Law and Order: Bethany man accused of taking part in crime spree in Wyoming County

Bradley R. Jordan, 21, of East Bethany, and Amber L. Reinisch, 18, of Castile, are charged with burglary, 3rd, petit larceny and criminal possession of stolen property, 5th.

The investigation that led to the charges against Jordan and Reinisch began with a resident in the Village of Silver Springs reporting that she observed a male and female break glass in an overhead door and enter the garage attached to her apartment. State Police responded, but the suspects fled before they arrived on scene. Suspect and vehicle descriptions were provided to law enforcement officers in Wyoming County.

Police also received a complaint of a male and female fitting the description of the burglary suspects causing a disturbance at the McDonald's in Warsaw. The vehicle description for the two individuals also fit the burglary description. The vehicle was reportedly seen heading toward Save-A-Lot in Warsaw.

A short time later, a customer at Save-A-Lot reported seeing a male customer in possession of a handgun. The person had not threatened anybody with the weapon, but had removed it from his waistband as he walked through the store and then put it back in his waistband.

Village of Warsaw police officers, Wyoming County Sheriff's deputies and troopers all responded to the area. The suspect vehicle was located and Jordan and Reinisch were taken into custody.

Both suspects are accused of stealing merchandise from Walmart and Olympia Sports in North Warsaw, along with the burglary in Silver Springs. The alleged theft from Walmart was of a compact C02 pistol, which State Police say was the weapon later observed by a customer at Save-A-Lot. State Police alleged that when Jordan observed troopers at the front of the store, he ducked into a bathroom and discarded the weapons in a wastebasket. The weapon was later recovered and secured as evidence.

Jordan and Reinisch were arraigned and jailed on $5,000 bail each.

(name redacted upon request), 22, of Batavia, is charged with unlawful possession of marijuana. Clark's vehicle was stopped by State Police in the Town of Attica, Wyoming County, for an alleged equipment violation. He was allegedly found in possession of a small amount of marijuana.

Paul D. Barth Jr., 23, of Cohocton Road, Pembroke, is charged with criminal contempt, 2nd. Barth was allegedly sending text messages to a person he was ordered by a judge not to contact.

Desiree Michelle Hutchinson, 18, of Batavia, is charged with endangering the welfare of a child. Hutchinson allegedly admitted to Officer James DeFreze that she was hold her baby while in same room with a friend who was smoking marijuana.

Scott P. Rodon, 48, of Garfield Avenue, Batavia, is charged with harassment, 2nd. Rodon was allegedly involved in a domestic incident at 1 a.m. Thursday.

Oliver Thomas, 22, of Chestnut Street, Batavia, is charged with harassment, 2nd. Thomas allegedly hit a person in the face during an argument, which was reported at 3:45 a.m. Friday.

Taylor M. Andrews, 20, of McKenzie Road, Caledonia, is charged with menacing, 2nd. endangering the welfare of a child and conspiracy, 5th. Andrews is accused of encouraging a juvenile to use a crowbar against another person during an argument. The victim was not struck with the crowbar. The alleged incident was reported at 2 a.m. Friday at 21 Wood St., Batavia.

Robi Liam Terziani, 19, of Route 19A, Portageville, is charged with petit larceny. Terziani is accused of stealing hydrocodone pills from a residence in Byron where he was hired to do service work.

Billy Joe Budziszewski Jr., 22, of Route 77, Corfu, is charged with criminal possession of a weapon, 3rd, and bail jumping, 2nd. Budziszewski was arrested on warrants out of Village of Corfu Court. He is also allegedly the subject of warrants out of Erie County on burglary, 2nd, and petit larceny charges and out of Wyoming County for failure to pay fine. Budziszewski was jailed on $25,000 bail or $50,000 bond.

(name redacted), 19, of Route 5 & 20, Canandaigua, is charged with unlawful possession of marijuana. xxxx was allegedly found in possession of marijuana in a medicine container and a glass smoking pipe with marijuana in it. Cooley was the passenger in a vehicle stopped for an alleged traffic violation at 12:15 a.m. Sunday on Route 77, Pembroke, by Deputy Chris Parker. Also charged was (name redacted), 22, of Terri Drive, Farmington, who was also issued a traffic summons for no front plate and no insurance.

Christopher C. Berg, 27, of Pavilion, is charged with a misdemeanor under the vehicle and traffic law. Berg was stopped by State Police at 8:36 p.m. Wednesday on Veterans Memorial Drive. No further details released.

Adam J. Bobzin, 43, of Byron, is charged with DWI and driving with a BAC of .08 or greater. Bozin was stopped at 9:42 a.m. Thursday on West Sweden Road, Bergen, by State Police.

Accident with injuries reported at Bank and Cockram, Byron

A motor-vehicle accident is reported at Bank Street Road and Cockram Road, Byron.

Byron and South Byron and Mercy EMS dispatched.

Injuries are reported.

It involves a sedan and tractor-trailer.

A responder is asking dispatch to check on the availability of Mercy Flight.

UPDATE 8:36 a.m.: A chief on scene says the injuries are not serious. A female driver has cuts on her face.

UPDATE 8:47 a.m.: Equipment and manpower needed for extrication.

Byron-Bergen students back bill to make yogurt the official snack of NYS

Fourth-graders at Byron-Bergen Elementary School are on track to making a substantial economic impact on their state and their community. The class has created a well-researched rationale for designating yogurt as the Official New York State Snack, based on job creation and promoting healthy eating.

They sent handwritten letters – over 200 of them – to state legislators, farm owners, and yogurt companies. Their idea is now a bill sponsored by New York State Senators Mike Ranzenhofer, Kathleen Marchione, and James Seward and by Assemblymen William Magee and Steve Hawley. The bill is currently in committee.

The 17 members of the “Snack Pack,” led by fourth-grade teacher Craig Schroth, say yogurt deserves the title of Official New York State Snack. Student Madelyn Pimm says, “New York is now the biggest yogurt producing state in the U.S., with over 30 processing plants. Governor Cuomo refers to us as the ‘Yogurt Capital of the Country.’ We are the fifth largest milk producing state. We have three yogurt companies right here in our own community – Alpina, Müller-Quaker, and O-At-Ka. Many of us have family members who work there.”

“We want to support the yogurt industry and help create more jobs,” says student Alayna Streeter. “If this becomes law, there will be more opportunities for farmers who milk the cows, for drivers who deliver the milk, for people who make it into yogurt and other products, for distributors, and stores – jobs all down the supply chain.”

“Making yogurt the official snack will help New York promote healthy eating,” says student Caleb Calhoun. “Yogurt tastes great and is really good for you.”

These students are all highly knowledgeable and engaged in the legislative process they started. Letters of support from their representatives line the classroom wall. “Our whole class came up with the idea to promote yogurt,” says student Carly Bergeron. “We’re learning about government in action.” The class is hoping that they may be invited to Albany if their bill becomes law. “We want to get the word out and build backing for our bill. It’s important for everyone to support the yogurt industry because they are also supporting our communities with jobs,” says Alayna.

One yogurt company is already grateful for the assistance being drummed up by the Byron-Bergen students. Chobani plans to send a representative to the school to thank the students in person later this spring.

Attica and Byron-Bergen advance to finals in mock trial competition

Attica and Byron-Bergen won semifinal rounds of the mock trial competition held in Wyoming County Court, in Warsaw, on Monday night.

All four teams were 1-1.  Here's the point totals:

Attica - 120 points
Byron-Bergen – 119 points
Batavia – 113 points
Pembroke - 112 points

The finals are tomorrow, 5 p.m., in the Genesee County Courthouse.

Four teams advance to semi-finals of mock trial competition

The quarter finals of the GLOW-region mock trials were held Wednesday night in the Genesee County Courthouse.

The winners were:

  • Batavia, 2-0 with 121 points
  • Byron-Bergen, 2-0 with 108 points
  • Attica, 1-1 with 112 points
  • Pembroke, 1-1 with 104 points

The semi-finals are Monday in the Wyoming County Courthouse. The cases start at 5 p.m.

The case this year involves a lawsuit filed by a farmer over nearby hydrofracking.

Mobile food pantry at Byron Presbyterian Church - no income requirements

Byron Presbyterian Church will partner with FoodLink of Rochester to host a Mobile Food Pantry from 10 to noon this Saturday, March 22, at Byron Presbyterian Church, 6293 W. Main St. (Route 262), Byron.

The exact food items available are not known, but fresh produce will be available. No financial documentation is required to receive food items, but those receiving food will be asked to sign in. The food items must be for your household unless you have signed documentation from an individual to pick up items for them.

The Mobile Food Pantry is available to residents of the Byron Bergen School District, but we will distribute to anyone who resides in Genesee County. There is no income verification required, but you must be 18 years old to pick up food from the pantry. Please provide your own bags/cart/vehicle to transport items to your home.

Brush fire reported off Transit Road, Byron

A brush fire is reported in the area of 6063 Transit Road, Byron.

Byron and South Byron were dispatched more than 10 minutes ago and are on scene.

A brush truck from Elba was just requested to the scene.

UPDATE 9:43 p.m.: Elba requested to fill in at Byron's hall.

UPDATE 9:54 p.m.: Mercy EMS requested to the scene. Unknown reason.

UPDATE 10:27 p.m.: Elba's tanker is back in service.

CORRECTION: It was the brush truck from Elba, not a Mercy ambulance requested to the scene.

Byron student earns bachelor's degree from Clarkson University

Casey Engle, of Byron, received a bachelor of science degree in electrical engineering, mathematics minor, from Clarkson University on Dec. 31.

Adults with developmental disabilities enjoyed Valentine's Day dance, more dances planned

On Thursday, Feb. 13 at the Byron Fire Hall, 70 plus attendees came together to celebrate Valentine’s Day at Genesee County’s Adults with Developmental Disabilities Valentine’s Day Dance.

Attendees entered the heart-filled Byron Fire Hall on a beautifully mild February evening. Most folks were dressed in red, some even wore heart-adorned T-shirts. As usual, folks danced to their favorite songs and enjoyed the usual snacks. Uncle Joe snapped photos between filling in as the evening’s DJ.

A highlight of the evening was when our young Byron volunteer firefighters paraded to the dance floor leading the group in Michael Jackson’s “Thriller.” Later on the young men came back to the dance floor in their firefighter’s gear to lead the group in the YMCA dance. February birthdays were recognized prior to our customary circle dances; the chicken dance and the hokie pokie.

The next dance is the St. Patrick’s Dance on Thursday, March 13. The dates for the dances through May are as follows: the April dance is a Pajama Dance on Thursday, April 17; and the last dance of the season is on Thursday, May 15, it will be the Hawaiian Dance.

All dances are 6:30 to 8:30 p.m. at the Byron Fire Hall on Route 262 near the Route 237 intersection. The dances are sponsored by Byron Ladies Auxiliary, and are open to all folks with developmental disabilities ages 13 and up living in Genesee County, family and caregivers are also welcome. Adequate supervision is required. Anyone wanting to volunteer or need more information may call Pat Iamon at 245-2918 or Laura Platt at 548-2245.

Law and Order: Man accused of trying to bring marijuana into City Court

Joshua Lee Baltz, 37, of Tracy Avenue, Batavia, is charged with unlawful possession of marijuana. Baltz allegedly was found to be carrying marijuana while entering the City Court facility.

John Robert Gerhardt, 64, of Centerline Road, Varysburg, is charged with DWI, driving with a BAC of .08 or greater and moving from lane unsafely. Gerhardt was stopped at 6:32 p.m. Friday on River Street, Batavia, by Deputy James Diehl.

Lisa M. Durham, 42, of Thorpe Street, Batavia, is charged with misapplication of property and falsifying business records, 1st. Durham allegedly rented merchandise from Rent-A-Center and pawned it at Pawn King.

Steven Michael Meyers, 34, of East Bethany - Le Roy Road, Bethany, is charged with menacing, 2nd. Meyers allegedly displayed a firearm during a dispute with another person.

Jenae M. Macleod, 29, of Genesee Street, Corfu, was arrested on a bench warrant out of City Court. Macleod was located by deputies from the Erie County Sheriff's Office during an investigation of an incident and discovered to have an active warrant. She was turned over to the Genesee County Sheriff's Office, arraigned, and jailed on $500 bail.

Tracy A. Hilton Sr., 33, of Jackson Street, Batavia, is charged with harassment, 2nd. Hilton was allegedly involved in a domestic incident at 12:07 a.m. Saturday.

Tyler D. Macey, 18, of Grandview Terrace, Batavia, is charged with strangulation, 2nd, acting in a manor likely to be injurious to a child and assault, 3rd. Macey is accused of being involved in a domestic incident.

Joshua A. Laraby, 23, of Byron, is charged with unlawful possession of marijuana and a traffic violation. Laraby was stopped at 5:56 p.m. Friday by State Police.

Daniel J. Laudico, 20, of Elba, is charged with DWI, driving with a BAC of .08 or greater, failure to keep right and speeding. Laudico was stopped at 1:02 a.m. Sunday on North Byron Road, Elba, by State Police.

Leaking fuel tank is reported on Bank Street Road, Elba

A leaking propane tank at 7556 Bank Street Road has prompted the response of Elba fire, which is in command, along with mutual aid from Corfu and Byron. The location is just north of Batavia Elba Town Line Road.

The homeowners have contacted the fuel company and a rep is responding to the scene.

UPDATE 6:32 p.m.: Elba has requested a tanker from Barre to stand by in Elba's fire hall.

UPDATE 7:01 p.m.: The fuel company rep is on scene. Barre is now in Elba's fire hall.

UPDATE 7:18 p.m.: Byron is leaving the scene, returning to service.

UPDATE 7:20 p.m.: The roadway, which had been closed by Fire Police, is being reopened. The assignment is back in service or will be shortly. Barre is released from standby.

Defendant asks for maximum sentence and Noonan gives it to him

In County Court today, Dustin Locicero got exactly what he asked for: the maximum sentence Judge Robert C. Noonan could possibly hand down.

That is three-and-a-half to seven years on Locicero's plea bargain in which Locicero admitted to forgery 2nd.

The 29-year-old Bergen resident was arrested in January and accused of stealing jewelry, collectable coins and personal checks from a home in South Byron and of stealing personal checks from homes in Bergen and Rochester.

Locicero allegedly cashed the checks at banks in Batavia, Elba and Le Roy. The coins and jewelry were valued at $7,000 and Locicero allegedly sold these items at different unknown locations.

He was charged with seven counts of criminal possession of a forged instrument, 2nd, grand larceny, 3rd, and criminal contempt, 2nd.

At the time of his arrest he had pending charges for identity theft.

The plea satisfied all of Locicero's charges.

District Attorney Lawrenece Friedman said he asked for the maximum sentence under the plea agreement, and public defender Jerry Ader asked for the minimum sentence, two to four years.

When Locicero was given a chance to address the court, Friedman said, the defendant told Noonan he might as well give him the maximum sentence because he will die in prison anyway.

A two-car accident with injuries that is blocking traffic is reported at the intersection of North Byron and Searls roads. Byron and South Byron fire departments are responding along with Mercy medics.

Grand Jury indicts man for attempted rape and unlawful imprisonment

These are the latest indictments issued by the Genesee County Grand Jury.

John J. Saddler is indicted on four counts. The first is for the crime of attempted rape in the first degree, a Class B felony, for allegedly attempting to engage in sexual intercourse with another person by forcible compulsion. This allegedly occurred Aug. 31 in the Town of Batavia. In count two, he is accused of touching the victim's genitals by forcible compulsion, a Class D felony. In count three, he is accused of forcing the victim to touch him on the genitals by forcible compulsion, also a Class D felony. In count four, Saddler is accused of unlawful imprisonment in the second degree, a Class A misdemeanor, for allegedly restraining the victim in a motel room.

Dortha L. Penders is indicted for aggrevated driving while intoxicated, a Class E felony, for allegedly driving a 2008 Dodge while intoxicated on Sept. 22 on Route 5 in the Town of Batavia while a child age 15 or less was a passenger. In count two, she is accused of committing the same crime with a BAC of .08 or more, also a Class E felony, and while a child age 15 or less was a passenger.

Donald W. Sczepanski is indicted for driving while intoxicated, a Class E felony, for allegedly operating a 2004 Pontiac while intoxicated on Route 238 on Aug. 2 in the Town of Alexander. In count two, he is accused of committing the same crime with a BAC of .08 or more, also a Class E felony.

Thomas P. Lester is indicted for driving while intoxicated, a Class E felony, for allegedly driving a 1998 Dodge while intoxicated on Sept. 12 on Townline Road in the Town of Byron. In count two, he is accused of committing the same crime with a BAC of .08 or more, also a Class E felony.

Robert C. Hinett is indicted for driving while intoxicated, a Class E felony, for allegedly driving a 2003 Subaru while intoxicated on Aug. 23 on Lake Street in the Town of Le Roy.

The Grand Jury issued No Bill for Kiernan W. Kinney after considering evidence relating to possible charges of sexual abuse in the first degree for incidents which allegedly occurred on April 10 in the Town of Pavilion.

Furnace explosion on Searls Road, Byron

A furnace explosion, with smoke showing, is reported at 6394 Searls Road in Byron. Byron Fire Department is responding. Other units from other departments were called, but command on scene said they could stand down.

Locicero allegedly cashed the checks at banks in Batavia, Elba and Le Roy. The coins and jewelry were valued at $7,000 and Locicero allegedly sold these items at different unknown locations. Locicero has a pending second-degree forgery charge in the City of Batavia. In 2011, Locicero was charged with identity theft (we don't have information on the disposition of that case). Locicero was taken into custody Tuesday. He was reportedly found hiding in a mobile home in the Town of Batavia and was arrested on a City of Batavia bench warrant. Locicero was arraigned in city court and jailed without bail. The investigation was conducted by Deputy Brian Thompson, Deputy John Duyssen and Investigator Timothy Weis.

Theodore R. Johnson Jr., 46, of Maple Street, Batavia, is charged with DWI, driving with a BAC of .08 or greater, speed not reasonable or prudent and leaving the scene of a property damage accident. Johnson's vehicle allegedly struck a building at 102 Evans St., Batavia, 4:48 p.m., Sunday. Johnson's vehicle was located stuck in a snow bank with a portion still in the roadway.

Dylan C. McKenzie, 19, of Batavia Stafford Townline Road, Batavia, is charged with unlawful possession of marijuana, failure to use headlights and operation by an unlicensed driver. McKenzie was stopped at 2:01 a.m. Wednesday on East Main Street, Batavia, by Officer Thad Mart.

Clenton J. Reese, 50, of Ellsworth Avenue, Batavia, is charged with criminal contempt, 2nd, and harassment, 2nd, Reese was allegedly involved in a disturbance and upon investigation was allegedly found in the presence of a protected person.

Catherine A. Lewis, 50, of Cone Street, Batavia, is charged with harassment ,2nd. Lewis is accused of pushing and threatening another person.

Robert K. Geandreau, 41, of Elm Street, Batavia, is charged with DWI, driving with a BAC of .08 or greater, open container and inadequate tail lamp. Geandreau was stopped at 11:42 p.m. Friday on East Main Street, Batavia, by Officer Stephen Cronmiller.

Tara is missing in the Byron-Bergen area

Kelly Crocker's dog Tara is missing. Tara was last seen about 4:30 p.m.  Kelly and Tara live on Batavia Byron Road.

Tara may have ran across the Thruway and was heading east.

Tara did not have her collar on when she went missing.

"We tried getting her to come with us but she wouldn't stop running, and it's very very cold out," Kelly said.

Law and Order: Le Roy man accused of stealing co-pays at doctor's office

James Mitchell, 35, of Le Roy, is charged with petit larceny. Mitchell was arrested following a months-long investigation by the Livingston County Sheriff's Office into reports of stolen co-payments at a doctor's office where Mitchell worked in Avon. The investigation took time, according to LCSO, because of lengthy billing cycles and victims coming forward. Mitchell was allegedly stealing co-pays as patients checked out at their physician's office. The investigation was conducted by Deputy Dan Rittenhouse, Deputy Ross Gerace, Deputy Steph Schroeder and Deputy Mike Yencer.

Kelly M. Zwolinski, 34, of Broadway Road, Darien, is charged with criminal possession of stolen property, 4th, and resisting arrest. Zwolinski was identified as a suspect in possession of a stolen horse saddle that was taken from a farm in Niagara County and an arrest warrant was issued. When Deputy Kevin McCarthy and Investigator William Ferrando attempted to place Zwolinski under arrest, she allegedly resisted arrest.

Darlene Ann Kingdollar, 51, of South Pearl Street, Oakfield, is charged with petit larceny. Kingdollar is accused of entering the 7-Eleven store in Oakfield while intoxicated and after she was denied the purchase of alcohol, she allegedly left the store with a can of beer without paying for it.

Bruce J. Brade, 33, of Galloway Road, Batavia, is charged with stalking, 4th, and criminal contempt, 2nd. Brade allegedly violated an order of protection.

Mark J. Price, 37, Township Road, Ashland, Ohio, was arrested on a warrant for alleged failure to appear for an alleged traffic violation in Batavia City Court. Price was aprehended during a traffic stop in the Village of Attica. Price was issued an appearance ticket.

Jeffrey A. Pionessa, 32, of Glenwood Drive, Attica, is charged with DWI, driving with a BAC of .08 or greater and speeding in zone. Pionessa was stopped at 2:30 a.m. Sunday on Law Street, Batavia, by Officer Arick Perkins. Pionessa allegedly had a BAC of .11.

A 17-year-old resident of Trumbull Parkway, Batavia is charged with criminal mischief, 4th, and harassment, 2nd. The youth is accused of damaging the mobile phone charger of another person by throwing it against a wall and grabbing the arm of the alleged victim and pushing the person's face.

John K. Rolls, 34, of Mill Street, Batavia, is charged with two counts of forcible touching. Rolls is accused of forcibly touching a 17-year-old girl on Jan. 7. Rolls is incarcerated in the Genesee county Jail on an unrelated matter and was issued an appearance ticket.

Brad Strzelecki, 19, of Hunter Street, Bergen, is charged with unlawful possession of marijuana. Strzelecki was reported at a location on Bank Street at 10:01 a.m. Jan. 13 when he was allegedly found in possession of marijuana by Officer Eric Foels.

Rodeny Lowell McKenzie, 49, of Weaver Street, Buffalo, is charged with petit larceny. McKenzie was located by Transit Police in Buffalo during a check-the-welfare interview and identified as a warrant suspect for allegedly stealing items from Kmart on Dec. 12.

Bryant William Hardtner, 28, of State Street Road, Batavia, is charged with unauthorized use of a motor vehicle. Hardtner is accused of taking a vehicle Sunday without the owner's consent.

Kimberly Diane Ribbeck, 27, of Genesee Street, Corfu, is charged with DWI, driving with a BAC of .08 or greater, driving a vehicle with obstructed vision and no or inadequate plate light. Ribbeck was stopped at 2:33 a.m. Sunday on Route 77, Pembroke, by Deputy Joseph Corona.

Michael Gerald Pernicano, 21, of Lake Road, Holley, is charged with DWI, driving with a BAC of .08 or greater, failure to signal and no plate light. Pernicano was stopped at 2:29 a.m. Saturday on North Byron Road, Byron, by Deputy Joseph Corona.

Lena Marie Evans, 26, of Ross Street, Batavia, is charged with petit larceny, two counts of criminal possession of a controlled substance and possession of a hypodermic instrument. Evans was arrested for allegedly shoplifting at Kmart by Deputy Andrew Hale.

Carey Anthony Bedell III, 18, of Lehigh Avenue, Rochester, is charged with unlawful possession of marijuana. Bedell was arrested on Clinton Street Road, Byron, at 9:43 p.m. Friday.

Matthew R. Smith, 21, of Basom, is charged with forcible touching. Smith was arrested by State Police for an alleged incident reported at noon Thursday.

Mark A. Allison, 52, of Lockport, is charged with felony DWI and felony driving with a BAC of .08 or greater. Allison was arrested by State Police following the report at 9:29 p.m. Thursday of a two-car accident at 372 Bloomingdale Road, Basom. One person was injured. The driver of the other vehicle was Alexander Shirira, 56, of Buffalo. No other details released.
