Police Beat: Sex abuse charged following alleged touching on Darien Lake ride

Alexander Agapii, 31, of Penfield, is charged with sexual abuse, 3rd. Agapii is accused of touching a 14-year-old girl without her consent while on the Lazy River Ride at Darien Lake. Agapii was jailed on $250 bail.

(name redacted upon request), 24, of Tracy Avenue, Batavia, is charged with two counts of criminal contempt. xxxx is accused of getting into an argument with his girlfriend. He allegedly "racked" a shotgun and pointed it at her. After the incident was reported, a warrant was issued for his arrest. He later turned himself in.

Bernard A. Buckenmeyer, 46, of Alexander, is charged with DWI and driving with a  BAC of .08 or greater. Buckenmeyer was stopped by State Police at 9:25 p.m., Sunday, on Hunn Road in Alexander.

Police Beat: Bergen man accused of possessing stolen dirt bike

James C. Oehler, 18, of Route 19, Bergen, is accused of possession of stolen property, 5th. At 9:16 p.m., Sunday, Oehler was allegedly found in possession of a dirt bike that was reported stolen from a residence in the Village of Bergen on July 25.

James Anthony Marchegiano, 22, of Westside Drive, Chili, is charged with a DWI, driving with a BAC of .08 or greater and aggravated unlicensed operation of a vehicle. Marchegiano was stopped at 11:36 p.m., Friday, on Sumner Road by Deputy Chad Minuto. Marchegiano was allegedly observed driving his car in an erratic manner in the parking lot following the Rascal Flatts concert at Darien Lake.

Grant Arnold Sundown, 46, of Skye Road, Tonawanda Indian Reservation, is charged with criminal mischief. Sundown allegedly punched another person in the head. When that person attempted to call 9-1-1, Sundown allegedly ripped the phone line from the wall while the caller was on the phone with Genesee County Emergency Dispatch.

Steven James Scott, 19, of Ford Road, Elba, is charged with trespass and unlawful possession of alcohol by a person under 21. Scott was allegedly on the property of College Village at 12:52 a.m., Friday, without permission.

Narciso Gullen, 36, of Route 98, Elba, is charged with possession of a forged instrument, 2nd. Gullen allegedly tried to use a forged federally issued residency card. He was jailed on $10,000 bail.

Richard Anthony Orlando, 31, of Cable Street, Buffalo, is charged with criminal mischief and unlawful possession of marijuana. At 12:30 a.m., Sunday, deputies responded to a report of a verbal domestic incident at a campsite in Alexander. Orlando allegedly smashed a television set and a fan and turned over a refrigerator. Orlando was jailed on $150 bail.

Joseph Aaron Monkelbaan, 38, of Pratt Road, Batavia, is charged with trespass. Monkelbaan is accused of going onto a neighbor's property at 7:21 p.m., Friday, without permission and causing a disturbance.

Kevin A. Hutzler, 21, of Darien, is charged with DWI, driving with a BAC of .08 or greater and failure to keep right. Hutzler was stopped by State Police at 8:41 p.m., Thursday, on Colby Road.

Anthony R. Cogdill, 40, of Darien, is charged with DWI and driving with a BAC of .08 or greater. Cogdill was stopped by State Police at 9:23 p.m., Thursday, Harper Road, Alexander.

Richard J. Rookey, 77, of Batavia, is charged with DWI, aggravated DWI and moving from lane unsafely. Rookey was stopped by State Police 8:14 p.m., Wednesday, on Clinton Street and East Avenue.

James V. Wells, 25, of Batavia, is charged with resisting arrest and disorderly conduct/obscene gestures. Wells was arrested by State Police at 12:24 a.m., Wednesday at College Village. No further details were released.

Man in horseback riding accident in Darien

A 42-year-old man suffered back injuries after a horsebacking riding accident in Darien. The accident occurred at 9711 Ridge Road.

Darien fire and Mercy EMS are responding. It is reported that the he was on the horse, which reared up, he fell off and the horse sat on him.

UPDATE (1:55 p.m.): Mercy EMS is transporting the injured man to Erie County Medical Center. Darien fire is back in service.

Man who fell on Route 77 calls 9-1-1

Dispatch has received a call from a man on Route 77 in Darien who apparently fell, hit his head, was knocked on unconscious, awoke, then called 9-1-1.

It's unknown how long he was unconscious.

He is still lying beside the roadway. He fell in the area of Darien Lake.

Law enforcement and Mercy EMS are in route.

Four arrests and 19 citations issued at Rascal Flatts concert

The following people were arrested during the Rascal Flatts concert Friday at Darien Lakes Performing Arts Center:

Ramzi J. Abialmouna, of Castlebar Drive, North Tonawanda, is charged with disorderly conduct, harassment, 2nd, and resisting arrest. Abialmouna allegedly refused to leave the area and kicked a deputy while being arrested. He was jailed on $200 bail.

Andrew E. Aguado, 23, of South Maple Street, Warsaw, is charged with disorderly conduct. Aguado allegedly urinated in the roadway.

Eric R. Weitz, 38, of Pine Wood Drive, West Seneca, is charged with aggravated DWI, DWI and following too closely. Weitz was allegedly involved in a car accident in the concert parking lot.

Calebmoises H. Garcia, 24, of Tremont Street, North Tonawanda, is charged with DWI, driving with a BAC of .08 or greater and unlicensed operation. Garcia was allegedly involved in a motor vehicle accident on Employee Road.

Police Beat: Man accused of inappropriately touching two girls at water park

Phillip Antonio Lee Sanders, 20, of Marine Drive, Buffalo, is charged with sexual abuse, 2nd. Sanders is accused of touching two girls under age 14 in intimate spots on their bodies. The alleged incidents were reported Thursday and allegedly occurred at Darien Lake's water park.

Police Beat: Robbery and drug charge follow alleged domestic incident

Christopher Patrick Ball, 28, of Ellicott Street Road, Batavia, is charged with robbery, 3rd, and criminal possession of a controlled substance, 7th. Ball was arrested following an investigation into an alleged domestic incident at 9:55 a.m., Sunday. Ball is accused of stealing the victim's purse. Upon further investigation, Ball was allegedly found in possession of hydrocodone.

Misael O. Rodriguez, 27, of North Clinton Avenue, Rochester, is charged with unlawful possession of marijuana. Rodriguez was reportedly found at 3:33 p.m., Sunday, by security officers at Darien Lake in a parking lot rolling a joint.

Daniel Lee Ward, 23, of West State Street, Albion, is charged with unlawful possession of marijuana. Ward was stopped  for an alleged traffic violation at 9:54 p.m., Thursday, on Route 98 in Batavia by Deputy Patrick Reeves.

Lloyd Peter Parsons, 49, of Broadway Road, Darien, is charged with unlawful possession of marijuana. Parsons was arrested on a warrant out of Orleans County. At the time of his arrest by Deputy Patrick Reeves, he was allegedly found in possession of marijuana.

Michael Joseph Valtin, 25, of Church Road, Bennington, is charged with endangering the welfare of a child. Valtin is accused of having unwanted physical contact with a child while visiting a campground.

Richard B. Smith, 21, of 4753 East Road, Batavia, is charged with DWI, driving with a BAC of .08 or greater and failure to keep right. Smith was stopped at 2:28 a.m., Sunday, by Sgt. Michael Hare of the Le Roy Police Department on West Main Street, Le Roy.

Elizabeth Anne Geddes, 53, of Stepping Stone Lane, Orchard Park, is charged with DWI, driving with a BAC of .08 or greater, driving while impaired by drugs, driving while ability impaired (alcohol and drugs) and criminal possession of a controlled substance. Geddes was stopped by Deputy Chad Minuto at 7:04 p.m., Saturday, in the parking of Darien Lake during the Tom Petty concert.

Chad Michael Wolter, 39, of Mountain Road, Gasport, is charged with harassment, 2nd. Wolter is accused of throwing his girlfriend to the ground, spitting on her and throwing a beer can at her. The alleged incident occurred at 11:10 p.m., Saturday, at 1575 Sumner Road.

Glenn K. King-McDade, 24, of Somers, is charged with DWI, driving with a BAC of .08 or greater and speeding. King-McDade was stopped at 11:17 p.m., Saturday, by Sgt. Michael Hare of the Le Roy Police Department on Clay Street. King-McDade is accused of driving 53 mph in a 35-mph zone.

Joseph Arthur Julyan, 46, of West Bain Street, Albion, is charged with assault, 3rd, and criminal mischief, 4th. Julyan was allegedly involved in a domestic incident where he pushed, grabbed and twisted another person's shoulders. He also allegedly grabbed the other person's mobile phone when the person attempted to call police. Julyan also allegedly violated the terms of his parole by being out of his county of supervision and drinking. He was jailed on $10,000 bail. New York State Parole was notified.

Jayme Roland Lang, 37, of Lewiston Road, Alabama, is charged with computer tampering, 4th. Lang is accused of changing the password on a woman's computer, denying her access to the computer.

Jose L. Rodriguez, 36, of 28 Voss Street, Rochester, is charged with DWI, driving with a BAC of .08 or greater, and failure to maintain the driving lane. Rodriguez was stopped at 2:02 a.m., Saturday, by Officer Kevin DeFelice on Oak Street, Batavia.

Eli R. Graves, 20, and Zachary J. Bourque, 20, both of East Aurora, are charged with burglary, 3rd. They were arrested by State Police for an alleged incident in Darien reported at 10:09 p.m., Friday. No further details were released.

James F. Hemmer, 49, of Elba, is charged with criminal mischief. Hemmer was arrested by State Police at 91 South Main St., Elba, for an alleged incident reported at 11:10 a.m., Thursday. No further details were released.

John T. Reagan, 28, of Cheektawoga, is charged with DWI with a conviction in the previous 10 years. Reagan was stopped by State Police on Sumner Road, Darien, at 11:53 p.m., Thursday.

Timothy D. Moore, of Geneseo, is charged with DWI, driving with a BAC of .08 or greater and failure to stop at a stop sign. Moore was stopped by State Police at 10:14 p.m., Wednesday, on Route 63 and Perry Road, Pavilion.

Alleged hit-and-run driver charged with DWI

A 23-year-old Erie County man is accused of striking a minivan and another car at the intersection of Sumner Road and Route 77 at 8:29 p.m. yesterday.

The driver then allegedly fled the scene and was later located in East Aurora.

Jonathan Paul Murphy is charged with DWI, aggravated DWI, aggravated unlicensed operation, 3rd, leaving the scene of a personal injury accident and failure to stop at a stop sign.

The driver of the minivan reported some pain to Deputy Eric Seppela, but was not seriously hurt. None of the children in the minivan were hurt, Seppela said.

The driver of the third car was also uninjured.

The hit-and-run vehicle was traced to Murphy after Seppela found a license plate from the vehicle at the scene of the accident.

The vehicle was later found by a witness in Erie County and Murphy was reportedly seen going into a building. He was taken into custody by State Police and transported back to Genesee County were he was evaluated for alleged DWI and charged.

UPDATE: Additional details released by the State Police. Murphy was reportedly found in the area of Two Road Road, Marilla, after Trooper Timothy Roof responded to the area where the car was registered and reportedly found it abandoned on Two Road Road. A nearby resident reported to Roof  that he thought someone was in his back yard. Murphy was reportedly found hiding in a corn field.

Tom Petty Concert at Darien Lake: 15 arrests, 22 citations

A 27-year-old Dunkirk man and his 17-year-old companion were accused of dealing hallucinogenic mushrooms prior to the Tom Petty concert at Darien Lake on Saturday.

Both men were jailed on $5,000 bail.

Brett A. Tofil (pictured, left) of Middle Road, Dunkirk, is charged with possession of a controlled substance, 5th. He was also accused of possessing brass knuckles, leading to a charge of criminal possession of a weapon, 4th.

Also arrested was Joseph W. Kulig II (pictured, right), 17, of Custer Street, Buffalo. He was also charged criminal possession of a controlled substance, 5th.

Additional arrests related to the concert:

Adam J. Phillips, 28, of Redman Road, Brockport, is charged with assault, 2nd, trespass and resisting arrest. Phillips is accused of entering the seating area without a ticket several times. When officers attempted to arrest him, he allegedly fled on foot. When apprehended, Philips allegedly fought with officers, punching one in the face and injuring a deputy's finger. Phillips was jailed on $5,000 bail.

Sarah J. Cooper, 19, of Cree-Ton Drive, Amherst, is charged with unlawful possession of marijuana, resisting arrest and two counts of harassment, 2nd. Cooper was allegedly found in possession of marijuana in a vehicle in the parking lot. She is accused of resisting arrest, thrashing about and attempting to get away while being transported to the security office. While being processed prior to arraignment, Cooper allegedly kicked a corrections officer and also kicked a security guard. Cooper was jailed on $1,000 bail. She had also been issued a citation for alleged underage drinking and additional charges may be pending.

Matthew J. Pasternak, 20, of North Ivy Hurst Road, Amherst, is charged with unlawful possession of marijuana, resisting arrest and harassment, 2nd. Pasternak was allegedly yelling and screaming profanities while in the concert venue parking lot. When officers attempted to arrest him, he allegedly fought with them. He was allegedly found in possession of marijuana while being processed prior to arraignment. While EMT personal attempted to treat him for minor abrasions, he allegedly kicked at the emergency personnel. He was jailed on $750 bail. He also had been issued a citation for alleged underage drinking. Additional charges may be pending.

Jonathan Raymond (AKA John Doe),  21, is charged with trespass. He is accused of refusing to leave the concert venue after being instructed to do so several times. The suspect allegedly refused to cooperate and provide information about himself. He was jailed on $1,000 bail.

James R. Ross Sr., 49, and James R. Ross, 25, of Washington Street, Lockport, were charged with disorderly conduct. They are accused of fighting with Darien Lake security while walking from the concert to the campgrounds. They were jailed on $200 each.

Tyler N. Taylor, 25, of Regent Street, Welland, Ontario, Canada, is charged with trespass. He is accused of refusing to leave the parking lot after being told several times to leave. He was jailed on $400 bail.

Eric M. Hallinan, 20, of Sheldon Road, Orchard Park, Jesse P. Hughes, 20, of Tim Tam Trail, Blasdell, and Clayton T. Bainey, 20, of Troupe Street, Buffalo, are all charged with petit larceny for allegedly stealing a charcoal grill from a car in the parking lot.

Myles D. Macleod, 22, of Cedar Street, Akron,  is charged with disorderly conduct. He allegedly physically threatened an officer while in the concert venue.

Sara N. Rogers, 24, of Country Place, Lancaster, is charged with unlawfully dealing with a child, 1st. Rogers allegedly provided alcohol to minors.

Christopher T. Wailand,  28, of Chapel Glenn Drive, Hamburg, is charged with trespass. Wailand allegedly entered the concert venue without a ticket.

Fourteen arrests, six citations at Darien Lake's Brooks & Dunn concert

The following people were arrested by the Genesee County Sheriff’s Department during the Brooks & Dunn concert at Darien Lake Performing Arts Center:

Gregory J. Smith, 23, of Austin Street, Alden, is charged with trespass. Smith allegedly returned to the concert venue after being ejected.

(Name removed upon request), 19, of Heyden Avenue, Orilla, Ontario, Canada, is charged with petit larcney. Gowanlock is accused of stealing Dippin’ Dots while in the Amusement Park. Gowanlock was released on $500 bail.

Alexander Vanloendersloot, 26, of E. Naples Street, Wayland, is charged with disorderly conduct. Vanloendersloot allegedly engaged in a fight in the parking lot of the concert venue. Vanloendersloot was released on $150 bail.

Travis E. Kanaval, 25, of County Route 92, Wayland, is charged with disorderly conduct. Kanaval is accused of allegedly revving his truck engine repeatedly causing annoyance and alarm while in the concert parking lot. Kanaval was released on $150 bail.

Frank W. Hoffman III, 21, of Michigan Street, Wayland, is charged with trespass, resisting arrest and unlawful possession of marijuana. Hoffman is accused of refusing to leave the parking lot and then resisting arrest. Hoffman was also found in possession of a small quantity of marijuana. He was released on $500 bail.

Jamie R. Perkins, 20, of County Route 90, Dansville, is charged with false personation. Perkins is accused of providing deputies with a fake date of birth. Perkins was also issued a citation for possession of alcohol under age 21 after allegedly being found in possession of an alcoholic beverage twice. Perkins was jailed on $300 bail.

A 16-year-old, of Mill Street, Cohocton, is charged with unlawful possession of marijuana and possession of alcohol.

A 16-year-old, of State Route 415, Cohocton, is charged with unlawful possession of marijuana and possession of alcohol.

Hilary E. King, 18, of Coomer Road, Burt, is charged with disorderly conduct and resisting arrest. She is accused of causing a disturbance inside the concert venue.

Tyler A. Austin, 20, of Mill Street, Cohocton, is charged with trespass. Austin allegedly re-entered the concert venue after being ejected. Austin was also issued a citation for allegedly possessing alcohol under age 21.

A 16-year-old, of S. Main Street, Medina, is charged with petit larceny. The youth is accused of stealing a can of beer. He was also issued a citation for allegedly possessing alcohol under age 21.

Bryan E. Ehrhart, 26, of Glendale Avenue, Hamburg, is charged with forcible touch. Ehrhart is accused of touching a female in an intimate area.

Eric A. Eick, 21, of Chestnut Ridge Road, Middleport, is charged with assault, 3rd. Eick is accused of striking another patron causing physical injury.

Ryan J. Eick, 27, of Chestnut Ridge Road, Middleport, is charged with assault, 3rd. Eick is accused of striking another patron causing physical injury.

Person jumps out of car, punctures tires, drives off

On Route 77, Darien, a person jumped out of a black Ford Crown Victoria, ran up to another car and punctured the tires.

The Crown Vic then sped off on Route 77 toward Route 20.

The car is registered at an address in Buffalo.

Erie County Sheriff's is being notified.

UPDATE 1 p.m.: Something is going on with this.  A father has been on the phone with dispatch. A law enforcement officer has said, "well, we can certainly work something out if he's willing to replace the tire." Also, the officer told dispatch to notify Buffalo PD so "they don't have to waste their time."  So, apparently, a subject has been identified and there is more to the story that's not coming across the scanner.

Dispatcher just said the father is returning to Darien and will take care of the tire, purchasing whatever tire needs to be purchased. "He's clearly not happy with his son," the dispatcher said. "He understands what we want?" said the officer. "He's very understanding and cooperative."  Officer: "We can't ask for more than that."

Police Beat: Drug Task Force busts alleged crack dealer

William J. Butler, 40, of 3 Vine St., Batavia, is charged with two counts of criminal possession of a controlled substance, 3rd, and promoting prison contraband, 1st. Butler was taken into custody by members of the Local Drug Enforcement Task Force as part of an investigation into trafficking in crack cocaine in Batavia. Members of the task force, the Genesee County Sheriff's Office and the Batavia Police Department executed a search warrant on Butler's residence. Butler was located in a vehicle on Route 33, Town of Batavia. As a result of the searches, Butler was allegedly found in possession of more than one-half ounce of crack cocaine. While being processed into Genesee County Jail, Butler was also allegedly found to have crack cocaine on his person. The total street value of the crack cocaine is estimated at $1,000. Additional charges may be pending. Butler was jailed with no bail.

Christopher Paul Rutherford, 26, of Cowan Road, Piffard, is charged with petit larceny. Rutherford is accused of giving away an oil change and tire rotation to a friend and fellow employee at 4133 Veterans Memorial Drive, Batavia.

Earl Shateek Anthony Lockhart, 18, of East Main Street, Batavia, is charged with petit larceny. Lockhart is accused of shoplifting from Walmart.

Diane Mary Kotarski, 37, of Lewiston Road, Batavia, is charged with harassment, 2nd. At 3:35 a.m., Kotarski allegedly grabbed a male victim by the neck and slammed him into a car window. Kotarski was arraigned and released and an order of protection was filed barring her from contact with the alleged victim.

Police Beat: Driver charged under Leandra's Law

Shawn Robert Hugar, 24, of Vandermark Road, Scio, is charged with DWI, a felony count of driving with a child under 15 in the car, driving with a BAC of .08 or greater, aggravated unlicensed operation of a vehicle and unsafe backing. Hugar was located at  12:55 a.m., Monday, on Route 77, south of Sumner Road, Darien, after backing his car into a ditch. Upon investigation, Sgt. Greg Walker found Hugar to be allegedly intoxicated and driving with a child in his car (a felony violation of Leandra's Law).

Tina M. Whitbeck, 43, of Penn Yan, is charged with a felony count of DWI, criminal contemp, 2nd, and aggravated DWI (drivng with a BAC of .18 or higher). State Police responded to a call at 8:40 p.m., Sunday, of a car partially blocking Pearl Street Road. The driver was also reported to be acting strangely. Upon investigation, Whitbeck's BAC was allegedly found to be .22. Whitbeck is also accused of traveling with a passenger that she was ordered to stay away from.

Jason Cleveland, 27, of Leroy, is charged with DWI and failure to keep right. Cleveland was stopped at 10 p.m., Sunday, by State Police on Route 77, Darien. Upon investigation, Cleveland was allegedly found to be operating with a BAC of .10.

Lansing H. Gardner, 35, of Lyndonville, is charged with DWI and driving with a BAC of .15. Gardner was stopped by State Police at 9:32 p.m., Sunday, on Colby Road, Darien.

Eric J. Goodwin, 31, of Lockport, is charged with DWI and driving with a BAC of .13. Goodwin was stopped at 12:45 a.m., Monday, by State Police, on Route 77 in Pembroke.

James E. Leair, 19, of Depew, is charged with unlawful possession of alcohol by a person under 21. Leair was cited by State Police at 7:30 p.m., Friday, on Sumner Road, Darien.

Keith A. Harman, 50, of Lancaster, is charged with DWI and aggravated DWI. Harman was stopped at 10:39 p.m., Friday, by State Police on Sumner Road, Darien.

Disturbed concert at Darien Lake: 13 arrests, 8 citations issued

The following people were arrested in connection with the Disturbed concert at Darien Lake Performing Arts Center:

David D. Bull, 27, of West Avenue, Attica is charged with criminal mischief, 3rd, and criminal mischief, 4th. Bull allegedly damaged two vehicles parked in the concert venue parking lot. He was jailed on $500 bail.

Josua N. Roshia, 27, of Van Allen Road, Watertown, is charged with disorderly conduct. Roshia allegedly got into a fight with another patron in the concert area. He was jailed on $250 bail.

David P. Zimmer Jr., 24, of Chapman Parkway, Hamburg, is accused of pushing a security guard while inside the concert venue. Zimmer was jailed on $500 bail.

Michael J. Hayes, 25, of Berger Road, Port Byron, is charged with criminal possession of a controlled substance, 7th, and unlawful possession of marijuana.

Robert P. Albini III, 29, of Sunrise Drive, Amherst, is charged with disorderly conduct and trespass. Albini is accused of fighting with security while being ejected. Albini later allegedly returned to the concert venue, leading to the trespass charge.

Christina T. Anderson, 35, of Fry Street, Rochester, is charged with trespass. Anderson allegedly re-entered the concert venue after being ejected and told not to return.

David Leake, 45, of Strohm Street, Rochester, is charged with trespass. Leake allegedly re-entered the concert venue after being ejected and told not to return.

Patrick J. Brink, 36, of Janet Street, Auburn, is charged with trespass. Brink allegedly re-entered the concert venue after being ejected and told not to return.

James M. Quinlan Jr., 25, of Essex Street, Syracuse, is charged with trespass. Quinlan allegedly re-entered the concert venue after being ejected and told not to return.

Amanda K. Jutze, 23, of Allegheny Road, Darien, is charged with trespass. Jutze was reportedly told several times to leave the concert venue and allegedly refused to leave.

Jason W. Senik, 29, of Upper Mountain Road, Sanborn, is charged with disorderly conduct. Senik is accused of throwing a lit cigarette and striking a security guard with it.

Nicholas P. Miano, 20, of South Lane, North Tonawanda, is charged with false personation. Miano is accused of providing a false date of birth. He was also issued a citation for alleged possession of alcohol under age 21.

A 16-year-old, of Warner Avenue, North Tonawanda, is charged with false personation. The youth is accused of providing a false date of birth. He was also issued a citation for alleged possession of alcohol under age 21.

Three people hurt in accident on Route 77, Darien

Three people were transported to area hospitals Friday evening following a two-car accident on Sumner Road and Route 77 in Darien.

One car allegedly stopped on Sumner at Route 77 but then pulled out on Route 77 while making a left-hand turn and was struck by the second vehicle, which was traveling southbound on Route 77.

The accident occurred at 7 p.m.

The driver of vehicle one is identified as Melissa M. Kenney, 40, of Exchange Street, Irving.

The second driver is Frederck W. Burtis, 30, of First Avenue, North Tonawanda.

Kenney had a passenger in her car, Rosemarie DeGeorge, 41.

Kenney and DeGeorge were taken to ECMC. Burtis was transported to UMMC.

While our initial report indicated that Mercy Flight was dispatched and did land, the accident report indicates all three passengers were taken by ground ambulance to the hospitals.

Toby Keith concert at Darien Lake: six arrests, 36 citations

The following arrests were made in conjunction with the Toby Keith concert on Friday at Darien Lake Performing Arts Center.

Ethan J. Young, 20, of North Road, Churchville, is charged with trespass. He is accused of returning to the concert venue after being ejected and told not to return. Young was jailed on $250 bail.

Stephen Masich IV, 27, of Broad Street, Tonawanda, is charged with disorderly conduct, harassment ,2nd, and robbery, 3rd. Masich allegedly pushed two females while inside the concert venue and stole a cell phone from another woman and threw it. Masich was released on $5,000 bail.

Emily M. Skotnicki, 22, of Sand Pebble Drive, Chili, is charged with disorderly conduct. Skotnicki allegedly yelled obscenities while being ejected from the concert venue.

James R. Phalen, 18, of Four Rod Road, Alden, is charged with harassment, 2nd. Phalen is accused of pushing a security guard to the ground while inside the concert venue.

Tristen L. Johnson, 26, of Cedar Grove Drive, Rochester, is charged with trespass for allegedly being found on the roof of the box office of the concert venue.

Kevin A. Olewniczak, 20, of Lockwood Drive, Lockport, is charged with trespass after allegedly re-entering the concert venue after being ejected and told not to return.

Motor vehicle accident at Route 77 and Sumner Road in Darien

There's a motor vehicle accident with injuries at Route 77 and Sumner Road in Darien. It is blocking traffic.

Darien fire and Mercy EMS have been dispatched and a fire chief has requested information about the availability of Mercy Flight.

UPDATE 7:14 p.m.: Route 77 has been closed in both directions. Mercy Flight should be on scene shortly.

UPDATE 7:17 p.m.: Mercy Flight is on the ground.

Police Beat: Youth from Darien charged with grand larceny

Timothy V. Meyers, 17, of 2481 Walker Road, Darien, is charged with grand larceny, 4th. Meyers is accused of stealing a 2006 Yamaha Blaster four-wheel ATV from a house on Dodgeson Road, Alexander.  The ATV was recovered by Erie County law enforcement at a house in Clarence.

Jeffery Allen Good, 34, of Route 98, Alexander, was picked up on a bench warrant. The charges prompting the warrant were not released. Good was jailed on $500 bail.

Charles Anthony Smalls, 26, of Shefflen Avenue, Bronx, is charged with assault, 2nd. Smalls was a passenger in a car involved in a rollover accident on Route 33, Town of Batavia. Smalls reportedly left the scene of the accident and was located a short time later. When he was identified, deputies learned there was a warrant for his arrest from NYS Parole.

Matthew D. Derrick, 25, of 4036 West Main St., Batavia, is charged with criminal contempt. Derrick allegedly sent eight text messages to a person he was ordered not to contact.

Roger A. Laird Jr., 41, formerly of 11 Mix Place, Batavia, is charged with criminal contempt. Laird was found inside of a particular residence in alleged violation of an order of protection.
