Jay M. Blatchley, 36, of Colby Road, Darien, is charged with robbery 3rd, resisting arrest and aggravated unlicensed operation. At 3:23 p.m., Monday, the Sheriff's Dispatch Center reportedly received a 911 hang up call from a residence on Colby Road, Darien. When a deputy arrived, he was reportedly told that Blatchley had been to the residence to retrieve some property. A domestic dispute reportedly ensued. The resident tried to call 911, but Blatchley allegedly grabbed the phone and terminated the call. Deputy Kevin McCarthy along with Sgt. Thomas Sanfrattelo and State Police responded to Blatchley's location both on this complaint and a reported outstanding warrant from another jurisdiction. Blatchley allegedly tried to flee and resisted arrest. Bail was set at $20,000.

Thomas T. Lapree, 26, of Galloway Road, Alabama, is charged with false reporting, moved from lane unsafely and leaving the scene of a property damage accident. Deputy Kevin McCarthy responded at 10:03 p.m., June 4, to a report of a property damage hit-and-run accident on Galloway Road in Alabama. Upon further investigation, McCarthy determined that Lapree may have been involved in the accident. When contacted, Lapree reportedly said his car had been stolen. It was later found hidden behind a barn across from Lapree's property and Lapree allegedly admitted to driving the car and being involved in the accident.

Cecilia R. Conklin, 46, of Skuse Road, Geneva, is charged with harassment. Conklin is accused of showing up at her daughter's College Village room and refusing to leave after being asked to leave. Conklin then allegedly followed her daughter to the GCC campus, where she was asked to leave by college security. When she allegedly refused, she was arrested.

News of an alleged sex act in a Batavia public park and the rare adultery charge that followed has made it across the pond.

British tabloids have picked up the story. By this morning, the Daily Mail, the Sunday Mirror and the Sun all carried some version of the story. The story has also appeared in the UK's Independent.

In the U.S., such diverse news outlest as the New York Daily News, ABC, AOL and a Wall Street Journal blog have given the story play.

The Daily Mail also used pictures owned by The Batavian without permission or compensation.

The stories don't tell us anything we don't already know, but the comments on a couple of them can make for interesting reading.

The Batavian has also heard from New York-based entertainment shows looking for more information. And of course, the story has been popular with radio talk shows in Buffalo and Rochester, as well as receiving extensive coverage from the TV stations in those two cities.

BATAVIA, NY -- Suzanne M. Corona, the 41-year-old Batavia mother accused of engaging in a public sex act in Farrall Park last Friday afternoon intends to challenge the constitutionality of the adultery charge leveled against her.

Asked after a brief court appearance at Genesee County Court today, Corona said she would "absolutely" challenge the legality of the charge once she retains a private attorney.

City Court Judge Robert Balbick gave her until June 22 to hire an attorney. He did not require her to enter a plea today to the adultery or public lewdness charges filed against her.

"I think the adultery charge is extremely unfair and uncalled for," Corona told assembled media before entering the courthouse. "My husband is standing beside me. He called the D.A. himself this morning and wants it dropped."

Joseph Corona said he loves and supports his wife of six-and-a-half years.

"I just want it on public record that I forgive her fully," Joe Corona said. "I wish that the charges were dropped so that we could resolve this as a man and wife, more of a private matter."

His wife called her behavior Friday "inappropriate" but denied doing anything that a child could see or be harmed by.

"If you were a passerby you would not see anything was going on," she said. "We were fully clothed. His pants were on. His shirt was on. My clothes were on."

At 5:15 p.m., Friday, Farrall Park reportedly had a number of parents with their children in the playground less than 30 feet from where the pavilion full of picnic tables sits. But Corona said she and her alleged paramour, 29-year-old Justin Amend, of Oakfield, were well away from any children. She said, at most, Amend's genitals were exposed through a pants' zipper while she sat on his lap.

"Yes, it was a sexual act," she said.

Amend was also charged with public lewdness. His case was continued to June 30. He also did not enter a plea today.

She apologized to the mothers, but said, "I've not heard from these mothers. I'd like to see something from the mothers that an offense occurred, because there was nothing, nothing that would have endangered a child, to hurt a child by any means."

Her husband complained that police never consulted him before filing the adultery charge.

"If they considered me the victim, they just left me out in the open," he said, adding that he felt "sad" about the whole situation.

"I'm hurt by all this," he said. "But I'm 41, but I've got 40 some more years to spend with my wife. I'm not going to throw it all away over one incident. This is something that is going to pass and life is going to go on. It's going to be forgotten. I'm going to love her and spend the rest of my life with her."

UPDATE (Howard)(1:30 p.m.): After her brief appearance in City Court, Suzanne Corona said she plans to retain a private attorney and challenge the constitutionality of laws making adultery a crime.

Suzanne M. Corona, the 41-year-old Batavia woman charged with adultery for allegedly engaging in sex in a public park, arrived at the Genesee County Courthouse this afternoon for her arraignment in City Court.

She walked up to the courthouse holding hands with her husband of six-and-a-half years, Joe Corona.

In an impromptu press conference, Corona denied the charges, took issue with being charged with adultery, apologized to mothers while denying that children could see anything. She further denied a police accusation that her alleged paramour, Justin Amend, had his pants down. Both denied that his genitals were exposed and said the whole affair should be a private matter between her and her husband.

Joe Corona said he stands by his wife and intends to be married to her for another 40 years.

Thomas M. Rastelli, 26, of Dewhirst Road, Gasport, is charged with a felony count of DWI, driving with a BAC of .08 or greater, leaving the scene of a personal injury accident, aggravated unlicensed operation, failure to stop at a stop sign and consumption of alcohol in a motor vehicle. Rastelli is accused of being involved in a one-car accident at 1:12 a.m. today on Route 5 in Pembroke. The incident was investigated by Deputy Jason Saile. Rastelli was jailed on $20,000 bail.

Shawn Michael Irish, 39, of Lake Street, Perry, is charged with illegal possession of a hypodermic instrument and unlawful possession of marijuana. Irish was stopped on May 16 by Deputy Brian Thompson in the area of 16 Bank St. for an alleged traffic violation. Thompson's K-9 reportedly alerted on Irish's vehicle.

Ronald Lewis MacGregor, 41, of Cole Road, Le Roy, is charged with criminal possession of a controlled substance. MacGregor was stopped on May 16 by Deputy Brian Thompson in the area of 16 Bank St. for an alleged traffic violation. Thompson's K-9 reportedly alerted on Irish's vehicle.

Kenneth M. Gray, 18, of 77 Myrtle St., Le Roy is charged with criminal mischief and robbery, 3rd. Gray is accused of forcibly taking property from a friend and then damaging the property during an alleged domestic incident on Sunday. Gray was jailed on an unspecified bail.

Jason M. Brooks, 32, of 98 Wilmont St., Rochester is charged with disorderly conduct and resisting arrest. Brooks is accused of being involved in a fight on Mill Street on Monday. Det. John Condidorio responded to the scene. During the investigation, Brooks allegedly used profane language numerous times in public and after being advised he was under arrest, allegedly physically resisted causing a minor struggle to ensue.  Brooks was jailed on $3,000 bail.

Michael L. Ruth, 42, of Stafford, is charged with harassment, 2nd. Ruth was arrested by State Police for an alleged incident at 1:12 p.m., May 17, in Bergen. No further details were released.

Jonathan Martinez, 22, of Batavia, is charged with DWI, operation impaired by drugs, unlawful possession of marijuana, speeding and driving without a license. Martinez was stopped 10:15 p.m., Monday on Route 33 in Bergen by State Police.

Batavia police spokesman Eric Hill pretty much admits that the police department is surprised that an alleged sex act in a Batavia park has become big regional news.

The initial press release was "local only," meaning it went out only to The Batavian, WBTA and the Batavia Daily News. Regional TV, radio and newspaper editors read all of those websites to help keep tabs on Batavia, so by Monday afternoon, the police department was besieged by a steady stream of media requests for more information.

At 3:45 p.m., Hill stood before half-a-dozen TV cameras and a barrage of mics and told the assembled reporters many things we already know, and added a couple of new details.

The angle driving the story up until now is the rare charge of adultery against Suzanne M. Corona, 41, of Ousterhout Street, and that unusual charge could lead to national news outlets picking up  "BATAVIA , NY" datelined news stories.

If not "adultery," then Corona's comments late this afternoon to WHEC out of Rochester will certainly add a more sensationalistic angle.

Corona said that her husband of seven years is transgendered and that they have been unable to have sex. That is part of the explanation of what she calls “inappropriate behavior.”

Corona told News 10NBC, “One thing lead to another and this is what ended up happening…I feel terrible, especially for my family. It’s an embarrassment for my family. It just happened. There was no reason for it...it just occurred and obviously I wish it never happened. It wasn’t planned. I am very sorry for the situation.”

Corona also denied police allegations that she was actively engaged in sexual intercourse with 29-year-old Justin Amend on a picnic table in Farrall Park when Officer Matthew Baldwin arrived on scene at 5:15 p.m., Friday.

In an attempt to confirm Corona's statements with her, I drove over to her house after reading the WHEC story. She was not at home, but her unshaven and slightly disheveled husband was.

The 42-year-old Mr. Corona said he's been reading The Batavian. He said he wondered why nobody was considering him in this situation. I said that normally we don't try to talk directly with people involved in pending legal cases.

I asked him if he had seen the comments that his wife made. He said yes. I said, "You've seen her latest comments to News 10?" He said, "yes." I asked, "any reaction?" he said, "in what way?"

I asked him what he thought about her saying he was transgendered, and he said, "Do I look transgendered to you?" I said, "no," and he said, "well, there you go, then."

At this point, another reporter walked up. I reached for my tape recorder and asked to record our conversation. He said, "no."  I then asked him, "but you do categorically deny what she said about you being transgendered." He said, "I don't understand your question." I said I just wanted to be clear that I understood exactly what he said. He told me I heard what he said.

He then told me that he's been reading what I've written about the case and considered me unfair and very narrow minded. He then backed into his doorway and shut the door.

As for Friday's incident, Officer Hill said that when Officer Baldwin approached the allegedly copulating couple, Amend had his pants down, but that Corona was mostly clothed.

"He asked what they were doing and they said, 'Just talkin'," Hill said. "Obviously, they weren't just talking."

Hill later said that upon more questioning, Corona said that they were just making out.

He described both as intoxicated at the time.

Officer Baldwin knew Corona was married, Hill said, because police have previously responded to calls at her residence.

Baldwin decided to charge Corona with adultery because the alleged facts as he knew them fit the penal code.

Section 255.17 of the New York State Penal Code reads:

A person is guilty of adultery when he engages in sexual intercourse with another person at a time when he has a living spouse, or the other person has a living spouse. Adultery is a class B misdemeanor.

A reporter also asked if Corona was married to, or formerly married to, any member of the Batavia Police Department. Hill said she has no direct relation to anybody in the police department.

UPDATE 11:05 p.m.: WHEC has deleted from its story online the transgender reference. I just spoke to a person on the news desk at WHEC who said, "I guess they felt it wasn't really relevant to the story."  On further discussion he said, "she made all kinds of excuses" and added again that this excuse just didn't seem relevant or fair to the husband since they couldn't check it out.

UPDATE 11:30 p.m.:  From WHAM 13's Sean Carroll:

The woman involved is charged with adultery in part because of statements she made to police.  According to court papers she told an officer after her arrest:

"Officer I know what I did was inappropriate and I apologize but you'd understand if you knew what my life was like.  I have a transgender husband and we never have sex.  One thing led to another."

Carroll also reports that he spoke with Corona, and she didn't deny engaging in sex, "However, she said police are painting a picture that isn't accurate.  She insists nobody was nearby and if they were that they would not have seen anything inappropriate."

Richard John Abramski, 22, of Main Road, East Pembroke, is charged with disorderly conduct. Abramski is accused of obstructing traffic in the area of 1993 Genesee Street, East Pembroke, by standing in the drive lane, causing traffic to move to avoid hitting him. Danny J. Torok, 23, of 12 Elm St., Batavia, is charged with harassment, 2nd, and endangering the welfare of a child. Torok is accused of slapping, pushing and pulling the hair of his girlfriend while holding his 4-month-old daughter. He was jailed on $2,500 bail.

Jeremy Dean Lyons, 25, of Judge Road, Oakfield, is charged with unlawful possession of marijuana, unsafe lane change and speeding. Lyons was stopped by Deputy Thomas Sanfratello at 5:25 p.m., June 1, at 14 Weber St., Oakfield.

Joseph Stephen Vernaccini, 34, of Clipnock Road, Stafford, is charged with DWI, failure to keep right and refusal to take breath test. Vernaccini was reportedly involved in a one-car accident 12:44 a.m., Saturday, in the area of 7000 Route 5, Le Roy. Vernaccini was jailed on $500 bail.

Justino Sanchez, 50, of West Ridge Road, Brockport, is charged with DWI, aggravated unlicensed operation, failure to keep right, improper right turn. Sanchez was stopped by Deputy James Diehl at 10:47 p.m., Friday, in the area of Route 98 and Edgerton Road, Elba. He was jailed on $1,800 bail.

A 17-year-old from Clarence was arrested by State Police in Darien at 8:05 p.m., Wednesday. She is charged with DWI, failure to keep right, crossing road hazard markings and unlawful possession of marijuana.

A 16-year-old from Williamsville was arrested by State Police at 8:05 p.m., Wednesday, in Batavia for unlawful possession of alcohol.

John J. Smalley, 47, of Oakfield, is charged with harassment and criminal mischief. Smalley was arrested by State Police at 12:50 a.m., Sunday, in the area of 7020 Macumber Road, Oakfield. No further details were released.

Convicted murderer Scott Doll allegedly tried to smuggle aspirin into the Genesee County Jail.

Chief Deputy Jerome Brewster said that lab results came back this morning on the white powder reportedly found hidden on Doll's body.

Brewster said the green balloon containing the aspirin was taped to Doll's inner buttocks.

"I have no idea why (he hid aspirin on his body), Brewster said.

Doll still faces a count of promoting prison contraband, because even aspirin can't be snuck into the jail.

If the substance had turned out to be any kind of more serious drug, the charges would have been elevated, Brewster said.

Doll was allegedly found with the balloon on his body during a routine jail processing search after he was convicted May 21 of killing 66-year-old Joseph Benaquist by bludgeoning him to death outside his Pembroke home on Feb. 16, 2009.

Doll is scheduled to appear on June 29 in City Court to answer the charge of promoting prison contraband.

He will be sentenced on the murder charge on July 2. He faces a sentence of either 15 years to life or 25 years to life.

A 41-year-old Batavia woman has been charged with adultery after being caught engaged in sexual intercourse on a picnic table in Farrall Park.

The woman was arrested along with a 29-year-old Oakfield man and both were charged with public lewdness.

The man was identified by Batavia Police as Justin M. Amend.

Because the woman is married with children, The Batavian has chosen to withhold her name.

UPDATE: After more thought (see our post explaining the reversal of the decision here), we've decided to publish the female suspect's name. It is Suzanne M. Corona.

Sgt. John Peck said that Officer Matt Baldwin was dispatched to Farrall Park about 5:15 p.m. after parents in the park called police. Baldwin witnessed the couple still engaged in sex when he arrived.

"There was a little alcohol involved," Peck said. "They initially didn't seem too embarrassed."

Peck acknowledge that adultery charges are rare these days.

"Many people probably don't realize it's still a crime," Peck said.

He said Amend was not charged with adultery because he was apparently not aware the woman was married.

Both suspects were issued appearance tickets for City Court on June 8 and released.

Thomas R. Allen, 28, of Elmsford Drive, West Seneca, was charged with assault, 3rd, after allegedly striking another patron in the face causing a split lip and bruising. He was jailed; $750 bail.

LaToya D. Jackson, 24, of Batavia, is charged with disorderly conduct, resisting arrest and violation of probation. Jackson was arrested by State Police at 4036 W. Main St., Road, Batavia, at 12:05 a.m., Monday. No further details available.

A driver on Walker Road said he didn't see a sign for an upcoming curve, leading to a single-vehicle rollover accident at 2:45 a.m. today in Darien.

The driver, 18-year-old Conor F. McNealus suffered "complaint of pain" injuries, according to the report prepared by Deputy Eric Seppella, but was not transported to a hospital.

McNealus, a resident of 19 Hubbell St., Canandaigua, was cited for alleged DWI, driving an uninspected vehicle and speeding.

His passengers, Taylor M. Selkirk, 19, Corbyn B. Manning, 18, and Joel Stitt, 19, were not injured.

The group was traveling in a 1996 Honda sedan.

McKeever is accused of exiting his home with a shotgun and approaching his son with it during a domestic incident. McKeever then approach a car and shot out the passenger-side window. At McKeever's arraignment, an order of protection was issued and McKeever was ordered to turn over all of his weapons to the Sheriff's Office.

Randell Lee Krtanik, 59, of State Street, Batavia, is charged with DWI, moving from lane unsafely, failure to reduce speed for hazard. Krtanik was arrested following a traffic accident on Bethany Center Road, Bethany, at 11:33 a.m., May 22. Krtanik was uninjured in the accident, and neither the mailbox he hit nor his vehicle were damaged. Krtanik allegedly swerved to avoid another car making a turn. The accident was investigated by Sgt. Thomas Sanfratello.

Melvin Leverne George, 42, of E Avenue, Akron, is charged with trespass. After being arrested for an alleged fight on Council House Road, Alabama, George is accused of staying on private property after being told to leave.

Robert Conrad Grant, 48, of West Main Street, Batavia, is charged with criminal possession of stolen property. Deputy Jason Saile reports that at 2:22 a.m., Sunday, he stopped Grant on Angling Road, Pembroke. Upon investigation, Saile determined that Grant was allegedly in possession of stolen telephone wire from a property on Route 5, Pembroke. Grant allegedly fled the scene of the traffic stop on foot. Grant was also charged with unlicensed operation, driving left of pavement markings, unregistered motor vehicle, consumption of alcohol in a motor vehicle and failure to yield to an emergency vehicle. Grant was issued an appearance ticket.

An unshaven Scott F. Doll appeared in City Court this afternoon to deny a charge of promoting prison contraband.

Doll is accused of hiding on his body a green balloon containing a white powder when he was admitted to Genesee County Jail on May 21 following his conviction by a jury of murder, 2nd, for killing Joseph Benaquist.

Lab results on the white powder are not yet available.

After Doll's attorney, Daniel Killelea, entered Doll's not guilty plea, Judge Robert Balbick set an other hearing date for June 29, giving the county ample time to produce the lab results.

Even though Doll, who appeared in the jail's orange jumpsuit and shackles, is locked up without bail on the murder conviction, Killelea ask for a nominal bail in the case so that Doll might get credit for time served on the contraband charge.

Balbick declined to set bail since Doll showing up for future appearances in the case is not in doubt.

Lee Earl Galton, 31, of East Main Street, Angelica, is charged with criminal mischief and trespass. Galton is accused of allowing a vehicle to be driven onto a farmer's cornfield, then setting up camp on the field and burning a wood campfire while camping overnight on the recently planted field, all without permission of the landowner. The field is in the area of 9666 Route 77, Darien. Also arrested and charged in the alleged incident was Bethanne Marie Brown, 27, of Angelica.

Michael John Johnson, 19, of Sprucewood Road, Cheektowaga, is charged with assault, 3rd. Johnson is accused of using Super Glue on a person who was sleeping. He is accused of trying to glue one of the person's eyes and ears shut. Johnson was jailed on $500 bail.

Joseph M. Miano, 20, of Akron Road, Corfu; Joseph N. Striegel, 19, of Main Road, Pembroke, as well as a two 17-year-olds from Pratt Road, Batavia, are charged with unlawful possession of alcohol by a person under 21. At 2:49 a.m., Tuesday, Deputy Jason Saile was dispatched to the TA Travel Center where a group of people were reportedly causing a disturbance. Striegel was also charged with petit larceny for allegedly stealing a laser pointer.

Sandra Lynn Pearce, 51, of Genesee Street, Corfu, is charged with disorderly conduct. Pearce is accused of interfering with a police investigation of a reported disturbance at an address on Genesee Street.

Robert Gehron McCarthy, 52, of Belvadere Lane, Batavia, is charged with harassment.  McCarthy is accused of getting into a fight with another person while at the dog show in Alexander Fireman's Recreation Hall.

James Ross Sweet, 49, of Shady Lane, Batavia, is charged with disorderly conduct. Sweet was taken into custody at 2:59 a.m., Monday, after the Sheriff's Office was called to the Country Meadows Trailer Park on three separate occasions within an hour's span. Sweet was reportedly playing his music too loud, honking a car horn more than 10 times and using profane language. Sweet was jailed on $250 bail.

A 17-year-old from Depew is accused by Batavia City Police of providing a false identification to a police officer on May 19, even after being warned that it was a crime to provide a false identity. Her true identity was later learned by police and she was located on Monday and arrested. She was jailed on $1,000 bail.

Kevin J. O'Connell, 29, of 433 E. Main St., Apt. 8, Batavia, is charged with endangering the welfare of a child and harassment, 2nd. O'Connell was charged following a domestic incident in which he allegedly hit another person and the child was knocked down.

Judson James Adamski, 42, of 142 Pamona Drive, Rochester, is charged with disorderly conduct. Adamski is accused of walking into a Subway restaurant in Pembroke at 9:02 p.m., Monday and yelling profanities.

Michael Cameron Humphrey, 19, of East Bethany Road, Le Roy, is charged with unlawful dealing with a child and criminal nuisance, 2nd. Humphrey is accused of hosting an underage drinking party. The alleged party was discovered while the Sheriff's Office investigated a 9-1-1 hang up call.

Cheryl A. Wittman, 40, of Bergen, is charged with acting in a manner injurious to a child under 17. Wittman was arrested by State Police following an alleged incident reported at 3:16 p.m., Saturday. No further details were released.

Matthew L. Hume, 19, of Silver Creek, and Joshua Fisher, 24, of Warsaw, are charged with unlawful possession of marijuana. Hume and Fisher were cited by State Police at 12:10 p.m., Wednesday, on Route 19 in Le Roy.

Eric J. Chaffee, 28, of Akron, is charged with DWI, driving with a BAC. of .08 or greater with two priors and unsafe turn. Chaffee was stopped at 11:46 a.m., Wednesday, by State Police on Akron Road in Pembroke.

Keith J. Lyman, 37, of 47 Clark St., Brockport, is charged with harassment, 2nd. Lyman is accused of contacting a City Court employee by telephone and threatening that person. He was jailed on $5,000 bail.

Keith Joseph Lyman, 37, of 41 High St., Brockport, is charged with harassment, 2nd.  Lyman is accused of kicking a corrections officer while being booked on another charge.

Duffy Starks, 17, of 20 N. Spruce St., Batavia, was arrested for alleged failure to comply with the conditions of his release on a previous harassment and unlawful imprisonment charges. Starks was jailed on $10,000 bail.

Nicole M. Dellapenna, 23, of 6120 Byron-Elba Road, Byron, is charged with disorderly conduct. Dellapenna is accused of repeatedly yelling obscenities outside Billy Goat's bar on West Main Street. She was arrested at 12:48 a.m., Sunday.

LaToya D. Jackson, 24, of 4036 W. Main St., Batavia, is charged with disorderly conduct. Jackson is accused of yelling obscenities while on State Street. She was arrested at 9:50 p.m., Friday.

Kelly A. Sparks, 27, of 235 Orland Road, Rochester, is charged with DWI and refusal to take breath test. Sparks was stopped at 2:45 a.m., Monday, by Le Roy PD Officer Robert Tygart for alleged failure to give half of the roadway and alleged failure to stop for a stop sign.

Michael J. Tobias, 19, of 131 State St., Batavia, is charged with petit larceny. Tobias is accused of shoplifting at Tops Market.

Markeda D. Starks, 19, of 5 Wood St., Batavia, is charged with criminal contempt. Starks is accused of approaching a person whom she was ordered to stay away from.

Jonathan Chad Sisk, 37, of Chili-Riga Center Road, Churchville, is accused of petit larceny. Sisk is accused of taking a BB gun from Walmart without paying for it.

A 16-year-old Batavia boy is charged with trespass. The youth is accused of entering a building on West Main Road, Town of Batavia, without permission of the owner.

Jose Juan Santiago Burgos, 21, of Telephone Road, Le Roy, is charged with criminal mischief. Santiago Burgos is accused of breaking the window of a tractor on Bethany Center Road.

Carly A. Herzog, 29, of 25 Morven Road, Rochester, is charged with DWI, driving with a BAC of .08 or greater and having a suspended registration. Herzog was stopped at 3:14 a.m., Saturday, on Church Street in Le Roy by Sgt. Michael J. Hare.

Scot Geoffrey Judd, 27, of Caroline Street, Albion, is charged with unlawful possession of marijuana. Judd was stopped for an alleged traffic violation by Sgt. Brian Frieday on West Main Street Road in Batavia.

Lee J. Zawicki, 22, of Batavia, is charged with unlawful possession of marijuana. Zawicki was cited by State Police at 1:05 a.m., Thursday, in Pembroke.

An apparent fight broke out in UMMC's emergency room Thursday evening, and two men were jailed as a result on $7,500 bail each.

The incident started around 7:35 p.m. while a Batavia Police officer and a State Police officer where at the ER on unrelated and separate investigations. The officers observed a commotion in the waiting room and moved to intervene and separate the parties.

One of the men in the waiting room struggled with officers and a woman who was in the ER for treatment of an earlier head injury jumped on the back of the Trooper.

She was Tasered by police.

Another man apparently involved in the altercation is accused of threatening to kill hospital staff.

Backup was called in from Batavia Police and State Police to help get the situation under control.

Charged with disorderly conduct and menacing, 3rd, was Ryan M. Norton, 35, of 45 Summit St., Le Roy. Norton is accused of threatening hospital staff.

Kyle W. Nash, 22, of 38 Church St., Le Roy, is charged with disorderly conduct and resisting arrest.

Alexandria M. Zarty, 18, of 38 Church St., Le Roy, is charged with obstructing governmental administration.

Norton and Nash were jailed. Zarty was released on her own recognizance so she could receive treatment in ER for her earlier head injury.

Batavia Polcie are looking for a man allegedly involved in an altercation on Wood Street around 5:30 p.m.

The man allegedly stuck another person in the face with an unknown object.

According to Det. Kevin Czora, the suspect and the victim were involved in a verbal argument. The assailant went to his car, grabbed some sort of object, came back and struck the victim in the face.

The victim suffered facial cuts and was transported by ambulance to UMMC.

The suspect is described as a black male in his late 20s. He fled the scene in a red Chevy Monte Carlo. The Monte Carlo may already have had a busted passenger window.

It's unknown, Czora said, whether the suspect was also injured.

A former corrections officer admitted in Genesee County Court this afternoon that he filed false workers compensation claims and stole thousands of dollars from the state.

James S. Gibbs, 34, faced a 24-count indictment, but reached a plea agreement to admit to one count of grand larceny and one count of filing false instruments.

As part of the plea, Gibbs will be required to pay back to the state $40,000, with a $20,000 payment due before he is sentenced. 

The maximum sentence under the plea agreement is four months of intermittent incarceration and five years probation and a $5,000 fine.

Gibbs was also required to resign from New York State Corrections.

Gibbs was arrested in October for receiving disability benefits while operating a company plowing snow and sealing driveways.
