A Wyoming County man is facing multiple felonies, some stemming from an accusation that he stole a rifle and vehicle keys of an employee of a local business, as well as a chase by law enforcement from Pembroke to the neighboring county.

Duane R. Hamill, 65, of Warsaw, is charged with:

• Burglary 3rd
• Grand larceny 3rd
• Robbery 2nd
• Robbery 3rd,
• Criminal possession of a weapon 3rd, and
• Menacing 2nd.

The incident began with a call sometime on Saturday (the time of call is not provided in the Sheriff's Office release) about a burglary that had occurred at an unidentified business in Pembroke.

Dispatchers were informed that an employee of the business was following the suspect. 

Once in the Town of Darien, Hamill and the employee reportedly got into a physical altercation and Hamill allegedly robbed the employee of a rifle and his vehicle keys. 

Hamill fled the scene and continued south in Wyoming County.  Deputies in Wyoming County located Hamill in his vehicle and initiated a pursuit.  He was eventually taken into custody and turned over to the Genesee County Sheriff's Office.

He was arraigned in Town of Pembroke Court on the robbery and weapons charges and in the Town of Pembroke Court on the remaining charges.  He was released under supervision of Genesee Justice.

The investigation was conducted by Investigator Kevin Forsyth, Investigator Erik Andre, Sgt. Michael Lute, Deputy Kevin McCarthy, Deputy Ryan Young, Deputy Ryan Mullen, and Deputy Alexander Hadsall.

Tara Lyn Robinson, 29, of Genesee Street, Pembroke, is charged with unlawful possession of a noxious material. Robinson is accused of using pepper spray on another person without proper justification during an incident reported at 10:36 a.m., Feb. 10, at a location on Genesee Street, Pembroke. Robinson was arraigned in Town of Pembroke Court and released on her own recognizance.

Matthew J. Sanchez-Sanquiche, 25, of Batavia, is charged with Burglary 2nd, robbery 3rd, criminal contempt 1st, and criminal contempt 2nd. Sanchez-Sanquiche allegedly violated an order of protection at 3:59 p.m., Jan. 20, at a location on North Spruce Street, Batavia, by striking a person multiple times in the cause causing an injury. He also allegedly took the victim's phone during the incident. There were also allegedly children in the residence who are protected by stay-away orders. He was arraigned in City Court and ordered held on $15,000 bail, $30,000 bond, or $60,000 partially secured bond.

Lyndsay T. Young, 38, of Batavia, is charged with criminal contempt 1st. Young is accused of making numerous calls to a person thereby violating an order of protection. Young was also arrested on two warrants for alleged failure to appear. Young was arraigned in City Court and released under supervision. 

Christina Sanchez-Anderson, 33, of Batavia, is charged with criminal possession of a controlled substance 7th. Sanchez-Anderson was arrested on a warrant stemming from an incident reported at 3:18 p.m., Oct. 11. She was arraigned in City Court and ordered jailed on $1 bail.

Jessica L. Holtz, 38, of Batavia, is charged with petit larceny. Holtz was taken into custody by the Monroe County Sheriff's Office and turned over to Batavia PD on two warrants stemming from an incident reported at 7:42 a.m., Nov. 27 on South Swan Street, Batavia, and at 10:44 p.m., Nov. 18, on Jackson Street, Batavia. Holtz was arraigned in City Court and released.

Daniel T. Henning, 41, of Batavia, is charged with criminal possession of stolen property 5th. Henning was arrested on a warrant following an investigation. He is accused of stealing property from a residence in Batavia and then found in possession of it at noon, Dec. 22, at a location on Veterans Memorial Drive. He was arraigned in Town of Batavia Court and released under supervision.

William Ramson Dieter, 48, of Lewiston Road, Oakfield, is charged with harassment 2nd. Dieter is accused of putting his hand on another person's neck and pushing her into a wall during an incident reported at 12:15 a.m., Feb. 5, at a residence on South Pearl Street, Oakfield. Dieter was arraigned in Town of Oakfield Court and released on his own recognizance.

Rafael Eliseo Colon, 39, of Grant Street, North Tonawanda, is charged with criminal contempt 2nd. Colon is accused of violating an order of protection at 8:46 p.m., Feb. 5, at a residence on Prestige Crossing, Batavia. Colon was arraigned in Town of Batavia Court. There is no information available on his release status.

Travis C. Wissinger, 22, of Medina, is charged with DWI. Wissinger was stopped at 3:09 p.m., Feb. 7, in the Town of Alabama by State Police. He was issued an appearance ticket. No further information released.

Shawntisha M. Gray, 30, of Apple Street, Syracuse, is charged with petit larceny. Gray is accused of shoplifting from Dick's Sporting Goods in Batavia at 6:59 p.m., Feb. 8. Gray was issued an appearance ticket.

Charles Timothy Kuhn, 47, of Alexander Road, Alexander, is charged with DWI and moving from lane unsafely. Kuhn was arrested by Deputy David Moore after dispatchers received a report of a vehicle off the road at 11:22 p.m., Feb. 8, on Sprauge Road, Alexander. Kuhn was released on an appearance ticket.

Antwoine Kush, 19, of Lockport, is charged with criminal contempt 1st, burglary 2nd, unlawful imprisonment, and robbery 3rd. Kush was arrested on a warrant in Savannah, Ga., and extradited back to Batavia, on charges stemming from an incident reported at 5:08 a.m., Dec. 16, on East Main Street, Batavia.  He was arraigned in City Court and ordered held on $25,000 bail, $50,000 bond, or $75,000 partially secured bond.  He was also arrested and arraigned on a warrant for alleged failure to appear on a prior arrest.

Antwan L. Odom, 21, of Batavia, is charged with assault 3rd.  Odom is accused of striking a neighbor in the face with a fist causing a physical injury at 12:25 p.m., Jan. 25, on Miller Avenue, Batavia. He was arraigned in City Court and released on his own recognizance. 

Isaac D. Abrams, 21, of Alabama, is charged with burglary 1st. Abrams was arrested by State Police in connection with an incident reported at 9:48 p.m., Dec. 28, in Alabama. He was ordered held in jail. No further details released.

Stephen Gerard Ognibene, 64, of Bank Street, Batavia, is charged with criminal purchase or disposal of a firearm and failure to report a lost or stolen firearm.  On Dec. 15, deputies Erik Andre and Jeremiah Gechell began an investigation into unaccounted handguns stemming from a criminal contempt arrest. It's alleged that Ognibene unlawfully disposed of two revolvers to an individual who could not legally possess firearms and failed to report to law enforcement that the firearms were lost or stolen. He was arraigned in City Court and released under the supervision of Genesee Justice.

Virginia Steen, 52, of Gilbert Street, Le Roy, is charged with harassment 2nd and criminal contempt 2nd. Steen is accused of tampering with the property of another person in a common area of a residence on Gilbert Street, Le Roy, at 1 a.m., Feb. 6. The action allegedly violated an order of protection. She was released on an appearance ticket.

Jose Antonio Cruz, 28, of Linwood Road, Le Roy, is charged with petit larceny. Cruz is accused of stealing from a business where he was employed on West Main Street, Le Roy, at 5 p.m., Feb. 1. He was issued an appearance ticket.

Quincy R. Byrd, 26, of Bacon Street, Le Roy, is charged with unauthorized use of a motor vehicle. Byrd is accused of driving a 2005 Toyota Camry without permission of its owner at about 3 p.m., Feb. 5, on Bacon Street, Le Roy. After being arraigned in Le Roy Town Court, Byrd was released to Lockport PD on an arrest warrant.

John A. Cabrera, Sr., 54, of Batavia, is charged petit larceny. Cabrera is accused of stealing two frozen pizzas and three cans of beer from a business on Ellicott Street, Batavia, at 11:36 a.m., Feb. 3. he was issued an appearance ticket.

Chantalle J. Bessil, 27, of Batavia, is charged with obstruction of governmental administration, resisting arrest, and suspended registration. Bessil was stopped at 9:29 pm., Feb. 1, on East Main Street by a Batavia PD patrol. She was issued an appearance ticket.

Carlene V. Santiago, 32, of Batavia, is charged with endangering the welfare of a child. Santiago was arrested on a warrant stemming from an incident reported at 3:19 p.m., March 17, on Vine Street, Batavia. She was arraigned in City Court and released on her own recognizance.

Talana J. Savery, 22, of Fulton, is charged with failure to appear. Savery was arrested on a warrant after turning herself into Batavia PD. She was arraigned in City Court and released on her own recognizance. 

Shawn M. Twardowski, 39, of Batavia, is charged with petit larceny. Twardowski is accused of stealing beer from a business on East Main Street, Batavia, at 9:32 a.m., Jan. 26. He was issued an appearance ticket.

Gregory Reese, 52, of Batavia, is charged with failure to appear. Reese was arrested on a warrant for alleged aggravated unlicensed operation in the City of Batavia at 12:23 a.m., Jan. 30, 2021, on Ellicott Street, Batavia. He was arraigned in City Court and released on his own recognizance.

Andrew J. Draper, no age provided, of Batavia, and Crystal A. Mounts, no age provided, of Batavia, are both charged with petit larceny. Draper and Mounts are accused of stealing at 1:46 p.m., Jan. 29, from a business on Ellicott Street, Batavia. They attempted to leave the store with more than $700 worth of merchandise.  They were issued appearance tickets.

John Kenneth Hobbs, 34, of Clinton Street Road, Batavia, is charged with criminal contempt 2nd. Hobbs was allegedly found in the presence of a protected party when authorities responded to a residence on Clinton Street Road, Batavia, for a medical emergency at 9:20 p.m., Feb. 1. He was arraigned in Batavia Town Court and ordered held on bail.

A 15-year-old male resident of Alabama is charged with promotion of a sexual performance of a child less than 17 and possession of sexual performance by a child. The youth was arrested by State Police in connection with an investigation begun at 7:28 p.m., Sept. 16, in the Town of Alabama.  The youth was issued an appearance ticket. No further details were released.

Manzel R. Maxwell, 30, of Rochester, is charged with grand larceny 4th. Maxwell is charged with a theft committed at 1:20 p.m., Dec. 6, in the Town of Batavia. The investigation is ongoing by State Police. No further details released.

Brooke Tubbins, 41 of Batavia, pled guilty to one count of petit larceny in Batavia Town Court on February 1, 2022.  Sentencing has been adjourned to a later date.

Tubbins was originally charged with 3rd-degree grand larceny and 3 counts of filing a false instrument after failing to report income on two separate applications for SNAP benefits after an investigation by Genesee County Department of Social Services Investigator Robert Riggi.  Tubbins received $6215 in SNAP benefits she was not entitled to.

Full restitution has been made to the Genesee County Department of Social Services and Tubbins will be disqualified from receiving SNAP benefits for one year.

Richard Lewis Conte, 29, of Central Avenue, Batavia, is charged with DWI, refusal to take a breath test, reckless driving, failure to keep right, and avoiding traffic device or intersection light. Conte was stopped at 10:50 p.m., Jan. 26, on Route 33 in Byron by Deputy Kenneth Quackenbush.

John Laurence Lyons, 53, of HIlltop Drive, Le Roy, is charged with criminal obstruction of breathing.  Lyons is accused of obstructing the breathing of another person at 11:45 p.m., Nov. 24, at a location on Hilltop Drive, Le Roy. He was arrested by Le Roy PD and issued an appearance ticket.

Gary David Doctor, 39, of Main Street, Akron, is charged with DWI, driving while ability impaired by drugs, aggravated unlicensed operation 3rd, and operating a vehicle with a suspended registration.  Doctor was arrested by Deputy Kevin McCarthy after dispatchers received a report at 10:56 a.m., Nov. 24, of a male passed out behind the wheel on West Main Street Road, Batavia. Doctor was issued an appearance ticket.

Matthew Zakrzewski, 42, of Batavia, is charged with arson 3rd and criminal mischief 3rd. Zakrzewski, already in custody on unrelated charges, was arrested on new charges stemming from an incident reported at 9:30 p.m., Jan 16, on Bank Street, Batavia. He was jailed on nominal bail. Laura Lee Pacer, 36, of Batavia, is charged with harassment 2nd. Pacer is accused of harassing a neighbor at 10 a.m., Jan. 24, on Jackson Street. She was issued an appearance ticket.

Bleyke Z. Culver, 25, is charged with harassment 2nd. Culver is accused of hitting another person in the face during a fight on Pringle Avenue at 5:31 p.m., Jan. 11. He was issued an appearance ticket.

Heather Nicole Holbrook, 36, of Ellsworth Avenue, Batavia, is charged with petit larceny. Holbrook is accused of stealing merchandise from Walmart in Batavia at 3:49 p.m., Jan. 28.  She was released on an appearance ticket.

Michael David Hazzard, 31, of Morgan Road, Scottsville, is charged with DWI, driving with a BAC of .08 or greater, aggravated unlicensed operation 3rd, driving with an open alcohol container. Hazzard was stopped at 4:11 a.m., Jan. 23, on Dublin Road, Bergen, following a complaint of a disturbance by Deputy Trevor Sherwood.

Joshua M. Bratcher, 31, of Pavilion, is charged with driving while impaired by drugs. Bratcher was stopped at 5:24 p.m., Jan. 30, by State Police in the Town of Bergen. He was issued an appearance ticket. No further information released.

Alonzo A. Dillard, 29, of Medina, is charged with DWI and driving with a BAC of .08 or greater. Dillard was stopped at 2:46 a.m., Jan. 30, by State Police in the Town of Alabama. He was issued an appearance ticket.  No further information released.

Jordan E. Brodie, 32, of Le Roy, is charged with possession of sexual performance of a child. Brodie was arrested in connection with an investigation that started on Jan. 13, 2020 by State Police. He was arrested on Jan. 29 and released on an appearance ticket.  No further details released.

Bobbi M. Bane, 45, of Batavia, is charged with welfare fraud 3rd and three counts of filing a false instrument 1st. Bane was arrested by State Police in connection with an investigation that began Jan. 25 in the Town of Albion.

John M. Toal, 46, of Oakfield, and Andrea L. Osborne, 37, of Oakfield, are charged with petit larceny.  Toal and Osborne were arrested by State Police in connection with an incident reported at 4 p.m., Jan. 28, in Albion. They were issued appearance tickets. No further details released.

Kenneth Harris, 26, of Tonawanda, is charged with two counts of grand larceny 4th. Harris was arrested in Cheektowaga by State Police in connection with an incident reported at 10:24 a.m., Oct. 23 in the City of Batavia. No further details released.

Jordan R. Rose, 21, of Oakfield, is charged with criminal contempt  1st. Rose was arrested by State Police in connection with an incident reported at 3:10 p.m., Jan. 25, in the Town of Royalton. He was ordered held. No further details released.

Jameson Arland Crocker, 35, of Godfreys Pond Road, Stafford, is charged with DWI, resisting arrest, obstruction of governmental administration 2nd, leaving the scene of a property damage accident, and unsafe backing of a vehicle.  Crocker is accused of being leaving the scene of a property damage accident at 12:22 a.m., Jan. 23. He was arrested by Deputy Jeremiah Gechell. He was issued an appearance ticket. 

Harold P. Gage, 78 of Le Roy, is charged with DWI, failure to keep right, and drinking alcohol in a motor vehicle. Gage was arrested by a trooper out of SP Warsaw on South Road, Town of Covington at 7:36 p.m., Jan. 25. Gage allegedly failed a field sobriety test and recorded a BAC of .14.  He was issued an appearance ticket.

Michael David Hazzard, 31, of Morgan Road, Scottsville, is charged with assault 3rd.  Hazzard allegedly hit a person 15 times in the face with a closed fist while at a location on Dublin Road, Bergen, at 2:30 a.m., Jan. 23. He was issued an appearance ticket.

Siavaija Treyevionna Lewis, 20, of Clifford Avenue, Rochester, is charged with petit larceny. Lewis is accused of stealing merchandise from the Target Store in Batavia at 5:11 p.m., Jan. 25. He was released on an appearance ticket.

Jeryn Chanel Boggs, 28, of Clifford Avenue, Rochester, is charged with petit larceny. Boggs is accused of stealing merchandise from the Target Store in Batavia at 5 p.m., Jan. 25. He was released on an appearance ticket.

Jerome Dwane Hightower, 22, of Princeton Street, Rochester, is charged with petit larceny. Hightower is accused of stealing merchandise from the Target Store in Batavia at 5:11 p.m., Jan. 25. He was released on an appearance ticket.

Todd Alan Brumber, 57, of Sumner Road, Darien, is charged with DWI, moving from lane unsafely, speed not reasonable and prudent, and failure to keep right. Brumber was reportedly involved in a property damage accident at 8:31 p.m., Jan. 23, at 9434 Alexander Road, Batavia. He was arrested by Deputy Trevor Sherwood.

Matthew Zakrzewski, 42, of Batavia, is charged with arson 5th. It is alleged that at 9 p.m., Jan. 16, Zakrzewski entered the bank yard of a residence on Bank Street and set a canvass shed on fire causing damage to the shed and its contents. Zakrzewski who is being held on other charges was issued an appearance ticket.

Matthew Zakrzewski, 42, of Batavia, is charged with criminal trespass 3rd and petit larceny. Zakrzewski is accused of trespassing on private property at 9:06 p.m., Jan. 16, and stealing a bicycle. Zakrzewski was arraigned in City Court and ordered jailed on $100 bail.

Kenneth Marrocco, 29, of Batavia, is charged with burglary 3rd and criminal mischief 4th. Marocco was arrested on a warrant issued in relation to an incident reported at 5:43 p.m., Dec. 28, on Ross Street, Batavia. He was arraigned in City Court and released under the supervision of Genesee Justice.

Adam Bortle, 38, of Wayland, is charged with petit larceny. He is accused of shoplifting from a local business on Dec. 17.  He was arrested at the Livingstone County Jail by Officer Kevin DeFelice on a City Court arrest warrant. He was jailed pending arraignment and following arraignment, released under the supervision of Genesee Justice.

Michael L. Jackson, 41, of Batavia, is charged with petit larceny. He is accused of a theft on May 16. He was arrested on a warrant and released on an appearance ticket.

Kyle A. Hillyard, 29, of Batavia, is charged with DWI, driving with a BAC of .08 or greater, and moving from lane unsafely. Hillyard was arrested by a Batavia PD patrol officer following an accident reported at 12:09 p.m., Jan. 16, on East Main Street. Hillyard allegedly fled the scene of the accident, He was issued an appearance ticket.

Alexandro Rodriguez, 25, of Batavia, is charged with harassment 2nd and criminal possession of a controlled substance. At 4:58 p.m., Jan. 17, Rodriguez allegedly pulled another person to the ground causing her to injure her hand. He was also allegedly found in possession of a controlled substance. He was arraigned in City Court and released.

Laquisha M. Bloom, 36, of Medina, is charged with assault 3rd. Bloom is a suspect in an incident reported at 11:15 p.m., Jan. 17, at a location on Bank Street. Bloom turned herself in at Batavia Police headquarters. She was issued an appearance ticket.

Jose A. Alvarado, 33, of Albion, is charged with sex offender failure to report a change of address within 10 days. Alvarado was reportedly living at the Days Inn but was allegedly located living at an address in Albion in an investigation conducted by Det. Jason Ivison. Alvarado is currently on federal probation.

Michael Ross Whiteman, 49, of South Federal Street, Perry, is charged with driving while ability impaired by drugs, open alcohol containers, and inadequate exhaust system. Whiteman was stopped at 12:58 a.m., Nov. 4, on Cockram Road, Byron, by Deputy David Moore.

Nicholas M. Canty, 24, of Buffalo, is charged with fleeing a police officer in a motor vehicle and reckless driving. Canty was arrested by State Police following an incident reported at 1:54 a.m., Jan. 22, in the Town of Batavia. Canty was issued an appearance ticket.  No further details were released.

Joshua D. Quaintance, 33, of Byron,  is charged with DWI. Quaintance was stopped at 4:10 p.m., Jan. 20, by State Police.  He was issued an appearance ticket. No further details were released.

Wesley N. Thigpen is indicted on four counts of predatory sexual assault against a child. Thigpen is accused of engaging in oral sexual conduct with a person less than 13 years old while he was at least 18 years old or older between the dates of June 1, 2014, and August 31, 2014.  He is accused of engaging in two or more acts of sexual conduct with a child less than 13 years old over a period of time not less than three months.  He is accused of engaging in sexual intercourse with a person less than 13 years old. Joshua D. Quaintance is indicated on counts of burglary in the second degree and sexual abuse in the third degree.  Quaintance is accused of entering a dwelling in the Town of Alexander on July 11 with the intent to commit a crime in that dwelling.  He is accused of subjecting a person to sexual contact without that person's consent.

Cody A. Bush is indicted on counts of burglary in the second degree, criminal contempt in the second degree, resisting arrest, and two counts of criminal possession of a controlled substance in the 7th degree. Bush is accused of entering a dwelling on Walnut Street, City of Batavia, on Oct. 11 with the intent to commit a crime in that dwelling. He is accused of violating an order of protection that day. He is accused of intentionally trying to prevent police officers from placing him in custody. He is accused of illegally possessing Clonazepam and Alprazolam.

Brandon C. Dodd is indicted on three counts of criminal contempt in the first degree, two counts of burglary in the second degree, criminal trespass in the third degree, criminal contempt in the second degree, and three counts of petit larceny. Dodd is accused of violating three orders of protection covering three different individuals on June 29 while in the City of Batavia. He is accused of entering a dwelling on Highland Park on that date with the intention of committing a crime in that dwelling. He is accused of being at that property without the permission of the property owner. He is accused of violating an order of protection on June 14. He is accused of shoplifting from Mr. Wine and Liquore on June 23. He is accused of stealing an air conditioner from a residence on Jackson Street on June 28. He is accused of entering a dwelling on Highland Park on June 23 with the intent of committing a crime in that dwelling. He is accused of stealing a bicycle from a residence on Highland Park.

Christopher J. Wiegman is indicted on counts of criminal possession of a controlled substance in the fifth degree and two counts of criminal possession of a controlled substance in the seventh degree. Wiegman is accused of knowingly and illegally possessing cocaine, fentanyl, amphetamine, and dextroamphetamine on April 21 in the City of Batavia.

Kerwin R. Vega is indicted on counts of felony aggravated DWI, felony DWI, aggravated unlicensed operation, circumvention of an interlock device, and endangering the welfare of a child. Vega is accused of driving a 2008 Toyota while drunk on Route 33 in the Town of Bergen on April 4 while a child less than 15 years old was in the vehicle. Due to a prior DWI conviction, Vega is required to use an interlock device on any vehicle he operates.

Joey Robert Tatro, 27, of Exchange Street, Attica, is charged with criminal contempt and bail jumping 3rd. Tatro was arrested on warrants out of City Court by Deputy Andrew Mullen and Sgt. Andrew Hale. He was jailed on $1,000 bail, $2,000 bond, or $3,000 partially secured bond.

Jonathan Lee Holland, 38, of Bethany Center Road, Bethany, is charged with DWI, driving with a BAC of .08 or greater, failure to keep right, aggravated unlicensed operation 2nd. Holland was stopped at 1:55 p.m., Jan. 19, on Ellicott Street Road, Batavia, by Deputy Kenneth Quackenbush.

The Batavia Police Department has partnered with Crime Stoppers Buffalo which is offering a reward of up to $2,500 for information leading to the arrest of Devon Wright. Wright is wanted for violating his release terms on a recent plea pertaining to the charges of PL 110.00 & 265.03-3 - Attempted Criminal Possession of a Weapon 2nd, PL 120.00-1 - Assault 3rd, PL 110.00 & 120.10-1 - Attempted Assault 1st, and PL 130.50-4 - Criminal Sexual Act 4th. Wright is also wanted for PL 145.14 - Criminal Tampering 3rd, and PL 240.26 - Harassment 2nd (2 counts) stemming from an incident that occurred on 11/27/2021 at a residence on Central Avenue.

Rebecca Lynn Martin, 27, of Brick Schoolhouse Road, Hamlin, is charged with DWI, driving with a BAC of .08 or greater, reckless in the endangerment, leaving the scene of an injury accident, and reckless driving. Martin is accused of being a driver involved in a motor vehicle accident at 7:02 p.m., Jan. 14, on Lake Street Road, Le Roy, and leaving the scene of the accident.  Martin allegedly failed to stop for a stop sign causing her vehicle to strike another vehicle.  Martin's vehicle was located in the Le Roy Park and Ride and while deputies attempted to stop the vehicle, her vehicle allegedly struck a Village of Le Roy patrol car.  Martin was processed at the Genesee County Jail and released on appearance tickets.

Rebecca L. Harrington, 28, of Attica, is charged with DWI, driving with a BAC of .18 or greater, driving left of pavement markings, speeding, and failure to stop at stop sign.  Harrington was stopped at 10:07 p.m., Jan. 6, by a Batavia police officer. She was issued tickets and released.

James R. Cooper, 39, of Batavia, is charged with unreasonable noise, a  violation of the Batavia Municipal Code. Cooper is accused of playing rock music at a loud volume for an extended period of time at a location on Buell Street on Jan. 11. He was issued an appearance ticket.

Jolene Y. Stevens, 33, of Batavia, is charged with harassment 2nd. Stevens is accused of using a piece of wood to hit another person in the back during an incident reported at 8 a.m., Jan. 22, on East Main Street, Batavia. Stevens was arraigned in City Court and released.

Lyndsay T. Young, 38, of Batavia, is charged with criminal contempt 2nd. Young is accused of violating an order of protection at 3:57 p.m., Dec. 30. She was issued an appearance ticket.

Sean D. Roczen, 38, of Rochester, is charged with aggravated harassment 2nd. Roczen turned himself on an arrest warrant in relation to an incident reported at 9:26 p.m., Jan. 7, on Kingsbury Avenue. He was arraigned in City Court and released on his own recognizance.

Jeffrey P. Schneider, 51, of Batavia, is charged with DWI, driving with a BAC of .08 or greater, and moving from lane unsafely. Schneider was arrested following a three-vehicle property-damage accident at 7:09 p.m., Dec. 27, on East Main Street, Batavia. Schneider was processed Batavia PD headquarters and released on tickets.

Montell L. Cunningham, 28, of Lockport, is charged with criminal contempt. Cunningham is accused of violating an order of protection at 11:55 p.m., Jan. 9, in the parking lot on Alva Place. He was issued an appearance ticket.

Daniel Thomas Henning, 41, of Maple Street, Batavia, is charged with falsifying business records 1st. Henning is accused of falsifying business records at Pawn King, on Veterans Memorial Drive, at 12:11, Dec. 22. The case was investigated by Investigator Erik Andre and Deputy James Stack. Henning was issued an appearance ticket.

Nicholas Scott Warriner, 24, DWI, refusal to take a breath test, speed not reasonable and prudent, and following too close. Warriner is accused of driving too fast for conditions and too close to a marketed Sheriff's patrol vehicle at 12:15 a.m., Jan. 16, on Clinton Street Road, Bergen. When the deputy slowed his vehicle while a lead vehicle was turning, Warriner's vehicle allegedly hit the rear of the patrol vehicle. Warriner allegedly failed a field sobriety test.  He was issued an appearance ticket. The investigating officer was Deputy Jacob Gauthier.

Brianna Nicole Greene, 34, of Parkridge Avenue, Buffalo, is charged with grand larceny 4th.  Greene is accused of stealing more than $1,000 in clothing from Dick's Sporting Goods at 1:51 p.m., Jan. 8.  Greene was issued an appearance ticket.

Qumane James Santiago, 23, of West Main Street, Batavia, is charged with harassment 2nd. Santiago is accused of striking another inmate at the Genesee County Jail at 7:21 a.m., Jan. 7. 

Rachel A. Keene, 26, of Pembroke, is charged with DWI. Keene was stopped by a trooper out of SP Clarence on south Newstead Road, Newstead, on Jan. 8. She was allegedly driving with a BAC of .10. She was released on an appearance ticket.

A 42-year-old Batavia man is in custody following an investigation into a fire at Washington Towers on Sunday.

Matthew T. Zakrzewski is charged with attempted arson 2nd, burglary 2nd, criminal trespass 3rd, petit larceny.

Zakrzewski is accused of setting a chair on fire in the communal area of the retirement residence at Jefferson and Washington in the city. 

The police identified Zakrzewski as a suspect during the beginning of the investigation when police received a report of a bicycle being stolen on Bank Street.  

Zakrzewski was located and identified as the suspect in the bicycle theft. During his arrest, police found he also matched the description of the arson suspect.

He is also a suspect in reports of broken windows on vehicles in the area. 

A current parolee, Zakrzewski was arraigned in City Court and ordered held on $50,000 bail, $75,000 bond, or $150,000 partially secured bond.

Assisting Batavia PD in the investigation was City Fire, Emergency Dispatchers, NYS Parole, and citizens.

Assemblyman Steve Hawley (R,C,I-Batavia) joined members of the Senate and Assembly Minority Conferences, law enforcement, and public safety advocates on Tuesday to call for the passing of anti-crime measures, following a rise in violence throughout New York state during the past two years. 

The legislative conferences advocated for the restoration of judicial discretion to locally-elected judges, among several other proposals. Since the passage of bail reform in 2019, the ability of judges to hold lawbreakers they know to be dangerous to the community on bail has been heavily restricted. The state has seen a 46.7% increase in murders throughout the state from 2019 to 2020. Criminals released under the bail reform law have gone on to frequently re-offend, at times retaliating against victims mere hours after their pretrial release.

“If we want New York to be a place people want to live, start families and spend their money, it must first and foremost be a safe place,” said Hawley. “During our governor’s State of the State address, there was a glaring absence of any discussion of the marked rise in violence we’ve seen in our communities all across New York. So putting public safety back on the agenda for the upcoming legislative session is a priority for me and our conference as a whole.”

Shannon Lee Marvin, 30, of West Main Street, Le Roy, is charged with grand larceny. Marvin is accused of stealing a credit card from a person in Bergen in November and making several purchases with the card. Marvin was processed at the Genesee County Jail and released on an appearance ticket.

Abigail M. Russell, 19, of Hamburg, is charged with petit larceny. Russell is accused of shoplifting a bag full of groceries from a local store at 12:01 p.m., Jan. 4. After receiving a report of the larceny, Russell was located by a Batavia patrol officer, identified as the suspect, and arrested.  She was released on an appearance ticket.

Walter M. Rhynes, 30, of Rochester, is charged with harassment 2nd. Rhynes is accused of trying to strike an employee of a local hotel at 1:29 p.m., Jan. 1. He was issued an appearance ticket.

Brittany N. Leach, 28, of Batavia, is charged with two counts of criminal mischief 4th. Leach is accused of damaging a door and a vehicle on State Street at 11:10 p.m., Jan. 4. She was issued an appearance ticket.

Marcus T. Hill, 29, of East Rochester, was arrested on a warrant for alleged failure to appear. The warrant stems from an incident reported at 9:45 p.m., April 25 (no details released) and was issued July 28 after Hill allegedly failed to appear in court as ordered. He was released under the supervision of Genesee Justice.

Hailee N. Callicutt, 21, of Batavia, is charged with obstruction of governmental administration, resisting arrest, driving without insurance, driving on a suspended registration, and driving a vehicle with an obstructed view. Callicutt was stopped by Officer Peter Post at 10:02 p.m., Jan. 1, on Liberty Street.  She was issued an appearance ticket.

Brian Graziaplena, 70, of Batavia, is charged with DWI, driving with a BAC of .08 or greater, and moving from lane unsafely. Graziaplena reportedly drove his car into a tree at 4:23 p.m., Jan. 1, on North Lyon Street, Batavia. He was issued an appearance ticket and released to a sober third party.

Dean C. Siminski, 32, of Batavia, is charged with criminal contempt 2nd. Siminski allegedly sent a letter to a person covered by an order of protection. He was issued an appearance ticket.

Eric Tyler McGrain, 29, of Donlin Drive, Rochester, is charged with felony DWI, speeding, refusal to take breath test, failure to keep right, and moving from lane unsafely. McGrain was stopped at 1:21 p.m., Jan. 8, on College Road, Batavia, by Sgt. Mathew Clor.

Trisha R. Santora, 39, of Batavia, is charged with eight counts of petit larceny and eight counts of falsifying business records 1st. Santora was arrested by State Police for an alleged crime reported in November. She was issued an appearance ticket. No further details were released.

Kyle A. Hillyard, 29, of Batavia, is charged with DWI and driving with a BAC of .08 or greater. Hillyard was stopped at 1:35 a.m., Jan. 9, by State Police in the Town of Batavia. He was issued an appearance ticket.

Brian P. Demko, 44, of Batavia, is charged with aggravated harassment 2nd. Demko was arrested by State Police following an investigation in an incident reported at 7:42 p.m., Dec. 26, in the Town of Batavia. He allegedly made a threat toward another person. He was released on his own recognizance. No further details released.

In a verdict rendered on January 4, 2022, defendant Michael T. Swiatowy was found guilty, after a single judge trial, of one count of misdemeanor driving while intoxicated. The trial was conducted on December 13, 2021, in Batavia Town Court by Judge Lisa Funke.

According to the trial testimony, as well as records of the Genesee County Sheriff’s Office, deputies were dispatched to the defendant’s home on January 10, 2020, for an unrelated matter. Upon arrival, they noticed that defendant had trouble standing and was slurring his speech. He also had bloodshot, glassy eyes, and was wearing only one sock and no shoes. Defendant admitted to driving home from a bar, and a witness at trial confirmed this.

While walking to the patrol car, the defendant was having trouble keeping his balance and kept saying, “I’m a corrections officer, extend me some damn courtesy.” He agreed to perform several field sobriety tests, which he failed. Defendant refused to provide a breath sample and was placed under arrest.

The arrest was handled by Brock Cummins and Deputy James Stack. Assistant District Attorney Robert J. Shoemaker was the trial prosecutor. The defendant was represented by Thomas D. Trbovich, Esq.

Michael J. Robinson, 44, of Lockport, is charged with grand larceny 4th and petit larceny.  Robinson is accused of picking up a wallet containing a credit card that was accidentally dropped at Batavia Downs and taking the wallet home and keeping it and making no attempt to return it.  Robinson was issued an appearance ticket.

Eric John Peluso, 45, of Clipnock Road, Bethany, is charged with assault 3rd and endangering the welfare of a child.  Peluso allegedly struck a minor causing substantial pain.  He was arraigned in Bethany Town Court and remanded to the Genesee County Jail.

Jennifer M. Moore, 36, of River Street, Batavia, is charged with criminal possession of a controlled substance 7th. Moore was arrested on Jan. 5 for alleged drug possession at 12:32 p.m., Oct. 22, at a location on Park Road, Batavia.

Jaylinn Marie O'Neil, 31, of Old Telephone Road, Bethany, is charged with criminal possession of a controlled substance 7th, aggravated unlicensed operation 3rd, and unlicensed operator. O'Neil was arrested following a traffic stop on Veterans Memorial Drive at 4:34 p.m., Dec. 29 by Deputy Nicholas Chamoun. O'Neil was allegedly found in possession of a narcotic.
