Three meetings set in June for review of draft revisions to county's Smart Growth Plan

As part of its 2019 triennial review, the Genesee County Department of Planning will hold a series of public meetings to present and gather comments on the draft revisions to the Smart Growth Plan. There will be three meetings as follows:

  • Monday, June 17 at 6:30 p.m. at Pembroke Community Center, 116 E. Main St., Corfu
  • Tuesday, June 18, at 6:30 p.m. at Pavilion Town Hall, 1 Woodrow Drive, Pavilion
  • Wednesday, June 19, at 6:30 p.m. at Genesee County Building 2 – Large Conference Room, 3837 W. Main Street Road, Batavia

On May 9, 2001 the Genesee County Legislature adopted the Smart Growth Plan. The Plan is a mitigating action of potential significant environmental impacts of the Genesee County Water Supply Project upon the viability of agriculture in Genesee County.

Smart Growth Development Areas throughout the county were designated based on their access to transportation, minimal conflict with County Agricultural Districts and State-regulated wetlands, feasibility of extending public water service, and the potential for extending public infrastructure to support development.

The Plan requires that it be reviewed every three years by the Legislature and that recommendations for its revision be made at that time.

During this review, the Town of Pavilion proposed changes to the Development Area Boundaries. Two substantive text changes are also being proposed as part of this review. The meeting will focus on the modifications being recommended to the County Legislature by the Planning Department.

Call to order 6:34 p.m.

Welcome guests: Duane Wittmer -- candidate for U.S. Congress 27th District and Alyce Auman.

Minutes of last meeting -- motion to accept Jim and 2nd by Dave with change.

Treasurer’s report was presented  Dave motioned to reimburse the Rosenbecks for the envelopes and printing of the outgoing letters, Jim R. 2nd--  approved. Postage was from the GCLP account.

GCLP Chair -- Meetup app is $59.94 for six months (3/30 to 9/30). Is this useful? Did anyone come to a meeting because of it? We will remove from auto renewal. Press release for candidates and letter to membership going out. Both Durin Rogers and Ben Bonarigo contacted us for endorsement for City Court Judge.  

LPNY Chair --  Convention May 4th in Rochester. Retaining an attorney, Harry Creski -- corporate and election law. Will look into the consolidation of the two entities, LPNY Corp and Interim State Committee. Thirty-six counties are moving to IOC. Fundraising will take place to set up financial accounts.

Enrollment -- Brenda Ranney’s “Turn Genesee Gold”  is on Facebook. The BOE new voter forms are on hold due to printer issues -- hopefully in April they will be available. Looking for help in finding venues for voter registration events.

Old Business

Convention date is a question. Motion to hold convention on June 4, 2019 at T.F. Brown’s at 6:30 p.m.; 2nd by Lisa -- approved. Would like to have a speaker and welcome any candidates.

Jim motioned to create a Rules Committee; 2nd by Dave -- approved. Rich was nominated to be chair by Jim; 2nd by Mark P. with members Jim, Mark P. using Mark Glogowski’s template.

New Business

Genesee County Fair July 13 - 20 -- motion to pay $50 fee for table to distribute material, provided the state LPNY covers the insurance costs required by the Fair by Deb; 2nd by Dave -- approved.

Business cards -- Joe is interested in producing them using our rack card as a template.

Comments

Duane is running for the 27th Congressional District against Chris Collins. He is hoping to raise $500,000 to finance this campaign, he feels now is time for change. He will be at the VFW on Lakeshore April 14, 2019.

Talk at Richmond library: 'Space Frontier at 50: From Apollo to 21st Century Private Space Travel'

A talk on the “Space Frontier at 50: From Apollo to 21st Century Private Space Travel" will be presented at Richmond Memorial Library on Thursday, June 6.

It begins at 7 p.m. and will take place in the Reading Room.

James Spiller, Ph.D., of the College at Brockport will sweep through 50+ years of human space travel coinciding with the 50th anniversary of the Apollo 11 moon landings in July.

Chamber event: speed networking May 15 at Arc Community Center

There will be a speed networking (or speed business meeting) sponsored by the Genesee County Chamber of Commerce on Wednesday morning, May 15, at the Arc of Genesee Orleans Community Center in Batavia. Time is 8 to 9:30 a.m.

It's a meeting format designed to accelerate business contacts. It involves participants gathering together to exchange information. Participants greet each other in a series of brief exchanges during a set period of time.

Fill your tank and come ready to network! Coffee and tea and other light snacks will be provided.

Arc of Genesee Orleans Community Center is located at 38 Woodrow Drive.

Tiffani Bragg of Pavilion named a Legacy Leader at RIT

Tiffani Bragg, of Pavilion, has been named a Legacy Leader at Rochester Institute of Technology. The Legacy Leadership program celebrates the leadership and contributions that graduating female-identified students have made to the RIT community during their time on campus.

Rochester Institute of Technology is home to leading creators, entrepreneurs, innovators and researchers. Founded in 1829, RIT enrolls about 19,000 students in more than 200 career-oriented and professional programs, making it among the largest private universities in the United States.

The university is internationally recognized and ranked for academic leadership in business, computing, engineering, imaging science, liberal arts, sustainability, and fine and applied arts. RIT also offers unparalleled support services for deaf and hard-of-hearing students.

The cooperative education program is one of the oldest and largest in the nation. Global partnerships include campuses in China, Croatia, Dubai and Kosovo.

 

Law and Order: Elba man accused of vehicular assault, driving recklessly while impaired by drugs in car-into-house crash

Rodney Lee Harmon Jr., 42, of Church Street, Elba, is charged with: vehicular assault in the second degree; driving left of pavement markings; moving from lane unsafely; reckless driving, and driving while ability impaired by drugs. At 3:16 p.m. on April 15, after the investigation of a motor-vehicle crash in which the car struck a house on Oak Orchard Road in Batavia, Harmon was arrested. Harmon and his passenger were allegedly involved in a domestic incident while Harmon was driving a Chevy Cruze southbound on Route 98. The vehicle crossed over the hazard warnings into the northbound lane of travel and exited the highway, crashing into the north side of a house. Harmon was transported to Strong Memorial Hospital and evaluated. He was issued an appearance ticket and is due in Town of Batavia Court on May 27. The case was handled by Genesee County Sheriff's Deputy Jeremy McClellan, assisted by Deputy James Stack.

     Wesley Thigpen

Wesley Thigpen, 38, of Vine Street, Batavia, is charged with first-degree sexual abuse. He was arrested on May 1 after an investigation into an incident that occurred in December on Vine Street in Batavia. He turned himself in upon request, was arraigned in Batavia City Court, then released under supervision of Genesee Justice. He is due in court again at 9 a.m. on Thursday, May 23. The case was investigated by Batavia Police Det. Thad Mart.

Christopher T. Sprague, 25, of West Main Street, Batavia, is charged with two counts of third-degree burglary. He was arrested on May 3 for allegedly attempting to burglarize the Salvation Army Thrift Store at 98 Jackson St. in the City of Batavia on Dec. 23. Also on May 3, he was charged with the same crime for allegedly burglarizing Bill's Auto at 101 Evans St. in Batavia. After his arraignment, he was released on his own recognizance but he is in GC jail on other charges. He is due in Batavia City Court on the burglary charges June 6. The case was handled by Batavia Police Officer Matthew Wojtaszczyk, assisted by Det. Eric Hill.

Christopher Sprague

Jonathan Wayne Arce, 35, of Wyoming Street, Wyoming, is charged with: driving while intoxicated; DWI -- operating a motor vehicle while having a BAC of .08 percent or higher; moving from lane unsafely. At 7:11 p.m. on May 3 on Francis Road, Bethany, Arce was arrested on these charges. He was issued an appearance ticket and is due in Bethany Town Court on May 21. The case was handled by Genesee County Sheriff's Deputy Mathew Clor, assisted by Sgt. John Baiocco.

Donald G. Cooper, 35, and Christine A. M. Wark, of School Street, Le Roy, were arrested by Le Roy police on May 3 and each was charged with four counts of endangering the welfare of a child, a Class A misdemeanor. Cooper was also charged with unlawful possession of marijuana, a violation. At about 10:30 p.m. on May 3, Le Roy Police Department received a complaint of two young children sitting on the side of the road on Route 19. When patrols arrived, they located two children, ages 8 and 10. Police were able to identify and locate the parents of the children. It was "discovered that the children were allegedly sent out of the residence to burn off some energy while retrieving a discarded item located on the side of the road approximately a half mile from their residence. During the investigation, an unsecured firearm and bullets for the firearm were located in the residence...in a location that was accessible to both children." Paraphernalia for smoking marijuana was also found in the residence, in a location accessible to both children. As a result of the significant disregard for both children's well-being..." both Cooper and Wark were arrested, without incident. After arraignment in Town of Le Roy Court, the defendants were released under supervision of Genesee Justice. They are due back in Town of Le Roy Court on June 4 to answer the charges.

Steven D. Smires, 23, no permanent address, was arrested on May 2 by the Le Roy Police Department and charged with one count of endangering the welfare of a child, a Class A misdemeanor, and one count of unlawful possession of marijuana, a violation. In the same incident, Leah M. Burrus-Stewart, also no permanent address, was arrested and charged with one count of endangering the welfare of a child. At about 11:30 a.m. on May 2, Le Roy PD received a complaint of a subject smoking marijuana in a vehicle with two small children inside. Upon arrival, patrols found Smires and Burrus-Stewart inside along with a 3-year-old child belonging to Burrus-Stewart and a 9-month-old baby that belonged to the couple. Police also allegedly located marijuana and paraphernalia for smoking it inside the vehicle. It was also discovered that the family did not have housing and had been living in the vehicle. Both adults were arrested without incident and Child Protective Services was contacted to assist with the children's care. The couple was arraigned in Le Roy Town Court and jailed in lieu of $750 bail each. They are due back in Le Roy Town Court on June 4 to answer the charges.

Jennifer L. Shaw, 33, of Bank Street, Batavia, is charged with endangering the welfare of a child. Shaw was arrested at 3:10 p.m. on April 22 on West Main Street in Batavia after an investigation of an incident in which she allegedly left two children unattended in a running vehicle in a parking lot. She was issued an appearance ticket and is due in Batavia City Court on Tuesday, May 7. The case was handled by Batavia Police Officer Felicia DeGroot.

William G. Schultz, 45, of Maple Street, Batavia, is charged with criminal possession of a controlled substance and second-degree criminal use of drug paraphernalia. At 11:15 a.m. Schultz was arrested on Evans Street in Batavia on an unrelated charge. While being searched, he was allegedly found in possession of a controlled substance and drug paraphernalia. He was arraigned in Batavia City Court then jailed in lieu of $2,500 cash bail or bond. The case was handled by Batavia Police Officer Miah Stevens, assisted by Officer Marc Lawrence.

Stanley F. Wenzel, 30, of Hutchins Place, Batavia, is charged with dog running at large. He was arrested on April 26 and is due in city court for arraignment on Tuesday, May 7. It is alleged that on April 7 at 4:28 p.m. a dog that Wenzel was in possession of got loose and attacked another dog on Hutchins Place. Wenzel was issued an appearance ticket. The case was handled by Batavia Police Officer Christopher Lindsay.

Tiesha Deon Doward, 32, of Prune Street, Batavia, was arrested on May 4 on a warrant out of Batavia City Court after police responded to an incident on Prune Street. They executed a bench warrant that was issued after she failed to appear in court April 24 on a petit larceny case from 2018. Doward was given an appearance ticket and is due in city court on Tuesday, May 7. The case was handled by Batavia Police officers Marc Lawrence and Peter Flanagan.

A 16-year-old who lives in Batavia is charged with unlawful possession of marijuana, a violation. The youth was stopped at 12:22 a.m. on April 20 on West Main Street in Batavia for vehicle and traffic violations. During the traffic stop, the youth was allegedly found in possession of marijuana. The youth was arrested and released to a parent and is due in Batavia City Court on Tuesday, May 7. The case was handled by Batavia Police Officer Marc Lawrence, assisted by Officer Peter Flanagan.

Paul W. Zeches, 30, of Oak Street, Batavia, was arrested on April 30 when he responded to Batavia Police Department for an unrelated matter. He had an active arrest warrant out of Batavia City Court for an unspecified incident that occurred on Feb. 28, 2017. He was arraigned, he pled guilty and was released. The case was handled by Batavia Police Officer Miah Stevens, assisted by Officer Marc Lawrence.

Anthony R. Piazza, 28, of Pratt Road, Pembroke, was arrested at 2:15 p.m. on April 30 on a bench warrant out of Batavia City Court. The warrant was issued after he failed to appear in court on a misdemeanor traffic ticket. He was released on his own recognizance and is due in city court May 30. The case was handled by Batavia Police Officer Christopher Lindsay.

WROTB/Batavia Downs Gaming sees highest Derby handle ever

Representatives from Western Regional Off-Track Betting (WROTB) reported today (May 6) that a record $2,039,088.30 was wagered on the Kentucky Derby through their outlets including BataviaBets.com, OTB Branches and EZ Bet Locations.

In particular the Empire branch in Rochester, saw significant growth, up 27 percent from the previous year. And wagering was also very strong at Batavia Downs Gaming and Hotel, up 7 percent there.

Batavia Downs hosted three separate parties with a full house of happy, gambling revelers enjoying the Run for the Roses. The Park Place Party served an all-time high 751 dinners; well eclipsing the 605 meals sold last year. Thurman Thomas’ Sports Bar “34 Rush” had their highest single day total for sales.

Down on the gaming floor, $4 million credits were played which was the second highest in their history. The week ending Saturday saw the highest credits played total of all time, with $18.3 million in Credits Played, beating the previous best seven-day period of $17.4 million.

The results of the 145th Kentucky Derby may have been controversial with the subsequent disqualification of Maximum Security, who was first under the wire, but according to Henry Wojtaszek, president and CEO of WROTB, Derby Day 2019 was unbelievable all the way around.

“The wagering, party and gaming numbers are a continuation and reflection of the solid year Batavia Downs has been experiencing,” Wojtaszek said. “We could not have pulled this off if it wasn’t for our dedicated OTB branch and Batavia Downs staff, who worked tirelessly on Derby Day. We appreciate the solid support from our loyal customer base.”

WROTB is already gearing up for the second jewel of thoroughbred racing's Triple Crown to be held on May 18 at Pimlico racetrack.

Among the events scheduled for Preakness is the $15 Trifecta special that will take place in the Park Place Event Center at Batavia Downs from 4 to 7 p.m.

Live harness racing return to Batavia Downs on Wednesday (July 24) for the meet that will run through Saturday (Dec. 14).

Accident with injuries and entrapment reported on West Sweden Road, Bergen

A one-vehicle accident with injuries and entrapment is reported in Bergen on West Sweden Road at Evans Road. Bergen Fire Department is responding, along with Mercy medics.

UPDATE 3:36 p.m.: The patient was extricated and is being transported to Strong Memorial Hospital.

GCEDC approves PILOT reassignment for Upstate Niagara, OKs GAIN loan for NY Craft Malt

The Genesee County Economic Development Center (GCEDC) voted Thursday to approve reassigning the terms of previously approved PILOT (Payment In Lieu Of Taxes) agreements for Upstate Niagara Cooperative.

The company recently announced the purchase of the former Alpina Foods manufacturing facility in the Genesee Valley Agri-Business Park.

Under the PILOT agreements, local taxing jurisdictions will receive $378,010 in revenues over the life of the PILOT. Upstate Niagara Cooperative plans to invest $22 million in the facility to meet the company’s operational needs.

“Genesee County has benefited greatly from the repeated investments by food and beverage companies into dairy production facilities,” said GCEDC Board Chairman Paul Battaglia. “The Genesee Valley Agri-Business Park provides excellent opportunities for the Upstate Niagara Cooperative and businesses in the dairy and food industries to succeed.”

The GCEDC Board also approved a loan from the Growing the Agricultural Industry Now! (GAIN) fund for New York Craft Malt. The $82,000 GAIN loan is part of a $206,968 investment for the purchase of new equipment and building improvements at the company’s facility at 8164 Bank Street Road in the Town of Batavia. The project will create two new jobs.

“NY Craft Malt’s project builds on our successful GAIN Loan Fund program, which supports the growth of agricultural products and businesses in Genesee County,” said GCEDC President and CEO Steve Hyde. “Low-interest GAIN loans have enabled producers to invest over $1 million into dairy, maple and malting operations.”

The NY Craft Malt is the fifth project in Genesee County to receive a GAIN loan. Previous recipients include Cottonwood Farms in Pavilion, Sandvoss Farms in East Bethany, and Junior’s Maple in Batavia.

Hawley condemns driver's licenses for undocumented immigrants

As details emerge about the effort peddled by New York City politicians to allow undocumented immigrants to obtain driver’s licenses, Assemblyman Steve Hawley (R,C,I-Batavia) blasted the proposal.

This measure comes on the heels of the Majority passing tuition assistance for illegal immigrants while initially opposing Hawley’s bill to do the same for Gold Star families.

“Instead of incentivizing legal immigration, Albany is once again creating a magnet for outright lawlessness,” Hawley said. “First they offered undocumented immigrants the right to free college tuition, now they offer the privilege of driving.

"This latest proposal jeopardizes the safety of our communities throughout the state. NYC lawmakers continue to place the interests of illegal immigrants ahead of law-abiding, middle-class New Yorkers. 

“We are a nation of laws, and these proposals only lead to more giveaways and services for illegal immigrants in our state. In addition, handing out these privileges blurs the lines between law-abiding citizens and those here illegally.

"Rest assured, I will continue to remain steadfast in my commitment to public safety and the rule of law especially in light of the avalanche of proposals endangering New York families in favor of realizing a political agenda."

Ranzenhofer asks residents to share their views on legislative issues

As the final two months of the 2019 Legislative Session begin, Senator Michael H. Ranzenhofer is asking for constituents’ opinions on issues affecting New York State and the Western New York community.

“From paper bag fees to driver licenses for undocumented immigrants and legalizing marijuana, your opinions on issues affecting New York State and the Western New York community are very important to me," Ranzenhofer said. "With the new majority in the Senate, there have been many new topics arising this year. With your help, I will continue to represent the views of my constituents."

Residents can complete the 2019 Legislative Questionnaire survey here that's on Senator Ranzenhofer’s website. The 13-question questionnaire covers a wide variety of legislative issues that have been in the forefront this Legislative Session.

Law and Order: Alexander Town Clerk charged with two NYS Election Law violations

Lisa Lynn Lyons, 42, of Alexander Road, Attica, is charged with two counts of misconduct in relation to petitions, a violation of NYS Election Law (ELN 17-122, #6). It is alleged that the defendant subscribed as a witness to a petition on April 1 for the designation of herself as the Republican candidate for the upcoming Town Clerk of Alexander position. It is alleged that she did not witness all signatures of the filed petition, thereby making a false statement or false affidavit. Lyons, who is the incumbent Town of Alexander Clerk and Tax Collector (her term expires Dec. 31), was issued an appearance ticket for the charges and is due in Batavia City Court at 1:30 p.m. on Tuesday, May 21. The case was investigated by Genesee County Sheriff's Sgt. James Diehl.

Devin A. Hill, 18, of Rochester, is the alleged driver a pickup truck that was seen leaving the Batavia Cycle Center, located at 4988 E. Main Street Road in the Town of Batavia, hauling a trailer at 2:15 a.m. this morning (May 2). His passenger was Angel I. Carrasquillo, 43, of Rochester, who was later located walking in the area of Route 33 and Warner Road. The men were arrested after the Genesee County Sheriff's deputies were called to a suspicious condition at the cycle center. The pickup truck and trailer were stopped a short time later on Route 33 in the area of Coward Road after a call by deputies. Two go-karts and one three-wheeler were on the trailer being towed and they were determined to be stolen from Batavia Cycle Center. Both men are charged with third-degree grand larceny, third-degree burglary, and fourth degree criminal mischief. Following their arraignments in Town of Batavia Court, Hill was jailed in lieu of $10,000 bail and Carrasquillo was jailed without bail. The case is being investigated by GC Sheriff's Deputy Mullen, Deputy Andre, Sgt. Baiocco, Sgt. Sanfratello, Investigator Parker and Investigator Minuto. Also assisting were members of the Batavia PD, NYSP, and Environmental Conservation Officer Fay Fuerch.

Jacob John Sponaugle, 20, of Liberty Street, Batavia, is charged with: introduction of prison contraband into prison in the frist degree; fourth-degree criminal facilitation; fifth-degree conspiracy; and seventh-degree criminal possession of a controlled substance. It is alleged that Sponaugle conspired with others to smuggle contraband items into the jail. Following an investigation of contraband smuggling in the GC Jail on Jan. 19, Sponaugle was arrested on April 30. After arraignment in Batavia City Court, the defendant was jailed on $2,500 cash bail or $5,000 bond. He was due back in city court May 1. The case was handled by Genesee County Sheriff's Deputy Jeremy McClellan.

Mark Daniel Caufield, 25, of Fisher Road, Rochester, is charged with: criminal possession of marijuana in the fifth degree -- more than 25 grams; aggravated unlicensed operation of a motor vehicle in the first degree; operating a motor vehicle while impaired by drugs -- first offense; and criminal possession of drug paraphernalia in the second degree. At 4:07 p.m. on April 21, Caufield was arrested on Clinton Street Road in Batavia following a traffic offense complaint. He was arraigned in Town of Batavia Court and is due there again on May 20. He was jailed on $2,500 cash or bond. The case was handled by Genesee County Sheriff's Deputy Jeremy McClellan, assisted by Deputy Travis DeMuth.
