Law and Order: Medina man accused of stealing rifle and $1K in property from Oakfield home

Edward C. Simmons, 33, of Applegate Drive, Medina, is charged with: second-degree burglary -- illegal entry into a dwelling; fourth-degree grand larceny -- a rifle; and grand larceny -- property value greater than $1,000. Simmons is accused of breaking into a residence on Sept. 16 on East Shelby Road in Oakfield and stealing a 22-caliber Remington rifle and other property valued at $1,000 or more. Following an investigation, he was arrested on Dec. 9 and arraigned in Oakfield Town Court. He was then released on his own recognizance and is due back in court at 6 p.m. on Jan. 6. The case was investigated by Genesee County Sheriff's Investigator Joseph Loftus.

Melody McMaster, 48, of Washington Avenue, Batavia, is charged with second-degree criminal contempt. McMaster was arrested on Dec. 9 at an apartment on Chestnut Street in Batavia for allegedly violating an order of protection by being in the protected party's residence at 11:17 a.m. She was issued an appearance ticket and is due in Batavia City Court on Dec. 24. The case was handled by Batavia Police Officer Peter Flanagan, assisted by Officer Stephen Quider.

Brandon Gene Rindell, 38, of West Main Street, Corfu, is charged with aggravated driving while intoxicated -- a BAC of .18 percent or more, and DWI. On Dec. 12 at 7:33 p.m., Rindell was arrested after his vehicle was involved in a motor-vehicle accident in the Village of Corfu. He was released on appearance tickets and is due in Village of Corfu Court on Dec. 16. The case was handled by Genesee County Sheriff's Deputy David Moore.

Mellanie Golamb, 36, of Folkestone Lane, Penfield, is charged with: aggravated driving while intoxicated -- a BAC of .18 percent or more; DWI; criminal possession of a controlled substance in the seventh degree; moving from lane unsafely; and failure to notify the DMV of an address change. On Dec. 10 at 7:33 a.m., the dispatch center received a call of a vehicle being operated irratically. Following a traffic stop on Stephen H. Hawley Drive in the Town of Batavia, standard field sobriety tests were performed. Golamb was arrested and processed at the Genesee County Jail. She was released on appearance tickets and is due in Batavia Town Court on Dec. 19. The case was handled by Genesee County Sheriff's Deputy Ryan DeLong, assisted by Deputy Chad Cummings. Deputy Lonnie Nati also assisted along with Genesee County Corrections officers.

Karen M. Lau, 54, of North Spruce Street, Batavia, is charged with aggravated driving while intoxicated  -- a BAC of .18 percent or more, and DWI. She was arrested at 8:16 p.m. on Nov. 30 on East Main Street in Batavia after she was allegedly found sleeping in the driver's seat of her vehicle parked in the parking lot of a business. The case was handled by Batavia Police Officer Joshua Girvin, assisted by Officer Stephen Cronmiller.

Angelo James Voltura, 24, of Meiser Road, Corfu, is charged with: operating a motor vehicle while having a BAC of .08 percent or more; driving a motor vehicle while intoxicated; speed not reasonable or prudent; and failure to keep right. Following the investigation of a single-vehicle accident at 1:41 a.m. on Dec. 11 on Pratt Road in the Town of Batavia, Voltura was arrested. He was arraigned in Town of Batavia Court and released on appearance tickets. He is due to return to court on Dec. 23. The case was handled by Genesee County Sheriff's Deputy Kenneth Quackenbush, assisted by Deputy James Stack.

Kyle J. Schroeder, 23, of Telephone Road, Le Roy, is charged with petit larceny. He was arrested following a shoplifiting incident at 9:09 a.m. on Dec. 8 at a business on East Main Street in the City of Batavia. Schroeder is accused of taking an item out of the packaging while at a business and attempting to conceal that item while continuing through the store. He was issued an appearance ticket and is due in Batavia City Court on Dec. 17. The case was handled by Batavia Police Officer Stephen Quider, assisted by Officer Mitchell Cowen.

Donations from third annual 'Living Manger' in Pembroke Town Park will help local food pantry

CORFU – For the third year, several churches in the Corfu/Pembroke area have combined their efforts to enact a live nativity scene in the Pembroke Town Park.

From 5 to 7 Saturday night, members of the Indian Falls United Methodist Church, High Point Community Church and North Darien Bible Church donned Biblical attire and took up their roles as shepherds, angels, Wise Men and Mary and Joseph.

Corfu Presbyterian Church also provided assistance, said Meagan Stringham, who helped organize the event with Celinda McQuistion.

There was no charge to drive through the displays, but donations were accepted for the Corfu Presbyterian Church food pantry.

Bales of straw were piled high along the driveway and a variety of live animals, including sheep, goats and a donkey nibbled at the bales.

Dan Spoth, of Clarence, said the Phelps family brought in a goat and the donkey, while two sheep came from Ed and Julie Keller, of Corfu.

After driving past all the stations set up, drivers could stop at the last tent to enjoy a hot beverage and cookies.

Law and Order: Corfu man charged with multiple felonies after domestic incident on Friday

Jerrol Paul Newell, 50, of East Main Street, Corfu, (photo above) is charged with: three counts of second-degree strangulation (Class D felonies); unlawful imprisonment in the first degree (Class E felony); and two Class A misdemeanors -- second-degree menacing -- displaying a weapon or dangerous instrument, and third-degree assault. At 7:50 a.m. on Nov. 29, Newell was arrested after the Genesee County Sheriff's Office investigated a domestic incident that occurred on East Main Street in the Village of Corfu. He was arraigned in Pembroke Town Court and put in Genesee County Jail with bail set at $50,000 cash. The case is still under investigation and additional charges are pending. The case was investigated by Genesee County Sheriff's Deputy Jared Swimline, assisted by Deputy Ryan DeLong. The Sheriff's Office was assisted by members of the Corfu Police Department, the Wyoming County Sheriff's Office and the New York State Police.

Mark T. Helm, 38, of State Street, Batavia, (inset photo left) is charged with second-degree assault and endangering the welfare of a child. Helm was arrested at 9:41 p.m. on Nov. 24 on State Street after allegedly striking a person, causing serious physical injury, all while in front of four children. Helm was arraigned in Batavia City Court and jailed without bail. He was due back in city court on Nov. 26. The case was investigated by Batavia Police Officer Joshua Girvin, assisted by Officer Wesley Rissinger.

Kiha S. McNear, 22, of Lake Street, Le Roy, (inset photo right) is charged with: criminal mischief -- intentionally damaging property; second-degree criminal contempt; aggravated criminal contempt -- previous conviction; and second-degree burglary -- illegally entering a dwelling. McNear was arrested at 9:35 p.m. on Nov. 25 at a resident on Walnut Street in the City of Batavia. He allegedly entered the residence of a person who has an order of protection against him and damaged some of the person's property. He was arraigned in Batavia City Court on Nov. 26 and is due back in court on Dec. 5. The case was handled by Batavia Police Officer Christopher Lindsay, assisted by Officer Miah Stevens.

Colby J. Swain, 34, of Amherst, was arrested Nov. 30 by New York State Police and charged with criminal possession of a weapon in the second degree ("loaded firearm other than a person’s home"), a Class C felony, and criminal possession of marijuana in the third degree, a Class E felony. Swain was stopped at 1:45 p.m. on I-90 in the Town of Batavia for a vehicle and traffic violation. During the interview, troopers determined there was "probable cause to search the vehicle." A duffle bag which was locked with a combination lock was located inside the vehicle. Swain allegedly refused to cooperate with the investigation, which result in the troopers obtaining a search warrant for the bag. "Inside the bag that Swain claimed ownership of, was over 11 ounces of marijuana and a loaded Smith and Wesson M&P .45-caliber pistol with an 8-round magazine" (in photo above). Swain did not possess a pistol permit. Swain was arraigned before the Town of Batavia Court and released under the supervision of Genesee County Probation. No return court date is available at this time.

Justin P. Mcgirr, 37, of Ross Street, Batavia, and Jeremiah T. Jones, age and address not provided, are charged with disorderly conduct by way of fighting/violent behavior. They were arrested on Ross Street after they were allegedly observed in a physical fight by police at 1:07 p.m. on Nov. 23. They were issued appearance tickets and were due in Batavia City Court at 1 p.m. today (Dec. 3). The case was handled by Batavia Police Officer Joshua Girvin, assisted by Officer Stephen Quider.

Jonathan Brice White, 27, of Buffalo Street, Bergen, is charged with second-degree criminal contempt. White was arrested at 3:15 p.m. on Nov. 13 after he allegedly repeatedly violated a full stay away order of protection by contacting the protected party. After his arraignment in Batavia City Court, he was jailed on $1,000 bail, cash or bond. He was due back in city court Nov. 26. The case was handled by Batavia Police Officer Felicia DeGroot, assisted by Officer Christopher Lindsay.

Raylynne M. Santiago, 20, of Walnut Street, Batavia, is charged with harassment and obstruction of governmental administration. Batavia Police Officer Peter Post arrested Santiago following a domestic incident reported at 12:50 a.m. on Nov. 24 in the vicinity of Jackson and Maple streets in the city. She was due in Batavia City Court at 1:30 p.m. today (Dec. 3). Post was assisted by Officer Stephen Cronmiller.

Daniel S. Kuczka, 75, of Walden Creek Drive, Batavia, is charged with trespassing. He was arrested after a trespass complaint was made at 11:35 a.m. on Nov. 20 at the Richmond Memorial Library on Ross Street in the city. He was due in Batavia City Court this afternoon (Dec. 3) to answer the charge. The case was handled by Batavia Police Officer Sean Wilson, assisted by Officer Mitchell Cowen.

Ross D. Rahn, 24, of Main Street, Le Roy, is charged with: stopping on a highway; moving from lane unsafely; and driving while ability impaired. At 1:28 a.m. on Dec. 2, Batavia police responded to a call of a vehicle parked crossways across the roadway on West Main Street near Vernon Avenue in the city. Rahn was subesquently arrested, issued appearance tickets, and is due in Batavia City Court on Dec. 18. The case was handled by Batavia Police Officer Arick Perkins, assisted by Officer Peter Post.

Zachary J. Marrow, 28, of Manhattan Avenue, Batavia, is charged with aggravated driving while intoxicated -- a BAC of .18 percent of more, and DWI -- first offense. Marrow was arrested at 12:31 a.m. on Nov. 16 on East Main Street in Batavia. He is due in Batavia City Court on Dec. 11. The case was handled by Bataiva Police Officer Miah Stevens, assisted by Officer Arick Perkins.

Gregory F. Frieday, 34, of Osterhout Avenue, Batavia, is charged with fourth-degree criminal mischief, a misdemeanor. On Nov. 17, Genesee County Sheriff's deputies responded to a complaint of criminal mischief for a broken exterior window at Batavia Downs. Following an investigation, it is alleged that Frieday broke an exterior window on the south side of the building. He was issued an appearance ticket and is due in Town of Batavia Court on Dec. 19. The case was handled by Deputy Brock Cummins, assisted by Deputy James Stack.

Melynda M. Gayhart, 31, of Hutchins Street, Batavia, was arrested on Nov. 25 on a bench warrant out of Batavia City Court. This stems from a larceny incident which occurred on Feb. 17 on East Main Street in Batavia. After her arraignment in city court, she was released and is due back in court on Dec. 5. The case was handled by Batavia Police Officer Nicole McGinnis.

Local law enforcement agencies and Rotary team up Saturday in Target parking lot for holiday charity event

Le Roy Police Department is putting on a special charity event on Saturday, Nov. 30, to help Genesee County families in need this holiday season.

Le Roy PD will be joined by New York State Police - Troop A in Batavia, New York State Environmental Conservation Police, Genesee County Sheriff’s Office, Batavia Police Department, Corfu Police Department, Genesee County Probation and Rotary International.

"Stuff the Cruiser" will take place 11 a.m. - 3 p.m. in the Target parking lot at Towne Center at Batavia on Veterans Memorial Drive.

Bring unwrapped toys, new clothing and nonperishable foods to stuff in a police vehicle. This is a kid friendly event, fun for the whole family.

Law and Order: Liberty Street woman arrested for conspiracy and larceny where she once worked

Stacy J. Watson, 43, of Liberty Street, Batavia, and Jennifer A. Mcauley, 46, of Shelby Basin Road, Medina, were arrested on Oct. 29 on misdemeanor charges following a larceny complaint at the Home Depot on Veterans Memorial Drive in Batavia. At 2:56 p.m. deputies responded to the store in the Town of Batavia for an investigation. Watson is charged with two counts of petit larceny and two counts of sixth-degree conspiracy. Mcauley is charged with two counts of petit larceny. It is alleged that Watson, a former Home Depot employee, conspired with Mcauley to steal merchandise from the store. Both subjects were issued appearance tickets and are due in Batavia Town Court on Nov. 14. The case was investigated by Genesee County Sheriff's Deputy Erik Andre.

Steven B. Nesbitt, 34, of Holland Avenue, Batavia, is charged with second-degree harassment and first degree criminal contempt. Nesbitt was arrested 2:22 p.m. on Oct. 24 after an incident that occurred at a residence on Holland Avenue. It is alleged that Nesbitt had physical contact with a person who had a "refrain from order of protection" against Nesbitt. He is due Batavia City Court on Nov. 7. The case was handled by Batavia Police Officer Jordan McGinnis, assisted by Officer Jason Davis.

Melissa A. Wetmore, 47, of Main Road, Corfu, is charged with driving while intoxicated and operating a motor vehicle while having a BAC of .08 percent or more. Wetmore was arrested at 8:11 p.m. on Oct. 26 on North Lyon Street in Batavia after an accident investigation. She is due in Batavia City Court on Nov. 6. The case was handled by Batavia Police Officer Sean Wilson, assisted by Officer Mitchell Cowen.

Tyler Lee Walls, 23, of Upper Holley Road, Clarendon, is charged with: unlawful possession of marijuana; operating a motor vehicle with a suspended registration; aggravated unlicensed operation in the second degree; and operating a motor vehicle with no headlamps. At 4:49 p.m. on Nov. 1, Walls was arrested following a traffic stop on Lake Street (Route 19) in Le Roy. It is alleged Walls was driving a vehicle without headlights while having a suspended driver's license and suspended registration. The case was handled by Genesee County Sheriff's Deputy Jordan Alejandro, assisted by Deputy Travis DeMuth.

Brittany M. Smith, of Pringle Avenue, Batavia, was arrested the morning of Nov. 2 on active bench warrants out of Batavia City Court for failing to appear in court and failing to comply with the court. She was arraigned at 9:50 a.m. and put in jail in lieu of $2,500 cash bail or bond. She is due in Batavia City Court this afternoon (Nov. 4). The case was handled by Batavia Police Officer Peter Post, assisted by Officer Christopher Lindsay.

Namesake of 'Austin's Army' fought rare childhood cancer courageously until the end

Since he was 17, Austin Heineman fought a rare childhood cancer and throughout the ordeal, "Austin's Army" of family, friends and supporters prayed for him, raised money for hospital bills, and tried to bouy his spirits.

At age 25, Heineman died Monday (Oct. 28) at a Buffalo hospice.

The first Facebook post about the legion of aides that would grow to hundreds of people was posted on St. Patrick's Day in 2012. The accompanying photo shows a resolute and unsmiling Austin side-by-side with a little sister; arms folded across their chests in body language that is universally decoded as a barrier to something negative -- like his disease, desmoplastic small round cell tumors.

The community rallied to help one of their own -- a hunter, buddy, fisherman, dirt biker, gamer, cinephile, schoolmate.

Race car driver Billy Burd painted a tribute to Austin and his Army on his vehicle that said: "In This Life There's No Surrender."

The McNutt family had an ATV in the 2012 Fourth of July Parade in Warsaw (Wyoming County) in tribute to Austin and his Army.

They offered countless prayers, mailed him get-well cards and held fundraisers.

A puppy helped, too. He got a buff-colored one when they first shaved his head after chemo.

The Alexander High School Varsity Cheerleaders hosted a benefit varsity boys' basketball game: Alexander Trojans vs. Letchworth. There were 50/50 raffles, half-court shootouts, a bake sale and gift certificates donated by local businesses.

"Amanda's Rage Cranking It Up For Austin" was a rock band fundraiser. Naturally, there were chicken BBQ fundraisers, including one held at the East Pembroke Volunteer Fire Department.

They went on an Austin's Army mud run, a Dirty Girl Mud Run. Oakfield students went Bald for Bucks in his name. One Oakfield student was inspired to hold a children's book drive for patients at Roswell Cancer Institute after meeting Austin.

The former Batavia tattoo and piercing shop Laughing Buddha held a piercing fundraiser. City Slickers Bar & Grill (now Ken's Charcoal Pits) held a Facebook fundraiser.

Teens at Batavia High School joined Austin's Army. Students at Notre Dame paid $3 for the privilege of "dressing down" one day for a fundraiser in Austin's honor.

People sold bracelets, and items from Pampered Chef and Partylite. They cut their hair for Locks of Love. The ladies at the (former) Genesee County Nursing Home held a bake sale.

They went all camo in Pembroke schools to show their support. Little kids camouflaged their faces with paint and at least one boy, "Pete," sported a spiked Mohawk with the concealing design.

They sold dark khaki-colored T-shirts that read Austin's Army on the front and An Army of Hope on the back (in Army font of course). They sent in vacation photos from Florida and a school sightseeing trip to Boston proudly wearing them.

And another T-shirt was offered with Invictus on the back (Latin for unconquerable or undefeated) from the title of Victorian poet William Ernest Henley's stoical poem.*

The Army pumped themselves up for their mission with the battle cry song Soldiers (2011) by Otherwise. It was Austin's handpicked "beating cancer anthem." As one friend wrote: "...Keep fighting...we are all fighting with you." 

The battlefield was strewn with: operations; medical trips to New York City and Maryland; rounds of chemotherapy and the nausea that follows; blood transfusions; bone-marrow transplants; a blood infection; double pneumonia; endless IVs; tests; CAT scans; PET scans; pain; foot-dragging insurance companies, and more of course.

A lot of encouragement in the trenches was warranted and received -- as one person wrote: "No matter how hard it may get, we will be with you every step of the way. We will never give up on you. We are your rock. Your strength, determination, and courage are an inspiration to all of us. Stay strong!"

The Heineman family will receive friends tomorrow (Oct. 31) from 4 to 8 p.m. at the Michael S. Tomaszewski Funeral & Cremation Chapel at 4120 W. Main Street Road, Batavia. A graveside service will be held at 11 a.m. Friday, Nov. 1, at Evergreen Hill Cemetery in Corfu.

Law and Order: Corfu sex offender accused of failing to register email address

Raymond Dennis Bieganski, 66, of Main Street, Corfu, a NYS Level 2 registered sex offender, is charged with failure to register an email address. He was arrested for violating NYS Correction Law by failing to register an email address on July 22. He was issued an appearance ticket for Nov. 4 in Village of Corfu Court. The case was handled by Genesee County Sheriff's Deputy Kevin McCarthy.

Justin David Spilberg, 31, of Salt Works Road, Medina, is charged with: driving while intoxicated with a BAC of .18 percent or more; DWI; and speeding. Spilberg was arrested at 7:54 p.m. on Oct. 26 on North Lake Road in Bergen after a traffic stop for speeding. He was released on an appearance ticket and is due in Bergen Town Court on Nov. 6. The case was handled by Genesee County Sheriff's Deputy James Stack.

Cameron James Demaison, 23, of Trumbull Parkway, Batavia, is charged with aggravated driving while intoxicated and DWI. He was arrested at 9:32 p.m. Oct. 17 on North Street in Batavia following a traffic complaint. Demaison was released on appearance tickets and is due in Batavia City Court on Oct. 30. The case was handled by Batavia Police Officer Sean Wilson, assisted by Officer Jason Davis.

Joseph M. Dispenza, 46, of Maple Street, Batavia, is charged with aggravated driving while intoxicated and DWI. On Oct. 26, Batavia Police Officer Peter Post arrested Dispenza on the charges following an investigation into a one-vehicle accident involving a motorcycle on Bank Street in the city at 10:22 p.m. on Aug. 4. Dispenza was given uniform traffic tickets and is due in Batavia City Court on Nov. 6. Post was assisted by Officer Sean Wilson.

Brian Keith Dyer, 53, of North Street, Batavia, is charged with second-degree harassment. Dyer was arrested following an incident in which he allegedly pushed someone at 9:29 p.m. Oct. 22 on North Street in Batavia. He was issued an appearance ticket and is scheduled to appear in Batavia City Court on Oct. 29. The case was handled by Batavia Police Officer Felicia DeGroot, assisted by Officer Jason Davis.

Law and Order: Three arrested on multiple charges after traffic stop at Ross and East Avenue

Gabrielle M. Chaplin, 28, of Porter Avenue, Batavia, and Trevon L. Armstrong, 34, of Denio Street, Batavia, and Darius L. Jones, 27, of Exchange Street, Attica, are charged with several crimes in connection with a traffic stop of a single vehicle at 12:22 p.m. on Oct. 2 at East Avenue and Ross Street in the City of Batavia. An investigation pursuant to a traffic stop for failing to signal a turn, allegedly revealed that marijuana, oxycodone and a loaded hangun were inside the vehicle. A 10-month-old child was allegedly in the back seat and not properly secured in a child-restraint seat; the child was also allegedly in proximity to the handgun. All subjects were arraigned in Batavia City Court and all were to appear again in court Thursday morning (Oct. 3). All are charged with: criminal possession of a weapon in the second degree, a felony; criminal possession of a controlled substance in the seventh degree, a misdemeanor; endangering the welfare of a child, a misdemeanor; and unlawful possession of marijuana, a violation. In addition, Jones is charged with exposure of a person, a violation. And Chaplin is also charged with failure to give notice, a traffic infraction, and improper/no child restraint, another traffic infraction. Armstrong and Jones were jailed without bail; Chaplin was jailed in lieu of $10,000 cash bail or $20,000 bond. The incident was investigated by Genesee County Sheriff's Investigator Christopher Parker, assisted by Deputy Christopher Erion and K-9 "Frankie," Sgt. Michael Lute, Sgt. James Diehl, Investigator Ronald Welker, Det. James DeFreze, and Batavia Police officers Felicia DeGroot, Jordan McGinnis, Stephen Cronmiller, Mitchell Cowen and Adam Tucker.

Jeffrey D. Hart, 40, of Sumner Road, Corfu, is charged with: aggravated unlicensed operation of a motor vehicle in the first degree; driving while intoxicated; DWI -- with a BAC of .08 percent or more; speeding; and refusal to take a breath test. On Oct. 3 following a traffic stop at 9:55 p.m. on Route 77 in the Village of Corfu, Hart was arrested. He was issued an appearance ticket and is due in Pembroke Town Court on Oct. 17. The case was handled by Genesee County Sheriff's Sgt. Jason Saile.

Corfu Grange Roast Pork Dinner

Annual Foam Training was held for members of fire departments in Genesee and Orleans counties, with three-hour classroom sessions held in each of the counties followed up with a three-hour hands-on session held on Sept. 30 at the Genesee County Fire Training Center. 

The annual foam training centered on terminology related to firefighter suppression foam, application techniques, equipment, calculations used in accordance with NFPA 11 and water supply to perform foam firefighting or vapor suppression operations.

Two dozen GC fire volunteers learn 'fireground strategies and tactics'

Responding to concerns over the length of firefighting training programs, the NYS Office of Fire Prevention and Control has redesigned the Fire Officer I (FOI) program into five individual modules. Completion of all five modules will earn the participant a Fire Officer 1 certificate. 

The latest offering in the Fire Officer program held at the Genesee County Fire Training Center was "Fireground Strategies and Tactics for the First Arriving Companies." 

The Fireground Strategies and Tactics course prepares fire officers to act as the leader of a company or as an initial incident commander. The students received instructions in both fire and non-fire emergency operations with an emphasis on risk vs. benefit analysis while conducting operations.

The fifteen-hour module was completed by 26 volunteer fire personnel, nine of whom earned their Fire Office 1 certification.

UPDATED: NYS Association of Counties celebrates Climate Week

Across New York State, local governments are enacting local laws, adopting energy-saving initiatives, taking steps toward climate resiliency, and collaborating to develop programs for supporting more resilient communities.

“As we celebrate Climate Week, it must be noted counties across New York are investing in hundreds of initiatives to combat climate change and promote more climate resilient communities,” said Erie County Executive Mark Poloncarz.

Through state programs such as Climate Smart Communities and Clean Energy Communities, counties are acting to both mitigate their environmental impact and save taxpayer dollars in the process.

Counties will also be key partners with the state in meeting the goals established by the recently-enacted New York State Climate Leadership and Community Protection Act. This legislation set the most aggressive greenhouse gas emission (GHG) reduction goals of any major economy and will put New York State on a path to carbon neutrality.

“Our county leaders are in a unique position to work with state, federal, and local agencies on environmental issues, and to develop partnerships to mitigate and prepare for the impact of climate change on our communities,” said NYSAC Executive Director Stephen Acquario. “During this Climate Week, we are highlighting the programs underway in our communities.”

***Genesee County received a Smart Growth grant from the NYS Department of State for climate resiliency planning: 

When the grant was announced last September, Genesee County Legislature Chairman Robert Bausch said, "The Smart Growth grant program has provided some of our State's most vulnerable counties with the resources they need to ensure they are prepared for the next severe weather event.

"We can never be sure when the next disastrous storm will hit. With this funding to build more resilient communities and fight against the devastating effects, Governor Cuomo is creating a more sustainable New York for all."

Genesee County was among five Upstate counties chosen to divvy up a total of $1 million to develop resiliency plans and identify projects while incorporating the principles of smart, sustainable growth and development.

The plans funded through the grant will address:

  • An increase in frequency and severity of storm and precipitation events;
  • Sea-level rise;
  • Storm surge;
  • Coastal and riverine flooding;
  • Drought; and
  • Debris and ice jams.

For the first phase, they mapped the whole county and worked closely with four municipalities (see below). Now, for Phase 2, they're hoping to work with as many communities as possible.

Reminder: PCD Kiwanis annual Car Cruise & Fall Festival is tomorrow at Pembroke Town Park

The Pembroke Corfu District Kiwanis Club will hold their 12th Annual Car Cruise & Fall Festival tomorrow, Sept. 15, at Pembroke Town Park on Route 77 (next to the high school).

Time is 11 a.m. to 4 p.m. Rain or shine!

Why not take a ride in the country and head over to the Pembroke Town Park (8799 Alleghany Road (Route 77)) for an afternoon of fun, and support a great cause at the same time?

There will be music, an awesome basket raffle to benefit Crossroads House, plenty of vendors, and delicious food options available -- Babz BBQ, hamburgers and hotdogs from Crossroads House, Pink Cow with breakfast sandwiches and ice cream, pizza from the wood stove, and awesome desserts.

Plus more than 200 cars are expected.

New this year is a free Kids Car Cruise for ages 8 and under, from 11 a.m. to 1 p.m. Kids register your ride-on vehicle and get a kid's goody bag.

Cruise registration starts at 9 a.m. Preregistration fee is $10 per car; $15 day of the cruise.

Law and Order: Pair of Ohioans accused of being obscene and disorderly at Darien Lake

Rachel M. Grace, 30, of 638 N. Buckeye St., Wooster, Ohio, and Jeremy R. Triesler, 39, of 9318 Lincoln Way East, Orrville, Ohio, were arrested at Darien Lake Theme Park on Alleghany Road in the Town of Darien on Sept. 7. At 7:20 p.m. deputies responded to a criminal mischief complaint. It is alleged that Grace became angry and threw a bucket of water at a food service employee, causing $594.15 in damages. Triesler allegedly became belligerent and used obscene language, which caused a disturbance at the theme park; then he allegedly shoved a security officer when they attempted to intervene. Grace is charged with fourth-degree criminal mischief. Triesler is charged with second-degree harassment and disorderly conduct. The case was handled by Genesee County Sheriff's Deputy Brock Cummins, assisted by Deputy Erik Andre.

James Darrell Hooten Sr., 30, of Sunset Parkway, Oakfield, is charged with obstruction of governmental administration, second-degree harassment and disorderly conduct. At 5:35 p.m. on Sept. 7, while attempting to arrest another subject on a warrant on Sunset Parkway in Oakfield, Hooten Sr. was arrested. He allegedly attempted to prevent the arrest of another person. He is also accused of threatening Genesee County Sheriff's deputies and Probation officers and using obscene language in public. He was released on an appearance ticket and is due in Oakfield Town Court on Oct. 7. The case was handled by Deputy Kyle Krzemien, assisted by Deputy Travis DeMuth.

Nancy M. Storms, 46, of Perry Road, Pavilion, is charged with second-degree harassment -- physical contact. At 7:45 p.m. on Sept. 2, Storms was arrested on North Street in Batavia for allegedly pushing another person during an altercation. She was issued an appearance ticket and is due in Batavia City Court on Sept. 17. The case was handled by Batavia Police Officer Jordan McGinnis, assisted by Officer Christopher Lindsay.

Lakeisha A. Gibson, 33, of Lewis Place, Batavia, is charged with fourth-degree criminal mischief. On Sept. 3 at 6:42 p.m. Batavia police responded to Lewis Place for a complaint of criminal mischief. Gibson was arrested for allegedly damaging a vehicle window. She was issued an appearance ticket for Sept. 17 in Batavia City Court. The case was handled by Officer Arick Perkins, assisted by Officer Peter Post.

Brian E. Freeman, 46, of Genesee Park, Monroe, is charged with: driving while intoxicated; aggravated DWI -- a BAC of .18 or more; and speeding. Freeman was arrested at 12:37 a.m. on Aug. 31 on Oak Street in Batavia following a traffic stop. He was issued appearance tickets and is due in Batavia City Court on Sept. 11. The case was handled by Batavia Police Officer Peter Post, assisted by Officer Mitchell Cowen.

Joshua M. Gaudioso, 30, of Albion Road, Oakfield, is charged with petit larceny. At 6:42 on Aug. 15, Gaudioso was arrested following a larceny complaint in the Village of Oakfield. He allegedly stole a NYS license plate that did not belong to him. Following his arrest, he was taken to jail then released on an appearance ticket. He is due in Corfu Village Court on Oct. 7. The case was handled by Genesee County Sheriff's Deputy Kyle Krzemien.

Ebony S. Sanders, 41, of Lake Avenue, Rochester, is charged with possession of marijuana in the second degree and speeding. On Sept. 3 at 10:30 a.m., Sanders was stopped on Interstate 490 in the Town of Le Roy following the alleged observation of a vehicle/traffic violation. Upon conducting a roadside interview with Sanders, the odor of burnt marijuana was allegedly detected. She was issued an appearance ticket and is due in Le Roy Town Court on Oct. 1. The case was handled by Genesee County Sheriff's Deputy Ryan DeLong, assisted by Deputy Chad Minuto.

Total of 28 volunteer firefighters complete skills refresher course

Designed to review previously learned skills and improve proficiency, the Self-Contained Breathing Apparatus / Interior Firefighter Operations (SCBA-IFO) four-hour refresher is an engine company refresher that combines skills learned in the Basic Exterior Firefighter Operations (BEFO) program and IFO program into a scenario-based response format.  

Twenty-eight Genesee County fire personnel completed the refresher class held on Aug. 19 at the Genesee County Fire Training Center.

Encompass Genesee to hold debut get-together Sept. 17 in Kiwanis Park

Encompass Genesee is a Corfu-based, nonprofit organization whose mission it is to provide social activities and employment training for people with developmental disabilities.

They will hold their debut get-together event from 5:30 to 7:30 p.m. on Tuesday, Sept. 17, in Kiwanis Park in the Town of Batavia. Food will be provided!

All are invited to come out and enjoy an evening of fun making new friends.

Law and Order: Tonawanda man accused of September 2017 stabbing on East Main Street, Batavia

Carey Culverhouse, 60, of Grandview Avenue, Tonawanda, (inset photo left) is charged with first-degree assault. He was arrested on a warrant out of Batavia City Court that was issued following an investigation into a stabbing on East Main Street in Batavia that occurred in September of 2017. He was located by the Tonawanda police and turned over the Batavia police. He was arraigned in Batavia City Court on Aug. 22 and jailed without bail. He was due to return to city court on Aug. 23. The case was handled by Batavia Police Officer Christopher Lindsay.

Malik I. Ayala, 27, of Walnut Street, Batavia, (inset photo right) is charged with second-degree burglary. He was arrested on Aug. 13 by Batavia Police officers Adam Tucker and Jason Ivison. He is accused of entering another person's residence on Naramore Drive in Batavia at about midnight on Oct. 14 and stealing property. He was arraigned in Batavia City Court and turned over to the GC Sheriff's Office, where he is being held on unrelated charges.

Alan R. Price, 24, of Chili Avenue, Rochester, is charged with: endangering the welfare of a child; criminal contempt in the first degree; and second-degree strangulation. Price was arrested on Aug. 12 for an incident reported at 8 a.m. on April 11 on North Spruce Street in the City of Batavia. He was arraigned in Batavia City Court and jailed on $5,000 cash or bond. The case was investigation by Batavia Police Officer Matthew Wojtaszczyk.

Kaleb J. Bobzien, 21, of Dellinger Avenue, Batavia, is charged with criminal contempt in the first degree. He was arrested after a domestic incident investigation in which it is alleged that he had contact with a protected person at 9:50 a.m. on Aug. 22 on Dellinger Avenue. Bobzien was jailed without bail and was due in Batavia City Court today (Aug. 26). The case was handled by Batavia Police Officer Kevin DeFelice, assisted by Officer Sean Wilson.

Brandon C. Dodd, 32, of Clinton Street, Batavia, is charged with: petit larceny; second-degree burglary; and second-degree criminal contempt. He was arrested on Aug. 24 after a domestic incident on Highland Park, Batavia. It is alleged that he broke into the home of a protected person and stole money. He was arraigned in Batavia City Court Aug. 24 and jailed without bail pending his return to city court today (Aug. 26). The case was handled by Batavia Police Officer Marc Lawrence.

Kevin Hal Deet, 69, of Rogers Road, Hamburg, is charged with trespass. He was arrested at 8:22 p.m. on Aug. 25 at Batavia Downs Gaming and Hotel on Park Road in Batavia after allegedly refusing to leave after being told to do so by security officers and deputies. He is due in Batavia Town Court on Sept. 12 to answer the charge. The case was handled by Genesee County Sheriff's Deputy Mathew Clor, assisted by Sgt. Andrew Hale.

Danielle E. Cummings, 41, of Batavia Oakfield Townline Road, Batavia, is charged with aggravated unlicensed operation of a motor vehicle in the first degree. Cummings was allegedly observed driving on Verona Avenue in the City of Batavia at 2:41 p.m. on Aug. 23 while having 17 active suspensions -- fifteen of them on 12 dates. She was arraigned in Batavia City Court and jail in lieu of $500 bail. She is due in city court at a later date. Sgt. Dan Coffey handled the case.

Taylor L. Finnin, 26, of Highland Park, Batavia, is charged with possession of a hypodermic instrument and loitering while unlawfully using a controlled substance in a public place on Jefferson Avenue in Batavia at 1:55 p.m. on July 9. He was arraigned Aug. 22 in Batavia City Court and jailed in lieu of $1,500 cash or $3,000 bond. The  case was investigated by Batavia Police Officer Jordan McGinnis, assisted by Officer Christopher Lindsay.

Ashley Marie Silliman, 23, of West Genesee Street, Corfu, is charged with petit larceny. She was arrested following a shoplifting complaint at the Dollar General on East Main Street in Batavia at 1:42 p.m. on Aug. 21. She issued an appearance ticket and is due in Batavia City Court on Aug. 27. The case was handled by Batavia Police Officer Wesley Rissinger, assisted by Officer Marc Lawrence.
