Benefit at Travelodge on Sunday for family of Marie "My My" Fragnito

A benefit for the family of the late Marie Fragnito will be held at 2 p.m. on Sunday, April 14, at the Travelodge in Batavia.

Marie ("My My") was a lifelong Batavia resident who worked most recently at the ARC. She is survived by her daughter, Vanessa Aquino, three granddaughters, her mother, Josie Fragnito, brother, Joe, and sister, Patty.

Tickets for admission to the event can be purchased pre-sale at the Enchanted Florist on East Main Street downtown and Salvania’s Restaurant, located at 41 Jackson St., for $20 or at the door for $25.

Some of the highlights of the benefit will be a Chinese auction with prizes that have been donated by the Buffalo Bills, Buffalo Sabres, Buffalo Bisons and Darien Lake, among other personal donations.

Food will be included with admission and a cash bar will be provided.

Jim Catino’s band will be performing and her family members, friends and coworkers will be in attendance.

Stafford Historical Society meeting -- trustee election, local author presentation

The Stafford Historical Society's Annual monthly membership meeting will be at 7 p.m. on Wednesday, April 24th, at the town hall.

Our program will be Lynda Breckenridge Gaetano, a local born author who has written a series of "Up South" books with stories about real-life happenings, folklore and local history.

Society members are encourage to attend as Trustees are elected at this meeting.

Tri-Town youth football and cheerleading sign-ups Saturday at Alexander School

Tri-Town Youth Athletics is holding sign-ups for football and cheerleading this Saturday, April 13, from 10 a.m. to 2 p.m. at Alexander Elementary School in the lobby. The school is located at 3314 Buffalo St. in Alexander.

Fees are $90 for football; cheer is $150.

Bring the child's birth certificate, current physical exam documentation, and current report card.

There are no weight restrictions. All teams are age-based, and age is determined by how old the child is as of 12/1/2013.

Age groups for football:

  • 6-7 -- Instructional
  • 8-9 -- Mini
  • 10-11 -- Junior Varsity
  • 12-13 -- Varsity

Age groups for cheer:

  • 6-7 -- Instructional
  • 8-9 -- Mini
  • 10-11 -- Junior Varsity
  • 12-14 -- Varsity

Person struck by vehicle in Walmart parking lot, minor injuries

A person was struck by a vehicle in the parking lot of Walmart, sustained minor injuries and is now inside the store near the customer service area. Town of Batavia Fire Department and Mercy medics are responding to the store on Veterans Memorial Drive.

UPDATE 1:46 p.m.: The car is only described as "a small four-door" and it's near the main entrance. The victim reportedly knows the driver.

UPDATE 1:53 p.m.: Town of Batavia fire is told to stand down.

UPDATE 1:59 p.m.: The pedestrian is being transported to UMMC.

UPDATE 2:06 p.m.: The victim is a female who was struck in the back of the knee by a vehicle backing out of a parking spot.

UPDATE 4:06 p.m.: The "victim" was later arrested a charge of falsely reporting an incident, which is a Class A misdemeanor. She is identified in an arrest report as Brandi L. Gimlin, 19, of Jerome Place in the city. State Police Sgt. Ron Lobur said the arrest was made after a review of Walmart's video, which showed she was not in proximity of the sedan when it backed out of the parking space. He also said Gimlin subsequently admitted that she made up the story. Troopers, firefighters and medics responded to the initial call.

Several roads in Alexander closed due to flooding

The Genesee County Emergency Dispatcher Center announced that the following roads in Alexander are closed or partially closed due to flooding:

  • Dorman
  • Creek
  • Peaviner
  • Old Creek Road

 

Law firm issues statement on Title IX suit over girls softball field

Press release:

On April 5, Empire Justice Center filed a class-action suit against Batavia City
School District on behalf of three female softball players and their families, alleging wide disparities in treatment between girls’ softball and boys’ baseball.

Title IX forbids all federally funded entities from discriminating on the basis of sex. We are proud of the girls and their families for joining the ranks of so many brave Title IX plaintiffs over the course of history who have stood up for their civil rights and helped to level the playing field for women in sports.

In the words of one federal judge in another Title IX case, “[e]ach day these inequalities go unredressed, the members of the girls’ softball team, prospective members, students, faculty and the community at large, are sent a clear message that girls’ high school varsity softball is not as worthy as boys’ high school varsity baseball, i.e. that girls are not as important as boys.”

While we must refrain from commenting on the merits of pending litigation, we would like to make clear that had the Batavia School District agreed to commit to any concrete plans to remedy the inequities between girls’ softball and boys’ baseball by a specific date, there would have been no need for a lawsuit. As soon as the district makes a binding commitment, the case will be resolved.

As stated in the complaint, the Plaintiffs do not ask to take anything from their male classmates; nor are the girls asking for their own Dwyer Stadium (a request that they recognize would not be feasible). They are fans of the boys’ team and will continue to show their support by attending Blue Devils games at Dwyer regardless of the outcome of the case. They simply want equitable facilities to play on, as well as recognition that their athletic endeavors are as worthy as those of their male classmates.

Possible structure fire at 33 Ross St. in the city

A possible structure fire is reported at 33 Ross St. in the city. The fourth platoon is called into headquarters and city firefighters are on scene. National Grid is called.

UPDATE 4:29 p.m.: The fourth platoon is now called to the scene along with the second platoon.

UPDATE 4:30 p.m.: This is a working structure fire. Occupants are out of the house.

UPDATE 4:31 p.m.: The Town of Batavia Fire Department is placed on standby. You can smell the smoke Downtown.

UPDATE 4:33 p.m.: Elba Rescue and Alexander's Fast Team are called to provide mutual aid and the city's third platoon is requested as well. Firefighters are still trying to gain access to the basement, which is where the blaze began.

UPDATE 4:36 p.m.: Ross at Main Street will be completely shut down to traffic.

UPDATE 4:38 p.m.: Flames are showing at the north side of the basement.

UPDATE 4:46 p.m.: Two Mercy ambulances are called to stage at the scene. Entry has been made to the basement.

UPDATE 4:52 p.m.: National Grid has shut off power at the house. Ladders will be employed on all four sides of the house.

UPDATE 4:59 p.m.: Howard, who is at the scene, said the commander reports they "are starting to get a handle" on the fire.

UPDATE 5:12 p.m.: The fire is out in the basement.

UPDATE 5:29 p.m.: Now the basement is clear, too.

UPDATE 5:32 p.m.: The house is owned by Dr. David Paul. It is a historic structure and previously received an award from the Genesee County Landmark Society.

UPDATE 6:05 p.m.: There's only a small amount of smoke coming from the house at this point. Firefighters are going to use hand tools to open up the attic. A company is called to board up the house.

UPDATE 6:10 p.m.: Command reports the fire is under control.

UPDATE 6:36 p.m.: Darien fire's Cascade System is requested. This is portable equipment used to refill backpack oxygen air canisters.

UPDATE 8:39 p.m.: City Ladder 15 and Engine 11 are returning to quarters. Mutual aid responders have gone back into service with the exception of Town of Batavia's standby unit, which will be released momentarily when the city's crews return to the fire hall. City Engine 12 will remain on scene to finish up the detail.

Car rear-ends tractor-trailer at Texaco Town, minor injuries

A car rear-ended a tractor-trailer at the intersection of routes 63 and 20 -- Texaco Town. There are minor injuries and no entrapment. But the car, with Connecticut plates, is pinned underneath the semi, according to a Sheriff's deputy on scene. Pavilion Fire Department and Mercy medics are responding.

UPDATE 1:28 p.m.: The Pavilion assignment is back in service.

Car plows into parked car at East Main and Broadlawn in Batavia, no injuries

A car plowed into a parked vehicle at East Main Street Road and Broadlawn Avenue in the Town of Batavia. The volunteer fire department and Sheriff's deputies are responding. A Mercy medic on scene reports no injuries.

UPDATE 8:39 p.m.: Town of Batavia Fire Department is told to return to quarters and is now in service.

Three-car crash, one person injured, pole with wires down, on Bloomingdale Road

A three-car accident, with one person injured, is reported at 372 Bloomingdale Road. A utility pole is down, three high-tension wires are in the roadway and a transformer is leaking fluid. National Grid is notified and will shut the power down. The location is between Shanks and Tesnow roads. Sheriff's deputies are on location and Alabama fire and rescue are responding. Mercy medics are there and say a male driver hit a pole and has chest injuries.

UPDATE 3:26 p.m.: Bloomingdale Road is going to be shut down at Shanks.

UPDATE 3:28 p.m.: Fire police out of Akron are called to the scene.

UPDATE 3:34 p.m.: Bloomingdale at Martin Road is also being closed.

UPDATE 4:11 p.m.: A male in his 50s is being taken to UMMC.

UPDATE 5:53 p.m.: The roadway is reopened. Alabama is back in service. National Grid is on scene.

Grass fire on Pavilion Center Road

A grass fire is reported at 10119 Pavilion Center Road. Pavilion Fire Department is responding non-emergency. The location is between Stubb and Junction roads. There is a small structure nearby, but the fire chief on scene says it's not in danger at this time.

UPDATE 3:38 p.m.: The fire is out. Pavilion is back in service.

Kitchen fire in Ontario Cottage of NYS Vets Home

A kitchen fire is reported at the New York State Veterans Home located at 220 Richmond Ave. City of Batavia fire is responding. It's in the Ontario Cottage.

UPDATE 2:26 p.m.: The fire is out.

Feed bunk fire on Hudson Road, Pavilion

A fire is reported at 6471 Hudson Road in the Town of Pavilion. No structures are involved -- it's a livestock feed bunk. Pavilion, Le Roy and Stafford fire departments are responding. "We've got heavy, heavy black smoke in the air."

UPDATE 2:23 p.m.: Tankers from York and Bethany are also called to the scene. A wind advisory for parts of Western New York, including Genesee County, is in effect until 6 p.m. Winds are expected to average 25 to 35 mph, with gusts of up to 50 mph. which, of course, makes fires more difficult to fight.

UPDATE 2:29 p.m.: Fire police will be deployed at Route 19 to stop westbound traffic onto Hudson Road so tankers can draw water from a pond near that juncture. Perry Center's tankers, if available, are summoned.

UPDATE 2:33 p.m.: Mutual aid from Alexander, Town of Batavia and Bergen are called in.

UPDATE 2:36 p.m.: Caledonia is called to the scene and also to stand by in Pavilion's quarters.

UPDATE 2:37 p.m.: Brockport and Mumford are enlisted.

UPDATE 2:38 p.m.: Pavilion Fire command says "The fire's contained, but we've got to get up here and put these hay bales out. I'm not sure the ladder's going to reach that far." Wyoming #2 is called, Perry Center is cancelled.

UPDATE 2:42 p.m.: They want to get a backhoe in there to bust up the hay bales. "They're going pretty good." There's a big heap of corn cobs to deal with, too.

UPDATE 2:51 p.m.: Mercy medics are responding in case they are needed.

UPDATE 2:57 p.m.: The Pavilion Auxiliary and/or Salvation Army is going to bring refreshments. Attica Rescue is called to fill air bottles.

UPDATE 3:25 p.m.: The fire is pretty much knocked down. No hands lines are in use at this point. Alexander is released from the scene and others will be soon.

Chimney fire reported on Genesee Street in Corfu

A passerby reported flames coming from a chimney at 856 Genesee St. in Corfu. Corfu, City of Batavia Fire Department's Fast Team along with Darien, Pembroke, East Pembroke, and Indian Falls are called to the scene. First responders confirm flames shooting from the chimney.

UPDATE 11:46 p.m.: Only Corfu and Darien are told to continue to the scene. Akron and Crittenden, the Fast Team and the others are cancelled. An infrared camera and a ladder to access the side of the house are requested.

Car and motorcycle wreck in the city

A car and motorcycle collision is reported at 5 Prospect Ave. There are injuries. City fire is en route and police just arrived on scene.

UPDATE 8:15 p.m.: Mercy medics are there now.

UPDATE 8:29 p.m.: Fire department has cleared the scene. The motorcycle needs to be towed.

Reward offered to finder of missing Australian shephard from Batavia named "Bindy"

MISSING: This 8-year-old Australian shephard answers to "Bindy" and was last seen in the West Main Road of Batavia. There's a reward for the finder. Please call Rita at 716.474.4121.

UPDATE 8:22 p.m.: Rita says the woman who found the dog yesterday contacted her about an hour after this post went up this evening to say Bindy was taken safely to the animal shelter. Because it's now after-hours, Rita won't be able to take Bindy home until tommorrow. Rita said she was overwhelmed with the response from readers of The Batavian who contacted her about the lost dog. And she thanks everyone who tried to help put.

Young 'inconsolable' woman resists arrest in Oakfield, is pepper-sprayed

A distraught young female who was seen walking and screaming "inconsolably" in Oakfield was reported to dispatch and a law enforcement officer responded to her location at Maple Avenue and Gibson Street. She apparently refused to comply with the officer's directives and became abusive. As the officer attempted to arrest this person, she physically resisted and was pepper-sprayed. Mercy medics just arrived on scene to provide aid for the "irritant to the eyes."

UPDATE 1:38 p.m.: The patient was transported to a hospital in Medina.
