It started last weekend, Assemblyman Steve Hawley says he was out mowing his lawn when he noticed his flag, which was at half-mast in honor of those who lost their lives in Afghanistan, was missing. Hawley says the flag was stolen sometime last Saturday, Aug. 28.

On his Facebook page, Hawley asked for his flag's return. "Please return it, no questions asked. This is a time for respecting our country and what it stands for," Hawley wrote.

Since then, Hawley says a neighbor from down the road replaced his flag with a new one, also installing a light to the display. 

However, on Saturday morning State Police were called to another residence in the 8000 block of Bank Street Road in the Town of Batavia for another flag theft. The homeowner there said his flag was stolen sometime between 9:30 Friday evening and 6:30 a.m. on Saturday. His flag was also displayed on a pole. 

Hawley said his replacement flag was also stolen in the overnight hours, Sep. 3 into Sep. 4.

State Police are now investigating the incidents and have a few leads. The City of Batavia Police have also looked into several complaints in the area recently.

Hannah Rose Roberts, 18, of Ontario Street, Fulton, and Talana Jay Savery, 22, of Emery Street, Fulton, are charged with trespass. Roberts and Savery are accused of being on property on Bethany Center Road, Bethany, at 4:49 a.m., Aug. 29, without permission.  Both were issued an appearance ticket.

Breeda Marry Kobler, 57, of Hutchins Raod, Rochester, is charged with DWI and refusal to take breath test.  Breeda was stopped at 5:56 p.m., Wednesday, on North Lake Road, Bergen, by Deputy Kenneth Quackenbush.

About 45 minutes ago, a pickup truck reportedly fled from police in the area of Cleveland Road in the Town of Batavia leading to a high-speed chase through Downtown Batavia and ending on East Main Street in the area of Blondie's.

No accident was reported though a spike strip was reportedly deployed at one point along Route 5.

On September 2, 2021, Troopers out of SP Newstead arrested Anthony T. Drake, 25 of Hornell, NY for Reckless Endangerment 1st degree (D Felony), Criminal Possession of a Weapon 4th degree, Criminal Possession of a Controlled Substance 7th degree and multiple traffic tickets.  The passenger in the vehicle, Brittany N. Howland, 27 of Hornell, NY was arrested for Criminal Possession of a Controlled Substance 7th degree and Violation of Probation.

On September 2, 2021, at 6:42 P.M., Troopers out of SP Newstead attempted to make a vehicle and traffic stop on a 2011 Chevrolet Silverado at the intersection of Crittenden Road and Main Street in the town of Newstead.  The Chevrolet failed to comply once the Trooper activated emergency lights.  The pursuit was initiated and the suspect vehicle continued eastbound on State Route 5 (Main Street) into Genesee County.  During the pursuit, the suspect vehicle swerved toward a Genesee County Sheriffs Department patrol traveling westbound on State Route 5.  The pursuit was picked up by Batavia Police Department and they deployed a tire deflating device, disabled the suspect’s vehicle.  Troopers arrested Drake and Howland.  Drake was in possession of brass knuckles and crystal meth and other drugs.

A 36-year-old Batavia woman is facing federal wire fraud charges after she was allegedly found with six state unemployment benefit cards during a traffic stop and subsequent vehicle search for drugs in Bergen on Nov. 24.

The U.S. Attorney's Office announced the arrest today of Danielle Tooley.  She faces a maximum penalty of 30 years in jail and a $1 million fine.

Tooley is accused of knowingly using the personal identifying information of other people to apply for and collect unemployment benefits connected with the federal COVID-19 relief programs.

The scheme came to the attention of law enforcement on Nov. 24 when Tooley was arrested by the New York State Police on charges of criminal possession of a controlled substance during a vehicle traffic stop in Bergen.

During the interaction with the defendant, troopers observed a crack pipe with white residue inside of Tooley’s vehicle.

After the arrest, the defendant’s vehicle was searched, and six New York State unemployment benefit cards were recovered.

The benefit cards were issued to individuals other than Tooley. The benefit cards were turned over to the Buffalo Field Office of the U.S. Department of Labor, Office of Inspector General, for further investigation.  A subsequent examination of bank records for the benefit cards revealed several indicators of fraud and video footage from ATMs where the cards were used confirmed that the defendant had consistently withdrawn money from the cards. Tooley routinely used the personal identifying information of others in order to apply for and collect unemployment benefits in their names. In total, the scheme resulted in a loss of at least $99,141.39 to the United States.  

The defendant made an initial appearance before U.S. Magistrate Judge Mark W. Pedersen and was released on conditions.

The criminal complaint is the result of an investigation by the U.S. Department of Labor, Office of Inspector General, Office of Investigations – Labor Racketeering and Fraud, New York Region, under the direction of Special Agent-in-Charge Jonathan Mellone; the Department of Homeland Security, Office of Inspector General, under the direction of Acting Special Agent-in-Charge Todd Allen; the U.S. Secret Service, under the direction of Special Agent-in-Charge Jeffrey Burr; the Social Security Administration, Office of Inspector General, under the direction of Special Agent-in-Charge John F. Grasso; and the New York State Police, under the direction of Major Barry Chase.  

Jomaine D. Johnson, 38, of Lozier Street, Rochester, is charged with grand larceny 4th. Johnson is accused of finding and keeping a Samsun Galaxy S20 smartphone at Batavia Downs on July 8.  He allegedly pawned the phone the next day in Gates. He was issued an appearance ticket.

Delton Barrington Paul, 29, of Alleghany Road, Darien, is charged with petit larceny.  Paul is accused of stealing merchandise from Walmart in Batavia at 10:19 p.m, Tuesday.  He was released on an appearance ticket.

Lamar Torrain Gaynor, 23, of Alleghany Road, Darien, is charged with petit larceny.  Gaynor is accused of stealing merchandise from Walmart in Batavia at 10:19 p.m, Tuesday.  He was released on an appearance ticket.

Wesley N. Thigpen, 40, of Batavia, is charged with two counts of predatory sexual assault against a child following a sex abuse investigation by Det. Jason Ivinson. Thigpen is accused of a continuous course of conduct where he sexually abused two children while they were under age 13 in the City of Batavia between 2007 and 2016. Thigpen was arraigned in City Court and ordered held without bail. (Thigpen is currently in state prison serving a sentence on prior sexual abuse charges. Mugshot is from 2019.)

Nathan W. Stringer, 46, of West Linden Avenue, East Rochester, is charged with DWI, DWI with children in the vehicle (Leandra's Law), breath test refusal, moved from lane unsafely, and unlicensed operator.   At 9:28 p.m., Aug. 28, deputies responded to 8483 Alleghany Raod, Pembroke, for a report of a vehicle accident and a vehicle in a ditch.  Stringer was reportedly operating the vehicle and allegedly found to be intoxicated. There were four children in the car, all under age 15. Stringer was issued an appearance ticket.

Norman James Humel, 62, of Sumner Road, Darien, is charged with DWI, driving with a BAC of .08 or greater, unreasonable speed, moved from lane unsafely, failure to keep right, and refusal to take breath test. Humel was arrested following an investigation into a motor vehicle accident at 5:22 p.m., July 19, on Read Road in Pembroke by Deputy Kyle Krzemien. Humel was released on an appearance ticket.

Zachary S. Natale, 28, of Beacon, is charged with grand larceny 4th and burglary 2nd. Natale was charged with a burglary on Elm Street in May 2017.  He is currently in prison at Fishkill Correctional Facility on unrelated charges. He was ordered held without bail.

Joseph D. Turner, 39, of Albion, is charged with harassment. Turner was arrested on a warrant. He was arraigned in City Court and released on his own recognizance.

Eric P. Doleman, 51, of Pembroke, is charged with petit larceny and criminal possession of a forged instrument 1st. Doleman is accused of knowingly using a counterfeit $100 bill at a local business. Doleman was arraigned in City Court and ordered held without bail.

Rhonda L. Reisman, 49, of Batavia, is charged with criminal contempt 2nd. Reisman allegedly failed to comply with a court order. She was issued an appearance ticket.

Brian P. Griffin, 36, of Batavia, is charged with criminal obstruction of breathing, attempted assault 3rd, and endangering the welfare of a child. Griffin is accused of getting into a physical dispute with a juvenile on Ellicott Place at 4 p.m., Aug. 18. Several other children were allegedly in close proximity to the incident. Griffin was arraigned in City Court and ordered held on $2,500 bail, $5,000 bond, or $10,000 partially secured bond.

Alyssa J. McKenzie, 23, of Batavia, is charged with harassment 2nd. McKenzie is accused of punching another person in the face on Aug. 23. She was issued an appearance ticket.

Andre L. Bryan, 42, of Batavia, is charged with harassment 2nd. Bryan is accused of striking a Batavia police officer in the face during an incident on Aug. 24 on East Avenue. He was issued an appearance ticket.

Michael J. Robbins, 61, of Batavia, is charged with petit larceny and criminal possession of a controlled substance. Robbins was allegedly found in possession of stolen property after an investigation into a larceny on East Main Street, Batavia.  He was issued an appearance ticket.

Danielle R. Tooley, 36, of Batavia, is charged with bail jumping 2nd. She was arrested by State Police and released on her own recognizance. 

Abigail E. Button, 26, of Charlotte, N.C., is charged with assault 3rd and criminal mischief 4th. Button was arrested by State Police at 10:51 p.m., Aug. 28 in the Town of Batavia. No details of the incident were released. She was issued an appearance ticket.

Tzepheniah R. Maccabees, 21, of Buffalo, is charged with DWI.  Maccabees was stopped by State Police at 5:20 a.m., Aug. 22, in the Town of Batavia. He was issued an appearance ticket.

Shawnika D. Spears, 34, of Buffalo, is charged with identity theft 3rd. Spears was arrested by State Police at 2:21 p.m., Aug. 13, in the Town of Alabama. She was issued an appearance ticket.

Valerie L. Marucci, 42 of Attica pled guilty to one count of Disorderly Conduct and was sentenced to a one-year conditional discharge in Batavia Town Court on August 24, 2021.

Marucci was originally charged with two counts of Offering a False Instrument for Filing and one count of Grand Larceny 4^th after an investigation by Genesee County Department of Social Services Investigator Robert Riggi revealed that she failed to report income.  She subsequently received $2725 in SNAP benefits she was not entitled to.

In addition to the reduced charges and conditional discharge, Marucci was also disqualified from receiving SNAP benefits for one year and she has made full restitution to the Department of Social Services.

Randy J. Dumbleton Jr., 38, of Rochester, is charged with felony attempted assault 1st, assault 2nd, criminal possession of a weapon 3rd, and obstructing governmental administration. Dumbleton is accused of being involved in an incident on Lake Street, Le Roy, on July 22. On that date, Le Roy police officers were dispatched to a reported stabbing. Upon arrival, police located a female victim who had been stabbed twice in the arm with a pointed weapon and suffered a glancing scrape in the abdominal area.  During the investigation, Dumbleton was identified as the alleged suspect and was located nearby and taken into custody after trying to hide in a nearby wooded area.  Dumbleton was arraigned in Le Roy Town Court and ordered held in lieu of bail. Dumbleton was also referred to the NYS Division of Parole for an alleged parole violation.

Antonio Santiago, Jr., 43, of Ferndale Crescent, Rochester, is charged with harassment 2nd. Santiago allegedly punched and pushed a companion while at Darien Lake Theme Park at 5:55 p.m., Aug. 24.  He was arraigned in Town of Pembroke Court and released.

Andrea Ilene Kinnaird, 48, of Penn Mills Avenue, Weston Mills, is charged with attempted grand larceny and grand larceny 4th.  Kinnaird was arrested at 2:08 p.m., Aug. 24, at Darien Lake Theme Park by deputies Jonathan Dimming and Eric Meyer. No details of the alleged crime were released. Kinnaird was arraigned in Town of Darien Court and released on her own recognizance.

Antonio Santiago, 43, of Ferndale Cresent, Rochester, is charged with reckless endangerment 2nd and attempted assault 2nd. Santiago is accused of spitting in the face of a deputy who was attempting to obtain information from Santiago during a complaint at Darien Lake Theme Park at 5:56 p.m., Aug. 24. Santiago was arraigned in Town of Pembroke Court and processed at the Genesee County Jail.

Trina Grimmer, 50, of Byron, pled guilty to one count of petit larceny and was sentenced to a one-year conditional discharge in Batavia Town Court on August 17, 2021.

Grimmer was originally charged with six counts of Offering a False Instrument for Filing 1st and one count of Grand Larceny 3rd after an investigation by Genesee County Department of Social Services Investigator Dakota Nicholson revealed that she failed to report that her son and his father were also residing in the home.  Grimmer subsequently received $8104.00 in SNAP benefits she was not entitled to.

Thomas Tacito, 61, of North Spruce Street, Batavia, is charged with six counts of failure to appear. Tacito was arrested on six bench warrants for allegedly failing to appear for court dates when previously arrested on appearance tickets.  He was arraigned and released on his own recognizance.

Cassandra Smith, 35, of Main Street, Piffard, is charged with cemetery desecration.  At 10:25 a.m., Aug. 17 police officers were dispatched for a report of a suspicious female in the St. Joseph Cemetery.  It appeared that she was taking items from gravesites. Police located Smith and her vehicle in the cemetery. She allegedly stole numerous items including statues, planters, and flags from gravesites in the cemetery. She was released on an appearance ticket.

Jeremiah Williams, 30, of Oak Street, Batavia, is charged with sex offender/failure to verify address. Batavia police officers responded to the Super 8 Motel in an attempt to locate Williams on multiple warrants, including a harassment 2nd warrant. Williams was located and taken into custody. Williams was arraigned in City Court.  His custody status was not reported.

Rosemary Waters, 35, of East Main Street, Batavia, is charged with failure to appear. Waters was arrested on a warrant following a police investigation into a suspicious condition at a business on Oak Street.  Waters was arraigned in City Court. Her custody status was not reported.

Germayne Session, 27, of Gardiener Street, Rochester, is charged with criminal mischief 4th and three counts endangering the welfare of a child. On July 27, Gardiener allegedly punched the windshield of a van belonging to another person causing it to shatter.  There were three children in the van. Gardiener was issued an appearance ticket.

Tyler Gorski, 19, of Bank Street, Batavia, is charged with criminal obstruction of breathing, unlawful imprisonment, and harassment.  Gorski was allegedly involved in a disturbance on Bank Street at 8:18 p.m., Aug. 13.  He was arraigned in City Court and released on his own recognizance.

Drew Fortes-Crimes, 23, of Ellicott Street, Batavia, is charged with criminal mischief 3rd and harassment 2nd. During an incident on Harvester Avenue on Aug. 14, Fortes-Crimes allegedly damaged property and subjected the victim to unwanted physical contact. He was issued an appearance ticket.

Jordin Schultz, 23, of State Street, Batavia, is charged with criminal obstruction of breathing, criminal mischief 4th, and harassment 2nd. Schultz allegedly slapped another person, grabbed that person by the neck, and took that person's phone in an attempt to prevent the person from calling 9-1-1 during an incident reported at 10 p.m., Aug. 13.  Schultz was arraigned in City Court and released.

Tarah Mruczek, 34, of Tracy Avenue, Batavia, is charged with harassment 2nd. Mruczek allegedly struck another person during an argument on Aug. 15.  She was arraigned in City Court and released.

Mark Farley, 53, of Oak Street, Batavia, is charged with criminal contempt. Farley is accused of violating an order of protection. He was jailed on $2,500 cash bail, $5,000 bond, or $10,000 partially secured bond.

Michael Quinn Keaney, 38, of Batavia, is charged with DWI and driving with a BAC of .08 or greater. Keaney was stopped at 12:03 a.m., Aug. 21, on Alexander Road, Alexander, by Deputy Trevor Sherwood.

Kyle Allen Hawley, 31, of Spring Street, Bergen, is charged with endangering the welfare of a child. Hawley allegedly overdosed on a narcotic analgesic while in a presence of a child less than 17 years old. Hawley was administered narcan by emergency responders and transported to an area hospital.  He was issued an appearance ticket.

Gabriel Otis Houlihan, 19, of North Angling Road, Pembroke, is chargerd with DWI, driving with a BAC 0f .08 or greater, and moving from lane unsafely.  Johnston was arrested on Thursday in connection with an allegation that on July 18 at 5:35 a.m. he was driving drunk while on Peral Street Road, Batavia.  The arresting officer is Deputy Zachary Hoy.

Richard Andrew Auguliaro, 53, of Mumford, is charged with grand larceny 4th.  On Aug. 15, the Sheriff's Office received a report of a wallet, containing a debit card, stolen from a location in Le Roy. Auguliaro was arrested and charged following an investigation by Deputy Robert Henning and Investigator Ryan DeLong.  He was released on an appearance ticket.

Michael Wesley Flint, 22, of Spring Street, Mount Morris, is charged with criminal possession of a controlled substance 7th. Flint was allegedly found in possession of heroin at the time of his arrest on a violation of probation warrant.  Flint was issued an appearance ticket and then turned over to the Livingston County Sheriff's Office on the warrant.

Corey Amber Knapp, 19, of North Street, Medina, is charged with two counts of criminal possession of a controlled substance 7th. Following a traffic stop at 7;23 p.m., Jan. 1, by Deputy Jacob Gauthier, Knapp, who was a back seat passenger, was allegedly found in possession of fentanyl and cocaine.

Charles M. Jackson is indicted on counts of menacing a police officer, criminal possession of a weapon in the second degree, criminal possession of a weapon in the third degree, four counts of reckless endangerment in the first degree, three counts of obstructing governmental administration in the second degree, two counts unlawful fleeing a police officer in a motor vehicle in the third degree, two counts of reckless driving, and criminal possession of a forged instrument in the second degree.  Jackson is accused of attempting to place, or place, a police officer in reasonable fear of physical injury or death by displaying a deadly weapon on March 21. He is accused of placing others in grave danger with depraved indifference to human life. He is accused of struggling with a police officer over a firearm placing others in danger. He is accused of placing others in danger by fleeing from a police officer in a motor vehicle and by ramming into two Genesee County patrol cars. He is accused of obstructing police officers from performing their official duties by fleeing. He is accused of possessing a forged Ohio State Driver's License.

James J. Santiago, Jr. is indicted on counts of criminal possession of a weapon in the third degree, attempted assault in the third degree, menacing in the second degree, and trespass. On May 3, Santiago allegedly possessed a knife while on Washington Avenue, Batavia, with the intent to use it against another person and that he intended to cause physical injury to another person. He is accused of threatening a person with the knife. He is also accused of entering the dwelling of another person without permission and remaining there.

Daniel J. Wolfe is indicted on counts of burglary in the second degree and two counts of criminal contempt in the second degree. Wolfe is accused of entering a dwelling with the intent of committing a crime and of violating an order of protection in the process.

Edwin L. Stancliff is indicted on counts of felony driving while intoxicated, felony driving with a BAC of .08 or greater, and criminal mischief in the third degree. Stancliff is accused of driving a 2004 Chevrolet Trailblazer while intoxicated on Feb. 14 in the Town of Batavia.   He is accused of intentionally damaging a glass door at State Police Troop A headquarters.

Wayne D. Potter is indicted on counts of criminal possession of a weapon in the third degree, menacing in the second degree, and assault in the second degree. On Jan. 11, at 111 Liberty St. Batavia, Potter allegedly held a knife with the intent to use it against another person. He is also accused of placing or attempting to place another person in fear of physical injury or death. On Feb. 16, Potter allegedly assaulted a person while in the Genesee County Jail.

James T. Saddler, III, is indicted on counts of assault in the second degree, criminal possession of a weapon third, and two counts of harassment in the second degree. On June 24, in the Town of Batavia, Saddler allegedly used a tire iron to injury another person.  He is also accused of shoving and kicking another person.

Two people from Rochester were arrested in the City of Batavia on suspicion of selling crack cocaine, powder cocaine, fentanyl, suboxone, and amphetamines.

Germayne D."Case" Session, 27, of Carl Street, is charged with six counts criminal possession of a controlled substance 3rd, three counts of criminal sale of a controlled substance 3rd, two counts of criminal possession of a controlled substance 5th, and two counts of criminally using drug paraphernalia 2nd.

Sylvia Perez, 60, of Carl Street, is charged with four counts of criminal possession of a controlled substance 3rd, criminal sale of a controlled substance 3rd, two counts of criminal possession of a controlled substance 5th, criminal possession of a weapon 3rd, and two counts of criminally using drug paraphernalia 2nd.

Members of the Local Drug Task Force made controlled purchases of suspected narcotics from Session and Perez. As a result, a search warrant was obtained and executed yesterday at a location not disclosed by the Sheriff's Office.  

Besides the drugs, investigators also reportedly found a digital scale and packaging material.  Perez was also allegedly found in possession of a stun gun.

The defendants were arraigned in City Court on the charges.  Bail was set for Session of $10,000 cash or $20,000 bond.  Session was also held in the Genesee County Jail on a parole warrant.  Perez was released under supervision of Genesee Justice.

The Task Force was assisted by Batavia PD, Sheriff's deputies, NYS Parole, and the District Attorney's Office.

Bryan Lewis Fitts, 32, of Chestnut Ridge, Gasport, is charged with criminal possession of narcotics with intent to sell and two counts of criminal possession of a controlled substance with intent to sell. Fitts was allegedly found in possession of a sufficient amount of narcotics and controlled substances to suggest he intended to sell the illicit drugs after being ejected from the Luke Bryan concert at Darien Lake at 9:23 p.m., Saturday.  Deputy Jeremy McClellan reportedly spotted baggies of drugs hanging out of his socks.  He was arraigned in Town of Pembroke Court and released.

Aaron J. McFollins, 42, of North Spruce Street, Batavia, is charged with assault 3rd. At 1:18 a.m., June 4, McFollins is accused of throwing a chair at a woman causing an injury.  He was arraigned in City Court and released on his own recognizance.

Larry Kennedy, 43, of Eastbrooke Lane, Greece, is charged with felony DWI, unlicensed operation, driving outside restrictions, driving without an ignition interlock device, and aggravated unlicensed operation. Kennedy was arrested by Batavia PD following an investigation into a suspicious condition at an undisclosed location on Aug. 8. He was released on his own recognizance.

Matthew Oppel, 34, of East Main Street, Batavia, is charged with driving while impaired by drugs, driving while using a portable electronic device, running a red light, and failure to keep right. Oppel on July 31 for an alleged incident at 7:37 p.m., March 20. Oppel was reportedly involved in a property damage accident on Main Street, Batavia. Following an investigation, Oppel was accused of driving while under the influence of drugs at the time of the accident.  He was issued an appearance ticket.

Laura R. Mroz, 32, of Chandler Avenue, Batavia, is charged with harassment 2nd. Mroz is accused of pushing another person on Aug. 7 at an undisclosed location.  Morz was issued an appearance ticket.

John K. Hobbs, 33, of Clinton Street Road, Batavia, is charged with menacing 3rd.  Hobbs allegedly threatened a woman and put her in fear of physical injury during an incident reported at 6 a.m., Aug. 13.  Hobbs was released on his own recognizance.

William G. Horner, 70, of Batavia, is charged with assault with intent to cause physical injury with a weapon, and Wendy L. Henry, 36, of Batavia, is charged with assault 2nd/injuring victim 65 or older.  Horner and Henry were arrested by State Police in connection with an incident reported at 8:39 a.m., Aug. 11, in the Town of Batavia. No further information was released. Horner was ordered held in jail and Henry was released on her own recognizance.

Parker-Sharkey, 28, of Rochester, is charged with criminal impersonation, criminal possession of a controlled substance 7th, and driving with a suspended registration. Parker-Sharkey was arrested by a trooper in connection with an incident at 3:20 p.m., Aug. 12.  No further information was released.  She was released on an appearance ticket.

Tyler J. Gasiorek, 27, of Cheektowaga, is charged with DWI and driving with a BAC of .08 or greater. Gasiorek was stopped at 3:47 p.m., Saturday, in Bergen by a state trooper. He was released on an appearance ticket.

Patrick J. Reiner, 49, of Corfu, is charged with felony DWI and felony driving with a BAC of .08 or greater. Reiner was stopped by a trooper at 12:01, Sunday, in the Town of Pembroke. He was released on an appearance ticket.

David B. Kenjockety, 44, of Lockport, is charged with DWI and driving with a BAC of .08 or greater. Kenjockety was stopped by a trooper at 8:50 p.m., Aug. 13, in the Town of Darien. He was released on an appearance ticket.

Deborah M. Kreienberg, 62, of Pittsford, is charged with felony DWI and driving with a BAC of .08 or greater. Kreienberg was stopped by a trooper at 2:19 p.m., Aug. 13, in the Town of Bergen. She was released on an appearance ticket.

Pamela Lynn Palaszynski, 35, of Bank Street Road, Elba, is charged with felony DWI, driving with a felony BAC of .08 or greater, moving from lane unsafely, and speed not reasonable and prudent.  Palaszynski was arrested by Deputy Trevor Sherwood following a car-into-house complaint at 11:59 p.m., Aug. 7.  Palaszynski was released on an appearance ticket.

Teresa Marie Stephenson, 31, of Cedar Street, Batavia, is charged with DWI and driving with a BAC of .08 or greater. Stephenson was arrested by Deputy Trevor Sherwood at 2:54 a.m., Aug. 6, on Bethany Center Road, Bethany, for allegedly driving drunk.  She was released on an appearance ticket.

Keith Alan Stevens, 63, of Forest Edge Drive, Batavia, is charged with failure to report a change of address within 10 days as a registered sex offender. Stevens was released on an appearance ticket.

Lyndsay Taylor Young, 38, of State Street, Batavia, is charged with petit larceny. Young is accused of stealing $206.03 in merchandise from Walmart at 4:04 p.m., Thursday.  She was released on an appearance ticket.

Ray Spencer-Lindquist Saile, 19, of Judge Road, Tonawanda Indian Reservation, is charged with criminal contempt 2nd. Saile is accused of violating a stay-away order after being found with the protected party at the protected party's house.  Saile was arraigned in Town of Alabama Court and ordered held on $2,500 cash bail.

A Utility Terrain Vehicle was spotted by a Sheriff's patrol at 1:34 a.m., July 31, on Route 33, in the area of Seven Springs Road, in the Town of Batavia and when the deputy attempted to initiate a traffic stop, the driver failed to stop.

According to the Sheriff's Office, the drive took the UTV into harvestable crops causing significant damage to the crops and to fencing in the area.

The Sheriff's Office is asking for the public's assistance in identifying and locating the UTV.

The UTV is described as white in color and affixed with lights that change colors while in operation.

Batavia PD received an anonymous tip that led to the recovery of some of the decorated stones and shells that were stolen from the Batavia Peace Garden a couple of weeks ago, according to Chief Shawn Heubusch.

The officers who recovered the stones and shells returned them to the Peace Garden.

Peace Garden founder and director Paula Savage confirmed that the stones and shells returned were from the Peace Garden.

Now is the time of year that many homeowners are having their driveways paved or repaired, and the Genesee County Sheriff’s Office would like to remind residents that if anyone comes to your door offering to pave your driveway, you should be very cautious of a scam.  Most towns in the county require a permit to solicit door to door.  If a contractor comes to your house offering to do work, they need to possess a permit from the respected town that indicates the town has approved them as a legitimate contractor.  If a blacktop contractor offers to do work at a price that is too good to be true, it probably is, and you should be very cautious.  These scam blacktop contractors tend to be very persistent and will later try to get you to pay more money than what was originally agreed upon.  As soon as you see any suspicious soliciting or work being done in your area, please call 9-1-1.
