Crossroads House delights in gift of new wheelchair van

A dream of Crossroads House founder Kathy Panepento has been realized through a generous gift from the family of a past resident.

Twenty years ago, Samuel Marchese spent his last days at Crossroads House. Because of a generous gift given by his daughter, Antoinette Clancy, and her husband, Emmett, Crossroads House was able to fund some foundational projects throughout the home, open only two years at the time.

The families of Crossroads House residents are forever families and so many faithfully support the mission long after their loved ones were served in our home. The Clancys remain one of those families. Recently they reached out to Crossroads House with the desire to bless our home again.

Panepento has always envisioned the idea of a comfort care home having it’s own wheelchair van to enhance the end of life experience and embrace every opportunity to live and make memories while at Crossroads House.

The Clancys embraced that idea and funded a brand new 2019 Dodge Grand Caravan wheelchair van. This gift allows Crossroads House to relieve families of often unreimbursed ambulance trips on admission.

The van will also make it possible to take residents and their loved ones out for day trips and outings that will create forever memories. Giving residents and their families the opportunity to live every moment has always been the mission of Crossroads House and this gift will help us continue to fulfill that in new and enduring ways.

Ag trade deal with Canada and Mexico to expand market for local dairy, wine, eggs and more

Washington, D.C. -- U.S. Secretary of Agriculture Sonny Perdue issued the following statement today (Jan. 29) after President Donald J. Trump signed the U.S.-Mexico-Canada Agreement (USMCA).

“Today is a good day for American agriculture," Perdue said. "Throughout this process, there were many detractors who said it couldn’t be done. But this is further proof that President Trump’s trade negotiation strategy is working. This agreement shows the rest of the world the United States is open for business.

"USMCA is critical for America’s farmers and ranchers, who will now have even more market access to our neighbors to the north and the south. I am excited to see the economic benefits of this agreement increase the prosperity of all Americans, especially those living in rural America."

Background about the USMCA

It will advance United States agricultural interests in two of the most important markets for American farmers, ranchers, and agribusinesses. This high-standard agreement builds upon our existing markets to expand United States food and agricultural exports and support food processing and rural jobs.

Canada and Mexico are our first and second largest export markets for United States food and agricultural products, totaling more than $39.7 billion food and agricultural exports in 2018. These exports support more than 325,000 American jobs.

All food and agricultural products that have zero tariffs under the North American Free Trade Agreement (NAFTA) will remain at zero tariffs. Since the original NAFTA did not eliminate all tariffs on agricultural trade between the United States and Canada, the USMCA will create new market access opportunities for United States exports to Canada of dairy, poultry, and eggs, and in exchange the United States will provide new access to Canada for some dairy, peanut, and a limited amount of sugar and sugar-containing products

Earlier this year, nearly 1,000 American food and agriculure associations and companies announced their support for USMCA and the National Association of State Departments of Agriculture signed a letter to Congressional leadership urging them to ratify USMCA.*

In September, all former U.S. secretaries of Agriculture since President Reagan’s Administration announced support for USMCA. In a letter to Congessional leaders, former Secretaries John Block (Reagan), Mike Espy (Clinton), Dan Glickman (Clinton), Ann Veneman (W. Bush), Mike Johanns (W. Bush), Ed Shafer (W. Bush), and Tom Vilsack (Obama) underscored the importance of passing USMCA saying:

“We need a strong and reliable trade deal with our top two customers for U.S. agriculture products. USMCA will provide certainty in the North American market for the U.S. farm sector and rural economy. We strongly support ratification of USMCA.”

Key Provision: Increasing Dairy Market Access

  • America’s dairy farmers will have expanded market opportunities in Canada for a wide variety of dairy products. Canada agreed to eliminate the unfair Class 6 and Class 7 milk pricing programs that allowed their farmers to undersell U.S. producers.

Key Provision: Biotechnology

  • For the first time, the agreement specifically addresses agricultural biotechnology – including new technologies such as gene editing – to support innovation and reduce trade-distorting policies.

Key Provision: Geographical Indications

  • The agreement institutes a more rigorous process for establishing geographical indicators and lays out additional factors to be considered in determining whether a term is a common name.

Key Provision: Sanitary/Phytosanitary Measures

  • The three countries agree to strengthen disciplines for science-based measures that protect human, animal, and plant health while improving the flow of trade.

Key Provision: Poultry and Eggs

  • U.S. poultry producers will have expanded access to Canada for chicken, turkey, and eggs.

Key Provision: Wheat

  • Canada agrees to terminate its discriminatory wheat grading system, enabling U.S. growers to be more competitive.

Key Provision: Wine and Spirits

  • The three countries agree to avoid technical barriers to trade through non-discrimination and transparency regarding sale, distribution, labeling, and certification of wine and distilled spirits.

WNY radio reading service for the vision-impaired gets grant to add podcasts and streaming

The Facebook Journalism Project has awarded the Buffalo-based Niagara Frontier Radio Reading Service a grant of $24,996 to fund the agency’s new Podcasts & Streaming Initiative. The project is expected to launch within the next two months.

The Niagara Frontier Radio Reading Service (NFRRS) -- a full-time radio station that was founded to serve people who are blind, have low vision, or have other print-related disabilities -- is expanding its service capacity by introducing podcasts and live streaming to its listeners.

The reading service is available to Genesee County listeners, primarily in the western portion of the county, according to Executive Director Michael Benzin.

The broadcast is carried over a subcarrier frequency leased for one dollar a year from WNED 94.5 FM. The radio station’s signal is not available to the general public but can be heard on special radio receivers, which are loaned at no charge to NFRRS listeners. While radios will continue to be an important communication tool, the NFRRS expects to see a tenfold increase in the number of listeners served with the addition of the new program.

By adding the Internet to its broadcast portfolio, listeners will be able to listen to the programs they want, wherever they are, when they want to, using virtually any internet-connected device.

The Facebook Journalism Project (FJP) is working with publishers around the world to help strengthen communities by connecting people with meaningful journalism. Working with the Lenfest Institute for Journalism, the Community Network grants were awarded to organizations in support of projects aimed at building community and new paths to sustainability in local news.

In addition to the award, NFRRS will also be matched with industry leaders as well as former or current participants in the Facebook Journalism Project’s Local News Accelerator to receive mentorship and guidance on specific program outcomes.

The Podcasts & Streaming Initiative received seed funding from the James Cummings Foundation and is also being supported by the East Hill Foundation, the Christos Foundation, Ingram Micro, and WNY Independent Living.

The Niagara Frontier Radio Reading Service was founded to help people who are blind, have low vision, or have other print-related disabilities "read" printed materials. Newspapers, magazines, books and other print materials are read "live" on-air or recorded for later broadcast by more than 100 active volunteers. The station’s radio signal covers Buffalo, Western New York and Southern Ontario, Canada.

Among the station’s program schedule are live readings of the Buffalo News six days a week and USA Today five days a week. The station also airs The Wall Street Journal, The New York Times, Niagara Gazette, Jamestown Post Journal, Dunkirk Observer, weekly newspapers like the local Bee Group Newspapers and Business First, a variety of magazines, and books curated from The New York Times' Best Seller List.

The NFRRS is an affiliate of Western New York Independent Living, a community-based nonprofit organization that serves more than 7,000 people with disabilities annually through peer counseling, support for independent living, transitional services, advocacy and information and referrals. WNYIL has an office in Batavia on West Main Street.

The NFRRS is funded primarily through philanthropic contributions and donations, grants, and special events.

Driver of car struck head-on in East Pembroke accident dies at ECMC

A woman who was driving an SUV struck head-on on Route 5 in East Pembroke yesterday morning has died, according to the Genesee County Sheriff's Office.

Patricia L. Dzienciol, 50, of Akron, succumbed to her injuries at the Erie County Medical Center.

Dzienciol was driving a 2015 Nissan Rogue westbound in the area of 2700 Main Road at 7:14 a.m. when 1997 Mercury sedan crossed over from the eastbound lane and struck her vehicle. The Rogue traveled off the north shoulder and overturned in a roadside ditch.

The driver of the Mercury, Kathleen Swanekamp, 84, of Roswell Avenue, Tonawanda, was cited for allegedly driving at a speed that was not safe nor prudent and for failure to stay in the right lane.

At the time of the accident, snow was falling and roadways were wet and slushy. East Pembroke Chief Don Newton said the conditions made it difficult for volunteers to respond to the scene both quickly and cautiously.

Car accident reported at Route 20 and Perry Road, Pavilion

A one-car accident is reported at Route 20 and Perry Road in Pavilion. The vehicle is in a ditch. The lone occupant, the driver, is breathing and semi-alert, according to a deputy on scene. Pavilion Fire Department and Mercy medics are responding.

UPDATE 5:15 a.m.: The first available tow is requested to the scene. The vehicle is a pickup truck 10 feet off the road, down in a ditch.

Four people seriously injured in early morning crash in East Pembroke

One of the drivers involved in a serious injury accident at 7:14 a.m. on Route 5 in East Pembroke was cited for two alleged traffic violations following an investigation into the collision.

Kathleen A. Swanekamp, 84, of Roswell Avenue, Tonawanda, was cited for allegedly driving faster than was safe or prudent for the conditions and for failure to stay in the right lane of traffic.

According to the accident report prepared by Deputy Nicholas Chamoun, Swanekemp was eastbound on Main Road east of Barrett Road when her 1997 Mercury sedan crossed into the westbound lane.

The car collided head-on with a 2015 Nissan SUV driven by Patricia Dzienciol, 50, of Golden Pond Estates, Akron. Dzienciol's vehicle overturned in a ditch on the north shoulder and East Pembroke Chief Don Newton said it was a lengthy process to extricate her from the vehicle.

Swanekamp had two passengers: William J. Danek, 26, and Daniel Cordner, 42. A passenger in the rear seat of Swanekamp's sedan also required extrication.

All four patients were taken to the trauma center at ECMC.

Law and Order: Batavia woman accused of striking person at GCASA multiple times

Jennifer L. Stack, 33, of South Main Street, Batavia, is charged with second-degree harassment. She was arrested on Jan. 25. At 10:35 a.m. on Jan. 11 an incident occurred at GCASA, 430 E. Main St., Batavia, and Stack is accused of striking a person multiple times while on the property. She was issued an appearance ticket and is due in Batavia City Court on Feb. 4. The case was handled by Batavia Police Officer Connor Borchert, assisted by Officer Kevin DeFelice.

Ashley E. Quintern, 30, of South Pearl Street, Oakfield, is charged with endangering the welfare of a child. She was arrested after an incident at 8:20 a.m. Jan. 24 where children were allegedly left without supervision for about an hour and a half at a location in the 100 block of Ross Street in the city. Quintern was issued an appearance ticket for Batavia City Court and is due there Feb. 4. The case was handled by Batavia Police Officer Felicia DeGroot.

Phillip D. Byford Jr., 29, of South Platt Street, Albion, is charged with two counts of petit larceny on the same day at the same store. He was first arrested at 8:01 a.m. on Jan. 24 after being accused of stealing beer and food from the Speedway convenience store at 204 W. Main St. in Batavia. The arrest was made by Batavia Police Officer Miah Stevens, assisted by Officer Jordan McGinnis. Later, at 10:35 p.m., a witness allegedly saw him stealing beer at the Speedway and reported it. He was arrested again at 11:05 p.m. The evening arrest was made by Batavia Police Officer Adam Tucker, assisted by Officer Wesley Rissinger. In each incident he was released with an appearance ticket to be in Batavia City Court on Feb. 4.

Robert C. Strollo, 59, of East Main Street, Batavia, is charged with petit larceny. He was arrested at 9:55 a.m. on Jan. 26 following the investigation of a larceny that occurred at the Family Dollar Store at 577 E. Main St. in Batavia. He is accused of stuffing merchandise in his pockets while there at 11:37 a.m. on Jan. 22. He allegedly walked out of the store without paying for the items. Strollo was issued an appearance ticket for Batavia City Court and is due there on Feb. 4. The case was handled by Batavia Police Officer Connor Borchert, assisted by Officer Kevin DeFelice.

Nateeka M. Gibson, 30, of Tracy Avenue, Batavia, is charged with petit larceny. Gibson was arrested after a larceny was reported at the Kwik Fill at 99 Jackson St. in Batavia. This allegedly occurred at 7:40 p.m. on Dec. 20. Gibson is accused of taking property from the convenience store without paying for it. She was issued an appearance ticket and is due in Batavia City Court on Feb. 11. The case was handled by Batavia Police Officer Peter Flanagan.

Save MiLB Task Force issues bipartisan resolution calling for status quo of current league structure

WASHINGTON, D.C. – Today (Jan. 27) representatives Lori Trahan (D-MA), David McKinley (R-WV), Max Rose (D-NY), and Mike Simpson (R-NY), co-chairs of the "Save Minor League Baseball Task Force" -- introduced a bipartisan resolution expressing the sense of Congress that Major League Baseball (MLB) should maintain the current Minor League structure rather than proceed with its plan to eliminate 42 Minor League clubs, including the Batavia-based Muckdogs.

Congresswoman Lori Trahan said: “We launched the Save Minor League Baseball Task Force for a simple purpose -- to help ensure a level playing field in the negotiations between MLB and Minor League Baseball so that they yield a fair resolution and protect Minor League Baseball in communities across the country. Congress has long been a partner to the league in protecting and expanding America’s favorite pastime. We deserve to have our voices heard in any conversation with such potentially devastating consequences. This resolution makes our position clear, and I am grateful to my fellow co-chairs and colleagues for their continued support of this effort."

Congressman David McKinley said: “Minor League Baseball teams have had a major impact on small communities. These teams provide an enormous cultural and economic benefit to the communities they call home. The goal of our involvement in this fight is to ensure a level playing field in the negotiations between Major League Baseball (MLB) and MiLB. Doing away with 42 teams is not a reasonable solution. We are hopeful that MiLB and MLB can find acompromise that will preserve the 42 MiLB teams and address MLB’s concerns.”

Congressman Max Rose said: “The value that Minor League Baseball adds to our communities goes so far beyond entertainment. Teams like the Staten Island Yankees offer youth clinics for our kids, donate to local schools and charities, and volunteer countless hours to help those in need. This resolution sends a clear message that we recognize those contributions, and that I’m going to do everything in my power to protect the Staten Island Yankees."

The proposal to cut 42 teams will leave communities like Idaho Falls without affordable and accessible options for families to experience America’s pastime. I am pleased to join my colleagues in introducing this resolution which expresses more than 60 members of Congress opposition towards eliminating the Chukars and other Minor League organizations. I hope Major League Baseball takes the concerns of fans in small-town America seriously when considering the current proposal.”

Congressman Joe Courtney said: “The proposal to eliminate our Norwich Sea Unicorns and 41 other Minor League teams across the country is a profound mistake. Countless baseball fans ofall ages attend MiLB games each season, and for many, It’s their only chance to see our nation’s pastime in a family-friendly, affordable atmosphere. There have been well over half a million statistical errors committed in the MLB since its founding in 1896, but this plan to do away with a quarter of all our Minor League teams ranks among the worst of them – it will cost American communities jobs, and more importantly it will cost us in quality of life. The House is leading the charge to protect our Minor League Baseball teams, and I’m proud to be part of this bipartisan effort. MLB Commissioner Manfred and his team need to take a hard second look at their proposal, and consider what it could mean for the long-term support that Congress hasalways afforded to the MLB on a variety of issues.”

Congress: "Unified Opposition to MLB plan"

On Nov. 19, more than 100 members of Congress joined together on a letter to MLB expressing our unified opposition to the MLB plan. This resolution is a further demonstration that Minor League clubs – and the communities for which they play – are not without support in Congress.

Furthermore, it reflects Congress’s legitimate interest in ensuring fair negotiations between MLB and MiLB.

MLB’s plan was offered in spite of the fact that Minor League Baseball (MiLB) just completed its 15th consecutive season with an attendance above 40 million; and it was the ninth-largest single season total in MiLB’s 100-plus year history.

Many of the Minor League clubs would fail without a PDC—leaving as many as 1,200 players out of work. The plan is a betrayal of the fans, players, municipalities, stadium vendors and employees who have supported these clubs for decades.

RESOLUTION
Supporting Minor League Baseball, and for other purposes.
Whereas 40 million plus fans have attended Minor League Baseball games each season for 15 consecutive years;
Whereas Minor League Baseball provides wholesome affordable entertainment in 160 communities throughout the country;
Whereas, in 2018, Minor League Baseball clubs donated over $45 million in cash and in-kind gifts to their local communities and completed over 15,000 volunteer hours;
Whereas the economic stimulus and development provided by Minor League Baseball clubs extends beyond the cities and towns where it is played, to wide and diverse geographic
areas comprising 80 percent of the population in the Nation;
Whereas Minor League Baseball is committed to promoting diversity and inclusion through its Copa de la Diversión, MiLB Pride, FIELD Program, and Women in Baseball Leadership initiatives;
Whereas Minor League Baseball is the first touchpoint of the national pastime for millions of youth and the only touchpoint for those located in communities far from Major League cities;

Whereas Congress has enacted numerous statutory exemptions and immunities to preserve and sustain a system for Minor League Baseball and its relationship with Major League Baseball;
Whereas abandonment of 42 Minor League Baseball clubs by Major League Baseball would devastate communities, bond purchasers, and other stakeholders that rely on the economic stimulus these clubs provide;

Whereas Minor League Baseball clubs enrich the lives of millions of Americans each year through special economic, social, cultural, and charitable contributions; and
Whereas preservation of Minor League Baseball in 160 communities is in the public interest, as it will continue to provide affordable, family friendly entertainment to those communities:

Now, therefore, be it Resolved,

That the House of Representatives
(1) supports the preservation of Minor League Baseball in 160 American communities; (2) recognizes the unique social, economic, and historic contributions that Minor League Baseball has made to American life and culture; and
(3) encourages continuation of the 117-year foundation of the Minor Leagues in 160 communities through continued affiliations with Major League Baseball.

Celebrate Recovery at Northgate Free Methodist Church meets every Thursday night and you're invited

Are there things in my life that I do that hurt others? Is there something I wish I could live without?

Is it time to crack my denial and admit that I am not in control of my life? Do I have a painful habit or hang-up from which I need to be freed?

If you answered “yes” to any of these questions then Celebrate Recovery may be a place for you.

A wide variety of hurts, hang-ups and habits are represented at Celebrate Recovery. Examples include dependency on alcohol or drugs, pornography, low self-esteem, need to control, depression, anger, co-dependency, fear of rejection, fear of abandonment, perfectionism, broken relationships, and abuse.

Anyone (inside or outside the church) who struggles can benefit from this group. 

Celebrate Recovery is a ministry outreach for anyone who is interested in a Christ-centered recovery program that will enable them to recover from life’s hurts, hang-ups and harmful habits.

This group meets every Thursday throughout the calendar year, even holidays, at Northgate Free Methodist Church (8160 Bank Street Road, Batavia). They meet from 6:30 to 9 p,m. There is no cost to attend Celebrate Recovery and you may join at any time.

Senator Ranzenhofer reminds shoppers of statewide plastic grocery bag ban starting March 1

As a result of last year’s plastic bag ban, Wegmans announced that they would eliminate the use of plastic carry-out grocery bags on Monday (Jan. 27th.) The ban goes into effect statewide on March 1. Paper bags will still be available for a fee.

While reusable shopping bags are already widely used, many residents do not have or do not wish to purchase reusable bags for one reason or another. As such, my office has a limited supply of reusable bags available free of charge.

The debut "Crafting for Critters" bazaar will be held from 10 a.m. to 4 p.m. on Saturday, April 4, at Batavia Downs Gaming & Hotel. All proceeds benefit homeless pets at the Genesee County Animal Shelter.

Admission is free. The event is hosted by Volunteers for Animals.

39th Annual Fashion Show at GCC will be May 2, 'eruption of emotion' through fashion is theme

The Fashion Program students at Genesee Community College announced the 39th Annual Fashion Show will take over the Richard C. Call Arena on Saturday, May 2, at 7 p.m. and no one should miss this "Ebullition" in Fashion!

Earlier in the semester, GCC's Fashion Program student Yuuka Sano unveiled the 39th Annual Fashion Show theme as "Ebullition!" (A sudden violent outburst or display; the act, process, or state of boiling or bubbling up. -- Merriam-Webster Dictionary.)

As the theme dictates, this show will be an eruption of emotion expressed through fashion.

Each scene in the show will be connected through a series of introspective garment selections with specific colors and textures to reflect authentic emotions consistent with the Japanese representation "ki do ai raku" meaning happiness, anger, sadness and joy in English.

With an exciting and powerful theme to guide their selections, the students have already begun to audition scene coordinators, marketing, advertising, sponsorships and scene garments. In the coming months, GCC students will build and coordinate more than a dozen scenes for the fast-paced, professionally produced show.

In addition, the Fashion Show student committees are holding Model Tryouts for all ages in GCC's Batavia Campus Forum on:

  • Tuesday, Feb. 11, from 12:30 to 2 p.m.
  • Wednesday, Feb. 12, from 4 to 7 p.m.
  • Thursday, Feb. 13, from 12:30 to 2 p.m.

Anyone interested in becoming a GCC Fashion Show Model should email Fashion Show Marketing Committee Member Jess Piper at jpiper1@my.genesee.edu to schedule a tryout timeslot.

Taking full advantage of the 24,000 square foot indoor field house in the Richard C. Call Arena, "Ebullition" will accommodate up to 2,000 guests and offer ample parking.

This year's students are planning a fully immersive production, which includes preshow interviews and photo ops featuring the coordinators of each scene, and a post-show party and vendor market. Currently, students are seeking vendors to participate in this portion of the program.

There are industry-exclusive sponsorship opportunities available that include public recognition and promotional value. The Fashion Program at GCC has always been a flagship for the college. The knowledge and experience of the faculty and their dedication to their students has produced quality and professional workplace candidates and well-prepared transfer students since the program's inception more than 40 years ago.

Recently, GCC renewed its articulation agreement with LIM for students in the Fashion Business: Merchandising A.A.S. program. Students who complete the track and degree can seamlessly transfer to LIM to complete their B.B.A. in Fashion Merchandising, Visual Merchandising, Marketing or Management.

In addition, GCC is very excited to announce a new articulation agreement with Cazenovia College. This agreement provides a seamless transfer opportunity for GCC's Fashion Business: Merchandising A.A.S. students to Cazenovia's Fashion Merchandising B.P.S. and for GCC's Fashion Business: Fashion Design A.A.S. students to Cazenovia's Fashion Design B.F.A. degree program.

JCPenney in Batavia donates $1,200 to Liberty Center for Youth

The JCPenney department store in Batavia is dedicated to helping our local youth. It has proudly donated $1,200 to the Liberty Center for Youth located at 114 Liberty St.

They have made this donation to help close the opportunity gap for the youth of our community. The opportunity gap refers to youth who have unequal access to programs, resources and necessities that enable them to be academically successful.

Many factors such as age, race, gender, household income and community wealth can put the underserved youth at greater risk of not graduating high school or getting the formal training they need to secure a good-paying job. That is where the Liberty Center for Youth Comes in. 

The Liberty Center for Youth offers free programing to all youth ages 9-16 in the community. The center is equipped with a technology lab fit with 10 new computers, 10 tablets and a smart board.

The facility is also has a gymnasium, indoor foursquare court and gaming room complete with air hockey, pool and foosball tables. Youth are offered a free snack every day in the cafeteria and tutoring services are also provided free of charge. 

The City of Batavia Youth Bureau and the Genesee County YMCA have entered into a collaborative partnership to deliver Liberty Center for Youth for youth programing. Both organizations have prided themselves on offering free, safe and fun activities to our youth.

JCPenney proudly supports this community and its success. JCPenney would like to thank Lydia Schauf, who is the program coordinator for the City of Batavia Youth Bureau, for making us aware of this need in our community and taking the time to coordinate this donation.

Crash with possible ejection reported on West Main Street Road, East Pembroke

A crash involving two vehicles is reported in front of Jim's Saloon in East Pembroke, 2677 W. Main Street Road. One of the vehicles rolled over and it's possible that a person was ejected.

East Pembroke Fire Department and Mercy medics are responding and mutual aid from Town of Batavia is called for extrication equipment.

Also, Town of Batavia Fire Police are asked to shut down Route 5 at Powers Road and Corfu Fire Police are asked to shut down eastbound Route 5 at Read Road. Alexander's ambulance is called to the scene, too.

UPDATE 8:34 a.m.: A gray sedan and a white minivan collided head on and all were transported to trauma centers with non-life-threatening injuries; at least two of them were taken to Erie County Medical Center. There was only a driver in the minivan. The sedan had three adults in it, including an elderly person. One occupant of the sedan was ejected. Due to the severity of the crash, a member of the county's Crash Management Team was called to the scene.

City resident: Time is now to invest in Falleti Ice Arena; Council perplexed over Ellicott Station situation

Public comments concerning the condition of Falleti Ice Arena on Evans Street, the prospect of the City losing out on Video Lottery Terminal funds generated by Batavia Downs Gaming, and the lack of progress on the Ellicott Station project took center stage at tonight’s Batavia City Council Conference Meeting at City Hall.

“We need to invest in this facility to make the next 40 years as successful as the past 40 years,” said Batavia resident Michael Reich, who said he has been involved with programs at the ice rink for more than 25 years.

Reich mentioned the efforts of Jack Porter and Ronald Setzer in helping to make the rink a reality and bringing “a lot of smiles under that roof.”

“Thousands of families have gone through there … lifelong connections there and (a notable) economic impact,” he said. “But it’s 40 years old and it needs some work.”

He mentioned that the goal of the management company, Firland Management, was to make it “self-financing in the long term” and said there is $300,000 in a reserve fund.

“We’re in a strong position going forward,” he said, adding that he would be willing to be a part of a group or committee to work on a number of necessary improvements. “The time has come to do these things, (to make) incredible investments in our youth. It’s a phenomenal facility. Just help us.”

Council Member Paul Viele, who also is a hockey enthusiast, agreed with Reich.

“What can we do to help the rink? We can put money into Dwyer Stadium, why not the rink?” Viele asked.

Council President Eugene Jankowski suggested forming a group to clean and make minor repairs.

“A lot of things are just cleanup and maintenance things,” he said. “We’re compiling a list. We’ve got a long way to go … but we have some possibilities here.”

Council Member Rose Mary Christian asked how much was in the reserve fund – City Manager Martin Moore said that the amount would be addressed in the budget sessions – and Robert Bialkowski asked if Firland was meeting their obligations, to which Moore replied that Firland has one more year left on its contract.

Batavian John Roach spoke about Gov. Cuomo’s proposal to take the VLT money away from the municipalities, suggesting that the City should look to the Batavia Improvement District or Genesee County Economic Development Center to fund the Batavia Development Corporation if that comes to pass.

“The $70,000 (for the BDC) was supposed to be funded by VLT money,” he said. “If lost … I think the GCEDC could pick it up easily.”

He also questioned why the City gives $4,000 annually to GO ART!, when it used to be $2,500 to conduct the Picnic in the Park on July 4th.

“Let’s take back our $4,000,” he said. “It was never meant to be a permanent subsidy to a private group.”

He also asked Council to consider “getting a little more aggressive to clean up Ellicott Station,” the mixed-use development project that has seen little progress.

On the GO ART! situation, Council Member Patti Pacino said she didn’t have a problem with a $4,000 contribution – “It’s not like giving $24,000" – and noted that GO ART! leadership makes a request for funding every year.

The Ellicott Station state of affairs generated more comments from the Council and management, with Moore informing the board that code enforcement personnel have a “green light” to make sure code issues are addressed.

He said the developer, Savarino Companies of Buffalo, is on “a very short leash” but acknowledged that not much can be done until he finds out whether a New York State Homes and Community Renewal grant of several million dollars is approved (likely to take place in April or May).

Council Member Kathleen Briggs said the community’s patience is wearing thin.

“Put up or shut up,” she said, directing her comments to Savarino. “What is this short leash?”

Understandably, Council members are worried that the project might fall through.

“If he doesn’t get the grant, does he just walk away?” Bialkowski asked.

Moore responded by stating that Savarino said he has $800,000 to $900,000 invested in predevelopment, and is working with the GCEDC and BDC on the funding.

Jankowski said he thought the initial announcement by the BDC (made in 2016) was premature since funding streams had yet to be put into place, but said he remains optimistic.

“If he (Samuel Savarino) does come through, it will be well worth it,” he said.

In another development, Council heard a request from Eric Biscaro, owner of Classic Home Improvements and Armor Building Supply at 653 Ellicott St., to construct an auto service station on his property.

Currently, the location is zone I-1 (Industrial) and does not allow the operation of a motor vehicle repair shop. Biscaro went to the Genesee County Planning Board, where his request for a use variance was rejected, and now he's hoping that the City can come up with a way to make this happen.

“We’re looking to put up a small two-bay garage behind the Armor side (of the facility),” he said. “You won’t even be able to see it from the street.”

Public Works Director Matt Worth suggested that City officials conduct an internal review of the proposal to see if a zoning change is in order – “We’ve done a couple zone changes in the not-too-distant past,” he said – and report back to Council before its next meeting.

Because a zoning modification may be the only route, it would take several months since it means adopting a Local Law, which requires a public hearing. Any zoning change would affect all I-1 zones and expand the scope beyond a singular project.

Viele, speaking in elevated tones, expressed his disdain for the process.

“We should be able to help the guy out … why drag our feet,” he said. “It’s baloney.”

After a short discussion, Council agreed to let City staff conduct the review and report back before the next meeting. As it stands now, all service stations in the City are in areas that are zoned Commercial.

In other action, Council approved moving the following resolutions to be voted upon at its next Business meeting on Feb. 10:

-- Adoption of the Genesee County 2019 Hazard Mitigation Plan to serve as the City’s Hazard Mitigation Plan, a measure that would permit the City to receive federal pre-disaster mitigation funds.

“This allows us to piggyback (on Genesee County) and garner more funding with more people in the mix – in the event that monies become available,” Fire Chief Stefano Napolitano reported. “It gives us greater buying power by working with the county and other municipalities.”

Napolitano said the county’s Hazard Mitigation Plan has been reviewed and approved by the State Emergency Management Office and by the Federal Emergency Management Agency, and was adopted by the Genesee County Legislature in October.

-- Acceptance of a $25,481 STOP-DWI grant from Genesee County to be used throughout the year and a $22,500 with a professional services firm (to be announced) to facilitate the acceptance of a $300,000 New York Main Street grant as a match for private investments to undertake proposed building improvements within the Batavia Business Improvement District.

-- Sale of a 12- by 50-foot parcel of property next to Eli Fish Brewing Co. in Jackson Square for the company to expand their offerings to include outdoor dining. Matt Gray represented AGRV Properties Inc. at the meeting. The parcel has been appraised for $840, which is the price offered to the City by AGRV Properties.

-- Appointments of Lois Gerace to the Board of Assessment Review and Council Member Rose Mary Christian as marriage officer to have the authority to perform wedding ceremonies.

-- Tentative public hearing on the 2020-21 budget, including water rates, sewer rates and capital improvement fee, for 7 p.m. Feb. 24. The amount to be raised by taxes is $5.4 million, resulting in an increase in the property tax rate of less than 1 percent.
