Warren R. Skye Jr., 62, of South Swan Street, Batavia, is charged with DWI, refusal of breath test, open container, reckless driving and leaving the scene of a property damage accident. Skye is accused of driving drunk at the time his vehicle struck a parked tow truck on South Swan Street, Batavia at 11:03 p.m. Jan. 20. Skye allegedly fled the scene of the accident and once located and taken into custody, refused to take a breath test. He reportedly urinated in the holding room at Batavia PD. (Prior Report)

Randy G. Leach, 29, of Torrey Road, Stafford, and Isaiah J. Munroe, 25, of Buell Street, Batavia, were charged with unlawful possession of marijuana. Leach and Munroe were arrested following a traffic stop by Le Roy PD on Lake Street at Bacon Street.

Sara A. Howard, 21, of Bergen, is charged with grand larceny, 4th, and petit larceny and Alexander E. Fostano, 28, of Batavia, is charged with grand larceny, 4th. Howard allegedly stole a Sony Play Station valued at $300 after gaining entry to a family member's home on Jan. 8. Howard and Fostano allegedly gained entry to another family's home Thursday and stole a .50-caliber CVA muzzleloader and a 12-gauge Mossberg Maverick valued at $700. They were jailed on $10,000 bail each.

Nateeka M. Gibson, 26, is charged with petit larceny. Gibson allegedly removed a Mongoose bicycle from a shelf at Kmart and then attempted to return the item at customer service. When that didn't work, she allegedly left the store with the bicycle, valued at $199.99.

Ward E. Royse, 40, of Walnut Street, Batavia, was arrested on a warrant for alleged failure to appear on a petit larceny charge. Royse turned himself in.

Adante L. Davis, 26, of South Main Street, Batavia, is charged with endangering the welfare of a child. Davis was allegedly involved in a fight while in the presence of a child less than 17 years old. He was jailed on $2,500 bail.

Danny D. Williams, 27, of Pearl Street, Batavia, is charged with petit larceny. Williams allegedly stole a bottle of wine from a liquor store in East Main Street, Batavia.

Lori A. Brightenfield, 56, of Maple Street, Batavia, was arrested on a warrant. She was ordered held without bail.

Timothy A. Banks, 24, of Columbia Avenue, Batavia, was arrested on a warrant for alleged failure to appear. Banks allegedly failed to obey conditions of his release under supervision of Genesee Justice. Banks was located and arrested following a panhandling complaint at McDonald's in Eastown Plaza. He was jailed on $500 bail.

Tyanna D. Green, 20, of Pearl Street, Batavia, was arrested on a warrant for failure to comply with sentencing stemming from a conviction for criminal possession of a controlled substance, 7th, and criminal use of drug paraphernalia, 2nd. 

Ryan A. Funke, 22, of Vine Street, Batavia, is charged with unlawful possession of marijuana and stop lamp equipment violation. Funke was stopped at 7:44 p.m. Saturday on North Street, Batavia, by Officer Matthew Wojtaszczyk.

David James Staba, 47, of Tinkham Road, Darien, is charged with felony DWI, felony driving with a BAC of .08 or greater and inadequate headlight. Staba was stopped at 7:24 p.m. Sunday on Attica Road, Darien, by Deputy Richard Schildwaster.

Nathan Everett Hinze, 22, of Ellicott Avenue, Batavia, is charged with DWI, aggravated unlicensed operation, unlicensed operator, refusal to take breath test and following too closely. Hinze was stopped at 11:30 p.m. Saturday on Law Street, Batavia, by Deputy Kevin Forsyth, following a citizen complaint of an erratic driver on Route 98, Alexander. He was jailed on $250 bail.

Katrina Marie Douglas, 26, of West Ridge Road, Rochester, is charged with unlawful possession of marijuana, aggravated unlicensed operation, 3rd, and driving by an unlicensed driver. Douglas was arrested after Deputy Ryan Young stopped to check on a disabled vehicle at 11:15 a.m. Thursday on Lockport Road, Oakfield.

Lorin Alexandra Volk, 21, of Livingston Street, Warsaw, is charged with petit larceny. Volk allegedly stole from Kmart.

Nathan Samuel Love, 22, of Montclair Avenue, Batavia, is charged with petit larceny. Love allegedly attempted to steal a vacuum cleaner from Kmart. Upon further investigation, he was identified as the suspect in a vacuum cleaner theft Jan. 12.

John Ronald Laude, 23, of Main Road, Akron, is charged with promoting prison contraband, 1st, and criminal possession of a controlled substance, 7th. Laude was allegedly found in possession of heroin while being processed for an arrest at the Genesee County Jail. He was arrested at 12:58 p.m. Thursday by Deputy Ryan Young and charged with driving while ability impaired by drugs and criminal possession of a controlled substance, 7th. He was allegedly found in possession of heroin following a report of a disturbance at Walmart. Also arrested following the investigation into the alleged disturbance was Christopher Brian Smith, 24, of Pearl Street Road, Corfu, who was charged with criminal possession of a controlled substance, 7th.

There was still enough ice on the rink behind the Corfu Village Hall for a bit of hockey today during the annual Winterfest, despite the temperature hitting 50 degrees.

Nobody was complaining about the warm weather as they enjoyed food, vendors, music and a basket raffle.

The Corfu-Pembroke Community Winterfest will be held from 10 a.m. to 6 p.m. this Saturday, Jan. 30, at the Pembroke Community Center. It's located at 116 E. Main St. in Corfu.

The attorney handling the murder conviction appeal of Scott F. Doll is asking for a hearing on why a Monroe County medical examiner testified during Doll's trial that fingernail clippings were taken and retained from the victim, Joseph Benaquist, when they were not.

Timothy Murphy argued his motion today in Superior Court, but presiding judge Michael F. Pieturszka was full of skeptical questions. 

Repeatedly, in various ways, Pieturszka asked Murphy what would be gained by a hearing when it's already known that the evidence doesn't exist. A hearing isn't going to suddenly produce the evidence, the judge noted.

Murphy argued that is presumably in the best interest of the court to find out why the trial judge -- Robert C. Noonan -- was misled about the existence of the fingernail clippings. Murphy also repeatedly stated that he didn't blame the DA's Office for the missing evidence, but he thinks the ME's Office should explain the now clearly false testimony that the evidence was collected.

At the time of trial, neither the DA nor the defense, led by Paul Cambria, requested DNA evidence from the fingernail clippings. The lack of the evidence was only discovered after Judge Robert C. Noonan, now retired, ordered the Monroe County ME's Office produce it.

Scott LaPoint, a deputy ME, testified in Doll's trial that the evidence is routinely collected and that it was collected in this instance.

Pieturszka asked what the pratical result of a hearing might be since a hearing wouldn't make evidence appear that didn't exist.

"The court is entitled to know why an order was not enforced and fully enforced," Murphy said, arguing that it was in the best interest of the court to find out why false testimony was given and why the ME's Office wasn't able to satisfactorily produce evidence Noonan ordered produced.

The fact that there may have been a third person's DNA at the scene of the crime, on Benaquist's left boot, made the inquiry all the more important, Murphy asserted, but Pieturszka asked whether even that fact was relevant without any idea of how the DNA came to be introduced into the crime scene.

It's an incomplete DNA sample, so a third person cannot be identified with it. There's no indication that, if there was a third person present, it was at the time Benaquist was killed, or if it was on Benaquist's boot prior to the attack, or if it accidently came from an investigator after the fact.

ADA Will Zickl argued that even if Murphy's request had merit, it wasn't related to the motion presently before the court. Zickl said Murphy could bring a new motion to uncover the information he seeks, but the fact that the evidence doesn't exist and can't be produced ends the original motion that prompted the discovery of the mistake.

Murphy also wants hair samples from Benaquist subjected to DNA testing to see if any third-party DNA might be found. But Zickl argued that it was such a bloody crime scene and the hair was covered so thoroughly with Benaquist's blood, there is nothing to be gained by another round of tests.

"The pulled hair samples are not worth the trouble it would take the lab to test it in light of the circumstances," Zickl said.

Pieturszka is reserving his decision until a later date. He gave Murphy two weeks to file a memo supporting his position, and Zickl two weeks after that to produce an answering memo.

Justine D. McWethy, 28, of South Main Street, Batavia, is charged with grand larceny, 2nd. McWethy is accused of stealing $80,000 from a business at 56 Harvester Ave., Batavia. McWethy was arrested on a warrant after being found to be a passenger in a car stopped by a Batavia PD patrol. The alleged theft was reported Nov. 11. McWethy was also arrested by Deputy Joseph Corona on a warrant for alleged failure to appear on a petit larceny charge. On that arrest, she was jailed on $500 bail or $1,000 bond. On the grand larceny charge, she was jailed without bail.

Alfred A. Panepinto, 59, of Ellicott Avenue, Batavia, is charged with unlawful possession of marijuana and failure to stop for stop sign. Panepinto was stopped at 10:48 p.m. Jan. 2 on Ellicott Avenue by Officer Christopher Lindsay.

Lonnie J. Ford III, 44, of Ellicott Street, Batavia, was arrested on a warrant for alleged failure to pay a fine stemming from a loitering charge. He was jailed on $125 bail.

Coretta M. Pitts, 47, of Williams Street, Batavia, is charged with criminal contempt, 2nd. Pitts allegedly entered a residence in violation of a complete stay away order. She was jailed on $1,000 bail. 

Vincent Allen Sanfratello, 49, of Gibson Street, Bergen, was arrested on a bench warrant for alleged failure to pay a fine. Sanfratello was jailed without bail.

Joshua David Schultz, 32, of Maple Avenue, Oakfield, is charged with unlawful possession of marijuana and insufficient tail lamps. Schultz was stopped on Drake Street, Oakfield, at 5:48 p.m. Tuesday by Deputy Joseph Corona.

Jonathan Patrick Little, 25, of Boyce Road, Corfu, is charged with petit larceny. Little is accused of stealing from Kmart on Wednesday.

A single DNA sample obtained at the scene where Joseph Benaquist was found murdered Feb. 19, 2009 does not match the DNA profile of the victim and may not match that of the man convicted by a jury for his murder, Scott F. Doll, according to a recent report produced by the Monroe County Crime Laboratory.

The laboratory, in compliance with a court order issued by Judge Robert C. Noonan in April, examined about two dozen blood samples from the crime scene and determined that the left boot of Benaquist had two possible blood stains. One of the DNA profiles, the lab found, clearly matches the DNA profile of Benaquist, but the other is insufficient to match either Benaquist or Doll.

Appeals attorney Timothy Murphy, in a Dec. 16 letter to Doll at the Elmira Correctional Facility, characterized this finding as promising news. He said the report indicates a third person's DNA was found at the scene.

There is no information available on who the DNA sample might match. Neither Benaquist nor Doll are ruled out as a possible match.

The report reads:

The minor component of the DNA profile is insufficient to support an inclusion or exclusion and is therefore not suitable for comparison. No further conclusions can be reached regarding the minor component mixture.

The lab-tested bloodstains are from the roadway near Benaquist's home at 683 Knapp Road, Pembroke, from the driveway at the residence, from both of Benaquist's boots, from a shirt, a sock and a jacket.

Only the left boot contains a DNA profile that can't be matched to any known person.

The lab report is part of a set of documents provided to The Batavian by Andrew Doll, brother of Scott Doll.

The documents also contain a letter from Monroe County Medical Examiner Caroline Dignan stating that contrary to testimony from Monroe County Deputy Medical Examiner Scott LaPoint in the trial of Doll, no fingernail clippings were collected during the autopsy of Benaquist.

LaPoint testified that such clippings were always collected in a murder investigation and that procedure was followed in this case.

This new evidence, along with additional information, has Andrew Doll feeling even more skeptical about his brother's murder conviction. These include: the unexpected lack of fingernail clippings; his belief that the driveway at 683 Knapp Road was washed down within 24 hours of the murder being discovered; and that a murder weapon has never been recovered.

He's never felt, he said, that his brother has the temperament to become so angry and so out of control that he would bludgeon to death one of his very best friends. There is simply no reason Scott Doll would have killed the 66-year-old Benaquist, Andrew Doll said.

"I just feel there is more to this than what's on the surface," Andrew Doll said. "There seems to be a lot of loose ends that need to be looked at. For the sake of both families, I'm hopeful we can get to some kind of conclusion."

Andrew said his brother asked that the evidence be shared with local media because he wants people to know he's not a murderer.

Scott Doll has maintained his innocence from the beginning and leveraged his life savings along with family money to hire a nationally known attorney from Buffalo, Paul Cambria, to mount his defense at trial. Since his conviction in June 2010, Doll has pursued a couple of appeals. His murder conviction was upheld by the NYS Supreme Court in July 2012.

Last year, Murphy filed a new appeal seeking a reexamination of the DNA evidence used in the case.

Two days ago, Murphy scheduled an interview about the new development in the case for this morning. But then Murphy said he decided he could not comment on the case at this time.

We don't know, therefore, what will happen next with the case, what strategy Murphy will pursue to press forward with an appeal, or if that's even in the cards.

So far we've been unable to reach ADA Will Zickl, who is handling the Doll appeal for the District Attorney's Office.

Doll was sentenced to 15-years-to-life in state prison, the minimum sentence available to Judge Robert C. Noonan on Doll's murder conviction. The way Andrew Doll sees it, he said, the minimum available sentence suggests strongly that even Noonan, who sat through the entire trial and heard all of the evidence, doesn't believe Scott Doll committed the murder.

Noonan stated during the sentencing that he thought Doll deserved a shot at parole before he was too old or would likely die in prison.

Scott Doll became a suspect when he was found by Deputy James Diehl wandering on Lake Street in Pembroke in blood-soaked overalls. During the course of the early part of the investigation, Doll made statements about the situation, including an assertion that the blood was from a deer he had butchered. The blood turned out to be that of the murder victim. For hours, Doll was in police custody but would not discuss where the blood came from or disclose the location of a person who might need medical attention. While in custody, he made statements that were later used against him at trial.

Andrew Doll acknowledged none of that made his brother look good.

"My brother did things that didn’t seem right and weren't right, and to this day, he doesn’t know what he did and why," Andrew Doll said.

The Sheriff's Office announced the following arrests as a result of investigations conducted by the Local Drug Task Force.

Joseph M. Platten, 32, of Warren Street, Batavia, is charged with two counts of criminal sale of a controlled substance, 5th, and criminal possession of a controlled substance, 5th. Platten allegedly sold a quantity of a controlled substance to an agent of the Drug Task Force while in the City of Batavia. Platten was jailed without bail.

James R. Soccio, 34, of Ross Street, Batavia, is charged with two counts of criminal sale of a controlled substance, 4th, and criminal possession of a controlled substance, 5th. Soccio allegedly sold a quantity of methadone to an agent of the Drug Task force while in the City of Batavia. He was jailed without bail.

Joseph C. Gaudio, 35, of Telephone Road, Pavilion, is charged with criminal sale of a controlled substance 3rd and criminal possession of a controlled substance 3rd. Gaudio allegedly sold a quantity of cocaine to an agent of the Drug Task Force. He was jailed without bail.

Jennifer S. Maychoss, 41, of Snipery Road, Corfu, is charged with criminal sale of a controlled substance, 3rd, criminal possession of a controlled substance, 3rd, criminal sale of a controlled substance, 5th, and criminal possession of a controlled substance, 5th.  Maychoss allegedly sold cocaine and pills containing a controlled substance to agents of the Drug Task Force in the Town of Batavia and in Pembroke. She was arraigned in Pembroke Town Court and released on her own recognizance and arraigned in Town of Batavia Court and jailed on $5,000 bail.

Nicholas E. Patterson, 21, of Kilian Road, Pembroke, is charged with two counts of criminal sale of a controlled substance, 5th, and two counts of criminal possession of a controlled substance, 5th. Patterson allegedly sold a quantity of pills containing a controlled substance to agents of the Drug Task Force in the Town of Batavia and in Pembroke. He was released under supervision of Genesee Justice.

Edward Jordan White, 20, of Michigan Street, Lockport, is charged with two counts of criminal sale of a controlled substance, 3rd, and two counts of criminal possession of a controlled substance, 3rd. White's vehicle was stopped Dec. 30 by members of the Local Drug Task Force for allegedly operating on a suspended license. White was accused of possessing crack cocaine and marijuana. He is also accused of aggravated unlicensed operation. He was also arrested on a warrant out of Genesee County Court for alleged violation of probation. White is alleged to have sold a quantity of heroin and crack cocaine to an agent of the Drug Task Force on another date while in the City of Batavia. Edward Jordan White, 20, of Michigan Street, Lockport, is charged with criminal possession of a controlled substance, 7th, unlawful possession of marijuana and aggravated unlicensed operation, 2nd. White was stopped by members of the Local Drug Task Force on Dec. 30 for allegedly driving on a suspended driver's license. White was allegedly found in possession of a quantity of marijuana and cocaine. White was also allegedly in violation of probation.

William Guadalupe Potter, 62, of North Pearl Street, Oakfield, is charged with harassment, 2nd. Potter allegedly pushed a woman into a wall causing her to fall over.

Brian Eric Dagger, 30, of Batavia Street, Holley, is charged with petit larceny. Dagger allegedly stole a bottle of Robitussin tablets from Kmart. He was jailed on $2,500 bail.

Seth Ryan Doster, 24, of Alleghany Road, Darien, is charged with petit larceny. Doster allegedly stole $102.20 in merchandise from Walmart. Also charged, Sarah Dianne Lazarus, 24, of Alleghany Road, Darien.

Kim Marie Spencer, 56, of Chick Road, Darien, is charged with DWI. Spencer was arrested by Deputy Michael Lute in connection into an investigation into an incident reported at 6:49 p.m. Thursday on Chick Road, Darien. The investigation is continuing and additional charges are pending.

Jeffrey Lynn Shultz, 21, of Walkers Corner Road, Byron, is charged with criminal contempt, 2nd. Shultz allegedly engaged in an unsupervised visit in violation of a court order.

Kenneth Fred McGiveron, 25, of Route 78, South Wales, is charged with no stop lights, open container, DWAI drugs and alcohol combined and DWAI drugs. McGiveron was stopped at 12:58 p.m. Saturday on Route 77, Pembroke, by Deputy Lonnie Nati.

Leonard Alfred Johnson, 23, of Hutchins Street, Batavia, is charged with criminal possession of a controlled substance, 3rd, and criminal use of drug paraphernalia, 2nd. Johnson was a passenger in a car stopped by Officer Chad Richards at 5:23 p.m. in the parking lot of Horizon Health Services, 31 Ellicott St., Batavia. Johnson allegedly fled on foot following the traffic stop, but returned on his own a short time later. Police allegedly found a bag containing a dozen smaller bags of cocaine, which Johnson indicated belonged to him. Johnson was jailed without bail.

Coretta M. Pitts, 47, of Williams Street, Batavia, is charged with second-degree harassment. Pitts allegedly scratched the face of another person during an argument reported at 4:50 a.m., Saturday. Pitts was jailed on $400 bail.

Jason A. Armstrong Sr., 43, of Main Road, East Pembroke, is charged with first-degree criminal sexual act and criminal obstruction of breathing or blood circulation. Armstrong allegedly choked and had unwanted sexual contact with another person during an alleged domestic incident reported at 10 p.m. Nov. 6 on South Main Street, Batavia. Armstrong was jailed without bail. Armstrong was also charged with strangulation, 2nd, and assault, 2nd, for an alleged incident reported at 6 a.m. Dec. 22 at a location on South Main Street, Batavia.

Robert W. Blankenberg, 31, of Union Street, Le Roy, was arrested on a warrant. Blankenberg was stopped for an alleged traffic violation and arrested on the warrant.

Robert D. Kendall, 55, of Jamaica Lane, Cheektowaga, is charged with leaving the scene of a property damage accident, moving from lane unsafely, driving a motor vehicle on sidewalk, driving through safety zone and unlawful possession of marijuana. Kendall was charged after an investigation into an accident reported at 12:03 p.m. Dec. 29 on Oak Street, Batavia. Kendall was located by police in the parking lot of a business on West Main Street following a tip from a witness.

Michael J. Henry, 48, of State Street, Batavia, is charged with disorderly conduct. Henry is accused of continuously using obscene language outside his home on State Street while police officers were there investigating a complaint.

Michael J. Antonucci, 33, of Alexander Road, Attica, is charged with criminal contempt, 2nd. Antonucci allegedly violated a complete stay away order by sending a text to the protected party.

Jason W. Wolf, 39, of West Main Street Road, Batavia, is charged with aggravated unlicensed operation, 2nd, and driving without interlock device. Wolf was stopped at 5:04 p.m. Dec. 29 on Brooklyn Avenue, Batavia, by Officer Mitchell Cowen.

Kenneth J. Wolter, 45, of Watson Street, Batavia, is charged with unreasonable noise. Wolter was allegedly playing music an unreasonable level at 10:37 p.m. Dec. 30 and he refused repeated requests to turn it down.

Robert Ernest Saari, 34, of Meiser Road, Corfu, was arrested on a warrant for alleged failure to appear. Saari allegedly failed to appear in City Court on a traffic violation. Saari posted cash bail and was released.

Melvin J. Swanson, 60, of Main Road, Pembroke, is charged with DWI, driving with a BAC of .18 or greater, failure to obey traffic control device and open container. Swanson was stopped at 1:58 a.m. Friday on South Main Street, Batavia, by Officer Mitchell Cowen.

Todd Allen Weigert, 20, of Helena Street, Perry, is charged with criminal possession of a controlled substance, 7th. Deputy Chris Erion and K-9 Destro responded to the 7-Eleven in Bergen at 12:16 p.m. Thursday following a complaint of people possibly using narcotics in the parking lot. An investigation led to an accusation that Weigert possessed a quantity of a suspected narcotic and paraphernalia.

Scott W. Froebel, 47, of Colby Road, Corfu, is charged with DWI, driving with a BAC of .08 or greater, inadequate stop lights and open container. Froebel was stopped at 9:26 p.m. Dec. 19 on Prospect Avenue, Batavia, by Officer Arick Perkins.

Joshua M. Pierce, 20, of Meadowbrook Terrace, Corfu, was arrested on a warrant for alleged failure to appear. Pierce allegedly failed to appear in City Court on a traffic violation and an unlawful possession of marijuana charge. 

Shane Zimblis, 44, of Hutchins Street, Batavia, is charged with criminal contempt, 2nd. Zimblis was arrested upon his release from the Wyoming County Jail, where he was held on unrelated charges. Zimblis is accused of contacting a protected individual in violation of an order of protection. He was jailed on $5,000 bail.

A 17-year-old resident of Fargo Road, Stafford, is charged with unlawful possession of marijuana. The youth was arrested following a search of his vehicle at 12:01 a.m. Thursday by Officer Mitchell Cowen.

Joshua Richard Nanni, 21, of Broadway Street, Oakfield, is charged with unlawful dealing with a minor, 1st. Nanni was charged following an investigation into a loud noise complaint at his residence at 6:08 p.m., Tuesday. He is accused of providing alcohol to persons under age 21. Also charged was Dylan Ricky LaFramboise, 21, of Broadway Street, Oakfield.

Duty Everett Casell, 24, of South Pearl Street, Oakfield, is charged with DWI, driving with a BAC of .18 or greater, no helmet, uninsured ATV. Caswell was arrested following the completion of an investigation into an accident at 7:55 p.m. Oct. 31 on South Main Street, Oakfield, involving an ATV. Caswell's ATV reportedly hit the rear end of a parked car. Caswell and his passenger were ejected from the ATV. Caswell allegedly fled the scene and located a short distance away. He was transported by an ambulance to an area hospital for medical treatment 

The Corfu Police Department sponsored a toy drive Sunday, with dozens of donations pouring in. The toys will be presented to local boys and girls Dec. 19.

Joshua M. Gaudioso, of Galloway Road, Batavia, is charged with second-degree harassment and second-degree strangulation. He was arrested following a domestic incident at 7:46 p.m. on Dec. 6 wherein he allegedly strangled the victim and threatened to kill the victim along with several members of the victim's family. He was jailed without bail. The case was handled by Batavia Police Officer Jason Ivison, assisted by Officer Christopher Lindsay.

James E. Wroten Jr., 49, of Central Avenue, Batavia, was arrested at 10 p.m. on Dec. 7 on Olyn Avenue following a verbal and physical argument between himself and a person who had a stay away order of protection from Wroten. It is alleged that the defendant called the protected party names and pushed a plate into her face during an argument. He was jailed without bail. The case was handled by Batavia Police Officer Jamie Givens, assisted by Officer Jason Ivison.

Kenneth C. Roma, 28, of South Main Street, Batavia, is charged with DWI, operating with a BAC of .08 percent or more, uninspected motor vehicle, cracked/broken windshield, and driving to the left of pavement markings (a no-passing zone). The Sheriff's Office received two calls from other motorists about the poor driving habits of the driver of a pickup truck eastbound on Route 5 in the Town of Batavia at around 10:20 p.m. on Dec. 11. The callers continued to follow the pickup and provide dispatchers with the current locations and details of when the pickup allegedly interfered with other vehicles on the roadway. Sheriff's Sgt. Ron Meides located the pickup on West Avenue in the Village of Attica with a caller's assistance. The driver indicated he was lost and did not know where he was. Meides was assisted by other members of the Sheriff's Office and two officers from the Attica Police Department. Roma was released on an appearance ticket and is to be in Alexander Town Court on Jan. 12. Sgt. Meides was assisted in the investigation and report by Sheriff's Deputy Richard Schildwaster.

Heather R. Frizol, 35, of Maple Street, Batavia, is charged with aggravated driving while intoxicated, DWI, speeding, failure to maintain lane, and passing through a red light. She was arrested following a traffic stop at 1:28 a.m. on Dec. 6 on Main Street, Batavia. Frizol was also charged as an unlicensed driver and for allegedly having an open container of alcohol in the vehicle. She is to appear in City Court on  Dec. 16. The case was handled by Batavia Police Officer Jason Davis, assisted by Officer Felicia DeGroot.

Richard Dean McKague Jr., 25, of West Main Street Road, Batavia, is charged with unlawful possession of marijuana, second-degree aggravated unlicensed operation, failure to yield right-of-way to an emergency vehicle, failure to stop at a stop sign, and being an unlicensed operator. His arrest at 6:06 a.m. on Dec. 10 came after a vehicular pursuit that started in the Town of Stafford and ended in the Town of Byron. It is alleged that McKague was observed violating sections of state vehicle and traffic law and then when a traffic stop was initiated, be failed to comply. The pursuit through two townships concluded on Beaver Meadows Road and he was taken into custody without incident. A search of his person allegedly produced a small quantity of marijuana. He was jailed in lieu of $2,500 cash bail or $5,000 bond and will respond to both Stafford and Byron courts to answer the charges. The investigation was handled by Sheriff's Deputy Joseph Corona, with the assistance of Deputy Christopher Erion, Sgt. Eric Seppala, and State Police.

Jeffrey Lynn Shultz II, 21, of Walkers Corners Road, Byron, is charged with operating a motor vehicle while impaired by drugs -- first offense, driving left of pavement markings, and operating a motor vehicle without an inspection certificate. He was arrested at 1:51 p.m. on Dec. 12 on Byron Road in Byron. He is to appear in Byron Town Court on Dec. 15. The case was handled by Sheriff's Deputy Joseph Corona, assisted by Deputy Patrick Reeves.

Roger James Farney, 33, of Clayton Street, Buffalo, is charged with second-degree criminal contempt. He was arrested at 1 p.m. on Dec. 9 on West Main Street in Batavia after allegedly making derogatory statements toward a person who has an order or protection. He turned himself into Batavia PD headquarters and is to appear in City Court on Dec. 29. The case was handled by Batavia Police Officer Peter Flanagan.

Jeannine Nicole Armbrewster, 38, of Ridge Road, Medina, is charged with driving while ability impaired by drugs. She was arrested at 7:42 p.m. on Dec. 12 on Alexander Road, Alexander. The case was handled by Sheriff's Deputy Dana Richardson, assisted by Deputy Christopher Parker.

Ryan Joseph Bellinger, 25, of Route 209, Varysburg, is charged with criminal possession of a weapon in the fourth degree -- brass knuckles, unlawful possession of marijuana, and operating a motor vehicle with obstructed vision. Bellinger was arrested following a traffic stop at 10:21 p.m. on Dec. 13 on Alleghany Road, Pembroke. He was issued an appearance ticket for Pembroke Court on Jan. 21. The case was handled by Sheriff's Deputy Lonnie Nati.

Daniel C. Brinkman Sr., 55, of Mill Street, Batavia, is charged with third-degree criminal trespass. It is alleged that at 8:30 a.m. on Dec. 9, Brinkman trespassed onto CSX Railroad property (located at 100 Evans St., Batavia) after having been warned to stay off the property. He is due in City Court on Dec. 16. The case was handled by Batavia Police Officer Chad Richards, assisted by Officer Kevin DeFelice.

Jason L. McKenzie, 37, and Pamela L. McKenzie, 39, husband and wife from Pavilion, were arrested by state Troopers on Dec. 6 and charged with petit larceny for allegedly stealing items from Kohl's earlier in the week.

Kelli E. Wallace, 53, of Swan Street, Batavia, is charged with petit larceny. She was arrested at 7:20 p.m. on Dec. 7 after allegedly stealing property from Dollar General. She was issued an appearance ticket and is to appear in City Court on Dec. 15. The case was handled by Batavia Police Officer Jason Ivison, assisted by Officer Jamie Givens.

Michael F. Geer, 24, of Trumbull Parkway, Batavia, was arrested at 3:56 a.m. on Dec. 11 as the result of an investigation into an incident that occurred on East Main Street on Nov. 13. Geer, who is currently in county jail, was issued an appearance ticket charging him with petit larceny. He is to be in City Court on Dec. 15. The case was handled by Batavia Police Officer Eric Foels.

After being pulled over for allegedly having insufficient tail lamps, it was found that the defendant's license was suspended more than 10 times on 10 dates. The case was handled by Sheriff's Deputy Eric Meyer, assisted by Deputy Kevin McCarthy.

Martin James Rodgers, 31, of West Main Street Road, Batavia, is charged with parole violation. As the result of a search of his residence at 10:45 p.m. on Dec. 10, is alleged that he violated parole. A court date for him has not yet been scheduled. The case was handled by Sheriff's Deputy Ryan DeLong, assisted by Deputy Howard Carlson.

Daniel Colin Healy, 24, of North Street, Le Roy, is charged with failure to appear on a traffic summons. He turned himself into Batavia PD headquarters after being notified by mail that he had a warrant out for his arrest. He is to be in City Court on Dec. 15. The case was handled by Batavia Police Officer Jason Davis.

Zachary B. Reeves, 19, of Maine, is charged with unlawful possession of marijuana. On Dec. 12 at Route 33 and Prospect Street, Corfu, Reeves was pulled over for allegedly driving 54 in a 35-mph zone and for having a loud muffler. The patrol officer allegedly smelled marijuana in the vehicle and allegedly found marijuana residue on the passenger seat. Subsequently, the officer allegedly found a jar containing about 1 gram of marijuana as well as two glass smoking pipes and "1 false cigarette containing marijuana residue." The case was handled by Corfu PD Officer Michael Petritz, assisted by Sheriff's Deputy Lonnie Nati and Deputy Chris Erion and K-9 "Destro."

James J. Spivey, 17, of Child Street, Rochester, is charged with burglary, attempted second-degree assault, and endangering the welfare of a child. The youth is accused of entering Batavia High School without permission with the intent to fight a student there. The defendant did allegedly engage in a fight with the student, who is under age 17, and during the fight used a dangerous instrument in an attempt to injure the student.

Erica Michelle Raphael, 30, of Walnut Street, Batavia, is charged with petit larceny. Raphael is accused of stealing merchandise from the Rite Aid on West Main Street Road, Batavia.

Tyler Austin Stoddard, 21, of Meiser Road, Corfu, is charged with making graffiti. Stoddard was arrested on a warrant. He is accused of drawing a picture of a penis on the wall of the ATM at the M&T Bank branch in Corfu.

Michael F. Geer, 24, no permanent address, is charged with burglary, 2nd, petit larceny, unauthorized use of a motor vehicle and criminal mischief, 4th. Geer allegedly entered a residence on Trumbull Parkway, took the keys to a vehicle that was parked in the driveway, and unlawfully moved the vehicle, striking the back porch. He was jailed on no bail.

Amber N. Wallace, 26, of Swan Street, Batavia, is charged with petit larceny. Wallace is accused of drinking a "5-hour ENERGY" drink without paying for it while at work at a business on Jackson Street.

Michael A. Wroten, 48, of Highland Parkway, Batavia, was arrested on a warrant. Wroten was located by probation officers and turned over to Batavia PD. He was jailed on $2,500 cash bail.

Nikayla C. Jackson, 18, of Slusser Road, Batavia, is charged with second-degree harassment and fourth-degree criminal mischief. Jackson allegedly pushed another person and damaged property while inside that person's apartment at 8:25 p.m., Nov. 9.

Jessica L. Ford, 24, of Perry Road, Le Roy, is charged with violation of probation. Ford was arrested on warrants issued by City Court.

Deborah R. Blatt, 54, of East Main Street, Batavia, was arrested on a warrant. She was jailed on $5,000 bail.

Chercal A. Smith, 20, of Bank Street, Batavia, is charged with violation of probation. Smith was observed by Officer James DeFreze, who was aware of a warrant for Smith's arrest, on Court Street. Smith was taken into custody without incident.

Cody N. Proefrock, 23, of West Court Street, Warsaw, is charged with aggravated unlicensed operation. Proefrock was arrested on a warrant for alleged failure to appear on the listed charges.

Sara A. Weaver, 46, of Watson Street, Batavia, was arrested on a warrant for alleged failure to appear in court and for aggravated unlicensed operation, 2nd. Weaver was arrested following a traffic stop by Officer Mitchell Cowen.

Nicholas G. Serret, 19, of 15 Dewain St., Rochester, is charged with unlawful possession of marijuana, a violation. The subject was a passenger in a vehicle stopped by Corfu Police for speeding on Route 77 at 2:34 p.m. on Nov. 24. The subject was allegedly found to have a plastic baggie containing about three grams of marijuana. The case was investigated by Corfu PD Officer Michael Petritz.

Brad L. Ohlson, 38, of Walnut Street, Batavia, is charged with third-degree assault. He was arrested on Nov. 20 after an incident occurred at 3:51 p.m. on Central Avenue. It is alleged that Ohlson struck another person, causing the person to fall and strike a door, causing physical injury to that person. Ohlson was issued an appearance ticket and is to be in City Court on Dec. 8. The case was handled by Batavia PD Officer Chad Minuto, assisted by Officer Mitchell Cowen.

Christopher J. Simmons, 42, of Wayneport Road, Macedon, Leanna J. Williams, 25, of St. Paul Street, Rochester, and Anthony J. Stagnitto, 26, of West Ridge Road, Rochester, were arrested Nov. 21 after the trio was allegedly involved in shoplifting at Kohl's department store in Batavia. The vehicle used in the crime was stopped on Noonan Drive near the intersection of Oak Street by city Police officers. It is alleged that Simmons entered the store and removed items while Williams drove the getaway car, picking Simmons up by the front doors and speeding away. Stagnitto was a passenger and identified himself falsely as another person because he had a felony arrest warrant out of Monroe County for him. Stagnitto was turned over to the Monroe County Sheriff's Office and is charged with criminal impersonation, a misdemeanor. Simmons was jailed without bail and is to reappear in Town of Batavia Court on Nov. 30. He is charged with a felony -- fourth-degree grand larceny, and he was also issued an appearance ticket for criminal possession of a controlled substance, 7th, which is a misdemeanor, and is due in City Court on Dec. 14. Williams was issued an appearance ticket for fourth-degree grand larceny, a felony, and is due in Town of Batavia Court on Dec. 17. The case was investigated by Sheriff's Deputy Rachel Diehl and Deputy John Baiocco, assisted by Deputy Christopher Parker, and Batavia PD officers Marc Lawrence and Frank Klimjack.

James A. McCormick, 23, of Kendall Road, Churchville, is charged with moving from lane unsafely, driving while intoxicated and aggravated driving while intoxicated for allegedly having a BAC of .18 percent of higher at the time. He was arrested after a motor-vehicle accident at 12:43 a.m. on Nov. 22 on North Lake Road, Bergen. His vehicle went off the roadway and struck a utility pole. He was issued an appearance ticker for Town of Bergen Court at a later date and time. The case was handled by Sheriff's Deputy Andrew Hale, assisted by Deputy Joseph Corona.

Armand M. Gioia, 28, of Hall Street, Batavia, is charged with driving without a license, driving while intoxicated -- first offense, operating a motor vehicle with a BAC of .08 or more -- first offense, and unsafe backing of a vehicle. Gioia was stopped at 1:20 p.m. on Nov. 15 on East Main Street, Batavia, after he allegedly struck another vehicle in the parking lot of a local restaurant. He is to be in City Court on Dec. 2. The case was handled by Batavia PD Officer Matthew Wojtaszczyk, assisted by Officer Felicia DeGroot.

Marissa Anne Brennan, 22, of North Byron Road, Byron, is charged with fourth-degree grand larceny. She was arrested at 2 p.m. on Nov. 17 for allegedly stealing property in excess of $1,000 in value. She was put in jail on $2,500 bail. The case was handled by Sheriff's Deputy Ryan DeLong, assisted by Deputy James Diehl.

Randy Dumbleton Jr., 32, of 3322 W. Main St., Batavia, is charged with criminal possession of a controlled substance, 3rd, a Class B felony, unlawful possession of marijuana, and criminal use of drug paraphernalia, 2nd. During a residence check on Nov. 21 at 7:26 a.m. by NYS Parole, the subject was allagedly found to possess a quantity what is suspected to be crack cocaine and marijuana. He was taken into custody and given no bail. The case was handled by Sheriff's Deputy Lonnie Nati, assisted by Deputy Chad Minuto.

A 16-year-old who lives on Central Avenue in Batavia is charged with disorderly conduct for fighting. The teen was arrested on Nov. 19 at Batavia High School for fighting with another student in the hallway. The teen was issued an appearance ticket and released. The case was handled by Batavia PD Officer Marc Lawrence.

Frank Lynn Morrison, 34, of West Main Street Road, Batavia, was arrested on a bench warrant for failing to appear in court on a charge of third-degree aggravated unlicensed operation of a vehicle. Arfter being arraigned in City Court, he was released and went to the City Clerk's Office and posted a fine of $135. He is scheduled to pay the remainder of his fines in increments. A return court date was not set. The case was handled by Batavia PD Officer James DeFreze.

Joshua M. Pierce, 20, of Meadowbrook Terrance, Corfu, is charged with unlawful possession of marijuana and speeding. On. Nov. 22, at 9:39 a.m. Pierce was stopped on Denio Street by Batavia PD for a speed violation. At that time, Pierce was allegedly found to possess marijuana. He was issued an appearance ticket and in due in City Court on Dec. 8. The case was handled by Batavia PD Officer Arick Perkins.

Jeremy David Holmwood, 24, of Corinthia Street, Lockport, is charged with possession of a hypodermic instrument. He was arrested on a bench warrant for allegedly failing to appear on previous charges on Nov. 4. He was jailed on $1,000 bail. The case was handled by Sheriff's Deputy Ryan DeLong.

Chong Christian Nimora, 35, of Metropolitan Drive, Rochester, was arrested on a bench warrant out of Town of Batavia Court for a charged on Nov. 7 of petit larceny. She was released on her own recognizance. The case was handled by Sheriff's Deputy Ryan DeLong.

Bleyke Z. Culver, 19, of Ellsworth Avenue, Batavia, was arrested after a bench warrant was issued through City Court for Culver's alleged failure to pay a fine in regards to owning/harboring an unlicensed dog. He posted bail and was released and is to return to court on Dec. 8. The case was handled by Batavia PD Officer Jamie Givens.

The driver in an accident in Bethany in February that claimed the life of an 18-year-old Genesee Community College student entered a guilty plea in County Court this morning to one count of second-degree vehicular manslaughter and DWI with a plea deal that caps her sentence to six months in county jail and five years on probation.

Hannah C. Dibble, 22, of Corfu, will also lose her driver's license and any vehicle that she might drive will be required to have an interlock ignition device.

After going through a series of alcohol-rehabilitation treatments, Dibble was scheduled to appear in court this morning with her attorney Benjamin Bonarigo on a hearing for motions to suppress some evidence in the case, but when the case was called, ADA Will Zickl told Noonan a plea deal had been reached in the case.

Dibble was at the wheel of a 1997 Chevrolet Geo on Feb. 21 when it crossed Route 20 at Molasses Hill Road, Bethany, and was struck by a semi-truck.

There were four passengers in her car at the time, including Alyson D. Krzanak, 18, of Corfu, who died as a result of injuries sustained in the crash. Suffering serious physical injuries in the collision Feb. 21 were James Scherer, 21, Brandon Danser, 22, and Felecia J. Fazzio, 20.

Bonarigo informed the court that Dibble remains in in-patient treatment and will enter a halfway house shortly after the first of the year.

The terms of the sentence are known as "shock probation," giving a defendant a taste of jail and five years of rules to follow and monitoring after release.

Sentencing is scheduled for Feb. 23.

After the case was adjourned, Judge Robert C. Noonan told Dibble, "I'm happy to see the recent report (on her progress), especially after the stumble you took early on, so keep on the right track."

A one-car accident with injuries is reported at 1428 Main Road in Corfu. East Pembroke Fire Department and Mercy medics are responding.

UPDATE 1:14 p.m.: Pembroke and Indian Falls fire departments are requested to the scene for mutual aid to East Pembroke.

A one-car rollover accident with entrapment is reported at 591 Main Road, Corfu. Unknown unjuries. Prior to the accident, dispatch had received calls that the vehicle was unable to maintain its lane. Pembroke and Indian Falls fire departments are responding.

UPDATE 3:42 p.m.: There is "heavy entrapment" of one occupant. East Pembroke fire is called to provide mutual aid. Mercy Flight #5 is called to the East Pembroke Fire Hall.

UPDATE 3:47 p.m.: The roadway will be shut down and is expected to be closed for a long time. The driver is a man in his late 60s or early 70s who is said to be semi-conscious. There are live wires in the road. The pole they are hanging from is not broken, but does have a transformer on it. National Grid and the phone and cable companies are being contacted about the lines.

UPDATE 3:54 p.m.: Mercy Flight is ariborne and headed to the scene, about three to four minutes away.

UPDATE 4 p.m.: The patient has been extricated. Mercy Flight is on the ground.

UPDATE 4:05 p.m.: Command requests Alden Fire Police to shut down Crittenden Road at Route 5. "There isn't going to be any traffic through here for awhile."

UPDATE 4:19 p.m.: Mercy Flight is airborne. Destination not provided.

UPDATE 4:39 p.m.: Pembroke Fire Chief Jamie Waff said one vehicle went off the road, broke a utility pole, rolled over and landed on its roof. "It was a lengthy extrication process and it usually is when the vehicle is on its roof because everything is basically backwards from what we're used to in everyday life." Waff said the driver was semi-conscious but talking and able to assist firefigthers in his extrication. He was transported to ECMC, primarily for evaluation. Waff said due to the fact that a transfomer was involved, along with six to eight different kinds of power lines, the roadway will remain closed for probably at least another two hours, and it will take up to six hours or more for everything to be restrung and put back together. National Grid is on scene. The accident is under investigation. A witness said the driver passed two cars on the right just prior to the accident.

UPDATE 7:27 p.m. (by Howard): The road remains closed. Volunteer firefighters have had their hands full with people trying to circumvent the roadblocks. One resident who lives between the roadblocks went back and forth between roadblocks trying to get to his house and when a chief was notified, he was allowed to proceed. A person on scene told a chief that he's "in shock and awe" at how long repairs are taking. He's asked that dispatchers contact National Grid about the length of time the repairs are taking. 

UPDATE 8:04 p.m. (by Howard): The entire hamlet of Pembroke is without power. This is apparently the cause of power outages as well at Brickhouse Corners and the Thruway interchange. Earlier we heard there was confusion about getting the proper National Grid on scene in a timely manner because the crew was not informed it was a 9-1-1 call and that a pole was down.

A GoFundMe account has been set up with an initial goal of raising $3,000 to assist Lori Ann Santini and her three children after they lost their home on Brown Road, Corfu, to fire yesterday.

So far, $2,300 has been raised.

The house and all its contents were destroyed in the wind-swept fire.

Santini is a volunteer with the East Pembroke department as well as a medic with Mercy EMS and Le Roy Ambulance.

Chief Don Newton said the brothers and sisters of the East Pembroke Volunteer Fire Department will take care of one of their own who lost her home to a fast-moving, wind-driven fire today. 

It was a tough thing to watch the home of a volunteer burn in conditions that made saving even a portion of the structure impossible. The house, at 2463 Brown Road, Corfu, sits in the middle of an agricultural area, so the high winds were complicated by a lack of a nearby fire hydrant. Water tankers and porta-ponds were needed to supply the pumpers and a consistent water flow was hard to maintain.

Newton and Tim Yaeger, emergency management coordinator, both said the fire was well advanced, the flames driven by the winds, by the time the first firefighters arrived.

"The fire would not have been advanced as it was if it was not as windy as it was today," Yaeger said. "We probably could have made an interior attack, but with this, right off the bat, the incident commander, the fire chief of East Pembroke, got on location and called an exterior attack only just because of the advancement of the fire."

The house, built in 1890, was owned by Lori Santini. She was at work and her children were in school when the fire broke out.

The fire appears to have started in an addition on the eastern side of the house at the location of a heat stove.

"Firefighters were able to retrieve a family pet, a dog, so the dog is out safely," Yaeger said.

However, the family cats were not located and are not believed to have survived, Newton said. The family also had pet birds and a pet newt. The fire did not spread to the nearby chicken coop and the chickens are apparently fine.

"It's always difficult to deal with that (a fire at the home of a volunteer firefighter), but thankfully everybody is OK, she's OK, the family is OK, and no injuries reported here of firefighters so far. Everybody is safe," Yaeger said.

The house and all of its contents were a complete loss. 

"We talked about Red Cross, but the chiefs said they will take care of her, so I'm sure she's in good hands," Yaeger said.

Newton said his department will likely head a communitywide effort to assist Santini and her children. The Batavian will share more information about assistance efforts when it becomes available.
