Fourteen arrests, scores of citations at Dave Matthews concert

The following arrests were made Wednesday by the Sheriff's Office during the Dave Matthews Band Concert at Darien Lake Theme Park.

ToniMarie Gigante, 39, of Hallam Road, Buffalo, is charged with disordlerly conduct after allegedly causing a disturbance and refusing to leave the concert venue. Gigante was arraigned and jailed on $250 bail.

Christopher K. Grasso, 30, of Westside Drive, Rochester, is charged with harassment, 2nd, after allegedly pushing an officer who was breaking up a fight. 

Shane M. Curry, 18, of Broxbourne Drive, Fairport, is charged with disorderly conduct after allegedly attempting to fight a deputy in the concert venue. Curry was jailed on $100 bail.

Thomas W. Hummel, 17, of Chapel Hill Drive, Rochester, is charged with criminal possession, of a controlled substance, 7th, and unlawful possession of marijuana after allegedly possessing oxycodone and marijuana.

Michael D. Capezzuto, 19, of Fenwick Lane, Victor, is charged with criminal mischief, 4th, after allegedly jumping onto the hood of a car, causing damage.

John R. Adams, 17, of Welsey Avenue, Buffalo, is charged with trespass after allegedly jumping a fence into a restricted area of the concert venue.

John M. Vandemoortel, 31, of Chadwick Drive, Waterloo, is charged with disordley conduct after allegedly using obscene language, causing a disturbance.

Robert C. Stapleton, 44, of Orchard Street, Ovid, is charged with disorderly conduct after allegedly fighting with security while being escorted from the concert venue.

John J. Stefaniak, 18, of George Street, Hamburg, is charged with criminal trespass, 3rd, after allegedly jumping a fence into the concert venue after being previously ejected from the concert.

Lawrence J. Lent, 20, of Bownshill Lane, Fairport, is charged with trespass after allegedly reentering the concert venue after being told not to return.

Patrick T. Van Vortel, 19, of Garnsey Road, Pittsford, is charged with harassment, 2nd, after allegedly striking a deputy while being ejected from the concert venue.

Matthew D. Wieczorek, 44, of Westminster Avenue, Syracuse, is charged with trespass after allegedly reentering the concert venue after being ejected.

Rachel M. Sanchez, 24, of Lake Street, Angola, is charged with disorderly conduct after allegedly using obscene language and causing a disturbance while exiting the concert venue.

Kristen B. Faricellie, 17, of Wood Acres Drive, East Amherst, is charged with trespass after allegedly entering the concert venue without a ticket.

Darien Lake Theme Park reopens after water main break forces two-hour closure

Press release:

Darien Lake confirms that its amusement park and water park were closed for approximately two hours today, after the water supply was accidentally cut off.

Monroe County Water Authority had been conducting routine maintenance nearby, which adversely affected the park’s water supply at 11:30 a.m. During the outage, Darien Lake’s bathrooms, food service, and water park were affected.

Darien Lake management closed the park at noon for guest safety. The park’s maintenance crews restored service before 1 p.m., and the park was reopened by 2 p.m.

Law and Order: Woman accused of pawning stolen laptop

Stephanie G. Pelkey, 18, no permanent address, is charged with criminal possession of stolen property, 5th. Pelkey allegedly pawned a stolen laptop, using her NYS learner's permit for identification, at Computer and Phone Repair in Batavia.

Nicholas A. Gaudy, 21, of 11 Allen St., Batavia, is charged with petit larceny. Gaudy is accused of stealing alcohol from Main St. Pizza Company.

Brodes J. Gibson, 52, of 13 Thorpe St., Batavia, is charged with grand larceny, 4th. Gibson is accused of taking the wallet of another person on Jackson Street. The wallet allegedly contained a credit card.

Carolyn Anne Laurie, 18, of Clay Street, Le Roy, is charged with petit larceny. Laurie is accused of shoplifting at Kmart. Also charged, Morgan Nicole Scofield, 18, of Clay Street, Le Roy.

Ronald Gregory Carney, 25, of West Main Street, Batavia, is charged with DWI, driving with a BAC of .08 or greater, failure to keep right and moved from lane unsafely. Carney was stopped at 2:14 a.m., Saturday, on Wortendyke Road, Batavia, by Deputy Joseph Corona.

Ettienne Eloy Ayala, 40, of Gelson Street, Buffalo, is charged with aggravated unlicensed operation, 3rd. Ayala was arrested on a warrant following an investigation into a complaint at Target.

Barbara Ann Likely, 55, of Jay Street, Rochester, is charged with unlawful possession of marijuana. Likely was a passenger in a vehicle stopped by Deputy Joseph Corona in Bergen for an alleged traffic violation.

Jacqueline Raj Garrett, 34, of East Main Street, Batavia, is charged with petit larceny. Garrett allegedly stole $39.99 in merchandise from Kmart.

Brandon J. March, 28, of Le Roy, is charged with criminal contempt. Marsh allegedly violated a court order on June 23 in Darien and was arrested by State Police. No further details released.

Kenneth M. Gray, 21, of 77 Myrtle St., Le Roy, is charged with DWI, driving with a BAC of .08 or greater and disorderly conduct. Gray was allegedly in a confrontation June 21 with Alexander A. Chandler, 21, of 25 Bacon St., Le Roy. He also allegedly drove to the Bank of America parking lot while intoxicated. Alexander was also charged with disorderly conduct.

Motorcycle rider accused of reaching speeds of 140 mph during pursuit

It allegedly took 25-year-old Christian John Finkney, a Wyoming resident, a mere 22 minutes to get from the Erie County line to Wyoming early Sunday morning while riding his motorcyle.

That's a distance of nearly 25 miles.

A deputy allegedly clocked his bike at times during the high-speed pursuit at 140 mph.

Finkney faces a laundry list of charges following his arrest by Deputy Patrick Reeves.

Reeves originally picked picked up a speeding motorcycle at 1:15 a.m. while running radar on Route 20 going 80 in the 55 mph. The deputy attempted a traffic stop, but the motorcycle allegedly sped up and started passing passenger vehicles.

The operator was observed allegedly swerving in and out of his lane as he sped east through Darien and Alexander.

The bike driver then reportedly turned onto Molasses Hill Road and started heading south into Wyoming County.

He was eventually stopped on Route 19 in Wyoming.

The State Police and Wyoming County Sheriff's Office assisted in the alleged pursuit along with Deputy Frank Bordonaro.

The South Academy Street resident was taken into custody without incident.

Finkney is charged with:

  • DWI
  • Driving with a BAC of .08 or greater
  • Unlawfully fleeing a police officer
  • Reckless driving
  • Speeding
  • Failure to yield to emergency vehicle
  • Speeding in zone
  • Passing in no passing zone
  • Failure to keep right
  • Unlicensed operator

He was issued an appearance ticket and ordered to appear in Town of Darien Court on July 11 at 5 p.m.

Law and Order: Nine arrests reported in recent days

Alicia M. Stankwick, 21, of 2880 Transit Road, West Seneca, is charged with disobeying mandate. Stankwick was arrested following a complaint of a woman refusing to leave an apartment on State Street, Batavia.

Glenn H. Wright Jr., 43, of 118 Prospect St., Warsaw, is charged with unlawful imprisonment and assault, 3rd. Wright was arrested by Warsaw PD on an arrest warrant out of City Court.

Douglas Scott Sprague, 46, of State Street, Batavia, is charged with a felony count of criminal contempt, 1st, and harassment, 2nd. Sprague was arrested on a warrant issued by Town of Batavia Court.

Timothy Huurman, 23, of Genesee Park Boulevard, Rochester, is charged with DWI, driving with a BAC of .08 or greater, speeding (69 in a 55 mph zone), and refusal to submit to breath test. Huurman was stopped at 11:49 p.m. Sunday on Route 20, Alexander, by Sgt. Ron Meides.

David Michael Snyder, 27, of East Main Street Road, Stafford, is charged with petit larceny. Snyder is accused of shoplifting at Walmart. Also arrested was Destany Ann Marie McNutt, 24, of East Main Street Road, Stafford.

Michael J. Anderson, 24, of Keady Road, Lodi, is charged with criminal contempt, 1st. Anderson is accused of threatening to shoot another person during a phone conversation, which allegedly violated a court order.

Timothy W. Churchill, 45, of Le Roy, is charged with DWI and DWI with a child in the car, and Joanne M. Riggi, 43, is charged with harassment, 2nd, and endangering the welfare of a child. A vehicle allegedly driven by Churchill was stopped by State Police at 5:18 p.m. Friday on South Street Road, Le Roy. No further details released.

Thomas M. Szarleta, 49, of Springville, is charged with DWI, aggravated DWI and improper passing on the right. Szarleta was stopped at 6:04 p.m. Sunday on Sumner Road at Route 77, by a state trooper.

Conor W. Wellott, 25, of North Tonawanda, is charged with DWI. Wellott was stopped at 12:10 a.m. Monday at Route 77 and Route 20 by a state trooper.

Eight people arrested during Zac Brown concert at Darien Lake

The following people were arrested Sunday by the Genesee County Sheriff’s Office during the Zac Brown Band concert at Darien Lake Performing Arts Center.

Thomas R. Cartere, 22, Graver Road, Niagara Falls, is charged with trespass after allegedly jumping a fence into the concert venue.

Patrick J. Conte, 22, Cayuga Road, Niagara Falls, is charged with trespass after allegedly jumping a fence into the concert venue.

Michael J. Adornetto, 24, Foxhunt Lane, East Amherst, is charged with disorderly conduct after allegedly causing a disturbance at the concert venue.

Michael P. Kedley, 35, Daytona Avenue, Webster, is charged with disorderly conduct after causing a disturbance as he was being ejected from the concert venue.

Samuel J. Carrigan, 50, Hayes Road, Montour Falls, is charged with disorderly conduct after allegedly causing a disturbance as he left the concert venue.

Sandra C. Bauer, 53, Meadow Drive, Boston, is charged with trespass after allegedly reentering the concert venue after being ejected and told not to return.

Nicholas H. Nadrowski, 20, Lakeview Road, Lakeville, is charged with trespass and resisting arrest after reentering the concert venue after being ejected and told not to return. Nadrowski then allegedly fought with deputies while being arrested.

Brittany D. McGown , 23, Ash Street, Niagara Falls, Ontario, Canada, was arrested for trespass after allegedly entering the concert venue without a ticket. McGown was released on $100 pre-arraignment bail.

More than 8,500 people showed up at Darien Lake Theme Park today for the Color Me Rad 5K Technicolor Run and Walk. The event, which benefits Special Olympics, puts participants through a course filled with "color bombs" -- storms of colored cornstarch.

Law and Order: Jackson Street resident accused of stealing from Pringle Avenue porch

Ryan D. Shumway, 33, of 104 Jackson St., rear, Batavia, is charged with petit larceny and criminal possession of stolen property, 5th. Shumway was arrested following an investigation by Officer Arick Perkins and Sgt. Dan Coffey into a theft reported Monday of an item from the porch of a residence on Pringle Avenue.

Jacob T. Bell, 21, of 205 Washington Ave., lower, Batavia, is charged with assault, 3rd. Bell is accused of being involved in a fight with a family member at 5:10 a.m., Wednesday.

A 17-year-old resident of Coe Avenue, Oakfield, is charged with trespass. The youth is accused of trespassing on property owned by Bonduelle USA, Inc., in the Village of Oakfield. Three other youths were referred to Juvenile Court.

Drew M. Frost, 24, of Attica, is charged with DWI. Frost was stopped on Bowen Road, Darien, by State Police at 12:30 a.m Tuesday.

Three local students make the dean's list at Clarkson University

Three local students were named to Clarkson University dean's list for the Spring 2013 semester:

Patrick Flynn, of Batavia, a sophomore majoring in Aeronautical Engineering and Mechanical Engineering.

Jacob Muench, of Darien, a sophomore majoring in Aeronautical Engineering and Mechanical Engineering.

Casey Engle, of Byron, a senior majoring in Electrical Engineering.

Dean's list students must achieve a minimum 3.25 grade-point average and also carry at least 14 credit hours. Clarkson University is located in Potsdam.
 

Darien Lake officials allege 'phony high-end passes' sold by scam artist in Flying J parking lot

Phony "high-end" season passes for Darien Lake Amusement Park and the campsites, complete with wristbands, were allegedly being sold at the parking lot of the Flying J Travel Center in Pembroke some time today. They were said to be selling for $200 and, apparently, some people bought them.

A Sheriff's deputy is responding to the travel center after dispatch received a call from officials at Darien Lake. There is no description of the seller(s) or the vehicle, but the deputy is investigating the matter.

UPDATE 7:32 p.m.: Barbara Pierce, a spokeswoman for Darien Lake, offers the following clarifications. Darien Lake is not allegeding anything. Officials received a call that caused concern about wristbands being sold by an unauthorized seller and asked the Sheriff's Office to check it out. There was no concern about season passes, just wristbands that are provided to guests of the park's hotel and campgrounds to gain access to the theme park. The bands are color-coded daily and a caller contacted Darien Lake to try and find out what color was being used today.  The park was closed today so there was no wristband for the park today. 

Darien resident trying to find missing cat

Abigail Engel is looking for help locating her lost 4-year-old cat. The feline has been missing for several days now.

He usually just stays inside her Darien home and has never been outside for 24 hours before.

The cat belongs to Abby's brother, who is presently stationed in Japan.

Big, friendly Newfies snoozing on stranger's porch in Darien

Didn't catch the address, but a caller to dispatch reports that two very large Newfoundland dogs, "Newfies," are sleeping on her porch. They are nice and friendly but she has never seen them before and has no idea who their owner is.

An animal control officer is responding.

UPDATE 2:27 p.m.: We believe the Darien address is 1402 Erie Road.

UPDATE 2:33 p.m.: The officer has picked up the pooches and is taking them to the Genesee County Animal Shelter.

Law and Order: Thorpe Street resident charged with trespass, order violation

Brodes J. Gibson, 52, of 13 Thorpe St., Batavia, is charged with criminal trespass, 2nd (unlawfully entering a dwelling), and criminal contempt, 2nd. Gibson is accused of entering a dwelling on Thorpe Street at 12:24 a.m., Tuesday, and allegedly violating a complete stay away order.

Alicia Ann Burgess, 22, of Sharrick Road, Darien, is charged with DWI, driving with a BAC of .08 or greater, unlawful possession of marijuana, failure to keep right, moving from lane unsafely. Burgess was stopped at 1:14 a.m. on Buffalo Street, Alexander, by Deputy Joseph Corona.

Vehicle strikes gas meter on Reynolds Road in Darien

A vehicle struck a natural gas meter in front of a residence at 1129 Reynolds Road in Darien. There are no injuries. The gas meter is leaking. The residents have evacuated and National Fuel has about a 20-minute ETA. Darien Fire Department is responding.

UPDATE 4:56 p.m.: A responder on scene says "It's a pretty good hit -- a line they took off." He's told winds are northeast at 5 mph.

UPDATE 5:35 p.m.: National Fuel is on scene. Darien is back in service.

The following people were arrested by members of the Genesee County Sheriff's Office during the Tim McGraw concert at Darien Lake Performing Arts Center on Sunday.

Michaelk P. Sobolewski, 19, of Edward Street, Lancaster, is charged with unlawful possession of marijuana and alcohol after allegedly being found in possession of marijuana and alcohol being under age 21.

Mitchell G. Wilkinson, 20, of Willow Woods, Alden, is charged with unlawful possession of marijuana after allegedly being found in possession of marijuana.

Devin M. Karnath, 17, of Seneca Street, West Seneca, is charged with harassment, 2nd, after allegedly punching another concert patron.

William R. Briggs, 20, of South Main Street, Wayland, is charged with unlawful possession of marijuana after allegedly being found in possession of marijuana.

Kyle G. McCarthy, 21 of Gordon Avenue, Lancaster, is charged with resisting arrest, disorderly conduct and trespass after allegedly reentering the concert venue after being ejected and told not to return several times and then resisting arrest.

Lacey M. Soro, 16, of Tuscarora Road, Niagara Falls, is charged with harassment, 2nd, after allegedly striking a security guard several times.

Law and Order: Truck driver involved in accident accused of DWI

David E. Muffley, 63, of Druck Valley Road, York, Pa., is charged with DWI and driving with a BAC of .08 or greater. Muffley was reportedly involved in an accident at 6:20 p.m., Thursday, at the intersection of Route 63 and Route 20. Muffley was allegedly operating a loaded tractor-trailer while intoxicated and attempted to turn right onto Route 63 and struck a vehicle stopped on Route 63. The accident was investigated by Deputy Cory Mower.

Clifford Leo Regimbal, 34, of Granite Street, Webster, Mass., is charged with criminal possession of stolen property with a value of more than $3,000. Regimbal was arrested in Webster, Ma., on unrelated charges and held as an alleged fugitive from justice on the Genesee County charge. He was returned to New York and jailed on $20,000 bail. Regimbal also has warrants issued by the courts in Corfu, Alexander and Rochester.

Francis E. Ikokide, 42, of 3330 Weston Road, Apt. 316, Toronto, Ontario, Canada, is charged with aggravated unlicensed operation, 3rd. Ikokide was stopped at 6:22 a.m. on Oak Street by Officer Felicia DeGroot for alleged defective brake light. Ikokide was allegedly found to have a suspended license. Ikokide posted $100 police bail and was released.

Nicholas Christian Doell, 22, of Lippold Road, Darien, is charged with criminal possession of a controlled substance, 7th, and possession of a controlled substance not in original container. Doell was allegedly found by his probation officer in possession of controlled substances concealed in a cigarette pack at 5 p.m., Friday. He was jailed on $500 bail. (Doell was allegedly involved in a high-speed chase with deputies and tasered Saturday night.)

Amanda Rose McDonald, 31, of Cherry Street, Batavia, is charged with petit larceny. McDonald is accused of shoplifting from Walmart.

Terry Lynne Butler, 54, of Genesee Street, Le Roy, is charged with driving while ability impaired by drugs, recless driving, moving from lane unsafely and improper signal. Butler was allegedly observed driving at 11:54 p.m., Friday, on Lewiston Road when her vehicle nearly collided with oncoming traffic. She was arrested by Deputy John Weis.

Dylan Jacob Keem, 19, of Folsomdale Road, Cowlesville, is charged with unlawful possession of marijuana. Keem was allegedly found in possession of marijuana concealed in a vehicle during an investigation on Route 77, Darien, by Deputy Patrick Reeves. Also arrested was Benjamin Edward Burek, 19, of Burrough Road, Cowlesville. Burek was charged with unlawful possession of marijuana and consumption of alcohol under 21 years of age.

Terry Robert Konfederath, 51, of Meadowbrook Terrace, Corfu, is charged with DWI, driving with a BAC of .01 or greater, failure to keep right and moving from lane unsafely. Konfederath was stopped at 12:47 a.m., Saturday, on Genesee Street, Pembroke, by Deputy Joseph Corona.

Daniel Lynn Diguardi, 31, of Upper Holley Road, Holley, is charged with falsifying business records, 2nd. Diguardi is accused of claiming ownership of property owned by Rent-a-Center that he allegedly pawned at Pawn King. Diguardi turned himself in on an arrest warrant to Deputy John Baiocco.

Benjamin Gove Evans, 24, of Maple Street, Batavia, was taken into custody on arrest warrants for alleged failure to pay fine on an attempted petit larceny charge. Evans appeared before Justice Tom Williams and promised to return the next day and make a fine payment and to make his payments every week until paid off.

Mary Jean Daniel, 26, of Morrow Road, Pavilion, is charged with petit larceny. Daniel allegedly stole an unassembled TV stand from Kmart.

Derrick R. Kio, 22, of Wyoming, is charged with criminal mischief (preventing emergency call), harassment, 2nd, and endangering the welfare of a child. Kio was arrested by State Police for an alleged incident reported at 10:24 a.m., Saturday, in the Town of Pavilion. No further details were released.

Tased motorcyclist racks up slew of misdemeanor charges following Saturday night's high-speed chase

The 22-year-old man who got Tased by a deputy Saturday after a high-speed chase in the Darien area is identified as Nicholas Christian Doell , according to a press release today from the Sheriff's Office.

Doell, who lives on Lippold Road, Darien, was riding a 2003 Harley Davidson at a quarter to nine last night when he allegedly failed to stop for an officer attempting to stop him for allegedly violating traffic law and for having vehicle violations.

After zooming 90 mph through Darien, Alexander and Town of Batavia, the defendant allegedly fled on foot and "was tased to effect arrest" in front of My Saloon on Route 20 in Darien Center.

The motorcyclist racked up a slew of misdemeanor charges, including unlawful fleeing a police officer, resisting arrest and reckless driving.

Other charges are: failure to yield right of way to an emergency vehicle; uninspected motor vehicle; operating without insurance; having modified exhaust on a motorcycle; two counts of improper left turn on a two-way road; three counts of improper / no turn signal; two counts for failure to stop at stop sign; speed in zone (90 mph in a 30-mph zone); speed over 55 mph (90 / 55); and failure to keep right.

Doell was arraigned in Town of Darien Court then jailed with bail set at $5,000 cash. He is scheduled to reappear in town court on June 4.

He was also issued tickets in the Town of Batavia and will appear in court there June 3 on charges of: unregistered motor vehicle; failure to stop at stop sign; speed in zone (90 / 45); improper / no turn signal; and speed over 55 (90 / 55).

In addition, he was issued a ticket for Town of Alexander Court and will appear in that court June 4 for alleged failure to stop at stop sign.

Taser deployed on suspect following high-speed chase of motorcycle

A deputy was involved with a high-speed chase of a motorcycle in the Darien area and then a deputy reported some sort of confrontation on Route 20.

Seconds later he reported Taser deployed in front of My Saloon on Route 20 in Darien Center.

A Mercy EMS ambulance is requested to the scene.

Other law enforcement units are responding.
