Co-owner of Settler's, Billy Goats, dies at age 66

Stylianos “Steve” Spryopoulos, co-owner of Settler's Restaurant, was found unresponsive on the floor of his neighboring business, Billy Goats, at 7 a.m. today and was later pronounced dead at the age of 66.

Spryopoulos and his wife, Rula, owned and operated Settler's with his son John. He opened Settler's in 1984 and expanded it to seat 150 people in 1995. He opened Billy Goats, a bar and grill, in late 2000.

The Settler's location was originally a Red Barn franchise, opening in 1966 and operated by Mike Bohn until he sold the location to Spryopoulos and a partner.

The restaurant was closed today. It will reopen at 5 a.m., Saturday.

'How to Create a Positive Work Environment' is topic of next week's small business workshop

“How to Create a Positive Work Environment” will be the subject of a small business workshop to be hosted by the Genesee County Chamber of Commerce on Wednesday, May 16.

This is the one of a series of business workshops held in conjunction with the United States Small Business Administration and the Genesee County Chamber of Commerce. The workshops are open to all Chamber and non-Chamber businesses and their employees and will offer expert advice from experienced professionals designed to help small businesses succeed and grow.

“It is possible to have positive – and perhaps even fun – work environment in any business and this workshop is designed to show you how,” said Tom Turnbull, Chamber president.

Greg Lindberg of the Small Business Administration will conduct the workshop.

The workshop will be held at the Chamber of Commerce office, 8276 Park Road, Batavia.The session will run from 7:45 to 9:15 a.m. and includes a question-and-answer period. Cost for non-Chamber members is $10 for each attendee.

Chamber members and Batavia Business Improvement District members may attend all small business workshops free of charge but should make reservations to insure space.

Auto Wash Car Wash on West Main Street Road opens tomorrow with three days of half-price specials, prizes

Tomorrow through Sunday, May 13, is the Grand Opening of the long-awaited Auto Wash Car Wash on West Main Street Road in the Town of Batavia.

You are invited to stop by and say hi and try out the completely refurbished car wash.

Throughout the three-day Grand Opening, all car wash package options will be half price. So the normal price range of $17 to $9 will be $8.50 to $4.50.

On Saturday, there will be free lunches served from 11 a.m. to 2 p.m. -- hamburgers, hot dogs and soda pop.

Bergen resident receives national award as TV Programmer of the Year for Rochester's WXXI

WXXI’s Television Program Director Irene Fink, who lives in Bergen, was recognized as the “Charles Impaglia Programmer of the Year” by TRAC Media Services and the Public Television Programmers’ Association (PTPA) at the PTPA Annual Meeting in New Orleans on May 6.

The Programmer of the Year Award is given to someone who “has developed a program format that has had significant impact on his/her community,” and “demonstrates an ability to creatively use changes in the media environment to his/her station’s advantage.”

Fink has served as WXXI’s Television program director since 2009. She is responsible for programming strategy and scheduling on WXXI's television stations and on City 12 (cable 1303) in the City of Rochester. 

The PTPA praised Fink’s impact at WXXI and the effect she has had on the community. They listed several reasons why she was the top programmer:

  • She weighs all content decisions with the audience and community in mind.
  • She is a good communicator and collaborator, ensuring that WXXI’s content reaches the widest audiences across multiple platforms.
  • She goes above and beyond in the programming and promoting of WXXI’s Move to Include initiative, helping to ensure people with disabilities are represented in WXXI’s content throughout the year. Move to Include is a partnership between WXXI and the Golisano Foundation designed to promote inclusion for people with intellectual and physical disabilities. 

Fink joined WXXI in 1998 as a casual in the Engineering Department, and in 2002 moved into the TV Division as traffic coordinator. In 2006 she was promoted to assistant director of TV Programming/Traffic and in 2009 to TV program director. She has a Bachelor of Science degree in Communication from SUNY Brockport. Fink resides in Bergen with her daughter Kaitlyn.

This is the second award Fink has received from PTPA and TRAC Media Services. The first was the Golden Grid Award in 2011, which she received in recognition of her ability to help strengthen her community by scheduling high-quality programs.

The “Charles Impaglia Programmer of the Year” award is given by PTPA and TRAC Media Services, an audience analysis organization that works with public television stations.

Dan Ireland: UMMC making great strides in health care

Dan Ireland, CEO of United Memorial Medical Center, had a steady stream of accomplishments to share with local health care leaders gathered Friday morning at Terry Hills for his annual State of UMMC presentation.

Ireland discussed the awards won by UMMC and staff members, the financial health of the organization, its successes in saving lives and preventing the spread of infections, and future plans for growth.

The hospital, now part of the Rochester Regional Health network, employes 880 full-time, part-time, and per-diem staff members.

In 2017, there were 22,000 emergency room visits, and nearly 100,000 medical visits total.

There were 576 births at the hospital.

"We’re touching our community in many different ways," Ireland said. "We’re making a difference to many patients."

He shared the story of Paul Boylan, a well-known figure in the local legal community as well as the UMMC community. Boylan was diagnosed with prostate cancer and chose the Lipson Cancer Institute for treatment.

After 28 rounds of radiation, Moylan, 78, is now cancer free.

"Paul credits Dr. Meri Atanas and all of the team at Lipson for the care he received right here at home, high-quality care, care that takes you through some of the biggest battles of your life," Ireland said. "Paul is very happy to be back practicing law, enjoying life and doing what he needs to do."

Ireland also shared the story of a staff member whose job includes educating portions of the population on health care. He found to talk with some people about health care, he needed to speak Spanish, so he learned Spanish.

"He did that on his own," Ireland said. "He made sure he had the right tools to give the right care to patients," Ireland said.

Then there is Andrea Sherwood, winner of the Josie King Hero Award. Josie King died in a hospital in Baltimore as the result of a medical staff mistake. Her mother, Sorrel King, created the Jose King Foundation, dedicated to helping hospitals eliminate mistakes that cost lives.

After Sorrel King spoke with UMMC staff at an event last year, she learned of actions Sherwood took to catch a mistake. She may have saved a patient's life.

It was Sherwood's job to administer contrast media to a patient for an MRI. As is the procedure, she reviewed the patient's lab results. Some patients, based on lab results, shouldn't receive contrast media. While an initial review of the results seemed to indicate it was fine to proceed with the procedure, Sherwood's instincts told her something wasn't right so she took extra steps to double check the lab results. It turned out, the wrong lab results had been provided for the patient. That patient could have been seriously injured or killed by the contrast media.

Other awards for the hospital have gone to the Wound Care Center, ICU, and the emergency room for stroke treatment.

UMMC has also received an award from Univera for taking steps to reduce hospital-acquired infections.

"About 10 years ago when they put this tool in place it seemed like it would be impossible to beat, to get that number down to where the benchmark should be," Ireland said. "Last year, Univera said, 'you not only got that number down, you beat the benchmark and now have the lowest (score) in Western New York.'”

In November, the Joint Commission on Accreditation initiated a surprise four-day inspection of UMMC, looking, Ireland said, around every corner and "under every rock." They do everything the can, he said, to find issues, what they call "findings."

"They also told us that they never come in without some findings," Ireland said. "They have to find something. So they did. They found 18 items they wanted us to work on, to make some corrections. As an administrator, of course, I asked the surveyor, '18, good, bad?' 'Well, we did the math and most organizations your size have about 40. You had 18 and we worked really hard to find those 18.'"

UMMC is also undertaken other steps to improve patient safety, including a meeting every morning among senior staff to review the previous day's safety alerts.

The process, because of the extra attention to identifying potential safety problems, has meant in 2017, the number of safety issues identified has gone up.

That creates more opportunities to correct problems, Ireland said. The goal is to get it down to zero.

Anybody can alert the hospital to a safety event, including every member of staff and patients who have access to the patient portal online.

As of Friday, it had been 71 days since a serious event was reported, and it had been 200 days before that without a serious event (the longest streak yet under the new reporting system).

A serious event is defined as one that increases the length of a patient's stay or changes the course of care.

In the area of fighting infections, the hospital also tracks infections as a result of using an IV in a patient's neck -- a very rare procedure because of the health risks associated with it. It's only used when absolutely necessary.

There have been no infections as a result of the procedure since 2013.

C-Diff infections have also been greatly reduced. While the trend across the nation is for C-Diff infections to increase at hospitals, it has declined dramatically at UMMC, Ireland said.

As for UMMC's future, there are plans a new $18 million ICU/Radiology wing, a new urgent care clinic in Le Roy, an improved urgent care in Batavia, and the partnership with the YMCA for a healthy living campus in Batavia.

Couple opens winery in Elba

Growing grapes and making wines is probably the last thing Bob and Ingrid Bowen expected to be doing after retirement.

Even Bob can’t believe the turn of events.

He and his wife both worked at Xerox, but after their four boys went to college, Ingrid announced she wanted a horse.

That started the search for a farm in the country.

“John Mortellaro of Batavia was a family friend and he said he knew about a place near Elba,” Bob said. “The farm had been abandoned, the house was a mess and the place was overgrown, but my wife loved it.”

“It was pretty dilapidated,” Ingrid said.

The Bowens retired in 2011 and bought the farm, renovated the house, cleared the land and built a barn.

Then Bob started thinking about what to do with the land, and he has always liked wine and had made wine as a hobby. He realized Genesee County doesn’t have the kind of weather needed for grapes, but he went to Cornell, where they have a grape research facility and took a course on becoming a vintner.

“In 2012, we planted the vineyards with three grapes from Cornell with code names,” Bob said. “They were developed to grow in cold country. Our weather here is colder, because we don’t have hills and lakes to keep the temperature moderate.”

The first year, temperatures were down to zero, with a wind chill of minus 30, Bob said.

“We lost 120 vines and there was nothing we could do,” he said.

The Bowens already knew they didn’t want to rely solely on grapes, and had planted acres of apple, cherry, peach and apricot trees, along with blueberries and raspberries.

They hired Augie Katrencik, of Macedon, as winemaker. He has 10 years of experience in the business and has been a longtime friend of the Bowens.

On Sunday, the Bowen’s officially opened their winery at 6870 Norton Road with an open house.                   

The Bowens specialize in fruit wines, with apricot, peach, peach and honey, pear, pumpkin and spice, and Traminette* available now.

In June, they will have available blueberry, Dechaunac, Diamond, spiced apple and even tomato wine.

“If you’ve never tried tomato wine, you’re in for a surprise,” Bob said. “It doesn’t look like V8.”

Kim Shay, of Victor, said she loved it.

“It’s very good,” she said.

The idea came from Katrencik, who said his grandparents used to make tomato wine.

Later in the year, the winery will have red raspberry and blueberry.

The Bowens are thrilled to be the first winery in Genesee County and are purchasing everything they can for the business locally. This includes contracting with Hodgins Printing to make their labels.

Bob said they will be at the Downtown Batavia Public Market this summer and at the Genesee County Fair. He is in discussions with local retail liquor stores to carry their wines.

Ribbon Cutting: Anyone can learn art at Art of Mandy in Le Roy

Mandy Humphry cut a bright red ribbon yesterday afternoon in front of the former Bank of Le Roy building on Main Street in Le Roy to celebrate her new business, The Art of Mandy.

The business, on the second floor, offers adult classes for anybody of any age 2 and older.

"I decided to open the studio because there’s nothing like this in Le Roy and this is where I live," Humphrey said.

Humphrey has a degree in art studio and painting and she earned her master's from RIT in art instruction. She worked in public schools but decided she preferred to working independently.  

The Art of Mandy offers classes for kids and adults in drawing, painting, watercolor, photography, calligraphy and more, Humphrey said. She also hosts private events and birthday parties (bring your own beverages) and she will also go to offices and homes for parties.

Arc of Genesee Orleans honors volunteer, inducts new board president

Peggy Schreck was awarded Volunteer of the Year at the annual dinner of the Arc of Genesee Orleans. The award was presented by Shelly Kurdish, director of Rainbow Preschool, where Schreck volunteers.

Debrah Fischer, co-owner of WBTA, assumed the office of president of the board of directors for Arc (next photo, and bottom photo, with board of directors).

More than 400 people attended the dinner and awards program at Genesee Community College's new field house.

“Each year the Arc of Genesee Orleans honors an individual for their commitment to outstanding volunteerism for making a difference in the lives of others. Volunteers are the cornerstone of our agency and are vital to raising awareness of the great work the Arc provides in the communities in which we live and work. This year the Arc of Genesee Orleans has selected Peggy Schreck as the Volunteer of the Year.

Peggy Schreck began volunteering at Rainbow Preschool in Albion in 2012, and before that Peggy participated on various Arc committees. Peggy actually began her career in the very same building that Rainbow Preschool is now, when it was the Arnold Gregory Memorial Hospital and she was a lab technician.

Peggy and her husband moved to this area so her husband could complete college at GCC and Brockport where he then went on to become an elementary teacher. Peggy also enjoyed the educational setting and was a teacher aide for several years at Medina schools. Peggy later moved in to a position at Medina Savings and Loan where she retired 2010. She wanted to still be a part of the classroom and that is when Peggy began volunteering at Rainbow Preschool.

It is very obvious to the staff, students and families that Peggy thoroughly enjoys her time in the Rainbow Preschool classrooms and the time spent with the children. Peggy states she most enjoys watching the children’s growth and success during the school year, such as hearing a child’s speech develop or their gross motor skills expand. She also enjoys all the children’s smiles and hugs when she gets to the classroom. Peggy notes she enjoys the structure of the classrooms and this is a good fit for her with her prior classroom experience. Peggy says she has also developed many friendships with the staff and families from her volunteer role and she enjoys these new relationships within the community.

Peggy feels she is utilized in the classroom and enjoys the hands on activities and responsibilities she is provided. The teachers and aides all comment what an incredible addition Peggy is to the classroom and she brings such compassion and care to her work. She does special projects with the children and brings fresh ideas to the classroom. Peggy treats all the children as she would her own grandchildren, and she enjoys this because she does not get to see her own grandchildren because they live far away in Georgia where her son is located for his profession. The children call her Miss Peggy or Grandmom and this warms Peggy’s heart with happiness and brings her joy.

I am so pleased to present this year’s award for Volunteer of the Year to Peggy Schreck and to give her on the behalf of everyone at Rainbow Preschool and the Arc of Genesee Orleans our heartfelt thanks and appreciation for her years of dedicated volunteerism at Rainbow Preschool."

The second consecutive year, the team in the Wound Care and Hyperbaric Medicine Center at UMMC received the Robert A. Warriner III, M.D., Center of Excellence Award.

UMMC achieved patient satisfaction rates of higher than 92 percent and a healing rate of at least 91 percent in less than 30 median days to heal. The award was presented by Healogics, the nation's largest provider of advanced wound care services.

Darien Lake announces new ride, fun summer events

Darien Lake showed off its newest roller coaster, Tantrum, on a hard hat tour just prior to the park’s opening day, Saturday, May 5. The nearly $5 million addition will be Darien Lake’s seventh coaster that will take riders on a signature beyond-vertical drop that hasn’t previously been offered to park guests.                                                                               

Tantrum, the first coaster of its kind in New York State and Ontario, Canada, is scheduled to open Memorial Day weekend. When complete, the coaster will embark riders on a 98-foot vertical lift at a 90-degree angle – straight up the coaster’s first hill. In a matter of seconds, upon reaching its apex, the train plummets into a 97-degree drop and pretzel inversion. Reaching speeds of 52 mph, the coaster snakes through the structure over a bunny hop, keeps riders wondering which way is up or down during an Immelmann turn, and finishes with a tilted loop.

“There is more time to ride the new Tantrum roller coaster and establish new family traditions with an extended operating season from May 5 to October 28,” said Darien Lake General Manager Chris Thorpe. “Season Pass holders visiting the park during opening weekend will even receive a bonus free friend ticket!”

New Mercy EMS headquarters about ready for move-in day

A new, spacious headquarters for Mercy Flight/Mercy EMS will serve as a much-needed home away from home once the ribbon is cut on the new facility off Route 98 in Batavia on May 21.

"I’m looking forward to the crews being able to move into a home," said Bill Schutt, business development manager for Mercy EMS. "That was the whole gist of this thing --  give them a home while they were at work.

"They spend a lot of time here. They spend a lot of shifts here. They spend a lot of time together, probably more so than families. Holiday time when we’re home enjoying our family, they're here still working."

The 12,000-square-foot facility has bays for ambulances in half the space and the other half contains offices, storage, showers, a workout area, a day room, a quiet room, a kitchen suitable for crews to enjoy meals with their families, and a large conference room.

"The space is large enough to house the ambulances, keep them out of the weather and to provide everything the crews need throughout their 12- or 24-hour shifts," said Scott Wooton, VP of finance for Mercy Flight. "If they’re here for a 24-hour shift, they need to be able to prepare food. They need to be able to wash their uniform if they come back from a call where their uniform is soiled.

"They need to be able to rest. They need to be able to sit down and chart stuff. This has been a need right from the start. It’s only that it’s taken nine years for us to put all the pieces together and make it happen."

The $2.5 million facility was largely financed through assistance from M&T Bank and the Genesee County Economic Development Center, which was able to provide tax-exempt financing.

That assistance was critical to making the new building possible, Wooton said.

"We certainly don’t have that much cash on hand so we couldn’t do it without the financing and being able to do it in a tax-exempt way keeps that interest rate more manageable for us and spread it out in a way that the monthly payments are more manageable," Wooton said.

David Ciurzynski, business development manager with Manning Squires Hennig, said one of the key features of the new building is its energy efficiency. The large garage doors that are all glass will allow a lot of natural light into the ambulance bays and all lighting throughout the building is LED. The energy efficiency will help Mercy EMS reduce its operating costs.

The pre-engineered building also helped reduce costs and accelerate construction time.

"We were able to keep the construction period tight so they can get in and get it in use as quickly as possible," Ciurzynski said. A pre-engineered building allows you a lot of flexibility on time because components come quickly but it also gives you a very handsome building they can use for years to come and it’s exapandable."

The Batavian celebrates 10 years in business

The Batavian celebrated 10 years of delivering news and support to local businesses at Eli Fish Brewing Company in Batavia yesterday.

Sharon White, above, representing Assemblyman Steve Hawley, delivered an Assembly Citation recognizing The Batavian for 10 years of service to the community. 

Michael Kracker, representing Rep. Chis Collins, delivered a copy of Congressional Record for May 1 commemorating The Batavian's 10 years in business and recognizing the efforts of Publisher Howard Owens and Editor Billie Owens for their commitment in preserving the First Amendment.

Jay Grasso, representing State Senator Michael Ranzenhofer, delivered a Legislative Resolution, which was read into the State Senate record yesterday, marking The Batavian's 10th anniversary.

A letter from Sen. Charles E. Schumer congratulating the publisher and editor of The Batavian on the 10th anniversary of their local news business was also received before the event.

It reads, in part: "I applaud you both for the leap of faith you took back in 2009 when you moved to Batavia and garnered the support of local businesses in order to keep this news outlet alive. Thanks to your efforts, The Batavian remains a go-to source for local news and is supported by more than 150 local businesses."

Tom Turnbull, president of the Genesee County Chamber of Commerce, and publisher of the Batavia Daily News when The Batavian first startedserved as emcee Tuesday afternoon. He noted how there was an intense rivalry between himself and Howard Owens in the beginning, but now they often work together as friends with the shared mission of promoting local business in Genesee County.

Also in attendance, Dan and Debbie Fischer, owners of WBTA radio. WBTA is an official news partner with The Batavian and has been a partner and friend to The Batavian from the beginning.

Howard Owens spoke briefly and recognized the contributions of several people, including the Fischers and Turnbull, who have helped him and his wife over these past 10 years, including staff member Lisa Ace, who has been with the company for almost seven years and is critical to helping The Batavian serve local businesses.

The Batavian officially launched May 1, 2008, without an office in Batavia. The site was then owned by GateHouse Media. The editor was Philip Anselmo* and he camped out at Main Street Coffee every workday covering local news from his unofficial office. The location of Main Street Coffee is now Eli Fish Brewing Company.

On March 1, 2009, Howard and Billie became owners of The Batavian, sold their house in Pittsford and moved to a duplex on Maple Street in June of that year.

At the time, there were only about a half dozen online-only news sites in the nation. Today, there are more than 200 and The Batavian is among the most successful of the online-only ventures.

The Batavian and Howard Owens have received awards from the New York Press Association, the Inland Press Association, and the National Press Photographers Association. This news site also received the 2009 Innovative Enterprise of the Year Award from the Genesee County Chamber of Commerce, and the 2013 Spirit of Downtown award from the Downtown Batavia Business Improvement District.

Ranzenhofer honors Bev Mancuso as Woman of Distinction

Senator Michael H. Ranzenhofer has recognized Cornell Cooperative Extension Executive Director Beverly L. Mancuso, as a Woman of Distinction at the 21st annual ceremony, for her outstanding contributions in enriching the quality of life for the community and beyond.

“Beverly has been widely recognized as an effective leader and a connector for community-based organizations to other partners and volunteers. This is a well-deserved honor to recognize Beverly’s efforts in our community, as well as her positive impact in the lives of so many residents. I wish her all the best in retirement,” Ranzenhofer said.

Mancuso has served at the Cornell Cooperative Extension in Genesee County for 16 years, 13 years as executive director. She is responsible for the overall leadership of the organization, including programming for Leadership Genesee, 4-H Youth Development, Master Gardener Program and Agriculture. 

Mancuso started her career working in finance and physician practice management at two hospitals, then furthered her education at the Rochester Institute of Technology. For five years, Mancuso worked to enhance the experience of patients at the Genesee County Health Department.

Mancuso is expected to retire from the Cornell Cooperative Extension in June.

“I am honored to be recognized by Senator Ranzenhofer. I learned the importance of listening at an early age, and this skill has helped me during my career in both the public and not-for-profit sectors,” Mancuso said. “I am looking forward to the next great adventure.” 

Mancuso was a member of the inaugural class of Leadership Genesee in 2001, and she was recognized as an Outstanding Alumna years later.

She is currently a proud member of the Muriel H. Marshall Fund Planning Team. Mancuso has been actively involved in the community for years, including Kiwanis, Boy Scouts, Genesee Country Village, Parish Councils, and Office for the Aging Advisory Committee.

UMMC recognized for second year in a row with national award for excellence in wound healing

United Memorial Medical Center physicians, leaders, and clinicians will gather together Wednesday to celebrate the Robert A. Warriner III, M.D., Center of Excellence Award, which is being presented to the Wound Care and Hyperbaric Medicine Center.

For two consecutive years, UMMC has achieved patient satisfaction rates of higher than 92 percent and a healing rate of at least 91 percent in less than 30 median days to heal. The Center is being awarded this prestigious honor by Healogics, the nation's largest provider of advanced wound care services.

Out of 340 eligible Centers, 268 were honored with this award. The award is named for Dr. Robert A. Warriner III, a pioneer in wound care and the former Chief Medical Officer for Healogics.

Downtown business owners encouraged and praised at BID's annual breakfast

Pastor Marty Macdonald was an evangelist for Downtown Batavia at the Business Improvement District's annual meeting and awards breakfast in the Generation Center on Friday morning.

Macdonald, pastor of City Church and the keynote speaker Friday, delivered a sermon on the virtues and values of Batavia, his belief in its potential, and his encouragement for Downtown's business owners to remain steadfast in their commitment to growth and community.

“This is the greatest city on the face of the Earth,” Macdonald said. “I really believe that. We as leaders are commissioned to make incredible decisions, not just once in a lifetime but every single day because we are presented with the call to make the future around us great. And not just for five, 10 or 15 years. We are called to change generations yet to come.”

He said he is overjoyed to see the success he sees coming Batavia's way and encouraged business owners not to gripe about the problems they might see but embrace what is going right.

"I’m thankful when I pull into the parking lot next to our building and I can’t find a place to park," Macdonald said. "I remember there was a time you could have thrown a bowling ball in any direction and not hit anything. Now people are upset because they’ve got to walk a little bit. Come on, we need to walk more anyways."

Instead of listening to the few lingering negative voices in the community who badmouth everything they see, Macdonald said we all should aim higher.

"I know I’m not talking to anybody in this room who talks about things that can’t be done," Macdonald said. "I’m talking to people who are can-do people here. Instead of saying what cannot be done or listening to the two or three voices in the community that seem to have the largest megaphone built into their mouths, let’s decide to live at a higher level than we’ve ever lived before. Let’s commit our attitude to be changed in order to go higher and go further than we have ever gone before."

After comparing and contrasting two birds of the desert -- the vulture that feeds only on dead things and the hummingbird that seeks beautiful flowers and spreads life -- Macdonald said, "Can I encourage you today to start thinking like a hummingbird, to start thinking like that one who is looking for life, looking things that are living, instead of focusing on something that is dead. I just want to throw this out here, and I don’t mean to insult anybody, but urban renewal is over. It’s dead. It’s gone. Yes, we learn from yesterday but we can’t stay stuck in yesterday if we are going to move on to a great future."

Adding, "In my church, everyone would say, ‘Amen’ right now."

Jon Mager, co-owner of the newly established Eli Fish Brewing Company, along with Matt Gray and Matt Boyd, delivered the opening remarks, talking about how the new restaurant, brewery, and restaurant incubator came to be.

"We all grew up in Batavia," Mager said. "We’re all very familiar with the area. We recognize that Downtown has been hurting for quite a few years. Over the years we, unfortunately, saw many restaurants and retail stores leave Downtown or close up completely. We admit we looked other places. We saw places with lower rent, lower operating costs, and lower construction costs over the entire project."

But they picked the former Newberry building for several reasons, including (the fact that) its surrounded by parking; Jackson Square is a hidden gem; there is ample traffic passing past the location; the current Downtown businesses are "awesome," and they are all nostalgic and love old buildings.

City Council President Eugene Jankowski talked about the benefits of the Downtown Revitalization Initiative and the process of the city winning the $10 million prize.

He recalled that while making a presentation in Albany, a slideshow of pictures was on a screen behind him when serendipity struck.

"I was talking about how I was walking to school and I remember the smell of those wet, demolished bricks and seeing this once beautiful downtown just rumble down," Jankowski said. "I remember that smell and I was telling the story, and unbeknownst to me, the picture came up of urban renewal and a pile of wet bricks. Jason (Molino) told me that afterward and I thought maybe the timing is right on this one."

Jankowski expressed his appreciation for Downtown's local business owners.

"I want to thank you from the bottom of my heart for investing your time and your hard-earned money in our Downtown and in our City," Jankowski said. "I know it’s a risk and I know sometimes it’s not always easy, but I as a Batavian really appreciate driving down Main Street and seeing all the traffic."

Sen. Schumer and Speaker Ryan join forces to protect O-AT-KA, and work to undo Canada's dairy trade barriers

U.S. Senate Democratic Leader Charles E. Schumer announced today that he is working directly with Speaker Paul Ryan (R-Wisconsin) and Senator Tammy Baldwin(D-WI) to urge U.S. trade officials to secure a level playing field with Canadian producers during the renegotiation of the North American Trade Agreement (NAFTA).
 
According to Schumer, in recent years, Canada has established dairy pricing policies and has maintained high tariffs that have effectively created a “Dairy Wall” stopping most U.S. dairy products from accessing Canadian markets and distorting global trade. Dairy farmers and producers, like O-AT-KA Milk Products Cooperative Inc. in Batavia, Cayuga Milk Ingredients in Cayuga County and dairy producers in Wisconsin, have been severely hurt by Canada’s manipulative trade practices and it will only get worse without action.
 
Senator Tammy Baldwin (D-WI) from Wisconsin has also been a leader on lowering Canada’s dairy trade barriers, working closely with Senator Schumer.
 
“With Speaker Ryan’s and Senator Baldwin’s help, we now have a real opportunity to churn the tide and hopefully fix the unfair Canadian dairy trade barriers that have plagued dairy farmers and producers from the Finger-Lakes to Central New York to Wisconsin,” said Senate Democratic Leader Schumer.
 
“Our hardworking New York dairy farmers and producers across Upstate New York are the most competitive in the world, but they depend on stable and fair rules to compete in a global economy, to sell their dairy products, expand their business and create new local jobs – and right now, for dairy, Canada is erecting unfair barriers and not playing by the rules and the current NAFTA renegotiation must be used to rectify that.”
 
Schumer explained Canada has an unfair advantage over New York dairy farmers and producers. In addition to Canada’s 270 percent tariff on milk, a program called the “Class 7” pricing program, a market-distorting supply management system, has caused severe pain to New York dairy producers since it came into force last year.
 
In fact, Canada has used the Class 7 program to triple its milk powder exports in the past year by creating excess milk production capacity within Canada, then dumping the resulting milk powder onto world markets. To further prove this dumping exists, Schumer added that Canada’s dairy farmers are some of the highest paid in the world, yet Canadian dairy companies are still able to be among the lowest cost sellers of Class 7 products globally.
 
As U.S., Canadian and Mexican trade officials are closing in on a deal to revamp North American Free Trade Agreement (NAFTA), Schumer said working with Senator Baldwin and Speaker Ryan – who represents many dairy farmers and producers in their own state, represents a real opportunity to finally dismantle Canada’s market-distorting policies and ensure a level playing field for American dairy farmers and producers.
 
Schumer continued: “As trade officials near a deal to renegotiate NAFTA – a bipartisan issue President Trump, Senator Baldwin, Speaker Ryan and I agree on – we must make it a top priority to begin reversing restrictive dairy pricing policies in Canada that are hurting our dairy producers at their core, and now is a real opportunity to do just that.”

Senator Schumer says new Nafta talks offer shot at undoing Canada's unfair dairy pricing and trade policies

Dairy farmers and producers, like the 340 dairy farmers who make up Upstate Niagara Co-Op, which supplies O-AT-KA Milk Products Cooperative Inc. in Batavia, have been severely hurt by Canada’s manipulative trade practices and it will only get worse without action.

O-AT-KA Milk Products Cooperative Inc., with more than 400 employees and majority owned by Upstate Niagara, has already lost millions of dollars in contracts due to Canada’s actions “Dairy Wall.”

Schumer said that the time to secure a level playing field with Canada by expanding market opportunities and eliminating Canada’s unfair pricing policies – is now and we cannot let this opportunity go to waste.

“Our hardworking New York dairy farmers and producers like Upstate Niagara Co-Op’s 340 farm family members across the Finger Lakes and O-AT-KA Milk Products in Batavia are the most competitive in the world, but they depend on stable and fair rules to compete in a global economy, to sell their dairy products, expand their business and create new local jobs,” Schumer said.

In fact, Canada has used the Class 7 program to triple its milk powder exports in the past year by creating excess milk production capacity within Canada, then dumping the resulting milk powder onto world markets. To further prove this dumping exists, Schumer added that Canada’s dairy farmers are some of the highest paid in the world, yet Canadian dairy companies are still able to be among the lowest cost sellers of Class 7 products globally.

Anderson Farm is one of the 340 dairy farm members of the Upstate Niagara Co-Op, which is the majority owner of the O-AT-KA Milk Products facility in Batavia. More than 400 employees work at O-AT-KA. Upstate Niagara dairies throughout the Rochester Finger Lakes Region like Anderson Farm depend on O-AT-KA to purchase their milk to then manufacture and sell milk products for the domestic and international markets.

Since Canada’s implementation of Class 7, O-AT-KA lost $19 million in annual sales of Ultra Filtered milk (UF Milk), a product used to make cheese and other dairy products that it had been exporting into Canada. Moreover, the production of this UF milk for the Canadian market had accounted for 20 percent (about 180 million pounds) of all of O-AT-KA’s milk volume.

This severely undercut a $16 million investment made by O-AT-KA in 2012 to build a two-story addition at its Batavia plant to manufacture UF Milk to support its export business to Canada. When Canada unfairly cut off UF Milk imports and implemented Class 7, it dealt a significant blow to the local agriculture economy and was a factor in the current U.S. milk inventory imbalance that is contributing to now drive the price of milk down.

Schumer was joined by Jim Anderson, fourth generation owner of Anderson Farm, O-AT-KA Milk Products Cooperative Inc. President & Chairman John Gould, local dairy farmers, and elected officials.

Gould, who also owns an Upstate Niagara Co-Op dairy farm in Genesee County, said “Canada has a long history of erecting barriers to trade when it comes to dairy and the creation of Class 7 is an example of that. Canada's Class 7 market manipulation has caused harm to O-AT-KA Milk Products and their farm family owners, whose investments in serving legitimate customers in Canada have been blocked.

"As NAFTA is renegotiated, it is time that Canadian gamesmanship ends and a constructive agreement is reached that allows market participation and access under rules that all trading partners can follow. We thank Senator Schumer for his leadership and work in keeping this important issue top of mind as negotiations proceed."

As U.S., Canadian and Mexican trade officials are closing in on a deal to revamp North American Free Trade Agreement (NAFTA), Schumer said now represents a real opportunity to dismantle Canada’s market-distorting policies and ensure a level playing field for American dairy farmers and producers.

Right now, products manufactured by O-AT-KA Milk Products include non-fat dry milk powder, buttermilk powder, whey powder, canned evaporated milk, butter, fluid condensed milk, iced coffee, nutritional beverages and other various drinks.

O-AT-KA has gross annual sales of more than $300 million and is a significant employer and economic development engine in Upstate NY’s dairy and manufacturing industries. Schumer said that in order for Upstate Niagara member dairies and O-AT-KA to continue to be global leaders, Canada’s rapacious dairy-related trade policies need to be addressed and that NAFTA represents a major opportunity to do so.

Here's Schumer's letter to Ambassador Robert Lighthizer, United States Trade Representative:

Dear Ambassador Lighthizer:

As the North American Free Trade Agreement (NAFTA) renegotiations come towards a conclusion, I would like to again emphasize the importance of securing meaningful concessions from Canada to provide stable market access for our dairy producers. Securing meaningful and enforceable commitments that will allow U.S. dairy producers to compete with Canada’s on a level playing field should be a top priority in NAFTA renegotiations. As I have expressed to you many times, I strongly believe that we should not miss this opportunity to protect our dairy producers from Canada’s recent predatory trade practices.

As you know, Canada’s Class 7 pricing program, a market-distorting supply management system, has caused severe pain to New York dairy producers since it came into force last year. Canada has also maintained large tariffs on dairy products, including a 270 percent tariff on milk. New York’s dairy farmers and companies like Cayuga Milk Ingredients, O-AT-KA Milk, and Ideal Dairy Farm, rely on market-based trade with Canada for a significant percentage – millions of dollars – of their revenue. Not only are New York’s producers locked out of Canada’s ultrafiltered milk market, but in just a year’s time, Canada has used its Class 7 program to triple its milk powder exports, dumping powdered milk products into global markets and undercutting New York dairy producer’s exports. This Class 7 system is likely a violation of Canada’s World Trade Organization (WTO) commitments, but addressing it quickly through NAFTA renegotiation is needed, rather than waiting for years for a WTO determination. This Class 7 system should be dismantled through new NAFTA commitments.

In our discussions, you have committed to me that you would prioritize addressing this issue through NAFTA renegotiations. The President has also privately expressed to me his explicit desire to address this issue and has publically emphasized, many times, the unfair way that Canada has treated our dairy producers, noting just last month: “Canada must treat our farmers much better. Highly restrictive.”
