Oakfield biology major recognized as 'Lycoming Scholar' at college in Williamsport, Pa.

Erin Hale, a senior with a major in Biology from Oakfield, was recently recognized as a Lycoming Scholar at the college's annual Honors Convocation in April.

In order to become a Lycoming Scholar, students must participate in five semesters of scholar seminars, be held to more exacting distribution requirements, and conduct independent work that culminates in a scholar seminar presentation during their senior year. Those who partake in scholars have more challenging and stimulating programs of study, participate in independent and interdisciplinary learning, and develop connections with scholars at other colleges and universities.

Lycoming College is a four-year, residential liberal arts and sciences school dedicated to the undergraduate education of 1,400 students. Its rigorous academic program, vibrant residential community and supportive faculty foster successful student outcomes. Law and Order: Bergen teen charged with five counts of sexual misconduct for allegedly having intercourse without consent

Dakota Scott Pocock, 19, of Townline Road, Bergen, is charged with five counts of sexual misconduct following an investigation in the Village of Oakfield. The defendant allegedly had sexual intercourse with the victim without consent five times between August and December. He was issued an appearance ticket for Oakfield Town Court at 5 p.m. on May 16. The investigation was conducted by Sheriff's Deputy Kevin Forsyth and Investigator Bradley Mazur.

Duty E. Caswell, 24, of Hutchins Place, Batavia, was arrested for having a vicious dog. The arrest stems from an incident on March 7 wherein his dog, according to police, attacked two people and another dog. Caswell was issued an appearance ticket and released and is scheduled to appear in Batavia City Court at 10:30 a.m. on May 13. The case was investigated by Batavia Police Officer Stephen Cronmiller.

Devon Schulman, 20, of Liberty Street, Batavia, is charged with second-degree menacing and criminal possession of a weapon, 3rd. It is alleged that at 6:52 p.m. on May 5 Schulman displayed a knife to a subject at an apartment on Liberty Street and made comments that led the victim to believe Schulman intended to use the knife against the victim. Schulman was jailed without bail and was to be in City Court on May 6. The case was investigated by Batavia Police Officer Mitchell Cowen, assisted by Chad Richards.

Shawn C. Smith, 35, of East Main Street, Batavia, is charged with driving while intoxicated, aggravated unlicensed operation, first, and speeding. Smith was arrested at 6:24 p.m. on April 30 following a traffic stop on East Main Street, Batavia, and following arraignment was jailed without bail. He was to be in court May 2. The case was handled by Batavia Police Officer Christopher Lindsay, assisted by Sgt. Dan Coffey.

Shane Michael Green, 28, of Trapping Brook Road, Wellsville, is charged with driving while ability impaired by drugs and moving from lane unsafely. At 7:36 a.m. on May 6, Green was arrested on Batavia-Stafford Townline Road, Stafford, for allegedly driving while the ability to do so was impaired by drugs. The arrest was the result of a complaint for erratic operation of a motor vehicle. Green is to be in Town of Stafford Court on June 6. The case was handled by Sheriff's Deputy Kyle Krzemien, assisted by Deputy Christopher Parker.

Ryan James Sundown, 35, of Meadville Road, Tonawanda Indian Reservation, is charged with second-degree criminal contempt. He allegedly violated a complete stay away order of protection at 6 p.m. on April 25 on Council House Road. He was arraigned on the charged on May 5 in Alabama Town Court. The case was handled by Sheriff's Deputyt Kevin McCarthy, assisted by Deputy Kyle Krzemien.

A 17-year-old female who lives in Batavia was arrested at 4:06 p.m. on May 2 and charged with fourth-degree criminal mischief. She allegedly broke a window during an argument. She was issued an appearance ticket for May 17 in City Court. The case was handled by Batavia Police Officer Christopher Lindsay, assisted by Arick Perkins.

Jany Girwath Jock, 20, of Batavia Stafford Townline Road, Batavia, is charged with identity theft, 3rd. The defendant was arrested following the investigation into the unlawful use of a credit card at 10:30 p.m. on May 3. Jock was issued an appearance ticket returnable to Batavia City Court at a later date. The case was handled by Sheriff's Deputy Ryan DeLong.

Mary Finnegan, 68, of Lake Street, Le Roy, was arrested on May 7 and charged with one count of criminal trespass in the second degree, a Class A misdemeanor. Le Roy Village Police Department responded to a local apartment house after receiving a complaint of a subject on the property trespassing. Upon arrival Finnegan was allegedly located on the property after she had previously been advised she was no longer allowed on the property. Finnegan was taken into custody and charged accordingly. Finnegan is to appear in the Le Roy Town Court on May 19 to answer to the charge.

Traffic being slowed on Route 63 in Batavia and Oakfield for fuel spill

A diesel fuel spill has been located along Route 63 that stretches across both sides of Batavia Oakfield Townline Road.

Oakfield fire is on scene and a Town of Batavia chief is responding.

The Oakfield chief is asking that traffic in the area be slowed by fire police because of the spill.

O-A kindergarten registration is next week

Oakfield-Alabama kindergarten registration is scheduled for Monday, May 2nd through Friday, May 6th at the elementary school office between the hours of 9 p.m. and 2 p.m. It is located at 7001 Lewiston Road in Oakfield.

Information packets have been sent to families. If you did not receive a packet or are new to the district, please notify the elementary office at 948-5211, ext. 3211 and we will send one to you.

Please bring the following mandatory documents with you: a completed Student Information Form (from the packet received in the mail), your child’s birth certificate, two proofs of residency, a current immunization record and a current physical examination.

Only children who have reached their 5th birthday on or before Dec. 1, 2016 may be registered for the 2016-2017 school year.

Law and Order: Brockport man jailed without bail after citizen's tip on suspicious vehicle leads to arrest on drug charges

Thomas L. Hill Jr., 26, of Fayette Street, Brockport, is charged with: unlawful possession of marijuana; two counts of criminal possession of a controlled substance in the third degree; and second-degree criminally using drug paraphernalia. Hill was arrested at 8:15 p.m. on April 21 after a citizen complained of a suspicious vehicle on Hutchins Place. Police located the vehicle in the parking lot of the Circle 3 Food Mart on Ellicott Street. An investigation allegedly revealed crack cocaine, drug paraphernalia and a small amount of marijuana inside the vehicle. Hill was jailed without bail and is to appear in City Court today. The case was handled by Batavia Police Officer Christopher Lindsay, assisted by Officer Chad Richards.

Chevaughn D. Hanson, 22, of East Main Street, Batavia was arrested for disorderly conduct following an altercation at 3:27 p.m. on April 19 on East Main Street with another male. Hanson is accused of engaging in violent, tumultuous and threatening behavior. He was issued an appearance ticket for City Court on April 26. The case was handled by Batavia Police Officer Arick Perkins, assisted by Officer Stephen Cronmiller.

Dylan B. Boykins, 43, no address provided, is charged with disorderly conduct -- fight/violent behavior. Patrols were dispatched to Highland Park near Jackson Street at 1:34 p.m. on April 16 for a reported altercation between a male and female. Boykins, who was located a short time later, was arrested following an investigation into the disturbance. Boykins allegedly shoved and attempted to strike another person and was arrested. The case was handled by Baavia Police Officer James DeFreze, assisted by Marc Lawrence.

Maggie S. Dipilato, 22, of Nelson Street, Holley, is charged with second-degree criminal contempt, and criminal use of drug paraphernalia. Dipilato was arrested on April 18 following a domestic incident on Hutchins Street on April 13 in which she allegedly violated a complete stay away order of protection. Dipilato was allegedly found in possession of drug paraphernalia and was jailed on $1,000 bail. The case was handled by Batavia Police Officer  Christopher Lindsay.

James R. Kosiorek, 23, no permanent address, is charged with criminal possession of a loaded weapon. He was allegedly in possession of a loaded hanbdgun in November 2014 that had previously been stolen from a vehicle in the Town of Le Roy. He was arrested on this charge April 21 while he was in Genesee County Jail on unrelated charges. He had $1,000 bail on this charge. The case was handled by Sheriff's Deputy Gregory Walker.

Ashli N. Zajaczkowski, 25, of Walnut Street, Batavia, is charged with unlawful possession of marijuana. Zajaczkowski was arrested at 7:48 p.m. on April 21 following a traffic stop during which the investigating officer detected the odor of marijuana. The officer allegedly located an amount of marijuana that would be consistent with personal use in the vehicle. Zajaczkowski was issued an appearance ticket for City Court for May 3. Batavia Police Officer Peter Flanagan investigated the case.

Cody E. Snyder, of East Shelby Road, Oakfield, is charged with offering a false instrument in the first degree and possession of a forged instrument in the second degree. Snyder was arrested on April 18 following an investigation into a complaint filed by Genesee County Probation. The incident occurred on Dec. 29, 2014. He was jailed in lieu of $10,000 bail. The case was handled by Batavia Police Officer James DeFreze, assisted by Officer Jason Ivison.

James A. Mitchell, 37, of Jackson Street, Batavia, was arrested on a bench warrant out of Batavia City Court after allegedly failing to pay a fine associated with a disorderly conduct violated issued on April 5 on West Main Street, Batavia. He was released after posting $100 bail. The case was handled by Batavia Police Officer Jason Ivison.

Michael Givonnie Chance, 18, of 145th Road, Springfield Gardens, is charged with unlawful possession of marijuana. At 8:34 p.m. on April 19, Chance was allegedly found to be in possession of a small quantity of marijuana on Batavia-Stafford Townline Road and was arrested and issued an appearance ticket for Town of Batavia Court on April 25. The case was handled by Sheriff's Deputy Kyle Krzemien and Deputy James Diehl.

Rochester man arrested for crashing into Oakfield 7-Eleven Tuesday

Press release from the Genesee County Sheriff's Office:

The Genesee County Sheriff's Office investigated a motor-vehicle accident at the 7-Eleven convenience store on South Main Street in Oakfield on April 19 at about 2 p.m.

A motor vehicle crashed into the south wall of the store and immediately fled the scene. The vehicle was later found on Townline Road in Byron occupied by a male operator. The male was identified at Hicham Fathallah, 34, of Rochester. He was charged with leaving the scene of a motor-vehicle accident and inadequate brakes.

He is to appear in the Town of Oakfield Court at a later date and time.

Car crashes into Oakfield 7-Eleven, then leaves the scene

A vehicle crashed into the 7-Eleven convenience store in Oakfield, located at 25 S. Main St., and then it left. Law enforcement is on scene and Oakfield Fire Department is responding. The building is damaged.

UPDATE 2:07 p.m.: Fire command is holding the assignment in quarters.

UPDATE 2:25 p.m.: The car involved is described as an older model red SUV. It was last seen heading toward the city.

UPDATE 3:10 p.m.: A car matching the description of the vehicle involved in this incident is reportedly broken down on Route 262. Law enforcement is heading there.

Law and Order: Porter Avenue man charged with DWI, allegedly allowed teens to smoke pot in his car

Kerry L. Norton, 33, of Porter Avenue, Batavia, is charged with operating a motor vehicle with a BAC of .08 or greater, driving while intoxicated, DWI -- Leandra's Law, and endangering the welfare of a minor. At 2:31 a.m. on April 16, Norton was arrested after being stopped for multiple traffic violations. Norton performed field sobriety tests, which he allegedly failed. Officers discovered that two of his passengers were juveniles under age 16. Officers later discovered that Norton allegedly allowed the children to smoke marijuana in the vehicle while he was driving. He was jailed without bail and set to return to court today. The case was handled by Batavia Police Officer Peter Flanagan, assisted by Officer Eric Foels.

Deniz M. Pirincci, 59, Garden Drive, Batavia, is charged with owning an unlicensed dog and owning a dog running at large. At 9:32 p.m. on March 27, Pirincci's dog was running at large and allegedly attacked another dog that was being walked by its owner on Garden Drive. Following at investigation, he was issued at appearance ticket for April 12. The case was handled by Batavia Police Officer Kevin DeFelice.

Joseph A. Monte, 52, of West Main Street Road, Batavia, is charged with third-degree robbery, second-degree harassment, and criminal obstruction of breathing. He was arrested at 2:32 a.m. on April 17 after an investigation into a domestic incident that occurred a short time earlier on Walnut Street. He was jailed and set to be in court today. The case was handled by Batavia Police Officer Eric Foels.

Carlos Samol, 51, of Libersty Street, Batavia, is charged with second-degree menacing. He was arrested after an incident at 8:07 p.m. on April 17 on Ellicott Street in which Samol allegedly menaced another person with what appeared to be a pistol. He was jailed on $5,000 bail and is to appear in City Court today. The case was handled by Batavia Police Officer Arick Perkins, assisted by Officer Christopher Lindsay. In addition, he was charged with second-degree criminal contempt for allegedly riding in a car with another person in violation of a complete stay-away order of protection. On the latter charge, the case was handled by Officer Christopher Lindsay, assisted by Mitchell Cowen.

Frank J. Finley Jr., 33, of Dellinger Avenue, Batavia, is charged with second-degree harassment and endangering the welfare of a child. Finley was arrested following an investigation into a domestic incident in the city at 11:40 p.m. on April 9. He was due in court on April 11. The case was handled by Batavia Police Officer Felicia DeGroot, assisted by Officer Peter Flanagan.

Riley J. Cole, 20, of Garibaldi Avenue, Oakfield, is charged with second-degree harassment. The charge stems from an incident on Walnut Street at 3:50 p.m. on April 8 wherein Cole allegedly struck an ARC staff member in the face. Cole is to appear in City Court Tuesday. The case was handled by Batavia Police Officer Christopher Lindsay, assisted by Officer Chad Richards.

Zachary Vernon Seeley, 19, of East Main Street, Batavia, is charged with second-degree harassment and fourth-degree criminal mischief. He was arrested following an altercation at 3:11 p.m. on April 13 at 555 E. Main St. with another resident at that location. Seeley allegedly became upset with the other resident and punched a hole in a wall there, prior to allegedly shoving the other resident. He was jailed in lieu of $500 bail and was due in court on April 14. The case was handled by Batavia Police Officer Chad Richards, assisted by Officer Stephen Cronmiller.

Taheed M. Moffett, 31, of Turner Street, Rochester, is charged with criminal mischief -- $250 in damages, resisting arrest and second-degree obstruction of governmental administration. Moffett was arrested at 8:56 p.m. on April 19 on Pearl Street. The defendant was to appear in April 12. The case was handled by Batavia Police Officer Matthew Wojtaszczyk, assisted by Officer Christopher Lindsay.

Scott D. Higgins, 35, of West Main Street Road, Batavia, is charged with aggravated driving while intoxicated, with a BAC of .18 percent or more, DWI -- common law, third-degree aggravated unlicensed operation, failure to use headlights, and operation of a motor vehicle by an unlicensed driver. At 2:22 a.m. on April 16, officers conducted a traffic stop on a vehicle without headlights on West Main Street at Burger King. Higgins was allegedly found to be operating the vehicle while intoxicated and he was subsequently arrested for DWI and issued tickets. He is scheduled to be in City Court on April 27. The case was handled by Batavia Police Officer Arick Perkins, assisted by Officer Matthew Wojtaszczyk. Higgins was subsequently arrested at 1 p.m. on April 19 for failure to appear on a charge stemming from an incident on Aug. 12, 2014, on West Main Street.  He was jailed, then released after posting $200 bail. He is to appear in City Court on this matter Tuesday. The case was handled by Officer Wojtaszczyk, assisted by Officer Perkins.

Christopher Michael Barone, 33, of Lawrence Avenue, Corfu, is charged with criminal possession of a controlled substance, 7th, and second-degree aggravated unlicensed operator. He was arrested at 7:59 p.m. on April 8 after a traffic stop on Main Street in Batavia. He was found to have a suspended driver's license (14 suspensions on four dates) and also had an active warrant out of the Town of Batavia for third-degree aggravated unlicensed operator. He was also allegedly found to possess cocaine. He was jailed on $1,000 bail and was to be in City Counrt on April 11. The case was handled by Batavia Police Officer Darryle Streeter.

Terry L. Travis Jr., 33, of Pringle Avenue, Batavia, is charged with driving while intoxicated, first offense, aggravated unlicensed operation of a motor vehicle, 3rd, refusal to take a breath test and illegal signal. He was arrested at 1:38 p.m. on March 25 and released with an appearance ticket for City Court on April 27. The case was handled by Batavia Police Officer Matthew Wojtaszczyk, assisted by Officer Eric Foels.

Robin D. Dixon, 28, of Barbie Court, Rochester, is charged with driving while intoxicated, driving while intoxicated -- common law, and driving the wrong direction on a one-way street. Dixon was arrested at 2:08 a.m. on April 9 after she was observed allegedly driving the wrong way on a portion of School Street, downtown. After a traffic stop, she was arrested for allegedly driving in an intoxicated condition. She is to be in court on April 20. The case was handled by Batavia Police Officer Arick Perkins, assisted by Officer Matthew Wojtaszczyk.

Brian V. Bisig, 29, of Transit Road, Elba, is charged with having insufficient tail lamps and second-degree aggravated unlicensed operation. At 9:47 p.m. on April 14, Bisig was stopped for having a defective tail lamp in the area of West Main and River streets. He was arrested and posted $200 bail and is to be in City Court on April 27. The case was handled by Batavia Police Officer Chad Richards, assisted by Officer Christopher Camp.

Johnney Lee Shannon, 57, of Creek Road, Batavia, is charged with seventh-degree criminal possession of a controlled substance and unattended motor vehicle. Shannon was arrested at 1:06 p.m. April 11 on West Main Street Road, Batavia, after allegedly leaving his vehicle running unattended in the parking lot of a local business. The defendant was issued an appearance ticket for City Court on May 3. Subsequently, Shannon was arrested on a warrant out of Wyoming County. The case was handled by Batavia Police Officer Jason Davis, assisted by Officer Marc Lawrence.

Nathan S. Love, 23, of Montclair Avenue, Batavia, is charged with failure to appear. He was arrested on a City of Batavia warrant that was issued after he failed to appear on a charge stemming from an incident on Feb. 27 on West Main Street, Batavia. He was jailed on $500 bail and was to be in City Court this afternoon. The case was handled by Batavia Police Officer Arick Perkins, assisted by Officer Felicia DeGroot.

Gregory F. Frieday, 31, of Osterhout Avenue, Batavia, is charged with criminal trespass and criminal mischief -- intent to damage property. He was arrested at 11:20 p.m. on April 9 and was issued an appearance ticket for court on May 3. The case was handled by Batavia Police Officer Matthew Wojtaszczyk, assisted by Officer Eric Foels.

Timothy J. Wood Sr., 27, of Oak Street, Batavia, is charged with second-degree harassment. He was arrested at 12:30 p.m. on April 3 following an investigation stemming from his allegedly threatening individuals. He was jailed on $1,000 bail and was to be in court on April 7. The case was handled by Batavia Police Officer Stephen Cronmiller.

Kyle Ratulowski, 20, of West Main Street Road, Batavia, was arrested on two counts of petit larceny after attempting to pawn items he allegedly stole from unsecured vehicles overnight while in the City of Batavia. He was issued an appearance ticket and is to be in City Court on Tuesday. The case was handled by Batavia Police Officer Jason Davis. Deputy Young from the Genesee County Sheriff's Office assisted in the investigation. The Sheriff's Office also had charges on Ratulowski for allegedly stealing items from unsecured vehicles in the Town of Batavia. He was jailed on those charges.

Kiha S. McNear, 18, of 1/2 Walnut St., Batavia, was arrested at 9:45 a.m. on April 11 after police responded to a report of a physical altercation in the parking lot of Tim Horton's. While police were interviewing multiple subjects, McNear became upset that poluce had stopped him and allegedly started using absive language and shouting obscenities and racial epithets toward police. He was subsequently arrested and issued an appearance ticket for city court at a later date. The case was handled by Batavia Police Officer Marc Lawrence, assisted by Sgt. Daniel Coffey. The case was handled by Batavia Police Officer Christopher Lindsay, assisted by Officer Kevin DeFelice.

Kasey J. Wagner, 34, of Fletcher Chapel Road, Shelby, is charged with failure to appear. Wagner was arrested on a warrant issued her failure to appear in court on a charge of third-degree aggravated unlicensed operation. Wagner was jailed on $250 bail and was due in court April 11.

Christina A. Cotter, 23, of Ellicott Street, Batavia, charged with second-degree criminal contempt. Cotter was arrested on April 4 after violating a complete stay-away order of protection issued by City Court by allegedly sending several text messages to the protected party. Cotter was to be in court April 12. The case was handled by Batavia Police Officer Jamie Givens.

Ralph A. Golding, 51, of Broadway, Alden, was arrested April 11 on a bench warrant out of City Court. The warrant was issued after Golding allegedly failed to pay a fine in relation to a conviction for petit larceny. The defendant was due in court April 13. The case was handled by Batavia Police Officer Christopher Lindsay.

Kathryn F. Long, 21, of Harris Road, Le Roy was arrested on April 14th by the Le Roy Police Department and charged with petit larceny, a Class A misdemeanor. Long was arrested following a complaint of an alleged larceny in progress from Tops Market located in the Village. Long allegedly took $5.89 worth of merchandise from Tops. She was issued an appearance ticket and is to appear in Le Roy Town Court on May 19.

Kenneth A. McJury, 52, of 1/2 Highland Park, Batavia, is charged with petit larceny. McJury was arrested following an investigated into a larceny at 5:57 p.m. April 6 at the Kwik Fill on Jackson Street. He was issued an appearance ticket for City Court on April 12. The case was handled by Batavia Police Officer Stephen Cronmiller, assisted by Arick Perkins.

Tyler D. Price, 23, of East Main Street, Batavia, was arrested at 1 p.m. on April 12 on a bench warrant. Price was released on an appearance ticket and was to be in City Court on April 12. The case was handled by Batavia Police Officer Matthew Wojtaszczyk, assisted by Officer Peter Flanagan.

Plans for new Arby's Restaurant on Lewiston Road put on hold

County planners expected a detailed discussion last night about a proposed Arby's restaurant at 8364 Lewiston Road, Town of Batavia, but the applicant withdrew the application earlier in the day.

County Planning Director Felipe Oltramari said he expects the proposal to come back to the planning board at a later date, perhaps as soon as the meeting next month.

There are a few variances needed for a 2,000-square-foot fast-food restaurant at the location, which is across from Kmart where a used car lot is now and next to Jerry Arena's Pizza.

The zoning code for the town requires a 40,000-square-foot lot for such an establishment, but the lot size at this location is only 29,664 square feet.

The builders are proposing parking spaces of 9x18 feet, instead of the required 10x20 feet.

The restaurant will also require three signs instead of the permitted two, with one being a bit larger than the sign ordinance allows.

The owner listed on planning documents is Bill Meland, with a business address of the current Arby's location on West Main Street in the City of Batavia.

In other matters brought to the board Thursday night:

  • The Chamber of Commerce received approval plans to remodel 8276 Park Road, Batavia, which will become the new headquarters for the chamber and the visitors' bureau once it's completed. The project includes a building addition, facade renovations, a new roof and a new accessible ramp.
  • Richard Mistretta is planning to open a record store at 220 E. Main St., Batavia, and received approval for his sign.
  • The Town of Batavia is planning to revise its zoning code to remove the requirement that certain properties in industrial parks be directly accessed from a state highway. The town has granted three variances in recent years and since there might be addition variance requests that would likely be granted, the town is seeking to remove the requirement altogether.
  • The Town of Alabama is extending its moratorium on commercial development for 12 months. This is the third extension sought by the town.
  • Daniel Miller and Padrna Kasthurirangan were approved for a windmill at 10021 Simonds Road, Corfu. The windmill will stand 121 feet tall.
  • The new Waggin (sic) Wheel Restaurant at 8282 Park Road, Batavia, was approved for outdoor cooking and a change to the commercial sign.
  • Suzanne Schultz received permission to hold craft classes at 57 Main St., Oakfield.

The county planning board is not the final word on application approvals. Their approvals are recommendations. Final decisions rest with the planning or zoning boards in each jurisdiction.

Law and Order: Sex offender arrested for allegedly failing to register change of address, Oakfield woman charged with DWI

Kevin C. Greene, 61, of Bloomingdale Road, Akron, is a convicted sex offender who is charged with failure to notify an address change within 10 days. He was arrested March 11 at noon for allegedly moving out of his residence in February 2015 and not filing an address change within 10 days. He was issued an appearance ticket and is to appear in Batavia City Court on April 26. The case was investigated by Batavia Police Det. Eric Hill.

Carmelina Munoz Chavez, 48, of Sunrise Parkway, Oakfield, is charged with driving while intoxicated. She was arrested at 12:40 a.m. on April 10 following a complaint of a motor-vehicle accident in the Town of Byron. The defendant's vehicle was located and upon investigation, the defendant was arrested for allegedly driving while intoxicated. She was issued an appearance ticket and is to appear in Oakfield Town Court on May 9. The case was investigated by Sheriff's Deputy Ryan DeLong.

Oakfield Town Hall to be dedicated this Sunday, public invited to tour $3 million facility

More than seven years in the making, and nearly a year under construction, the new Oakfield Town Hall at 3219 Drake St. will be open for touring from 2 to 5 p.m. Sunday, April 10.

A dedication ceremony is planned at 2:30 with Oakfield Town Supervisor Carol Glor, and guests Genesee County Legislature Chairman Ray Cianfrini and Assemblyman Steve Hawley.

Light refreshments will be served.

The facility has been completely refurbished and 5,000 square feet was added on the back side. It includes a new bay for the Highway Department, new offices, including one for law enforcement (Sheriff's deputies/Troopers), a courtroom shared by Oakfield and Elba, the Town Hall and meeting rooms. The space can accommodate 300 people and be partitioned with an optional center divide.

"It can be used in the event of a disaster," said Town Assessor Barry Flansburg. "It's all up to code, with a handicap accessible entrance and new bathrooms."

He said $2.6 million of the total $3 million cost came from borrowing the money from a bank, which voters permitted passively. Once announced, no referendum for a vote materialized, thus the expenditure was approved de facto.

"This was done as part of our normal operations," Flansburg said. "There was no tax impact."

The remainder was funded with reserves and grant money, which typically trickles in well after the fact.

In addition to residents and the general public, businesses, highway departments, contractors, and "everyone we worked with over the years" are invited to attend this Sunday, says Flansburg.

UPDATED: House fire reported on Knowlesville Road, Alabama

A wood-frame, fully involved house fire, with smoke and flames shooting through the second story, is reported at 6324 Knowlesville Road, Alabama, near Roberts Road. The structure has been evacuated. Alabama Fire Department and Mercy medics are responding.

UPDATE 11:15 p.m..: Oakfield Fire Department is also called to respond, mutual aid. Fire Police are called to shut down Knowlesville Road at Roberts Road. The emergency West Battalion Fire Chanel has been secured for Alabama and Oakfield.

UPDATE 11:26 p.m.: Pembroke and Indian Falls fire departments are asked to stand by in Alabama's hall.

UPDATE March 18: from our news partner, WBTA: The house was extensively damaged and declared uninhabitable. Two adults and three dogs all made it out safely – one dog, did not. The family is staying with relatives. Firefighters from Alabama, Oakfield and Shelby battled the blaze.

Robbery in Oakfield

Robbery this morning in the Village of Oakfield.
Genesee County Sheriff’s deputies are investigating a robbery of the 7-11 Store in on Main Street in Oakfield.
Deputies say two masked men entered the store about 2:30 this morning.
They forced the store clerk into a back room and demanded the code for the cash register.
The two then scooped up cash and fled the building.
The clerk was not injured.
Deputies said the thugs displayed some type of object during the heist but did not describe it as a weapon.

Law and Order: Felony DWI charge following rollover accident on Liberty Street

Jason E. Hammond, 34, of Ross Street, Batavia, is charged with felony DWI, felony driving with a BAC of .08 or greater, speed not reasonable and moving from lane unsafely. Hammond was arrested following a single-vehicle accident at 2:24 a.m. Sunday on Liberty Street, Batavia. Hammond's vehicle hit a utility pole and flipped over. The accident was investigated by Officer Felicia DeGroot. Hammond was ordered held without bail. (Previous coverage).

Victoria M. Fleck, 22, of Wood Street, Batavia, is charged with second-degree harassment and criminal obstruction of breathing. Fleck was arrested following a reported domestic incident at 11:45 p.m., Sunday. Fleck was held on $750 bail.

Timothy J. Becker, 51, of Ellicott Street, Batavia, is charged with second-degree harassment. Becker was allegedly involved in a domestic incident at 11:30 p.m., Saturday.

Matthew Joseph Engert, 24, of Geddes Street, Holley, is charged with aggravated harassment. 2nd. Engert was arrested on a warrant stemming from a criminal complaint reported at 11:22 p.m., Nov. 2. No further details released. Engert was jailed on $1,000 bail.

Donald Robert Rock, 58, of Judge Road, Oakfield, is charged with felony DWI, felony driving with a BAC of .08 or greater, failure to keep right and driving left of pavement markings. Rock was stopped at 11:29 p.m. Friday on Kelsey Road, Batavia, by Deputy Ryan DeLong.

Jason William Penny, 31, of Maple Lane, Susquehanna, Pa., is charged with petit larceny. Penny is accused of shoplifting at Target.

Oakfield fire takes delivery of bright red engine

Oakfield Fire Department has a new pumper. Well, not new, exactly. It's what's called a demo model, so it's like new, but allows the department to upgrade at a lower price.

The department spent $356,000 on the new engine, which is red, continuing the department's evolution away from lime green apparatus.  

The pumper is "an attack truck." It will be dispatched first to the scene of a fire for equipment and manpower. It's a side pumper and cab-over, which increases cargo space as well as personnel space.

The department took delivery of the new engine last night and expects to have it in service in about a week.

Two more defendants in racketeering case enter guilty pleas in district court

Two more people involved in a racketeering case that also involved a pair of Genesee County residents have entered guilty pleas in U.S. District Court.

The pleas are the latest in a string of convictions in the case for federal authorities.

Robert W. Moran Jr., 63, of Rochester, entered a guilty plea to a count of conspiracy to commit assault with a dangerous weapon in aid of racketeering. Gina Tata, 52, also of Rochester, entered a guilty plea to being an accessory after the fact.

Both defendants face possible federal prison terms and potential six-figure fines.

Authorities say Moran was an officer with the Hells Angels in Rochester and was involved in an assault at Spenders Bar on Lyell Avenue, Rochester, that involved an attack on a victim with a baseball bat. Authorities say Moran was the attacker and beat the victim on the head and body after the person made disparaging remarks about motorcycle clubs, including the Hells Angels.

"The defendant committed the assault order to maintain his position in the Rochester Hells Angels," said federal prosecutors.

Tata was the bartender that night and tried to help Moran evade arrest and prosecution. It was Tata who informed Moran of the remarks by the patron, prosecutors said. She then lied to police about the identity of the attacker and counseled other eyewitnesses not to speak to provide identifying information to police. She helped another member of the Hells Angels retrieve a hard drive containing recordings of the interior of the bar at the time of the attack.

"In May 2007, a year after the assault, Tata lied to the FBI about the perpetrators of the assault, describing them as tall, young Hispanic males, and falsely told the FBI that she used the phone at Spenders Bar only to call 9-1-1 and the owner of the bar," prosecutors said.

These pleas are part of a larger investigation that resulted in the indictment and arrest of members and associates of the Rochester and Monterey (California) Hells Angels for drug trafficking and racketeering-related offenses in February 2012. Hells Angels President Richard W. Mar, and Jeffrey A. Tyler, were charged with conspiracy to possess with intent to distribute, and to distribute, 500 grams or more of methamphetamine. Five other defendants – Henry McCauley, Donna Boon, Paul Griffin, Richard E. Riedman, and Gordon L. Montgomery – were convicted for their roles in the methamphetamine conspiracy. Judge Siragusa sentenced Griffin to probation and Riedman to 37 months in prison. McCauley, Boon and Montomgery are awaiting sentencing. Another defendant, Timothy M. Stone, was convicted and of being an accessory after the fact to the assault and conspiracy, and was sentenced to 12 months in prison.

McAuley and Boon are residents of Oakfield.

Sentencing is scheduled for 10:15 a.m. and 11 a.m., respectively, May 25.

Oakfield residents admit roles in meth distribution ring in federal court

A former Hells Angels vice president whom authorities say is an Oakfield resident entered a guilty plea in U.S. District Court today to a methamphetamine distribution charge.

James Henry McAuley faces a mandatory minimum sentence of 10 years in prison and a potential $4 million fine.

The Democrat and Chronicle reported this morning that McAuley intended to plead guilty to help spare his wife, Donna Boon, 50, of Oakfield, a potential prison term.

Boon also entered a guilty plea today, to a count of conspiracy to possess with intent to distribute, and to distribute, methamphetamine.

Federal prosecutors accused McAuley of leading a methamphetamine ring from 2002 through July 9, 2010. At the time, McAuley was reportedly a vice president with the Hells Angels.

McAuley was reportedly obtaining the meth from a source in Monterey, Calif.

According to authorities:

The defendant and other members of the conspiracy traveled to California on numerous occasions to obtain pound-size quantities of methamphetamine from the supplier they then transported or shipped from California to the Rochester area where another member of the conspiracy would sell it to their customers.

On July 9, 2010, federal and local authorities, working together, concluded a lengthy investigation that included drug buys, wiretaps and video surveillance, and arrested five people on meth distribution charges.

The five arrested did not include McAuley, but did include Boon, along with Donald G. Vanelli II, who was eventually sentenced to 17 1/2 years in prison.

The charges against Boon from that arrest were eventually dropped and Boon contacted The Batavian to proclaim her innocence.

McAuley was arrested in April 2008 on racketeering charges and authorities contend that McAuley continued to maintain control over the meth ring.

According to prosecutors:

McAuley’s wife, Donna Boon, distributed quantities of methamphetamine to others, including an individual in Genesee County, who further distributed the drugs to customers in the Genesee County area. Boon admitted to trafficking up to 30 grams of methamphetamine.

McAuley and Boon are scheduled to appear for sentencing at 10 a.m. and 11 a.m., respectively, May 24.

Law and Order: Ross Street resident accused of strangulation and theft

Adam M. Kruetz, 27, of Ross Street, Batavia, is charged with strangulation, 2nd, petit larceny and criminal mischief, 4th. Kruetz allegedly grabbed the throat of another person at 10:20 a.m. Sunday at 5 Ross St., Batavia, and caused that person to nearly lose consciousness, then stole property and broke an item belonging to that person. Kruetz was jailed without bail.

Elizabeth A. Wortman, 28, of Lake Street, Le Roy, is charged with DWI, driving with a BAC of .08 or greater and driver's view obstructed. A witness reported a vehicle driving erratically on Lake Street Road, Le Roy, on Monday. A Le Roy PD patrol stopped Wortman's vehicle on Lake Street and Wortman was allegedly found to be intoxicated.

Michael J. Elmore, 25, of Liberty Street, Batavia, is charged with criminal impersonation. Elmore was located in the parking lot of 305 E. Main St., Batavia, and Elmore allegedly provided false identification to a Batavia police officer in an attempt to avoid arrest on a warrant.

Joseph A. Auricchio, 25, of Broadway Road, Darien, is charged with possession of a hypodermic instrument. Auricchio was allegedly found in possession of a needle at 4:53 p.m. Monday at a location on South Main Street, Batavia.

Brant Gordon Matthews, 21, of Maple Avenue, Le Roy, is charged with unlawful possession of marijuana. Matthews allegedly showed up to a probation meeting at 2:08 p.m. Monday with marijuana in his pocket.

Tyler D. Price, 23, of East Main Street, Batavia, was arrested on a warrant for alleged failure to meet conditions of sentencing.

Todd Patrick Galen, 53, of Merrill Road, Byron, is charged with criminal contempt, 2nd. Galen allegedly violated a court order by failing to comply with animal control regulations.

Tyler J. Penepent, 21, of Oakfield, is charged with petit larceny. He allegedly stole a car lighting bar worth $12.96 from WalMart. 

Kristen E. Dwyer, 23, of Rochester, is charged with unlawful possession of marijuana. Dwyer was stopped on Judge Road by State Police for an alleged expired registration. She was allegedly found in possession of 3.5 grams of marijuana in a baggie, a glass pipe containing burnt marijuana and a multicolored glass pipe containing burnt marijuana residue.

Man with Genesee County ties given year in federal prison on racketeering charge

An East Rochester man, whom federal authorities say has ties to the Hells Angels, has associates in Genesee County and was arrested in 2009 in Corfu as part of reported scrap metal heist, has been sentenced to 12 months in federal prison on a racketeering charge.

Timothy M. Stone, 36, was convicted of being an accessory after the fact to an assault with a dangerous weapon in aid of racketeering activity.

Stone was convicted of participating in a May 31, 2006 baseball bat attack on a male patron at Spenders Bar in Rochester. Surveillance cameras recorded the attack and the video was stored on a computer hard drive. Stone forcibly removed the hard drive and took the hard drive from the bar and later destroyed the hard drive and the baseball bat used in the attack.

The case is part of a larger investigation that stretches from Monterey, Calif., to Oakfield, with Oakfield residents James H. McAuley Jr. and Donna Boon being charged, along with others, of conspiracy to possess with intent to distribute, and to distribute, 500 grams or more of methamphetamine.  

Gordon L. Montgomery, of Batavia, has already been convicted on the charge. He is scheduled to be sentenced May 3.

Robert W. Moran Jr., of Rochester, and Gina Tata, of Rochester, are charged with assault with a dangerous weapon in aid of racketeering activity; and McAuley is charged with conspiracy.

A jury trial for Richard W. Mar, of Monterey, McAuley, Moran, Boon, Jeffrey A. Tyler, of Rochester, and Tata, is scheduled to begin March 7.
