Two Genesee County schools are among 10 finalists to receive $50,000 grants from Pepsi Co. following a competition among thousands of grant proposal submitted to the soft drink company.

Supporters of the projects were asked to express that support through online voting and text messages in the national competition.

"We couldn't have done it without the team effort of the entire community," said Robert Morris Principal Diane Bonarigo.

Robert Morris applied for a grant to fund construction of a new playground.

The Byron-Bergen Elementary School Playground Committee also finished in the top 10.

Next, Bonarigo said, Pepsi will review the grant applications again and make sure all of the paperwork is in order. She said she expects official confirmation of the grant in a couple of weeks.

"We are very excited to be finalists," said Bonarigo. "The students are excited."

She thanked the whole community for their support and the local media for promoting the competition.

A passerby has called in a trailer fire in the area of Route 262 and Transit Road.

It's unknown if the trailer is occupied.

Byron and South Byron being dispatched along with a tanker from Elba and Town of Batavia's Fast Team.

UPDATE 2:05 p.m.: A tanker from Bergen is now on scene. Mercy EMS also responded. A fire chief asks dispatch to contact Elba School to see if they have anyone registered at that address.

Two children are said to have minor injuries following a car-into-pole accident at Route 33 and Warner Road.

Byron and South Byron fire departments and Mercy BLS are responding.

UPDATE 2:49 p.m.: Firefighter on scene says a National Grid pole is busted. A few minutes later, it was determined that the pole was for phone and cable only, not power.

UPDATE 3:45 p.m.: Adults signed waivers for treatment of the children, since their injuries were not serious and transport to a hospital was not needed. All Byron and South Byron units are back in service.

Adam Richard Kopp, 20, of Bushhill Road, Farmersville, is charged with criminal possession of a controlled substance and petit larceny. Kopp is of stealing and then possessing a quantity of Lortab tablets. Kopp was jailed on $10,000 bail.

Dana Douglas Hagen, 31, of Batavia-Byron Townline Road, Byron, is charged with DWI, moving from lane unsafely and no seat belt. Hagen was allegedly involved in a personal injury accident at 11:08 p.m., Wednesday, in the area of 7812 Fotch Road, Stafford. Hagen's car reportedly struck a utility pole at that location.

Penny S. Hofert, 45, of 11 Porter Ave., Batavia, is charged with petit larceny. Hofert is accused of shoplifting from Dollar General.

This afternoon I drove out to Byron for a bit and found a couple of interesting looking barns. The pair above, if I remember correctly, were on Warboys Road. Below, a group of barns on North Byron Bergen Road.

Nicholas Adkins, 20, of West Main Street Road, Batavia, is charged with burglary, 2nd. Adkins allegedly forcibly entered a house on Swamp Road, Town of Byron, and stole money. Adkins was jailed on $5,000 bail.

A 17-year-old resident of Transit Road, Elba, is charged with endangering the welfare of a child. The youth is accused of becoming physically abusive toward a 14-year-old boy while the boy was in the area of 430 E. Main St., Batavia. The Elba youth may be eligible for youthful offender status.

David Paul Bartholf, 19, Kelsey Road, Batavia, is charged with unlawful possession of marijuana. Bartholf was reportedly a passenger in a vehicle stopped by Deputy Patrick Reeves at 4:58 p.m., Nov. 11.  Bartholf was allegedly found in possession of a marijuana pipe.

Gregory Seppe, 52, no permanant address, is charged with petit larceny. Seppe is accused of shoplifting from Dollar General at 8:08 p.m., Wednesday. Seppe was jailed on $750 bail. (For previous reports on Seppe, click here.)

Donna M. Croft, 57, of 56 Buell St., Batavia, is charged with petit larceny. Croft is accused of trying to hide several items of merchandise from Dollar General  in her purse. The alleged crime was reported at 9:54 p.m., Wednesday.

A 15-year-old South Byron girl is missing for the second time within about two months.

Justice Osborne hasn't been seen since Dec. 20, said the John Dehm, youth detective for the Sheriff's Office.

"I'm really worried about her," Dehm said.

While Dehm said she is most likely still in the local area, some of his contacts have suggested she could be as far away as Florida.

Dehm is asking that anybody with any information about Osborne to call him directly at (585) 345-5000, ext. 3575.

Osborne, who is biracial and also known as Jessi, is described as 5'3" and 130lbs.

A motor-vehicle accident is reported on Byron Road, on the curve at Byron-Holley and Tower Hill roads. There are injuries and an ambulance is called.

Byron Fire Department is responding.

Ricky Allen Marsceill, 46, of 174 Ross St., Batavia, is accused of being a fugitive from justice. Marsceill was arrested by Batavia Police Det. Pat Corona on a warrant out of Florida. The underlying charge of the Florida warrant was not released. At 1:10 p.m., Wednesday, Corona approached Marsceill's residence on Ross Street and spotted Marsceill on a bicycle. Marsceill allegedly tried to flee on foot. Corona pursued Marsceill and Officer Jay Andrews responded to the scene. Marsceill was apprehended by Corona and Andrews on Manhatten Avenue. Marsceill was jailed without bail pending extradition to Florida. (Initial Report)

Randy K. Braun, 48, of Maier Lane, Caledonia, is charged with DWI, failure to keep right, moving from lane unsafely and uninspected vehicle. At 9:04 p.m., Wednesday, Deputy Matthew Butler responded to Route 63 in Bethany to investigate a report of a car off the road in a ditch. Braun was allegedly found to be the driver of the vehicle. He was arrested on suspicion of DWI and jailed on $1,000 bail.

Vesna Brongo, 41, of Cadillac Avenue, Rochester, was arrested on a warrant for alleged aggravated unlicensed operation. Brongo was taken into custody by Rochester Police and turned over to the Genesee County Sheriff's Office. Brongo was arraigned in Town of Elba Court and jailed on $250 bail.

A 14-year-old boy from Byron is charged with criminal sexual act with a child 11 years old or younger and endangering the welfare of a child. The name of the suspect was not released by State Police. The crime was reported Dec. 21. No further details were released.

A rollover accident is reported on Transit Road, near Watson Road. Unknown injuries.

Byron and South Byron fire and fire EMS are responding.

UPDATE 5:39 p.m.: All Byron, South Byron units are told to remain in quarters. A responder reports that there is no one in the vehicle. It apparently is not blocking the roadway.

UPDATE 5:44 p.m.: A responder says "We believe (the occupants) went to a labor camp. We are going to have personnel check it out." Meanwhile, a driver and an EMS crew remain on standby in the Byron fire hall.

UPDATE 5:52 p.m.: Now Byron command is calling personnel to the scene of the accident.

UPDATE 5:57 p.m.: The exact location is reported to be 6063 Transit Road.

UPDATE 6:04 p.m.: The commander says "The location has changed, meet us here at Transit and North Byron roads."

UPDATE 6:37 p.m.: About a half hour ago, responders at the scene reported they knocked on the door of a trailer. Apparently, it was someplace near the accident scene, possibly with victims inside. At 6:32, South Byron left the scene. Shortly afterward, two ambulances were reported heading to Strong Memorial Hospital in Rochester.

UPDATE 6:44 p.m.: Byron fire is back in quarters.

A Genesee County man will spend 24 months in federal prison for drug dealing, the U.S. Attorney's Office in Buffalo announced today.

Kenneth E. Munnings, 45, of Byron, was convicted in July in Federal Court of conspiracy to possess with intent to distribute, and to distribute, methamphetamine, cocaine and marijuana.

The charges stemmed from a join federal, state and local wiretap investigation, which revealed the defendant was responsible for obtaining significant quantities of methamphetamine, cocaine and marijuana from a drug trafficking network in Rochester and then distributing the drugs in Genesee County.

Prosecutors say Munnings dealt drugs from some time in 2006 until October 2008.

Michael Aaron Witkop, 18, of Ross Street, Batavia, is charged with sexual misconduct. Witkop is accused of having sexual intercourse with a girl under 17 years of age, who is considered too young to give consent.

Timothy J. McGall, 22, of Mill Pond Road, Byron, is charged with aggravated DWI and DWI. McGall was arrested Monday following an investigation into an accident on Swamp Road in Bergen at 10:10 p.m., Oct. 31. Based on an investigation by the Monroe County Toxicology Laboratory, McGall was allegedly found to be driving with a BAC of .18 or greater.

Brittany Lynn Frey, 20, and Scott Alexander Lawrence, 19, both of Griswold Road, Darien, are charged with petit larceny. Frey and Lawrence are accused of shoplifting from Kmart on Tuesday.

A two-car head-on collision with minor injuries is reported at 7980 Byron Road, near School Road, in Stafford.

Stafford fire and Mercy EMS are responding.

UPDATE 11:58 a.m.: Responders are urged to use caution on approach because of slippery road conditions.

UPDATE 12:01 p.m.: Byron ambulance is asked to respond to provide mutual aid to Stafford. Traffic is blocked in the northbound lane at Byron and School roads and traffic control is needed.

UPDATE 12:10 p.m.: Stafford has cancelled the assistance from Byron, which was en route and is now returning to quarters. Traffic is being blocked off at Bryon Road and the Prole Road extension.

UPDATE 12:22 p.m.: A fire official on scene calls for a snowplow to help clear the roadway. It's on the way.

An 18-year-old Batavia man allegedly called a Byron-Bergen School and imitated a girl's father to get her released from school early.

There was reportedly a court order in place requiring the man not contact the girl.

Arrested by the Sheriff's Office was Michael Aaron Witkop of Ross Street.

He is charged with criminal contempt, 2nd, and criminal impersonation, 2nd.

Witkop was jailed on $250 bail.

Darrell Smith, 43, of Queens Drive, West Seneca, is charged with DWI, driving with a BAC of .08 or greater, aggravated unlicensed operation and improper stopping on a highway in the Town of Alexander. Smith was arrested following a report of a one-car accident at 3:32 a.m. on Oak Street in the City of Batavia. Smith allegedly fled the scene of the accident in his car. Smith also faces charges in the city for allegedly leaving the scene of a property damage accident, moving from lane unsafely and aggravated unlicensed operation.

A 17-year-old from Attica Road, Attica, is charged with criminal possession of stolen property, 5th. The youth was allegedly found in possession of a stolen a black Diamond Back BMX-style bicycle. The bicycle had been reported stolen from a person in the Village of Attica on July 3.

Peter J. Gravante Jr., 21, of Townline Road, Byron, is charged with DWI, driving with a BAC of .08 or greater, aggravated unlicensed operation, 3rd, no license plate lamp and operating without brake lights. Gravante was stopped at 4:08 a.m., Friday, on Route 5, Town of Batavia, by Deputy Kevin McCarthy.

Alexander Kae Zorich, 18, of Batavia-Stafford Townline Road, Batavia, is charged with petit larceny. Zorich is accused of shoplifting from Kmart.

A 16-year-old from Route 20, Alexander, is charged with criminal possession of stolen property. The youth was arrested following an investigation into car break-ins in the Village of Alexander during the night hours of Aug. 6-7. A younger defendant was also arrested, and considered the prime suspect. That case was handed over to family court.

Wesley Herrick Marean, 20, of Bronson Avenue, Avon, is charged with petit larceny. Marean is accused of shoplifting from Kmart.

Tiffany Monea Gaulden, 19, of Taft Avenue, Rochester, is charged with criminal trespass. Gaulden was allegedly found in a controlled access building at College Village. Gaulden was reportedly barred from the property. On Nov. 4, Gaulden was also arrested for alleged trespass and issued an appearance ticket. For the alleged trespass on Friday, Gaulden was jailed on $500 bail.

Gina Lee Schmidt, 21, of Elm Street, Le Roy, is charged with petit larceny. Schmidt is accused of using a fraudulent check at Walmart.

Peter S. Brigzna, 21, of Townline Road, Bergen, is charged with felony DWI and stopping on a highway. Brigzna was arrested following a report of a car stopped in the middle of the road on Bank Street Road, Batavia, at 6:52 p.m., Friday. Brigzna was allegedly found passed out in the car with the car running and the lights on. He was jailed on $1,500 bail.

Travis J. Schultz, 22, of 3620 Maltby Road, Oakfield, is charged with criminal mischief, 4th. Schultz is accused of recklessly damaging the entry door of Sport of Kings restaurant during a fight with another person.

Clinton A. Anderson, 25, of 8 Walden Creek Drive, Batavia, is charged with criminal contempt, 2nd. Anderson was allegedly involved in a domestic incident with a woman he was ordered to stay away from. He was jailed on $2,500 bail.

Brandon T.C. Johnson, 20, of Culver Road, Rochester, is charged with unlawful possession of marijuana and uninspected motor vehicle. Johnson was stopped at 5:14 p.m., Nov. 3, on Main Road, Corfu, by Deputy Patrick Reeves.

Latoya D. Jackson, 25, no permanent address, is charged with disorderly conduct and resisting arrest. Jackson was arrested after police responded to T.F. Brown's restaurant at 12:35 a.m., where she was reportedly causing a disturbance after being denied entry due to her apparent intoxication. Jackson allegedly yelled obscenities on Liberty Street and began to struggle with officer Darryl Streeter following her arrest. Jackson was jailed on $2,500 bail. Manuel Larry Valdez, 32, of Shane Drive, North Syracuse, is charged with criminal mischief, petit larceny, harassment and disorderly conduct. Valdez was arrested following an investigation by Deputy Jason Saile into an alleged incident at 9:55 p.m., Friday, on Veterans Memorial Drive. Valdez is accused of yelling profanity in a public parking lot, allegedly pulling the hair of another person, biting her arm and punching her in the face.  Valdez also allegedly damaged the victim's car keys so she couldn't start her car. Valdez also allegedly stole merchandise from a store. He was jailed on $10,000 cash bail.

Mark R. Mack, 48, of 5 Chapel St., Mt. Morris, is charged with DWI and driving with a BAC of .08 or greater. Mack was reportedly found at 3:34 a.m., Friday, in his car with the motor running by Sgt. Michael J. Hare of the Le Roy Police Department, in a parking lot on Main Street, Le Roy.

Andrew Russell Desmond, 27, of Seaford Terrace, Hamburg, is charged with unlawful possession of marijuana. Desmond was stopped at 8:20 p.m., Friday, for allegedly driving 100 mph on Route 5 in Pembroke by Deputy Patrick Reeves. Reeves reported he found Desmond allegedly in possession of marijuana.

Armekcl Devonte Austin, 19, of Terrace Park, Rochester, is charged with trespass. Austin allegedly trespassed on College Village property after being evicted and told to stay away.

Carla L. Spikes, 20, of Hutchins Place, Batavia, is charged with DWI, driving with a BAC of .08 or greater, aggravated unlicensed operation, unlicensed operation and speeding. Spikes was stopped at 3:13 a.m., Saturday, by Deputy Howard Carlson.

Patrick Anthony Martone, 48, of Benedict Drive, Rochester, is charged with unlawful possession of marijuana. Martone was stopped by Deputy Brian Thompson at 10:45 p.m., Oct. 24, for allegedly running a red light on West Main Street, Batavia. Thompson reportedly could smell the odor of marijuana coming from the car.

John Richard Schumacher, 19, of Colonial Woods Drive, Alden, is charged with trespass. Schumacher was reportedly on College Village property after being banned from the property several months ago.

Gregory P. Drake, 20, of Phillips Road, Holley, is charged with DWI, driving with a BAC. 08, driving left of pavement markings in a no-passing zone, consumption of alcohol in vehicle and failure to dim headlights. Drake was stopped at 12:32 a.m., Sunday, on Route 237, Byron, by Deputy Jason Saile.

Ronald A. Bialy II, 20, of 337 Bank St., Apt. 37, Batavia, is charged with DWI and aggravated unlicensed operation of a vehicle. Bialy was stopped at 2:33 a.m., Sunday, by Officer Eric Bolles.

Paul E. Bishop, 44, of Batavia, is charged with harassment, 2nd, and endangering the welfare of a child. Bishop is accused of striking the 13-year-old child of an acquaintance.

A 16-year-old resident of Killian Road, Pembroke, is charged with trespass. The youth is accused of being on private property after being advised not to.

Marie Nicole Wenzel, 19, of Melville Street, Rochester, is charged with unlawful possession of marijuana. Wenzel was stopped by at 2:46 p.m., Sunday, on Route 33 in Stafford, by Deputy Brian Thompson for allegedly tinted windows and illegal license plate cover. Wenzel was reportedly found in possession of a marijuana pipe with marijuana in it.

The Lancers' offense never quite got untracked and the defense was a bit too porous at Marina Auto Stadium in Rochester on Saturday as Elba/Byron-Bergen dropped a Section V semi-final playoff game to first seed Holley, 0-29.

Holley out gained Elba/BB 259 to 141 yards, including 169 on the ground compared to 80 rushing yards for the Lancers.

Elba/BB coach Michael Cintorino said Holley simply got the job done.

"There were probably a couple of missed opportunities, but Holley has a great team," said Cintorino. "They’re very disciplined and strong and they’re very well coached. Today they did their job. I’m not saying we didn’t do ours, but they just did a better job."

Even so, Cintorino said, he told his players they could be proud of their season.

They had a great season," he said. "There were a lot of people who doubted they could get this far. They had a great year. Obviously, it didn’t end the way we wanted it to, but they have nothing to be ashamed of."

Zack DuBois (pictured above) led the Elba/BB offense with 52 yards on 14 attempts, while Dylan Bordanaro was held to 22 yards on 11 carries.

QB Eric Kowalik was 7 for 18 with two interceptions, tossing the ball for a total of 68 yards.

The Lancers never advanced the ball into the red zone.

A small brushfire is reported at the softball field behind the Byron Fire Station. A crew is requested from the Byron Volunteer Fire Department to go to the station and deploy its brush truck to put out the blaze.

UPDATE (12:33 p.m.): The fire is out and the Byron Fire Department is ready for service.

Latifa Aminya Abdullah-Muhammad, 19, of Tibbets Road, Medina, and Merle Franklin Agee, 19, of Ontario Avenue, Niagara Falls, are charged with disorderly conduct. Abdullah-Muhammad and Agee were reportedly at 8204 Park Road, Batavia, at 7:54 p.m., Sunday, where they allegedly used abusive and obscene language while in a public place.

Porfirio Diaz Gomez, 35, of Merriman Road, Byron, has been charged with illegal entry. Gomez was taken into custody at 5:15 a.m., Sunday by Deputy Frank Bordonaro and turned over the the U.S. Border Patrol.

The Byron-Bergen education community is dealing with an unexpected loss after the Central School Board of Education Vice Presdient Lori Nelson passed away yesterday.

The school district announced the passing of Nelson, 49, today.

She served on the Byron-Bergen board since her election in 2000.

“Our community suffered a great loss yesterday with the sudden passing of Lori Nelson,” said Scott Martzloff, Ed.D, Byron-Bergen CSD superintendent of schools. “Lori served our board with distinction for 11 years, eight of which were in the role of vice president.”

The Byron-Bergen CSD community sends its deepest condolences and sympathy to Lori’s family and friends during this difficult time, including Robert, her husband, and their three children Mitchel, Bobbi Gayle and Regina, and all Byron-Bergen CSD graduates. “Lori was a passionate advocate for Byron-Bergen students and staff,” Martzloff said.  “She was well liked and respected by her board colleagues and will be sorely missed here as a leader.”

Nelson was a voting delegate on the New York State School Boards Association, a member of the Executive Board of Genesee Valley School Boards Association and active in the Boy Scouts.
