Matthew Kyle Johnson, 21, of 2509 E. Main Road, Pembroke, is charged with petit larceny. Johnson is accused of stealing a mobile phone while employed at Darien Lake Theme Park.

Kenneth R. MacGreagor, 23, of Cheektowaga, is charged with false personation and having no motor vehicle license. MacGreagor was stopped at 1:30 p.m. Thursday by State Police on Stephen Hawley Drive in the Town of Batavia.

Joseph Kyle Loveland, 26, of 665 Niagara Falls Blvd., Amherst, is charged with harassment. Loveland allegedly punched another person in the face while at Chestnut Ridge Country Club in Darien at about 6:30 p.m. on Saturday. The victim was reportedly treated at the scene and declined transportation to a hospital. Loveland was issued an appearance ticket. The incident was investigated by Sgt. Greg Walker.

Pamela A. Loughridge, 41, of 5630 Buffalo Road, Apt. 5, Churchville, is charged with DWI, aggravated DWI with a BAC of .08 or greater, aggravated unlicensed operation of a vehicle and moving from the lane unsafely. Loughridge was stopped at 6:04 p.m. yesterday by Deputy Chad Minuto on Route 237 in Byron.

Justin J. Jaszko, 30, of 8087 Kelsey Road, Batavia, is charged with criminal trespass. Jaszko allegedly entered the residence of his child's mother in Oakfield and refused to leave. The alleged incident occurred Friday morning at 8:45. Deputy Christopher Parker handled the call.

Ann M. Burgler, 49, of 6592 Royal Parkway, Lockport, is charged with DWI, DWI with a BAC of .08 or greater and failure to keep right. Burgler was stopped by Deputy Kevin McCarthy on Route 5 in Pembroke at 2:54 p.m. on Saturday.

Adam M. Gaylord, 29, of Byron, is charged with DWI, operating a vehicle with a BAC of .08 or greater and criminal possession of a weapon. Gaylord was stopped by State Police on Chapel Road in Elba at 10:50 p.m. on Friday.

Stephen L. Nichols, 33, of New York City, is charged with DWI and DWI with a BAC of .08 or greater. Nichols was stopped by State Police in Pavilion at Route 63 and Route 20 at 2:50 a.m. on Saturday.

Anthony J. Rivera, 25, of 208 Vermont St., #2, Buffalo, and Ilena Carrillo, 27, of the same address, and Damian Rivera-Melendez, 20, of 353 Plymouth Ave., Buffalo, are each charged with a felony count of gang assault in the 2nd degree. The trio allegedly hit a man several times, causing serious injury, following a dispute over cutting in line at Darien Lake Theme Park. The victim was not identified by the Sheriff's Office. The three suspects were jailed on $15,000 bail each.

Janette Sonia Vazquez, 24, of 854 Prospect Ave., Apt. 4, Buffalo is charged with harassment. Vazquez reportedly threatened to stab an employee of Darien Lake Theme Park.

Jody B. Gillet, 48, of 8 Pine Hollow Drive, Batavia, is charged with assault. Gillet allegedly stabbed another person several times. The alleged incident took place at Country Meadows trailer park on Sept. 5. The alleged victim was transported to Strong Memorial Hospital and has since been released. Gillet as jailed on $5,000 bail. The incident was investigated by Deputy Bradley D. Mazur and Investigator Timothy Weis.

Rebecca J. Sando, 44, of 5678 Walkers Corner Road, Elba, is charged with criminal contempt. Sando allegedly approached a woman she was barred from going near.

Sarah J. Emerson, 25, of 15 Ross St., Batavia, is charged with harassment and criminal contempt. Emerson allegedly poured a can of beer on her husband and then allegedly pushed him on his chest and face. Emerson allegedly violated an order of protection. Emerson was jailed on $1,500 bail.

Shandell M. Lissow, 21, of Brookville Road, Alexander, is charged with unauthorized use of a motor vehicle. Lissow allegedly borrowed a car from a friend and then failed to return it as agreed.

Stephen P. Medwid, 52, of 9364 Alexander Road, Alexander, is charged with DWI, DWI with a BAC of .08, failure to take breath test and failure to yield. Medwid was arrested following at traffic stop Friday at 9:29 p.m.

A warrant is being issued for the arrest of a Lockport man who failed to appear in Genesee County court this morning for his sentencing on an attempted burglary conviction.

(name redacted upon request) admitted in May to entering a portion of a business in Darien that the public was not authorized to enter and grabbing bags of money. The manager caught him before he could leave.

As part of xxxxx plea deal, Judge Robert Noonan had offered him probation with a sentence cap, but xxxxx is now looking at incarceration once he's arrested.

Noonan also indicated that both the Genesee County and Orleans County probation departments recommended Wisniewski be jailed for some time rather than given probation.

There are four primary elections in Genesee County today.

There are Republican primaries in Byron and Pembroke for town board seats.

In Darien, there's a three-way Democratic primary for two town board seats.

In Stafford, the Conservative Party will pick a candidate for Highway Superintendent.

Polls are open until 9 p.m.

John Michael Bieganski is doing fine now,  but he might not be doing so great if not for the quick action of a group of people willing to step forward and help him Saturday night after he was stabbed in the leg by a knife-wielding assailant.

Bieganski, 23, a Clarence resident, had his leg cut during Cruefest, the concert of Motley Crue at Darien Lake Theme Park.

A friend carried him from the mosh pit (a tangle of dancing males (usually) who typically bang against each other and jump up and down and side-to-side rather violently) after he had been stabbed.

Trouble started for Bieganski, according to a Sheriff's Office report, when he thought he saw a friend being tackled and punched by one or two other men. When he tried to pull one of the men off his friend -- it turned out not to be his friend who was being attacked -- Bieganski said he suddenly felt something warm on his leg, touched it and then saw the blood.

The alleged attacker is described as a white male, about 25 years old, 6-feet tall, a strong build, wearing a gray T-shirt, khaki shorts, with a buzz cut, no glasses and clean shaven.

Bieganski required 28 stitches to close a gaping 4-inch long wound on his leg.

Contrary to initial reports, his artery was not cut, but he did bleed profusely before being treated.

After the attack, Bieganski's buddy, Evan Laczi, grabbed him in a fireman's carry hold and hoisted him from the mosh pit, but according to Glenn Hall, who was one of the first people to come to Bieganski's aid, Laczi and Bieganski came through a whole crowd of people who ignored Laczi's cries for help.

"They had walked past people to get up there (the beer trailer, where Hall was located)," Hall said. "They had walked past a number of people and nobody had done anything, to help him carry his friend or anything like that. Nobody had ran up. I'm sure he screamed out more than once, 'hey, I need help' and nobody ran out to get help or anything."

Hall, a six-year veteran of the Air Force, was a volunteer for a group of recruiters trying to raise funds to help with their recruitment effort (his wife is a military recruiter), and he said when he saw Laczi carrying Bieganski with blood soaking his right leg, his military emergency training just kicked in. He didn't even think about what he needed to do.

"Many soldiers who get this kind of training face this kind of stuff all the time," Hall said. "Overseas and abroad, these are guys are real heroes and they know what they're doing, but every military member gets this kind of training ... but I'd never reached that situation (before) and I didn't know how I would react in that situation (before Saturday night)."

Hall was working the beer trailer when he heard Laczi calling for help and he looked up and saw all the blood on Bieganski's leg.

"My immediate reaction was, 'we need to do something to stop this bleeding,'" Hall said.

His first instinct was to pull off his volunteer T-shirt and then his "wife beater" undershirt, which he ripped into two so it could be used as a tourniquet. Laczi helped place Bieganski on the long towing tongue of the beer trailer (which was covered by a sheet of plywood) while a non-military man who was part of the volunteer group asked, "hey, what can I do?"

Hall had the man put as much pressure on the wound as possible while keeping Laczi's leg elevated. Laczi held onto Bieganski's head. Then Hall went to fetch Darien's security personnel, who came to the scene to confirm the report of a man stabbed, and then called for emergency medical personnel.

It took about 15 minutes, according to Hall, for emergency personnel to arrive.

"The guy was being very compliant," Hall said. "He had bought beer from me earlier that night. He was a very nice guy, but you could tell, he had a very good buzz on. But he was not really moving, not really fighting us. He was just kind of laying there, but you could see that he had a lot of pain going on. At that point, there was nothing we could do but wait for emergency medical personnel to get there."

Hall doesn't want to be painted as a hero who saved a man's life, however.

"Truthfully, I feel like we all did our parts," Hall said. "I'm happy for the guy. It turns out he's alright, but I feel like this was group effort. Everything fell into place like dominoes and the situation was handled the best it could."

"I think the military just pounds it in there so hard and you're constantly trained on it, it almost became like second nature," Hall said. 

Bieganski is out of the hospital, but whomever stabbed him is still at large. The Sheriff's Office investigation is ongoing.

Joseph D. Becerril, 21, of 320 Polebride Road, Avon, is charged with criminal possession of stolen property and petit larceny. Becerril was arrested at Darien Lake Theme Park for allegedly stealing items from cars in the parking lot. Becerril was jailed on $1,500 bail. The case was investigated by Deputy Jason Saile with assistance from deputies Frank Bordonaro and Howard Carlson as well as the State Police and Darien Lake security.

Joseph M. Hamm, 32, of 580 Glide Road, Rochester, is charged with DWI, driving with a BAC of .08 and unlicensed operation. Hamm was arrested after the Sheriff's Office received a report early Saturday morning of a car in a ditch off Sumner Road in Darien.

Eric P. North, 29, of 152 Linwood Ave., Amherst, is charged with DWI, driving with a BAC of .08 and failure to keep right. North was arrested following a traffic stop on Route 33 in Pembroke by Deputy Bradley D. Mazur.

Karen A. Dusky, 37, of 7158 Wright Road, Basom, is charged with DWI, driving with a BAC of .08, failure to keep right and endangering the welfare of a child. Dusky was stopped just after midnight Saturday morning by Deputy Patrick J. Reeves on Route 77 in Pembroke. She reportedly had a child under 17 in the vehicle with her.

Carrie M. Capizzi, 28, of 3300 Broadway, Alexander, is charged with DWI, driving with a BAC of .08 and failure to dim headlights. Capizzi was stopped for allegedly failing to dim headlights at 2:39 a.m. on Route 20 in Alexander by Deputy Howard Carlson.

Heather L. Leith, 30, of 3938  Risher Road, Youngstown, Ohio, is charged with DWI, driving with a BAC of .08 and inadequate headlights. Leith is also accused of with driving an unregistered vehicle, improper license plates and operating without insurance. Leith was stopped by Deputy Mazur just after midnight on Sunday morning. She was jailed on $500 bail.

A 17-year-old is charged with trespass. The youth is reportedly a former employee of Darien Lake Theme Park who had been banned from the property, yet was found in the park Sunday about 4 p.m..

Mitchell J. Atwell, 24, of 308 Mcintyre Road, Le Roy, is charged with harassment. Atwell is accused of making verbal threats during a dispute with a neighbor.

Christopher T. Herman, 30, of 39 Citation Drive, Henrietta, is charged with DWI, operating with a BAC of .08 and endangering the welfare of a child. Herman was stopped Sunday at 1:05 a.m. at a police checkpoint on Law Street. Herman reportedly had his 4-year-old son in the car.

Julian J. Matla, Jr., 45, of 35 Church St., Le Roy, is charged with DWI and operating with a BAC of .08. Malta was stopped at a police checkpoint at 11:58 p.m. Saturday.

Michael T. Ellis, 21, of 2781 School St., North Collins, is charged with DWI. Ellis was arrested by Batavia Police after allegedly failing to abide by rules set down in a conditional discharge for a previous DWI guilty plea.

Karen Grzybowski, 38, of 24 Audabon Terrance, is charged with harassment. The charge stems from an incident at 10:05 p.m. Saturday on Allegany Road in Darien. No details were provided.

Jacob R. Hennard, 20, of Bergen, is charged with DWI and operating with a BAC of .08. Hennard was stopped by State Police on Colby Road in Darien at 10 p.m. on Friday.

A Pennsylvania man who was reported missing after attending a concert at Darien Lake Theme Park on Friday was found dead early Sunday morning in Sunshine Lake by scuba divers investigating his disappearance.

The death of William "Billy" Sutherland, 33, of Bradford, Pa., is not considered suspicious at this time, but the investigation continues.

Sutherland attended the Toby Keith and Trace Adkins concert Friday, but became separated from his friends. The group spent several hours looking for him, but eventually returned home.

When Sutherland did not return to Bradford Saturday, his family and friends drove back to Darien Lake to look for him and contacted the Genesee County Sheriff's Office to report him missing.

After interviews with friends and family, the Sheriff's Office concentrated its search in the parking area, especially in the area of Sunshine Lake, which is located within the parking area.

There is no word on how long the search took. His body was found by divers at 1:30 a.m..

The Sheriff's Office was assisted by the security staff of Darien Lake, the Darien Volunteer Fire Department, the Alden Fire Department's water rescue team, and the Genesee County Office of Emergency Management.

A person has been stabbed near the beer gardens at Darien Lake Theme Park.

The victim's leg was cut by the knife and the artery was hit.

UPDATE: FWIW, at Darien tonight is "Cruefest – Motley Crue with Godsmack," and it appears to be the final concert on the Darien Lake schedule for the season.

Danielle L. Young, of Orchard Park, is charged  with DWI and DWI with a BAC of .08. Young was stopped by State Police on Sumner Road in Darien.

Kaylie N. Rumon, 23, of Elmira, is charged with  DWI and DWI with a BAC of .08. Rumon was stopped by State Police in the City of Batavia.

Joey Somsy, 21, of Buffalo, is charged with DWI and DWI with a BAC of .08. Somsy was stopped by State Police on Colby Road in Darien.

Brian P. Verney, 25, of Attica, is charged with petit larceny and possession of a hypodermic instrument. Verney is accused of shoplifting from Wal-Mart. He was arrested by State Police and jailed without bail.

Amy L. Showler, 34, of Batavia, is charged with petit larceny. Showler is accused of shoplifting from Wal-Mart. She was arrested by State Police.

A 15-year-old from Batavia is charged with petit larceny and trespass. The alleged crime occurred on West Saile Drive on Aug. 23 in Batavia and was investigated by State Police.

Erica Michelle Raphael, 24, of 335 Bank St., Batavia, is charged with petit larceny.  Raphael is accused of shoplifting from Target.

Gregory M. Brew, 24, of 4799 Linden Road, East Bethany, is charged with DWI and unlicensed operationof a vehicle. Brew was arrested at Strong Memorial Hospital following a rollover accident on East Road at 10:38 p.m. on Wednesday. No other vehicles were involved in the accident. Deputy Matt Butler investigated the incident.

Tyrell T. Harris, 19, of 114 W. Englewood Ave., Teaneck, N.J., and William P. Ponder, 19, of 3905 Carpenter Ave., Bronx, are charged with trespass. Harris and Ponder were allegedly involved in an incident at College Village and told to leave. After Sheriff's deputies left College Village, Harris and Ponder allegedly returned. They were jailed on $250 bail each.

William Grey Neff, 35, of 1210 S. Main St., Medina, is charged with forcible touching. Neff is accused of forcibly touching a woman.

Kelly A. Decker, 23, of 127 Liberty St., upper, Batavia, is charged with petit larceny. Decker is accused of stealing $200 from July 23 to Aug. 20 while employed as a cashier at Kmart.

Dustin R. Benham, 20, of Darien, is charged with petit larceny and criminal possession of a controlled substance. Benham was arrested by State Police in the Town of Batavia. He was held without bail. No other details were provided.

James S. Nottingham, Sr., 29, of 511 E. Main St., Batavia, is charged with assault in the second degree, two counts of endangering the welfare of a child, harassment, aggravated DWI, aggravated unlicensed vehicle operation and unlawful possession of marijuana. James allegedly got involved in an argument with a woman and during the incident, he allegedly threw a chair that struck a 4-year-old in the face causing an injury. James also allegedly grabbed another child by the hair. James then reportedly left the scene of the incident in a car. He was subsequently stopped and arrested for alleged DWI and marijuana possession. He was jailed on $3,000 bail.

Peter C. Ayala, 44, of 44 Walnut St., Batavia, is charged with obstructing governmental administration, harassment and resisting arrest. Ayala was arrested after police responded to a reported argument between a man and a woman. He was jailed on $2,000 bail.

Mark F. Limoli, 22, of Honeoye Falls, is charged with DWI, driving with a BAC of .08 and failure to stop for a stop sign. Limoli was stopped by State Police on Sunday night at 4282 Clover St. in Darien.

A driver involved in a three-vehicle accident Saturday night has been charged with a felony DWI and may face other charges, according to a Sheriff's Office accident report.

His name is Christopher Dycha, 40, 1321 Vanderbilt Ave., North Tonawanda. He was reportedly driving a 1997 Chevy SUV westbound on Sumner Road approaching Colby Road in Darien at 11:03 p.m. when the driver of another vehicle allegedly failed to yield the right of way from the stop sign on Colby Road.

Dycha's SUV struck the 2007 Ford SUV driven by Susan Mathewson, 56, of 835 Bennett Road, Angola. His SUV then careened into the eastbound lane striking head-on a 1994 Cadillac driven by Stephen Tortoretti, 56, of 23 Angelus Drive, Rochester.

Injured were Dycha, who suffered an injured arm, and Mathewson, who suffered a cut or cuts on her head, and Adreienne Wong, a passenger in Dycha's car, who reportedly had an internal chest injury. All three victims were taken by ground ambulance to UMMC.

Passengers in Mathewson's vehicle, Karen L. Ryerse, 43, and Brandon D. Mathewson, 26. Those passengers and Tortoretti were all reportedly uninjured.

Troy Sanford Wescott, 25, of 717 Lemoyne Ave., Syracuse, is charged with petit larceny, harassment and criminal mischief. Wescott along with Harold G. Dings, 24, of 406 John St., Syracuse,  and Lyle R. Fish, 25, of 32 Gertrude St., Syracuse, allegedly entered Wal-Mart and put on clothing and other merchandise from the store. All three then allegedly cut a jacket from the store in an attempt to conceal more items inside of it. When confronted by store security, Wescott allegedly elbowed a woman employee of the store and started running. Dings and Fish then also ran from the store without allegedly paying for the items they had with them. A short time later, the trio was apprehended in the Batavia Downs parking lot by Deputy Tim Wescott and Sgt. Greg Walker. Dings and Fish are each charged with petit larceny and criminal mischief.

Jeanna M. Hattaway, 22, of 112 Jackson St., Apt. 2, Batavia, is charged with petit larceny. Hattaway is accused of shoplifting at Tops Market, 390 W. Main St..

Jimpce J. Etienne, 33, of 30 Buell St., Batavia, charged with assault and endangering the welfare of a child. Etienne allegedly choked a woman in front of her child.

Bruce Ross, 19, of 41 Longs Lane, Corfu, is charged with criminal mischief and reckless endangerment. Ross allegedly spun the tires of his vehicle, causing stones to fly that struck another person and hit a parked car.

Larry S. Yoho, 37, of 5155 E. Main St.Road, Batavia, is charged with criminal contempt. Yoho allegedly shoved a person during a dispute, and there was an order of protection in place regarding this person. Yoho was jailed on $2,500 bail.

A man arrested for alleged assault during the Lil' Wayne concert Thursday is now also accused  possessing cocaine in jail.

David F. John, Jr., 23, of 1248 Lackawana St., Buffalo, was placed into Genesee County Jail on $1,000 bail following an alleged altercation at Darien Lake Theme Park.

During a routine search at the jail, he was found to allegedly possess cocaine.

He has been charged with promoting prison contraband in the first degree.

John was initially charged with harassment and assault.

Bail on the new charge is $5,000.

A 16-year-old from Cheektowaga, charged with trespassing for allegedly jumping a fence to get into the concert venue.

Jonathan R. Bonner, 26, of 187 Jewett Ave. Upper, Buffalo, charged with trespassing after allegedly refusing to leave the concert venue.

Matthew A. Cary, 20, of 19 Cassandra Circle, Churchville, charged with unlawful possession of marijuana and possession of alcohol under age 21.

Sergio Cruz Vazquez, 22, of 7 Cheswick Drive, Churchville, charged with unlawful possession of marijuana.

Cameron D. Martin, 23, of 201 Privet Way, Rochester, charged with unlawful possession of marijuana.

Richard B. Wylie, 20, of 9717 South Protection Road, Holland, is charged with trespassing for allegedly jumping the fence to enter the concert venue.

Brian M. Johnson, 22, of 82 River St., Salamanca, is charged with disorderly conduct and unlawful possession of marijuana. Johnson allegedly tried to force his way into the concert venue. He was jailed on $250 bail.

Rose M. Wright, 26, of 17 Springfield Drive, Apt. D, Cheektowaga, is charged with is charged with disorderly conduct and unlawful possession of marijuana. Wright allegedly refused a request to stop swearing in public. She was jailed on $250 bail.

Steven M. Chauncey, 18, of 5931 Ellicott St., Pavilion, is charged with unlawful possession of marijuana.

Timothy J. Penders, 18, of 146 Main St., Wyoming, is charged with unlawful possession of marijuana.

Mark P. Ricci, 18, of 281 Ridgeview Drive, East Rochester, is charged with criminal possession of marijuana after allegedly smoking marijuana in public view.

Bryon M .Wiese, 18, of 906 E. Main St., East Rochester, is charged with unlawful possession of marijuana.

David F. John, Jr., 23, of 12456 Longhorse Road, Lowtown, is charged with harassment and assault after allegedly hitting a woman and injuring a security guard who attempted to break up the incident. John was jailed on $1,000 bail.

Nicolo A. Chirico, 18, of 1820 Hudson Ave. Apt. 11, Rochester, was charged with criminal mischief. Chirico allegedly smashed a car window and was found sleeping in the vehicle.

Kristen L. Fedick, 19, of 62 Southpoint Drive, Lancaster, is charged with possessing alcohol under age 21.

Alicia D. Dinardo, 19, of 29 Southwind Way, Rochester, is charged with possessing alcohol under age 21.

Michael R. Ritts, 19, of 8 Peppermill Lane, Orchard Park,  is charged with possessing alcohol under age 21.

A 10-year-old from Alexander J. Costello, IV, 19, of Hamburg was charged with possessing alcohol under age 21.

A 17-year-old from Kenmore was charged with possessing alcohol under age 21.

Paul A. Zagami III, 20, of 19 Arcade Ave., Amherst, is charged with possessing alcohol under age 21.

Alexis Cruz Vazquez, 20, of 7 Cheswick Drive, Churchville, is charged with possessing alcohol under age 21.

George Michael Thompson, 32, of 310 Wilson Drive, Milton, Ontario, Canada, is charged with criminal mischief and endangering the welfare of a child. Thompson allegedly got in a argument with a woman at Darien Lake Theme Park and proceeded to cause at least $250 damage to a camping trailer owned by the facility.  A 12-year-old child was present during the incident.

A 17-year-old from Albion is charged with petit larceny for allegedly stealing $53 worth of merchandise from K-Mart.

Wendy M. Cilnyk, 25, of 9 Liberty Ave., Lancaster, is charged with DWI, refusal to take breath test and moving from lane unsafely. Cilnyk was stopped by officer Chris Camp on Pearl Street after police received several calls about an erratic driver.

Jane Amanda Richardson, 24, of 788 Route 33, Corfu, is charged with falsifying business records and petit larceny. Richardson allegedly falsified business records at the Elba Yellow Goose store. The case was investigated by Deputy Brian Thompson.

Ronald J. Wendt, accused of vehicular manslaughter in the death of an 18-year-old Dansville girl, will have his case presented to a grand jury, Darien Town Justice Michael Davis ruled this afternoon.

Davis made his ruling following an hour-long hearing in which District Attorney Lawrence Friedman was required to prove the state has enough evidence to sustain a charge of vehicular manslaughter in the second degree.

Friedman called two witnesses: the Sheriff’s deputy who conducted the field sobriety test at the scene of the Aug. 14 accident and a young lady who was a passenger in the car with the teen-ager who died later that night.

The night of the accident Wendt was driving a 2001 Dodge Ram truck back from Attica, where he had been bailing hay most of the afternoon. He was headed westbound on Route 20.

Wendt made a left-hand turn into the parking lot of My Saloon when his truck was struck by a 1993 Toyota Camery.

Katie Stanley was a passenger in the right rear of the Camery. She sustained fatal injuries.

Neither the speed of the Toyota nor whether Stanley was wearing a safety belt was discussed during the testimony of Deputy Timothy Wescott.

Wescott spent more than an hour on the stand, mostly detailing the procedures and conclusions of the field sobriety test he conducted.

Shortly after he arrived at the accident scene, Wescott said Wendt approached him and said, "I'm the one you're looking for."

When Wescott asked Wendt what happened, Wescott testified that Wendt said, “I saw the vehicle coming. I thought I had time (to make the turn). I guess I didn’t.”

The Camery stuck the back portion of Wendt's truck.

Wescott did not conduct the accident investigation and could not say whether there were skid marks on the roadway.

The portion of Route 20 were the accident occurred is a short span of roadway that moves quickly from a 55 mph speed zone down to 40 and then back to 55.

Wescott testified that he smelled alcohol on the breath of Wendt and also detected slurred speech.

Wendt reportedly told Wescott that he had a couple of beers while bailing hay in Attica, then two or three beers after the work was done. He said, according ot Wescott, that he finished his last beer about 15 minutes before the accident.

Defense Attorney Thomas Burns honed in on the details of Wescott's field sobriety test, apparently trying to establish that Wendt was not impaired at the time of the accident.

Wendt failed all but one of the tests. Burns asked questions about the heavy boots Wendt was wearing at the time, and whether fatigue could play a role in Wendt's inability to successfully complete some of the tests -- it can, Wescott said.

The test Wendt passed involves a police officer holding a pen or other object in front of a suspect's eyes and asking the suspect to track the pen. The officer is looking for whether the suspect can smoothly track the pen, whether the eyes jump and whether the movements remain coordinated. Wendt passed that test.

A chemical test, however, conducted at 12:10 a.m. showed that Wendt's BAC was .08 of 1 percent, right at the limit of when a driver is considered intoxicated.

Once Wendt was at the Sheriff's station, Wescott testified, he expressed concern about the victims of the accident.

"He asked me a couple of times 'is every one OK?'" Wescott said. "He said he would deal with whatever happened to him, but  he wanted everybody to be OK."

Burns issued a statement following the hearing challenging the prosecution's conclusion that Wendt's conduct constitutes, as defined by New York State law, a "criminal cause of action."

"While we are acutely aware of the grief which the family of the deceased must be enduring, the plain fact is that not every motor vehicle fatality constitutes the basis to charge a motorist with a crime," Burns wrote.

Burns asserts that it is a common misperception that drinking and driving is illegal in New York.

"The plain fact is that it is not," Burns wrote. "Our state legislature, through the laws in effect, has determined that it is the responsibility of every motorist to determine for him/herself when they have had too much to drink. ... Simply stated, it is illegal to operate a motor vehicle in an intoxicated condition. We believe that there is ample evidence available which demonstrates that Mr. Wendt was not intoxicated at the time of accident occurred."

In addition to calling Wescott, Friedman also asked Gabrielle E. Mahus to testify. He asked only a couple of questions to establish that Mahus was at the scene of the accident, was aware that Stanley was taken away in an ambulance and had recently attended her funeral.
