A fight involving about a dozen people is reported on Summit Street between Washington Avenue and East Main Street. City police just arrived on scene.

The following people were arrested by the Genesee County Sheriff’s Office during the Chris Stapleton Concert at Darien Lake Performing Arts Center on Sunday:

Jeremy A. Wicks, 34, of Beebe Road, Afton, is charged with unauthorized use of a vehicle after allegedly taking a Darien Lake golf cart without permission. Wicks was arraigned in Darien Court and put in jail in lieu of $500 bail.

Russell P. Vincent Jr., 18, of Chestnut Road, Newfane, is charged with unlawful possession of marijuana after allegedly being found in possession of a quantity of marijuana.

Brandon M. Welsh, 29, of Main Street North, Jarvis, Ontario, is charged with harassment, 2nd, after allegedly having unwanted contact with a Live Nation employee.

Amanda M. Ott,  30, of East Avenue, Lockport, is charged with harassment, 2nd, after allegedly pushing a Live Nation employee in the chest.

Kaitlyn M. Hornburg,  20, of Seger Road, Sinclairville, is charged with harassment, 2nd, after allegedly spitting in a Live Nation employee's face.

Chris Kaboingo, 28, of Mill Street, Le Roy, is charged with criminal possession of a controlled substance, 4th. Kaboingo was arrested following a property damage accident at 7:29 p.m. May 25 on Alexander Road, Alexander. He was allegedly found in possession of amphetamine pills. He was arraigned July 11 and released under supervision of Genesee Justice. Also charged was Darazian Willie Paul Williams, 24, of West Main Street, Batavia. Williams was also cited for alleged failure to keep right.

Alexander Albert Chandler, 25, of Lake Street, Le Roy, is charged with unlawful possession of marijuana and inadequate plate lamp. Chandler was stopped at 9:50 p.m. Friday on Main Road, Stafford, by Deputy Michael Lute.

Riley Kristine Davis, 20, of Gilbert Road, Bergen, is charged with petit larceny. Davis is accused of shoplifting from a business on Veterans Memorial Drive at 12:11 p.m. on July 10. Davis allegedly stole jewelry. 

Nasir Chalee Nathan, 21, of Goade Park, Batavia, is charged with unlawful possession of marijuana. Nathan was allegedly found in possession marijuana while in a parking lot off Veterans Memorial Drive, Batavia, at 12:43 p.m. on July 10 by Deputy Ryan DeLong.

Jessica Ann Shiltz, 33, Claybed Road, Filmore, is charged with DWI and refusal to take breath test. At 12:27 a.m., July 13, Deputy Ryan DeLong observed a vehicle stopped at the side of the road on Colby Road, Darien. Upon investigation, Shiltz was found to be allegedly driving drunk. She was jailed on $250 bail.

Jay'von D Spivey, 18, of Holland Avenue, Batavia, is charged with criminal possession of stolen property, 5th, and resisting arrest. Spivey is accused of stealing a bicycle. He allegedly pulled away and resisted when police attempted to place him in custody. He was jailed on $1,000 bail or $2,000 bond.

Gregory Seppe, 59, of South Swan Street, Batavia, is charged with petit larceny, burglary, 2nd, and conspiracy, 4th. Gregory Seppe was arrested with Brandon Seppe, 33, when the two men were allegedly found leaving the area of a reported burglary. Both were held without bail.

Olivia J. Paganin, 28, of Myrtle Street, Le Roy, is charged with DWI, driving with a BAC of .08 or greater, and motor vehicle with lights that do not meet standards. Paganin was stopped at 1:15 a.m., July 1, on East Main Street, Batavia, by Officer Matthew Wojtaszczyk.

Sheryl A. Jeffery, 58, of Summit Street, Batavia, is charged with harassment, 2nd. Jeffery allegedly struck a registered nurse while being treated at UMMC.

A 38-year-old Batavia man is being accused of selling crack cocaine to an agent of the Local Drug Task Force on three separate occasions.

Jason M. Giuliani, of Oak Street, was arrested at the Genesee County Jail, where he is being held on unrelated charged.

Giuliani is charged with three counts of criminal sale of a controlled substance and three counts of criminal possession of a controlled substance. The charges are Class B felonies.

Bail was set for Giuliani on these charges at $15,000 cash or $30,000 bond.

A "physical disturbance" is reported in the area of 110 Evans St. City police are responding.

A 73-year-old man in Bethany was asaulted tonight in his home by an intruder and is being transported to UMMC by ambulance for treatment of his injuries. 

The intruder awoke the man and struck him several times with an unknown object. He also sprayed him with an unknown substance. 

The suspect was not on scene when deputies arrived and law enforcement has no description at this time. 

The initial 9-1-1 call was just before 9 p.m.

Sometimes good people do bad things, Judge Micheal Mohun told Bill Thomas before sentencing him to three years in state prison for menacing a police officer.

With the nearly 14 months already served in county jail, and time off for good time, Thomas should be back home with his family in a little over a year.

Family is a big part of the Thomas story, something Mohun noted during his sentencing remarks.

"You're a lucky fella," Mohun said. "Every time you've come to court, your family has been here. Your family has been very supportive. I see you are one of 10 kids, the second youngest. Your mother died in May while you were in jail. I'm sure that was very hard on you.  It gives me great encouragement that your family is with you and has backed you throughout your court appearances and your trial and now they're here with you today. That is a real testament to the Thomas family.

Then he added, "you're also lucky to be alive."

On the morning of March 16, 2016, Officer Pete Flanigan responded to a home on State Street to investigate a report of a disturbance. Bill's brother Rand answered the door and Flanigan saw Thomas, he testified at trial, with a knife in his hand. He said Thomas came at him with the knife and he thought he would have to shoot Thomas, but Rand, in trying to flee the residence, got in between the officer and his brother.

At a trial last month, Thomas was convicted of criminal possession of a weapon and menacing a police officer.

The mandatory minimum sentence for menacing a police officer is two years in prison, with a maximum of eight. 

Mohun also sentenced Thomas to one to three years on the weapons conviction, to run concurrently to the menacing charge. Thomas will also have a year and a half parole to serve when he's released.

Thomas has a prior criminal record, but nothing in the past 20 years and never had a prior arrest for any kind of violence.

He had been living with his mother, caring for her, prior to his arrest.

While Thomas, 57, was represented at the jury trial by the Public Defender's Office, retained counsel Maurice Verillo appeared for the defendant today. He argued for a minimum amount of time in prison and asked that his client's time in prison be at a facility close to Batavia so his family could easily visit him.

Mohun said he has no control over where the Department of Corrections sends Thomas, but he did attach the request to his file, so it is with him when he is processed, and all of the letters of support from friends and family the court received.

District Attorney Lawrence Friedman, who usually has something to say when asked what his sentencing recommendations are by a judge, made no statement in court today.

About a dozen members of his family were in court. After Mohun adjourned the case, they all stood. Deputies allowed Thomas to turn and say goodbye to his family.  Family members told him they supported him and loved him.

Three people have been arrested, all on Class B felony charges, following an investigation by the GC Local Drug Enforcement Task Force in the City of Batavia.

Jacklyn M. Ganzhorn, 30, of South Lyon Street, Batavia, is charged with two counts of criminal sale of a controlled substance in the third degree -- heroin/fentanyl; and two counts of criminal possession of a controlled substance in the third degree (same drug).

Ganzhorn was arrested Wednesday afternoon by Batavia Police while they were investigating an unrelated matter.

She was jailed on $20,000 cash bail or $40,000 bond.

Uniformed officers of the Batavia Police Department assisted Task Force members with the investigation.

Johnnie M. Watson, 34, of West Main Street, Batavia, is charged with three counts criminal sale of a controlled substance in the third degree -- "crack" cocaine; and three counts of criminal possession of a controlled substance in the third degree (same drug).

Watson was arrested Tuesday afternoon by Genesee County Sheriff's Deputies.

Watson is currently on parole.

He was jailed on $20,000 cash bail or $40,000 bond.

Uniformed officers of the Genesee County Sheriff's Office assisted Task Force members with the investigation.

Edward J. "Jordan" White, 21, of Michigan Street, Lockport, is charged with one count of criminal sale of a controlled substance in the third degree -- "crack" cocaine; and one count of criminal possession of a controlled substance in the third degree (same drug).

White was arrested Tuesday afternoon by Genesee County Sheriff's deputies.

White, who is also currently on parole, was jailed on $20,000 cash bail or $40,000 bond. 

Uniformed officers of the Genesee County Sheriff's Office assisted Task Force members with the investigation. The Task Force is comprised officers from the Genesee County Sheriff's Office, Batavia Police NET officers, and the Le Roy Village Police Department.

Kortney R. Howell, 19, of Church Street, Victor, is charged with unlawful possession of marijuana after allegedly being found in possession of marijuana.

A 17-year-old of North Davis Road, Elma, is charged with criminal impersonation, 2nd, after allegedly identifying himself as another person and using their identification.

Nicholas S. Zabmester, 21, of Fernwood Drive, Lockport, is charged with trespass after allegedly jumping a fence to enter the concert venue after being ejected and told not to return.

Andrew C. Denslow, 42, of Pocono Drive, Austin, Texas, is charged with harassment, 2nd, after allegedly pushing a Live Nation employee while attempting to gain entry to the concert venue.

Kimberly Brodsky, 25, of Bank Street, Batavia, is charged with offering a false instrument for filing, 1st, and grand larceny, 4th. Brodsky is accused of filing a falsified application for assistance with the Department of Social Services in May 2016. Brodsky allegedly received $2,423 in benefits as a result of the falsified application.

Susan Jordon, 54, of State Street, Batavia, was charged with two counts of offering a false instrument for filing, 1st, and grand larceny, 3rd. Jordan is accused of submitting falsified applications to the Department of Social Services in August 2016 and in February (2017). As result, Jordan allegedly received $3,105 in benefits. 

Catherine Spink, 52, Genesee Street, Corfu, is charged with 10 counts of offering a false instrument for filing in the first degree and one count of grand larceny, 3rd. Spink is accused of submitting various forms of falsified documentation to the Department of Social Services between March of 2015 and March of 2017, which resulted in Spink receiving $3,756 in benefits.

Arne H. Zipkin, 69, of Woodcrest Drive, Batavia, is charged with petit larceny. Zipkin is accused of shoplifting from Dick's Sporting Goods. Zipkin allegedly stole $97.99 in merchandise.

Grand Jury Report:

Jason C. Lehnortt is indicted on a count of felony DWI, felony driving with a BAC of .08 or greater, aggravated unlicensed operation in the first degree, and speeding. Lehnortt is accused of driving drunk May 3. He was allegedly drunk while driving his 2006 Subaru on the Thruway over the posted speed limit through Stafford while on a suspended license. He is alleged to have had a prior DWI conviction in January 2008, making the DWI a felony charge with three prior suspensions or revocations still in effect.

A 40-year-old Batavia resident kept Batavia PD at bay for more than an hour this afternoon while he remained locked in his apartment at 4 Miller Ave. following a report of a domestic incident.

Gordon D. Sprague eventually surrendered and was jailed without bail on charges of harassment, 2nd, obstructing governmental administration, 2nd, criminal possession of a weapon, 3rd, and criminal mischief, 4th.

The incident began at 2:48 p.m. with a call to 9-1-1 about a physical domestic on Miller Avenue. As police responded, officers received an update that the male subject was continuing to physically attack the female victim.

Upon arrival, the subject reportedly went into the apartment on Miller Avenue and locked the doors.

Sheriff's Deputies provided backup, including the department's K-9 unit, and a police negotiator attempted to communicate with the suspect.

Sprague, behind locked doors, would not respond to either the negotiator or family members.

Police Chief Shawn Heubusch said at the scene that officers did not believe Sprague was armed or presented a threat, but the street was shut down in "overabundance of caution."

Eventually, Sprague agreed to exit the apartment and he was taken into custody.

He was allegedly found in possession of an illegal switchblade knife. Because of a prior criminal conviction, the weapon's charge was elevated to a felony.

Michael Thomas Coffey Sr., 48, of South Main Street, Albion, is charged with burglary, 2nd. Coffey was arrested following an investigation into a burglary on Batavia-Oakfield Townline Road in 2012. Coffey is already being held in the Genesee County Jail on unrelated charges.

Michelle Ann Hahn, 53, of Gibson Street, Oakfield, is charged with: DWI; driving with a BAC of .08 or greater; failure to keep right; failure to stop at stop sign; and refusal to take breath test. Hahn was stopped at 10:25 p.m. Tuesday on North Pembroke Road, Pembroke, by Deputy Ryan Young.

Dana Ryan, 39, of Galloway Road, Alabama, is charged with two counts of fourth-degree grand larceny. An investigation by the Genesee County Sheriff's Office was initiated after two complaints reported to the Sheriff's Office, one in the Town of Pembroke, the other in the Town of Batavia. The complaints concerned payments which were allegedly made to Ryan by two different customers pursuant to construction contracts for work agreed upon but not completed. It is alleged that the payments to Ryan for home-improvement contracts were not allocated into a proper account and that these funds were used by the defendant for purposes other than the agreed upon work. The time frame of the allegations in the complaints, according to the Sheriff's Office news release, is February 2016 through May (2017). Ryan is due in Town of Pembroke Court on July 11 and in Town of Batavia Court on July 13. The case was investigated by Sheriff's Office Investigator J.M. Graff, assisted by Deputy K.M. McCarthy.

Danny D. Williams Sr., 28, of Pearl Street, Batavia, is charged with criminal possession of a weapon in the third degree, second-degree menacing, and endangering the welfare of a child -- a child less than 17 years old. The charges stem from an incident which occurred at 8:01 p.m. on June 9 on Central Avenue, Batavia. It is alleged that Williams pulled a knife on an individual during an altercation and that there was a child in close proximity at the time. He was jailed in lieu of $15,000 cash bail or $30,000 bond and was due in Batavia City Court on July 7. The case was handled by Batavia Police Officer Chad Richards, assisted by Officer Christopher Lindsay.

Dustin L. Landin, 38, of Sierk Road, Attica, is charged with grand larceny -- value greater than $1,000. Landin was arrested for allegedly stealing money/property from a local business at 8:20 p.m. on June 28 on East Main Street in Batavia. He was issued an appearance ticket for Batavia City Court on July 11. The case was handled by Batavia Police Officer Matthew Wojtaszczyk, assisted by officer Stephen Cronmiller.

Christopher Harris Pompa, 45, of Byron Road, Byron, is charged with DWI, refusal to take breath test, and speeding. At 6:16 p.m. on July 8 on South Lake Road in Bergen,  the defendant was stopped in the Village of Bergen following the observation of an alleged traffic violation. The defendant was arraigned on the charges and then released on his own recognizance. He is due in Bergen Town Court on July 19. The case was handled by Genesee County Sheriff's Deputy Ryan DeLong.

Joseph K. Schlossel, 58, of Linwood Avenue, Batavia, is charged with: moving from lane unsafely; backing unsafely; drinking alcohol in a motor vehicle; and DWI -- first offense. The charges stem from a one-car accident that occurred at 11:45 a.m. on March 11 on Clifton Avenue in Batavia. He was issued tickets and released and is due in City Court July 12. The case was handled by Batavia Police Officer James DeFreze, assisted by Officer Nicole McGinnis.

Salvatore M. Schwable, 19, no permanent address, is charged with failure to appear. He was arrested on a bench warrant out of City Court for failure to appear for a scheduled court appearance and jailed on July 6 in lieu of $2,500 cash bail or bond. He was due back in court on July 7. The case was handled by Batavia Police Officer Chad Richards.

Salvatore M. Schwable, 19, no permanent address, is charged with fourth-degree grand larceny and two counts of petit larceny. The charges stem from an incident at McDonald's on East Main Street in Batavia at 6:33 p.m. on May 12. It is alleged that Schwable took property from three different individuals without their permission. The defendant was jailed without bail and was due back in court on July 7. The case was handled by Batavia Police Officer Chad Richards.

Felicia Dianne Swartenberg, 20, of Willowbrook Road, Brockport, is charged with unlawful possession of marijuana and speeding. At 9:51 p.m. July 8, the defendant was stopped on Waterman Road in the Town of Stafford for an alleged vehicle and traffic violation. The defendant allegedly possessed a quantity of marijuana and drug paraphernalia. Swartzenberg is due in Stafford Town Court on Aug. 1 to answer the charge. The case was handled by Genesee County Sheriff's Deputy Ryan DeLong.

Lindsay Rae Crist, 20, of Redman Road, Brockport, is charged with unlawful possession of marijuana. At 9:51 p.m. July 8, the defendant was a passenger in a vehicle that was stopped on Waterman Road in the Town of Stafford for an alleged vehicle and traffic violation. The defendant allegedly possessed a quantity of marijuana and drug paraphernalia. Crist is due in Stafford Town Court on Aug. 1 to answer the charge. The case was handled by Genesee County Sheriff's Deputy Ryan DeLong.

(name redacted upon request), 19, and (name redacted upon request), 18, both of Pacecrest Court, West Seneca, are charged with unlawful possession of marijuana. At 8:02 p.m. on July 3, the driver, (name redacted upon request), was stopped on Clinton Street Road in the Town of Batavia following the observation of an alleged vehicle and traffic violation. At the time, both (name redacted upon request) and (name redacted upon request) allegedly possessed a quantity of marijuana and drug paraphernalia. The defendants were issued appearance tickets for Town of Batavia Court on July 31. The case was handled by Genesee County Sheriff's Deputy Ryan DeLong and Deputy Michael Lute.

Evan M. Wilson is indicted for the crime of aggravated unlicensed operation in the first degree, a Class A felony. It is alleged that on May 6 in the Town of Le Roy that Wilson drove a 2006 Toyota on Route 19 while knowing, or having reason to know, that he driver's license was suspended, revoked or otherwise withdrawn by authorities. He allegedly had three separate suspensions imposed on at least three separate dates for failure to answer, appear or pay a fine. In addition, Wilson is accused of driving on May 6 while under the influence of alcohol or a drug. In count two, the defendant is accused of the crime of DWI, as a misdemeanor. In count three, he is accused of the offense of unlawful possession of marijuana on the same date. In count four, Wilson is accused of speeding, a traffic offense, for driving in excess of 55 mph. In count five, Wilson is accused of the offense of refusing to submit to a breath test on that date.

Jason M. Guiliani, 38, of Oak Street, Batavia, is charged with criminal possession of a controlled substance, 7th, and criminally using drug paraphernalia, 2nd. Guiliani was charged following a traffic stop at 1:46 p.m. on July 1 on West Main Street in Batavia. Allegedly, a quantity of heroin, cocaine and drug paraphernalia was found in the vehicle and on the defendant. He was issued an appearance ticket for July 3 in City Court. The case was handled by Batavia Police Sgt. Dan Coffey, assisted by Officer Marc Lawrence.

Jason M. Guiliani, 38, of Oak Street, Batavia, is charged with: unlawful possession of personal ID -- used in the commission of a crime; second-degree identity theft -- assuming another person's identity and then committing a felony; and criminal possession of stolen property in the fourth degree -- credit card. Guiliani was located on July 1 after an unrelated traffic stop on West Main Street in Batavia and then arrested after an investigation allegedly revealed he possessed and used a stolen credit card on Dec. 24 on West Main Street. He was jailed in lieu of $10,000 bail -- cash or bond. Guiliani is due in court at a later date. The case was handled by Batavia Police Officer Marc Lawrence, assisted by Sgt. Dan Coffey.

Christopher Scott E. Knox, 23, of Old Pike Road, Fitzpatrick, Ala., is charged with: DWI -- common law; DWI -- with a BAC of .08 percent or more; speeding; and refusal to take a prescreening breath test. At about 12:27 a.m. on June 29, Batavia police conducted a traffic stop on Oak Street of a Subaru for an alleged speed violation. Investigation resulted in Knox being arrested for DWI. He was due in City Court on July 5. The case was handled by Batavia Police Officer Arick Perkins, assisted by Officer Felicia DeGroot.

Michael L. Williams, 37, of 332 W. Main St., Room #3, Batavia, is charged with first-degree aggravated criminal contempt. At 3:15 p.m. on June 27, Williams allegedly violated an order of protection by having contact with the protected party on Highland Park, Batavia. Since Willams has a prior conviction within the previous five years for first-degree criminal contempt, he was arrested and charged with the June 27 crime cited. He was jailed without bail. The case was handled by Batavia Police Officer Frank Klimjack.

Eddie L. Miles Jr., 45, of Washington Avenue, Batavia, is charged with second-degree criminal contempt, fourth-degree grand larceny, and unauthorized use of a motor vehicle in the second degree. The defendant was arrested on a warrant out of City Court. The charges stem from an incident at 2:46 a.m. on May 18 wherein he allegedly took a car belonging to another individual without that person's permission. He was jailed in lieu of $2,500 cash bail or $5,000 bond and was due back in court today (July 6). The case was handled by Batavia Police Officer Chad Richards, assisted by Officer Christopher Camp.

Christopher J. Draper, 46, of West Main Street Road, Batavia, is charged with trespass. Draper was arrested at 5:55 p.m. on July 1 on West Main Street Road after he allegedly entered a business from which he had previously been banned. He is due in City Court on July 11 to answer the charge. The case was handled by Batavia Police Officer Christopher Lindsay, assisted by Officer Mitchell Cowen. 

Christopher J. Draper, 46, of West Main Street Road, Batavia, is charged with third-degree burglary and second-degree criminal contempt following a trespass complaint on July 1. Draper was allegedly in violation of a court order after being told to stay away from the Rite Aid on West Main Street in Batavia on several occasions. At 1 p.m. on July 5, he was jailed on $10,000 cash bail or $20,000 bond. He is due in court at a later date. The case was handled by Batavia Police Officer Andrew Hale, assisted by Officer Kevin McCarthy.

A 17-year-old in the city was arrested on Garfield Avenue at 8:28 p.m. on June 27. Patrols were dispatched to Jackson Street for a disturbance. After an investigation, the defendant was located on Garfield Avenue and arrested. The teen is charged with criminal mischief -- intentional damage of property, and is due in City Court on July 11. The case was handled by Batavia Police Officer Nicole McGinnis, assisted by Officer Matthew Wojtaszczyk.

Kim L. Minuto, 56, of Clinton Street Road, Batavia, is charged with petit larceny. Minuto was arrested at 10:30 a.m. on July 5 at Tops Market in Batavia and issued an appearance ticket for July 18 in City Court. The case was handled by Batavia Police Officer Eric Bolles.

Oliver Thomas, 25, entered a guilty plea to attempted burglary in the second-degree on Thursday morning and could face up to seven years in prison as a second felony offender.

Thomas was part of the attack that occurred around 11 p.m. on Oct. 28 at an upper apartment on Central Avenue, involving several people and resulting in the hospitalization of two individuals.

He also pleaded guilty to failure to register change of address as a registered sex offender. Thomas was convicted of rape in 2009 and was required to register as a Level 2 sex offender when he was released from prison.

Thomas was the last of the four men accused of the attack, who was taken into custody after police had been looking for him for five months.

Also charged were Daniel Gilbert, Adante Davis and Marquis Saddler.

Gilbert received a four-year prison term. Davis five years, and Saddler five years.

Thomas will be held without bail until his sentencing at 1:30 p.m. on Aug. 4.

Isaac C. King is indicted for the crime of criminal possession of a controlled substance in the fifth degree, a Class D felony. It is alleged that on Jan. 9 in the City of Batavia that King knowingly and unlawfully possessed a controlled substance, Suboxone, with intent to sell it. In count two, King is accused of the crime of criminal possession of a controlled substance in the seventh degree. It is alleged in count two that on the same day, the defendant knowingly and unlawfully possessed a controlled substance, Suboxone. In count three, King is accused of unlicensed operation in the third degree, a misdemeanor. It is alleged in count three, that on the same day, King drove a 2017 Nissan on Swan Street while knowing, or having reason to know, that his driver's license was suspended or revoked by authorities.

Darrel T. Wilder is indicted for the crime of driving while intoxicated, per se, as a Class E felony. It is alleged that on April 29 in the Town of Stafford that Wilder drove a 2001 Jeep Grand Cherokee on Route 33 while he had a BAC of .08 percent or more as shown by a chemical analysis of his breath. In count two, he is accused of DWI as a Class E felony for allegedly driving on the same day on the same road while intoxicated. In count three, Wilder is accused of aggravated unlicensed operation in the first degree, a Class E felony. It is alleged in count three that the defendant drove on that day on that road while knowing, or having reason to know, that his driver's license was suspended revoked or otherwise withdrawn by authorities and that he did so while under the influence of alcohol or a drug. In count four, Wilder is accused of the crime of circumvention of an ignition interlock device, a Class A misdemeanor. It is alleged in count four that the defendant, while subject to a court-ordered ignition interlock device, operated a vehicle that was not equipped with this device.

George J. Budzinack is indicted for the crime of aggravated unlicensed operation in the first degree, a Class E felony. It is alleged that on March 14 in the Town of Stafford that Budzinack operated a 2001 Chevrolet Venture van on Route 33 while knowing, or having reason to know, that his driver's license was suspended, revoked or otherwise withdrawn by authorities. It is also alleged that the defendant was operating the vehicle while under the influence of alcohol or a drug. In count two, Budzinack is accused of driving while intoxicated, as a misdemeanor. In Special Information filed by District Attorney Lawrence Friedman, the defendant is accused of having been convicted of DWI on March 3, 2004, in Genesee County Court. The document states the defendant knew, or had reason to know, that his driving privilege was suspended or revoked as a result of the conviction and that the revocation or suspension was still in effect at the time of the crimes alleged in the indictment.

Bryan D. Bates Jr., 37, of West Main Street, Batavia, is charged with criminal contempt, 2nd, and Andrea Gray, 39, of Lake Street, Le Roy, is charged with falsely reporting an incident, 3rd. The charges stem from a domestic disturbance July 1 at a residence on Lake Street, Le Roy. Bates was allegedly violating a stay away order issued out of Batavia City Court. He was jailed in lieu of an unspecified amount of bail. Gray allegedly falsely reported to a neighbor that Bates had committed suicide, causing the neighbor to call 9-1-1. Gray was also jailed on an unspecified amount of bail.

Kevin William Dart, 59, of Transit Road, Elba, is charged with unlawfully dealing with a child. Dart allegedly allowed people under age 21 to consume alcohol during a party at his house.

Todd Alan Kendall, 54, of Main Road, Stafford, is charged with harassment, 2nd. Kendall allegedly struck another person in an incident reported at 5:56 a.m. Monday at a location on Main Road, Stafford.

Susan Ann Minardo, 28, of Shelby Road, Kings Mountain, N.C., was arrested as a fugitive from justice. During an investigation by Deputy Chad Cummings of a call at the TA Travel Center in Pembroke, Minardo was located and identified as the subject of a warrant out of Pennsylvania. Minardo was jailed without bail.

Christopher James Draper, 46, of West Main Street, Batavia, is charged with trespass. Draper allegedly entered Rite Aid on West Main Street Road, Batavia, after being previously advised he was not allowed on the property.

Douglas James Tallent, 36, of Walworth-Marion Road, Marion, is charged with felony DWI, felony driving with a BAC of .08 or greater, aggravated unlicensed operation, driving on a suspended registration, and consumption of alcohol in a motor vehicle. Tallent was stopped at 9:40 p.m., June 24, on Buffalo Parkway, Bergen, by Deputy Rachel Diehl and jailed without bail.

Cathleen Ann Bishop, 51, of West Main Street, Batavia, is charged with petit larceny. Bishop is accused of stealing $145.99 in merchandise from Kohl's Department Store on June 30.
