Rochester man seeks trial on charge stemming from Kid Rock concert

By Howard B. Owens

"I fought the law, and the law won."

Peter H. Scrooby is going to try and do what Bobby Fuller and The Clash said they couldn't do, fight the law and win.

Scrooby asked for a jury bench trial (the charge is not serious enough to warrant a jury trial) tonight in Darien Town Court on his disorderly conduct charge. Scrooby was arrested at the Kid Rock concert July 15. The Batavian featured him as one of three defendants arrested that night as part of a story about the Darien court on a concert night.

While the other two defendants featured in the story long ago accepted guilty pleas and have moved on, Scrooby isn't rolling over for the law.

The Rochester resident has retained Batavia attorney Thomas Burns, and Burns indicated his client doesn't think he did anything to warrant his arrest and the charge.

"It's very important to him," Burns said. "It's a matter of principle. Despite the fact that it's a minor charge, he's willing to invest the time and effort to let the truth be known as to what happened."

Scrooby's trial is set for Feb. 1 at 5:30 p.m. in Darien.

Dog struck by car gets prompt treatment, thanks to deputy and animal control officer

By Howard B. Owens

A dog was hit by a car yesterday at 1:30 p.m. and Deputy Brian Thompson, a K-9 officer, and Animal Control Officer Bill Taylor responded to the scene.

The accident occurred at Route 77 and Reynolds Road, where a stray boxer-mix darted into the road, according to Deputy Chief Gordon Dibble.

The dog was struck by a car driven by a person from Florida.

Thompson and Taylor first took the dog to an animal hospital, which recommended treatment at Corfu Vet Clinic, so Taylor and Thompson transported it there.

From what I heard on the scanner, the dog didn't sound seriously injured. Dibble said there's no information on how the pooch did after being transported.

I spoke with Shannon at the vet, who was off that day, and she said the dog was transferred to another facility, although she doesn't know where.

But it was good to hear on the scanner Monday about the extra effort Thompson and Taylor went to to care for the stricken animal.

Three Genesee County women get endorsement from Eleanor Roosevelt committee

By Billie Owens

Earlier this week, the Eleanor Roosevelt Legacy Committee announced 150 winners of its 2009 Campaign Grants and Endorsements. Three are from Genesee County.

This information is from a press release:

The Eleanor Roosevelt Legacy Committee was designed to build a new generation of pro-choice Democratic women candidates, informed voters and activists in New York State. It was founded in 2001 by former New York State Democratic Committee Chair Judith Hope.

This year, the ERLC awarded Sara Burk-Balbi of Batavia an endorsement in her race for Batavia City Council-at-Large, Alice Burkhardt-Calmes of Darien an endorsement in her race for Town Clerk of Darien and Jennifer Keys of LeRoy an endorsement in her race for LeRoy Town Council.

Genesee County Democratic Chair Lorie Longhany said: "The Eleanor Roosevelt Legacy Committee’s endorsement is very important support for their campaigns and demonstrates confidence in their ability to win these offices. All three wonderful women are proud to be a part of Eleanor’s Legacy."

“To receive such an important endorsement is really an honor,” says Sara Burk-Balbi.  “Eleanor Roosevelt was not only an active First Lady of the United States, she was a front runner on the importance of women in our political system. Her support of women’s issues as well as the issues of children and families was astounding and life-long. I am proud to be one of three women in Genesee County to receive this honor.”

Keys stated: “This shows the commitment that the ERLC has in helping to elect women candidates across New York State. I accept their support with gratitude."

Alice Burkhardt-Calmes said: “I am pleased that this organization realizes the importance of women in local races. It shows their support of grassroots campaigns at the local level."

Since its founding, the ERLC has elected over 400 women to state and local office across New York State and equipped over 600 women with the skills they need to run and win. The ERLC endorses progressive women candidates with a demonstrated commitment to upholding a woman’s right to choose and to promoting the values of the Democratic Party. To be eligible, a candidate must be pro-choice, female, and an enrolled Democrat running for state or local office in the state of New York.

The ERLC will celebrate this year’s grantees at their Annual Fall Luncheon with special guests Abby Disney, Senator Charles Schumer and Senator Kirsten Gillibrand. This year’s luncheon honors Geraldine Ferraro with the Pioneer in Politics – Lifetime Achievement Award.

Quick thinking helps save man stabbed during Motley Crue concert at Darien Lake

By Howard B. Owens

John Michael Bieganski is doing fine now,  but he might not be doing so great if not for the quick action of a group of people willing to step forward and help him Saturday night after he was stabbed in the leg by a knife-wielding assailant.

Bieganski, 23, a Clarence resident, had his leg cut during Cruefest, the concert of Motley Crue at Darien Lake Theme Park.

A friend carried him from the mosh pit (a tangle of dancing males (usually) who typically bang against each other and jump up and down and side-to-side rather violently) after he had been stabbed.

Trouble started for Bieganski, according to a Sheriff's Office report, when he thought he saw a friend being tackled and punched by one or two other men. When he tried to pull one of the men off his friend -- it turned out not to be his friend who was being attacked -- Bieganski said he suddenly felt something warm on his leg, touched it and then saw the blood.

The alleged attacker is described as a white male, about 25 years old, 6-feet tall, a strong build, wearing a gray T-shirt, khaki shorts, with a buzz cut, no glasses and clean shaven.

Bieganski required 28 stitches to close a gaping 4-inch long wound on his leg.

Contrary to initial reports, his artery was not cut, but he did bleed profusely before being treated.

After the attack, Bieganski's buddy, Evan Laczi, grabbed him in a fireman's carry hold and hoisted him from the mosh pit, but according to Glenn Hall, who was one of the first people to come to Bieganski's aid, Laczi and Bieganski came through a whole crowd of people who ignored Laczi's cries for help.

"They had walked past people to get up there (the beer trailer, where Hall was located)," Hall said. "They had walked past a number of people and nobody had done anything, to help him carry his friend or anything like that. Nobody had ran up. I'm sure he screamed out more than once, 'hey, I need help' and nobody ran out to get help or anything."

Hall, a six-year veteran of the Air Force, was a volunteer for a group of recruiters trying to raise funds to help with their recruitment effort (his wife is a military recruiter), and he said when he saw Laczi carrying Bieganski with blood soaking his right leg, his military emergency training just kicked in. He didn't even think about what he needed to do.

"Many soldiers who get this kind of training face this kind of stuff all the time," Hall said. "Overseas and abroad, these are guys are real heroes and they know what they're doing, but every military member gets this kind of training ... but I'd never reached that situation (before) and I didn't know how I would react in that situation (before Saturday night)."

Hall was working the beer trailer when he heard Laczi calling for help and he looked up and saw all the blood on Bieganski's leg.

"My immediate reaction was, 'we need to do something to stop this bleeding,'" Hall said.

His first instinct was to pull off his volunteer T-shirt and then his "wife beater" undershirt, which he ripped into two so it could be used as a tourniquet. Laczi helped place Bieganski on the long towing tongue of the beer trailer (which was covered by a sheet of plywood) while a non-military man who was part of the volunteer group asked, "hey, what can I do?"

Hall had the man put as much pressure on the wound as possible while keeping Laczi's leg elevated. Laczi held onto Bieganski's head. Then Hall went to fetch Darien's security personnel, who came to the scene to confirm the report of a man stabbed, and then called for emergency medical personnel.

It took about 15 minutes, according to Hall, for emergency personnel to arrive.

"The guy was being very compliant," Hall said. "He had bought beer from me earlier that night. He was a very nice guy, but you could tell, he had a very good buzz on. But he was not really moving, not really fighting us. He was just kind of laying there, but you could see that he had a lot of pain going on. At that point, there was nothing we could do but wait for emergency medical personnel to get there."

Hall doesn't want to be painted as a hero who saved a man's life, however.

"Truthfully, I feel like we all did our parts," Hall said. "I'm happy for the guy. It turns out he's alright, but I feel like this was group effort. Everything fell into place like dominoes and the situation was handled the best it could."

"I think the military just pounds it in there so hard and you're constantly trained on it, it almost became like second nature," Hall said.

Bieganski is out of the hospital, but whomever stabbed him is still at large. The Sheriff's Office investigation is ongoing.

Body of Pennsylvania man found in lake at Darien theme park

By Howard B. Owens

A Pennsylvania man who was reported missing after attending a concert at Darien Lake Theme Park on Friday was found dead early Sunday morning in Sunshine Lake by scuba divers investigating his disappearance.

The death of William "Billy" Sutherland, 33, of Bradford, Pa., is not considered suspicious at this time, but the investigation continues.

Sutherland attended the Toby Keith and Trace Adkins concert Friday, but became separated from his friends. The group spent several hours looking for him, but eventually returned home.

When Sutherland did not return to Bradford Saturday, his family and friends drove back to Darien Lake to look for him and contacted the Genesee County Sheriff's Office to report him missing.

After interviews with friends and family, the Sheriff's Office concentrated its search in the parking area, especially in the area of Sunshine Lake, which is located within the parking area.

There is no word on how long the search took. His body was found by divers at 1:30 a.m..
