An Alabama man was seriously injured in a single-car accident today when his car struck a tree on Sandhill Road, Basom.

Robert J. VanPelt, 22, was taken by Mercy Flight to ECMC following the 1:40 p.m. accident.

While the accident remains under investigation, a Sheriff's Office release says alcohol may have been a contributing factor.

"Charges may be pending," according to the release.

VanPelt is being treated for multiple serious injuries.

VanPetl's passenger, Brandon Rueben (no age provided), also from Alabama, was taken by ground ambulance to ECMC. The Sheriff's Office describes his injuries as "non-life threatening."

VanPelt was driving a 1997 Buick north on Sandhill when he apparently failed to negotiate a curve and traveled off the east side of the road. His car then traveled back across Sandhill and off the west shoulder, where hit struck an embankment and then a tree.

Responding to the scene were Deputy Lonnie Nati, Deputy Dana Richardson, Sgt. T.A. Sanfratello, Investigator Kris Kautz, Deputy Kevin McCarthy and Deputy Eric Seppela from the crash-management team. Assisting at the scene were Alabama, Indian Falls and Pembroke fire departments as well as Mercy EMS.

Mercy Flight is on stand by following a single-car accident in the area of 7605 Sandhill Road, Basom.

The car hit a tree. Injuries are reported.

Alabama Fire and Indian Falls are being dispatched along with Mercy EMS.

UPDATE 1:49 p.m.: Two Mercy Flight helicopters are being requested along with another Mercy EMS advance life support ambulance. One patient is reported unconscious. The landing zone is being set up at the corner of Hopkins and Sliker Roads. The first helicopter has a three-minute ETA.

UPDATE 1:55 p.m.: A fire engine needs to be positioned so the winch can be used to stabilize the vehicle.

UPDATE 2:10 p.m.: Second patient extricated.

UPDATE 2:16 p.m.: The second helicopter is coming from Buffalo. It has at least at 20 minute ETA yet.

UPDATE 2:28 p.m.: The second helicopter is being cancelled. The patient will be transported by ground ambulance.

A Batavia woman was hurt in a two-vehicle accident at 1:35 p.m. Friday in Alabama.

The woman stopped the 2003 Toyota pickup she was driving at intersection of Townline Road and Maple Street Road when she was struck by another car that was behind her.

Cheryl A. Vagg, 53, of 110 Evans St., Batavia, was transported to UMMC by ground ambulance with back pain, according to Deputy Timothy Wescott, who investigated the accident.

The other driver, Susan J. Neamon, 46, of 2272 Thomas Road, Varysburg, was not injured.

Vagg's passenger, Keith W. Cadieux, 54, was not injured.

Neamon told Wescott she was "looking for oncoming traffic and must have rolled forward." Her 2009 Ford Sedan struck Vagg's truck, which was in front of her preparing to make a right-hand turn on Maple Street Road.

No citations were issued.

A 35-year-old Batavia man reported being shot and his wallet stolen as he walked down what he thinks was Indian Falls Road about 5:30 p.m., Saturday.

After being shot and robbed, Carlos Torres called a friend for assistance, who drove him to UMMC. He was transferred from UMMC to Strong Memorial Hospital by Mercy Flight, according to the Sheriff's Office.

He was in surgery at the time the Sheriff's Office released information on the incident at 11:23 p.m., Saturday.

Torres told officials, according to the release, that he believes he was walking on Indian Falls Road when a car pulled up behind him and somebody demanded his wallet. He was then shot in the back and his wallet was taken.

After the suspects left, he continued walking to Route 5, where he called a friend for help.

The Sheriff's Office says Torres was shot twice with a small caliber weapon. His injuries are not believed to be life threatening.

Anyone with information is asked to call the Sheriff's Office at 345-3000.

David J. Balonek, Jr., 34, of 209 Ross St., Batavia, is charged with criminal mischief, 4th, harassment, 2nd and endangering the welfare of a child. Balonek is accused of getting in a fight with a family member while a child was nearby.

James Edward Brown, 29, of Oakfield, is charged with failure to obey court order, coercion, 2nd and petit larceny. Brown is accused of stealing a mobile phone as part of a domestic incident at 2 a.m., Thursday. He also allegedly violated an order of protection.

Robert R. Richmond, 46, of 250 Ross St., Batavia, is charged with petit larceny. Richmond is accused of stealing money from the cafeteria at UMMC.

Mykeal Bryan Myers, 20, of Alexander, is charged with criminal trespass, criminal mischief and petit larceny. Myers is accused of stealing fuel from the U.S. Gypsum facility at 2754 Pike Road, Alexander.

Daryl Duane Scott, 29, of Rochester, is charged with criminal contempt and aggravated harassment. Scott is accused of calling and texting an ex-girlfriend, violating an order of protection.

Eric D. Johnston, 31, of Batavia, is charged with conspiracy, 6th, and petit larceny; Matthew J. Long, 20, of Le Roy, is charged with conspiracy, 6th, petit larceny and violation of probation. Johnston and Long were arrested by State Police earlier this week in connection from an unspecified incident on March 9. No further details are available.

Jillian A. Schmidt, 19, of Byron, is charged with unlawful possession of alcohol by a person under 21. Schmidt was arrested by State Police for an incident on March 12. No further details are available.

Sherry L. Lewis, 25, of Alabama, is charged with conspiracy, 6th, petit larceny and endangering the welfare of a child; Shannon L. Amidon, 30, of Akron, is charged with conspiracy, 6th, petit larceny and endangering the welfare of a child. Lewis and Amidon were arrested at 5:40 p.m., Wednesday, on Veterans Memorial Drive. No further details available.

Joshua Cordero McIver, 22, of 130 Third Ave., Apt. 18H, Brooklyn, is charge with criminal trespass, 3rd. McIver was reportedly barred from College Village on Feb. 22. He was reportedly arrested for trespassing on April 1. Then, on Monday, Mciver was allegedly found again at College Village, this time hiding under a desk covered by a bed comforter in Pine Hall.

Nicholas A. Darrow, 19, of 13192 Broadway Road, Alden, is charged with petit larceny. Darrow is accused of shoplifting from The Rez Smoke Shop.

Frankie McQueen, 19; Nickol Burnett, 19; Erick Horning, 20; David Klecker, 18; Joseph Striegil, 19; Christopher King, 18; Andrew Wright, 19, are charged with possession of alcohol under 21 years of age. Batavia Police reportedly responded to a complaint of a loud party with possible underage drinking at Woodstock Gardens Apartments. Allegedly, McQueen was hosting a party where people under 21 were consuming alcohol. McQueen was also charged with criminal nuisance.

Crystal L. Goodrich, 26, of 1090 Water St., Apt 1, Perry, is charged with DWI, driving with a BAC of .08 or greater, aggravated unlicensed operation, failure to stop at stop sign, operating while registration suspended, operating without insurance and unlicensed operator. Goodrich was stopped at 1:56 a.m., Saturday, on Perry Road in Pavilion by Deputy Howard Carlson.

Jared Christopher Dawe, 22, of 6469 Swamp Road, Lot #39, Byron, is charged with unlawful possession of marijuana. Dawe was allegedly involved in a domestic dispute at 1:54 a.m., Saturday, with his girlfriend. During the investigation by Deputy Frank Bordonaro, Dawe was allegedly found to possess marijuana.

Amy Lou Platten, 40, of 337 Main Road, Pembroke, is charged criminal contempt, 2nd. Platten is accused of contacting a person she was ordered not to contact.

Leon James Pocock, 36, of 83 S. Lake Ave., Studio 1, Bergen, is charged with criminal contempt, 2nd. Pocock is accused of violating an order of protection by texting a person he was ordered not to contact.

Bryan P. Umlauf, 24, of Batavia, is charged with unlawful possession of marijuana. Umlauf was issued a ticket by State Police in Le Roy at 2:10 p.m., Saturday.

Timothy J. Tryjankowski, 31, of Alabama, is charged with DWI and aggravated unlicensed operation. Tryjankowski was stopped by State Police at 5:30 a.m., Sunday. He was jailed on cash bail.

Jeremy D. Lyons, 25, of Oakfield, is charged with trespass and aggravated unlicensed operation, 2nd; and, Robert J. Spenton, 24, unknown address, is charged with trespass. Lyons and Spenton were charged by State Police for an alleged incident March 31 at Park Avenue and Route 63. No further details were released.

Patrick J. Puccio, 36, of Oakfield, is charged with DWI and driving with a BAC of .08 or greater. Puccio was charged by State Police follow a one-vehicle accident 3:20 a.m., Saturday, on Reuben Road, Alabama.

Amy L. Brown, 37, of Batavia, is charged with grand larceny, 3rd. Brown was arrested by State Police on Thursday in connection with an alleged incident on Jan. 13. No further details are available.

There will be no charges filed against an Alabama man who reportedly shot two dogs April 3.

A State Police investigation concluded the dogs may have been ill, as the man claimed.  The dogs belonged to him and his wife, and there is no law against killing your own dogs if you believe they are ill, said Rebecca Gibbons, spokeswoman for the State Police.

On April 3, a woman on Bloomingdale Road called police after she came home and found her dogs shot.  The woman's husband reportedly told police he was the one who shot them.

The case is closed, Gibbons said.

A State trooper is still investigating the case of two dogs that were found shot dead by their owner Saturday night on Bloomingdale Road in Alabama.

State Police spokeswoman Rebecca Gibbons said a person has admitted shooting the dogs (his name is not being released at this time), but said he did so because the dogs had health problems.

The man is somebody the woman knows.

The dogs were turned over to the Department of Environmental Conservation for examination.

Gibbons said the case remains open.

Jeff Allen Good, 34, of 3700 W. Main St., Room 1, Batavia, is charged with criminal possession of a controlled substance, 7th, possession of a hypodermic instrument, driving while impaired by drugs and driving left of pavement markings. The Sheriff's Office responded to a report of an erratic driver at 5:58 p.m., Sunday, who was forcing other cars off the roadway. The vehicle was located at 3700 W. Main St., and Good was identified as the alleged erratic driver. He was arrested by Deputy Patrick Reeves.

Jarred Ray Lewis, 21, of 50 Bloomingdale Road, Akron, is charged unlawful possession of marijuana. Lewis was stopped at 4:24 a.m., Sunday, for a vehicle check at Main and Oak streets in the city. He was ticketed by Deputy Patrick Reeves.

Michael Joseph Elmore, 19, of 814 Sumner Road, Darien, is charged with criminal possession of a controlled substance, 7th, and possession of a controlled substance not in its original container. Elmore was arrested following a traffic stop 6:49 p.m., Saturday, on Route 33, Pembroke, by Deputy Patrick Reeves.

Mark Christopher Kahabka, 18, of 3991 Pratt Road, Batavia, is charged with endangering the welfare of a child. Kahabka allegedly hosted an under-age drinking party Saturday night.

Nicole Marie Clark, 32, of 72 Blue Ridge Road, Penfield, is charged with DWI, driving with a BAC of .08 or greater, aggravated unlicensed operation, and failure to keep right. Clark was stopped by Deputy Eric Seppala at 1:20 a.m., Friday following a report of an erratic driver on Route 33, Town of Batavia.

Daniel Wayne King, 42, of 3481 Batavia-Oakfield Townline Road, Batavia, is charged with criminal possession of a controlled substance. Following a traffic stop by Deputy Patrick Reeves at 2:35 a.m., Saturday, on Veterans Memorial Drive, King was allegedly found in possession of crack cocaine.

Nicole A. Wilson, 33, of 126 E. State St., Albion, DWI, driving with a BAC of .08 or greater and aggravated unlicensed operation. Wilson was stopped on Route 19 in Le Roy at 12:45 a.m., Friday, by Deputy Chad Minuto.

Brett F. Dieter, 31, of Alabama, is charged with menacing, 3rd, stemming for an alleged domestic dispute that was reported to State Police at 1:06 a.m., Friday. Dieter was arrested at 8:29 p.m. No further details available.

Michael J. Nugent, 21, of Le Roy, is charged with criminal possession of a controlled substance, criminal use of drug paraphernalia (scales) and unlawful possession of marijuana. Nugent was arrested in the Town of Batavia by State Police at 3:25 p.m., Friday. No further details available.

Dewey E. Towner, 43, of Batavia, is charged with DWI, driving with a BAC of .08 or greater, and a motorcycle helmet violation. Towner was stopped by State Police on Oak Street, Batavia, at 8:25 p.m., Friday.

A woman on Bloomingdale Road came home a short time ago to find both of her dogs shot.

No further details available at this time.

A large grass fire has been reported in the area of 545 Bloomingdale Road, on the Tonawanda Indian Reservation.

It is reportedly moving toward a structure.

A truck hit a utility pole in the area of 1254 Bloomingdale Road, Alabama.

A transformer may have been knocked down. There are wires on the roadway and Bloomingdale is now closed.

There is also fluid on the ground.

Alabama Fire is responding.

UPDATE:  Reportedly, a semi-truck with trailer hit the pole. It reportedly also hit a structure, possibly a house.  It then reportedly left the scene.

A vehicle has reportedly hit a guardrail and is smoking in the area of 1084 Ledge Road, Basom.

Katrina L. Drake, 20, of 14 South Main St., Batavia, is charged with criminal mischief, 4th; Toni M. White, 29, same address, is charged with disorderly conduct. Drake and White were allegedly involved in a domestic dispute at 10:53 a.m., Saturday, with Drake allegedly destroying property belonging to White, and White allegedly yelling obscenities repeatedly while outside.

Stephen A. Lewis, II, 29, of 18 Cherry St., Batavia, is charged with DWAI (Drugs); aggravated unlicensed operation; moved from lane unsafely and inadequate headlamps. Officer Jason Davis stopped Lewis stopped Lewis at 12:15 a.m, Sunday, after reportedly observing him driving on East Main Street with out headlamps, turning onto Harvester Avenue and striking the curb.

Gregory L. Brennan, 41, of 8044 Kelsey Road, Batavia, is charged with DWI, driving with a BAC of .08 or greater, aggravated unlicensed operation, 3rd, and driving the wrong way on a one-way street. Brennan was stopped at 5:06 a.m., Friday, by Officer Daniel J. Coffey after allegedly being observed driving the wrong way down North Spruce Street.

Summer Ogden, 31, of 112 State Street, lower, rear, is charged with assault, 3rd, and criminal mischief, 4th. Ogden is accused of attacking her boyfriend and biting him causing an injury. She also allegedly destroyed some property. She was arrested at 8:15 p.m., Thursday. She was jailed on $1,000 bail.

Andrew J. Duckworth, 31, of 128 Jackson St., Batavia, is charged with harassment, 2nd. Duckworth was allegedly involved in a domestic dispute with his girlfriend at their residence. He was arrested at 4:08 a.m., Sunday, and jailed on $1,000 bail.

Warren H. Gaskin, 51, of 541 East Main St., Batavia, is charged with DWI, driving with a BAC of .08 or greater and operating without headlamps. Gaskin was stopped at 2:17 a.m., Saturday, by Officer Thad Mart after allegedly being observed driving on West Main Street without headlamps.

Robert J. Scott, 35, of 30 West Ave., Medina, is charged with aggravated unlicensed operation, 2nd. Scott was taken into custody on a warrant from 2005 by Batavia Police on Friday after being released from Orleans County Jail on unrelated charges. He was jailed on $1,000 bail.

Dennis F. Johnson, 49, of 901 Akron Road, Pembroke, is charged with DWI, driving with BAC of .08 or greater, consumption of alcohol in a motor vehicle, inadequate plate lamps and failure to yield to an emergency vehicle. Johnson allegedly failed to stop at 8:30 p.m., Saturday, for Deputy Kevin McCarthy who was attempting to make a traffic stop for an alleged equipment violation. Johnson allegedly didn't stop until he was in the driveway of his home.

Justin Zane Barker, 21, of 52 Columbia Ave., Batavia, was taken into custody on a bench warrant out of Cheektowaga Court for alleged petit larceny.

Julie Skye Besser, 42, of 380 Council House Road, Alabama, is charged with DWI, failure to yield right of way to emergency vehicle, refusal to take a breath test and failure to dim lights. Besser was reportedly stopped at 12:47 a.m., Sunday, on Hopkins Road in Pembroke, by Deputy Jason Saile.

Justin James Jaszko, 30, of 8087 Kelsey Road, Batavia, is charged with criminal contempt, 1st, two counts of criminal trespass, 2nd, unlawful imprisonment, 2nd, menacing, 3rd, harassment, 2nd. Jaszko allegedly violated an order of protection at 4:30 a.m., Saturday. He was jailed on $20,000 bail.

A 17-year-old from Oakfield is charged with aggravated harassment. The youth allegedly sent unwanted text messages and made unwanted phone calls to a young victim after being told to have no further contact with that person.

Lacey Ann Easton, 21, of 13369 Steiner Road, Akron, is charged with unlawful possession of marijuana. Easton was stopped at 12:34 a.m., Saturday, by Deputy Patrick Reeves for alleged traffic violations on Route 5, Pembroke.

Anthony John Ferris, 28, of 43 Longs Lane, Corfu, is charged with six counts of criminal contempt, 2nd. Ferris allegedly tried to call his ex-girlfriend in violation of a court order while locked up in Genesee County Jail.

Henry Leon Polanowski, 30, of 7205 E. Superstition Springs Blvd., Mesa, Ariz., is charged with unlawful possession of marijuana. Polanowski was arrested by Deputy Chad Minuto at 2:21 p.m., Friday, in Oakfield.

James R. Presnal, 51, of Penfield, is charged with DWI, driving with a BAC of .08 or greater, moving from lane unsafely and refusal to take a breath test. Presnal was reportedly stopped by State Police at 7:46 p.m., Saturday on the Thruway in the Town of Batavia.

Robert Michael Price, 25, of 693 E. Main St., Batavia, is charged with DWI, driving with a BAC of .08 or greater and criminal mischief, 4th. Price allegedly drove to a friend's house and broke the window at a little after midnight today. Deputy Frank Bordonaro arrested Price on the additional charge of DWI.

Matthew J. Klink, 38, of Albion, is charged with DWI and driving with a BAC of .08 or greater. Klink was stopped by state police at 12:28 a.m., Thursday, on Route 77 in Alabama. No further details released.

Anthony W. Johnson, 54, of Buffalo, is charged with DWI. Johnson was arrested by state police at 11:43 p.m., Wednesday following an accident on the Thruway at mile marker 383.8, Town of Stafford. Erin M. Vecio, 33, of Pittsford, was reported as the driver of the other vehicle. One person was reported injured in the accident. No further details were released.

Linda M. Clemens, 49, of Batavia, is charged with criminal mischief and harassment, 2nd. Clemens was arrested by state police at 11 Mix Place, Batavia, at 7:30 p.m, Sunday in connection with an alleged incident in Stafford. No further details were released.
