Body of missing man found in field off Cookson Road

The body of an 84-year-old Batavia man was found in a field off Cookson Road late this morning following a search by state troopers and Sheriff's deputies.

Alphonse Spiotta was last seen by a family member yesterday evening, a trooper said. His daughter reported him missing this morning.

At around 10 a.m., a county road maintenance worker reported finding a car off the roadway at 4312 Cookson Road, Alexander, that crashed into a tree. No one was around the vehicle, which was just around the curve where Dorman becomes Cookson. The worker told dispatch he first spotted the vehicle yesterday.

About 10 minutes later dispatch got a call from a woman who said her father was missing and that he was last seen yesterday.

A State Police helicopter was dispatched to the scene, but officers found the body shortly before it arrived. Sheriff's and State Police K-9s assisted in the search.

The man's body was found along a tree line next to the field some 300 yards south / southeast from where the car was found.

Alexander fire and Mercy EMS also responded to the scene.

Smoke in basement of structure on Lockport Road, Oakfield

Smoke is reported in the basement of a structure at 2719 Lockport Road. Oakfield fire is responding, along with mutual aid from Alabama. Town is Batavia fire is asked to fill in at the Oakfield Fire Hall. The location is Allied Electric Co., located between Bliss and Lewiston roads.

UPDATE 8 p.m.: Command says responders can proceed non-emergency.

Weather advisory for light snow and freezing drizzle in effect until 11 tonight

A winter weather advisory for snow and freezing drizzle is in effect until 11 p.m. for most of Western New York. The National Weather Service in Buffalo.

The weather outlook is hazardous and the mix of freezing drizzle and light snow will create a light coating of ice, procuding slippery spots on untreated roads as well as sidewalks and parking lots.

"A surface that appears just wet may in fact be icy," says the advisory.

College again offering free help for tax preparation

January is flying by and April 15th will be here before you know it. If that sends you into a panic, take advantage of free tax preparation help from Genesee Community College. For the sixth year straight, GCC volunteers are offering free income tax preparation services to the community through the Volunteer Income Tax Assistance (VITA) program and the Internal Revenue Service (IRS).

Those interested may access walk-in sessions at GCC's Batavia Campus as noted below or appointment-based services at Genesee County Department of Social Services (GCDSS) on Tuesdays.

There are four walk-in sessions scheduled at the GCC Batavia campus, all in room T205:

•    Thursday, Feb. 12th 4 -7 p.m.

•    Tuesday, Feb. 24th 4 - 7 p.m.

•    Tuesday, March 24th 4 – 7 p.m.

•    Thursday, April 2nd 4 – 7 p.m.

The appointment-based services are available from Feb. 3rd – April 7th at the Genesee County DSS at 5130 E. Main St., Batavia. To make an appointment call Betty at 344-2580, ext. 6552.

Through VITA, IRS-certified volunteers provide free basic income tax return preparation to community members with household income up to $53,000. Business tax returns or complicated capital gains transactions cannot be completed through the VITA program. VITA offers free electronic filing of federal and state returns.

"Genesee Community College is once again pleased to offer this service to our local residents. Our certified volunteers consist of faculty, staff and current students," said Cheryl Corke, GCC associate professor of Accounting and Business and VITA program director.

Last year we prepared 162 Federal and NYS income tax returns. Through this effort, our clients received $226,087 in Federal Income Tax Refunds, including $51,899 in earned income tax credits, $15,479 in child tax credits and $10,107 in education tax credits."

Corke advises participants to bring all necessary documents including W-2 (wage and earning statement(s) from employer(s), W-2G, 1098,1099-R, 1099-Misc (interest and dividend statements from banks) forms and the new 1095A forms related to the ACA; Social Security cards for all persons listed on the tax return; and a copy of last year's Federal and State returns, if available.

In addition, bank account routing numbers and account numbers are also needed for direct deposit of refunds. Other information participants may need to provide includes total annual payment for daycare providers plus the daycare provider's tax identifying numbers and address.

Lastly, for married-filing joint tax returns both spouses must be present to sign the required forms.

"I want to personally thank all of those involved in this program. It really is a fantastic opportunity for community members and our students," Corke said. "We have several certified preparers from GCC and DSS and many others have put time and effort into this endeavor."

The certified volunteers have undergone rigorous online training to be able to help prepare basic tax returns in communities across the country. VITA sites are generally located at community and neighborhood centers, libraries, schools, shopping malls and other convenient locations.

Deputy County treasurer resigns, new one is appointed

It is with very mixed feelings that I announce the resignation of James D. Stack, Deputy County Treasurer, and the appointment of Kevin J. Andrews as my next Deputy. Mr. Stack is resigning effective today to become a Monroe County Deputy Sheriff. James said becoming a deputy sheriff was a dream job of his since he was a young man. I will sincerely miss Jim, not only was he a great deputy to me, he is also a great friend. I wish Jim all the best in his new career.

Kevin J. Andrews, 26, of LeRoy, is my choice to succeed Jim as my next deputy. Andrews currently works in the Treaurer's Office as the Director of Real Property. I have worked with Kevin for four years and he has become a very valuable employee and will fit in well as Deputy Treasurer.

Kevin obtained his Bachelor's Degree in Mathematics/Statistics and Financial Economics from the University of Rochester in 2010 and has worked in the Treasurer's Office since he graduated.

Kevin and his wife, Alexandra, are expecting their first child in March.

Crash at routes 20 and 238, unknown injuries

A motor-vehicle accident, unknown injuries, is reported at routes 20 and 238. Darien fire and ambulance and Mercy medics are responding.

UPDATE 11:55 a.m.: This is a pickup truck vs. car accident. Both drivers are reportedly out of the vehicles, talking. The vehicles are off the road; traffic is not blocked.

UPDATE 12:11 p.m.: A second Mercy rig is called in lieu of Darien's ambulance.

UPDATE 1:21 p.m.: The Darien assignment is back in service.

Wreck with injuries on Clinton Street Road, Bergen

A two-car accident with injuries is reported at 8073 Clinton Street Road. Bergen fire and Mercy medics are responding. The location is in front of the feed convenience store.

Genesee County firefighters working a house fire in Middlebury

Several Genesee County fire departments are helping fight a fully involved house fire on Kingsley Road in the Town of Middlebury, which is in Wyoming County. The house is at 566 Kingsley Road.

Bethany, Pavilion and Le Roy are called to the scene, along with a tanker from Alexander. An engine from Alexander is requested to fill in at Bethany's hall. York is asked to fill in at Pavilion. Bergen is asked to stand by in its quarters. Bethany is requested to send an ambulance to the scene.

Garage fire reported on Cone Street

A garage fire with flames showing is reported at 28 2A Cone St. in the city. The location is between Jackson Street and Garfield Avenue. City firefighters are at the scene.

UPDATE 3:40 p.m.: This is a shed fire. Heavy smoke is pouring from its roof. The third platoon is called to stand by in city headquarters.

UPDATE 3:41 p.m.: Command says the fire is under control and they are overhauling the site.

UPDATE: Fire officials say the blaze was started by hot coals, discarded from the house fire, being deposited too close to the shed.

Rollover accident, unknown injuries, on Ellicott Street Road, Pavilion

A one-car rollover accident with unknown injuries is reported at 6653 Ellicott Street Road. Pavilion fire and Mercy medics are responding. The location is between Cook and Sparks roads.

UPDATE 11:13 a.m.: Minor injuries. A second vehicle was also involved.

Baby Chandler's 'grandma' arrested in 6-month-old's death

Batavia PD announced that Jacquelyn Deats, 63, was arrested today in connection with the death of infant Chandler Zuchs. The 6-month-old boy was found unresponsive when Mercy medics and Batavia city firefighters responded to a call for help at her address, 10 Olyn Ave., on Dec. 14. She is charged with endangering the welfare of a child.

Her son, Jeffery Deats, was arrested for manslaughter in the baby's death. Subsequently, it was revealed that he was not Chandler's biological father.

Jeffery Deats attempted suicide while in custody and later died at Erie County Medical Center.

Both Jacquelyn and Jeffery Deats were present in the Olyn Avenue home at the time Chandler was found unresponsive.

According to police, investigators learned with Jacquelyn did not contact emergency personnel for "a protracted amount of time after realizing there was something medically wrong with the infant."

The District Attorney's Office assisted with the case.

She is scheduled to appear in Batavia City Court at 1 p.m. on Tuesday, Jan. 27.

Smoke coming from walls of mobile home on Alexander Road

Smoke is reportedly coming from the walls of a mobile home at 9132 Alexander Road. Town of Batavia fire is responding.

UPDATE 6:48 p.m.: A responder on scene confirms "structure fire in the walls." The location is between Pike and Rose roads.

UPDATE 6:57 p.m.: A code enforcement officer is called to the scene.

UPDATE 7 p.m.: Oakfield is called to fill in at Town of Batavia's fire station.

UPDATE 7:05 p.m.: Traffic is backed up. They are going to alternate the traffic flow. The homeowner is safe and inside a vehicle.

UPDATE 7:07 p.m.: The fire is out and they are beginning overhaul.
