Brian M. Raphael, 21, of 4 Noonan Drive, Batavia, is charged with DWI, driving with a BAC of .08 or greater and criminal possession of a weapon. Police Officer E.E. Bolles reports that he found Raphael sleeping in his car with the engine running Saturday at 3:10 a.m. at 419 E. Main St., Batavia. Upon his arrest, Raphael was allegedly found in possession of a collapsible billy club.

Michael D. Snyder, 37, of 679 E. Main St., Apt. 4a, is accused of criminal contempt and harassment. Snyder allegedly violated the terms of an order of protection by shoving his girlfriend. He was jailed without bail.

Timothy P. Tucker, 35, of 12 Ellicott St., is charged with DWI, refusal to take breath test, failure to stop for a stop sign, speed not reasonable and prudent, improper turn and leaving the scene of an injury accident. On Sunday at 1:48 a.m., Tucker allegedly ran a stop sign from northbound Union Street at Oak Street. His vehicle reportedly continued through the intersection until it hit a tree. Officer Dan Coffey reports that Tucker allegedly fled the scene on foot. His female passenger suffered minor injuries in the accident. Tucker was found a short time later at his residence, according to Officer Coffey.

James Frank Webb, 27, of 10215 Colby Road, Darien, is charged with criminal contempt and harassment. Webb is accused of violating an order of protection that barred him from contacting a particular person. He allegedly called that person on the phone.

Shaundalee M. Hill, 20, of 81 Lyncourt Park, Greece, is charged with DWI and driving with a BAC of .08 or greater. Hill was arrested by Deputy Tim Wescott after Hill was reportedly involved in a one-car accident Fisher Road in Oakfield at 6:46 p.m. on Friday. Hill was also charged with unlicensed operation of a vehicle and having an open container.

Adam M. Ganzhorn, 25, of Town of Batavia, is charged with obstruction of governmental administration and filing a false report of an incident. He was arrested at 4346 Batavia-Elba Townline Road by State Police and jailed on $2,000 bail. No further details available.

Christopher A. Saddler, 25, of Albion, is charged with petit larceny. Saddler was arrested in the Town of Batavia by State Police. No further details available.

A young Elba/Byron-Bergen team had some lessons to learn tonight, homecoming night, according to Head Coach Michael Cintorino, so he kept his players on the field, fighting until the final second.

Cintorino didn't want the referees to let the clock run down at the change of possession with more than a minute left in the game and the 28-0 score favoring a bigger, more experienced Notre Dame squad.

"What we’re trying to do is get them that experience and really understand what a tough team like Notre Dame, what it takes to get them where they are," Cintorino said. "We want them to understand that they have a little work to do in the coming years to match a team like Notre Dame."

There was a lot of fight in the Lancer's tonight, but critical mistakes and an inability to string together enough consecutive good plays on the offensive side to sustain a drive had Elba/BB fighting uphill through all four quarters.

Trouble started on Elba's first drive when it was stopped short by an interception. On the next play, Mike Pratt had a clear 17-yard path to the end zone. A missed PAT put the score at 6-0.

On its next possession, the Lancers failed to move the ball and a high snap on a fourth-down punt turned into a two-point safety when the punter kicked the ball out of the back of the end zone. That made the score 8-0.

Pratt scored later in the first quarter on a four-yard run, and with another missed PAT, the Irish were up 14-0.

The Irish would score again in the second quarter on a 11-yard run by Mike Aina, and again in the third quarter on a three-yard rush by Pratt, making he score 28-0.

As the game wore on and the Irish showed more preference for the clock-devouring run game, Elba's defense displayed some grit in forcing more than one three-and-outs in the second half.

"(The defense was) very impressive," Cintorino "If you look at what ND has been doing this year, they’re a power running team and they throw quick passes. When they run, both Beau Richter and Mike Pratt are very hard runners. Their offensive line is big and strong and they get a great push and we were able to stand up to them."

Cintorino said he also came away from the game hopeful about his young team's offense, which features a promising junior quarterback in Eric Kowalik and an athletic junior receivers, Tess Schramm and Joe Burr.

"We have some young guys out there and they’re very close to making these big plays," Cintorino said. "We work on it the rest of this season, we work on it during the off season and we come back next a little bit more veteran and we get the job done."

Notre Dame (5-1) Head Coach Rick Mancuso said he's also seen the weekly improvement in Elba, which came into the game with a 2-3 record, and said his team didn't take the Lancers lightly.

"Week in and week out, every team is a test, and they’re very well coached," Mancuso said. "They’ve got a great group of guys in that coaching staff and they’ve got a really nice team. We’ve watched them -- this is the sixth week, we’ve got a lot of film on them, we’ve seen a ton of progress week-to-week. We didn’t come out here and expect to have an easy time, that’s for sure."

Mancuso said he was particularly proud of his offensive line in helping to establish the run game early

"Our linemen did a great job, I thought," Mancuso said. "We’re starting to come around. Those younger kids that started out the season for us, they’re not young kids any more. Everybody is pretty much seniors and four-year players now."

Notre Dame heads into sectionals with a 5-1 record, same as Holley (5-1) and Attica (5-1), who played a nail-biter of a game today, reaching the final nine seconds of game time in a 0-0 tie. Attica pulled it out on a 35-yard field goal by Zack Fleiss, ruining Holley's bid for an undefeated season and giving the three top teams a share of the Genesee Region league title.

Mancuso said he feels good about his team heading into sectional play.

"Our loss last week (to Holley) was very difficult to take," Mancuso said. "I was really interested to see how the kids would challenge themselves this week and get back in the saddle and I thought they did a nice job doing that."

For Elba/BB, Pete Pryzbl had 9 carries for 52 yards. Schramm, two catches for 37 yards. Joe Burr had two catches for 18 yards. Kowalik completed five passes in 21 attempts for 58 yards. On Defense, Burr had seven tackles and six assists. Brandon Shuknecht had five tackles and a fumble recovery. Tom Fowler had six tackles and three assists.

James S. Gibbs, 39, of Batavia, is charged with grand larceny, insurance fraud and offering false instruments for filing and a violation of the worker's compensation law. Gibbs is accused of collecting full disability related to an on-duty injury while drawing income from plowing driveways and sealing parking lots in Batavia. Gibbs was jailed on $10,000 bail.

Kathleen M. McBride, 44, of 115 State St., lower, is charged with assault and criminal possession of a weapon. McBride is accused of cutting her husband's face during a domestic dispute. Her husband was not seriously injured in the alleged attack. After he was cut, her husband allegedly pushed her onto the bed and held her there, not allowing her to get up. McBride was jailed on $3,000 bail.

Jean Marie Lorenz, 49, of 7907 Allegheny Road, Corfu, is charged with two counts of assault. Lorenze allegedly attacked and cut two people with a knife Saturday night. Lorenz was reportedly drunk at the time. She was jailed on $1,000 bail.

Karen Ann Garcia, 45, of 13535 Miller Road, Albion, is charged with endangering the welfare of a child. Gardia allegedly allowed her daughter to shoplift at Kmart. Garcia also reportedly lied about her daughter's name and age.

Jamie Luis Santiago, of 5057 Hundredmark Road, Elba, is charged with assault. Santiago was taken into custody for an alleged incident July 12. Santiago allegedly punched his wife in the face causing injury on that date.

Sath P. Dhanda, 29, of 219 Washington Ave., Batavia, is charged with disorderly conduct and assault. Dhanda allegedly instigated a fight. At the time of his arrest, Dhanda allegedly made verbal threats to a police officer. Dhanda was arrested at 7:48 p.m. on Friday.

Dylan A.J. Dembrow, 18, of 14 Pearl St., Akron, is charged with unlawful dealing with a child. Dembrow is accused of hosting an underage drinking party at a location on Akron Road in Pembroke on Saturday night.

James M. Wisniewski, 19, of Attica, was charged by State Police with harassment. The charge stems from a Sept. 19 incident in the Village of Alexander. No further retails are available at this time.

Thomas J. Preedom, 21, of Wyoming, is charged by State Police with rape in the second degree and acting in a manor to injure a child. According to the State Police blotter entry, Preedom is accused of raping an underage girl. The alleged incident took place in the City of Batavia on Sept. 25. He was subsequently charged with bail jumping, criminal mischief, escape and harassment. Cash bail was set at $50,000.

Ronald G. Albertson, 51, of Albion, is charged with DWI. Albertson was stopped by State Police in Elba on at 10:03 p.m. Saturday.

Joseph Kyle Loveland, 26, of 665 Niagara Falls Blvd., Amherst, is charged with harassment. Loveland allegedly punched another person in the face while at Chestnut Ridge Country Club in Darien at about 6:30 p.m. on Saturday. The victim was reportedly treated at the scene and declined transportation to a hospital. Loveland was issued an appearance ticket. The incident was investigated by Sgt. Greg Walker.

Pamela A. Loughridge, 41, of 5630 Buffalo Road, Apt. 5, Churchville, is charged with DWI, aggravated DWI with a BAC of .08 or greater, aggravated unlicensed operation of a vehicle and moving from the lane unsafely. Loughridge was stopped at 6:04 p.m. yesterday by Deputy Chad Minuto on Route 237 in Byron.

Justin J. Jaszko, 30, of 8087 Kelsey Road, Batavia, is charged with criminal trespass. Jaszko allegedly entered the residence of his child's mother in Oakfield and refused to leave. The alleged incident occurred Friday morning at 8:45. Deputy Christopher Parker handled the call.

Ann M. Burgler, 49, of 6592 Royal Parkway, Lockport, is charged with DWI, DWI with a BAC of .08 or greater and failure to keep right. Burgler was stopped by Deputy Kevin McCarthy on Route 5 in Pembroke at 2:54 p.m. on Saturday.

Adam M. Gaylord, 29, of Byron, is charged with DWI, operating a vehicle with a BAC of .08 or greater and criminal possession of a weapon. Gaylord was stopped by State Police on Chapel Road in Elba at 10:50 p.m. on Friday.

Stephen L. Nichols, 33, of New York City, is charged with DWI and DWI with a BAC of .08 or greater. Nichols was stopped by State Police in Pavilion at Route 63 and Route 20 at 2:50 a.m. on Saturday.

Attorney Thomas Burns won't get a change of venue for his client Matthew Wells, at least not yet, according to a ruling handed down by the New York Supreme Court, Appellate Division, Fourth Judicial Department.

Wells is one of three men accused of robbing the M&T Bank branch in Elba on June 18 and then leading local law enforcement on a six-hour manhunt through the fields and woods between Batavia and Oakfield.

Burns argued that Wells could not get a fair and impartial jury in Genesee County because many residents -- as evidenced primarily by comments left on The Batavian -- took offense to the perception that three city slickers could get away easily with a bank robbery in a rural county. Burns, in his motion, picked up on the phrase of one comment on The Batavian about dishing out "rural justice."

Burns also suggested that the only a fraction of Genesee County residents are black, so that it would be hard to seat a jury of peers for his African-American client.

The appellate judges ruled that Burns did meet the burden of proof that there is "reasonable cause to believe that a fair and impartial trial cannot be had." But the single-page ruling left open the ability for Burns to appeal again during the jury selection phase of a trial.

It's rare -- if not unheard of -- for attorneys to be granted a change of venue before jury selection begins, but if Burns had not filed the motion now, he could not file a motion -- under rules of the court -- for a change of venue later.

Wells is the only one of the three defendants to not plead guilty. Both Damone Dillon and Dennis Abrams have admitted to their roles in the June 18 robbery. Abrams, who planned the heist, is facing a lengthy prison term. Wells is accused of entering the bank with Abrams and actually participating in the stick up, while Dillon held the door and claims to have been a reluctant participant.

Neither defendant has been sentenced yet.

Organizers are calling the Genesee ARC Friends & Family 5K, that was held September 19th  in Elba a BIG success!  Perfect weather conditions resulted in a record number of people participating in the event which featured a 5K race, 5K walk and a 1 ½ mile fun walk.  A great family event.

The Post Race Party had plenty of kids’ activities including Magician, Adam Michael

and music by the Buffalo Road Show.

Many area farmers contributed to our “Taste of the Elba Area” produce display, giving everyone who attended  the chance to have some fresh grown fruits and vegetables to take home with them.

Funds raised in the Genesee ARC Friends & Family 5K helps support disability services provided by ARC and funds the Genesee ARC Mary Anne Graney Memorial Scholarship.  Two past scholarship winners, Misty Stratton of Elba and Nichole Longhini of Batavia attended the event. Mary Anne Graney was a parent, educator, advocate and friend of ARC and was committed to helping enrich the lives of people with developmental disabilities and their families.  Pictured below are Graney family members.

In addition to the event’s many sponsors, runners and walkers, Genesee ARC wants to thank the Elba community, neighbors, Elba Town Board and Highway Officials, Genesee County Sheriff’s Department and Mercy EMS.  A big salute goes out to our crew of 45 volunteers who coordinated parking, registration, photo coverage, food, the kids’ zone, and ensured safety along the route.  The biggest thanks of all, goes out to the Graney family, the driving force behind the success of this event.    

A motorcyclist who apparently lost control of his bike on Swamp Road in Byron last Wednesday has died as a result of injuries sustained in the accident.

Thomas Legler, 49, of North Byron Road, Elba, died at Strong Memorial Hospital.

Legler was reportedly wearing a helmet, but it was not a Department of Transportation-approved safety helmet.

Deputies investigating the accident concluded that speed was a factor, but there is no evidence Legler was drinking prior to the accident.

Anthony J. Rivera, 25, of 208 Vermont St., #2, Buffalo, and Ilena Carrillo, 27, of the same address, and Damian Rivera-Melendez, 20, of 353 Plymouth Ave., Buffalo, are each charged with a felony count of gang assault in the 2nd degree. The trio allegedly hit a man several times, causing serious injury, following a dispute over cutting in line at Darien Lake Theme Park. The victim was not identified by the Sheriff's Office. The three suspects were jailed on $15,000 bail each.

Janette Sonia Vazquez, 24, of 854 Prospect Ave., Apt. 4, Buffalo is charged with harassment. Vazquez reportedly threatened to stab an employee of Darien Lake Theme Park.

Jody B. Gillet, 48, of 8 Pine Hollow Drive, Batavia, is charged with assault. Gillet allegedly stabbed another person several times. The alleged incident took place at Country Meadows trailer park on Sept. 5. The alleged victim was transported to Strong Memorial Hospital and has since been released. Gillet as jailed on $5,000 bail. The incident was investigated by Deputy Bradley D. Mazur and Investigator Timothy Weis.

Rebecca J. Sando, 44, of 5678 Walkers Corner Road, Elba, is charged with criminal contempt. Sando allegedly approached a woman she was barred from going near.

Sarah J. Emerson, 25, of 15 Ross St., Batavia, is charged with harassment and criminal contempt. Emerson allegedly poured a can of beer on her husband and then allegedly pushed him on his chest and face. Emerson allegedly violated an order of protection. Emerson was jailed on $1,500 bail.

Shandell M. Lissow, 21, of Brookville Road, Alexander, is charged with unauthorized use of a motor vehicle. Lissow allegedly borrowed a car from a friend and then failed to return it as agreed.

Stephen P. Medwid, 52, of 9364 Alexander Road, Alexander, is charged with DWI, DWI with a BAC of .08, failure to take breath test and failure to yield. Medwid was arrested following at traffic stop Friday at 9:29 p.m.

Pastor Mike and a few of his congregation members came out tonight to lend a helping hand for our weekly cookout at Edwards Street. We will be returning there on Sunday at 2:30 PM for Street church when Pastor Mike will be delivering the message.

This Saturday, Care-A-Van will be at 193 South Main Street Apartment Complex for grocery distribution.

We are thankful this was a fun tug of war. As we all know, many folks have their personal tugs of war going on in their lives. Care-A-Van goes forth to bring encouragment,, prayer,  hope and food to those in need.

An Elba man is in critical condition at Strong Memorial Hospital following a single-vehicle motorcycle accident on Swamp Road in Byron this afternoon.

Thomas M. Legler, 49, was reportedly not wearing a DOT-approved helmet when he apparently lost control of his bike around 3:34 p.m..

The initial investigation indicates that Legler was westbound on Swamp Road when he failed to navigate a sharp turn in the roadway. His 2003 Harley Davidson crossed the double-yellow line and then skidded on its side, exiting the roadway on the south shoulder. Legler was ejected from the motorcycle.

There were no passengers.

Speed is believed to be the primary factor in the accident. Alcohol is not considered a factor.

Legler was transported to Strong via Mercy Flight.

The investigation is ongoing and being handled by Deputy Butler, Sgt. Walker and Sgt. Scott of the Genesee County Sheriff's Office Crash Management Team.

Ninety-plus Elbans turned out Tuesday night for a town hall meeting in the Elba Central School auditorium. The purpose of the meeting was to provide information and solicit input from the community on which services residents believe are important. 

Town Supervisor Lucine Kauffman opened the meeting by giving an overview of the tentative 2010 budget and tax rates as well as those of the previous five years. Highway Superintendent Allan Totten provided information on highway maintenance costs. Town Councilman Bill Hynes explained that the town transfer station operates at a yearly loss and asked for feedback from residents regarding its future. 

The vast majority of questions were directed at Eric Wies, an engineer with Clark Patterson Associates, and Tim Hens, Genesee County Highway Superintendent. Citizens inquired about the process of forming water districts to hook up to the Monroe County Water Supply. Wies and Hens gave an overview of the Genesee County Water Project and step-by-step details on how residents can form water districts.

Kauffman said she was pleased with the turnout. 

"We gave the town residents a lot to think about tonight. We have many important issues facing us. I'm glad we got the dialogue started, and the town board is looking forward to more participation from the residents."

Billy Joe Budziszewski, 18, no permanent address, is charged with rape in the second degree and endangering the welfare of a child. Budziszewski is accused of having sexual intercourse with a 14-year-old girl in the Village of Corfu. He was jailed on $10,000 bail.

An 11-year-old boy from Harpersville is charged with rape, having sexual intercourse with a minor, a criminal sex act and sex abuse. According to a State Police blotter item, the victim appears to be 11-years-old or younger. The arrest was made in Elba. The case remains under investigation.

A woman accused of getting more than $21,000 in food stamps she shouldn't have received has been charged with seven counts of offering a false instrument for filing in the first degree.

Kelly Spenton, 36, allegedly lived with an employed person from March 2005 to March 2008 while she was collecting food stamps from the Department of Social Services.

Spenton, formerly of Elba, allegedly did not report this living arrangement to DSS.

The charges are felonies.

Batavia Town Justice Thomas Williams set bail in this case at $10,000, but Spenton is already in jail on a previous conviction.

Who would ever have thunk that the idea of a President of the United States speaking to the nation's students on the first day of school could be controversial, but in the days leading up to the speech, Obama was accused of attempting to subvert school kids, turning them all into socialists, or worse, Democrats, and/or of using the speech to push a policy agenda through Soviet-style propaganda.

Who would have thunk that a simple message: Do your homework and stay in school could be seen as an inappropriate message from the President.

Imagine, a President proclaiming the virtues of personal responsibility being blasted by the opposition party.

“At the end of the day, we can have the most dedicated teachers, the most supportive parents, and the best schools in the world – and none of it will matter unless all of you fulfill your responsibilities,” Obama said in the speech.

“Unless you show up to those schools; pay attention to those teachers; listen to your parents, grandparents and other adults; and put in the hard work it takes to succeed. And that’s what I want to focus on today, the responsibility each of you has for your education,” Obama said.

The speech didn't stir much notice in Genesee County. Only two districts were in session today -- Elba and Pembroke. The other schools start tomorrow.

Elba Superintendent Joan Cole spoke with WBTA this morning and said use of the president's speech in the class room was optional for teachers.

"We haven't had any concerns expressed by any of our parents," Cole said.

Two of the three men accused of robbing the M&T Bank in Elba on June 18 appeared in court today, and one of them, Dennis M. Abrams entered a guilty plea to one of the charges against him.

The felony conviction, as part of a plea bargain, carries a maximum sentence of 17-and-half-years in prison.

When District Attorney Lawrence Friedman informed Judge Robert Noonan of the plea arrangement, the friends and family of Abrams who were in the courtroom let out audible expressions of shock.

Abrams will be sentenced in two weeks, after a probation department review to help the judge determine an appropriate sentence. He could serve only five years, depending on Judge Noonan's ruling.

Meanwhile, co-defendant Matthew J. Wells followed Abrams into court, but he wasn't there to enter a plea. Rather the judge and attorneys were agreeing to a date for a future hearing on motions made by Attorney Thomas Burns, including a motion for change of venue.

Under questioning from Noonan, Abrams entered his guilty plea and then admitted to the bank robbery. He also said his previous confessions were true and accurate. He also agreed to testify in any trials for his co-defendants, if there is a trial (at this time, that would likely be only Wells, who is proceeding with a defense).

Co-defendant Demone Dillon entered a guilty plea two weeks ago.

Abrams and Wells remain in jail in lieu of bail.
