Comptroller's office finds alleged improprieties in Corfu Fire District finances

A NYS audit of the Corfu Fire District released today (pdf) says that fire district board members have not completed proper annual audits and that such audits would have found unauthorized personal use of district credit cards.

The fire district collects taxes to help fund the Corfu Fire Department, but is a separate entity from the fire department.

Its annual budget is more than $112,000.

The NYS Office of the Comptroller examined the district's financial records for 2008 through 2011.

Among the findings was that allegedly the district treasurer and a former fire chief made personal purchases with district credit cards totalling $2,045.

The report states that the treasurer confirmed $601 in purchases made in June and July of 2009 were for personal items.

The former chief allegedly made purchases reportedly for $779 from July through December 2008. His January 2008 bill also included a balance due of $665, according to the report.

Neither the former chief nor the treasurer are named in the report, but the report states these charges were reimbursed to the district, though it's unclear when the reimbursements took place.

According to the comptroller's office, district credit card balances included $1,600 in interest and late fees.

The district paid $380 in fees and interest, but only authorized $142 of these payments, according to the report.

"If the board had properly reviewed the actual credit card monthly billing statement," the report reads, "it would have seen that the amount on the abstract was greater than the amount due for legitimate district purchases."

The report, issued to the district on Sept. 2, offers four recommendations, including that the board: formerly adopt a credit card policy; audit every claim before approving payment; require annual financial reports issued to the comptroller's office; and that the treasurer make payments directly to vendors as authorized by the board.

In a response letter, Board Chairman Robert Ammon says that the district will adopt a former credit card policy and that it adopted internal financial controls in 2009. He also says the district has sought and received assistance from the controller's office on filing proper reports, and that the board will document concerns and require further back up for any questionable expenditures.

The response letter states that reports were not filed with the state previously because of technical difficulties involved in meeting new requirements by the state.

The letter does not directly address the issue of unauthorized use of district credit cards for personal purchases.

Fire alarm sounding at Presbyterian Church of Corfu

Corfu and Darien fire departments are responding to a fire alarm at the Presbyterian Church of Corfu, located at 63 Allegany Road.

The alarm is indicating a problem in the basement, bathroom and pantry.

UPDATE 7:48 a.m.: Darien is told to stand down. The Corfu unit is held to one unit.

UPDATE 7:50 a.m.: The chief says "It was just burnt turkey. Corfu returning, in service."

Multiple car smash up on Route 77, Corfu

A multiple vehicle accident with multiple injuries is reported at 9049 Route 77. Corfu Fire Department and Mercy medics are en route.

UPDATE 2:15 p.m.: There are four vehicles involved. Darien Fire Department is also headed to the scene.

UPDATE 2:40 p.m.: Traffic is snarled near the accident scene. Traffic police are needed and they are seeking an available unit. A medic from Darien has transported one patient to UMMC.

UPDATE 2:59 p.m.: All Corfu units are back in service. A Sheriff's deputy is handling traffic detail.

UPDATE 3:13 p.m.: Darien units are about to clear the scene and when they do they plan to go to Alexander High School to stand by at the football game while Alexander Fire Department handles a race car accident.

Four local resident earn degrees from Ithaca College

Four local residents recently received degrees from Ithaca College.

Megan Suttell, daughter of John and Kathleen Suttell, of Oakfield, received a degree from the Division of Interdisciplinary and International Studies.

Allyce Barron, daughter of Bruce and Marie Barron, of LeRoy, received a degree from the School of Music.

Chad Condidorio, son of Joseph and Christine Condidorio, of Le Roy, received a degree from the School of Health Sciences and Human Performance.

Cody Chittenden, son of Franklin and Susan Chittenden, of Corfu, received a degree from the School of Humanities and Sciences.

Coeducational and nonsectarian, Ithaca College is a nationally recognized independent college of some 6,300 undergraduates and 400 graduate students. The college offers more than 100 degree programs.

Corfu resident accused of selling cocaine enters guilty plea

A Corfu resident admitted today in Genesee County Court to drug dealing and faces up to two and a half years in state prison if Judge Robert C. Noonan imposes the maximum sentence available under a plea bargain.

Brandon R. Brade, 29, entered a guilty plea to one count of criminal possession of a controlled substance, 5th.

Brade was facing four more felony counts of criminal sale of a controlled substance, 3rd, and possession of a controlled substance, 3rd.

Noonan has a range of sentencing options available, from probation with no jail up to the maximum, because Brade has no prior felony convictions.

Sentencing is set for Nov. 7.

Meanwhile, Brade is out of jail under supervision of Genesee Justice.

Brade was accused of selling cocaine to an undercover agent and arrested in February.

Police Beat: Bail set at $25K for man accused of burglarizing home in Elba

Christopher Michael Lambert, 31, of Elm Street, Batavia, is charged with burglary, 2nd. Lambert is accused of entering a residence on Log City Road, Elba, after being told to stay away. Lambert allegedly stole money and a new Garmin GPS unit. Bail was set at $25,000.

Jenea Marie Macleod, 27, of Genesee Street, Corfu, is charged with DWI, driving with a BAC of .08 or greater, operating an ATV on a public highway and no headlights on an ATV. Macleod was stopped at 10:08 p.m., Saturday, on Genesee Street in Pembroke by Deputy Howard Carlson.

Tracy Lynn Polak, 40, of Aldercreek South Road, North Tonawanda, is charged with DWI, driving with a BAC of .08 or greater, operating with registration suspended or revoked and driver's view obstructed. Polak was stopped at 10:36 p.m., Wednesday, on Route 77, Corfu, by Deputy Patrick Reeves.

Jonathan David Eldred, 27, of Main Road, Akron, is charged with criminal possession of a controlled substance, 7th, and criminal possession of a hypodermic instrument. Eldred was arrested at 10:46 p.m., Friday, at a residence on Bloomingdale Road, Tonawanda Indian Reservation, when he was allegedly found in possession of heroin and a needle during an investigation into an overdose.

Austin M. Heineman, 17, of Marble Road, Akron, is charged with DWI, driving with a BAC of .08 or greater, operating out of class and failure to keep right. Heineman was arrested following an investigation into an accident that was reported at 12:43 a.m., Saturday, on Sandhill Road, Alabama, by Deputy James Diehl. In the accident, Heineman was reportedly driving south on Sandhill Road when he lost control of the car and it overturned. His passenger, Timothy Ryan, 17, was transported to UMMC with non-life threatening injuries.

Mitchell Gregory Hoinski, 25, of Boll Street, Sloan, is charged with DWI and driving with a BAC of .08 or greater. Hoinski was reportedly involved in a motor-vehicle accident at 11:42 p.m., Friday, in the parking lot of Darien Lake Theme Park. Hoinski reportedly attended the Rascal Flatts concert earlier in the evening.

A one-vehicle rollover accident is reported in the area of 788 Genesee St. in Corfu. There are four people involved, one is an infant, all are conscious and alert. One person is entrapped, another is complaining of back pain. Corfu Fire Department is responding along with Mercy EMS. An ambulance from Darien is also responding, mutual aid.

Police Beat: State Street man accused of intercourse with 14-year-old

Kasean Shannon, 19, of State Street, Batavia, is charged with three counts of sexual misconduct. Shannon allegedly had sexual intercourse with a 14-year-old on three separate occasions in 2010.

Daniel Stephen Boynton, 25, Red Cedar Drive, Rochester, is charged with unlawful possession of marijuana. Boynton was stopped at noon, Thursday, on Route 77 in Corfu by Sgt. Greg Walker for allegedly driving 48 in a 35 mph zone. He was allegedly found in possession of a small quanity of marijuana.

Nicholas W. Higbee, 30, of 280 Matila St., Rochester, is charged with DWI, operating on a suspended or revoked license and unlawful possession of marijuana. Higbee was stopped at 12:03 a.m. on Route 77, Village of Corfu, by Officer Richard Retzlaff.

Ian Taylor McPhail, 22, of Gorham Street, Canandaigua, is charged with DWI and driving with a BAC of .08 or greater. McPhail was reportedly found in a car parked on the shoulder of Colby Road at 1:15 a.m. by Deputy Frank Bordonaro.

Police Beat: Batavia man accused of choking another person

Thomas Michael Pillo, 40, of Alexander Road, Batavia, is charged with criminal obstruction of breathing and harassment, 2nd. Pillo is accused of choking and shoving a victim multiple times during a domestic dispute. The incident, at an address on Alexander Road, Batavia, was reported at 9 p.m., Wednesday.

Joseph Michael D'Amato, 19, of Sumner Road, Corfu, is charged with unlawful dealing with fireworks. D'Amato was arrested following a complaint at 12:05 a.m., Thursday, about fireworks in the Town of Pembroke. D'Amato allegedly set off fireworks "causing annoyance and alarm to several homeowners in the area."

Kateyln Christen Kubala, 22, of Maple Street, Batavia, is charged with petit larceny. Kubala is accused of shoplifting at Walmart.

Jillian Hunt, of Corfu, has been named to the School of Education Spring 2011 Deans' List at Buffalo State College. Hunt is the daughter of Ron and Pamela Burdinaro.

To qualify, students must earn a minimum term GPA of 3.5 and complete a minimum of 12 credit hours.

Tyler J. Scoins, of Hartshorn Road in Corfu, has reserved a place as a transfer student at SUNY Oswego. Fall classes will begin Aug. 29. He last studied at Genesee Community College.

Police Beat: Driver charged with DWI in connection with accident in February

Jody Blaine Gillett, 50, of Pine Hollow Drive, Batavia, is charged with DWI, aggravated DWI and moving from lane unsafely. Following a lengthy investigation into an accident on Clinton Street Road, Batavia, on Feb. 23, Gillett was accused of driving while intoxicated.

Douglas Paul Cornelius, 32, of Pratt Road, Pembroke, is charged with petit larceny. Cornelius is accused of stealing woodworking equipment from a location on Pratt Road, Pembroke. 

Tyler P. Schroeder, 19, of Lewiston Road, Batavia, is charged with petit larceny. Schroeder is accused of stealing $700 from a residence in Elba on June 3. Schroeder was arraigned in Oakfield because no Elba town justice was available and remanded to Genesee Jail on $3,000 bail.

Earl Shateek Anthony Lockhart, 18, of East Main Street, Batavia, is charged with unlawful possession of marijuana. Lockhart is accused of trying to hand off marijuana he had in his pocket to a girlfriend while in Town of Batavia Court on an unrelated criminal charge.

William Andrew Johnson, 23, of Alexander Street, Rochester, is charged with unlawful possession of marijuana. Johnson was allegedly found in possession of marijuana during a traffic stop at 8:43 p.m., Tuesday, on Route 77, Corfu, by Deputy Patrick Reeves.

John Jeffery McCombs, 23, of Oxford Street, Rochester, is charged with unlawful possession of marijuana. McCombs was a passenger in a vehicle stopped for alleged traffic violations at 8:43 p.m., Tuesday, on Route 77, Corfu, when he was allegedly found in possession of marijuana by Deputy Patrick Reeves.

Nathaniel Michael Dickens, 18, of Broadway Street, Oakfield, is charged with harassment, 2nd. Dickens is accused of striking another person during an incident on July 7.

Deborah A. Schramm, 30, of East Main Street, Batavia, and Michael R. Schramm, 35, of East Main Street, Batavia, are charged with petit larceny. Deborah and Michael are accused of shoplifting at Walmart.

GCEDC announces approval of tax abatements for four local projects

The following projects have been approved for tax abatements for job-creation and retention projects, according to the Genesee County Economic Development Center:

  • An $18,000 sales tax exemption has been approved by the GCEDC board for Ken Barrett Chevrolet, 229 W. Main St., Batavia, for expansion of its collision shop. The shop will expand from 7,833 square feet to 15,536 square feet and will cost $635,000. Three new jobs will be created and 10 jobs retained.
  • Graham Manufacturing, 20 Florence Ave., is planning an expansion of its finishing (sandblasting and painting) operation. GCEDC has granted a sales tax exemption of $36,818 and a PILOT tax abatement of $89,088. The project will create an estimated 30 new jobs and help retain 278 existing jobs. The $1.8 million expansion will add 10,000 square feet of manufacturing space to the facility.
  • Angelica Textile Services, Inc., 1-3 Apollo Drive, will receive a $15,125 mortgage tax exemption to help refinance its current $1.2 million mortgage. The project will help retain 78 jobs in Batavia.
  • J&L Feed is planning on converting current greenhouses at 47 West Main St., Corfu, into a project called "The Market," which will create a floral shop, fresh meat and deli market and a general store. An approximately 3,400-square-foot building will be constructed and existing greenhouses will be demolished. J&L will receive a $22,000 property tax exemption, $4,800 sales tax exemption and a $1,250 mortgage tax exemption. An estimated three jobs will be created.

Car accident reported in Village of Corfu

A motor-vehicle accident has been reported in the area of 22 Alleghany Road, Village of Corfu.

Unknown injuries.

Corfu Fire Department and Mercy EMS dispatched.

UPDATE 2:36 a.m.: One lane of traffic shut down. No word on injuries, but it isn't sounding serious.

Murder victim in Buffalo may be from Batavia

A homicide in Buffalo early Friday may have a Genesee County connection.

The Buffalo News reports that Joseph Hale, 35, was shot in the back while in the area of  St. Paul Mall and Ellicott Street. He later died at ECMC.

A reader informs us that Hale was a former Batavia High School student. A public record check shows that a Joseph Hale, 35, has lived in Buffalo, Batavia and Corfu.

From the Buffalo News:

"Homicide detectives are attempting to trace the victim's whereabouts before the shooting incident occurred," said Dennis J. Richards, chief of detectives. "Mr. Hale was seen in the Allentown area earlier in the morning and prior to the shooting."

This is the city's 21st homicide of 2011.

Youths suspected of vandalism at Corfu Intermediate School

Investigators are still trying to identify one youth believed to have been involved in vandalism at Corfu Intermediate School overnight Thursday.

The damage was discovered by school officials Friday morning, which included damaged ceiling tiles and a broken bulletin board.

It's possible at least three youths were involved, with two juveniles already identified as possible suspects.

Besides the damage, the suspects allegedly stole a bicycle and candy.

The bicycle has been recovered.

Youth Officer John Dehm and Investigator Tim Weis are handling the case.
