Law and Order: Batavia man accused of fighting with police

Tyquawn D. Bethel, 23, of East Main Street, Batavia, is charged with obstructing governmental administration, 2nd, resisting arrest, endangering the welfare of a child, criminal trespass, 2nd, and petit larceny. Officers were dispatched to an address on Prune Street for a report of an argument at 10:06 p.m. Tuesday. Bethal allegedly entered the residence uninvited and refused to leave. Bethal allegedly argued with a person at the residence. He allegedly grabbed money from the purse of the resident and then attempted to leave with the money. When patrols arrived, Bethal was allegedly combative with officers and refused to comply with verbal commands. Bethal allegedly initiated a fight with the officers. Children were allegedly present during the scuffle. He was subdued and taken into custody. Bethal was jailed on $2,500 bail. The investigation was handled by Officer Kevin DeFelice and Sgt. Dan Coffey.

Robert L. Peachey Jr., 30, of Gibson Street, Oakfield, is charged with petit larceny. Peachey is accused of stealing a bottle of Jack Daniel's Honey from YNGodess on Feb. 28. (Previously)

Shaumyk Antonio Santiago, 21, of St. Paul Street, Rochester, is charged with burglary. Santiago is accused of forcing entry into a residence on Tinkham Drive, Darien, on or about Dec. 27, and stealing handguns, cash, jewelry and other property. Santiago was arraigned, released on his own recognizance and turned over to another police agency on unrelated criminal charges. A second arrest in the case is pending. The investigation was conducted by Investigator William Ferrando and Sgt. Ron Meides.

Christopher M. Colantonio, 34, of East Main Street, Batavia, is charged with failure to appear. Colantonio was arrested on a bench warrant. He was jailed on $1,000 bail.

Elizabeth A. Denise, 33, of Hutchins Street, Batavia, was arrested on a bench warrant. Denise turned herself in. She was released on $100 bail.

Kevin R. Baumgarte, 39, of Birchwood, Batavia, is charged with DWI, driving with a BAC of .08 or greater, passing a red light, leaving scene of a property damage accident and failure to keep right. Baumgarte was allegedly involved in a hit-and-run accident on South Main Street at 4:30 p.m. Sunday. Batavia patrols subsequently located Baumgarte. The accident was investigated by Officer Eric Foels.

Micahel Samuel Yamonaco, 41, of Trumbull Street, Mount Morris, Kathleen Melissa Pritchard, 35, of Spartan Drive, Farmington, Aaron Michael Higgins, 34, of Genesee Street, Piffard, and Miranda Ariene Ralston, 27, of Genesee Street, Piffard, are all charged with grand larceny, 4th. The four suspects are accused of stealing a TV from the Batavia Walmart. They were arrested by the Monroe County Sheriff's Office and found with the allegedly stolen TV. 

Law and Order: Stafford resident arrested in Attica for alleged larceny and drug possession

Corey S. Snyder, of Route 33, Stafford, is charged with criminal possession of a forged instrument, 2nd, grand larceny, 4th, criminal possession of a controlled substance, 7th, criminal possession of a hypodermic instrument, unlawful possession of marijuana and operating with no front bumper. Snyder's vehicle was stopped by Village of Attica PD on Route 99, Attica, at 10 p.m. Monday for an alleged traffic violation. He was allegedly found in possession of a controlled substance, hypodermic instruments and marijuana paraphernalia. He was also charged in connection to an allegation that he cashed a check that had been reported stolen. Snyder was arraigned and jailed in Wyoming County Jail on $10,000 bail or $20,000 bond.

Gregory Allan Merritt, 27, of Rose Road, Batavia, is charged with DWI, driving with a BAC of .08 or greater, leaving the scene of a property damage accident and unsafe starting. Merritt is accused of striking another vehicle in the T.F. Brown's parking lot at 1:49 a.m. Tuesday and leaving the scene of the accident. The incident was investigated by Deputy Joseph Corona.

Law and Order: Perry man accused of stealing steel from business in Pavilion

John S. Dueppengiesser, 53, of Page Road, Perry, is charged with grand larceny, 3rd. Dueppengiesser is accused of stealing more than $3,000 worth of steel from a business on Route 63 in Pavilion during a night in February. Dueppengiesser was arraigned and released under supervision of Genesee Justice. The case was investigated by deputies Bradley Mazur, John Duyssen and Joseph Loftus. Deputies from Livingston County and Wyoming County assisted in the investigation.

Ashley Anne Dunham, 24, of Edward Street, Batavia, is charged with DWI, driving with a BAC of .18 or greater, failure to keep right and speeding (69 in a 55 mph zone). Dunham was stopped at 2:25 a.m. Sunday on Hartshorn Road, Batavia, by Deputy Joseph Corona.

Alicia Susan Hough, 22, of Bridge Road, Elba, is charged with DWI, driving with a BAC of .08 or greater, speed not reasonable and prudent and moved from lane unsafely. Hough was reportedly involved in a property damage accident at 7:35 a.m. Friday on Norton Road, Elba. The accident was investigated by Deputy John Weis.

Iesha Marie Vetter, 21, of Royce Road, Varysburg, was arrested on a warrant for alleged petit larceny. Vetter turned herself in on the warrant. She was jailed on $500 bail.

Brent E. Keheley, 34, of South Main Street, Batavia, is charged with failure to answer summons. Keheley was arrested on a warrant and taken to BPD headquarters where he was released upon posting $260 police bail.

Ricky A. Leach, 33, of Central Avenue, Batavia, harassment, 2nd. Leach is accused of hitting a woman in the stomach during an altercation on State Street at 10 p.m. Thursday. Leach was released to the Wyoming County Sheriff's Office on a warrant.

Three drug investigations in the city yield three arrests of suspected dealers

Three separate investigations by the Local Drug Task Force have led to the arrest of three Batavia residents suspected of dealing crack cocaine in the city.

Arrested where:

  • Demetrius W. "G" Richardson, 33, of East Main Street, Batavia, charged with two counts of criminal possession of a controlled substance, 3rd, and two counts of criminal sale of a controlled substance, 3rd.
  • Dajuandrick C. "Omega" Gardner, 37, of East Avenue, Batavia, charged with three counts of criminal possession of a controlled substance, 3rd, and three counts of criminal sale of a controlled substance, 3rd.
  • Diana L. Bloom, 57, of State Street, Batavia, is charged with three counts of criminal possession of a controlled substance, 3rd, and three counts of criminal sale of a controlled substance, 3rd.

Richardson allegedly sold cocaine to undercover agents Sept. 12 while on Jackson Street and again on Sept. 20 while on Pringle Avenue.

Gardner allegedly sold cocaine to undercover agents Nov. 22 while on State Street, Jan. 2 while on State Street and Jan. 15 while on State Street.

Bloom allegedly sold cocaine to undercover agents while at her residence at 117 State St. on Oct. 30 and again Oct. 31.

All three were arrested on sealed indictments within the past week. Their arrests were announced today.

All three were arraigned in County Court and Richardson was jailed on $50,000, Gardner on $75,000 bail and Bloom was released under supervision of Genesee Justice.

Assisting in the investigation and arrest were uniformed Batavia PD officers, Genesee County deputies, NYS Parole and the District Attorney's Office.

Local police plan stepped up DWI enforcment for St. Patty's weekend

Genesee County STOP-DWI Program announced today that Genesee County police agencies will participate in a special enforcement effort to crackdown on impaired driving.

The statewide STOP-DWI Crackdown efforts start on March 15th and will end on March 18th. St. Patrick’s Day week is historically a deadly period for impaired driving. This year St. Patrick’s Day is on a Monday and that will extend the weekend until Tuesday for many people. The New York State Police, County Sheriff and municipal law enforcement agencies will collaborate across the state and will be out in force in this coordinated effort to reduce the number of alcohol-related injuries and deaths during this period.

Batavia City Police Chief Shawn Heubusch stated, “The City of Batavia Police Department encourages everyone celebrating to do so safely and have a designated driver. Do not get behind the wheel of a vehicle if you have been drinking. We wish everyone a safe and happy holiday weekend.”

Genesee County Undersheriff William Sheron stated, “St. Patrick's Day is well known as of day of celebration. Please celebrate responsibly. Avoid tragedy; Don't plan on the luck of the Irish, arrange for a designated driver.

The St. Patrick’s Day Weekend Crackdown is one of many statewide enforcement initiatives promoted by the New York State STOP-DWI Association. The Statewide STOP-DWI Crackdown Campaign also targets Memorial Day, 4th of July and Labor Day Weekend, Halloween and the national Holiday Season in December.

Genesee County STOP-DWI Coordinator Matt Landers stated, "Enforcement efforts like these have contributed to the steady decline in DWI accidents since the program was established. Families in Genesee County are safer while traveling the roads with a program like STOP-DWI funding extra patrols by our fine law enforcement professionals."

While STOP-DWI efforts across New York have led to significant reductions in the numbers of alcohol- and drug-related fatalities, still too many lives are being lost because of crashes caused by drunk or impaired drivers. Highly visible, highly publicized efforts like the STOP-DWI Crackdown Campaign aim to further reduce the incidence of drunk and impaired driving.

Law and Order: Driver involved in accident last month charged with DWI

Douglas James Hanley, 23, of Batavia Stafford Townline Road, Batavia, is charged with DWI, driving with a BAC of .08 or greater, failure to stop at stop sign and aggravated unlicensed operation. Hanley, while driving a 2013 Chevrolet Cruze, was reportedly involved in a motor-vehicle accident at 10:59 p.m. Feb. 1 on Prole Road, Stafford. Hanley's vehicle reportedly hit a tree. Hanley was transported to Strong Memorial Hospital where he was treated and released. The accident was investigated by Deputy Frank Bordonaro.

Adam Matthew Shultz, 31, of Fargo Road, Batavia, is charged with DWI, driving with a BAC of .08 or greater and speeding. Shultz was stopped at 3:01 a.m. Tuesday on Main Street, Batavia, by Officer Matthew Lutey.

Bonnie S. Oleandi, 44, of Montclair Avenue, Batavia, was arrested on a bench warrant. The reason for the warrant was not released. Oleandi was jailed on $100,000 bail.

A 17-year-old from Batavia was charged with criminal possession of a controlled substance, 7th. The youth was allegedly found with a controlled substance for which he didn't have a prescription following an investigation by school personnel at Batavia High School.

Charles P. Mitchell, 34, of Sanders Road, Stafford, is charged with criminal contempt. Mitchell allegedly violated an order of protection by sending text messages to the protected person.

Law and Order: Alleged beer theft leads to jail on $500 bail

Phillip Daniel Burrs, 32, of West Main Street, Batavia, is charged with petit larceny. Burrs is accused of stealing a can of beer from the Hess Express at Main and Oak streets, Batavia. Burrs was arraigned in City Court and jailed on $500 bail. (Burrs was charged with DWI following an alleged bank robbery by a passenger in his vehicle in Batavia on Jan. 18.)

Philip J. Grazioplene, 44, of South Lyon Street, Batavia, is charged with DWI, driving with a BAC of .08 or higher and passing a red light. Grazioplene was stopped at 3:07 a.m., on East Main Street, Batavia, by Officer Peter Flanagan.

Darenisha M. Thomas, 18, of Hutchins Street, Batavia, is charged with disorderly conduct and harassment, 2nd. Thomas is accused of attacking a fellow student at Batavia High School.

Law and Order: Vine Street resident allegedly threatens EMS personnel after requesting help

Tonia M. Doell, 44, of 14 Vine St., Batavia, is charged with three counts of menacing, 2nd, one count of criminal possession of a weapon, and one count of attempted assault, 2nd. Doell is accused of requesting medical assistance at 2:21 p.m. and when Mercy EMS personnel arrived at her residence and attempted to enter, Doell allegedly threatened them with a kitchen knife. Doell was arraigned and jailed without bail.

Jason D. Lang, 27, and Ashley R. Keene, 26, both of 244 Liberty St., Batavia, are charged with grand larceny, 4th. Lang and Keene are accused of stealing 10 pairs of eyeglass frames valued at more than $1,600 from the Lencrafters location in Hamburg. Hamburg detectives received several calls identifying Lang and Keene as the suspects after police posted pictures of the shoplifting suspects on Facebook and Buffalo media outlets picked up the story. Upon further investigation, Lang and Keene were asked to appear at Hamburg PD and did so voluntarily. Hamburg detectives report that Lang and Keene confessed to the theft. They were issued appearance tickets.

Pamela Kristene Goerss, 43, of Oak Hill Road, Silver Springs, is charged with DWI, speed not reasonable and prudent, unlicensed operator, leaving the scene of an accident and parked in roadway. Goerss was reportedly operating a 2011 Volkswagan Jetta southbound on Perry Road at 3:16 a.m. Sunday when she was involved in an accident. The other vehicle left the scene. Goerss also allegedly tried to drive away from the scene, but her vehicle became disabled. The Sheriff's Office is asking for the public's assistance in identifying the other vehicle and driver. Anybody with information can contact Deputy Frank Bordonaro at (585) 343-5000. Goerss was jailed on $500 bail.

Brian Lee Smith, 52, of Colonial Boulevard, Batavia, is charged with criminal contempt, 2nd, and aggravated family offense, a felony. Smith is accused of yelling a vulgar word at the victim, who has an active order of protection in place, Smith allegedly yelled at the victim while she was in her own driveway. Smith was jailed on $20,000 cash bail or $40,000 bond.

Bryan R. Bartholomew, 27, of Hutchins Street, Batavia, is charged with criminal contempt, 2nd. Bartholomew allegedly violated an order of protection by being at the residence of the protected party. Bartholomew was released under supervision of Genesee Justice.

Matthew D. Derrick, 29, of Bank Street, Batavia, is charged with harassment, 2nd. Derrick is accused of being involved in a domestic incident March 6.

Dariel A. Giffith, 21, of Jackson Street, Batavia, is charged with harassment, 2nd. Griffith is accused of striking another person in the hand during a dispute on South Swan Street at 4:56 p.m. March 6.

Jon David Vega, 48, of 78th Street, Howard Beach, was arrested on two bench warrants for alleged failure to appear. Vega was arrested upon his release from the Monroe County Jail on unrelated charges. He was arraigned in City Court and jailed on $5,000 cash bail or $10,000 bond.

Christina M. Colantonio, 27, of Snipery Road, Corfu, is accused of failure to appear after appearance ticket served. Colantonio was located walking westbound on West Main Street near Union Street by Officer James DeFreze and she was arrested on an active warrant. Colantonio posted $500 bail and was released.

Heather Daffney Stone, 19, of Elwood Drive, Rochester, was arrested on a bench warrant related to a third-degree burglary charge. Stone was released from Monroe County Jail on an unrelated matter and taken into custody on the burglary charge. Stone was held without bail.

Johnny Uylesse Troche, 28, of West Main Street Road, Batavia, is charged with menacing, 2nd. Troche allegedly threatened another person with a knife at 9:26 p.m. Saturday.

Francisco Rodriguez, 37, of Portland Avenue, Rochester, is charged with possession of untaxed cigarettes. Rodriguez was stopped at 8:43 p.m. Saturday on Lewiston Road, Batavia, for alleged failure to dim high beams by Deputy Joseph Corona. Rodriguez was allegedly found in possession of more untaxed cigarettes than legally allowed.

Christina Sandra Baudanza, 37, no address given, was arrested on a Family Court warrant. Baudanza was arrested upon her release from the Wyoming County Hospital. She was arraigned in Family Court and released to a social service worker who took her to temporary housing.

Katie Lee Winnie, 20, of Exchange Street, Attica, was arrested on bench warrants related to charges of petit larceny and possession of marijuana. Winnie allegedly failed to appear for a court date in the Town of Batavia. She turned herself in and was jailed on $500 bail.

Eric X. Williams, 22, of Batavia, is charged with harassment, 2nd. Williams was arrested by State Police for an alleged incident reported at 10:46 p.m. on Feb. 24. No further details released.

Joshua J. Clark, 37, of Le Roy, is charged with DWI and driving with a BAC of .08 or greater. Clark was stopped at 1:50 a.m. Friday at the junction of routes 5 and 63 by State Police.

Former Bergen resident told second trial on fraud charges will be July 7

Michele Ann Case, granted a second chance at a trial on fraud charges after her first conviction was overturned, is likely to get that trial starting July 7, Judge Robert C. Noonan said in County Court today.

Case will have until April 18 to accept any plea offer, if one is forthcoming, Noonan said.

It's Noonan's practice to set plea cut-off dates, after which point a defendant must either go to trial or plead guilty without any conditions.

District Attorney Lawrence Friedman has not publicly stated whether there is any potential plea offer.

Case, 47, a home health care nurse, formerly from Bergen, is accused of bilking her former employer out of $14,000 by filing fraudulent financial records about her hours and travel.

Woman given second chance on drunken driving charge sent to jail for six months

A Pavilion mother twice arrested under provisions of Leandra's Law will have to serve six months in jail after blowing a chance to avoid lockup given to her by Judge Robert C. Noonan a year ago.

Angela R. Kruse, 42, will also be on probation for five years.

Kruse was first arrested in Le Roy for driving drunk with her children in her car in June 2012. She was arrested again four months later in Wyoming County following a rollover accident.

Kruse appeared before Noonan last March after going through rehab and was told if she could stay out of trouble for 11 months she could have a chance to put her Genesee County charge behind her, but she violated the terms of her release and appeared before Noonan again today to answer for the lapse.

Police want to question man in connection with theft from downtown liquor store

Batavia PD is looking for the public's assistance in locating a man suspected of stealing a bottle of Jack Daniel's Honey from the YNGodess Shop on Main Street, Batavia.

Owner Christine Crocker reported the alleged theft to police last weekend after confronting a person she believes took a bottle of booze from the store. Crocker chased the man down and recovered a bottle of alcohol, but the man then fled.

Crocker said she had refused to sell liquor to the man, citing state law, because she believed he was already intoxicated.

The man in the photos is wanted for questioning in connection with the incident.

The suspect is described as a white male, thinner build, with a shaved head and a goatee. He was said to be wearing a dark zip-up jacket and white and black Nike sneakers.

Pair accused of Park Avenue house burglary indicted on three felonies

The duo accused of breaking into a house on Park Avenue in the city on Jan. 14 were indicted yesterday afternoon by the Grand Jury on three counts in connection with the alleged crime.

Nathaniel R. Davis, 18, and Akeem M. Simmons, 23, are accused of first-degree burglary for allegedly entering a house at 28 Park Ave. illegally with the intent to commit a crime, and one of the participants, Davis, was armed with a handgun. Both defendants are also accused of criminal use of a firearm, 1st, for allegedly possessing a loaded weapon during the commission of the crime.

No weapon was found on Simmons.

These are Class B violent felonies.

In count three, the men are accused of fourth-degree conspiracy, a Class E felony, for allegedly agreeing with one another to commit the crime.

The defendants were taken into custody in less than an hour after the burglary was first reported at 11:28 a.m.. Davis, who was allegedly armed, was caputured about 100 yards from the residence. Simmons was captured after a manhunt which lasted about 45 minutes.

According to Batavia PD Det. Rich Schauf, it didn't appear that anything was stolen.

Nikkia M. Phillips, 27, of West Main Street Road, Batavia, was arrested Wednesday afternoon on a bench warrant issued by Batavia City Court for alleged failure to appear at a previous court date on a charge of second-degree aggrevated unlicensed operation of a vehicle. She was jailed on $500 bail or $1,000 bond and is to appear in city court on March 12.

Christopher Lee Taylor, 25, of Frost Avenue, Rochester, was arrested today on a warrant out of Town of Elba Court for aggravated unlicensed operation of a vehicle, 3rd, and no/inadequate headlights. The violations allegedly occurred on Maple Avenue in Elba on Feb. 11. He was jailed with bail set at $250.

Justine Denae McWethy, 27, of Richmond Avenue, Batavia, was arrested Tuesday night for petit larceny for allegedly stealing $73.85 in merchandise from Walmart. She was issued an appearance ticket and is to appear in Batavia Town Court on March 27.

Ronald Louis MacGregor Jr., 45, of Washington Avenue, Batavia, was arrested Monday afternoon for petit larceny for allegedly stealing $29.88 in merchandise from Walmart. He was issued an appearance ticket and is to appear in Town of Batavia Court on March 27.

Law and Order: Former Batavia business owner arrested in Victor

Jason Lang, 30, of Liberty Street, Batavia, is charged with petit larceny, reckless endangerment, unlawful fleeing a police officer and reckless driving. Lang was arrested in Ontario County for an incident reported at 1 p.m. Monday at Pearl Vision in Eastview Mall. Lang allegedly stole two pair of Ray-Ban sunglasses valued at $358. He allegedly fled from police. He later turned himself in to the Genesee County Sheriff's Office. He was arraigned in Victor Town Court and jailed on $5,000 bail, $10,000 bond. Aaron Michael Bove, 23, of East Buffalo Street, Churchville, is charged with grand larceny, 4th. Bove allegedly stole $1,000 in cash from a business in Bethany while there cleaning the establishment.

A 16-year-old resident of North Bergen Road, Bergen, is charged with harassment, 2nd. The youth allegedly struck another student in the head during a class at Byron-Bergen High School.

Daniel Paul Hinca, 18, of Railroad Avenue, Alexander, John M. Francis, 20, of Vernon Avenue, Batavia, and a 17-year-old resident of Vernon Avenue, Batavia, are charged with unlawful possession of marijuana. The trio were allegedly found in the rear parking lot of 80 Vernon Ave., Batavia, following a complaint about people in a vehicle who appeared to be smoking marijuana. The three defendants were allegedly found in possession of a bag of marijuana and drug paraphernalia.

Grand Jury indicts man for violating an order of protection

Roger L. Lashure Jr. is indicted for first-degree criminal contempt, a Class E felony. He is accused of violating an order of protection. It is alleged that on Oct. 8 in the City of Batavia Lashure slapped a woman in violation of the court order not to have contact with her.

The Grand Jury returned no bill against Steven A. Desmore, who was accused of two counts of criminal possession of stolen property, 3rd, for incidents which allegedly occurred Oct. 15 in the Town of Le Roy.

Pembroke grandmother admits to role in drug dealing operation that stretched from Florida to WNY

A Pembroke grandmother portrayed by state officials as a leader of a significant drug ring that sold cocaine and pills in a three-county area, including Genesee County, entered guilty pleas to two felony counts in a Buffalo court today.

Geraldine Horsefall faces a possible seven year jail sentence after admitting to criminal possession of a controlled substance, 5th, and criminal possession of a controlled substance, 3rd.

Another person arrested as part of the months-long, multi-agency law enforcement investigation, Michelle King, entered a guilty plea to criminal sale of a controlled substance, 4th. She is facing a possible judicial diversion sentence.

Attorney General Eric Schneiderman announced the break up of the drug ring Jan. 28 in Buffalo.

Schneiderman said Horsefall's operation moved a significant amount of cocaine, which was transported by couriers from Florida to WNY in the soles of tennis shoes.

King was accused of providing pills from a doctor's office where she worked to the drug ring.

Law and Order: Man accused of trying to bring marijuana into City Court

Joshua Lee Baltz, 37, of Tracy Avenue, Batavia, is charged with unlawful possession of marijuana. Baltz allegedly was found to be carrying marijuana while entering the City Court facility.

John Robert Gerhardt, 64, of Centerline Road, Varysburg, is charged with DWI, driving with a BAC of .08 or greater and moving from lane unsafely. Gerhardt was stopped at 6:32 p.m. Friday on River Street, Batavia, by Deputy James Diehl.

Lisa M. Durham, 42, of Thorpe Street, Batavia, is charged with misapplication of property and falsifying business records, 1st. Durham allegedly rented merchandise from Rent-A-Center and pawned it at Pawn King.

Steven Michael Meyers, 34, of East Bethany - Le Roy Road, Bethany, is charged with menacing, 2nd. Meyers allegedly displayed a firearm during a dispute with another person.

Jenae M. Macleod, 29, of Genesee Street, Corfu, was arrested on a bench warrant out of City Court. Macleod was located by deputies from the Erie County Sheriff's Office during an investigation of an incident and discovered to have an active warrant. She was turned over to the Genesee County Sheriff's Office, arraigned, and jailed on $500 bail.

Tracy A. Hilton Sr., 33, of Jackson Street, Batavia, is charged with harassment, 2nd. Hilton was allegedly involved in a domestic incident at 12:07 a.m. Saturday.

Tyler D. Macey, 18, of Grandview Terrace, Batavia, is charged with strangulation, 2nd, acting in a manor likely to be injurious to a child and assault, 3rd. Macey is accused of being involved in a domestic incident.

Joshua A. Laraby, 23, of Byron, is charged with unlawful possession of marijuana and a traffic violation. Laraby was stopped at 5:56 p.m. Friday by State Police.

Daniel J. Laudico, 20, of Elba, is charged with DWI, driving with a BAC of .08 or greater, failure to keep right and speeding. Laudico was stopped at 1:02 a.m. Sunday on North Byron Road, Elba, by State Police.

Wine shop owner confronts intoxicated shoplifter on Jackson Street, gets bottle of Jack back

Christine Crocker doesn't have a lot of patience for people who steal bottles of booze from her store.

She's posted the mug shots of shoplifters inside her store and yesterday she chased one down Main Street onto Jackson and confronted him.

Crocker owns YNGodess Shop in Batavia.

Yesterday, at about 2 p.m., a man came into the store and walked up to the counter with a bottle of whiskey he wanted to buy.

The man was obviously intoxicated, Crocker said, and so she told him she couldn't sell him the bottle.

"But I'm not driving," he said, according to Crocker.

"It doesn't matter. It's the law. I can't sell to you," Crocker told him.

The man said he was sorry and walked out.

"I was still concerned for other people in the city that he could be driving while he was loaded," Crocker said.

Crocker looked out her front door soon after he left. At that point, she said, she saw him pull a bottle of Jack Daniel's Honey from his pocket.

She chased him down and caught up with him on Jackson Street. He tried hiding the bottle behind his back, denying he had it, she said.

She told him she knew he had it and then he admitted he did and gave it back.

"Prepare to be arrested," Crocker told the man.

At that point, the man took off running.

Crocker returned to the store, called the police and officers responded immediately. 

Later today, Crocker said, she will be providing police with surveillance photos to help police identify the suspect.

Law and Order: A pair of recent arrests

Cale David Fryer, 19, of Chase Park, Batavia, is charged with petit larceny. Fryer is accused of stealing $24.79 in merchandise from Kmart.

Sharonda R. Brown, 40, of Lockwood Avenue, Buffalo, turned herself in on a warrant for alleged failure to appear on a parking ticket in the City of Batavia. Brown was reportedly issued a ticket on a 2 a.m. to 6 a.m. parking violation. She posted $100 bail and was released.

Trial date set for man accused of throwing punch Kid Rock concert

A trial date has been set for Craig Malcolm Lawson, the 34-year-old Canadian citizen accused of throwing a single punch following a Kid Rock concert at Darien Lake and seriously injuring a former WNY man.

Jury selection is set to begin at 10 a.m., June 23 for an anticipated four-day trial.

Lawson is accused of punching Jason McNeil, of Tuscaloosa, Ala. McNeil reportedly hit his head on the pavement. He was in a coma following the incident and sources say he will never fully recover.

He is charged with assault in the second degree.

It remains possible Lawson will accept a plea offer. He has until April 24 to decide, Judge Robert C. Noonan said.

Lawson did not appear in court today and the last time he appeared -- for an evidence hearing -- he was 45 minutes late.

Noonan asked his attorney today why Lawson had a hard time crossing the border that day and the attorney said INS agents would not initially let him cross because of the pending felony charge. The attorney said he will provide his client with a letter to present at the border before his April 24 appearance.
