An Elba man's attempt to keep his job with the Town of Amherst was blocked by an appeals court ruling last week, reports the Buffalo News.

James I. Johnson was the town's assistant engineer when officials figured out he was living in Genesee County, apparently violating the town's strict residency requirements for town employees.

Johnson has filed numerous suits and appeals over the years to regain town employment.

“The determination that the petitioner is a domiciliary of Elba rather than the town (of Amherst) is supported by substantial evidence,” stated the decision of the five-judge panel.

Michelle A. Parker is indicted on four counts, including grand larceny, 3rd, petit larceny, grand larceny, 4th and perjury,1st. Parker is accused of stealing in November 2006 from a bank branch in Batavia and making a false statement related to the case. The amount of the alleged thefts exceed $4,000.

Gerardo Pineda-Sanchez is indicted on a count of assault, 2nd, a Class D felony. Sanchez is accused of stabbing a victim with a knife April 28 in Elba.

Theodore R. Cooper is indicted on one count of grand larceny, 3rd, a Class D felony. Cooper is accused of stealing property valued in excess of $3,000 sometime between Dec. 30 and Feb. 3 from a Batavia resident.

Scott Stine (aka Scott Campbell) is indicted on a count of DWI. Stine is accused of operating a motor vehicle while intoxicated on Lovers Lane Road, Batavia, on May 1.

Ami L. Blackmore is indicated on three counts related to driving while intoxicated. Blackmore is charged with DWI, driving with a BAC of .08 or greater and driving with a BAC of .18 or greater. Blackmore is accused of driving a car while intoxicated on Bloomingdale Road, Alabama, on Jan. 22.

Jamie R. Montgomery is indicted on two misdemeanor counts and one felony count related to an alleged DWI. Montgomery is charged with a misdemeanor count of DWI and a misdemeanour count of driving with a BAC of .08 or greater. She is charged with a Class E felony of aggravated unlicensed operation. Montgomery is accused of driving intoxicated on Route 5 in Stafford on March 17.

For a year-end project, I thought it would be cool to take some video and pictures of music- and arts-related activities -- respectively -- in the Genesee County schools.

The following video is 20 minutes long and divided into two parts (Youtube limits most users to about 10 minutes per video). It features concert footage from various schools in the county.

I have to make a quick apology for the poor video quality in a couple of instances. I had to be very careful to protect the identity of the kids (the ones photographed without parental approval), so I made sure none of the students' faces appeared too clearly on camera; plus, to be honest, the first camera I used turned out to be pretty awful when it came to taking video (even while taking decent pictures).

I also feel bad that I couldn't include every group I filmed in the video. My selections were based on a combination of different criteria, including:

•  making sure the best songs were included
•  making sure all of the schools I visited were included
•  arranging the selections in a way that flowed nicely

So there's the music part. Here are some pictures I was able to take of art work done by Elba and Leroy students:

A 20-year-old driver heading north on Route 98 in Elba on Friday says he was "daydreaming" and didn't see a car stopped ahead of him. The lapse of attention led to a rear-end accident that sent one person to the hospital.

The accident at 4:49 p.m. injured 65-year-old Charlene Worthington, a passenger in the stopped vehicle.

Cited for allegedly following too closely was Daniel J. Quatro, of 3709 Riches Corners Road, Albion.

The driver of the other car was June D. Boldt, 55, of Elba.

Noisy power tools and a smell like pesticides is reported at 16 N. Pearl St., Oakfield.

A firefighter reports that there is pesticide spraying and packing going on at the "old golf park."

The complaint was intitially called in by Department of Public Works employees.

Fernando Casteneda, 47, of Transit Raod, Elba, is charged with criminal possession of a weapon, 4th (unlicensed handgun). Deputy Chris Parker responded to Casteneda's residence at 9:52 a.m., Sunday, following a complaint of an alleged domestic dispute in which it was reported Casteneda had a gun. Casteneda is accused of possessing an unlicensed Hi Point 40 Cal semi-automatic pistol.

Lucus M. Hamlin, 32, of Canaseraga, is charged with DWI and driving with a BAC of .08 or greater. Hamlin was charged for allegedly driving drunk in the Darien Lake parking lot at 12:16 a.m., Sunday.

Justin D. McQuillen, 21, of Freeman Road, Byron, is charged with DWI and speeding. McQuillen was stopped at 11:52 p.m., Saturday, on Route 237, Byron, by Deputy Chad Minuto.

Raymond William Schramm, 24, of W. Main St. Road, Batavia, is charged with endangering the welfare of a child. Schramm was charged after a 4-year-old child reportedly entrusted to his care was found wondering on the shoulder of Route 5.

The following individuals were charged with disorderly conduct following an alleged fight at Darien Lakes Theme Park at 9:15 p.m., Sunday: Octavia M. Kimble, 19, of Rochester; a 17-year-old from Rochester; Tara B. Moore, 19, of Rochester; Corey M. Bogdanovitch, 21, of Waterloo; a 17-year-old from Rochester; Katlin C. Baily, 18, of Clyde; Tasia D. Blocker, 20, of Rochester.

Theodore D. Lazik, 27, of 73 River St., Batavia, is charged with DWI, running a red light and unlicensed operation. Lazik was stopped by Officer J.A. Davis at 10:35 p.m., Saturday, at the intersection of Main and Bank streets.

Katrina I. Drake, 20, of 21 Wood St., Batavia, is charged with criminal mischief, 4th. Drake is accused of breaking the window of a neighbor's house on Friday. She was located and arrested on Saturday.

Gregory Seppe, 52, of Batavia (no permanent street address), is charged with attempted petit larceny and criminal trespass, 3rd. Seppe is accused entering the rear fenced yard of a local resident and attempting to steal a portion of the white vinyl fence. Seppe was reportedly observed by the resident. Seppe was jailed on $1,000 bail.

Brittany LeeAnn Ellis, 21, of Mill Street, Nunda, was arrested on a bench warrant for petit larceny. Ellis was turned over to the Genesee County Sheriff's Office by the Livingston County Sheriff's Office.

A 17-year-old is charged with petit larceny and illegal entry into the country. The youth was allegedly caught concealing two bottles of cologne in his pants pocket. He allegedly left the Kmart store without paying for the cologne. After receiving an appearance ticket for the alleged petit larceny, he was turned over to ICE on the immigration charge.

A 16-year-old from Albion is charged with petit larceny for alleged shoplifting from Kmart.

Steven L. Maltese, 41, of Rochester, is charged with DWI and driving with a BAC of .08 or greater. Maltese was stopped by State Police at 12:05 a.m., Saturday, on Center Street, Batavia.

Paula Ann Kingdollar, 41, of Bank Street, Batavia, is charged with issuing a bad check. Kingdollar is accused of writing a check on a closed account in September, 2009, at a business in Corfu.

Joshua Paul Piscitelli, 25, of Eagle Harbor Road, Albion, is charged with unlawful possession of marijuana. Piscitelli was stopped by Deputy James Diehl at 9:34 p.m., Wednesday for an alleged traffic violation on Quaker Hill Road in Elba.

James A. Mitchell, 32, of 3 Maple Ave., Le Roy, is charged criminal possession of stolen property, 5th. He was arrested by Le Roy Police.

Anthony J. Donoghue, 27, of 6 School St., Le Roy, is charged with two counts of criminal possession of stolen property, 5th, and possession of an altered vehicle document. Donoghue was arrested by Patrolman Daryl Robb of the Le Roy Police Department. It was alleged that Donoghue unlawfully possessed one license plate and one vehicle registration belonging to another and also that he altered the vehicle registration.

Two youths from the Town of Batavia were arrested by State Police and charged with criminal mischief. One youth is 16 and the other is 12. Both are males. The alleged incident occurred at 5:31 p.m., March 25. The alleged incident occurred in the area of 8792 Haven Lane, Batavia. No further details were released.

Richard John Abramski, 22, of Main Road, East Pembroke, is charged with disorderly conduct. Abramski is accused of obstructing traffic in the area of 1993 Genesee Street, East Pembroke, by standing in the drive lane, causing traffic to move to avoid hitting him. Abramski was allegedly drunk at the time. The alleged incident occurred at 11:23 p.m., Saturday.

Danny J. Torok, 23, of 12 Elm St., Batavia, is charged with harassment, 2nd, and endangering the welfare of a child. Torok is accused of slapping, pushing and pulling the hair of his girlfriend while holding his 4-month-old daughter. He was jailed on $2,500 bail.

Jeremy Dean Lyons, 25, of Judge Road, Oakfield, is charged with unlawful possession of marijuana, unsafe lane change and speeding. Lyons was stopped by Deputy Thomas Sanfratello at 5:25 p.m., June 1, at 14 Weber St., Oakfield.

Joseph Stephen Vernaccini, 34, of Clipnock Road, Stafford, is charged with DWI, failure to keep right and refusal to take breath test. Vernaccini was reportedly involved in a one-car accident 12:44 a.m., Saturday, in the area of 7000 Route 5, Le Roy. Vernaccini was jailed on $500 bail.

Justino Sanchez, 50, of West Ridge Road, Brockport, is charged with DWI, aggravated unlicensed operation, failure to keep right, improper right turn. Sanchez was stopped by Deputy James Diehl at 10:47 p.m., Friday, in the area of Route 98 and Edgerton Road, Elba. He was jailed on $1,800 bail.

A 17-year-old from Clarence was arrested by State Police in Darien at 8:05 p.m., Wednesday. She is charged with DWI, failure to keep right, crossing road hazard markings and unlawful possession of marijuana.

A 16-year-old from Williamsville was arrested by State Police at 8:05 p.m., Wednesday, in Batavia for unlawful possession of alcohol.

John J. Smalley, 47, of Oakfield, is charged with harassment and criminal mischief. Smalley was arrested by State Police at 12:50 a.m., Sunday, in the area of 7020 Macumber Road, Oakfield. No further details were released.

A caller reported a "substantial" gas spill at the Yellow Goose station in Elba.

A first responder from the Elba Fire Department reports a "smaller gas spill."

The original call said the gas was flowing into a storm drain.  The caller said the driver who caused the spill left the station.

UPDATE 7:07 a.m.: Spill contained. Elba Fire back in service.

A youth who was wanted by local law enforcement, and allegedly led Batavia Police, State Police and Sheriff's deputies on a manhunt in the city two months ago, was sentenced to prison time for a violation of probation.

Christopher Laird, 17, originally from Elba, but has also lived in Le Roy and Batavia, failed to report for probation meetings in early 2010.

Police eventually caught up with Lair in Le Roy on April 4, two days after the manhunt, which involved a State Police helicopter.

Laird's probation was revoked. He will spend one to three years in state prison.

Jesse Adam Dispenza, 24, of Union Street, Scottsville, is charged with trespass. Dispenza is accused of trespassing on the Dolomite property in the Town of Le Roy at 6:20 p.m., Saturday.

Marissa Christine Zeiner, 19, of Sunset Circle Lane, Brockport, is charged with trespass. Zeiner is accused of trespassing on the Dolomite property in the Town of Le Roy at 6:20 p.m., Saturday.

A 17-year-old resident of Maple Avenue in Le Roy is charged with unlawful possession of marijuana. The youth was allegedly found in possession of marijuana during a traffic stop by Deputy Matt Butler at 5:03 p.m., Saturday.

Ami Kadar, 64, of Albion, is charged with harassment, 2nd. Kadar was arrested this week by State Police on Maple Avenue, Elba, in connection with an alleged incident at 12:01 p.m., March 30. No further details are available.

Jorge L. Portugal-Pineda, 22, of Elba, is charged with DWI, driving with a BAC of .08 or greater, unsafe tires and consuming alcohol in a motor vehicle. Portugal-Pineda was arrested by State Police on Transit Road at 3:15 p.m., Monday.

Ethan R. Kitanik, 19, of Oakfield, is charged with unlawful possession of marijuana, and ticketed for no headlights. Kitanik was stopped by State Police on Oak Street in Oakfield at 10:55 p.m., Sunday.

An alleged knife attack that left a victim in need of more than 80 stitches on his face and hand has led to the arrest of an Elba man on an assault and weapons possession charge.

Gerardo Pineda-Sanchez, 42, of Oak Orchard Road was taken into custody by the Sheriff's Office for the alleged April 28 attack.

The victim, described as a Mexican male, was interviewed by investigators after he showed up at the UMMC emergency room. The victim was eventually transferred to ECMC where he received 65 stitches on his face and 20 on this thumb.

With the aid of ICE, the Sheriff's Office was able to identify Pineda-Sanchez as the suspect and apprehended him at his workplace without incident.

Pineda-Sanchez is being held in a federal detention facility on $10,000 bail.

A structure fire in Elba on Saturday caused an estimated $100,000 damage after a diesel engine connected to a generator apparently overheated, setting off the blaze.

A shed at 5327 Watson Road was destroyed.

The fire damaged the motor, generator, wiring and controls.

Elba Fire and Deputy Jason Saile investigated the incident.

Tree branches are down in the area of 166 Summit St., completely blocking it.

At 9 Holland Ave., a tree is down and electrical wires are arcing.

Also, trees down blocking Macomber Road in Oakfield and a street in Bergen.

UPDATE 4:22 p.m.: A line is down and arcing on Route 77. Also, Batavia Fire is being dispatched to 71 S. Main St. for a tree limb on fire. A Le Roy Fire chief reports a limb down on Myrtle Street.

UPDATE 4:28 p.m.: In Le Roy, there are at least two limbs down on Myrtle, with one causing damage to a vehicle, plus one on Glibert Street. Le Roy is setting up a command post at the Fire Hall and requesting all available manpower.

UPDATE 4:30 p.m.: Fire Dispatch just notifed all fire personnel to go to various operational channels and keep radio transmissions to a minimum: "We have several emergencies to get out."

Update 4:35 p.m.: There is some sort of fire on West Bergen Road. Wires are down on Elm Street in Le Roy, also in Le Roy several tree branches and wires are down and arcing on Lake Street. There is also an incident on Washington Avenue in Batavia that has the street shut down.

UPDATE 4:38 p.m.: A tree has fallen on a house on Kibbe Avenue.

UPDATE 4:40 p.m.: There's a chain reaction of poles down and wires popping on Clipknock Road. There's also another pole down in Le Roy, but we didn't catch the location. Also several poles and wires down on Bethany Center Road.

UPDATE 4:43 p.m.: Somebody just said, "We've lost all power in the village." Not sure which village.

UPDATE 5:09 p.m.: National Grid is on scene on Erie Street in Le Roy for lines down.  Also on Oatka, a large tree is leaning on wires. Wires are intact. In Batavia, Jackson Street is blocked at Wood Street. Darien is being asked to check 9295 Colby Road for unknown wires down.

UPDATE: A tree has fallen into power lines on Vine Street.
