eight ounces during a vehicle checkpoint at 4:59 p.m. Saturday on Route 33, Bergen, by Deputy Matthew Bailey and Deputy Ryan DeLong.

Curtis Rashaad Beaty, 20, of Winbourne Road, Rochester, is charged with aggravated unlicensed operation, unlawful possession of marijuana, and driving without a valid vehicle inspection. Beaty was charged following a stop by Deputy Ryan DeLong and Matthew Bailey at a vehicle checkpoint at 4:59 p.m. Saturday on Route 33.

Dartanyon A. Robinson, 47, of Rochester, is charged with driving under the influence of drugs, driving without an interlock device, aggravated unlicensed operation and speeding. Robinson was stopped at 7:39 a.m. Friday on the Thruway in the Town of Batavia by State Police.

Bradley W. Polle, 40, of Spencerport, is charged with criminal contempt, 1st. Polle was arrested by State Police in Bethany.

David J. Zauner, 50, of Darien Center, is charged with grand larceny, 3rd, falsifying business records, and filing a false instrument. Zauner was arrested by State Police. No further details released.

Benito Hernandez-Vega, 37, of Le Roy, is charged with felony driving under the influence of drugs, felony aggravated DWI with a child in the vehicle, and endangering the welfare of a child. Hernandez-Vega was stopped at 1:14 p.m. Wednesday on Route 5 in Stafford by State Police.

CTE students inducted into the National Technical Honor Society

This month, the National Technical Honor Society (NTHS) Chapters inducted 49 career and technical students from Batavia Career and Technical Education Center.

Evening candlelight ceremonies took place at Elba High School.

These students met the rigorous criteria set forth by this national organization. The minimum grade point average for acceptance is a 3.0. Students are also selected based upon credit hours completed, attendance, volunteer service, and membership in other student organizations.

The Batavia Career and Technical Education Center is a program of the Genesee Valley Educational Partnership. The Partnership operates as a Board of Cooperative Educational Services offering shared programs and services to 22 component school districts located in Genesee, Wyoming, Livingston and Steuben counties in New York State.

Law and Order: Batavia man charged with felonies following physical domestic

Joseph M. Tornabene, 26, of Dellinger Avenue, Batavia, is charged with third-degree assault, aggravated criminal contempt, fourth-degree criminal mischief, and second-degree robbery. Tornabene is accused of physically attacking a woman during a violent domestic dispute, causing injuries. He is also accused of forcibly taking the victim's mobile phone, preventing her from calling 9-1-1. He also allegedly violated an order of protection. He was jailed on $25,000 bail.

Daniel Edward King, 41, of Phelps Road, Pembroke, is charged with failing to register a change of address within 10 days as a sex offender. The charge followed an investigation into an incident in the Town of Pembroke.

Bin Chen, 32, of Wangman Street, Rochester, is charged with possession for the purpose of sale of 30,000 or more untaxed cigarettes, criminal tax fraud, 3rd, and failure to stop at stop sign. Chen was stopped at 1:29 a.m. Friday in the area of 7152 Alleghany Road, Alabama, by Deputy James Stack.

Jacob Russell, 22, of Walkers Corner Road, Byron, is charged with criminal possession of a weapon with a previous conviction and unlawful possession of marijuana. Russell was charged following a search of his residence by probation officers, who allegedly found a switchblade knife and five marijuana smoking devices containing marijuana. Russell was jailed on $20,000 bail or $40,000 bond.

Kevin Watson, 58, of East Main Street, Batavia, is charged with petit larceny. Watson is accused of stealing several items from Dollar General.

Scott D. Larnder, 41, of Tracy Avenue, Batavia, is charged with an unlicensed dog and owning a vicious dog. Larnder's dog allegedly bit another person at his residence at 10:23 p.m. on March 12.

Pembroke falls to Northstar in Section V final

The Pembroke Dragons lost its Section V Class C1 championship battle Monday at Blue Cross Arena to Northstar Christian, 80-72.

Reid Miano scored 17 points and had 11 rebounds. Lucas Kohorst scored 15, Jamil Marable, 13, Zach vonKramer, 12, and Ethan Stone, 10.

For Northstar, Mile Brown scored 39 points.

Pembroke Dragons will get a shot Friday at a Section V title

For only the third time in program history, the Pembroke Dragons will play for a Section V boys basketball championship on Friday after beating Avon 65-50 in a semifinal game played last night in Warsaw.

"It’s a big deal for the program," said Head Coach Matt Shay. "Basketball hasn’t always something that the school has had a lot of success in, so it’s really exciting to see this group buy in and work and get that success."

On Friday, the Dragons fell behind in the second quarter but then went on a 14-0 run to close out the half and go into the locker room with a 10-point lead.

While Avon pulled close a couple of times in the second-half, Pembroke remained in control of the game.

"The lapses that I really didn't like were in the middle of the third and beginning of the fourth quarter whey they (Avon) started to make a run," Shay said. "They were making good cuts and we were caught sleeping, staring at the ball."

Shay said he was proud of Reid Miano's performance, who struggled to score in the first half but kept his head in the game and finished with 16 points on the night.

"We have so much depth and talent that we can survive if he doesn't have a great night," Shay said. "Some teams, their star guy starts off slow, they’re in trouble, but I really talked with him about just keep playing. You can be our best player and still not score. I’m so proud of him because at the end of this game, he didn’t do much in the first half, but in the second half, he really came alive."

Lucas Kohorst scored 20 points, Zach VonKramer and Ethan Stone each scored 10.

The Dragons, with a record of 23-0 is the #2 seed in the Class C1 bracket. On Friday, they play the #1 seed, Northstar Christian (22-1) for the championship at Blue Cross Arena in Rochester.

Oil spill reported from accident on Thruway in Pembroke

There is an oil spill on the Thruway in the eastbound lane in the area of mile marker 404 because of a truck accident.

It's unclear if a truck was carrying oil or if the oil comes from the engine. 

Two trucks may have been involved and there is heavy damage. There's no word yet on how large of an oil spill.

Pembroke fire and Indian Falls fire dispatched.

UPDATE 5 p.m.: There is oil leaking from "the last two tractor-trailers involved," a chief reports.

UPDATE 5:03 p.m.: The spill is 50 to 60 feet from a waterway. Department of Environmental Conservation being notified.

UPDATE 6:02 p.m.: Reader-submitted photos added. Apparently, only one truck involved. It was carrying 44,000 pounds of flour for a pizza shop.

Car in ditch on Main Road, Pembroke

A one-car accident is reported in the area of 246 Main Road, Pembroke. 

The vehicle is in a ditch and is smoking.

Unknown injuries.

Pembroke preserves undefeated record in playoff game against Gananda

Pembroke remained one of three undefeated Class C basketball teams in the state Friday with a 67-58 win over Gananda in a Section V playoff game.

Jamil Marable scored 20 points, Reid Miano, 18, and Lucas Kohorst, 17. 

Pembroke is now 21-0 on the season.

Also on Friday night, in Class D, #4 ranked, lost to #5 ranked Avoca, 73-59.

In girls basketball, Batavia beat Geneva, 57-48. Pavilion beat Naples, 56-29.

Sen. Schumer announces building can begin for national vets' cemetery in Pembroke

Today, U.S. Senate Minority Leader Charles E. Schumer announced that the U.S. Department of Veteran Affairs (VA) has completed the final acquisitions of an additional 60-acre parcel and a 77-acre parcel in Pembroke that is required in order for the VA to construct the new Western New York National Veterans Cemetery.
 
With the acquisitions complete, Schumer is now urging the VA to swiftly begin construction of the cemetery this year. Schumer said with the two newly acquired parcels the cemetery will effectively double in size.
 
Schumer said once constructed, the new veterans’ cemetery in Genesee County, will be the first and only of its kind in the Buffalo-Rochester area and will save thousands of military families from having to travel upward of 100 miles to visit their loved ones at what is now the closest vet cemetery in Bath.
 
Schumer said now it is vital the VA begin the cemetery’s construction.
 
“I applaud the Department of Veteran Affairs for overcoming this last impediment and acquiring these two land parcels," Schumer said "With this final hurdle cleared, I urge the VA to stick to a swift construction timetable and take the steps to begin the Western New York Veterans Cemetery construction this year."
 
"Making this cemetery a reality has been one of my top priorities, and now the VA has a clear path to begin construction. I am elated the VA heeded my calls and I look forward to seeing this project come to fruition. This cemetery's construction guarantees Western New York’s veterans will have the proper burial, at a site close to the homes, families, and the very communities they dedicated their lives to defend and serve.”
 
Previously the VA purchased a 132-acre site bordering on Indian Falls Road and State Route 77 in the Town of Pembroke as the site of the new veterans' cemetery but required these two additional parcels before construction could begin.
 
Schumer explained the new cemetery design calls for the main entrance to be built through this 60-acre parcel of land so that veterans, their families, and cemetery visitors can access the cemetery from Indian Falls Road, rather than via the busy State Route 77 corridor. Schumer said both parcels are located adjacent to the existing 132-acre cemetery site that was purchased by the VA in 2014.
 
The VA had advised last year that before the VA could acquire these two parcels needed to begin the cemetery’s construction, a buried gas line that traversed the 60-acre and 77-acre parcels needed to be plugged and then relocated. Per the timeline provided by the VA to Schumer’s office last June, the VA aimed to begin construction approximately six months after purchase of the 60- and 77-acre parcels, followed by the opening of the early turnover area for burials a year later in 2019.

Newly elected county officials attend training in Albany

Newly elected Genesee County legislators Gordon Dibble (District 3, towns of Pembroke & Darien), John Hilchey (District 1, towns of Alabama & Oakfield), and Gary T. Maha (District 9, Wards 4 & 5, City of Batavia) attended an Orientation Program for Newly Elected and Appointed County Officials, sponsored by the New York State Association of Counties (NYSAC) at its annual Legislative Conference held in Albany Jan. 29-31.

Topics of discussion and presentations included an overview of the New York State Association of Counties; New York State Open Government Laws; Major Policy Issues Affecting Counties; Introduction to County Finance and Budget Issues; County Government Structure in New York State; Ethics in Government; Adopting Local Laws; and Role of the Clerks of Legislative Boards.

Approximately 70 newly elected and appointed county officials attended the training program, and upon completion were awarded Certificates of Achievement by NYSAC’s County Government Institute and Cornell University.

Law and Order: DSS investigation leads to drug charges against Walnut Street resident

Jaylinn M. Oneil, 27, of Walnut Street, Batavia, is charged with criminal possession of a controlled substance, 7th, criminal use of drug paraphernalia, 2nd, criminal possession of a hypodermic instrument, and endangering the welfare of a child. Oneil was arrested by members of the Local Drug Task Force following a search of his residence as the result of an investigation initiated by the Department of Social Services. Following arraignment, Oneil was released under supervision of Genesee Justice.

Timothy James Hodgins, 32, of Lewiston Road, Batavia, is charged with unlawful possession of marijuana and inadequate headlamps. Hodgins was stopped at 7:48 p.m. Thursday on Lewiston Road, Batavia, by Deputy Kyle Krzemien.

Andrew Charles McGiveron, 29, of Walkers Corners Road, Byron, is charged with unlawful possession of marijuana. McGiveron was stopped at 7:52 p.m. Feb. 2 on Clinton Street Road, Stafford, by Investigator Christopher Parker. McGiveron was allegedly found in possession of a glass pipe and a small quantity of marijuana during a traffic stop.

Paul Donald Fields Jr., 48, of Pearl Street Road, Batavia, is charged with DWI, driving with a BAC of .8 or greater, aggravated unlicensed operation, 1st, criminal possession of a controlled substance, and moving from lane unsafely. Fields was charged following an investigation by Deputy Travis DeMuth into a motor-vehicle accident reported at 10:46 p.m. Wednesday on Indian Falls Road, Pembroke.

Abrain D. Wright, 33, of Rochester, is charged with unlawful possession of marijuana. Wright was stopped by State Police at 11:07 p.m. Thursday on Route 33 in Bergen.

GC Health Department offers FREE anti-rabies vaccination clinic at Pembroke Highway Department

The Genesee County Health Department, Division of Environmental Health, will hold an anti-rabies immunization clinic from 4 to 7 p.m. on Thursday, Sept. 20, at the Pembroke Highway Department.

The location is 1145 Main Road (Route 5), Pembroke.

Each dog, cat and ferret brought to the clinic must be leashed or crated and accompanied by someone who can control the animal.

Dog, cat and ferret vaccinations are FREE. Voluntary donations are accepted.
