Following Rascal Flatts concert, 38 people in trouble with the law

The following people were arrested during the Rascal Flatts concert at Darien Lake Performing Arts Center on Saturday.

Kelly D. Roth, 23, Hamilton Road, Jamesville, is charged with criminal trespass, 3rd, and disorderly conduct after allegedly reentering the concert venue after being ejected and told not to return and then causing a disturbance in the parking lot. Roth was jailed on $500 bail.

Christopher A. Shoemaker, 21, Ogden Road, Syracuse, is charged with disorderly conduct after allegedly causing a disturbance while being escorted off Darien Lake property. Shoemaker was jailed on $200 bail.

Brandon R. Innes, 18, Stoughon Lane, Orchard Park, is charged with criminal trespass, 3rd, disorderly conduct after allegedly reentering the concert venue after being ejected and told not to return and then causing a disturbance in the VIP parking lot. Innes was jailed on $1,200 bail.

Jessica A. Turner, 19, Taylor Road, Eden, is charged with disorderly conduct after allegedly causing a disturbance while being escorted from Darien Lake property.

Trevor B. Berberian, 19, State Route 80, Tully, is charged with disorderly conduct after allegedly causing a disturbance while being escorted from Darien Lake property.

Kassandra R. Kerves, 24, North Greece Road, Rochester, is charged with disorderly conduct after allegedly causing a disturbance while leaving the concert venue.

Danielle A. Schulik, 22, Alfonso Drive, Rochester, is charged with disorderly conduct after allegedly fighting in the parking lot.

BrittaA. Schulik, 25, Alfonso Drive, Rochester, is charged with disorderly conduct after allegedly fighting in the parking lot.

Daniel R. Clever, 20, Bear Lake Road, Stockton, is charged with disorderly conduct after allegedly fighting with security while being escorted from the concert.

Adam E. Kress, 21, Haseley Road, Gasport, is charged with disorderly conduct after causing a disturbance in the parking lot.

Crystal J. Spurling, 20, Strouts Road, Elba, is charged with unlawful possession of marijuana and possession of alcohol under 21 after allegedly being found in possession of marijuana and alcohol.

Timothy M. Lincourt, 65, Rush-Lima Road, Honeoye, is charged with DWI after allegedly being found operating a vehicle in the parking lot while impaired by alcohol.

Anna M. Jones, 19, Victoria Boulevard, Kenmore, issued a citation for allegedly possessing another’s license after being found in possession of another person's NYS driver's license.

Emily H. Thomson, 17, Kent Street, Queenston, Ontario, Canada, issued a citation for allegedly possessing a fraudulent driver’s license after allegedly being found in possession of a fake British Columbia driver's license.

Eric S. Bagne, 20, Main Street, Walworth, issued a citation for possession of another’s license and possession of alcohol under age 21 after allegedly being found in possession of another person's NYS driver's license and alcohol.

Six Maroon 5 fans accused of fighting with guards or deputies

The following people were arrested during the  Maroon 5 Concert at Darien Lake Performing Arts Center on Wednesday.

Emily L Simmons, 21, North Central Avenue, Springville, is charged with two counts of second-degree harassment after allegedly grabbing a security guard by the head and then kicking several deputies and security guards. Simmons was jailed on $250 bail.

Patrick P. Sheridan, 45, Via Cimato Drive, Clarence Center, is charged with second-degree harassment and resisting arrest after allegedly pushing a security guard and then resisting arrest by refusing to be taken into custody.

David J. Irwin, 49, Pinyon Court, Clarence Center, is charged with two counts of second-degree harassment after allegedly pushing a security guard and then pushing and hitting another security guard in the face.

Joseph M. Ciliberto, 42, Pine Terrace, Orchard Park, is charged with second-degree harassment after allegedly striking a deputy during an investigation. Ciliberto was jailed on $250 bail.

Kara M. Balog, 22, Cochran Avenue, Springville, is charged with second-degree harassment after allegedly pushing a deputy after repeatedly being told to leave the venue. Balog was jailed on $200 bail.

Amanda N. Hayden, 21, Hefner Drive, Webster, is charged with disorderly conduct and second-degree harassment after allegedly causing a disturbance in the venue and then punching a deputy in the chest after being instructed to leave the concert venue. Hayden was jailed on $300 bail.

Amanda C. Snyder, 20, Woodhaven Circle, Hamburg, issued a citation for using another’s license.

The following people were cited for alleged consumption or posession of alcohol under age 21:

Man accused of hitting fellow concertgoer at Darien Lake pleads not guilty in first court appearance

The most significant news out of County Court today is that Craig Lawson showed up.

Lawson is accused of hitting Jason McNeil, a former WNY resident living in Alabama, following the Kid Rock Concert at Darien Lake in July.

Following the punch, according to court documents, McNeil's head hit the ground. He was in a coma for more than a week and has been hospitalized since.

Initially, Lawson, who lives in Canada, was charged with a misdemeanor, assault 3rd, and bail was set at a mere $1,000.

Once it became apparent that McNeil's injuries were serious and McNeil might face an upgraded charge, there was concern in the community that Lawson would just skip his next scheduled court appearance.

Last month, a grand jury indicted Lawson on a single felony count of second-degree assault.

Today, Lawson appeared before Judge Robert C. Noonan and pled not guilty.

To win a conviction on an assault, 2nd, charge in New York, a prosecutor must prove that the defendant intended to cause serious physical injury.

Noonan dismissed a similar charge against Jacquetta Simmons in the Walmart case, ruling that the grand jury had not received enough evidence to sustain the assault, 2nd, count (Simmons was convicted by a jury on a subsection of assault in the second degree dealing with hitting and injuring an elderly person).

Mike Ranzenhofer, co-counsel with Buffalo attorney Joel Daniels, for Lawson, said it's hard to compare different cases and until the defense has received all of the supporting documents from the DA's office, it's hard to say if the charge can be supported.

But he expressed skepticism that his client is guilty as charged.

"This is a one-punch situation," Ranzenhofer said. "I don't think anything was intended here. That's pretty clear. But we'll have look at the documents once we get them."

The DA's office is dealing with another reportedly one-punch assault case right now, as well.  Last month, Batavia resident Scott Baker suffered a fractured skull when he was punched on Harvester Avenue. In that case, Shane Bell is accused of delivering a single punch that was the direct cause of Baker's injury.

Baker remains in critical condition and in a coma at ECMC.

Lawson is accused of delivering a hit that caused the victim to fall to the ground and hit his head.

Assistant District Attorney Robert Zickl said that of course the DA's office believes it can get a conviction on the crime as charged.

"We're very confident presenting that to the court and ultimately to a jury," Zickl said.

Last week, a page that had been set up by Pam McNeil to supply followers with status updates about her husband's medical condition, reported that McNeil was improving and that she was hopeful he would soon return home to Alabama.

Two nights ago, McNeil complained in a status update that the media was using the page to "harass" her and announced she would be removing the page from Facebook. As of today, the page no longer exists. She offered no details on what she considered harassment.

Darien man accused of making sexual advance to teenage boy in Le Roy

A 53-year-old Darien resident is accused of making a sexual advance two weeks ago toward a 14-year-old boy while at the Le Roy Community Pool.

Robert F. Williams, of 10933 Townline Road, Lot 18, Darien, is charged with one count of endangering the welfare of a child.

Williams is accused of offering the boy oral sex while at the pool on Aug. 21.

Following arraignment, Williams was released under supervision of Genesee Justice.

A Christian is a person who believes with their heart that Jesus Christ died on the cross for their sins. It is a person who confesses their sin to God in prayer and asks for His forgiveness (Romans 10:9-10). It is a person who desires to live a life pleasing to God. It is a person who denies himself to become a follower of Christ (Luke 9:23). What does it mean to become a follower of Christ?

Law and Order: Batavia man charged with grand larceny for alleged thefts from Walmart

Jason Daniel Lang, 29, of Liberty Street, Batavia, is charged with grand larceny, 4th. Lang is accused of stealing merchandise from Walmart during two separate visits. Lang was jailed on $2,500 bail. (For previous coverage of Jason Lang, click here).

Donald William Schulz, 34, of Garden Springs Drive, Mount Sterling, Ky., was arrested on a bench warrant for alleged failure to pay fine. Schulz is accused of failing to pay a fine or restitution on a manslaughter charge. Schulz was extradited and returned to Genesee County and is being held in Genesee County Jail pending arraignment in County Court.

Daniel Johnston Duryea, 32, of Grant Avenue, Humbolt, Neb., is charged with felony DWI, felony driving with a BAC of .08 or higher, moving from lane unsafely, failure to keep right and driving left of pavement markings in no passing zone. Duryea was stopped at 12:33 a.m., Sunday, on Route 238 in Alexander by Deputy Jason Saile.

Marc Harry Rice, 35, of Judith Drive, Cheektowaga, is charged with DWI, driving with a BAC of .18 or higher and failure to keep right. Rice was stopped at 8:13 p.m. Saturday on South Alleghany Road, Corfu, by Deputy Patrick Reeves.

MacKenzie Douglas Barrett, 17, of Eagle St., Medina, is charged with grand larceny, 4th. Barrett is accused of stealing about $2,000 in cash since June while employed at Darien Lake Theme Park.

Wesley C. Burgess, 29, of Jefferson Street, Attica, is charged with unlawful possession of marijuana. Burgess allegedly possessed a bag of marijuana and a pipe with marijuana residue while passing through a checkpoint at 12:08 a.m. Saturday on West Main Street Road, Batavia.

Updates on four critically injured people

In the past few weeks, we've had four people hospitalized with serious injuries. Here's what we know about them today.

  • Jason McNeil: McNeil's health is improving according to a Facebook post by his wife. He may be able to return home soon. McNeil was hit following the Kid Rock concert at Darien Lake Performing Arts Center on July 6. Craig Lawson was recently indicted on a charge of assault, 2nd, and is scheduled to be arraigned on the charge next week.
  • Benjamin L. Falker, 16, was critically injured in an ATV accident Aug. 3. He remains listed in serious condition at ECMC.
  • Ashley M. Stillwell, 19, was a passenger on a motorcycle driven by her boyfriend Derek Sheldon when the bike struck a car at the intersection of Selden and West Bergen roads. Sheldon was killed in the accident. Stillwell was transported with serious injuries by Mercy Flight to Strong Memorial Hospital. As of today, Strong does not have Stillwell listed as a patient and we have no further information.
  • Scott Baker, 51, was critically injured during an apparent fight Sunday night on Harvester Avenue. He remains in a coma, listed in critical condition, at ECMC. Shane M. Bell is accused of hitting Baker and is charged with felony assault.

UPDATE 5:05 p.m.: We were contacted by State Police and told Stillwell remains a patient at Strong, regardless of Strong's patient record which does not list her.

UPDATE: Since the last update, I had another conversation with Trooper Victor Morales, Troop A's PIO. He said Stillwell is doing well. She's listed in good condition at Strong and could be released from the hospital soon. She suffered a broken pelvis, broken back and fractured knee cap. The accident reconstruction is not complete, but investigators believe that speed was not a factor. Stillwell does not remember them speeding prior to the accident, but even if they were, the other driver had clear visability for at least a mile down the road. At this point in time, no citations have been issued.

Overnight fire destroys barn on Bennett Road, Darien

By the time firefighters got the call at 2:28 a.m., a barn filled with hay at 2311 Bennett Road, Darien, was fully engulfed in flames.

At 9 a.m., firefighters were still on scene tending to smoldering hay bales with potentially hours of work still ahead of them.

A few firefighters who had been up practically all night had to leave for their day jobs.

Responding to the fire with Darien were East Pembroke, Indian Falls, Corfu and Alexander. Crittenden filled in at Corfu's hall and Alden filled in for Darien.

Water was drawn from a pond on Charlie Miller's property at Ellinwood and Brown roads.

The barn property is owned by Miller's Sonshine Acres, Inc.

The barn, of course, was a total loss, but firefighters said that was apparent from the moment they rolled up on scene. From that point, it was just a matter of knocking down the flames.

Four arrests at Goo Goo Dolls concert at Darien Lake

The following people were arrested by the Genesee County Sheriff’s Office during the Goo Goo Dolls Concert at Darien Lake Performing Arts Center on Saturday.

Matthew S. Conover, 28, Green Forrest Court, East Amherst, is charged with DWI, aggravated DWI and aggravated unlicensed operation, 3rd, after allegedly operating a motor vehicle while intoxicated and with a blood alcohol level of .18% or higher. Conover allegedly drove into a ditch inside the concert venue parking lot. Conover’s license to operate a motor vehicle was also suspended. Conover was jailed on $500 bail.

Antho G. Serrano Jr., 19, Dodge Road, Getzville, is charged with unlawful possession of marijuana after allegedly being found in possession of marijuana.

Riley T. Munger, 19, Greiner Hall, Buffalo, is charged with unlawful possession of marijuana after allegedly being found in possession of marijuana.

Ty T. Buczkowski, 20, Wellington Road, Cheektowaga, is charged with unlawful possession of marijuana after allegedly being found in possession of marijuana.

The following people were cited for alleged possession or consumption of alcohol under age 21.

One arrest reported at Allman Brothers concert at Darien Lake

The following person was arrested Friday at the Allman Brothers concert at Darien Lake Performing Arts Center.

Joseph M. Trippi, 18, of Meigs Street, Rochester, is charged with criminal trespass after allegedly jumping a fence to reenter the concert venue after being ejected and told not to return. Trippi was jailed on $250 bail.

Grand Jury Report: Alleged assailant at Kid Rock concert now charged with felony

Craig M. Lawson is indicted on one count of assault in the second degree, a Class D felony. The indictment accuses Lawson of hitting another person with intent to cause serious physical injury. Lawson allegedly hit Jason McNeil following the Kid Rock concert at Darien Lake Performing Arts Center on July 5. McNeil suffered a serious head injury when he fell to the ground and remains hospitalized at ECMC. Lawson, a Canadian who was originally arrested on a misdemeanor charge, is out of jail on $1,000 bail. He is scheduled to be arraigned on the felony charge Sept. 3.

Felipe R. Fernandez is indicted on a count of aggravated unlicensed operation in the first degree.  Fernandez is accused of driving a motor vehicle on May 8 in the Town of Batavia while knowing that his license to operate a motor vehicle was revoked with 10 or more suspensions.

Hector A. Leon-Figueroa is indicted on a count of criminal possession of marijuana in the third degree, a Class E felony. Leon-Figueroa is accused of possessing more than eight ounces of marijauna March 10 on the Thruway in the Town of Bergen.

Jimmy T. Garcia Jr., is indicted on a count of grand larceny in the fourth degree. Garcia is accused of of stealing $3,010 sometime between Aug. 24 and Aug. 29 in the Town of Batavia.

Law and Order: Trio from Rochester arrested following reported fight on Swan Street, Batavia

Patrick D. Powell, 27, of 98 Barton St., Rochester, is charged with resisting arrest. Powell is accused of physically interfering with the arrest of Richard Johnson at 9:43 p.m., Saturday, at 45 Swan St., Batavia.

Richard E. Johnson, 53, of 159 Millbank St., Rochester, is charged with disorderly conduct. Johnson allegedly used obscene language and gestures on a crowded public street after being warned by police to cease such conduct.

Jovon C. Johnson, 24, of 960 Gleason Circle, East Rochester, is charged with resisting arrest. Johnson allegedly interfered with a police officer's attempt to arrest another person during following a reported fight involving several people on Swan Street at 9:43 p.m., Saturday.

Willie A. Toney, 26, of Finch Street, Rochester, is charged with criminal possession of a weapon, 4th, criminal possession of a controlled substance, 7th, criminal use of drug paraphernalia, 2nd. Toney was stopped at 3:03 p.m., Saturday, on Route 77, Village of Corfu, by Corfu Police Officer Michael Petritz for allegedly driving 48 in a 35 mph zone. Upon further investigation, it was determined Toney's license was allegedly suspended 21 times. A search of his vehicle allegedly turned up a .38 caliber pistol and a crack pipe containing crack cocaine residue.

Jennifer L. Spraugue, 30, of Pringle Avenue, Batavia, was arrested on a warrant for alleged failure to appear on a falsely reporting an incident case. Spraugue is being held on an unrelated charge. She was arrested for allegedly failing to appear in Bergen Town Court on a third-degree charge of falsely reporting an incident to law enforcement. Spraugue entered a guilty plea and was sentenced to time served. She was returned to the jail on the unrelated matter.

Stoan Richard Dietzman, 18, of Dartwood Avenue, Cheektowaga, was arrested on warrants related endangering the welfare of a child and strangulation, 2nd, charges. Dietzman was a passenger in a vehicle stopped in the City of Buffalo and after a records check was arrested on the warrants. After being turned over to the Sheriff's Office, Dietzman was jailed on $1,000 bail.

Barbara Ann Kosciolek, 67, of Osterhout Avenue, Batavia, is charged with DWI, aggravated DWI, failure to keep right and moving form lane unsafely. Kosciolek was stopped at 11:11 p.m. Saturday on Route 5 in Stafford by Deputy Matthew Butler.

John Edward Ryman, 32, of Macedone Center Road, Palmyra, is charged with possession of untaxed cigarettes. Ryman was allegedly found in possession of 35 cartons of untaxed cigarettes during a traffic stop on Route 5 in Le Roy by Deputy Matthew Butler.

Jeanine Danielle Fuller, 26, of Holland Avenue, Batavia, is charged with petit larceny. Fuller is accused of shoplifting $33.78 in merchandise from Walmart.

Robert Gordan Woodhouse, 54, of Creek Road, Batavia, is charged with felony DWAI-Drugs and moving from lane unsafely. Woodhouse was stopped following a report at 4 p.m. Friday of a black H3 Hummer operating erratically on West Main Street Road in the Town of Batavia. The Hummer allegedly crossed the center line and nearly struck an oncoming vehicle. The Hummer was stopped by Deputy Chad Minuto and upon investigation Woodhouse was accused of driving while under the influence of drugs.

Robert Walter Plantiko, 38, of West Main Street Road, Batavia, is charged with burglary, 2nd. Plantiko allegedly entered a motel room and stole property. Plantiko was jailed on $10,000 bail or $20,000 bond.

Mark Robert Willard, 39, of Tinkham Road, Darien, is accused of violating probation. Willard was arrested and held without bail.

Iesha Marie Vetter, 20, of West Main Street, Batavia, is charged with petit larceny and criminal mischief. Vetter is accused of removing products from packaging as part of an effort to steal items from Target.

Winston A. Lockhart, 18, of 3 Lewis Place, Batavia, is charged with harassment, 2nd. Lockhart allegedly hit a woman at 119 State St., Batavia, during an incident reported at 3:22 p.m. Saturday.

Ashlea M. Harmon, 22, of 665 Ellicott St., Batavia, is charged with petit larceny. Harmon was found in possession of an allegedly stolen bicycle that she admitted to stealing.

Michael S. Lytle, 24, of 11 Wood St., Batavia, is charged with harassment, 2nd, and criminal mischief. Lytle was arrested following a reported domestic incident on Wood Street at 11:40 p.m. Friday. Lytle was jailed on $250 bail.

Today Darien Lake Theme Park hosted the “Fiesta Latino Americana." The event was an all day festival of Latino music and dancing, including dance lessons for guests.

Unfortunately, my schedule didn't allow me to be there but for a short time today. I did drop in to see the Victor Antonetti Band.

The following people were arrested or issued citations by the Genesee County Sheriff’s Office and NYS DMV Investigators during the Jason Aldean Concert at Darien Lake Performing Arts Center on Aug. 17:

Jaime Barzey, 30, of Carroll Place, Bronx, is charged with criminal trespass, 3rd, after allegedly being found on Darien Lake property after being ejected several times on previous dates and told not to return. Barzey was jailed on $1,000 bail.

Ryan C. Jenks, 24, of Upper Alley Road, Holley, is charged with disorderly conduct after allegedly fighting in the concert parking lot. Jenks was jailed on $250 bail.

Shawn R. Schottmiller, 21, of Vandervoort Street, North Tonawanda, is charged with two counts of harassment, 2nd, after allegedly hitting two Darien Lake security guards. Schottmiller was jailed on $500 bail.

Craig D. Gingerich, 22, of Fish Hill Road, South Wales, is charged with attempted petit larceny, resisting arrest and harassment, 2nd, after allegedly attempting to take money from a food stand cash drawer and then while being placed under arrest, Gingerich allegedly bit a Genesee County Sheriff’s deputy in the hand. Gingerich was jailed on $750 bail.

Adam M. Logue, 23, of Jackson Road, Webster, is charged with disorderly conduct after allegedly fighting in the concert venue entrance. Logue was jailed on $250 bail.

Brandon M. Hallock, 23, of Happy Hollow Road, Olean, is charged with disorderly conduct after allegedly engaging in a fight in the concert parking lot. Hallock was jailed on $250 bail.

(name redacted), 20, of Port Dover, Ontario, Canada, was arrested for trespass after allegedly attempting to reenter the concert venue after being ejected and told not to return. xxx was jailed on $250 bail.

Sidney E. Cammilleri, 23, of Sias Lane, Spencerport, is charged with trespass after allegedly attempting to reenter the concert venue after being ejected and told not to return.

Small car fire in garage, now under control, reported on East Main, Corfu

A small car fire inside a garage is reported at 59 E. Main St. in Corfu. It has not spread to the structure and is under control. Corfu Fire Department is responding, along with mutual aid from Darien and Indian Falls.

The location is between Lawrence Avenue and Meadowbrook Terrace.

UPDATE 8:40 a.m.: Fire is out; vehicle is cooled down; smoke is gone. Mutual aid companies put back in service.

UPDATE 8:43 a.m.: Some Corfu responders are put back in service.

UPDATE 8:55 a.m.: Corfu command puts the assignment back in service.

 

Fight by the Porta Potties at Darien Lake

There was a fight reported at the Porta Potties, section P1, of the parking lot at Darien Lake. Where again? asks an officer. "P1 by the potties."

Alas, a subsequent search of the area found no problems, the alleged participants had gone upon arrival.

The performing arts center is hosting a concert tonight featuring Jason Aldean, Jake Owen, and Thomas Rhett.

Limo riders relieve themselves on the lawn of Darien residents

A caller on Broadway Road in Darien reports that a blue and silver limousine out of Buffalo stopped in front of her house and several of its passengers got out and urinated on her lawn before continuing their journey eastbound on Route 20.

Car wreck at Sumner and Colby roads, Darien

A one-car accident is reported at Sumner and Colby roads in Darien. The vehicle is on its side and a person is complaining of back pain. Darien Fire Department and Mercy medics are responding.

UPDATE 11:44 a.m.: The male patient, who recently had back surgery, is being transported to an area hospital. Darien fire is back in service and the vehicle is being towed away.

 

Person in black Chevy Silverado said to have tossed cat out the window

A person reportedly tossed a cat out of the window of a moving vehicle in the vicinity of Darien Lake Theme Park. The vehicle is said to be a 2002 black Chevy Silverado registered to a Corfu resident. The vehicle was last seen heading west on Route 33. Law enforcement is searching for it now.

UPDATE 6:41 p.m.: The complainant told an officer that the cat was tossed out the driver's side window, north of the theme park's camping entrance. It was white, and it rolled a few times and then ran off. Someone is looking for it to check its well being and officers are still searching for the Silverado.

UPDATE 7:03 p.m.: A State Trooper found the suspect and interviewed her. The woman said that the cat is hers and that "it was underneath her car and not thrown." The Trooper is back in service. No word on whether the cat was found or if the owner is going back to try and retrieve her pet.

Thirty-six people arrested or issued citations at John Mayer concert at Darien Lake

The following people were arrested by the Sheriff's Office during the John Mayer Concert at Darien Lake Performing Arts Center on Tuesday.

Robert M. Murphy, 34, Brixton Trail, Webster, is charged with two counts of assault, 3rd, after allegedly causing two Live Nation security guards injuries while he was being ejected from the venue. One security guard sustained a broken finger and the other Security Guard sustained a severe laceration to his head. Murphy was arraigned in Darien Court and remanded to jail in lieu of $500 bail.
