Pembroke set to host 11th annual Shooting for a Cure on Feb. 11

By Press Release

Press release:

The Pembroke Jr./Sr. High School Girls’ Basketball Team will host its 11th annual Shooting For A Cure! event versus Oakfield-Alabama on Friday, February 11, 2022, at 7:00 PM at the high school gym located at the corner of Routes 5 and 77 (8717Alleghany Road) in Pembroke, New York. Admission is free. The team asks that attendees make a donation of any amount as they enter the facility, and all donations go to Roswell Park to support research efforts. In addition to donations at the door, all proceeds from raffle tickets, concession sales, and apparel sales go directly to Roswell Park. To date, Shooting For A Cure! has raised over $200,000 and has become Roswell Park’s largest independent, community-based fundraising event.

The event began over a decade ago when the team approached then head coach Mike Wilson with an idea; they wanted to show their support for Toni Funke, wife of former coach and Pembroke teacher Ron Funke, in her battle against breast cancer by hosting a game in her honor which would bring the community together to raise awareness and funds for cancer research at Roswell Park. This season, the team hopes to add to the $200,000 the event has generated and donated since 2011, by continuing this benevolent Pembroke tradition.

At this present time, in accordance with NYS guidelines, we kindly ask that all attendees wear a mask when entering the school that evening.

Direct online donations are now being accepted in support of this year’s Shooting For A Cure! at: http://give.roswellpark.org/goto/shooting-for-a-cure-11. In addition, the team is seeking donations from the community in the form of items to include in various raffles, as well as food, beverages, and merchandise that can be offered for sale during the event.  All of the proceeds will benefit cancer research at Roswell Park Comprehensive Cancer Center.  The 2021-2022 Shooting For A Cure! donors list already contains many businesses and organizations, including 26Shirts, ADPRO Sports, Buffalo Bandits, Buffalo Bills, Buffalo Sabres, Burnin’ Barrel BBQ, Buttercumbs Bakery, Clarence Deli, Five Guys, Genesee County YMCA, Hershey's Ice Cream, Homeslice 33 Pizzeria, Knockaround Sunglasses, Linda's Family Diner, Original Pizza Logs, Pesci's Pizza, Roswell Park Alliance Foundation, Salvatore’s, Terry Hills, Tim Horton's. Businesses and organizations wishing to make a donation for this year’s event should contact Mike Wilson, the Shooting For A Cure! coordinator at Pembroke, by calling 716.949.0523.

Court affirms DWI conviction after appeal of trooper's entry of car

By Howard B. Owens

Press release:

In a decision rendered December 21, 2021, Genesee County Court Judge Charles N. Zambito affirmed the misdemeanor DWI conviction of defendant James D. Doyle (complete decision attached). The defendant was convicted upon his guilty plea in Pembroke Town Court in March of 2018 and was sentenced to a conditional discharge.

On August 26-27, 2012, around midnight, Trooper Timothy Pickering was on duty and received multiple reports through dispatch of an erratic vehicle traveling eastbound on the Thruway. Trooper Pickering located the car in the Pembroke service area. The vehicle was parked but it was still running. When the trooper approached the car, he saw "a driver sitting in the driver's seat, no seat belt, slumped over the wheel, and there was a female passenger in the passenger seat slumped over, too." The trooper knocked on the window and received no response. He then opened the door and was eventually successful in waking up the driver, who was Mr. Doyle.

After Mr. Doyle pleaded guilty, he filed a notice of appeal In April of 2018. In July of 2020, after Mr. Doyle had made no further action to perfect the appeal, the Genesee County District Attorney's Office moved to dismiss the matter. Genesee County Court allowed Mr. Doyle to complete his appeal, and an oral argument occurred on September 29, 2021.

In its decision, Genesee County Court found that Trooper Pickering was justified In "the minimally intrusive act of opening the defendant's . . . door to continue his Investigation" due to "the recent and substantial report of the defendant's erratic driving behavior, the manner in which the defendant's vehicle was parked, the fact that the vehicle was still running, and the defendant's unresponsive state." These factors gave the trooper reasonable cause to believe that the defendant had operated the vehicle while intoxicated or impaired. The trooper's actions were also justified under the emergency doctrine.

Assistant District Attorney Robert J. Shoemaker, who handled the appeal, welcomed the decision. "This is a good result not only for law enforcement, but it is also a win for logic and reason. We appreciate County Court's recognition that a trooper in this situation can approach a car and check on the occupants, both to determine their welfare and to investigate possible criminal activity.

Indeed, Trooper Pickering would have been derelict in his duties if he had knocked on Mr. Doyle's window and, upon receiving no response, had simply walked away.”

“The story of ‘C. Jay’ Hall’s sacrifice and bravery in the face of danger encapsulates the selfless spirit of our service members and is one that should be remembered for generations,” said Hawley. “Seeing the sign honoring his sacrifice unveiled today was a proud moment after working for so long to make it a reality, so I want to thank all of the local and state legislative partners I’ve worked with in the last year who helped make it happen for their dedication to getting this bill passed, as well as our local veteran organizations, who were of tremendous assistance in advocating for its creation.”

Rath also praised Hall's service and sacrifice in Vietnam.

"Ronald Reagan said, 'we're forever indebted to those who gave their lives so that we can be free,'" Rath said. "Our debt to C. “I am proud that Governor Hochul signed this legislation into law. It is especially significant for me as S6105 was my first piece of legislation to pass the Senate.” Senator Rath continued, “the story of Specialist Four Hall’s bravery and courage is truly awe-inspiring and his sacrifice should never be forgotten.  Thank you to everyone involved for sharing his story with me. I am honored to have had a role in bringing this proposal to reality and look forward to driving down "Specialist Four (SP4) Clarence 'C. Jay' Hall Memorial Highway” in the future.”

“As a veteran and representative, it humbles me any time there is an opportunity to honor those who served. There’s no time more solemn than when we are memorializing and giving thanks for the heroic and ultimate sacrifice of a soldier in combat, like Specialist Four Clarence "C. Jay" Hall. May God bless him and his family. We are all freer today because of his service,” said Hawley. “I am so proud to have worked with Sen. Rath to get this bill enacted into law, and I would also like to thank all of the veterans groups, Pembroke High School and Mr. Matt Moscato’s class, and all the members of the community who helped to support this initiative. I look forward to marking the official occasion with you all at an upcoming dedication ceremony.”

Specialist Four Clarence "C. Jay" Hall served as a rifleman in the United States Army in Binh Duong, Vietnam.  He was mortally wounded on October 7, 1969, during an intense attack by enemy forces.  Specialist Hall earned the NYS Conspicuous Service Cross, the National Defense Service Medal, the Vietnam Service Medal with One Bronze Star, Vietnam Campaign Ribbon, Combat Infantryman Badge, and the Silver Star, which is the nation's third-highest award for valor.  The Veteran’s Outreach Club and the Government classes of the Pembroke Jr. /Sr. High School requested this legislation.

The bill passed the Senate and Assembly on May 25 and June 8 respectively.  It was delivered to the Governor for consideration on September 28, 2021.

A formal presentation and renaming ceremony will be held at a later date.
