Town of Alabama Board opposed roundabout at Alleghany and Ledge

The town board in Alabama has notified that New York Department of Transportation that it opposes a planned $1.8 million roundabout at the intersection of Route 77 and Ledge Road, the site over the years of numerous accidents.

State officials maintain that roundabouts save lives and reduce high-impact, right-angle, serious-injury accidents but town officials in a letter to the DOT said they believe a roundabout at that intersection will make things worse.

"While it may decrease high-impact accidents," the board members wrote, "it will increase low-impact accidents, which will, in turn, increase the amount of emergency calls for our volunteer firemen."

The letter also raises concerns about farmers moving equipment through the roundabout, plowing it in winter, increased noise from trucks slowing and applying their jake brakes, and the danger of traffic slowing as vehicles approach the roundabout.

"The proposed roundabout will be approximately 30 feet from a residence," the letter states. "This poses a significant safety hazard to this property owner."

The town is also concerned that current equipment cannot properly clear the roundabout during and after snowstorms.

"Is the state going to pay for (the town) to purchase the equipment necessary to maintain it?" the letter states, adding later, "Our own highway superintendent is not in favor of this project. It is very difficult to keep this intersection clear in the winter as it is. Adding a roundabout to the mix will make it even more difficult."

The letter is signed by Supervisor Janet Sage, Deputy Supervisor Kevin Fisher, board members Gordon Linsey, Jill Klotzbach and William Cleveland.

Law and Order: Pair of Batavia residents suspected of selling drugs in Village of Attica

Kendra Kenyon, 22, (pictured left) and Dominic Beck, 23, (pictured below right) both of Batavia, no addresses noted, were among 12 people arrested recently by the Wyoming County Drug Task Force and accused of selling and/or manufacturing drugs throughout Wyoming County over the past year or so. Kenyon and Beck were the only defendants from Genesee County arrested in the sweep.

On March 13, Kenyon was charged with criminal sale of a controlled substance in the fourth degree and conspiracy in the fourth degree. 

It is alleged that Kenyon and Beck agreed to sell suboxone to an individual in the Village of Attica on Feb. 8. Both allegedly travelled to Attica with the intentions of selling the drug to another subject at which time they were arrested by Task Force Members and Wyoming County Probation officers who were waiting for them when they arrived to sell the drugs.

Kenyon is currently in the Wyoming County Jail in lieu of $15,000 cash bail, while Beckwho was arrested on the same charges March 8, has since posted bail. 

The Wyoming County Drug Task Force is a multi-agency unit with members from the Sheriff’s Office, Warsaw, Perry, Attica, and Arcade Police Departments, which all participate.

Tonya Lee Buzzell, 36, of Liberty Street, Batavia, is charged with: third-degree bail jumping; false personation; violation of the Family Court Act; criminal possession of a controlled substance in the seventh degree. Buzzell was located in Erie County and arrested on March 13 on four warrants then turned over to the Genesee County Sheriff's Office. Following her arraignment in Genesee County Family Court, she was released on her own recognizance. Next she was arraigned in Batavia City Court regarding the false personation charge and released on her own recognizance. Afterward, she was jailed in lieu of $1,500 bail on the criminal possession of a controlled substance charge and $10,000 bail on the third-degree bail jumping charge. Additional charges may be pending. She is due in city court April 24. The case was handled by Genesee County Sheriff's Deputy Ryan Young, assisted by Sgt. Thomas Sanfratello.

Sharnice Shantell Gibson, 27, of Frank Street, Medina, is charged with: aggravated driving while intoxicated -- with a passenger less than 16 years of age; DWI; two counts of endangering the welfare of a child; and loud exhaust. Gibson was arrested March 14 on Alleghany Road in Alabama following a complaint of an erratic driver. She was arraigned in Town of Alabama Court and jailed in lieu of $2,500 cash or $5,000 bond. She is due in Town of Alabama Court on April 4. The case was handled by Genesee County Sheriff's Deputy Joshua Brabon, assisted by Deputy Erik Andre.

Jamie Leigh Ayala, 39, of Walnut Street, Batavia, is charged with fourth-degree grand larceny and petit larceny. Ayala was arrested at 6:29 p.m. on Feb. 28 at Palm Island Indoor Water Park on Park Road in Batavia after allegedly stealing and preventing the return of a wallet containing three credit cards and other personal documents while at the water park. Ayala is due in Batavia Town Court on April 4 to answer the charges. The case was handled by Genesee County Sheriff's Deputy James Stack.

This year we welcome back spring with the theme -- Little Critters Mean a Lot! Join us for a variety of nature-related exhibits, crafts, fishing demos, and games for the kids.

There will be activities for all ages including toad abode construction, wildlife silhouette painting, pinecone feeder creation, live birds of prey, archery games, and face painting. Law and Order: Lockport man charged with damaging ex-girlfriend's vehicle in Pembroke

Axel E. Antongiorgi-Colon, 32, of Prospect Street, Lockport, is charged with second-degree criminal mischief. On Dec. 8 at 10 p.m. on Main Road in Pembroke, the defendant allegedly damaged a vehicle in the parking lot of his ex-girlfriend's residence. He is due in Pembroke Town Court on March 21 to answer the charge. The case was handled by Genesee County Sheriff's Investigator Christopher Parker, assisted by Deputy David Moore.

Cynthia H. Owens, 43, of Rochester Street, Bergen, was arrested on March 4 on three separate outstanding bench warrants out of Batavia City Court. She was also charged with three separate counts of third-degree bail jumping. Owens was arraigned in city court then jailed with bail set at $5,000 cash or bond on each warrant. She was due back in city court on March 7. The case was handled by Batavia Police Officer Nicole McGinnis.

Nicole M. Albrecht, 35, Pleasant Street, Le Roy, is charged with petit larceny. She was arrested for allegedly stealing a television from Target at 1:27 p.m. on Feb. 8. She is due in Batavia Town Court at 1 p.m. on March 14 to answer the charge. The case was handled by Genesee County Sheriff's Investigator Christopher Parker.

Douglas Mitchell Smith, 39, of Tara Drive, High Point, N.C., is charged with aggravated unlicensed operation of a motor vehicle in the third degree. Smith was arrested on a bench warrant out of Town of Alabama Court after he failed to answer a summons to appear in court Jan. 31 for allegedly operating a motor vehicle while his privilege was suspended in New York. He was arraigned on March 7 and sentenced to time served. He is to reappear in Alabama Town Court on Oct. 3 to pay his fines and surcharges. The case was handled by Genesee County Sheriff's Deputy Michael Lute.

Zachary G. Garigen-Johnstone, 22, or Birch Circle, Rochester, is charged with unlawful possession of marijuana, running a red light, unregistered motor vehicle and uninspected motor vehicle. Garigen-Johnstone was stopped at 12:44 a.m. on East Main Street in Batavia for a traffic violation. Upon further investigation, he was allegedly found to have a grinder containing marijuana and a marijuana pipe. He was processed roadside and issued three traffic tickets. He was released on an appearance ticket and is due in Batavia City Court to answer the unlawful marijuana charge on March 26. The case was handled by Batavia Police Officer Miah Stevens, assisted by Jason Davis.

Joshua Patrick Johnson, 21, of Redfield Parkway, Batavia, is charged with unlawful possession of marijuana and a window tint violation. He was arrested following a traffic stop at 9:42 p.m. March 2 on Lewiston Road in Batavia. He was released on an appearance ticket and in due in Town of Batavia Court on March 18. The case was handled by Genesee County Sheriff's Deputy Eric Meyer, assisted by Deputy Michael Lute.

Tonight's Harlem Wizards basketball game is switched to O-A High School gym due to high ticket sales

Due to higher than anticipated ticket sales, tonight's basketball game featuring the Harlem Wizards will take place inside the Oakfield-Alabama High School Gymnasium instead of at O-A elementary school.

Doors open at 6 and the game starts at 7.

Online ticket sales ended at noon today. If still available, tickets will be sold at the door -- $10 for students and $12 for adults.

The Oakfield-Alabama Elementary Student Council, in conjunction with the Genesee Community College Baseball Team, are presenting this exciting sports spectacle.

Factory that could have been in STAMP about to open in Malaysia

The advanced manufacturing plant that could have been in Genesee County with a little more political support will open soon in Cyberjaya, Malaysia.

Bedford, Mass.-based 1366 Technologies has been building a plant with the support of one of the companies that have invested in the startup, Hanwha Q CELLS, and announced this week the plant will open soon.

Until this week, 1366 had been unwilling to release the location of its new factory.

It will be the world's first direct wafer factory. The direct wafer process was invented at MIT and patented by 1366. It makes solar wafers much like glass is made, with silicon being poured on a flat surface. The company has claimed the process is more energy efficient and produces less waste.

In 2015, Gov. Andrew Cuomo came to Batavia to announce 1366 as the first tech company to agree to open a plant in STAMP, the advanced manufacturing project in Alabama, that would bring 1,000 mostly high-paying jobs to Genesee County.

The plan was for 1366 to invest $700 million in the plant. GCEDC and Empire State Development and other state agencies would provide $53 million in tax abatements and grants, based on certain incentives being met over 10 years.

The Department of Energy, in 2009, also promised 1366 a $150 million loan guarantee based on 1366 meeting two criteria: selecting a site for their factory and raising $100 million in private investment.

That deal fell apart on claims by Department of Energy officials that 1366 failed to select a site for its factory and had failed to raise the $100 million.  

The company had raised $80 million in private equity but the DOE would not renegotiate the terms of the loan.

Rep. Chris Collins, based on a conversation with a member of his staff, was not hugely supportive of his staff and it's not clear he did much to help the process along. After 1366 announced plans to pull out of the STAMP deal, Collins questioned the company's credibility. He said at the time that 1366's announcement was evidence that the company was never serious about building a plant in Genesee County.

Based on the expectation that 1366 was coming to STAMP, with the help of Sen. Michael Ranzenhofer, the state released $33 million for development of shovel-ready infrastructure at the Alabama location. 

Since 1366 pulled out of the deal nearly a year ago, GCEDC Steve Hyde has said on multiple occasions that GCEDC is talking with several prospective tenants for STAMP but so far no new deals have been announced. 

As of May 1366 and the DOE were locked in a dispute over ownership of patents because of the assistance the DOE had given to 1366 early in the process of developing its technology. The Batavian is not aware of any change in the status of that dispute.

UPDATE 4:16 p.m.: In this story, and previously, we reported that 1366 withdrew from plans to build in STAMP in March. Shortly after this story published we received documents, in response to a Freedom of Information Act request, from the Department of Energy, that revealed that STAMP informed DOE of its request to withdraw its loan application on Jan. 31, 2018.  There was no other new information in the set of documents.

Grand Jury: Trio accused of driving while impaired, plus pair of accused scofflaws

Antonio D. Dames is indicted for the crime of driving while intoxicated, as a Class E felony. It is alleged that on Aug. 9 in the Town of Alabama that Dames drove a 2000 Chevrolet on Lewiston Road while intoxicated. In count two, he is accused of DWI, per se, as a Class E felony, for allegedly having a BAC of .08 percent or more at the time. In count three, he is accused of aggravated unlicensed operation of a motor vehicle in the first degree, a Class E felony, for driving while his driver's license was suspended, revoked or otherwise withdrawn by authorities and while under the influence of alcohol or a drug. In count four, Dames is accused of circumvention of an interlock device, a violation, for driving a vehicle not equipped with an ignition interlock device. In Special Information filed by the District Attorney, Dames is accused of having been convicted of DWI, as a misdemeanor, on April 3, 2014 in Town of Lockport Court in Niagara County. That conviction forms the basis for the license suspension/revocation referred to in count three of the current indictment.

John D. Meiler is indicted for the crime of driving while ability impaired by drugs, as a Class D felony. It is alleged that on Aug. 21 in the Town of Alabama that Meiler drove a 2011 Chevrolet on Bloomingdale Road while his ability to do so was impaired by drugs. In count two, he is accused of aggravated unlicensed operation of a motor vehicle in the first degree, a Class E felony. It is alleged in count two that the defendant drove when he knew his driver's license was suspended, revoked or otherwise withdrawn by authorities and while under the influence of alcohol or a drug. In count three, he is accused of circumvention of an interlock device, a violation, for driving a vehicle not equipped with an ignition interlock device. In Special Information filed by the District Attorney, Meiler is accused of: having been convicted of DWI, as a misdemeanor, on Sept. 5, 2006, in Town of Alden Court in Erie County; having been convicted of DWI, as a misdemeanor, on Dec. 8, 2006 in County Court in Erie County; and having been convicted of DWI, as a misdemeanor, on Jan. 26, 2018 in County Court in Erie County. These three prior convictions form the basis for the license suspension/revocation referred to in count two of the current indictment. Furthermore, it is alleged that Meiler knew of the prior conviction and that his driver's license was still suspended or revoked.

William R. Reynolds is indicted for the crime of aggravated unlicensed operation in the first degree, a Class E felony. It is alleged that on July 28 in the Town of Pembroke that Reynolds drove a 2008 Chevrolet on Interstate 90 while his driver's license was suspended, revoked or otherwise withdrawn by authorities and that he did so while under the influence of alcohol or a drug. In count two, he is accused driving while intoxicated, as a Class E felony. In count three, the defendant is accused of aggravated DWI, as a Class E felony, for having a child age 15 or less as a passenger. In Special Information filed by the District Attorney, Reynolds is accused of having been convicted of aggravated DWI, a Class E felony, on Jan. 15, 2010 in County Court in Tioga County and that conviction forms the basis for count one in the current indictment.

Rahim J. Collazo is indicted for the crime of aggravated unlicensed operation of a motor vehicle in the first degree, a Class E felony. It is alleged that on June 29 in the Town of Batavia that Collazo drove a 2008 Chevrolet on Batavia Elba Townline Road while his driver's license was suspended or revoked and he had in effect 10 or more suspensions imposed on 10 different dates for failure to appear or pay a fine: March 24 in the Town of Irondequoit -- Monroe County; Nov. 9, 2017 in the Town of Henrietta -- Monroe County; March 14, 2017 in the Rochester Administrative Adjudication Bureau -- Monroe County; Feb. 5, 2016 in the Town of Brighton -- Monroe County; Oct. 10, 2015 and Sept. 24, 2014 and June 24, 2014 in the Rochester Administrative Adjudication Bureau -- Monroe County; June 22, 2013 in the Town of Tully -- Onondaga County; Feb. 6, 2013 in the Town of Windsor, Broome County; Nov. 1, 2012 in the Town of Sandy Creek, Oswego County; and Dec. 6, 2011 in the City of Rochester. In count two, Collazo is accused of the offense of speeding. It is alleged in count two that the defendant drove in excess of 55 mph, the posted speed limit.

Kayel J. McClary is indicted for the crime of aggravated unlicensed operation in the first degree, a Class E felony. It is alleged that on Sept. 1 in the Town of Pembroke that McClary drove a 2016 Ford on Interstate 90 while his driver's license was suspended or revoked and he had in effect 10 or more suspensions imposed on at least 10 separate dates for failure to appear or pay a fine in the City of Rochester: Aug. 11, 2011; April 8, 2014; May 6, 2014; June 10, 2014; July 8, 2014; Dec. 23, 2014; March 4, 2015; April 7, 2015; June 16, 2015; Jan. 18, 2017; May 9, 2017; Feb. 6, 2018; and April 24, 2018.

Law and Order: 17-year-old male at BHS accused of 'unwanted physical contact against staff member'

A 17-year-old male who lives on Cherry Street in Batavia is charged with second-degree harassment. At 12:30 p.m. on Jan. 14, Batavia police investigated an incident at Batavia High School involving a student who allegedly had unwanted physical contact against a staff member. The youth was issued an appearance ticket for Batavia City Court and is due there Jan. 22. The case was handled by Batavia Police Officer Jason Davis, assisted by Sgt. Dan Coffey.

Shadow Star Jonathan, 24, of Meadville Road, Tonawanda Indian Reservation, is charged with second-degree assault. He was arrested at 6:45 p.m. on Jan. 10 for allegedly assaulting another person at 1:30 a.m. on Oct. 14 on Sandhill Road, Alabama. He was arraigned in Alabama Town Court and jailed in lieu of $10,000 bail. He is to return to Alabama Town Court on Feb. 7. The case was handled by Genesee County Sheriff's Deputy James Diehl, assisted by Deputy Richard Schildwaster.

James Arthur Daggar, 64, of Batavia Elba Townline Road, is charged with: DWI; aggravated unlicensed operation in the first degree; operating without a driver's license; refusal to take a breath test; and failure to yield the right of way at a stop sign. At 4:02 p.m. on Jan. 15, Daggar was arrested following a motor-vehicle accident investigation. The accident on Alleghany Road (Route 77) resulted in minor injuries and only Dagger was transported to UMMC, where he was treated. Traffic tickets were issued and the defendant is to appear in Alabama Town Court on Feb. 13. The case was handled by Genesee County Sheriff's Deputy James Stack.

Ronnie Joe Flinchum, 59, Mill Street, Le Roy, is charged with failure to appear. Flinchum was arrested at 11:39 a.m. on Jan. 14 on a bench warrant for failure to appear on a prior charge of third-degree assault. The defendant was arraigned in Batavia City Court and put in jail in lieu of $1,000 cash or bond. Flinchum is to reappear in city court on Jan. 17. The case was handled by Batavia Police Officer Jason Davis, assisted by Officer Marc Lawrence.

Mehmet Kahraman Dilek, 43, of Meadowbrook Drive, Rochester, was arrested on Jan. 15 on a warrant out of Batavia City Court for failure to appear. Dilek was arraigned at 7:30 p.m. at jailed with inspecified bail. The defendant is due back in city court this afternoon (Jan. 16). The case was handled by Batavia Police Officer Christopher Lindsay, assisted by Officer Felicia DeGroot.

Crash reported at Route 77 and Judge Road, one person requires extrication

A personal injury accident involving two vehicles is reported at Route 77 and Judge Road. Smoke is coming from one of the vehicles. One is off the roadway, and a jackknifed tractor-trailer is partially blocking the roadway. Oakfield's rescue unit is asked to respond mutual aid to extricate one patient. Alabama Fire Department and Mercy medics are also responding.

Law and Order: Rochester resident arrested on felony DWI charge

Tevin Alexander Dowdell, 40, of Clifford Ave., Rochester, is charged with: driving while intoxicated as a felony; speeding in a 55-mph zone; refusal to take a breath test; uninspected motor vehicle; and aggravated unlicensed operation in the first degree -- operating a motor vehicle without a required ignition interlock device. On Dec. 31 at 8:33 p.m. on Clinton Street Road in Bergen, Dowdell was arrested on the charges, arraigned and put in Genesee County Jail in lieu of $2,000 cash bail or $4,000 bond. Dowdell is due in Bergen Town Court this afternoon (Jan. 2). The case was handled by Genesee County Sheriff's Deputy Mathew Clor, assisted by Deputy Jeremy McClellan.

Andrew John Rock, 32, of Judge Road, Oakfield, is charged with unlawful possession of marijuana. At 12:08 a.m. on Dec. 29 on Alleghany Road in Alabama, Rock was a passenger in a vehicle during a traffic stop. The defendant allegedly possessed a quantity of marijuana in the glove compartment of the vehicle and a smoking pipe in the passenger door. The case was handled by Genesee County Sheriff's Deputy Christopher Parker, assisted by Deputy Andrew Mullen.

Damian Michael-Edward Schoonmaker, 20, of Smith Street, Rochester, is charged with unlawful possession of marijuana. At 5:01 a.m. on Dec. 31 on Lewiston Road in Oakfield, Schoonmaker was arrested for allegedly possessing marijuana inside his 2000 Buick LaSabre. The case was handled by Genesee County Sheriff's Deputy James Stack.

Bethany and Alabama to receive water district funding

U.S. Senate Minority Leader Charles E. Schumer and U.S. Senator Kirsten Gillibrand today announced $4,639,000 in federal funding for six water infrastructure improvement projects across the Rochester-Finger Lakes Region. The funding was provided by the U.S. Department of Agriculture’s (USDA) Rural Development’s Water and Waste Disposal Loans and Grants Program.

Specifically, Schumer and Gillibrand explained, the Town of Alabama in Genesee County will receive: $1,653,000 to create Water District #2 and the Town of Bethany in Genesee County will receive $722,000 to create Water District #4.

The Town of Clarendon in Orleans County will receive $790,000 to create Water District #13 and an additional $790,000 to improve the water improvement benefit area #12, and the Town of Torrey in Yates County will receive $684,000 to create Water District 1, the first municipal water system to serve this area.

“These federal investments in job-creating and economy-boosting water infrastructure projects are great news for the Rochester-Finger Lakes region,” Schumer said. “This federal funding will allow five towns across the region to construct and make critical improvements to municipal water systems needed to provide clean, safe drinking water to their communities.

"I am proud to announce these federal investments and will continue fighting to ensure rural communities across Upstate New York have the resources they need to build, protect and maintain their water infrastructure.”

“All New Yorkers should have access to a reliable source of clean water, and with these grants, communities throughout the Rochester-Finger Lakes region will be able to expand and improve their water systems,” Gillibrand said.

“These investments will help provide safe and clean water for residents in the towns of Alabama, Bethany, Clarendon and Torrey, and I will always fight in the Senate for the resources to protect the health and quality of life for residents.”

A hunter is lost in the woods in an area north of Roberts Road and west of Sour Spring Road, Alabama.

The hunter is not injured. He can walk on his own. 

Alabama fire dispatched. East Pembroke fire requested to respond with its ATV.

Mercy EMS dispatched.

UPDATE 1:26 p.m.: The hunter has been located and will be assisted in walking out.

Rollover accident reported on Lewiston Road in Alabama

A one-vehicle rollover accident is reported in the area of 1093 Lewiston Road, Alabama.

Dispatchers are checking on the availability of Mercy Flight. 

Alabama fire and Mercy EMS responding.

An off-duty police officer is on scene and he reports a person is pinned in the vehicle but is conscious and alert.

UPDATE 7:23 a.m.: The person is reportedly out of the vehicle, only minor neck pain cited as injuries.

House filling with smoke on McAlpine Road, Alabama

A house is reportedly filling with smoke at 1142 McAlpine Road, Alabama. The occupant was advised to evacuate and Alabama Fire Department is responding. The location is between Ogden Street and Meiser Road.
