Prescription Drug Take Back Day is Saturday

On Saturday, April 27, from 10 a.m. to 2 p.m., Genesee County law enforcement agencies and the Drug Enforcement Administration will give the public an opportunity to prevent pill abuse and theft by ridding their homes of potentially dangerous expired, unused and unwanted prescription drugs.

Only pills and other solids, like patches, can be brought to the collection sites—liquids and needles or other sharps will not be accepted. The service is free and anonymous; no questions asked.

This initiative addresses a vital public safety and public health issue. Medicines that languish in home cabinets are highly susceptible to diversion, misuse, and abuse.

Rates of prescription drug abuse in the U.S. are alarmingly high, as are the number of accidental poisonings and overdoses due to these drugs. The Substance Abuse and Mental Health Services Administration’s National Survey on Drug Use and Health shows year after year that the majority of misused and abused prescription drugs are obtained from family and friends, including someone else’s medication being stolen from the home medicine cabinet.

In addition, Americans are now advised that their usual methods for disposing of unused medicines — flushing them down the toilet or throwing them in the trash — both pose potential safety and health hazards.

Elba teens injured in Easter Sunday accident

A 17-year-old Elba resident and her younger brother were injured Easter Sunday after another reportedly rear-ended the car she was driving in the area of 2102 Main Road, Pembroke.

Theresa M. Gioia, 60, of Auburn, was cited for allegedly following too closely.

The accident sent four people to area hospitals, including Maddison T. Howard, 17, and Zachary D. Howard, 15. Maddison reportedly suffered a minor head injury and Zachary had a complaint of neck pain. Both were transported to Buffalo General Hospital.

Gioia reportedly told a deputy that she "looked back for one minute" while driving 2011 Jeep before hitting a 2017 Mazda SUV driving by Maddison.

Gioia and passenger Julie Wall, 36, were taken by Mercy EMS to UMMC. Gioia reportedly suffered a broken elbow. Wall had a complaint of neck pain.

Also in the car, with no reported injuries, were Jacob Kraatz, 15, and James Gioia, 64.

The accident was investigated by Deputy Ryan DeLong.

Law and Order: Hamburg couple accused of stealing cartons of smokes while their small child was with them

Matthew A. Oakes, 39, and Kailyn M. Oakes, 24, both of Boston State Road, Hamburg, are each charged with these misdemeanors: three counts of petit larceny; three counts of endangering the welfare of a child; and three counts of sixth-degree conspiracy. Between 11:20 and 11:50 p.m. on April 6, 12 and 15, the subjects allegedly stole several cartons of cigarettes from the Two Eagles Smoke Shop on Bloomingdale Road in Basom. They allegedly had their small child with them on each occasion. The parents were arrested, issued appearance tickets and are due in Alabama Town Court on May 8. The case was investigated by Genesee County Sheriff's Deputy David Moore, assisted by Deputy Joshua Brabon, Sgt. John Baiocco, and NYS Police Officer Michael Machniak.

Kayla Frances Twardowski, 29, of Spencer Court, Batavia, is charged with third-degree attempted grand larceny. Twardowski was arrested at 3 p.m. on April 16 after it was alleged that she allowed two fraudulent checks totaling more than $3,000 to be deposited into her bank account. She was issued appearance tickets and is due in Batavia City Court on May 7 to answer the charge. The case was handled by Genesee County Sheriff's Deputy Chad Minuto, assisted by Deputy Kyle Krzemien.

Michael Scott VanBuren, 51, Wesley Drive, Akron, is charged with: driving while intoxicated; aggravated DWI -- operating a motor vehicle while having a BAC of .18 percent of higher; moving from lane unsafely; speed not reasonable and prudent. VanBuren was arrested at 5:55 p.m. on April 19 on Knapp Road in Pembroke following the investigation of a motor-vehicle accident. He was released on an appearance ticket and is due in Pembroke Town Court on May 14. The case was handled by Genesee County Sheriff's Deputy Mathew Clor.

Gary Alfred Rynkowski, 50, of Thomas Avenue, Batavia, is charged with driving while intoxicated with a BAC of .18 percent or greater; DWI; open container; and inadequate plate lamp. On April 20, Rynkowski was arrested at 2:33 a.m. on West Main Street in Batavia following a traffic stop. He is due in Batavia City Court on May 15 to answer the charges. The case was handled by Genesee County Sheriff's Deputy James Stack, assisted by Deputy Erik Andre.

Ar-Rahmaan M. Jones, 38, of East Avenue, Le Roy, is charged with driving while ability impaired by alcohol and having an open container of alcohol in a motor vehicle. Jones awas arrested at 10:29 p.m. on April 20 on East Main Street Road in Batavia. It is alleged that while a deputy was checking the welfare of a motorist parked roadside on Route 5 in the Town of Batavia, Jones was found behind the wheel of a vehicle with its motor running. At the time, Jones allegedly was under the influence of alcohol and had an open container of alcohol in the vehicle. He was released on an appearance ticket and is due in Town of Batavia Court on May 20. The case was handled by Genesee County Sheriff's Deputy Jeremy McClellan, assisted by Brabon Joshua.

Jordan R. Rose, 18, of Maple Street, Batavia, is charged with second-degree criminal contempt. Rose was arrested after he was allegedly found to have been in the presence of two parties protected by a stay away order of protection at 4:30 p.m. on April 10 on Maple Street in Batavia. He was issued an appearance ticket and is due in Batavia City Court on Tuesday, April 23. The case was handled by Batavia Police Officer Stephen Cronmiller.

Joshua David Capwell, 39, of West Main Street, Batavia, is charged with second-degree harassment and criminal mischief. Capwell was arrested following an investigation into a domestic dispute on West Main Street in Batavia at occurred at 11:45 p.m. on April 18. He was issued a computer-generated appearance ticket and is to be arraigned in Batavia City Court on Tuesday, April 23. The case was handled by Batavia Police Officer Peter Flanagan, assisted by Officer Arick Perkins.

Heidi L. Harder, 43, of Montclair Avenue, Batavia, was arrested on a bench warrant following an unrelated incident. She was located at her residence and taken into custody with incident. After arraignment in Batavia City Court on April 16, she was jailed in lieu of $1,500 cash or bond. She is due to return to city court at a later date. The case was handled by Batavia Police Officer Miah Stevens, assisted by Marc Lawrence.

Law and Order: Batavia man accused of stealing tools from former Pembroke employer

Willis Floyd Miller Jr., 59, of West Main Street, Batavia, is charged with petit larceny. He was arrested on April 18 and arraigned in Pembroke Town Court at 4:30 p.m. for allegedly stealing tools belonging to his former employer on Dec. 5 on Genesee Street in Pembroke. He was released on an appearance ticket and is due in Pembroke Town Court again on April 30. The case was handled by Genesee County Sheriff's Deputy Kevin Forsyth.

Elizabeth Rose George, 28, of Council House Road, Tonawanda Indian Reservation, is charged with: unauthorized use of a vehicle; leaving the scene of a property damage accident; and moving from lane unsafely. George was arrested on April 18. It is alleged that she drove a vehicle on April 18 without the owner's consent and that she was subsequently involved in an accident at 5:13 a.m. on Bloomingdale Road. It is also alleged that she left the scene of the accident. George was issued traffic tickets and released on appearance tickets. The defendant is due in Alabama Town Court on May 8 to answer the charges. The case was handled by Deputy Travis DeMuth, assisted by Deputy Joshua Brabon.

Brandon Eugene Matteson, 25, of Ellicott Street Road, Pavilion, is charged with endangering the welfare of a child and second-degree harassment. Following a domestic incident that occurred at 7:56 a.m. on April 17 on Ellicott Street Road in Pavilion, Matteson was arrested and arraigned at 11:41 p.m. on April 17 in Le Roy Town Court. He was jailed in lieu of $500 cash or $3,000 bond. Genesee County Sheriff's Deputy Eric Meyer handled the case, assisted by NYS Police.

Two-car accident reported on Route 77, Pembroke

One hundred people, mostly teenagers, were at the St. Maximilian Kolbe Hall in East Pembroke on Saturday for a Rubik's Cube competition.

This is the second year Eli Fox and his parents hosted the competition in Genesee County.  Families came from Canada, Pennsylvania, Ohio, and of course from throughout Western New York to participate in the competition, which is the only one like it in the region.

Law and Order: Man arrested for throwing bag of feces on a vehicle, causing 'substantial inconvenience'

Paul Orrie Doctor Jr., 45. of Council House Road, Tonawanda Indian Reservation, was arrested at 5:45 p.m. on April 4 and charged with third-degree criminal tampering. It is alleged that he threw a bag of feces onto a vehicle belonging to another person, causing "a substantial inconvenience." The incident allegedly occurred on Bloomingdale Road. He was issued an appearance ticket for Alabama Town Court and is due there at 6 p.m. on April 24. The case was investigated by Genesee County Sheriff's Deputy James Stack, assisted by Deputy Kyle Krzemien.

Tareq Fouad Saleh, 30, of Plymouth Avenue, Buffalo, is charged with: possessing more than 10,000 unstamped cigarettes; fourth-degree criminal tax fraud; speeding; and not wearing a seat belt -- a violation. He was arrested at 9:22 p.m. on April 3 on Alleghany Road in Pembroke following a traffic stop for speeding. The case was handled by Genesee County Sheriff's Deputy James Stack, assisted by Deputy Patrick Reeves.

Krystal Lee Frye, 29, of West Main Street, Batavia, is charged with fourth-degree grand larceny -- credit card. She was arrested and will be arraigned on April 9 on the charge following an investigation into a stolen wallet. The incident allegedly occurred at 7:40 a.m. on April 1 at an apartment on Maple Street in the city. Frye was released on an appearance ticket. The case was handled by Batavia Police Officer Jason Ivison.

Andrea Marie Gray, 41, of West Main Street Road, Batavia, is charged with second-degree harassment. On April 4 at 3:19 p.m., Gray was arrested at the Genesee County Courts Facility for allegedly engaging in a physical altercation with a male. She was arraigned and released on her own recognizance and is due in Batavia City Court at a later date. The case was handled by Genesee County Sheriff's Deputy Ryan DeLong.

Heyward Clark Jr., 54, of Locust Street, Lockport, was arrested on April 6 on two Batavia City Court warrants after he was identified as a passenger in a vehicle during a traffic stop. He is charged with third-degree burglary -- entry with intent to commit a crime, petit larceny, and criminal mischief -- intent to damage property. The charges stem from an incident on School Street in Batavia at 10 p.m. on Oct. 27, 2016. Clark was jailed without bail and is due back in Batavia City Court at a later date. The case was handled by Batavia Police Officer Stephen Quider, assisted by Officer Nicole McGinnis.

Daniel S. Carpenter, 30, of Hickory Manor Drive, Rochester, is charged with: driving while intoxicated as a misdemeanor; moving from lane unsafely; and having alcohol in a motor vehicle. Carpenter was arrested at 10:27 a.m. on April 6 following a one-vehicle rollover crash on Route 19 in the Town of Le Roy. He suffered minor injuries and was released on appearance tickets for Le Roy Town Court. The case was handled by Genesee County Sheriff's Deputy Travis DeMuth, assisted by Deputy Ryan DeLong.

Walter T. Snell, 31, of Walnut Street, Batavia, is charged with failure to appear. He was arrested at 5:45 p.m. on April 5 on a bench warrant out of Batavia City Court for failing to appear in court. He was jailed in lieu of $1,000 bail and is to return to city court on April 10. The case was handled by Batavia Police Officer Miah Stevens, assisted by Officer Mitchell Cowen.

Dustin Wyatt Albrecht, 24, of Jay Street, Phelps, is charged with unlawful possession of marijuana and having no restraint system for a backseat passenger between the ages of 4 to 6. Albrecht was arrested at 4:25 p.m. on April 7 on Alleghany Road in Pembroke following a traffic checkpoint. He was released on an appearance ticket and is due in Town of Pembroke Court at a later date. The case was handled by Genesee County Sheriff's Deputy Travis DeMuth.

Woman who destroyed ex-boyfriend's Harley in fire put on probation, fined and given community service

The ex-boyfriend of a Pembroke woman who destroyed his Harley-Davidson motorcycle in a garage fire Jan. 6, 2018, let Judge Charles Zambito know today that he wasn't happy the 53-year-old woman is able to avoid jail time as part of her plea agreement.

"What kind of lesson will she learn with no prison time or no jail time?" asked Ben Reuben. "Local jail time would be an education for stopping her from doing something like this again."

Zambito told Jacqueline Saeli that both the probation department and Sheriff's Office investigators recommended jail time for her, but in order to send her to jail, he would have to allow her to withdraw her guilty plea and take the case to trial.

He said he wasn't inclined to send her to jail because she has paid $10,000 in restitution. She has a 30-year career caring for other people as a nurse and no prior criminal record. Saeli has successfully completed alcohol abuse treatment on her own.

All of those factors figured into his decision, Zambito said.

Saeli's attorney requested three years probation but Reuben and District Attorney Lawrence Friedman both said they thought five years probation was more appropriate. Zambito agreed that the case called for at least five years probation.

"This case isn't just about you and the victim," Zambito said. "This crime put at risk an entire neighborhood. You set a shed on fire out of anger at your boyfriend. That required volunteer firefighters and the police to show up and deal with a substantial fire. These firefighters are people who are there to serve you and your community and you put them all at risk. What if a volunteer had had a heart attack? How would you have felt if somebody had died because of what you did?"

Though Zambito couldn't send Saeli to jail, he did order to serve 200 hours of community service over the next 18 months and fined her $1,000.

Before being sentenced, Saeli had told Zambito that she was raised by her grandmother who instilled in her a sense of integrity, honesty and accountability, and that "you always do your best to help others."

She said the Jan. 6 incident was prompted by what she thought was a betrayal by two people she trusted. She said she was hurt and distraught and she admitted to drinking that night.

"I can't take back what I've done," Saeli said. "I've lived with regret and shame every day since. I can't believe I did this to somebody I loved. I wish I could take this back but I can't."

Saeli and Reuben didn't look at each other as she left the courtroom.

Grand Jury: Woman accused of filing NYS pistol application containing false information

Laura L. Dutton, AKA Laura Godlewski, AKA Laura L. Godlewski Dutton-Pontillo, AKA Laura Dutton, is indicted for the crime of filing a false instrument in the first degree, a Class E felony. It is alleged that on May 4 at the Genesee County Clerk's Office that Dutton filed a NYS Pistol-Revolver license application knowing that it contained false information, and with intent to defraud she offered it to a public servant for filing to become part of the public records.

Dennis S. Rogers Jr. is indicted for the crime of driving while intoxicated, as a Class E felony. It is alleged that on Nov. 3 in the Town of Pembroke that Rogers drove a 2003 Chevrolet on Route 5 while he was intoxicated. In count two, Rogers is accused of DWI, per se, as a Class E felony, for having a BAC of .08 percent at the time. In count three, the defendant is accused of aggravated unlicensed operation in the third degree for driving that day when his license was suspended or revoked. In Special Information filed by the District Attorney, Rogers is accused of having been convicted of DWI as a misdemeanor on June 30, 2011 in County of Monroe Court and also on Sept. 16, 2002 in City of Rochester Court. Those convictions and an additional suspension of Rogers's privilege to drive on July 27 last year, based on failure to pay child support, forms the basis for the suspension or revocation referred to in count three of the current indictment.

Pembroke volleyball team serves desserts, volunteers at Buffalo City Mission

Members of the Pembroke Dragon's volleyball team traveled yesterday to Buffalo to serve homemade desserts to the women and children seeking temporary shelter at the Buffalo City Mission.

They were inspired by Social Studies teacher Greg Kinal, who often volunteers at the mission and is sometimes joined by students.

The volleyball team was looking for a volunteer project so asked Kinal if they could serve at the mission. They made the desserts.

Coach Morgan Wagner said she was proud of her team.

"The athletes in our program are always thinking of others," Wagner said. "They are the kindest and most generous young ladies and teammates. I am very fortunate to work with these quality character student-athletes

"Their parents even got involved by assisting in the baking of the goodies we delivered. We are truly blessed here at Pembroke to be apart of a community that so selflessly loves and serves others."

The mission is always in need of donations so if anybody in the community wishes to pitch in and help, contact Kinal at the high school.

Pamela Smielecki of Pembroke sang in Spring Concert at Butler Community College in Kansas

EL DORADO, Kan. -- Pamela Smielecki, of Pembroke, sang in the annual Spring Concert performed by the Butler Community College Vocal Music Department.

This concert was the second of a three-concert series: “From Page to Stage.”

The 120-voice Concert Choir including the Chamber Singers, Headliners, Butler Ladies and A Cappella entertained the crowd each evening with the Jubilate Deo masterwork by Dan Forrest. The master work included seven different movements ranging in tempo, language and tone.

The Vocal Music faculty includes Valerie Lippoldt-Mack, chair of Vocal Music and Dance, as well as Matthew Udland, Chad Ingram and Nick Engels.

Butler Community College, an Aspen Institute Top 150 U.S. Community College with nearly 9,000 students, offers nearly 85 degree programs and 30 professional certification programs. Crime Victims' Rights Week: Committee planning discussion of 1987 crash that claimed four lives in Pembroke

Crime Victims' Rights Week in Genesee County will be commemorated April 7-13 with a special presentation at Genesee Community College from 8:15 a.m. to 1 p.m. on Monday, April 8, examining a fatal car accident that has become a key part of Genesee County history.

"Honoring Our Past. Creating Hope for the Future" will look back on a 1987 head-on collision that took the lives of three students in Pembroke and their driver's education instructor.

The panel for the discussion includes: 

  • Sheriff's Office Crash Scene Investigator -- Judge James Orr
  • Prosecuting District Attorney -- Judge Robert C. Noonan
  • Pembroke School teacher -- Gregory Kinal
  • Family members: Deputy Patrick Reeves

Reeves is the brother of Rhonda Reeves, who was 17 the day a car driven by Lyndon Goodell, then 23, hit the car she and her classmates were in. Also killed were students Eric Hamm-Johnson, Mindy Beals, and 55-year-old instructor Patrick Collins.

Goodell, a Batavia resident who had already served a stint in prison for burglary, was eventually convicted of manslaughter and vehicular manslaughter. He was sentenced to seven to 15 years in prison.

A wrongful-death lawsuit filed by the victims' families found Goodell and his passenger, Carol Rokicki Elder, equally at fault. Rokicki Elder gave Goodell the keys to her car and the bottle of whiskey that they shared.

In next month's presentation, the impact of the trauma will be discussed and details will be shared about how those involved were able to work through the heartbreak and also make positive changes for the future.

Area man killed in accident on Main Road, Pembroke

A Pembroke-area resident, whose name has not yet been released by local law enforcement, was killed this afternoon in a head-on collision with a tractor-trailer on Main Road near the county line.

The accident was reported at 3:06 p.m. in the area of 352 Main Road.

First responders reported a large debris field. Mercy Flight helicopters were put on ground standby but soon canceled after medics arrived on scene.

The driver of the tractor-trailer suffered minor injuries and was taken by Mercy EMS to UMMC for evaluation.

The driver of the SUV was westbound when it crossed the center line and struck the truck driver's-side-to-driver's-side. The SUV was heavily damaged in the accident.

Assistant Chief Ed Mileham, Indian Falls fire, said it was one of the worst accident scenes he's responded to in the 37 years he's been a volunteer firefighter.

UPDATE 9:30 a.m., Friday, March 15: The name of the driver killed in the crash is Wayne A. Striewing, 54, of Pembroke. Striewing was driving a 2017 Lexus NX2 westbound on Route 5 when the vehicle crossed the centerline, entering the eastbound lane. Investigators have yet to determine why Striewing's vehicle cross the centerline. The Lexus struck a 2016 Peterbilt tractor-trailer operated by Raymond L. Bennett, 56, of Winona, Mo. 

The crash is being investigated by Deputy James Stack, Deputy Kyle Krzemien, Sgt. Andrew Hale, Sgt. Jason Saile, Investigator Chris Parker, Investigator Chad Minuto, and Chief Deputy Joseph Graff. Assisting at the scene were the State Police Commercial Vehicle Enforcement Unit, Department of Environmental Conservation, Pembroke Volunteer Fire Department, Indian Falls Volunteer Fire Department, East Pembroke Volunteer Fire Department, Mercy EMS, and Coroner Jeff McIntyre.

Head-on collision: Car vs. semi in Pembroke, serious injuries

A head-on car vs. tractor-trailer accident with serious injuries was reported in Pembroke about an hour ago.

The location is 352 Main Road. It is close to the Erie County line.

Pembroke, Indian Falls and East Pembroke fire departments are on scene along with an ambulance.

Two Mercy Flight helicopters on standby were cancelled.

The accident is blocking traffic and the road is closed. There is a large debris field. The semi is in a ditch.

UPDATE 5:52 p.m.: Law enforcement command at the scene confirms this a fatal accident.

Case study of 1987 Pembroke DWI tragedy to be focus of GC Criminal Justice Day April 8

"Honoring Our Past. Creating Hope for the Future." -- Theme for 2019 National Crime Victims' Rights Week, April 7-13

Genesee County Criminal Justice Day will focus on "A Case Study of the 1987 Pembroke School DWI Tragedy."

The case study will be presented from 8:15 a.m. to 1 p.m. on Monday, April 8, at Genesee Community College in Room T102 of the Conable Technology Building.

On June 10, 1987, an automobile accident killed three Pembroke High School students and their driver-education teacher while they were participating in a hands-on driving exercise on Route 5 in Pembroke. Killed at the scene were Rhonda Reeves, Eric Hamm-Johnson, Mindy Beals -- all 17, and 55-year-old instructor Patrick Collins, who died several hours later.

They were struck head on when Lyndon Goodell, 23, drove recklessly on the wrong side of the road while intoxicated. A wrongful-death lawsuit filed later by the victms' families found Goodell and his passenger, Carol Rokicki Elder, equally at fault. Rokicki Elder gave Goodell the keys to her car and the bottle of whiskey that they shared.

Goodell was convicted in a jury trial in August 1988 of manslaughter, vehicular manslaughter and several traffic infractions. A month later, Genesee County Judge Glenn R. Morton sentenced Goodell to 7 1/2 to 15 years in state prison.

The wrongful-death suit settlement totaled $340,000 for all four victims, paid out by auto and homeowners insurance companies, including $40,000 from the auto insurance company for Pembroke schools. The sum was considered the maximum obtainable in light of insurance coverage the parties had in effect.

The tragic episode struck the heart of the small Pembroke community.

In next month's presentation, the impact of the trauma will be discussed and details will be shared about how those involved were able to work through the heartbreak and also make positive changes for the future.

This case study will offer different perspectives, including:

Law and Order: Lockport man charged with damaging ex-girlfriend's vehicle in Pembroke

Axel E. Antongiorgi-Colon, 32, of Prospect Street, Lockport, is charged with second-degree criminal mischief. On Dec. 8 at 10 p.m. on Main Road in Pembroke, the defendant allegedly damaged a vehicle in the parking lot of his ex-girlfriend's residence. He is due in Pembroke Town Court on March 21 to answer the charge. The case was handled by Genesee County Sheriff's Investigator Christopher Parker, assisted by Deputy David Moore.

Cynthia H. Owens, 43, of Rochester Street, Bergen, was arrested on March 4 on three separate outstanding bench warrants out of Batavia City Court. She was also charged with three separate counts of third-degree bail jumping. Owens was arraigned in city court then jailed with bail set at $5,000 cash or bond on each warrant. She was due back in city court on March 7. The case was handled by Batavia Police Officer Nicole McGinnis.

Nicole M. Albrecht, 35, Pleasant Street, Le Roy, is charged with petit larceny. She was arrested for allegedly stealing a television from Target at 1:27 p.m. on Feb. 8. She is due in Batavia Town Court at 1 p.m. on March 14 to answer the charge. The case was handled by Genesee County Sheriff's Investigator Christopher Parker.

Douglas Mitchell Smith, 39, of Tara Drive, High Point, N.C., is charged with aggravated unlicensed operation of a motor vehicle in the third degree. Smith was arrested on a bench warrant out of Town of Alabama Court after he failed to answer a summons to appear in court Jan. 31 for allegedly operating a motor vehicle while his privilege was suspended in New York. He was arraigned on March 7 and sentenced to time served. He is to reappear in Alabama Town Court on Oct. 3 to pay his fines and surcharges. The case was handled by Genesee County Sheriff's Deputy Michael Lute.

Zachary G. Garigen-Johnstone, 22, or Birch Circle, Rochester, is charged with unlawful possession of marijuana, running a red light, unregistered motor vehicle and uninspected motor vehicle. Garigen-Johnstone was stopped at 12:44 a.m. on East Main Street in Batavia for a traffic violation. Upon further investigation, he was allegedly found to have a grinder containing marijuana and a marijuana pipe. He was processed roadside and issued three traffic tickets. He was released on an appearance ticket and is due in Batavia City Court to answer the unlawful marijuana charge on March 26. The case was handled by Batavia Police Officer Miah Stevens, assisted by Jason Davis.

Joshua Patrick Johnson, 21, of Redfield Parkway, Batavia, is charged with unlawful possession of marijuana and a window tint violation. He was arrested following a traffic stop at 9:42 p.m. March 2 on Lewiston Road in Batavia. He was released on an appearance ticket and in due in Town of Batavia Court on March 18. The case was handled by Genesee County Sheriff's Deputy Eric Meyer, assisted by Deputy Michael Lute.

Pembroke's championship run cut short by Avon

For the first 10 minutes of Monday's crossover game between Pembroke and Avon at Cal-Mum, it looked like the Dragons might be on their way to continuing a great post-season run that on Saturday had given the school its first sectional title in girls basketball.

Then, things fell apart and Pembroke would eventually lose to Avon 57-49. A pair of whistles for traveling gave Avon the ball in their half of the court and Avon erased Pembroke's three-point lead on two easy baskets.

Next, Avon's Abby Decillis and Keni Read rained threes down on the Dragons. They hit five between them plus another pair of two-point buckets. 

"We had a little bit of a run going," said Coach Ron Funke. "We had some momentum. The turnovers and then those daggers, those three-pointers were just, you know, they just killed us."

In the second quarter, Avon outscored the Dragons 26 to 12. Only once the rest of the way would Pembroke get as close as nine points of the lead.

On the night, Decillis hit three three-pointers and Read hit five. Decillis finished with 20 points, Read with 19, and Sarine Mcdowell with 17.

"We got some of the looks that we wanted, we just couldn't finish near the basket," Funke said. "And our free throws ... I just can't understand. We set a school record for free throws percentages this season."

On Monday, Pembroke shot only five for 15 from the line.

In the fourth quarter, down by 14 or 15 points, Pembroke got some life back with under five minutes to play. Playing with hustle and confidence, twice they pulled within nine points of the lead but time expired before they could close the gap.

"They never quit," Funke said. "That's for sure. They never have. And you know, those girls they never will."

For Pembroke, Serene Calderon scored 16 points. MacKenna Johnson scored 13. Dekari Moss scored nine. Casey Wurtz scored six.

At 6:30 p.m. tomorrow at Genesee Community College, Avon plays Oakfield-Alabama to see which Class C team will represent Section V in the Far West Regional championship.

Law and Order: Irving Parkway man accused of unlawfully tapping into Oakfield village water line

Brian Carl Falk, 36, of 12 Irving Parkway, Oakfield, is charged with second-degree criminal tampering. On Feb. 26, the Genesee County Sheriff's Office was contacted by the Village of Oakfield Department of Public Works for the report of a larceny. It was alleged that a resident in the village unlawfully made a connection with the main water line to his residence after being advised that the connection was terminated. Following an investigation, it is alleged that Falk, without having any right to do so, nor any reasonable ground to believe he had such right, made a connection with the Village of Oakfield's water line. He was issued an appearance ticket and is due in Town of Oakfield Court at 6 p.m. on Monday, March 4, to answer the charge. The case was investigated by Genesee County Sheriff's Deputy Ryan DeLong.

Ronald G. Besemer-McLean, 37, of Portland Parkway, Rochester, was arrested on Saturday, March 2, by the Le Roy Police Department and charged with: one count of aggravated unlicensed operation of a motor vehicle in the first degree, a Class E felony; one count of tampering with physical evidence, a Class E felony; and one count of resisting arrest, a class A misdemeanor. On Saturday at approximately 8:12 a.m. the on-duty patrol was requested to respond to the area of Route 19 and the onramp to the Thruway entrance for the report of a subject passed out at the wheel of a vehicle in that area. Upon arrival, the officer found Besemer-McLean asleep in the driver’s seat. During the investigation, it is alleged that he drove there after leaving an unknown location in Greece. Besemer-McLean has a revoked NYS driver’s license. When attempting execute the arrest, Besemer-McLean allegely failed to comply with the officer’s orders and a struggle ensued. Besemer-McLean allegedly took an item that was evidence pertaining to the investigation, placed it in his mouth and swallowed it. A portion of the investigation was conducted by members of the Genesee County Sheriff’s Officer and NYS Police also assisted. Additional charges are pending. After arraignment in Le Roy Town Court, Besemer-McLean was jailed in lieu of $15,000 bail. He is to return to the Le Roy Town Court on March 5 to answer to the charges. The report says: "The Le Roy Police Department would like to say a special thank you to the citizens that took the time to stop and assist the officer."

Philip Joseph Severino, 42, of Pratt Road, Pembroke, is charged with second-degree assault and endangering the welfare of a child less than 17 years old. Severino was arrested March 1 after an investigation into a domestic incident involving an assault victim and two children that occurred at 4:30 p.m. on Feb. 20 on Pratt Road in Pembroke. After his arraignment in Town of Batavia Court, the defendant was jailed in lieu of $2,000 cash or $4,000 bond. He is due Town of Pembroke Court on March 12. The case was handled by Genesee County Sheriff's Deputy Michael Lute, assisted by Deputy Mathew Clor.

Lawrence John Isaac, 66, of Brant Reservation Road, Irving, is charged with second-degree harassment -- physical contact. Following an incident that occurred on Bloomingdale Road on the Tonawanda Indian Reservation on Feb. 16, Isaac was arrested on Feb. 28. It is alleged that he shoved a person while at the Community Center. He was arraigned in Town of Alabama Court and is due to return there on March 7. The case was handled by Genesee County Sheriff's Deputy Jeremy McClellan.

Eric J. Bratcher, 30, of Fargo Road, Stafford, was arrested on March 1, by the Le Roy Police Department and charged with one count of endangering the welfare of a child, a Class A misdemeanor, and one count of harassment in the second degree, a violation. The Le Roy Police Department investigated a complaint alleging that Bratcher made threats to harm another individual, at the time the incident occurred Bratcher was holding an 18-month-old child. After a brief investigation, Bratcher was located and taken into custody without incident. Bratcher was arraigned in the Le Roy Town and released under supervision of Genesee Justice. He is to return to the Le Roy Town Court on March 14 to answer to the charges.

Jessica R. Sylvester, 26, of Myrtle Street, Le Roy, was arrested on Feb. 28 by the Le Roy Police Department and charged with three counts of criminal contempt in the second degree, a Class A misdemeanor. The Le Roy Police Department investigated a complaint alleging that on three occasions Sylvester violated a court order restricting her contact with the victim. Sylvester was arraigned in the Le Roy Town Court and released under supervision of Genesee Justice. She is to return to the Le Roy Town Court on March 14 to answer to the charges.

Derrick E. Pickard, 59, of Genesee Street, Le Roy, was arrested on March 1 by the Le Roy Police Department and charged with: one count of driving while impaired by drugs, a misdemeanor; one count of consumption of alcohol in a motor vehicle, a violation; and one count of failure to keep right, a violation. On March 1 at about 11:24 a.m. the Le Roy Police Department was notified by an off-duty patrol that they had almost been struck head on and had the operator of the vehicle detained. It is alleged that Pickard failed to maintain his lane while operating his motor vehicle, almost causing an accident. Following a brief investigation, it was determined that Pickard was allegedly operating the motor vehicle under the influence of drugs. He was taken into custody without incident. He was issued several tickets and turned over to a family member. Pickard is to appear in the Le Roy Town Court on March 14 to answer the charges.

Jason Jonathan Forte, 47, of Trelawne Drive, Irondequiot, is charged with: driving while intoxicated with a BAC of .08 percent or more; DWI; and failure to yield the right of way when entering the roadway. Forte was arrested following the investigation of a motor-vehicle accident which occurred at 7:48 p.m. on Feb. 28 on West Main Street Road in Batavia. The case was handled by Genesee County Sheriff's Deputy James Stack, assisted by Deputy Mathew Clor.

Elizabeth Mary Johnson, 39, of Batavia, no address noted, is charged with: driving while intoxicated with a BAC of .08 percent or more and drinking alcohol in a motor vehicle on a highway. Johnson was arrested at 1:24 a.m. on March 2 on Indian Falls Road in Pembroke after she was allegedly found by law enforcement while she was asleep in a motor vehicle with its engine still running. Johnson is due in Town of Pembroke Court on March 21 to answer the charges. The case was handled by Genesee County Sheriff's Deputy Austin Heberlein.

Pembroke Dragons wins first sectional title upsetting Geneseo 43-38

Defense helped Pembroke get passed #1 seed Marion on Thursday and on Saturday, the Lady Dragons again held their opponent in check to clinch the team's first-ever sectional title.

Pembroke, which came in seeded fourth, beat #3 seed Geneseo 43-38 in Class C2.

There are three Class C brackets this year in Section V and only one Class C team will represent Section V against Section VI in the Far West Regional championship game, so tomorrow Pembroke plays Avon, Class C1 champions, to see who will play Oakfield-Alabama, Class C3 champions, for a chance to represent Class C going forward.

Game time tomorrow is 7 p.m. tomorrow at Cal-Mum.

On Saturday, Casey Wertz scored 10 points, Dekari Moss, nine, Emily Peters, nine, Serene Calderon, eight, and MacKenna Johnson, seven.

For Geneseo, Heidi Phelps scored 11 points and Kaniya Jackson scored 10.
